No crucial experiment demonstrates that four hue categories are needed to describe color appearance. Instead, converging lines of evidence suggest that the terms red, yellow, green, and blue are sufficient and precise enough for deriving color discrimination functions and for a useful model constraining relations between color appearance and neuronal responses. Such a model need not be based on linguistic universals. Until something better is available, this holds.

Volume 1 of the Writings and Speeches of Edmund Burke presents Burke's early literary writings up to 1765, and before he became a key political figure. It is the first fully annotated and critical edition, with comprehensive notes and an authoritative introduction. The writings published here introduce readers to Burke's early attempts at a public voice. They demonstrate in a variety of ways how determined he was to become involved in the social and intellectual life of his times. The (...) one work of Burke's early life which has long been recognized as having prime critical significance, the Sublime and the Beautiful, is naturally found here. In addition the volume includes the first fully edited version of other works which have been neglected, notably the Vindication of Natural Society, a substantial satire on current philosophical and religious thought, the Abridgement of English History and the Hints for an Essay on the Drama. The volume also prints reliable texts of his early poems and prose `characters' as well as the first complete text of The Reformer since it was first published in 1748. This was a weekly paper devoted principally to the Dublin cultural scene and was edited by Burke shortly after he graduated from Trinity College, Dublin. (shrink)

The problem of divine impassibility, i.e., of whether the divine nature in Christ could suffer, stands at the center of a debate regarding the nature of God and his relation to us. Whereas philosophical reasoning regarding the divine nature maintains that the divine is immutable and perfect in every respect, theological needs generated an ever-growing demand for a passionate God truly able to participate in the suffering of his creatures. Correlating with the different approaches of Thomas Aquinas and John Duns (...) Scotus, the paper develops an incarnation model that aims, on the one hand, to solve the dualistic problem between the divine and human natures, and on the other hand to make room for both impassible and passible elements in God, and so to make room within the patristic impassible model for genuine suffering in God. The discussion, though centered around Christ's im/passibility and passions, can easily be modified to approach the body-mind problem since the essence of the problems is the same. (shrink)

This is the first of two papers responding to ‘recent’ commentary on various aspects of hyperplane dependence by several authors. In this paper I focus on the issues of the relations of HD to state reduction and unitary evolution. The authors who’s comments I address here are Maudlin and Myrvold. In the second paper of this set I focus on HD dynamical variables and localizable properties and measurements and address comments of de Koning, Halvorson, Clifton and Wallace. Each paper ends (...) with some reflections on the implications of HD for the ontology of Minkowski space-time. To set the stage for my responses, I begin this paper with some general position statements designed to correct what seem to be widespread and erroneous construals of some of my views. Two central points are argued for in this first paper. First, dynamical evolution occurs not only within foliations of Minkowski space-time. Rather the transition from the physical state of affairs on any one hyperplane to any other, whether the hyperplanes intersect or are parallel, is always an instance of dynamical evolution between them, generated by some active combination of boost-like transformations and/or time-like translations and/or state reductions and ‘reconstructions’. This point gives rise to a generalized conception of a history of dynamical evolution, allowing for the use of parameterized families of hyperplanes that multiply cover some portions of space-time. Nevertheless, and this is the second central point, for any two generalized histories, H and H’, the quantum states for a system on all the hyperplanes of H from the asymptotic past up to some hyperplane, h, determine the quantum states for the system on all the hyperplanes of H’ from the asymptotic past up to any hyperplane, h’, such that h’ lies to the past of all those state reduction regions that lie to the future of all hyperplanes of H that are ‘earlier’ than h. Consideration of these results should defuse concerns that have been voiced about the coherence and consistency of HD. Much progress has been made in recent years regarding the mechanisms of targeting of secretory proteins to, and across, the endoplasmic reticulum (ER) membrane. Many of the cellular components involved in mediating translocation across this bilayer have been identified and characterized. Polypeptide domains of secretory proteins, termed signal peptides, have been shown to be necessary, and in most cases sufficient, for entry of preproteins into the lumen of the ER. These NH2‐ terminal segments appear to serve multiple roles in targeting (...) and translocation. The structural features which mediate their multiple functions are currently the subject of intense study. (shrink)

We develop an axiomatic set theory — the Theory of Hyperfinite Sets THS— which is based on the idea of the existence of proper subclasses of large finite sets. We demonstrate how theorems of classical continuous mathematics can be transfered to THS, prove consistency of THS, and present some applications.

This volume of Burke's writings and speeches is divided into two parts. The first covers the period between the time of his retirement from the House of Commons in 1794 and his death in 1797. His main preoccupation during this period was, of course, the French Revolution and the progress of the war against France. Surveying developments with dismay and apprehension, he produced a critique of the Revolution which expressed much of his mature thinking on political and social life, and (...) issued a clarion call for a European crusade to save civilization. Part II contains Burke's writings and speeches relating to Ireland. From his entry into political life, he was intensely interested in Irish problems, religious, economic, and constitutional, and in Anglo-Irish relations. Fervently believing that Great Britain and Ireland should be partners within the Empire, in his last years he was deeply disturbed by the influence of the French Revolution on Irish politics. I attempt to show that when someone is, E.G., Angry about something, The events or states that conjointly are causing him to be angry conform to a certain structure, And that from the causal structure underlying his anger it is possible to 'read out' what he is angry about. In this respect, And even in some of the details of the structure, My analysis of being angry about something resembles the belief-Want analysis of intentional action. The chief elements of the (...) causal structure I describe are a belief and an attitude so related in content as to constitute either a wish-Frustration (in the case of negative emotions) or a wish-Satisfaction (in the case of positive emotions). THE TEXT In the summer semester of 1925 in Freiburg, Edmund Husserl delivered a lecture course on phenomenological psychology, in 1926127 a course on the possibility of an intentional psychology, and in 1928 a course entitled "Intentional Psychology. " In preparing the critical edition of Phiinomeno logische Psychologie (Husserliana IX), I Walter Biemel presented the entire 1925 course as the main text and included as supplements significant excerpts from the two subsequent courses along with pertinent selections from various research (...) manuscripts of Husserl. He also included as larger supplementary texts the final version and two of the three earlier drafts of Husserl's Encyclopedia Britannica article, "Phenomenology"2 (with critical comments and a proposed formulation of the Introduction and Part I of the second draft by Martin Heidegger3), and the text of Husserl's Amsterdam lecture, "Phenomenological Psychology," which was a further revision of the Britannica article. Only the main text of the 1925 lecture course (Husserliana IX, 1-234) is translated here. In preparing the German text for publication, Walter Biemel took as his basis Husserl's original lecture notes (handwritten in shorthand and I Hague: Nijhoff, 1962, 1968. These notes discuss some aspects of the sort of symmetry considerations that arise in philosophy of physics. They describe and provide illustration of: (i) one common sort of symmetry argument; and (ii) a construction that allows one to eliminate symmetries from a given structure.

Behavior, language, development, identity, and science—all of these phenomena are commonly characterized as 'social' in nature. But what does it mean to be 'social'? Is there any intrinsic 'mark' of the social shared by these phenomena? In the first book to shed light on this foundational question, twelve distinguished philosophers and social scientists from several disciplines debate the mark of the social. Objective: To assess the adequacy of the process of informed consent for surgical patients at the University Hospital of the West Indies. Method: The study is a prospective, cross-sectional, descriptive study. 210 patients at the University Hospital of the West Indies were interviewed using a standardised investigator-administered questionnaire, developed by the authors, after obtaining witnessed, informed consent for participation in the study. Data were analysed using SPSS V.12 for Windows. Results: Of the patients, 39.4% were male. Of the surgical procedures, (...) 68.6% were scheduled, 7.6% urgent and 23.8% emergency, 35.2% were minor and 64.8% major. Information imparted/received was acceptable in 40% of cases, good in 24% and inadequate (unacceptable) in 36% of cases. Almost all (97.6%) patients stated that they understood why an operation was planned and 93.3% thought that they had given informed consent. Most (95.2%) thought that they had free choice and made up their own mind. A quarter (25.2%) of all patients were told that it was mandatory for them to sign the form. There was a discussion of possible side effects and complications in 56.7% of patients. Conclusions: This study clearly indicates that surgical patients at the University Hospital of the West Indies feel that they have given informed consent. However, it also suggests that more information should be given to patients for consent to be truly informed. (shrink)

Philosophical interest in intentional action has flourished in recent decades. Typically, action theorists propose necessary and sufficient conditions for a movement's being an action, conditions derived from a conceptual analysis of folk psychological action ascriptions. However, several key doctrinal and methodological features of contemporary action theory are troubling, in particular (i) the insistence that folk psychological kinds like beliefs and desires have neurophysiological correlates, (ii) the assumption that the concept of action is "classical" in structure (making it amenable to definition (...) in terms of necessary and sufficient conditions for its proper application), and (iii) the assumption that deferring to intuitions about the application of the concept of action amidst the context of fantastical thought experiments furnishes an effective method for judging the adequacy of proposed analyses. After consideration of these problems it is argued that action theory needs to be reoriented in a more naturalistic direction, the methods and aims of which are continuous with those of the empirical sciences. The paper concludes with a sketch (and defense) of the methodological foundations of a naturalistic approach to intentional action. (shrink)

Philosophical interest in intentional action has flourished in recent decades. Typically, writers in the field of action theory seek necessary and sufficient conditions for a movement's being an action, conditions derived from a conceptual analysis of everyday action ascriptions. However, only a naturalistic account of intentional action, an account whose methods and aims are continuous with those of the empirical sciences, will truly help further our understanding of action as a biological phenomenon. ;Action is naturalized as a species of movement (...) that is both purposive and self-controlled, using these terms in novel senses. Various psychological and physiological models of purposiveness have been offered, including negative feedback, motor program, and dynamical systems models. However, while such non-historical models offer valuable insights into the nature of how organisms control their movements, they fail as general models of purposiveness because consideration of a movement's selectional history is required in order to classify movements as unitary behaviors rather than merely accidental motions. Non-historical models also fail to cover instances of unsuccessful purposive movements and cases of "functionally emergent behaviors." For such reasons, purposiveness must be seen as an historical property of movements; a movement is purposive insofar as it has a Millikanian proper function. ;An agent's capacity to exert a high degree of control over its movements marks the second key underlying property of action. I highlight an aspect of behavior-control which empirical theorists have largely ignored, namely the extent to which agents "could have done otherwise" than how they have in fact acted upon particular occasions. Self-control in this "could have done otherwise" sense is naturalized in terms of "modulatory interconnectivity." Modulatory interconnectivity involves the extent to which an agent's internal behavior-control modules facilitate behavioral interruptability via the interaction of informational links of inhibition and/or suppression. The greater the extent to which an agent's behavior-control modules have the capacity to modulate one another's activities, the more the agent has the capacity for self-control in the "could have done otherwise" sense. This view is elucidated and supported with the aid of models from robotics and neurophysiology. (shrink)

This paper situates the data privacy debate in the context of what I call the death of the data subject. My central claim is that concept of a rights-bearing data subject is being pulled in two contradictory directions at once, and that simultaneous attention to these is necessary to understand and resist the extractive practices of the data industry. Specifically, it is necessary to treat the problems facing the data subject structurally, rather than by narrowly attempting to vindicate its rights. (...) On the one hand, the data industry argues that subjects of biometric identification lack legal standing to pursue claims in court, and Facebook recently denied that that its facial recognition software recognizes faces. On the other hand, industry takes consent to terms of service and arbitration clauses to create enforceable legal subject positions, while using promises of personalization to create a phenomenological subject that is unaware of the extent to which it is being manipulated. Data subjects thus have no legal existence when it is a matter of corporate liability, but legal accountability when it is a matter of their own liability. Successful reform should address the power asymmetries between individuals and data companies that enable this structural disempowerment. (shrink)

We introduce and discuss a concept of approximation of a topological algebraic system A by finite algebraic systems from a given class K. If A is discrete, this concept agrees with the familiar notion of a local embedding of A in a class K of algebraic systems. One characterization of this concept states that A is locally embedded in K iff it is a subsystem of an ultraproduct of systems from K. In this paper we obtain a similar characterization of (...) approximability of a locally compact system A by systems from K using the language of nonstandard analysis. In the signature of A we introduce positive bounded formulas and their approximations; these are similar to those introduced by Henson [14] for Banach space structures (see also [15, 16]). We prove that a positive bounded formula φ holds in A if and only if all precise enough approximations of φ hold in all precise enough approximations of A. We also prove that a locally compact field cannot be approximated arbitrarily closely by finite (associative) rings (even if the rings are allowed to be non-commutative). Finite approximations of the field R can be considered as possible computer systems for real arithmetic. Thus, our results show that there do not exist arbitrarily accurate computer arithmetics for the reals that are associative rings. (shrink)

Despite a wide range of restorative practices in use around the world, most recent research has been focused on one model, family group conferencing. In part due to the salience and appeal of Braithwaite’s reintegrative shaming theory, this important emphasis on the role of structured dialogue with family and intimates privileges an emotional connection that elicits reintegrative shame on the part of the offender, accompanied by group support. In this paper, I argue that reintegrative shaming as practiced in family group (...) conferencing in the youth justice context is based on a theory of “strong ties” associated with the extended families of Gemeinschaft societies. This important emphasis on the family/extended family unit as an affective focus, however, may have inadvertently diverted attention from the importance in Gessellschaft societies of “weak ties.” In modernity, such ties provide instrumental support that leads to connections that link offenders and victims to broader “bridging” relationships associated with social and human capital. This paper briefly considers two ostensibly “weak” restorative practices that effectively engage these broader connections for young offenders and families that may be fundamental to reintegration and other prosocial outcomes, while also mobilizing and strengthening the parochial controls and social support of neighbors and other adults. Ultimately, the sustainability of restorative justice will require an openness to practices that accomplish restorative goals, while also facilitating a more flexible, problem solving, and community-building focus. Putnam presents a Peircean characterization of truth in an attempt to avoid relativism, which he argues is incoherent. I argue that Putnam has not avoided relativism. According to Putnam's theory of understanding, we must understand all claims concerning a Peircean community in terms of our own experiences and in terms of our own standards of rational assertability. Truth simply collapses into warranted assertability. At this point Putnam appeals to the objectivity of our standards of assertability. But Putnam's notion of "objectivity (...) for us" is a notion of objectivity which the relativist can happily adopt. Putnam's failure to provide more than a superficial distinction between internal realism and relativism means that internal realism faces the same problems which Putnam directs at "self-refuting" relativism. The Idea of Philosophy and its Historical Origin is the first chapter on Edmund Husserl’s First Philosophy . First Philosophy, vol. I, is the edited and completed text of the course which Husserl gave under that title at the University of Freiburgim-Breisgau . The manuscript, written in Husserl’s shorthand, was typed by his assistant Ludwig Landgrebe. The article is an introduction to phenomenology as first philosophy and makes reference to the critical reflection of the historical interpretation of first philosophy (...) and to the „necessity“ of first philosophy. Husserl postulates a return to the first philosophy, he shows how first philosophy is the theorizing of being as being and how philosophy/phenomenology is both metaphysical and perennial. (shrink)

As is made plain in the critical apparatus and editorial matter appended to the original German publication of Hussed's Ideas II, I this is a text with a history. It underwent revision after revision, spanning almost 20 years in one of the most fertile periods of the philosopher's life. The book owes its form to the work of many hands, and its unity is one that has been imposed on it. Yet there is nothing here that cannot be traced back (...) to Hussed himself. Indeed, the final" clean copy" for publication, prepared by an assistant, was completely reviewed by the master three times and emended by him in detail on each occasion. Nevertheless, in the end the work was in fact not submitted for publication, and after Hussed's pen last touched the manuscript in 1928 it was set aside until posthumously edited and published by the Hussed-Archives in 1952. The story of the composition of Ideas II begins with the "pencil manuscript" of 1912. This is the ultimate textual source for both Ideas II and Ideas III. 2 It has been preserved as a folio of 84 sheets in very dense shorthand of the Gabelsberger system, written mostly with a pencil. This paper attempts a theoretical discussion of effects on the legal regime of copyright induced by the change from material to digital media. Specifically, a fundamental question remains unanswered: what is the relationship between an object and a copy? A conceptually clear answer to this question has been unnecessary because it has always been possible to provide an ad hoc answer through visual inspection of an object. Authorized mechanical reproductions – authorized copies – look similar to one another, and unauthorized (...) reproductions bear tangible evidence of degradation. Digital reproduction, however, makes such visual inspection impossible, as both authorized and unauthorized digital reproductions look the same. At that moment, one “would expect” that copyright protects the essence of the object, independently of how it looks. Indeed, this is precisely what copyright jurisprudence, which emphasizes originality, tries to do. However, absent the baseline of visual intelligibility, there is no criterion for knowing which object legitimately embodies its eidos and which does not. The effects of this absence stand behind many of the battles surrounding digital reproduction. In section 2, I discuss more precisely how digital reproduction undermines the original/copy distinction. In section 3, I show how the effects of this are manifest in contemporary debates. Section 4 attempts a more theoretical discussion, organized around Deleuze's discussion of Platonism (and the degree to which, for Deleuze, the Platonic original/copy distinction functions to enable the police work of good copy/bad copy). I examine issues in the philosophy of religion at the intersection of what possibilities there are and what a God, as classically conceived in the theistic philosophical tradition, would be able to do. The discussion is centered around arguing for an incompatibility between theism and two principles about possibility and ability, and exploring what theists should say about these incompatibilities. -/- I argue that theism entails that certain kinds and amounts of evil are impossible. This puts theism in conflict with (...) popular principles of modal recombination. However, theists have plausible explanations for the violations of recombination that they posit, and can suitably amend these principles without giving up their usefulness in accounting for what possibilities there are. -/- I also argue that despite the impossibility of these evils, God is able to bring these evils about. This puts theism in conflict with the principle that no one is able to do the impossible. However, theists can give a plausible account of why God is unique in being able to do the impossible, and have distinctive resources to address the arguments in favor of the idea that no one is able to do the impossible. And by denying this principle, theists are able to resolve several otherwise difficult puzzles, including reconciling conflicts between the divine attributes. (shrink)

Artificial intelligence (AI) and machine learning (ML) systems increasingly purport to deliver knowledge about people and the world. Unfortunately, they also seem to frequently present results that repeat or magnify biased treatment of racial and other vulnerable minorities. This paper proposes that at least some of the problems with AI’s treatment of minorities can be captured by the concept of epistemic injustice. To substantiate this claim, I argue that (1) pretrial detention and physiognomic AI systems commit testimonial injustice because their (...) target variables reflect inaccurate and unjust proxies for what they claim to measure; (2) classification systems, such as facial recognition, commit hermeneutic injustice because their classification taxonomies, almost no matter how they are derived, reflect and perpetuate racial and other stereotypes; and (3) epistemic injustice better explains what is going wrong in these types of situations than does the more common focus on procedural (un)fairness. This paper discusses some of the current literature around the precautionary principle in environmental philosophy and law with reference to the possibility of transgenic food in Uganda (GMO bananas specifically). My suggestion is that the distinction between formal and substantive versions of a principle, familiar from legal theory, can be useful in imposing some conceptual clarity on aspects of debates concerning the precautionary principle. In particular, most of the negative critical response to the principle has been to formal versions of (...) it, and follows a pattern not unfamiliar from discussions of how to get from rules to outcomes. For its part, the less-discussed substantive account admits of at least two very different emphases. The first, which I call “Heideggerian,” exhibits a deep distrust of technology. The second, “autonomist,” is less concerned with the fact of technology than with the question of who controls it. As with any exercise of analytic taxonomy, this one will fail to adequately treat many of the objects it studies. However, I hope to illuminate what I take to be serious philosophical differences within the precautionary camp, and to highlight some of the questions they suggest in terms of the differences in political philosophy that might underlie and support them. Google Earth allows us to obtain a new vision of the planet we live on, with an ability to zoom in from space to ground level detail at any point on Earth. As it is only recently that we have been able to look toward the Earth from space, we review instead the history of imaging of the Jupiter moon Ganymede, another globe, first seen by Galileo. Observations of Ganymede are mined for lessons on the importance and impact of improving (...) imaging technology. Similarly, new insights may await us when we have proper tools for quantitatively looking at another unexplored globe, the embryo, in a sense for the first time. (shrink)

BackgroundAn increasing number of studies utilize intracranial electrophysiology in human subjects to advance basic neuroscience knowledge. However, the use of neurosurgical patients as human research subjects raises important ethical considerations, particularly regarding informed consent and undue influence, as well as subjects’ motivations for participation. Yet a thorough empirical examination of these issues in a participant population has been lacking. The present study therefore aimed to empirically investigate ethical concerns regarding informed consent and voluntariness in Parkinson’s disease patients undergoing deep brain (...) stimulator (DBS) placement who participated in an intraoperative neuroscience study.MethodsTwo semi-structured 30-minute interviews were conducted preoperatively and postoperatively via telephone. Interviews assessed participants’ motivations for participation in the parent intraoperative study, recall of information presented during the informed consent process, and participants’ postoperative reflections on the research study.ResultsTwenty-two participants (mean age = 60.9) completed preoperative interviews at a mean of 7.8 days following informed consent and a mean of 5.2 days prior to DBS surgery. Twenty participants completed postoperative interviews at a mean of 5 weeks following surgery. All participants cited altruism or advancing medical science as “very important” or “important” in their decision to participate in the study. Only 22.7% (n = 5) correctly recalled one of the two risks of the study. Correct recall of other aspects of the informed consent was poor (36.4% for study purpose; 50.0% for study protocol; 36.4% for study benefits). All correctly understood that the study would not confer a direct therapeutic benefit to them.ConclusionEven though research coordinators were properly trained and the informed consent was administered according to protocol, participants demonstrated poor retention of study information. While intraoperative studies that aim to advance neuroscience knowledge represent a unique opportunity to gain fundamental scientific knowledge, improved standards for the informed consent process can help facilitate their ethical implementation.
