La musique occupe une place singulière au sein de la philosophie de G.W. Leibniz (1646-1716). Si les développements que ce dernier y consacre sont peu nombreux et dispersés à travers son œuvre, ils n'en dessinent pas moins les contours d'une philosophie de la musique aussi pénétrante que méconnue. Celle-ci apparait tout à la fois comme l'expression et le modèle privilégié de sa métaphysique générale, dont la portée esthétique reste largement à explorer. Une œuvre en particulier, cependant, semble avoir déjà donné (...) corps à cette esthétique musicale. Cette œuvre est celle de Jean-Sébastien Bach (1685-1750), dont l'écriture contrapuntique manifeste plus que toute autre une parenté structurelle avec la philosophie de Leibniz. À scruter l'architecture complexe de ses compositions, on peut y déceler comme un miroir de l'univers leibnizien, une expression sensible des principes mêmes de l'harmonie universelle. Au vu du contexte intellectuel dans lequel évoluait J.-S. Bach, cette parenté n'est du reste pas sans fondement historique. Il n'est ici que de mentionner l'implication du Cantor dans la société philosophique dirigée par Lorenz Mizler (1711-1778), élève de Wolff et héritier de Leibniz, à laquelle il dédia plusieurs de ses œuvres les plus hautement formelles, dont la dernière, inachevée, devait être 'L'Art de la fugue'. À travers l'étude de la conception leibnizienne de la musique, envisagée dans son rapport à la pensée musicale de J.-S. Bach, cet ouvrage explore les relations entre métaphysique et musique à la lumière du concept d'harmonie comme "unité dans la diversité. (shrink)

In this paper we review selected international legal instruments, the effect, if any, that they have had on global health, and how these instruments might have contributed to the realization of health rights. We consider a number of instruments from the international health law field as well as two from the field of international environmental law.1 The latter two, in addition to the considerable link between health and climate/environment, are considered with the purpose of drawing more generalized lessons about what (...) contributes to the success or failure of an international legal instrument; the lessons are then applied to our analysis of the health law instruments that are the primary focus of our paper. Examples of tipping suggest that the distinction between tipping, bribery and extortion can be questioned. Some well known ideas about bribery will not work if extended to tipping and, indeed, these analyses may founder whether or not tipping, bribery and extortion merge. I suggest that more case study analysis as well as a discussion of the relationship between character and actions are needed.

Since 9/11 the European Court of Human Rights (the European Court) has raised anew the question of the relationship between religion and public education. In its reasoning, the European Court has had to consider competing normative accounts of the secular, either to accept or deny claims to religious liberty within Europe's public education system. This article argues that the trajectory on which the term 'secularism' had been used by the European Court pointed increasingly towards secular fundamentalism. This study is located (...) at the cutting edge of religion, education and the law and builds on previous work in the field (Arthur, 1998, 2008). It examines, through extensive research of legal cases, the most important developments of the usage of secular and secular education in modern discourse and explores the background to these concepts. Unless otherwise stated, religion in this article shall refer to the Christian tradition because Christianity has been the historical context for the development of the concept of 'secular' in Europe. The paper outlines three models of secular education before moving on to scrutinise how the European Court has understood and evaluated various legal cases before it on the interaction between secular States, public education and notions of religious symbolism and influence. The paper will discuss the significance of the European Court's reasoning and decisions for public education within a secular State context and offer some conclusions on the implications of these decisions. It examines the legal principles that underpin the European Court's supervision of the State's role in the provision of education. It focuses on the chimeric goal of neutrality and highlights the risks attached to the use of an ideological conception of secularism that could lead potentially to the complete removal of the religious as a vital cultural and intellectual dimension of public education. Hertzberg develops his daring thesis that the "modern, secular, anti-Semitism was fashioned not as a reaction to the Enlightenment and the Revolution, but within the Enlightenment and Revolution themselves." He finds that modern anti-Semitism owes less to Christian theological mentality than to doctrinaire libertarianism of figures such as Voltaire, d'Holbach, Diderot, and Marat.

There seem to me, however, to be serious flaws in Goodman's intricate chain of argument, which I wish to examine in some detail.

One observes regulation at every biological level. Organisms, cells, and biochemical processes operate efficiently, normally wasting neither material nor energy, and adjusting their functions to external influences. Nature evidently has evolved mechanisms specifically dedicated to regulation at many levels. What is the molecular basis of this control?In the 1950s these molecular control mechanisms began to be explored seriously. The discoveries of feedback inhibition of enzyme activity were important because they gave an initial example of how regulation is achieved at the (...) molecular level. We showed that certain enzymes are composed of two parts, one for catalysis and another distinct part present only to regulate this catalysis. Catalytic activity can be either stimulated or inhibited when a small molecule in the environment combines with the enzyme's regulatory site. In particular, a final product of a metabolic pathway generates a feedback loop which automatically limits its own excessive production, by combining with the regulatory site of an early enzyme in that pathway. Later studies showed that catalytic and regulatory structures of some enzymes could be separated physically.The discovery of regulatory sites and their interaction with molecules unrelated to their substrates was the basis for the generalized allosteric concept. This concept extends the regulatory site idea to a wide variety of processes such as control of gene expression, hormone action, and cellular growth. (shrink)
