This article explores the existential conditions for a transition towards socioeconomic degrowth through an analysis of a paradigm shift between two extreme polarities of socio-ecological positioning: the Dominant Social Paradigm (DSP) and the New Ecological Paradigm (NEP). It is suggested that the transition from one to the other – understood as the first collective step towards degrowth – requires a transformation in the way we, in western capitalist society, define ourselves in relation to nature. This identity transformation corresponds with the (...) reconnection between humans and nature that ecopsychology has been calling for since its emergence in the 1970s. However, according to recent empirical studies in existential psychology, such a transformation contains potentially disquieting aspects, since it implies recognising and accepting the idea of our own mortality. Staging a dialogue between ecopsychology and critical degrowth theories, this article argues that the necessary transition towards degrowth requires new ways of dealing with these existential fears – namely, confronting them in a ‘reflexive’ rather than ‘defensive’ way – so as to develop relationships with nature that respect the limits of the biosphere. We translate sentence generation from TAG grammars with semantic and pragmatic information into a planning problem by encoding the contribution of each word declaratively and explicitly. This allows us to exploit the performance of off-the-shelf planners. It also opens up new perspectives on referring expression generation and the relationship between language and action.

My paper consists of two parts. The first part deals with the fundamental normative standards of domestic social justice on the one hand and global justice on the other, standards that are requisite in order to identify injustices on both levels. On this basis, the second part focuses on the interrelations between domestic social justice and global justice with particular attention to the interdependencies between domestic and global injustices.

This paper deals with the question of how norms are to be conceived of in order to understand their role as guidelines for human action within various normative orders, particularly in the context of law on the one hand and conventional morality on the other. After some brief remarks on the history of the term “norm,” the author outlines the most significant general features of actually existing social norms, including legal and conventional norms, from which he arrives at two basic (...) requirements on an appropriate conception of such norms: the actuality and the normativity requirements. On this basis, he enters into a critical discussion of Kelsen's highly influential view of norms, arguing that this view is doomed to failure. In the last part of the paper, the author scrutinizes the more promising “practice theory of norms” by H.L.A. Hart, which, in his view, also suffers from some shortcomings, but may be modified in a way that leads to a conception of social norms providing us with a plausible explication of their actual existence and their normative force. Waar wij het simpelweg vertalen als ‘Ook ik was in Arcadië’, een vertaling die past bij ons beeld van een idyllisch, pastoraal landschap, had het oorspronkelijk een veel minder onschuldige lading. Overtuigend toont Panofsky aan, door te verwijzen (...) naar onder meer Vergilius, Sannazaro en Guercino, dat de ‘ik’ die in het citaat spreekt niemand minder is dan de Dood. De juiste vertaling is dan het sinistere, moralistische ‘Ook in Arcadië heers ik, de Dood’: de Arcadiërs wordt gemaand hun sterven te gedenken. Panofsky maakt duidelijk dat de foutieve interpretatie, met alle gevolgen van dien voor het arcadisch thema, zijn oorsprong heeft bij Nicolas Poussins beroemde Et in Arcadia Ego-composities. Many theories of fairness distinguish between compensation factors and responsibility factors. Whereas the distinction between both types of factors is a matter of definition in theory, empirical work usually requires a sharp cut. All determinants of the outcome of interest have to be classified as either a compensation factor or a responsibility factor. We argue that the determinants are often hard to classify. A pragmatic solution to the problem at hand is to introduce a more general soft cut: determinants can (...) be partly compensation, partly responsibility. Still, in a first-best income tax framework, such a soft cut is possible only if the gross income function is additively separable. In case separability fits the data, a simple partial sharing rule emerges as a natural candidate for partial redistribution. This rule can be characterized on the basis of two simple properties, equal treatment of equals and partial solidarity. In case additive separability is rejected by the data, we propose two alternative solutions. (shrink)

_Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. ABSTRACT An ontological analysis of time and of serial order is offered within the framework of a comprehensive ontology wherein the category of facts plays a crucial role. It is applied to distinguish them while various ways and contexts in which both have been mixed up in past and in present philosophy are discussed. The good reasons for that mix-up and the astonishing difficulty of keeping them apart are considered. The focus is more on the ontology of order than on (...) the ontology of time. The latter is too wide a subject. It turns out that order has not really been grounded even in set theory. The ontology of serial order expounded is new. It is also needed for the adequate ontological analysis of relational facts. (shrink)

It is 50 years since the first Nobel Prize in economics was awarded to Jan Tinbergen and Ragnar Frisch. This article analyzes the collaborations between these pioneers of econometrics which spanned four decades and various subfields in economics, based on records of their correspondence. It is demonstrated that, while Frisch was largely responsible for theoretical breakthroughs, Tinbergen was responsible for making them public and popularizing them. This is especially relevant for understanding the development of econometric models in the 1950s, decision (...) models of the 1950s, and subsequent work on utility measurement. This division of labor is analyzed in relation to the goals they pursued in their research and their respective perfectionistic and pragmatic approaches to economic science. Both men shared a sense of deep social responsibility, but differences in their personalities and approaches to science generated important differences in scientific recognition and policy influence. Although they are both widely remembered for helping to turn economics into a quantitative empirical science, this article shows that they were motivated by separate personal and political goals which shaped their scientific approaches. In advanced societies, the sphere of work is subject to far-reaching changes which erode the system of gainful employment achieved in the second half of the last century, called ‘typical work’, i.e. full-time employment for an indefinite period with collectively negotiated wages and working conditions. This development has lead to a proliferation of various kinds of ‘atypical work’, most of which amount to poorly rewarded and insecure jobs with bad labour standards, and it has also weakened the traditional systems of (...) social security. As a result, most advanced societies have experienced a significant increase in social inequality and poverty in recent decades, even though their overall social wealth has constantly grown, a state of affairs which may be deemed to be not merely undesirable, but also unjust. This judgment, however, presupposes a particular conception of social justice that submits the economic order and the working world to certain normative demands. The paper aims to illuminate these demands by proceeding in three steps. First of all, it starts with recapitulating the conditions of the rise of typical work and the features of its decay. Secondly, it seeks to sketch a conception of social justice and its requirements on the working world, on the basis of which the present situation may be considered as unjust. Finally, it will deal with the question of how to reform the present working world in a way that, as far as possible, meets the requirements of justice. (shrink)
