In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the scientific (...) method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

A fascinating recent turn in epistemology focuses on inquiring attitudes like wondering and being curious. Many have argued that these attitudes are governed by norms similar to those that govern our doxastic attitudes. Yet, to date, this work has only considered norms that might prohibit having certain inquiring attitudes (“norms of restriction”), while ignoring those that might require having them (“norms of expansion”). We aim to address that omission by offering a framework that generates norms of expansion for inquiring attitudes. (...) This paper is focused on the major contributions of the two main schools of semiotic thought in Russia during the 20th century. It considers cultural mythologiesof behaviour as the focal point of the Moscow-Tartu school and then proceeds to the pre-semiotic school of Russian thought, which dealt with the philosophy of the (divine) Name(s). Both traditions are linked by a common preoccupation with the human sign-vehicles-cultural, artistic, literary and religious. Russian semiotics of culture (the author’s life & biography considered as (...) a peculiar kind of a sign-text) and Russian religious philosophy of language (philosophy of the Name) are the most unique scholarly offerings to have originated within the Eastern-European tradition of semiotics. When a person commits a testimonial injustice, the unjust thing they do consists in their reaction to an assertion (theorists diverge on the details; paradigmatically the relevant unjust thing consists in prejudicially refraining from believing the assertion). Whatever reactions to questions are analogous to these reactions to assertions, those things are "interrogative injustices". I explore some models of those things and apply them to some non-ideal cases. One of the models appeals to mental states like curiosity and wonder, telling us (...) that interrogative injustice occurs when hearers prejudicially refrain from adopting those mental states. Other models appeal to common conversational goals – these goals including the answering of questions. On these models, interrogative injustice occurs when a person asks a question, and another person prejudicially blocks the answering of that question from joining the common goals. Or, if they don’t block said answering, perhaps they believe that it should be thus blocked. Or perhaps they merely resist the question, not fully blocking its answering from joining the common goals but instead pushing back against it in some other way. Or perhaps they merely believe that they should resist the question. I endorse a pluralism on which each of these things can be an interrogative injustice. (shrink)

In The Elm and the Expert, Jerry Fodor tries to reconcile three philosophical positions he is presently committed to: a computational theory of mind, intentional realism and a denotational theory of meaning. One problem he faces is this: a denotational semantics, according to which the meaning of a singular term like a name is exhausted by its referent, seems to rule out there being true intentional generalizations, or generalizations which advert to the contents of a subject's mental states. That there (...) are such true generalizations is a major element in Fodor's intentional realism. Accordingly, Fodor is forced to find a way of dissolving this apparent incompatibility. In this article, I reject the “principlism” of Tom Beauchamp and James Childress and argue that respect for autonomy is, and ought to be, the fundamental value of bioethics. To do so, I offer a reconstruction of what I call the field's “founding myth,” a genealogy that affords primacy to the right to be respected as a human being with dignity. Next, I examine the relationship between this basic right and a derivative right of autonomy. I suggest that principlism has (...) promulgated an uncharitable understanding of respect for autonomy, one that ensures that the principle cannot occupy the central position I claim for it. Finally, I sketch a more plausible understanding of respect for autonomy and explore its implications. (shrink)

Existing ethical guidelines that aim to guide the development of mental health apps tend to overemphasize the role of Western conceptual frameworks. While such frameworks have proved to be a useful first step in introducing ethics to a previously unregulated industry, the rapid global uptake of mental health apps requires thinking more deeply about the diverse populations these apps seek to serve. One way to do this is to introduce more intercultural ethical perspectives into app design and the guidelines that (...) aim to encourage best practices. In addition to this, existing ethical guidelines can also benefit from the ethical scholarship from the feminist and disability traditions, both of which highlight specific ethical considerations for vulnerable users. Rethinking the ethical responsibilities of mental health app designers through the prisms of feminism, disability studies, and intercultural philosophy leads us to a more global and inclusive set of ethical considerations in app design. This white paper explores what existing guidelines for the regulation of mental health apps are missing. It also explores how these guidelines could be improved for users who inhabit an increasingly diverse and globalized world. (shrink)

This paper aims to show that the thought of Aristotle can shed much light on the irksome problems that lurk around the philosophical foundations of neuroscience. First, we will explore the ramifications of Aristotle’s mereological principle, namely, that it is not the eye that sees, but the human person that sees by the eye. Next, we shall draw upon the riches of Maxwell Bennett’s and Peter Hacker’s Philosophical Foundations of Neuroscience in order to elucidate how Aristotle’s mereological principle can be (...) of service to contemporary neuroscientists, psychologists, and philosophers. In the third and fourth parts we aim to complement the project of PFN by showing how Aristotle’s philosophical anthropology and doctrine of pros hen equivocation can strengthen PFN’s response to eliminativists, reductionists, and other critics of “folk psychology.” Finally, our last section will investigate the kinds of correlations involved in brain scanning techniques, such as fMRI, so as to determine whether the most recent empirical discoveries do in fact support various critics’ rejection of “folk psychology.” We will show that the empirical evidence does not in fact favor eliminativist or reductionist views, and that we would do well to turn to the more Aristotelian approaches to neuroscience adopted by PFN and ourselves. In this paper, I want to zero in on the Kantian idea that,whilst things in themselves must logically be presupposed as the ground underlying appearances and things are not reducible to their representations, (1) objects as appearances are not properties of things in themselves, and (2) things in themselves or the thing in itself cannot properly be represented or even thought. To do this, I turn to one of the earliest defenders and champions of the Kantian philosophy, Karl Leonhard Reinhold, (...) and specifically to his first major work Versuch einer neuen Theorie des menschlichen Vorstellungsvermögens, published in 1789. I am here interested neither in the extent to which Reinhold’s interpretation of Kant is correct or even adequately represents Kant’s thought in all of its aspects, nor whether Reinhold’s attempt to present a systematic philosophy based on a rigorous deduction from a single principle (his strong foundationalism) stands up to scrutiny. I am here solely interested in some of Reinhold’s positive insights, in the Versuch, concerning elements of his representationalism that may shed light on Kant’s idealism, specifically, the relation between appearances (as objects of knowledge) and things in themselves, i. e., points (1) and (2) described above. I read the early Reinhold of the Versuch as confirming the Kantian view that objects as appearances are not properties of things in themselves and that we are radically ignorant of things in themselves, in the sense that we can neither know things in themselves (through the senses) nor even intellectually grasp things in themselves through the understanding alone. Art works provide a unique and influential way to teach human virtues because they can place individuals (or particular artistic expressions) within the ambiguities, complexities, and forces of the human experience. I use four art works to teach about the virtue of kindness: Giotto di Bondonie's Scene 2: St. Francis Giving His Mantle to a Poor Man; Bishop Charles Francois in Victor Hugo's Les Misérables; Adam in William Shakespeare's As You Like It; and Sonya in Fyodor Dostoevsky's Crime and Punishment. In these four examples, we see necessary characteristics of being a kind person: supererogatory behavior, altruistic behavior, a display of the way the world ought to be, and the presence of a kind soul. The intention of this article is investigate ways in which the image and metaphor of the garden open productive avenues for thinking the being of nature. The primary focus of this investigation is found in two instances in which gardens play significant roles in presenting, even if only tacitly, an image of nature: Homer’s Odyssey and Plato’s reference to the “Gardens of Adonis” in Phaedrus.

Key to Gadamer's theory of hermeneutics are notions of translation, conversation, and openness. What is often not known is just how much Gadamer himself embodied those notions in his own practice as a teacher and a friend. In what follows, I speak of how the man I knew Hans-Georg Gadamer to be, illustrated some of the traits of hermeneutic theory that show that such a theory is always a practice of life and an ethical practice. Foucault introduit une nouvelle pensée dans sa philosophie, selon laquelle le sujet même joue un rôle actif dans sa propre constitution en tant que tel. Le concept de transgression, qui provient de Georges Bataille, constitue une clé de compréhension de ce troisième Foucault et permet de saisir et de donner forme à ce qu'on (...) appelle, suivant Emmanuel Kant, une attitude moderne. ABSTRACT Michel Foucault's work is marked by a continual displacement. In particular between two axes: power-knowledge on one side, subjectivation on the other. Foucault introduces a new line of thought in his philosophy, in which the subject takes up an active role in his own constitution as such. The concept of transgression, taken from Georges Bataille, is key to understanding this third Foucault and allows for a better understanding and shaping of what may be called, following Immanuel Kant, a modern attitude. Recent accounts on the global workspace theory suggest that consciousness involves transient formations of functional connections in thalamo-cortico-cortical networks. The level of connectivity in these networks is argued to determine the state of consciousness. Emotions are suggested to play a role in shaping consciousness, but their involvement in the global workspace theory remains elusive. In the present study, the role of emotion in the neural workspace theory of consciousness was scrutinized by investigating, whether unconscious and conscious display of emotional compared (...) to neutral facial expressions would differentially modulate EEG coherence. EEG coherence was measured by means of computing an average EEG coherence value between the frontal, parietal, and midline scalp sites. Objective awareness checks evidenced that conscious identification of the masked facial expressions was precluded. Analyses revealed reductions in EEG coherence in the lower frequency range for the masked as compared to unmasked neutral facial expressions. Crucially, a decline in EEG coherence was not observed for the emotional facial expressions. In other words, the level of EEG coherence did apparently vary as a function of awareness, but not when emotion was involved. The current finding suggests that EEG coherence is modulated by unconscious emotional processes, which extends common views on the global workspace architecture of consciousness. (shrink)
