Techniques from artificial intelligence (AI) can be used in forensic evidence evaluation and are currently applied in biometric fields. However, it is generally not possible to fully understand how and why these algorithms reach their conclusions. Whether and how we should include such ‘black box’ algorithms in this crucial part of the criminal law system is an open question that has not only scientific but also ethical, legal, and philosophical angles. Ideally, the question should be debated by people with (...) diverse backgrounds. Here, we present a view on the question from the philosophy of science angle: computational reliabilism (CR). CR posits that we are justified in believing the output of an AI system, if we have grounds for believing its reliability. Under CR, these grounds are classified into ‘reliability indicators’ of three types: technical, scientific, and societal. This framework enables debates on the suitability of AI methods for forensic evidence evaluation that take a wider view than explainability and validation. We argue that we are justified in believing the AI’s output for forensic comparison of voices and forensic comparison of faces. Technical indicators include the validation of the AI algorithm in itself, validation of its application in the forensic setting, and case-based validation. Scientific indicators include the simple notion that we know faces and voices contain identifying information along with operationalizing well-established metrics and forensic practices. Societal indicators are the emerging scientific consensus on the use of these methods, as well as their application and interpretation by well-educated and certified practitioners. We expect expert witnesses to rely more on technical indicators to be justified in believing AIsystems, and triers-of-fact to rely more on societal indicators to believe the expert witness supported by the AIsystem. Automatic identification system is a vessel tracking system, which since 2004 has become a global tool for the detection and analysis of seagoing traffic. In this article, we look at how this technology, initially designed as a collision avoidance system, has recently become involved in debates concerning migration across the Mediterranean Sea. In particular, after having briefly discussed its emergence and characteristics, we examine how through different practices of appropriation AIS, and the data it generate, have been seized upon, both (...) to contest and to sustain the exclusionary nature of borders, and the mass dying of migrants at sea to which it leads. We do so by referring to forms of data activism we have contributed to in the frame of our Forensic Oceanography project as well as to situations in which AIS has been mobilized by xenophobic groups to demand even stronger exclusionary measures. At the same time, we point to the multiplicity of actors who participate in the politics of migration through AIS in unexpected ways. We conclude by highlighting the irreducible ambivalence of practices of appropriation and call for persistent attention to one’s own positioning within the global datascape constituted by AIS and other data. The widespread tendency, even within AI, to anthropomorphize machines makes it easier to convince us of their intelligence. How can any putative demonstration of intelligence in machines be trusted if the AI researcher readily succumbs to make-believe? This is (what I shall call) the forensic problem of anthropomorphism. I argue that the Turing test provides a solution. This paper illustrates the phenomenon of misplaced anthropomorphism and presents a new perspective on Turingʼs imitation game. In this paper, a case study is conducted to test the capability of the Carneades Argumentation System to model the argumentation in a case where forensic evidence was collected in an investigation triggered by a conflict among art experts on the attribution of a painting to Leonardo da Vinci. A claim that a portrait of a young woman in a Renaissance dress could be attributed to da Vinci was initially dismissed by art experts. Forensic investigations were carried out, (...) and evidence was collected by art history experts and scientific experts. The expert opinions were initially in conflict, but new evidence shifted the burden of proof onto the side of the skeptics. In the history of crime, a dialectics takes place between felonious attempts at concealing, disguising, or forging identities and societal efforts at unmasking the impostures. Semiotics offers specialistic skills at studying the signs of societal detection and identification, including those of forensics and criminology. In human history, no sign more than the face is attached a value of personal identity. Yet, modern forensics realizes that the (...) face can mislead and, inspired by eastern models, adopts fingerprinting. In the digital era, however, fingerprinting first goes digital, then it is increasingly replaced by facial recognition. Today, open source intelligence (OSINT), i.e., information derived from publicly available sources, makes up between 80 and 90 percent of all intelligence activities carried out by Law Enforcement Agencies (LEAs) and intelligence services in the West. Developments in data mining, machine learning, visual forensics and, most importantly, the growing computing power available for commercial use, have enabled OSINT practitioners to speed up, and sometimes even automate, intelligence collection and analysis, obtaining more accurate results more quickly. As the infosphere expands to (...) accommodate ever-increasing online presence, so does the pool of actionable OSINT. These developments raise important concerns in terms of governance, ethical, legal, and social implications (GELSI). New and crucial oversight concerns emerge alongside standard privacy concerns, as some of the more advanced data analysis tools require little to no supervision. This article offers a systematic review of the relevant literature. It analyzes 571 publications to assess the current state of the literature on the use of AI-powered OSINT (and the development of OSINT software) as it relates to the GELSI framework, highlighting potential gaps and suggesting new research directions. Agenda Relevance is the first volume in the authors' omnibus investigation of the logic of practical reasoning, under the collective title, A Practical Logic of Cognitive Systems. In this highly original approach, practical reasoning is identified as reasoning performed with comparatively few cognitive assets, including resources such as information, time and computational capacity. Unlike what is proposed in optimization models of human cognition, a practical reasoner lacks perfect information, boundless time and unconstrained access to computational complexity. The practical reasoner is (...) therefore obliged to be a cognitive economizer and to achieve his cognitive ends with considerable efficiency. Accordingly, the practical reasoner avails himself of various scarce-resource compensation strategies. He also possesses neurocognitive traits that abet him in his reasoning tasks. Prominent among these is the practical agent's striking (though not perfect) adeptness at evading irrelevant information and staying on task. On the approach taken here, irrelevancies are impediments to the attainment of cognitive ends. Thus, in its most basic sense, relevant information is cognitively helpful information. Information can then be said to be relevant for a practical reasoner to the extent that it advances or closes some cognitive agenda of his. The book explores this idea with a conceptual detail and nuance not seen the standard semantic, probabilistic and pragmatic approaches to relevance; but wherever possible, the authors seek to integrate alternative conceptions rather than reject them outright. A further attraction of the agenda-relevance approach is the extent to which its principal conceptual findings lend themselves to technically sophisticated re-expression in formal models that marshal the resources of time and action logics and label led deductive systems. This book provides an overview of computer techniques and tools — especially from artificial intelligence (AI) — for handling legal evidence, police intelligence, crime analysis or detection, and forensic testing, with a sustained discussion of methods for the modelling of reasoning and forming an opinion about the evidence, methods for the modelling of argumentation, and computational approaches to dealing with legal, or any, narratives. By the 2000s, the modelling of reasoning on legal evidence has emerged as a significant area (...) within the well-established field of AI & Law. An overview such as this one has never been attempted before. It offers a panoramic view of topics, techniques and tools. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. Computer scientists must not blunder into design choices resulting in tools objectionable for legal professionals, so it is important to be aware of ongoing controversies. A survey is provided of argumentation tools or methods for reasoning about the evidence. Another class of tools considered here is intended to assist in organisational aspects of managing of the evidence. Moreover, tools appropriate for crime detection, intelligence, and investigation include tools based on link analysis and data mining. Concepts and techniques are introduced, along with case studies. Information of high evidentiary quality plays a crucial role in forensic investigations. Research shows that information provided by witnesses and victims often provide major leads to an inquiry. As such, statements should be obtained in the shortest possible time following an incident. However, this is not achieved in many incidents due to demands on resources. This intersectional study examined the effectiveness of a chatbot (the AICI), that uses artificial intelligence (AI) and a cognitive interview (CI) to help record statements (...) following an incident. After viewing a sexual harassment video, the present study tested recall accuracy in participants using AICI compared to other tools (i.e., Free Recall, CI Questionnaire, and CI Basic Chatbot). Measuring correct items (including descriptive items) and incorrect items (errors and confabulations), it was found that the AI CI elicited more accurate information than the other tools. The implications on society include AI CI provides an alternative means of effectively and efficiently recording high-quality evidential statements from victims and witnesses. (shrink)

In designing the Handbook of the History of Logic, the Editors have taken the view that the history of logic holds more than an antiquarian interest, and that a knowledge of logic's rich and sophisticated development is, in various respects, relevant to the research programmes of the present day. Ancient logic is no exception. The present volume attests to the distant origins of some of modern logic's most important features, such as can be found in the claim by the authors of the chapter on Aristotle's early logic that, from its infancy, the theory of the syllogism is an example of an intuitionistic, non-monotonic, relevantly paraconsistent logic. Similarly, in addition to its comparative earliness, what is striking about the best of the Megarian and Stoic traditions is their sophistication and originality. Logic is an indispensably important pivot of the Western intellectual tradition. But before we start to think of ourselves as ethereal entities for whom body parts are merely resources, Simon Cole presents us with an intriguing history of how we came to equate ourselves with our bodies. Suspect Identities offers clear style, (...) innovative materials, solid research, and instructive analysis. The result is a rich but accessible book that should become an important text for everybody interested in science and society and in the histories of biological thinking and criminal identification.In the first part of his book Cole follows the late‐nineteenth‐century search for reliable physical indicators of social tendencies, potential criminality in particular. This hope, we know, did not materialize. Criminal potentiality could not be read directly from the body. What could be read from the body, however, was the identity of its owner. That may have disappointed the anthropologists and the criminologists, who believed that behavior has biological roots, but it certainly pleased the bureaucrats. Thus, by the end of the nineteenth century, two technologies, anthropometry and fingerprinting, were already used by the growing arms of the state to identify criminals and link them to their history, stored within the burgeoning paper memory of the state.Anthropometry and fingerprinting were developed in different contexts. Anthropometry emerged in the cities of Europe. Fingerprinting developed on the imperial frontiers. Anthropometry, with its careful protocol and exact quantitative measurements of the human bones, enjoyed more scientific credibility. Nevertheless, it was the visual technique of fingerprinting that won the day. The choice, Cole argues, was more than a mere technical decision in favor of a better technique. It was a preference for industrial‐style speed and economy over scientific accuracy and precision. Mechanical in nature, fingerprinting transferred bodily inscriptions of the undifferentiated colonial masses into colonial records with relative ease and effectiveness, and it did not take it long to migrate from the imperial frontiers to the rapidly growing and increasingly anonymous urban centers of Europe and America.In the middle section of the book Cole follows the twentieth‐century brilliant career of fingerprinting, mainly in America. Starting as a record‐keeping technology, a way of identifying criminals and linking them to their past, fingerprinting soon developed into a formidable forensic technique that linked suspects to the scenes of their crimes. What intrigues Cole the most is the wholesale acceptance of fingerprint evidence, even though it always lacked an easily articulated scientific foundation. Fingerprinting, Cole points out, was never subjected to the careful scrutiny that is supposed to be inflicted on scientific and legal facts, and fingerprint experts were allowed remarkable leeway by the courts, testifying with almost complete immunity from attacks. Cole's search for an explanation of this peculiar arrangement produces some fascinating insights concerning the mutually constitutive relations between science and the state and the ways in which certain technologies gain credibility and become as common as flying in the air.In the final part of the book Cole brings his history to bear on our present genetic age. Diagnosing criminals and diagnosing criminality were never clearly distinct. Thus, as Cole points out, every new criminal identification technique—photography, anthropometry, fingerprinting—has stimulated biological theories of criminality. The same happens now with DNA typing, the latest in this long line of technologies. A large number of people expect molecular biology, the science behind DNA typing, to allow us to explain human nature. The history of criminal identification, Cole argues, should teach us to heed the difference between a biological marker and a code and make us skeptical about the likelihood that biological information, genetic or otherwise, will ever provide a full explanation of social behavior. In some languages every statement must contain a specification of the type of evidence on which it is based: for example, whether the speaker saw it, or heard it, or inferred it from indirect evidence, or learnt it from someone else. This grammatical reference to information source is called 'evidentiality', and is one of the least described grammatical categories. Evidentiality systems differ in how complex they are: some distinguish just two terms (eyewitness and noneyewitness, or reported and everything else), while (...) others have six or even more terms. Evidentiality is a category in its own right, and not a subcategory of epistemic or some other modality, nor of tense-aspect. Every language has some way of referring to the source of information, but not every language has grammatical evidentiality. In English expressions such as I guess, they say, I hear that, the alleged are not obligatory and do not constitute a grammatical system. Similar expressions in other languages may provide historical sources for evidentials. True evidentials, by contrast, form a grammatical system. In the North Arawak language Tariana an expression such as "the dog bit the man" must be augmented by a grammatical suffix indicating whether the event was seen, or heard, or assumed, or reported. This book provides the first exhaustive cross-linguistic typological study of how languages deal with the marking of information source. Examples are drawn from over 500 languages from all over the world, several of them based on the author's original fieldwork. Professor Aikhenvald also considers the role evidentiality plays in human cognition, and the ways in which evidentiality influences human perception of the world.. This paper establishes several algebraic embedding theorems, each of which asserts that a certain kind of residuated structure can be embedded into a richer one. In almost all cases, the original structure has a compatible involution, which must be preserved by the embedding. The results, in conjunction with previous findings, yield separative axiomatizations of the deducibility relations of various substructural formal systems having double negation and contraposition axioms. Objective: This study aimed to explore the relationship among cognitive fusion, experiential avoidance, and obsessive–compulsive symptoms in patients with obsessive–compulsive disorder.Methods: A total of 118 outpatient and inpatient patients with OCD and 109 healthy participants, gender- and age-matched, were selected using cognitive fusion questionnaire, acceptance and action questionnaire−2nd edition, Yale–Brown scale for obsessive–compulsive symptoms, Hamilton anxiety scale, and Hamilton depression scale for questionnaire testing and data analysis.Results: The levels of cognitive fusion and experiential avoidance in the OCD group were significantly (...) higher than those in the healthy control group. Regression analysis results showed that, in predicting the total score of obsessive–compulsive symptoms, AAQ-II and CFQ entered the equation, which explained 17.1% variance. In predicting anxiety, only AAQ-II entered the equation, which explained 13% variance. In the prediction of depression, AAQ-II entered the equation, which explained 17.7% variance.Conclusion: Cognitive fusion and experiential avoidance may be important factors for the maintenance of OCD, and experiential avoidance can positively predict the anxiety and depression of OCD patients.
