Ever since Parmenides, one of philosophy's riddles has been how we are able to direct our thoughts to non-being. Erhard uses the problem of non-existence as the starting point for an analysis of Husserl's phenomenology. He examines Husserl's interpretation of judgments about non-being as judgments made "under assumption" and his analysis of "free fantasy." Erhard thus demonstrates that Husserl is compatible with today's non-relational theories.

With this autobiographical remark in mind, Simon May appropriately develops his study of Nietzsche's ethics, Nietzsche's Ethics and His War on "Morality," by attending to Nietzsche's writings of the 1880's, using the relatively late On the Genealogy of Morals (1887) as his textual keystone.For the sake of his English-speaking readers' convenience, May reiterates Walter Kaufmann's familiar translations of Nietzsche's works in all of his book's citations, and keeps a relatively tight leash on his references to Nietzsche's pre-1880 works and unpublished notebooks. Historical guideposts to authors within Nietzsche's surrounding cultural context are also limited, and the book unfolds around May's reflections on Nietzsche's publications, supplemented by contemporary references to the works of Bernard Williams in matters concerning ethics, and by references to a substantial number of English-speaking Nietzsche scholars in matters concerning Nietzsche's valuation of truth. Such are the book's methodological contours, which are defensible, but which will probably disappoint those who have philosophical sensibilities that are more philologically and historically pronounced.May divides his book in half, the first segment of which reviews a series of familiar Nietzschean thematics, Nietzsche's conception of values, his distinction between master and slave moralities, his analysis of guilt and bad conscience, his conception of life enhancement, and his conception of the ascetic ideal, all with the prospect of suggesting that Nietzsche's ethical ideal is best encapsulated by the phrase, "become what one is." This ideal, as May understands it, is to develop oneself maximally in a life-enhancing way, given the parameters of one's natural capacities. Although one would expect May to associate this prescription with Nietzsche's conception of the "superhuman" (Übermensch), he thought-provokingly sets the ideal of "becoming what one is" directly against Nietzsche's Übermensch, arguing that the latter is, in fact, "unattainable and undesirable." According to May, Nietzsche's discussion of the superhuman type is distractingly unrealistic, chiefly because a perfectly sovereign individual, unlike us, would be an infallible "man-god" (117) and would have nothing left to overcome.The second half of May's study concentrates on Nietzsche's crucial revaluation of the value of truth. May argues that although Nietzsche rejects an unconditional value for truth and its associated ascetic ideal, it is nonetheless consistent to "passionately" value truth and remain a Nietzschean life-enhancer. May respects Nietzsche's perspectivism, but his interpretation clearly runs against the grain of the more extremely relativistic, "anti-truth," readings of Nietzsche.May's short volume contains plenty of food for disagreement. To cite one notable example, May maintains that "with Nietzsche there is not even an attempt to produce a systematic safety net against cruelty... and, to this extent, his philosophy licenses the atrocities of a Hitler" (132). May's fundamental reason is that since unfettered cruelty is consistent with what he understands to be Nietzsche's radically individualist [End Page 450] principle of life-enhancement, the Nietzschean conception of life-enhancement is ethically deficient. Some of Nietzsche's remarks do provoke May's criticism, but common knowledge also tells us that unfettered cruelty often backfires into either physical or spiritual self-destruction. Neither, however, would such a Nietzschean seek to erect an absolute barrier against unfettered brutality, but would more discriminatingly consider what wisdom dictates in each circumstance, given the interests of life.May's study intends to exclude from the philosophically best interpretation of Nietzsche, what are recognized by most people as ethically undesirable qualities. Abstract:The term stakeholder is a powerful one. This is due, to a significant degree, to its conceptual breadth. The term means different things to different people and hence evokes praise or scorn from a wide variety of scholars and practitioners. Such breadth of interpretation, though one of stakeholder theory’s greatest strengths, is also one of its most prominent theoretical liabilities. The goal of the current paper is like that of a controlled burn that clears away some of the underbrush of (...) misinterpretation in the hope of denying easy fuel to the critical conflagration that would raze the theory. We aim to narrow its technical meaning for greater facility of use in management and organizational studies. By elaborating a number of common misinterpretations – critical and friendly – of the theory, we hope to render a stronger and more convincing theory as a starting place for future research. Like Kant at his time, Jürgen Habermas wants to encourage the reader to use his „reasonable liberty“. There is no doubt, that the philosophical positions of Kant on the one hand and of Hegel on the other hand hold, until today, a key role in the development of the „discourse of modern age“. In order to oppose a short-circuited synthesis of both systems, which are obliged to the idea of liberty quite differently, this essay demonstrates the substantial differences regarding to (...) elementary concepts like peculiarity of the individual will, law and legislation, people and sovereignty of the people. That both philosophers differ in their interest of questioning becomes quite clear regarding to the citizen/state relation. While Hegel tries to describe the reality of the state as a „moral universe“ and therefore as „reality of reason“, Kant is interested in knowing about the potential state togetherness of individuals which have experienced in them the „radical evil“. The differences concerning the estimation of the „subjective“ individual will in its relationship to the „objective“ will of „generality“, concerning also the (Rousseauian) concept of contract and the citizens as „co-legislators“ are culminating in the relationship between „law“ and „morality“. Whereas Kant (wrongly) ignores ethos and history, Hegel is lacking the concept of „intersubjective communication“ (so Habermas states). From both insufficiencies conclusions are resulting which are important for coping with the actual difficulties with „inclusion“ and „integration“. (shrink)

Biofilms can be viewed as tissue‐like structures in which microorganisms are organized in a spatial and functional sophisticated manner. Biofilm formation requires the orchestration of a highly integrated network of regulatory proteins to establish cell differentiation and production of a complex extracellular matrix. Here, we discuss the role of the essential Bacillus subtilis biofilm activator RemA. Despite intense research on biofilms, RemA is a largely underappreciated regulatory protein. RemA forms donut‐shaped octamers with the potential to assemble into dimeric superstructures. The (...) presumed DNA‐binding mode suggests that RemA organizes its target DNA into nucleosome‐like structures, which are the basis for its role as transcriptional activator. We discuss how RemA affects gene expression in the context of biofilm formation, and its regulatory interplay with established components of the biofilm regulatory network, such as SinR, SinI, SlrR, and SlrA. We emphasize the additional role of RemA played in nitrogen metabolism and osmotic‐stress adjustment. (shrink)

El autor va más allá de la mera afirmación de que entre esos dos polos existe una relación de tensión, e intenta fijar los elementos que en el Estado de Derecho son absolutamente irrenunciables si es que no se quiere abandonar este tipo de Estado. Analiza para ello, críticamente, la jurisprudencia del (...) Tribunal Constitucional Federal Alemán, con referencias al acervo normativo de la Unión Europea. Su conclusión es que la intervención del Estado en la esfera privada del ciudadano debe estar sujeta a límites infranqueables, también en lo que concierne al control preventivo de riesgos relacionados con el terrorismo. In this paper I argue that the almost forgotten early dissertation of the phenomenologist Hans Reiner Freiheit, Wollen und Aktivität. Phänomenologische Untersuchungen in Richtung auf das Problem der Willensfreiheit engages with what I call the unity problem of activity. This problem concerns the question whether there is a structure in virtue of which all instances of human activity—and not only “full-blown” intentional actions—can be unified. After a brief systematic elucidation of this problem, which is closely related to the contemporary “problem (...) of action,” I elaborate and critically discuss two relevant threads running through Reiner’s work. The first view concerns the alleged motivational asymmetry between activity and passivity according to which it is essential only for active experiences to be motivated by an underlying passivity. The second view focuses on Reiner’s phenomenology of the will, especially on his notions of “ego-centrality” and “inner will” the latter being introduced in analogy to Brentano’s notion of “inner consciousness.” These two notions are supposed to unify all manifestations of the human will, including “full-blown” intentional actions and non-intentional doings such as laughter. Reiner’s extension of will-based actions to non-intentional activity is one of the most remarkable aspects of his early work. Finally, I show that Reiner ultimately answers the unity problem in the negative because he ends up with the view that besides will-based agency he also acknowledges so-called “motor activity” which is not intrinsically related to the will. I close with a couple of tentative proposals how volitional and motor actions might be unified nonetheless. (shrink)

In this article we revisit the notion of stakeholder responsibility as a way to highlight the role that stakeholders have in creating anethical business context. We argue for modifying the prevailing focus on corporate responsibility to stakeholders, and giving more serious attention to the importance of stakeholder responsibility—to firms, and to other stakeholders who are part of the collective enterprise. We elaborate why stakeholder responsibility matters, and suggest how making stakeholder responsibility a central focus of academics and practitioners can redefine (...) the interaction between firms and stakeholders and ultimately enhance business excellence. This paper analyses the change in the notion of fundamental and human rights in Germany and throughout the European Union during the process of European integration. This change, that can be summarized in the formula “from human rights to state tasks,” signifies the integration and partial amendment of the French Revolution's ideals (liberté, égalité, fraternité) with the new ideals of security, diversity and solidarity. These new ideals make it necessary for the state to play a positive role in devising, for (...) example, a policy of minority recognition and a long list of social rights. These rights are often translated into merely generic “norms on state objectives” and not directly binding law in force. This means that such rights increasingly become a political and legislative issue making it more difficult for the Courts to offer guarantees. (shrink)

Abstract:Stakeholder theorists have generally misunderstood the nature and ramifications of the fiduciary responsibilities that corporate directors owe their stockholders. This fiduciary duty requires the exercise of care, loyalty, and honesty with regard to the financial interests of stockholders. Such obligations do not conflict with the normative goals of stakeholder theory, nor, after a century of case law that includesDodge Bros. v. Ford,do fiduciary responsibilities owed shareholders prevent managerial policies that are generous or sensitive to other corporate stakeholders. The common law (...) recognizes a multitude of legal relationships between various corporate constituents, and fiduciary duties are only a subset of the obligations that arise from these relationships. This article argues that statute and case law can bring comparable legal protection to constituents other than stockholders, and suggests ways that these protections might be further strengthened. For example, at the conclusion of his Histoire de la folie (Madness and Civilization, 1961)—a book which brought him extensive intellectual recognition in France—Foucault (...) drew his readers' attention to José de Goya y Lucientes's (1746-1828) well-known etching, El Sueño de la Razón Produce Monstruos (The Sleep of Reason Brings Forth Monsters, Plate 43 of Los Caprichos, 1797). In Foucault's estimation, by revealing a "night which is doubtless that of classical unreason," Goya's work represented a socially removed condition within which people encounter "what is most solitary" and experience what is "deepest" within themselves. With his reference to Goya's imagery, Foucault illustrated a major theme of his history of madness, namely, how people referred to as "mentally ill" experienced a gradual, physical exclusion from participation in public society, and how they were eventually isolated in a more frightening way: within their physical confinement, they were subject to techniques of psychological and spiritual alienation that reduced them to a condition of utter solitude.In a comparable, if not more central manner, Foucault used as thematic motifs for the preface, first and second chapters of a book for which he is widely known, Les Mots et les choses (The Order of Things, 1966), the work of three major writers and artists from the Spanish-speaking world: Jorges Luis Borges (1899-1986), Diego Velázquez (1599-1660), and Miguel de Cervantes (1547-1616). This essay critically examines the view recently set forth by Paul Guyer that Kant's theories of artistic beauty and artistic creativity exclusively coincide with this theory of natural beauty. I note that very great works of art, although they may indeed be beautiful, also tend to be sublime. To acknowledge the sense of awe which attends those great works of art which are also beautiful, I argue that Kant's theory of sublimity must also be included within an accurate interpretation of (...) Kant's account of artistic beauty, and maintain that Guyer's exclusive reference to Kant's theory of natural beauty will not suffice. (shrink)
