Do the various forms of literary theory - deconstruction, Marxism, new historicism, feminism, post-colonialism, and cultural/digital studies - have anything in common? John and Curran have convincingly shown that Scanlonian contractualism is a valuable resource for evaluating pandemic response policies, and that we should reject cost–benefit analysis in favour of a contractualist framework. However, they fail to consider the part of contractualism that Scanlon constructed precisely to deal with the question of when the state can restrict individuals from making choices that are harmful to themselves and others: the value of choice view. In doing so, they leave it open for opponents of (...) lockdowns to misuse contractualism to justify mistaken policies. This is because the most powerful contractualist objections to locking down are likely to be based on the VoC. When we apply the value of choice view, we see that a lockdown policy’s justifiability depends on the extent to which particular values of choice are found to be threatened by the policy in question, and what safeguards policy-makers have put in place to increase the value of choice and protect people from the harmful consequences of lockdown. Without the VoC, it is harder to explain why lockdowns, to be non-rejectable, must have certain features. With the VoC, the case for contractualism over cost benefit analysis can be made even stronger. (shrink)

In this paper we ask whether liberal egalitarians can endorse workfare policies that require that welfare recipients should work in return for their welfare benefits. In particular, we focus on the fairness-based case for workfare, which holds that people should be responsible for their own welfare since they would otherwise impose unfair costs on others. Two versions of the fairness-based case are considered: The first defends workfare on the grounds that it would form part of an unemployment insurance scheme that (...) individuals would endorse under certain hypothetical conditions that are salient for the purposes of determining just public policy. The second appeals to the notion of reciprocity in order to justify the requirement that people work for their benefits. We cast doubt on both of these arguments for workfare. Neither argument shows that the unconditional provision of welfare benefits is unjust; hence, the fairness case for workfare is inconclusive. (shrink)

According to the most influential contemporary reading of John Locke's Letter Concerning Toleration, his main argument against religious persecution is unsuccessful. That argument holds that coercion is ineffective as a means of instilling religious beliefs in its victims. I propose a different reading of the Letter. Locke's main consideration against persecution is not the unsuccessful belief-based argument just outlined, but what I call the sincerity argument. He believes that religious coercion is irrational because it is ineffective as a means of (...) inculcating the right intentions in people. Once this alternative argument is placed at its centre, the Letter is seen to be a more fertile source of political argument than is suggested by alternative readings. In particular, the sincerity argument gives us a powerful reason for rejecting state moral paternalism, the doctrine that the state may use coercion to make people morally virtuous. If moral virtue depends upon people having the right intentions, and if coercion is ineffective as a means of instilling the right intentions in people, then state moral paternalism is ineffective and hence irrational. The strengthening of intolerance and religious movements of various mass organisations after the 1998 reform in Indonesia caused social friction. The Ministry of Religious offers religious moderation as an essential aspect of the plurality of spiritual life. What is the concept and practice of religious moderation for each mass organisation? This research is qualitatively descriptive, with a sociological approach to religion. The concept of religious moderation of mass organisastions is different; they claim to understand the principle of wasathiyyah so that (...) it becomes a view of life that accepts religious differences outside themselves. Religious moderation is in the form of religious views, attitudes, and behaviours that balance the interests of life, the world and the hereafter, personal with the public, and others. There are four indicators of religious moderation: nationalism, tolerance, non-violence, and local cultural accommodation. MTA understands religious moderation based on two principles: not being self-righteous, and do not blame other groups; FPI departs from its vision, religious moderation over the spirit of ‘amar ma’ruf nahi munkar; LUIS sees religious moderation based on the principles of Islam as a religion of rahmatan lil’alamin, the implications for the balance of the relationship between habl min Allah; habl min an-nass and habl min al-’alam; and MMI understands religious moderation based on three aspects: Islam is a religion that is syumul and rahmatan li’alamin; religious moderation related to sharia enforcement; and religious moderation means that fulfillment of maqashid asy-syariah includes ushul al-khamsah: hifdz al-din, hifdz an-nafs, hifdz al-mal, hifdz al-’aql, and hifdz an-nasb. En 1685, le Code noir défendait « aux esclaves de porter aucunes armes offensives ni de gros bâtons » sous peine de fouet. Au xixe siècle, en Algérie, l'État colonial français interdisait les armes aux indigènes, tout en accordant aux colons le droit de s'armer. Aujourd'hui, certaines vies comptent si peu que l'on peut tirer dans le dos d'un adolescent tout en prétendant qu'il était agressif, armé et menaçant. Une ligne de partage oppose historiquement les corps « dignes d'être défendus (...) » et ceux qui, désarmés ou rendus indéfendables, sont laissés sans défense. Ce « désarmement » organisé des subalternes et des opprimés au profit d'une minorité jouissant d'un droit permanent à porter des armes et à en user impunément pose directement, pour tout élan de libération, la question du recours à la violence pour sa propre défense. Du jiu-jitsu des suffragettes aux pratiques insurrectionnelles du ghetto de Varsovie, des fusils des Black Panthers aux patrouilles queer, Elsa Dorlin retrace une généalogie philosophique de l'autodéfense politique. Derrière l'histoire officielle de la légitime défense, il est ici question du récit des « éthiques martiales de soi », ces histoires ensevelies où le Sujet ne préexiste pas à sa propre défense, où le fait de se défendre en attaquant apparaît à la fois comme la condition de possibilité d'un soi et la matière des mythologies politiques. Cette histoire – une histoire de la violence – conditionne la définition même de la subjectivité moderne. This paper examines the moral case for a right to religious accommodation, which requires that religious conduct be free of any serious burdens placed on it by the state. Two different types of normative argument for this right are outlined and rejected. The first appeals to religion as a ‘basic good’, and the second to religion as an ‘intense preference’. In place of these, I suggest that a third type of argument has greater prospects of success. Religious accommodation is justified (...) on the grounds that religious conduct is a ‘derivative good’— that is, it derives its value from its being necessary for something else, namely, the integrity of the religious person. The prevalence of dementia is increasing with the ever-growing population of older adults. Non-pharmacological, music-based interventions, including sensory stimulation, were reported by the Lancet Commission in 2020 to be the first-choice approach for managing the behavioural and psychological symptoms of dementia. Low frequency sinusoidal vibration interventions, related to music interventions through their core characteristics, may offer relief for these symptoms. Despite increasing attention on the effectiveness of auditory music interventions and music therapy for managing dementia, this has not included low (...) frequency vibration. This scoping review, following the JBI methodology guidelines, was conducted to investigate participants’ responses to both sound and mechanical vibration, the characteristics of the delivered interventions, methodological challenges, and the specifics of the research experiments reported. An extensive search was conducted in BMC, CINAHL, Cochrane Central Register of Controlled Trials, EMBASE, ERIC, MEDLINE, Pedro, ProQuest Central, PsycINFO, Scopus, and Web of Science. Current Controlled Trials, Clinical Trials, and Google Scholar were also searched as well as a hand search in relevant journals. Studies on adults with all types of dementia, investigating tactile low frequency sound or mechanical vibration in any context were considered. Data from eight full-length studies were extracted using the data extraction table developed by the authors and were included in the analysis and critical appraisal. Issues in quality related to, for example, control groups and blinding. Few studies addressed participants’ subjective responses to the interventions. Reporting on the intervention characteristics was unclear. It appeared more frequent sessions led to better outcomes and home-based interventions potentially addressing the issue of access and feasibility. Future research should include neuroimaging to measure and confirm the hypothesised mechanism of cerebral coherence. Standardised reporting of intervention characteristics is also needed to ensure replicability of the experiments. Higher quality research is needed to investigate the impact and effect of low frequency vibration for the symptoms of dementia and compare outcomes in meta-syntheses. (shrink)

Die Reihe Religionsgeschichtliche Versuche und Vorarbeiten (RGVV) will dieser Komplementarität von historischer Kontextualisierung, theoretischer Verdichtung und disziplinärer Positionierung Rechnung tragen. Studien zu kulturspezifischen Sachzusammenhängen stehen neben vergleichenden Arbeiten, in Form von Monographien oder thematisch fokussierten Sammelbänden.

Policies that shift the costs of higher education from the taxpayer to the university student or graduate are increasingly popular, yet they have not been subjected to a thorough normative analysis. This paper provides a critical survey of the standard arguments that have been used in the public debate on higher education funding. These arguments are found to be wanting. In their place, the paper offers a more systematic approach for dealing with the normative issues raised by the funding of (...) higher education. This approach is drawn from the political theory of John Rawls, whose view seeks to reconcile the values of equality, efficiency, and liberty. I show that, contrary to what we may think at first, an egalitarian approach like Rawls’ does not in principle rule out policies that shift the funding burden from taxpayers to students or graduates. Which funding policy that approach selects as most fair will instead depend on the likely impact on the lifetime income prospects of the worst-off group in society, and this is a question which will need to be settled by empirical evidence. Permaculture design seeks to create sustainable communities, and over time has established itself as a transnational community of practice. Based on original interviews with permaculture practitioners from around the world, and drawing on the three core elements of communities of practice – shared domain, communality and shared practices – as our analytical framework, this paper makes three arguments. First, the shared domain of permaculture as a body of knowledge, a system of ethics and set of practical design principles creates an (...) overarching teleological regime that anchors the globally dispersed collective activities of permaculture practitioners. Second, communality in the international permaculture community is centred around the permaculture design course, national and international permaculture convergences, and organisations and demonstration sites that act as hubs for practitioner interaction, linked across national borders by social media networks. Third, shared practices in the permaculture community centre on relationship-building and local-level community organisation. (shrink)

I Can we make promises to ourselves? This is a question that has not received much consideration in the large body of philosophical work on promising. And in what commentary there is, the answer is uniformly negative. I think this negativity is a mistake, and that the conventional view that we can't make reflexive promises is wrong. I also think that this has some important implications for promissory theory in general. This article develops the argument that the state must provide parental subsidies if, and to the extent that, individuals would, under certain specified hypothetical conditions, purchase ‘insurance cover’ that would provide the funds they need for adequate childrearing. I argue that most citizens would sign up to an insurance scheme, in which they receive a guarantee of a means-tested parental subsidy in return for an obligation to pay a progressive income tax to fund the scheme. This argument from insurance bolsters (...) the weaker case that proponents of parental subsidies might offer were they to rely exclusively on arguments from fair play and efficiency. (shrink)

The online dating application has in recent years become a major avenue for meeting potential partners. But while the digital public sphere has gained the attention of political philosophers, a systematic normative evaluation of issues arising in the ‘digital sexual sphere’ is lacking. I provide a philosophical framework for assessing dating app corporation conduct, capturing why people use these apps and their experience so often is unsatisfactory. Identifying dating apps as agents intervening in a social institution necessary for the reproduction (...) of society, with immense power over people's lives, I ask if they exercise their power in line with individuals’ interests. Acknowledging that people have claims to non-interference, equal standing, and choice improvement relating to intimacy, I find that the traditional, non-digital, sexual sphere poses problems to their realisation, especially for sexual minorities. In this context, apps’ potential for justice in the sexual sphere is immense, but unfulfilled. (shrink)

Now that the usage and meaning of urban spaces have been dramatically challenged by the global pandemic, several debates and reflections are going on around the manner in which cities – both as concerns the public and the private spaces – have been designed. The article observes how “urban-human face” representations have served different models of urbanity across times and cultures. Using a framework deriving from semiotics of culture, according to which the city represents a model of the world, the (...) article attempts to interpret how portraits of faces have been modelling the city through different urban faciality mechanisms. The focus is on a sample of what we call ‘urban-human faces’, ranging from Soviet propaganda posters to the digital #selfiecity project. The expression refers to series of representations that bring together the city and the face. It can be argued that both the city and the face, produced at a specific historical and cultural moment, with their figurative and plastic elements, deploy the struggle for the city ownership and authorship. Nonetheless, the commensurability of the city and the face can be just based on the fact that both semiotic configurations represent an excess with the help of cartographic reproduction (the city) and the portrait (the face), respectively. A city can be represented by a face to the extent to which it is also multifaceted as a polylogue. On the basis of such instable commensurability, the article will ultimately attempt to bring together the semiotics of the face and the semiotics of the city. (shrink)

Philosophers often understand environmental sustainability as a duty of distributive justice between the generations of the earth. Since every generation is equally entitled to the bounty of the natural environment (the thinking goes) every generation should have a fair share of that bounty. But since generations precede each other in time, it is the duty of earlier generations to ensure that later generations receive their fair share. Acting sustainably is the way of meeting this duty, since sustainable practices are those (...) that (ideally) preserve the environment for the future. But what is a ‘fair’ share of something as complex, varied and dynamic as ‘the environment'? How are we to value nature for the purposes of measuring ‘shares’ of it? I think the answer to these questions lies in the difference between sharing something by parts, like a pie, and sharing something by turns, like a bicycle. The generations share the earth by turns, not by parts, and so questions about fairness of shares are questions about turns, not parts. We need to ask what constitutes a ‘fair turn’ with the earth, and for that question we don't necessarily need to be able to commensurate the various parts of nature, just as we don't need to know the relative value of the parts of a bicycle to say what constitutes a fair turn with it. This paper provides a critical examination of the strongest defenses of the pure lifetime view, according to which justice requires taking only people's whole lives as relevant when assessing and establishing their distributive entitlements and obligations. The paper proposes that we reject a pure lifetime view and replace it with an alternative view, on which some time-specific considerations--that is to say, considerations about how people fare at specific points in time--have nonderivative weight in determining what our obligations are to them.

According to Tocqueville, the freedom of the press, which he treats as an extension of the freedom of speech, is a primary constituent element of liberty. Tocqueville treats the freedom of the press in relation to and as an extension of the right to assemble and govern one’s own affairs, both of which he argues are essential to preserving liberty in a free society. Although scholars acknowledge the importance of civil associations to liberty in Tocqueville’s political thought, they routinely ignore (...) the importance he places on the freedom of the press and speech. His reflections on the importance of the free press and speech may help to shed light on the dangers of recent attempts to censor the press and speech. (shrink)

Apparaît alors une quasi synonymie entre psychanalyse et politique : l'une et l'autre ont en commun de faire avec l'impossible. Ni psychanalyse (...) appliquée, ni psychanalyse du politique, mais penser avec la psychanalyse, s'en servir, faire travailler ses notions, parler ses langues, l'altérer aussi, la déplacer. Arendt nous apprend que dès qu'il est question de langage, le politique est engagé. Mais dès qu'il est question de langage, c'est le vif de la psychanalyse qui est également mis en jeu. Nouage inextricable de la psychanalyse et du politique, donc. Si la psychanalyse ne sort pas de ses institutions, de ses dispositifs, et, partant, ne se mêle pas au politique, alors nous tenons qu'il n'y a pas de psychanalyse qui vaille une minute de peine. A la vérité, une psychanalyse qui n'est pas sollicitée par le monde et ne le sollicite pas en même temps ne peut encore s'appeler psychanalyse. (shrink)

Since the 2008 financial crisis, Europe's largest banks have largely remained unchallenged. Is this because of the structural power banks continue to hold over states? This article challenges the view that states are sheer hostages of banks’ capacity to provide credit to the real economy—the conventional definition of structural power. Instead, it sheds light on the geo-economic dimension of banks’ power: key public officials conceive the position of “their own” banks in global financial markets as a crucial dimension of state (...) power. State priority toward banking thus results from political choices as to what structurally matters most for the state. Based on a discourse analysis of parliamentary debates in France, Germany, and Spain, as well as on a comparative analysis of the implementation of a special tax on banks, this article shows that power dynamics within states largely shape political priorities toward banking at both domestic and international levels. Racial profiling appears to be morally more troubling when the racial group that is the object of the profile suffers from background injustice. This article examines two accounts of this intuition. The responsibility-based account maintains that racial profiling is morally more problematic if the higher offender rate within the profiled group is the result of social injustices for which other groups in society are responsible. The expressive harm based account maintains that racial profiling is more problematic if it makes background (...) injustice vivid and thereby causes the profiled to feel resentment. I raise problems with both accounts and suggest a third account. On the humiliation-based account, individuals who are subjected to racial profiling in a context of background injustice are placed in a situation in which they cannot prevent appearing to onlookers in a demeaning way. While there has been much discussion of how the scientific establishment’s culture can engender research misconduct and scientific irreproducibility, this has been discussed much less frequently with respect to the medical profession. Here the authors posit that a lack of self-criticism, an encouragement of novel scientific research generated by the recruitment policies of the UK Royal Training Colleges along with insufficient training in the sciences are core reasons as to why research misconduct and dishonesty prevail within the medical community. Furthermore, (...) the UK General Medical Council’s own data demonstrates a historic inattentiveness to the ease with which doctors can engage in research misconduct. Suggestions are made as to how these issues can be investigated and alternative incentives for career advancement are adumbrated. (shrink)
