Written by one of the pre-eminent interpreters of Heidegger, this book is an important statement about the basis of human sociability that is a major contribution to the continuing debates about Heidegger in particular, and ethics in general. Existential philosophy is often thought to promote moral nihilism in which everything is permitted. This book demonstrates that, in the case of Martin Heidegger, any such accusation is unjust. On the contrary, Heidegger thought seriously about the implications of human co-existence, and this (...) book shows that conceptions of trust and responsibility that lie at the very heart of morality are to be found in the sketch of Mitsein - our being together with one another in the world - offered in Being and Time. That Heidegger never developed these conceptions may explain why they have been overlooked, but renders them no less important for that. (shrink)

The problem of 'no fault' compensation for patients who suffer adverse effects as a result of their participation in clinical trials is discussed in the light of the guidelines issued by the Association of the British Pharmaceutical Industry (ABPI) and our recent experiences in reviewing protocols submitted to the local ethics of surgical research sub-committee. We have found a variety of qualifications being applied by pharmaceutical firms which are not in the spirit of the guidelines, let alone the interests of (...) the patient, and we suggest a means whereby the patients can be assured of fair treatment in the event of 'no fault' injury. In his introduction Professor Edwards remarks that he does not believe that the work will be condemned "as either dull or timid", whatever else may be said about it. And, in the main, he is right in this belief. It is hardly feasible of course to maintain a uniform policy of scintillating provocativeness when one is summarizing the ideas of some rather obscure thinkers or dealing with some highly technical matter. But on controversial issues articles are often lively and make (...) no pretense of Olympian detachment. Some articles, even though useful, may be a bit flat. But the work as a whole certainly does not give this impression. (shrink)

This paper considers the debate over how we attribute beliefs, desires, and other mental states to our fellows. Do we employ a theory of mind? Or do we use simulational brain mechanisms, but employ no theory? One point of dispute between these theories focuses upon our ability to have empathic knowledge of the mind of another. I consider whether an argument posed by Ravenscroft settles the debate in favor of Simulation Theory. I suggest that the consideration of empathy does not (...) settle the dispute. Then I look at recent results from false memory research and other research employing neural imaging. I suggest that new discoveries there may help shape the future of the empirical dimension of the debate. (shrink)

Theological stateist theories, the most well-known of which is Divine Command Theory (DCT), ground our moral obligations directly in some state of God. The prior obligations objection poses a challenge to theological stateism. Is there a moral obligation to obey God’s commands? If no, it is hard to see how God’s commands can generate any moral obligations for us. If yes, then what grounds this prior obligation? To avoid circularity, the moral obligation must be grounded independent of God’s commands; and (...) therefore DCT fails to ground all moral obligations in God’s commands. I argue that DCT proponents should embrace “metaethical DCT.” On this view, there is no moral obligation to obey God. God creates our moral obligations out of normative nothingness. I argue that this helps DCT proponents to escape the prior obligations objection. Other theological stateist theories can modify their theory similarly to meet this objection. (shrink)

Wright's _Truth and Objectivity_ seeks to systematise a variety of anti-realist positions. I argue that many objections to the system are avoided by transposing its talk of truth into talk of warrant. However, a problem remains about debates involving 'direction-of-fit'. -/- Dummett introduced 'anti-realism' as a philosophical view informed by mathematical intuitionism. Subsequently, the term has been associated with many debates, ancient and modern. _Truth and Objectivity_ proposes that truth admits of different characteristics; these various debates then concern which characteristics (...) truth has, in a given area. This pluralism of truth is at odds with deflationism. I find fault with Wright's argument against deflationism. However, transmission of warrant across the Disquotational Schema suffices to ground Wright's proposal, which survives as a pluralism of classes of warrant. -/- The two main debates concern whether truths are always knowable (Epistemic Constraint) and whether disagreements in an area must be down to some fault of one of those involved (Cognitive Command). I introduce Assertoric Constraint, relating to Epistemic Constraint, where truths cannot outstrip the availability of warrant for their assertion. I solve a structural problem by a comparison with a constitutive analysis of Moore's Paradox. The relativism of blameless disagreement is problematic. Wright's response invokes a sort of ignorance which he calls `Quandary'. I criticise this before proposing an alternative. -/- I agree with Wright that Dummett's original anti-realism does not belong among the positions which Wright seeks to systematise. However, two candidates show that the proposal suffers a weakness. Wright thinks Expressivism misguided, and implicitly rules out his earlier non-cognitivism about necessity. I argue that Expressivism has promise, and I endorse Wright's Cautious Man argument for non-cognitivism about necessity; both involve play with `direction-of-fit'. I conclude that this sort of anti-realist debate needs to be accommodated by the proposal. (shrink)

Writing under the pseudonym "Jotabeche," José Joaquín Vallejo wrote forty-one short articles on Chilean life and society in the early republic. Known for their caustic wit, his writings were an instant success when they were first published in Chilean magazines and newspapers. This volume presents these vivid essays for the first time in English. Vallejo made famous the style of writing termed "costumbrista"—sketches and vignettes of society and local customs. He focused on the Norte Chico, or the mining zone of (...) Copiapó where he was born and where he lived most of his later life. His essays include vivid studies of mineworkers; the advancement of modernity in the steamships at Caldera; the religious, intensely cultural province of Copiapó; and the general atmosphere of liberalism beginning to pervade the country of Chile during that time. Considered the founder of his country's "genuinely national literature," he is the first creative writer of stature to emerge in Chile after the country's wars of independence. A provincial northerner, his writings give a sense of what these parts of Chile looked and felt like during the years of the early Chilean republic, and are consequently of ultimate value. (shrink)

The UK School Curriculum and Assessment Authority proposes a set of values to which everyone can subscribe, which can provide schools with a secure basis for the provision of spiritual, moral, social and cultural education. The proposal is misguided. The code would be determined by political negotiation, which would bring the whole idea of moral education into disrepute, and it would be an impediment to moral advancement, which requires trial and error experimentation. Imposing a code on all state schools would (...) be political indoctrination; and in a pluralistic society any non-vacuous statement of values will meet with objections from some sections of society. Further, the proposed statement of values is open to objections on moral and other grounds. The aims of the proposal would be best met by privatising schools. Given vested-interest opposition to privatisation, the most realistic option is to alter the Local Management of Schools regime to allow schools to innovate in moral teaching and training, to strengthening parental choice, and to increase competition between schools. Dans cet article, je tente de remettre en question la position minimaliste défendue par deux auteurs, James Nickel et James Griffin, en défendant une thèse selon laquelle la philosophie et la morale ne devraient pas être limitées par la pratique et les circonstances du monde. Sans apporter une réponse précise à la question de (...) la faisabilité des droits de l'homme tels qu'on les connaît, je soutiens que le minimalisme défendu par Griffin et Nickel n'est pas nécessaire, ni souhaitable, dans la lutte pour la défense des droits de l'homme, lutte dans laquelle la philosophie a un rôle de premier ordre à jouer.
