O alojamento do recluso no estabelecimento prisional deve respeitar a sua dignidade. Os dados oficiais, até dezembro de 2020, revelam sobrelotação em algumas prisões. Analisamos a problemática no foro constitucional, dos direitos de personalidade e do direito penitenciário, recorrendo a fontes legais e doutrinárias. Concluímos que a sobrelotação configura um problema que tem de ser ultrapassado e que existe um claro desfasamento entre a law in the books e a law in action.

We argue, in light of Collapse Model interpretation of quantum theory, that the fundamental division between the quantum and classical behaviors might be analogous to the division of thermodynamic phases. A specific relationship between the collapse parameter $$(\lambda )$$ and the collapse length scale ( $$r_C$$ ) plays the role of the coexistence curve in usual thermodynamic phase diagrams. We further claim that our functional relationship between $$\lambda$$ and $$r_C$$ is strongly supported by the existing International Germanium Experiment (IGEX) collaboration (...) data. A separation between interpretive and post-interpretive processes is central to Caplan & Waters's theory of language comprehension. This commentary raises some issues that are intended to help sharpen the distinction.

The article reflects on the symbolic forms of domination developed in the social environment and the real games of power that they are hidden behind the representations in nowadays. It approaches the relation that the medias has in the representation context, being an instrument of domination for the processes ofconstruction of the important meanings for the structure of a society. The study calls the attention for the problematic theoretician presented for the philosopher Pierre Bourdieu, writing on the agent and society, (...) through the antagonism and exclusion between itself. Others two philosophers worked in the research are Michel Foucault and Jürgen Habermas. Thinking on individuals separately, we have that as the participant ones to be responsible in all the constructionof ethical values, politicians, cultural among others that they guide the collective context. However, we will only get success in this question, if we know how to analyze the “search of the real”. (shrink)

This paper explores Quentin Skinner's historiographical thesis, named linguistic contextualism, as a potential challenge to the dichotomy in contemporary philosophy between the ‘analytical’ and ‘continental’ traditions. This divide, rooted in differing approaches to language and methodology, has led to labeling and categorizing philosophers into these two areas. However, Skinner’s work, drawing on the ideas of R.G. Collingwood, Ludwig Wittgenstein, and John L. Austin, presents a nuanced view that defies easy classification. By emphasizing the importance of historical context and the ways (...) language shapes philosophical inquiry, Skinner’s thesis blurs the boundaries between analytical and continental philosophy. We examine Skinner’s arguments and their implications for the ‘parting of ways’ concept, suggesting that linguistic contextualism challenges the validity of this dichotomy. Ultimately, it argues for the inclusion of linguistic contextualism as a significant alternative within contemporary philosophical discourse, particularly in discussions about metaphilosophy and the limitations of rigid categorizations. Este texto propõe uma discussão sobre o potencial de gêneros e formatos midiáticos tradicionais – a telenovela e o jornalismo – como instrumentos de visibilidade, construção de empatia e revisão das imagens do outro, comunicando experiências de alteridade por meio de histórias de vida que enfatizam silenciamentos e o (não) lugar atribuído a esses sujeitos no espaço público, bem como aspectos de subjetividade e identidade sociocultural. Para isso, orientamo-nos pelos estudos culturais e pela análise do discurso e propomos a leitura (...) crítica de dois conteúdos midiáticos contemporâneos: a produção da jornalista Eliane Brum a respeito de vítimas de contaminação por amianto, e a representação de uma transexual na teledramaturgia de Glória Perez. O USO DOS DIREITOS HUMANOS COMO FUNDAMENTO DE INTERVENÇÃO NA SOBERANIA DOS ESTADOS.

Este artigo pretende evidenciar a relação entre o hedonismo e a educação – sobretudo a educação moral – dentro do pensamento de Mill. Primeiramente, mostrarei que sua noção de felicidade é mais complexa que a de seus predecessores utilitaristas e que seu hedonismo qualitativo concebe os prazeres resultantes das capacidades tipicamente humanas como sendo os melhores prazeres e também os constituintes de modos de vida mais felizes. Na sequência, discutirei duas objeções ao hedonismo de Mill. Na seção seguinte, apresentarei como (...) a educação é necessária para a formação dos juízes competentes, aqueles agentes capazes de julgar quais prazeres são superiores e quais são inferiores. Tratarei brevemente do papel da liberdade neste contexto. Concluirei que, para Mill, as pessoas mais educadas tendem a ser mais felizes e mais aptas a realizar toda espécie de juízos ; de modo que a sociedade tem fortes razões para oferecer a todos os agentes a oportunidade para se desenvolverem e para satisfazerem as condições necessárias para atingirem a felicidade e realizarem tais juízos. The concept of legal pluralism has been used widely in legal scholarship to draw attention to the existence of multiple legal orders. Scholars have relied upon it to avoid the ideology of legal centralism, to counter colonialism, and to highlight the neglect of Indigenous laws. These are ameliorative approaches, which aim to expand the concept of law for particular purposes. But it is not clear that they help to explain what law is and does. In this article, I contrast these (...) normative and critical projects with analytic and descriptive approaches to the concept of law. Descriptive conceptual analysis, using empirical examples to enhance the insights of legal theorists, can better shed light on what is distinctive about law as a social form. The article illustrates this approach with a number of historical and anthropological examples. This leads us, I suggest, to form rather than function, that is, to the quality of legalism. The creation and use of general rules and abstract categories, that is, usefully distinguishes law, as a category that encompasses both state and non-state forms, from the wider class of norms encompassed by the expansive theories of the legal pluralists. 'Community' and 'justice' recur in anthropological, historical, and legal scholarship, yet as concepts they are notoriously slippery. Historians and lawyers look to anthropologists as 'community specialists', but anthropologists often avoid the concept through circumlocution: although much used by historians, legal thinkers, and political philosophers, the term remains strikingly indeterminate and often morally overdetermined. 'Justice', meanwhile, is elusive, alternately invoked as the goal of contemporary political theorizing, and wrapped in obscure philosophical controversy. A conceptual knot emerges in much legal and political (...) thought between law, justice, and community, but theories abound, without any agreement over concepts.The contributors to this volume use empirical case studies to unpick threads of this knot. Local codes from Anglo-Saxon England, north Africa, and medieval Armenia indicate disjunctions between community boundaries and the subjects of local rules and categories; processes of justice from early modern Europe to eastern Tibet suggest new ways of conceptualizing the relationship between law and justice; and practices of exile that recur throughout the world illustrate contingent formulations of community. In the first book in the series, Legalism: Anthropology and History, law was addressed through a focus on local legal categories as conceptual tools. Here this approach is extended to the ideas and ideals of justice and community. Rigorous cross-cultural comparison allows the contributors to avoid normative assumptions, while opening new avenues of inquiry for lawyers, anthropologists, and historians alike. (shrink)

Corporate social responsibility refers to the duty of management to consider and respond to issues beyond the organization’s economic and legal requirements in line with social and environmental values. However, ‘management’ is constituted by real people responsible for routine decisions and formulation and implementation of policies. It can be said therefore that the ethical ideals and beliefs of these individuals – in particular their personal values – play an important role in their decisions. It is contended in this article that (...) the personal values of managers may contribute to the creation and maintenance of ‘CSR cultures’ in their organizations; that is, organizational cultures focused on ensuring environmental and social sustainability. Based on an exploratory study carried out in Brazil in 2008, this article explores the perceptions of five CSR managers in relation to the influence of their personal values on their work. The first part discusses the notion of CSR within the context of Brazilian society, the second provides a brief literature review on the link between values and organizational cultures and the third explores the perceptions of the participating managers, identifying the main thematic patterns that emerged in the study. This article aims to produce a perusal of the archaeological investigation undertaken by Michel Foucault as a diagnostic work of the present. This posture seeks to establish a critique of the dominant anthropological thinking in the French scenario of the nineteen sixties. For this task, we describe the conceptual apparatus forged in the Archeology of Knowledge to follow a double movement of strong Nietzschean presence: at the same time that Foucault makes his critique of the humanisms that permeate the current (...) philosophical thinking, he rehearses another way of thinking, freed from anthropological bonds and from any founding instance. This article revisits the concept of the dividual, taking as a starting point Deleuze’s diagnosis about the relevance that dividual practices have gained with the advent of biotechnology and digital culture. Although we agree with this diagnosis, we highlight the intersections between the dividual and the individual both in Modernity and in the present time. The contemporary dividual is in tension with the modern individual, but not as a substitution, division or duplication of the individual. Rather, we state a complex (...) dividual-individual composition, focusing on biotechnologies, digital culture and financial capitalism. Following a Foucauldian approach, we understand this composition as a result of technologies of power and the result of certain modes of subjectivation. In dialogue with Simondon’s theory of individuation, we suggest that the dividual takes part in a new mode of subjectivation which can be named a ‘dividuation’ in the context of technologically mediated experiences. Disfluencies include editing terms such as uh and um as well as repeats and revisions. Little is known about how disfluencies are processed, and there has been next to no research focused on the way that disfluencies affect structure-building operations during comprehension. We review major findings from both computational linguistics and psycholinguistics, and then we summarize the results of our own work which centers on how the parser behaves when it encounters a disfluency. We describe some new research showing that (...) information associated with misarticulated verbs lingers, and which adds to the large body of data on the critical influence of verb argument structures on sentence comprehension. The paper also presents a model of disfluency processing. The parser uses a Tree Adjoining Grammar to build phrase structure. In this approach, filled and unfilled pauses affect the timing of Substitution operations. Repairs and corrections are handled by a mechanism we term “Overlay,” which allows the parser to overwrite an undesired tree with the appropriate, correct tree. This model of disfluency processing highlights the need for the parser to sometimes coordinate the mechanisms that perform garden-path reanalysis with those that do disfluency repair. The research program as a whole demonstrates that it is possible to study disfluencies systematically and to learn how the parser handles filler material and mistakes. It also showcases the power of Tree Adjoining Grammars, a formalism developed by Aravind Joshi which has yielded results in many different areas of linguistics and cognitive science. (shrink)

Pickering & Garrod's (P&G's) mechanistic theory of dialogue is a major advance for psycholinguistics. But the commitment to representational parity in production and comprehension is problematic. Recent research suggests that speakers frequently produce a structure that listeners find ungrammatical and have trouble understanding. If the grammars of the two systems are different, then the assumption of representational parity must be relaxed.

Este trabalho visa informar aos leitores lusófonos sobre a publicação (em português) de John Stuart Mill, de autoria de Donner e Fumerton. O livro tem cunho introdutório e é dedicado aos tópicos mais importantes da filosofia de Mill. Ele divide-se em duas partes principais, sendo uma sobre o pensamento moral e político de Mill e a outra sobre a sua lógica, epistemologia e metafísica. Saliento as discussões que mais se destacam ao longo de cada parte e, ao final, apresento considerações (...) acerca dos pontos negativos e positivos do livro. Concluo que trata-se de uma leitura recomendável para os interessados na filosofia de Mill, sobretudo, para os iniciantes em seus estudos sobre ele. (shrink)

Nem sempre é claro o método que os juízes utilizam para interpretar a lei aplicável aos casos a serem julgados. Vários filósofos do direito argumentam que se deve investigar a intenção do legislador para alcançar um julgamento adequado. Por outro lado, autores dentre os quais se inclui Ronald Dworkin explicam como esse método de interpretação não é útil e nem deve ser considerado correto. Este ensaio enfoca especialmente no pensamento de Ronald Dworkin e em suas explicações sobre o assunto.

In his 1965 work on Freud, Paul Ricoeur states and reasons that the hermeneutic field, as a space of interpretations, is constitutively fragmented and is, at the same time, a structure for hosting different interpretations formed in language, as a place where different human perspectives on the nature of reality converge. This justification emerges from epistemological and ontological conditions.

Residências Integradas Multiprofissionais em Saúde são programas de pós-graduação caracterizados por ensino em serviço. A ULBRA oferece o programa com ênfase em Saúde do Adulto e do Idoso e Saúde Comunitária. Objetiva-se descrever as atividades realizadas em ambiente hospitalar por enfermeiras. Trata-se de um relato de experiência de enfermeiras residentes em relação ao primeiro ano de formação especializada. O primeiro ano de residência abrangeu atividades em unidades de internação, centro cirúrgico e unidade de tratamento intensivo. Diversas foram as atividades desenvolvidas (...) pelas residentes, abrangendo aperfeiçoamento técnico, produção de conhecimento científico e atuação em gestão e gerenciamento. A presença de tutores e preceptores é fundamental no sentido de discutir, orientar e facilitar a inserção e o desenvolvimento profissional do residente. O programa de residência permitiu aperfeiçoar habilidades nos três campos de atuação da categoria: assistência, gerenciamento e pesquisa. (shrink)

The coronavirus disease 2019 pandemic is altering dynamics in academia, and people juggling remote work and domestic demands – including childcare – have felt impacts on their productivity. Female authors have faced a decrease in paper submission rates since the beginning of the pandemic period. The reasons for this decline in women’s productivity need to be further investigated. Here, we analyzed the influence of gender, parenthood and race on academic productivity during the pandemic period based on a survey answered by (...) 3,345 Brazilian academics from various knowledge areas and research institutions. Productivity was assessed by the ability to submit papers as planned and to meet deadlines during the initial period of social isolation in Brazil. The findings revealed that male academics – especially those without children – are the least affected group, whereas Black women and mothers are the most impacted groups. These impacts are likely a consequence of the well-known unequal division of domestic labor between men and women, which has been exacerbated during the pandemic. Additionally, our results highlight that racism strongly persists in academia, especially against Black women. The pandemic will have long-term effects on the career progression of the most affected groups. The results presented here are crucial for the development of actions and policies that aim to avoid further deepening the gender gap in academia. (shrink)

El artículo intenta explorar el poemario Álbum de Valparaíso de Elvira Hernández, a partir de la confluencia de las propuestas de sujeto “náufrago” y “testigo imposible”. El objetivo de esto, es proponer una descentralización del texto señalado, debido a que se posicionaría como una producción poética tránsfuga que sobrepasa las clasificaciones “generacionales” de los años 90 del siglo XX y del 2000. Por otra parte, el concepto de heterotopía planteado por Foucault, nos ayudará a reconocer y problematizar el espacio liminal (...) que se construye en el poemario y desde cual se produce la enunciación del sujeto poético. Para Jean-Luc Marion, el pensamiento tomasiano no se deja encerrar en los parámetros de la metafísica onto-teo-lógica, tal como es definida por Martin Heidegger. Esto implica, respecto de Dios, que, si ya no ha de ser llamado “_ente supremo_”, pues para Tomás Dios se revela como el “_Ser mismo_”, carente de esencia, éste se caracteriza por su absoluta incognoscibilidad. Para sustentar esta interpretación, Marion recurre a una serie de tesis que entiende se desprenden de la consideración de algunos textos del (...) Aquinate. En el presente trabajo se analizan algunas de estas tesis en función de dichos textos, y se propone una lectura alternativa a la del autor. Se intenta mostrar particularmente que, a los ojos de Tomás, sí es posible atribuir la noción de “esencia” a Dios, y también, alcanzar un conocimiento verdadero, aunque imperfecto y limitado de la realidad divina, a partir de la predicación positiva de ciertas perfecciones absolutas que se encuentran en las creaturas. In the so-called “Spin-Echo Experiments” the behaviour of a spin’s system seems to violate the second law of thermodynamics. For this reason the “Spin-Echo Experiments” are considered of particular interest for the Foundations of Physics. Interventionists have provided a classical explanation (Blatt 1959; Ridderbos & Redhead 1998) and a quantum-based explanation (Hemmo & Shenker 2005) of these experiments. Here both interventionist explanations are assessed by means of the Manipulability Theory of Causal Explanation (Woodward 2003). It is argued that interventionism would (...) gain explanatory depth by providing functional relations and predicting relaxation times. En los llamados “experimentos espín-eco” el comportamiento del sistema de espines parece violar la segunda ley de la termodinámica. Por esta razón, los “experimentos espín-eco” son considerados de gran interés en Fundamentos de la Física. Los intervencionistas han ofrecido explicaciones clásicas (Blatt 1959; Ridderbos & Redhead 1998) y explicaciones basadas en mecánica cuántica (Hemmo & Shenker 2005) de dichos experimentos. Aquí ambas explicaciones intervencionistas son analizadas mediante la Teoría Manipulabilista de las Explicaciones Causales (Woodward 2003). Se argumenta que el intervencionismo ganaría profundidad explicativa si proporcionara relaciones funcionales y realizara predicciones de los tiempos de relajación. (shrink)

When we think of Sartre's proposal for a theory of alterity in Being and Nothingness, our attention often turns to his famous and original analysis of “the look of the other”. The moment when Sartre presents this analysis in his work is characterised by the author's effort to escape from the problem of solipsism, and the development of a “phenomenology of the look” is presented as a decisive response to the problem. However, Sartre's critics have shown how problematic this response (...) is, insofar as it favours the “being-seeing” - a dimension acquired through a metamorphosis that the look of the other is capable of provoking in the subject - as what would guarantee an effective relationship of otherness. In this work, I try to return to these criticisms in order to highlight their limits, and then change the focus, bringing to the fore the "backstage" of the look that directs us towards a way out of solipsism. Em sua obra magna, O mundo como vontade e representação, Arthur Schopenhauer entende a sua filosofia como um sistema orgânico e afirma que o mundo é vontade e aparece como representação, ou seja, tudo é vontade e, por conseguinte, manifestação da vontade. De modo especial, o autor define uma das formas mais penetrantes da vontade, assim chamada de Vontade de vida, entendida como uma força obscura e cega; um impulso terrível e dramático, que move os indivíduos de forma dolorosa e (...) brutal. Este desejo extremamente rude e irrefletido é condicionado pelo instinto de conservação. Um dos problemas a ser ressaltado é de que existe uma condição existencial relacionada a vida humana que é o sofrimento humano e a espécie humana seria a mais suscetível ao sofrimento. A vida é um perpétuo combate e cada indivíduo é apenas um instrumento da vontade que luta para impor o que parece necessário, já que todo o querer nasce de uma necessidade. Em todos os graus de objetivação da vontade, existe necessariamente uma luta contínua entre os indivíduos de todas as espécies. O ponto de partida de toda luta está no egoísmo, representado na figura de Éris. Em virtude de a essência íntima da natureza, a Vontade de vida, ter como expressão máxima o impulso sexual. Os poetas e filósofos antigos, dentre eles Hesíodo, Parmênides, Péricles, Aristóteles, afirmaram que Eros seria o primeiro, o criador, o princípio do qual provêm todas as coisas. A natureza, cuja essência íntima é a Vontade de vida, compele com todas as forças o homem e o animal para a propagação da espécie. Tal vontade de vida, preocupa-se exclusivamente com a conservação da espécie e, neste caso, o indivíduo pode ser considerado em vão. (shrink)
