The title of this book refers to the tension between formal and informal elements in the ways analytical philosophy is practiced. The authors examine questions of the scopes and limits of both kinds of research methods.

Legal ethics, particularly at undergraduate level, should incorporate the expertise and teaching of someone outside traditional legal education and professions. Most appropriately, legal ethics education should involve an applied ethicist. Whilst lawyers are very good at identifying critical legal issues, it is the ethical issues that are of concern here. I therefore propose that because laws often have a deep-rooted ethical foundation and students need to appreciate this to truly understand the aim, nature and objective of the relevant law, legal (...) ethics should be taught in cooperation with an applied ethicist. I begin by creating a foundation for my argument about using an applied ethicist by addressing ethics teaching at undergraduate level. Next, I make a case for ethics teaching beyond professional ethics and teaching to codes of conduct. It is at this juncture, in the third section, where I explain the benefits of involving an applied ethicist in legal education. Finally, I will address possible concerns related to integrating an applied ethicist into Law School teaching. (shrink)

Metzler, an imprint of Springer-Verlag GmbH Germany, part of Springer Nature in 2020. The translation was done with the help of artificial intelligence. A subsequent human revision was done primarily in terms of content, so that the book will read stylistically differently from a conventional translation. Descartes' Ideentheorie ist in der neueren Forschung immer wieder als Ausgangspunkt des neuzeitlichen "way of ideas" dargestellt worden, der in einen verhängnisvollen Repräsentationalismus mündet. Denn Cartesische Ideen scheinen so etwas wie mentale Objekte in einer "inneren Arena" zu sein. Da wir nur zu diesen mentalen Objekten einen unmittelbaren Zugang haben, können wir höchstens auf die Existenz äußerer Objekte schließen, wir können sie aber nie unmittelbar erkennen. Stets sind wir in unserer inneren Arena gefangen. Gegen diese weit verbreitete Auffassung argumentiert diese (...) Studie, daß Descartes' Ideentheorie im Rahmen einer Theorie der Intentionalität zu verstehen ist: Ideen sind nichts anderes als intentionale Akte, die im Normalfall auf äußere Objekte gerichtet sind und diese Objekte zum Inhalt haben. In der Cartesischen Ontologie gibt es keinen Platz für mysteriöse innere Objekte, die sich gleichsam zwischen den Geist und die äußeren Objekte schieben. This paper discusses a scenario borrowed from Williamson (2000) and repurposes it to argue for the possibility of conflict between two _prima facie_ categorical norms of epistemic rationality: the norm to respect one’s evidence and the norm to be coherent. It is argued, _pace_ Williamson, that in the conflict defining the scenario, the evidence norm overrides the coherence norm; that a rational agent with our evidence would lack evidence about some of their own credences; and that for agents whose evidence (...) is limited in this way, incoherence fails to entail irrationality. The above possibility claim has also been defended by Worsnip (2018), albeit on a quite different premise set and in conjunction with a coherence-centered account of epistemic rationality that issues predictions incompatible with those licensed by the evidence-centered account recommended here, as illustrated towards the end of the paper. The debate on empirical tests of social mechanisms suffers from a fragmented view on the relative benefit of the empirical method a researcher considers to be superior, compared to the flaws of all other methods. In this outlook. I argue that disciplinary barriers might be surmounted by a common methodological perspective on the analysis of social mechanisms. First, experimental, quantitative, qualitative, and simulation methods (agent-based modeling) are all required, but also capable to deal with the issue of causal identification, respectively. (...) Second, having established causal identification (among which I subsume strategies to deal with causal heterogeneity). each method disposes of genuine techniques to deal with the most crucial property of mechanism-based explanations: input-mechanism-output (IMO) relations. Weit davon entfernt, Glücksratgeber zu sein, hinterfragen die hier versammelten Autoren verschiedene Glücksdefinitionen: Philosophisch gesehen findet sich das Glück zum Beispiel im «guten Leben». Wer der schwierigen Frage, was ein gutes Leben sei, aus dem Weg gehen will, der sucht das Glück vielleicht lieber in konkreten Dingen, wie Geld, Sport, Drogen, Musik, Reisen oder Lesen. Neben dem individuellen Glück werden auch große, kulturelle (...) Glücksbeschaffer besprochen, denn Religion, Ideologie und Magie wollen ebenfalls das Glück herbeibringen - oder sie versprechen es zumindest. Im Licht der unterschiedlichen Methoden und Fragestellungen treffen in diesem Band verschiedene Facetten der zutiefst menschlichen Suche nach dem Glück aufeinander. Aus der Summe der Perspektiven eröffnet sich ein fragmentarisches Panorama, welches auf eindrucksvolle Weise die Größe des gesuchten Gefühles offenbart. (shrink)

Although bees are a frequent motif in ancient literature, the people who work with bees are often left in the background. An exception is the motif of the older man on his – usually small – farm who lives from and with his bees. The article shows that this motif is a topos that appears in various texts of Greek and Latin literature of the imperial period. Depending on the intention behind these representations, different elements of the motif may be (...) emphasised or omitted. This article explores the phenomenon of consecration, which, so far, has been neglected by sociologists of intellectuals. Contrary to the common Bourdieusian approach to consecration, which conflates it with legitimization, consecration is conceptualized as a process of the symbolic elevation of a figure, or an object, to the level of sacred symbols relevant to a particular community. Five analytically distinctive elements are identified that constitute the consecration process and a proposed framework is applied to disentangle the consecration of the Czech (...) philosopher, and martyr of anti-communist dissent, Jan Patočka. In this analysis, original data are used to uncover repressed facts about the life of this intellectual icon. (shrink)

Focusing on the works of Theodor W. Adorno, Walter Benjamin, and particularly Werner Hamacher, this essay seeks to develop an understanding of “survival” as the medial condition of linguistic structures. In the course of the past century and beyond, the term “survival” has repeatedly been deployed in discussions around the ontological status of linguistic entities. Most prominently, Benjamin finds in “survival” the essence of what he calls “translatability.” He decidedly puts the term in quotations marks to signal its linguistic nature, (...) which prompts Hamacher to speak of “survival in citation.” This article thus attempts to demonstrate that the term “survival” is not reducible to its biological or phenomenal implications, and reintroduces it as the fundamental concept of a renewed understanding of philology. In three sections, the essay discusses linguistic technification, translation, and irony as three modes that bring the survival of language to the fore. (shrink)

Die nicht zuletzt im Zuge der Deklaration eines „nachmetaphysischen Zeitalters“ für überzogen gehaltenen epistemologischen Ansprüche der klassischen Metaphysik scheinen sich auch und vor allem in der Auseinandersetzung mit skeptischen Argumenten bzw. Paradoxien tatsächlich als unhaltbar herauszustellen. Wenn sich bereits alltägliche Wissensansprüche unter dem Seziermesser skeptischen Scharfsinns als insgesamt problematische Klasse entlarven lassen, wie sollte man dann noch sinnvoll Metaphysik betreiben können? Doch der Anschein trügt, wie die Beiträge des vorliegenden Sammelbandes ausführlich darlegen. Dieses Buch reagiert damit auf einen aktuellen internationalen (...) It seems quite natural to explain the activities of human and non-human animals by referring to their special faculties. Thus, we say that dogs can smell things in their environment because they have perceptual faculties, or that human beings can think because they have rational faculties. But what are faculties? In what sense are they responsible for a wide range of activities? How can they be individuated? How are they interrelated? And why are different types of faculties assigned to different (...) types of living beings? The six chapters in this book discuss these questions, covering a wide period from Plato up to contemporary debates about faculties as modules of the mind. They show that faculties were referred to in different theoretical contexts, but analyzed in radically different ways. Some philosophers, especially Aristotelians, made them the cornerstone of their biological and psychological theories, taking them to be basic powers of living beings. Others took them to be inner causes that literally produce activities, while still others provided a purely functional explanation. The chapters focus on various models, taking into account Greek, Arabic, Latin, French, German and Anglo-American debates. They analyze the role assigned to faculties in metaphysics, philosophy of mind and epistemology, but also the attack that was often launched against the assumption that faculties are hidden yet real features of living beings. The short "Reflections" inserted between the chapters make clear that faculties were also widely discussed in literature, science and medicine. (shrink)

This study illuminates how a cross-sector social partnership legitimizes itself toward multiple internal and external stakeholders. Within a single-case study design, we collected retrospective and real time data on the partnership between Deutsche Post DHL and The United Nations Office for the Coordination of Humanitarian Affairs. Within this partnership, Deutsche Post DHL provides corporate volunteers that support disaster response after natural disasters on a pro bono basis. The main objects that needed legitimacy as well as the audiences from which legitimacy (...) was mainly sought changed over time. In addition, we identified legitimation work as occurring across objects, audiences, and time. Thus, we introduce legitimation work as the purposeful effort of the legitimacy seeker to avoid certain issues while ensuring other issues that are of importance to the conferrer of legitimacy. These findings contribute to micro-level considerations within institutional theory which view legitimacy as socially constructed between legitimacy seeker and conferrer. Hence, we add another perspective on legitimation to the previously existing conceptualizations of legitimacy as a deterministic consequence of institutionalization. (shrink)

Sie ergeben sich aus ihren zentralen Fragestellungen und den Grenzen dessen, was überhaupt als wissenschaftlich gelten kann. Das Buch versteht sich daher als Beitrag zur Diskussion dessen, was die Wissenschaft als eine fortwährende Befragung der eigenen Standpunkte von allen anderen Formen der Erkenntnis unterscheidet. Die dazu versammelten Texte gingen mehrheitlich aus dem studium universale Leipzig hervor. Anlass war das 600-jährige Bestehen der Universität Leipzig. Zur Debatte steht (...) das grundlegende Selbstverständnis der Wissenschaften am Beispiel von Wissenschaftsgeschichte, Erkenntnistheorie, Sprachkritik und dem Fehlverhalten von Wissenschaftlern. Demgegenüber stehen Fragen zu den Grenzen der Wissenschaftlichkeit am Beispiel der Theologie, der Alchemie, des Farbempfindens, der Plastination oder der Tendenz zum Exzentrischen und Absonderlichen in der Wissenschaft. Das abstrakte Paradox der «geschlossenen Offenheit» der Wissenschaften kann letztlich von diesen selbst nicht eingelöst werden. Hierzu bedarf es der Kunst. Dass das Verständnis von und die kritische Auseinandersetzung mit argumentativen Zusammenhängen für den Philosophie- und Ethikunterricht von besonderer Bedeutung ist, ist unumstritten. Ebenso unumstritten ist es, dass es sich bei der schulischen Vermittlung von Argumentationskompetenzen um keinen Selbstzweck handelt, sondern dass Lernende vor dem Hintergrund der erworbenen Fähigkeiten und Kenntnisse zu einer fundierten Meinungsbildung befähigt werden sollen. In diesem Artikel argumentiere ich vor dem Hintergrund neuerer Ergebnisse der erkenntnistheoretischen Forschung dafür, dass das soeben skizzierte Bild jedoch einer grundlegenden Ergänzung bedarf, (...) da im spezifischen Kontext des Philosophie- und Ethikunterrichts nicht die Bildung, sondern vielmehr die Aufgabe eines eigenen Urteils das epistemisch wünschenswerte Ergebnis darstellt. What kind of entities are faculties? How are they related to the soul and to the entire living being? How can they be classified? And in what sense are they responsible for a large variety of activities? This chapter examines these questions, which were extensively discussed by scholastic authors, and focuses on the metaphysical models established by William of Auvergne, Thomas Aquinas, William of Ockham, and Francisco Suárez. It argues that there was no unified scholastic doctrine. While some authors (e.g. (...) Ockham) took the faculties to be mere ways of acting of the soul, others (e.g. Suárez) conceived of them as distinct entities with their own power. The latter theory gave rise to a new model of the soul—a model that presented it as a complex entity with many distinct causes. (shrink)

This paper addresses the ongoing debate over the relation between belief and credence. A proposal is made to reverse the currently predominant order of analysis, by taking belief as conceptually basic and credence as the phenomenon to be clarified. In brief, the proposal is to explicate an agent’s credence in a proposition P as the agent’s tendency toward believing P. Platitudinous as this reduction may seem, it runs counter to all of the major positions in the debate, including the Threshold (...) View, the Certainty View as conventionally understood, Dualism, Eliminativism, as well as Credence Primitivism. Section 1 gives an overview on the current state of the debate. Section 2 considers unsuccessful predecessors of the proposed belief-first approach to credence. Section 3 motivates and lays out the basics of a conceptual framework for thinking about doxastic states that characterizes such states in terms of two formally independent dimensions, one pertaining to the agent’s tendency toward believing P, the other to the level of resilience with which the agent manifests that tendency. Against this backdrop, it is argued in Sect. 4 that the present reduction satisfies a set of standard, theoretically neutral criteria of adequacy for theories of credence, at least once they are purged of a quite common conflation of tendency and resilience. What is the point of taking ethics classes? In this paper, I would like to discuss a specific answer to this question, according to which ethics instruction can facilitate moral education by directly teaching students what’s morally right. More specifically, I will argue that this view is much more plausible than one might first suspect. Therefore, the widespread disregard of this view in the philosophical literature is unwarranted. To establish this claim, I will proceed in two steps. First, I will (...) argue that the idea of educational transfers of moral knowledge is perfectly in line with specific epistemological assumptions that already underly wide parts of our educational practice. Second, I will argue that moral knowledge transfers would be a promising way of facilitating moral education in ethics classes. Having thus established the claim that the idea of moral knowledge transfers deserves closer scrutiny, I will discuss its implications in a little more detail by delineating some specific desiderata for future philosophical research that arise against the background of the previous considerations.
