This chapter analyzes European social policy as a test case to comment on both the originality and the weakness of a unique supranational legal order, such as the one created in 1957 with the Treaty of Rome. Regulatory measures in social policy, related to equal treatment, nondiscrimination, and working conditions were implemented via hard law measures aiming at the harmonization of standards. The chapter also looks at the latest innovations in social policy brought about by the Lisbon Treaty. Article (...) 3 of the Treaty on European Union (TEU) mentions full employment among the objectives to be pursued in a social market economy. The economic and financial crisis has accentuated the problems of supranational coordination versus national initiatives and has given rise to exceptional austerity actions that have departed from the methods provided for in the treaty. Algorithmic technologies and artificial intelligence are centred on data and generate new business models, known as the data-driven economy. In the European Union context, the development of such new business is accompanied by a regulatory and political framework. An important aspect of this regulatory framework regards the legal conditions that enable the data collection, availability, sharing, use and reuse. Within the larger context, this article analyses the development of the European Union regulatory framework governing the availability, (...) sharing and reuse of public sector data, also referred to as Public Sector Information policy. Anchored in the analytical tools provided by Discursive Institutionalism and Critical Data Studies and after studying the evolution of this policy over 25 years, this article argues that economic considerations have been overwhelmingly decisive in the European Union Public Sector Information policy and much less attention has been paid to fundamental rights and democracy issues. It also shows how European Union Public Sector Information policy contributes to the data infrastructure, enabling a thriving data-driven economy. In doing so, this article argues that the possible problematic effects of this new data-driven economy are not only affordances of the technology itself but are also the result of political and regulatory choices. More globally, the article stresses the need for policymakers to inscribe each of the policies and regulations affecting the digital transformation in the framework of fundamental rights and democracy. In this article, we reflect on our personal experience of acting as ‘independent academic experts’ in an European Union policy forum, to reflect on how the EU utilises gender to legitimise certain policy discourses in combating sex trafficking. Starting from our personal experience, we draw on wider feminist research on gender expertise and on Fraser’s new reflexive theory of political injustice, to consider how the EU structures debates in this area to determine ‘who’ is entitled to speak and (...) be heard on this issue. In a context in which sex trafficking policy intersects with a variety of competing agendas on – among other things – law and order, organised crime, immigration, asylum and border security policy, our argument will suggest that the exclusion of critical feminist voices and lack of alternative perspectives permits much scope for continuing inequality and injustice. This paper attempts to explore the underlying nature and terms of Higher Education policy. Higher Education policy cannot be viewed outside the changing conditions of the state especially when the inquiry centres on Europe. In the European context, policy making, in order to be efficient, seems to be conducted on two levels, the supranational and the regional. This change in the structure of Higher Education policy making can be considered as an outcome of globalization and the current market economy. (...) The EU's Higher Education policy may be expected to go beyond the national into the supranational level of cooperation with the launching of new initiatives resulting from the Bologna Process and the European Higher Education Area. These initiatives are reshaping the role and responsibilities of Higher Education Institutes towards society and the market. The problems of the functioning of religion in the countries of the European Union are extremely complex and ambiguous. The EU is primarily political and economic. It is in these areas that active intra-integration processes are observed: introduction of a single currency, single payment system, actual “blurring” of borders between member states, development of the Constitutional Treaty, orientation towards the creation of a common market, a common transport network, harmonization of educational systems, etc.

Executive power in the European Union consists of various bits and pieces that have been cobbled together across a spectrum of institutions, sub‐actors, and policy areas. No fewer than three institutions of the European Union and its predecessors can claim to exercise executive authority within the Union, albeit to varying degrees and with varying emphasis: the Commission, the Council, and the European Council. This chapter provides a brief overview of the three core executive institutions, (...) followed by a discussion on recent executive constructions outside the EU legal framework. It highlights the pressing need for accountability mechanisms on all levels of Union governance. The European Council has gradually reinforced its own role, becoming in effect the most important agenda setter of the larger developments of the European Union, in spite of the Commission's monopoly of legislative initiative. The first part of the paper is mainly descriptive. Starting from a short historical sketch of the European construction process, from the initial Treaty of Rome to the actual Treaty of the European Union, the changing trade-offs between the environmental and the economic domain will be overviewed. We will focus on a pragmatic examination of the texts, in their dynamic historical evolution.The second part is evaluative. Examining the fifth Environmental Action Programme more in detail, we will try (...) to determine for which environmental ethics the E.U. stands, as confronted with the alternative paradigm defended by environmentalists and the Green Group in the European Parliament. Is the environmental issue a unifying or a dividing factor in the contrasting cultural landscape of the Old Continent? I think probably Cortona is an excellent place to ask such a speculative question, because we are not far away from Assisi, where a successful Interfaith Meeting on the Environment was organised by the W.W.F. in 1986. This study focuses on taxonomic and typological methods of innovation policies in the European institutional context. Although many types of policies affect innovation, no universally accepted criteria exist to classify them. As innovation policy in a myriad of thematic areas—systemic model—has become pluralized, this article offers a method for classification. Such policies are grouped and categorized according to biological and neofunctional approaches.

Industrialization laid the foundation for contemporary civilization but also begot environmental problems, which have been building up and remained unsolved to this day. There is widespread belief that, if industrial manufacturing lies at the root of environment degradation through endless spewing of residual waste, trade among nations is to blame for scattering residual waste the world over. Yet paradoxically, it is the very international trade that might be the ground for major remedies thereto. The 20th century witnessed the shift from (...) free trade to fair trade; it is about time to shift from fair trade to clean trade. Nevertheless, such serious problems had barely been dealt with until the post-World War II period. An awareness-raising effort in this line was made by the European Union which, since the early 1970s, has been dealing with environmental and social issues, especially the ones deriving from international trade, in a decisive and responsible manner. Still, EU’s new policy in the field of environment protection has a downside in that it affects trade relations with partners from outside the Union, both developing and developed countries, thereby drawing fierce international reaction. The good part is that EU’s actions will most likely prompt other nations to follow suit. (shrink)

The European Union’s common agricultural policy (CAP), in addition to its primary production and farm income goals, is a large source of funding for environmentally friendly agricultural practices. However, its schemes have variable success and uptake across member states (MS) and regions. This study tries to explain these differences by demonstrating differences between policy levels in the understanding of the relationship between nature and farming. To compare constructs and values of the respective policy communities, their discursive construction as (...) it appears in the main strategic EU and MS agricultural policy documents is analysed. The theoretical framework integrates elements from existing frameworks of CAP and environmental discourse analysis; specific agri-environmental discourses, their elements and interplay, are identified. The six discourses suggested here are ‘Productivism’, ‘Classical neoliberal’, ‘Ecological modernisation’, ‘Administrative’, ‘Multifunctionality’ and ‘Radical green’. The discourse analysis of selected documents reveals that there are indeed differences in how farming and the environment are generally conceptualised at different levels of CAP decision-making. At EU level, farming is primarily understood as a sector whose main task is to produce food (‘Productivism’), and the environment is used as a justification for CAP payments (‘Multifunctionality’). At the national/regional level, Rural Development Programmes reflect different value systems: in England, environmental protection is mainly seen as sound management of natural capital (‘Classical neoliberal’); in Finland, a benefit for producers and conscious consumers (‘Ecological modernisation’); in Croatia, a necessity limiting productivity (‘Productivism’) and imposed by an external authority (‘Administrative’ discourse). This diversity shows that differences can visibly manifest despite the Commission constraining the discursive space, helping to explain the differential implementation and success of environmental measures. Anti-ageing medicines are products intended to extend lifespan and healthspan in humans that have a good potential use in public health policies. In the European Union, their development, production and consumption are dependent on regulatory science performed by the European Medicines Agency and its associated epistemic policies. They impose, among other things, an unfavourable burden of proof, a strict standard of proof and meta-methodological constrictions related to some theoretical issues. This results in a distribution of (...) errors that tends to reduce false positives while increasing false negatives, leading to a set of social consequences that are generally accepted when the focus is placed on conventional medicines. However, when the same epistemic policies are applied to anti-ageing medicines, the distribution of errors is imbalanced, and undesirable outcomes like research discouragement and waiting time extensions appear. Three possible strategies that policymakers could implement to unblock the situation are presented for future reflection: the consideration of ageing as a disease, the application of methodological asymmetry and the use of biomarkers during clinical research. Ukraine is the largest country that is included in European Neighborhood Policy. That is why the European Union should spotlight relations with this eastern partner, especially by foreign policy instruments like association agreement. The focus here is on the EU’s involvement in the Ukrainian crisis in period from Maidan revolution at the end of 2013, which was occasioned by the rejection of the association agreement with the EU by President Viktor Yanukovych, and to the presidential election in (...) 2014. The main issue is to evaluate the EU’s scope to stabilize the political environment in the nearby neighborhood and eliminate threats, which are the results of war between Ukraine and Russia. During the Intergovernmental Conference of1996, the European Union's institutional structure should be adapted, most notably in preparation for the Union's enlargement with the Central and Eastern European countries. «Youth policy» as an independent term is defined in the scientific literature in the 1960s., which in many ways «was associated with the formation of youth as an independent social force and its self-determination in the socio-political space». By the 1970s XX century youth policy in the vast majority of developed countries is transforming an independent direction of national policy. Youth is a complex, multidimensional and rather controversial social phenomenon. Modern youth acts as the most active and mobile social group, (...) which requires special attention from state institutions in need of socialization and adaptation. At the same time, it is youth that is increasingly viewed today as the most important and promising part of society. It is no accident that already in the mid-60s of the XX century, in the practical activities of a number of international institutions, in particular the UN, a specialized area of cooperation began to develop, in the field of education and social support for the young generation. It should be noted that in the world there are more than 1 billion 800 million young people under the age of 25, which emphasizes the importance of effective youth policy by members of the international community. In the post-bipolar period, youth policy has become one of the priority areas of state policy of most developed countries. A striking example in this regard is the activities of the countries of the European Union (EU) and its structures. Europe is making significant efforts to create a single space in which not only common political institutions, but common values for all Europeans should be formed. And in this process, it is youth that acts as the key object on which measures are aimed at the formation of a pan-European identity. In recent years, the European Union has significantly stepped up youth policy. Its mechanisms were developed (open coordination method), special institutions were formed. It seems extremely relevant to analyze the EU’s activities in this direction, to consider concrete steps taken at the European level to consolidate measures in the field of youth policy. Despite the fact that integration processes in Europe continue, nevertheless, a number of problems have already been accumulated there today, the success of the entire European project will depend on the solution of these problems. In many ways, these problems are connected precisely with the young generation of Europeans, to whom the EU leadership has special hopes. As noted in a recent communiqué of the European Commission, “social and human capital of youth is one of the greatest European assets of the future». Among the studies affecting various aspects of working with young people, one can single out works of S.V. Aleshchenko, V.P. Baskov, Yu.R. Vyshnevskyi, Yu.V. Volkov, T.I. Zaslavskaia, I.M. Ylynskyi, E.Sh. Kamaldynova, A.I., Kovalova, O.A. Koriakovtseva, V.T. Lysovskyi, V.A. Lukov, O.A. Rozhnov, B.A. Ruchkin, S.K. Savin, V.I. Chuprov and several other authors. However, the young generation of Europeans faces serious challenges. The growth of unemployment, absenteeism, deprivation, the growth of radicalism, cultural indifference (including religious) – main youth problems that today require urgent solutions. Moreover, in different EU countries, these problems have varying degrees of severity. Continued heterogeneity continues to be a serious obstacle to pan-European unity. It is likely that youth policy may be another very painful issue for the future of the EU. Thus, it seems necessary to analyze the national and supranational levels of youth policy in the European Union in order to identify their degree of coherence, common goal-setting and specific implementation methods. This chapter presents the successive stages to make changes in the Polish development policy after 1989. The national administration reform of 1990 in the Third Commonwealth of Poland restored the local government after 40 years of non-existence during the time of Polish People’s Republic that was a satellite state of the Soviet Union after the Second World War. Another reform took place in 1998 as a part of preparations for the country’s membership in the European Union from (...) 2004. Currently developed strategic documents are suggesting the use of the "polarization and diffusion model of the development." The authors also discuss the regional policy currently implemented in Poland, which was designed in years 2009-2014. The process of creation of new policy includes plans to reform the policy instruments and to update the strategic framework. Conclusions highlight a need for a clearer division of powers between the center and regional governments and the importance of strengthening the financial basis and institutional capacity building. This article aims to make a contribution to the conceptualization of mainstreaming gender equality promoted by the European Union. It starts by exploring the historical periodization of equal opportunities delivery strategies and challenging the compartmentalization of these developments. It suggests that equality policies can better be conceptualized in terms of a `three-legged equality stool', which recognizes the interconnectiveness of three perspectives — the equal treatment perspective, the women's perspective and the gender perspective. The article argues that the (...) gender perspective has been closely associated with strategies for mainstreaming gender equality, but that this association is misleading. As a result mainstreaming has remained a `fuzzy' concept, which in turn has led to many different styles and forms of practical implementation in European member states. (shrink)

The European Union, a pioneer in gender equality policies, is moving from predominantly attending to gender inequality, towards policies that address multiple inequalities. This article argues that there are tendencies at EU level to assume an unquestioned similarity of inequalities, to fail to address the structural level and to fuel the political competition between inequalities. Based upon a comparison of specific sets of inequalities, this article explores where and how structural and political intersectionality might be relevant. (...) It argues that a ‘one size fits all’ approach to addressing multiple discrimination is based on an incorrect assumption of sameness or equivalence of the social categories connected to inequalities and of the mechanisms and processes that constitute them. Focusing on similarities ignores the differentiated character and dynamics of inequalities. It also overlooks the political dimension of equality goals. Moreover, it has become clear that attention to structural mechanisms and to the role of the state and the private sphere in reproducing inequalities is much needed. The final part of the article presents constructive ideas for a more comprehensive way of addressing multiple inequalities. (shrink)

Solidarity is a key concept in the European Union. However, the concept of solidarity lacks systematic theoretical examination to enable a sufficient understanding of its contextual meaning and to provide an operationalisable benchmark for analysis. To address this research gap, I propose an analytical framework for solidarity in the European Union that features four necessary conditions: particularity, instrumentality, reciprocity, and responsibility. I develop the framework through a transdisciplinary conceptual history approach, substantiated with a thorough document and (...) legal analysis of European integration and CJEU case law. I demonstrate the robustness and validity of the proposed framework by using EU asylum policy as a test case, a field where the question of solidarity is notoriously salient, which is exemplified by an area-specific expression of the concept: fair sharing of responsibility between the EU member states. Moreover, I show that the EU’s solidarity principle is necessary to maintain the bloc’s raison d’être. (shrink)

A characteristic feature of the EU's current foreign policy course is its stepping up its policy towards relations with Islamic countries, especially the Middle East and Middle East, and enhancing its role in addressing key issues in the region. To date, the region has been identified in the Council of Europe and European Commission documents as a "key foreign policy priority".

Political theorists aiming to articulate normative standards for the EU have almost entirely focused on whether or not the EU suffers from a ‘democratic deficit'. Almost nothing has been written, by contrast, on one of the central values underpinning European integration since at least the European Coal and Steel Community (ECSC), namely solidarity. What kinds of principles, policies, and ideals should an affirmation of solidarity commit us to? Put another way: what norms of socioeconomic justice ought to (...) apply to the EU? This is not an empirical or narrowly legal question. We are not trying to gauge the degree of attachment there currently is in the EU by, for example, citing the latest Eurobarometer poll. We are also not attempting to state the implicit rationale followed by the Court of Justice in its recent ‘solidarity’ jurisprudence, let alone trying to fix what the Commission might mean by it. In this article, I ask the more fundamental question underlying both the legal and the empirical questions: What principles of social solidarity ought to apply between states and citizens of the emerging European polity? This question has rarely been asked or answered by political theorists in an EU context, so we are entering largely uncharted territory. The article develops a tripartite model of EU solidarity in Section 2, and then applies it to the case of free movement of persons in Section 3. (shrink)

There is widespread agreement that the European Union is presently suffering from a lack of social justice. Yet there is significant disagreement about what the relevant injustice consists in: Federalists believe the EU can only remedy its justice deficit through the introduction of direct interpersonal transfers between people living in separate states. Intergovernmentalists believe the justice-related purpose of the EU is to enable states to cooperate fairly, and to remain internally just and democratic in the face of increased (...) global pressure on welfare states. I suggest that despite their fundamental differences, many of the most reasonable and prominent philosophical accounts of social justice in the EU nonetheless converge in their institutional prescriptions. In particular, they may each serve as a justificatory basis for introducing the European social minimum, an EU-wide income support scheme. (shrink)

This article focuses on the so-called “Area of Freedom, Security and Justice” (ASFJ), namely the policy field of the European Union (EU) that covers judicial and police cooperation, migration and asylum policies and the control of external borders. The article explores how the AFSJ has emerged and how, within it, the relationship between freedom and security has evolved over time and brought about a shift towards a “Security Union”.

Preparedness is an anticipatory approach developed in the military and health sectors in response to unforeseen and unforeseeable crises and emergencies. It has recently entered the debate over the resilience and sustainability of European food systems. The paper seeks to shed light on the implications of the European Union's adoption of preparedness in its food security policy, particularly focusing on the preparatory phase and the early activity the European Food Security Crisis Preparedness and Response Mechanism (EFSCM), (...) a consultative body launched by the European Commission in 2021. Through an analysis of documents and meeting minutes, we illustrate how debates on implementing preparedness are influenced by conflicting sociotechnical imaginaries of sustainable food security. Results show that the EU's shift towards preparedness combines elements of continuity and novelty in its food policy. Continuity concerns the acknowledged need to deal with growing turbulence and unpredictability affecting food systems. Novelty involves attempts at building bridges between diverging imaginaries of sustainable food security to address both short-term and long-term challenges to food security. Also new is the shift to a ‘management,’ as opposed to a ‘problem-solving,’ outlook on crisis and emergency. (shrink)

The most urgent problem facing the European Union is to develop the best approach to conflicts over integration in the fields of culture, economics and foreign policy. The essay argues that a particular form of democratic integration is better than the two predominant approaches. This approach draws on the actual practices of the democratic negotiation of integration that citizens engage in on a daily basis but which tend to be overlooked and overridden in the dominant approaches.

In its decision in ex parte Blood the Court of Appeal relied on European Community (EC) law to hold that the Human Fertilization and Embryology Authority had acted unlawfully in taking its decision to prevent Mrs Blood from exporting sperm taken from her dying husband without his written consent. The Blood case raises the issue of the extent to which EC law may affect the regulation of human reproduction in the Member States. Responding to fears that such national regulation (...) might be ‘swept away’ by the commodifying nature of EC law, this article considers the scope of the potential application of EC law to regulation of human reproduction. The cautious conclusion is that, while there may be some increase in deregulatory pressures, the ‘vertical relationship’ of supreme EC law to national law may turn out to be less significant than ‘horizontal relationships’ between policy makers within and between the EU and its Member States. The concept of Europeanization has become very popular in studies of European integration and particularly in analyses on the post-communist countries undergoing extensive transformation on the road to European Union membership. Although the Europeanization process has been quite successful in the countries of Central and Eastern Europe (CEE), the same scenario has not played out in the western Balkans region. With the purpose of analysing the effectiveness and impact of the Europeanization process in the western Balkans, the (...) main subject of the paper is Bosnia and Herzegovina’s EU-related reform processes. Although Bosnia has been undergoing thorough Europeanizing reforms since the late 1990s, when the country entered the Stabilization and Association Process (SAP), it is still an unstable and dysfunctional country. That makes it the perfect case for assessing the possible shortcomings of the Europeanization process. Thus far, most scholars have concluded that domestic political elites in Bosnia are the only party responsible for Bosnia’s political deadlock. However, this paper analyses the continued Bosnian deadlock from a different perspective, trying to figure out the degree of responsibility the European Union shares in the country’s Europeanization process. Although uncooperative Bosnian political elites are to a great extent responsible for the continued political and social status quo, EU leaders are not faultless either. In fact, so far European leaders have often appeared to be deeply divided, incoherent, and short-sighted in terms of Europeanization policies in Bosnia, thus further deepening the political deadlock in the country. Therefore, we can ask whether Bosnia represents a litmus test which the EU has failed. (shrink)

The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.

Scholarship on gender and the European Union has consistently pointed out that EU gender equality policies have always been embedded in the logic of the market and that the economic framing has had negative impacts on the content and concepts of these policies. This article provides novel insights into this discussion by combining a discursive approach focused on framings with insights of feminist economists and examining how the relationship between gender equality and the economy has been (...) conceptualized in EU policy documents from the 1980s up until the present day. The article identifies the key actors and processes behind the escalation of economic arguments for gender equality and makes visible the economic assumptions that underpin EU gender equality policy. It argues that in recent years the European institutions have intentionally developed and propagated a market-oriented gender equality discourse, the economic case for gender equality, which highlights the macroeconomic benefits of gender equality. The economic case reaffirms the gender-biased assumptions of neoclassical economic theory and legitimizes the EU’s current economic priorities and policies, many of which are detrimental to gender equality. The European Commission represents the argument that gender equality contributes to economic growth as an innovative way to promote gender equality. However, the economic case represents a risk for gender equality advocates, because it may tame the emerging feminist criticism of the EU’s economic policies and governance. (shrink)

This article sheds light on the European Union’s policy on citizenship; on the collective dimension of this policy, its ‘we’. It is argued that the inclusive, identity-constituting forces prominent in EU policy on European citizenship serve as a basis for the exclusion of people, which is illustrated by the recent expulsion of Romani from France. Based on a reading of Derrida, the twofold aim of this article is to reformulate the concept of a European citizenship ‘we’ (...) and secondly, to outline some implications of this reframing as concerns the role of education in the formation of citizens.
