: Most contemporary attempts to draw inspiration from Kant's cosmopolitan project focus exclusively on the prescriptive recommendations he makes in his article, ‘On Perpetual Peace’. In this essay, I argue that there is more to his cosmopolitan point of view than his normative agenda. Kant has a unique and interesting way of problematizing the way individuals and peoples relate to one another on the stage of world history, based on a notion that human beings who share the earth in common (...) ‘originally’ constitute a ‘commercium’ of thoroughgoing interaction. By unpacking this concept of ‘commercium’, we can uncover in Kant a more critical perspective on world history that sets up the cosmopolitan as a specific kind of historical-political challenge. I will show that we can distinguish this level of problematization from the prescriptive level at which Kant formulates his familiar recommendations in ‘Perpetual Peace’. I will further show how his particular way of framing the cosmopolitan problematic can be expanded and expatiated upon to develop a more critical, reflexive, and open-ended conception of cosmopolitan thinking. Recent years have witnessed an explosion of debate re what democratic theory has to say about the boundaries of democratic peoples. Yet the debate over the ‘democratic boundary problem’ has been hindered by the way contributors work with different understandings of democracy, of democratic legitimacy and of what it means to participate in a demos. My argument is that these conceptual issues can be clarified if we recognize that the ‘demos’ constitutive of democracy is essentially dual in character: it must (...) be defined from a third-person, observer’s perspective from which it can be represented as a whole entity; but it must also be seen as arising out of an association of numerous and ongoing second-person relationships that participants negotiate among one another. Both perspectives are essential to conceptualizing the demos, but their relation to each other has been obscured by democratic theory’s historical reliance on the imaginary of the sovereign state. Drawing on literature from deliberative democratic theory, this article reconstructs the concept of the demos in a way that better distinguishes the logic of democracy from the logic of the state, allowing us to think more clearly about how demotic boundaries may be subjected to standards of democratic legitimation. “Crisis” is a key concept in our political lexicon. Since the beginning of the modern age, it has arguably been, as much as anything, the experience of crisis that has calibrated the aims of both politics and political theory. But as central as crisis experiences have been for the shaping of our political imaginary, the concept itself has proven difficult to incorporate into the political theory enterprise. In this article, I argue that we can think politically about crisis by taking (...) up a “pragmatist” perspective that focuses on how we deploy crisis as a conceptual tool for guiding judgments and coordinating actions. I argue that crisis is a fundamentally reflexive concept that bridges our traditional distinctions between objective phenomena and normative experience, and whose very usage implies the active participation of those involved in it. Only by examining these crucial aspects of the crisis concept can we begin to grasp its normative political content, as well as how it may be deployed in the service of political action and social change. Donation after circulatory determination of death (DCDD) is an accepted practice in the United States, but heart procurement under these circumstances has been debated. Although the practice is experiencing a resurgence due to the recently completed trials using ex vivo perfusion systems, interest in thoracoabdominal normothermic regional perfusion (TA-NRP), wherein the organs are reanimated in situ prior to procurement, has raised many ethical questions. We outline practical, ethical, and equity considerations to ensure transplant programs make well-informed decisions about TA-NRP. We (...) present a multidisciplinary analysis of the relevant ethical issues arising from DCDD-NRP heart procurement, including application of the Dead Donor Rule and the Uniform Definition of Death Act, and provide recommendations to facilitate ethical analysis and input from all interested parties. Over several articles, John McDowell sketches an analogy between virtue and perception, whereby the virtuous person sees situations in a distinctive way, a way that explains her virtuous behavior. Central to this view is his notion of silencing, a psychological phenomenon in which certain considerations fail to operate as reasons in a virtuous person's practical reasoning. Despite its influence on many prominent virtue ethicists, McDowell's ‘silencing view’ has been criticized as psychologically unrealistic. In this article, I defend a silencing view (...) of practical reasoning. I argue that the phenomenon of silencing has a narrower scope than is typically acknowledged. As a result, the view does not require the virtuous to be detached, unfeeling, or unpalatably stoic. Furthermore, I offer a psychologically plausible interpretation of McDowell's claim that the virtuous see situations in a distinctive sort of way. The salient fact at which the virtuous arrive in their view of a situation should be understood, I argue, in terms of subjective construal. (shrink)

Human subject research involving brain imaging is likely to reveal signifcant incidental fndings of abnormal brain morphology. Because of this fact and because of the fduciary relationship between researcher and subject, board-certi-fed or board-eligible radiologists should review the scans to look for any abnormality, the scans should be conducted in accordance with standard medical practice for reviewing the clinical status of the whole brain, and the informed consent process should disclose the possibility that incidental fndings may be revealed and what (...) consequences will follow. BackgroundDecision-making in initiating life-sustaining health technology is complex and often conducted at time-critical junctures in clinical care. Many of these decisions have profound, often irreversible, consequences for the child and family, as well as potential benefits for functioning, health and quality of life. Yet little is known about what influences these decisions. A systematic review of reasoning identified the range of reasons clinicians give in the literature when initiating technology dependence in a child, and as a result helps determine the (...) range of influences on these decisions.MethodsMedline, EMBASE, CINAHL, PsychINFO, Web of Science, ASSIA and Global Health Library databases were searched to identify all reasons given for the initiation of technology dependence in a child. Each reason was coded as a broad and narrow reason type, and whether it supported or rejected technology dependence.Results53 relevant papers were retained from 1604 publications, containing 116 broad reason types and 383 narrow reason types. These were grouped into broad thematic categories: clinical factors, quality of life factors, moral imperatives and duty and personal values; and whether they supported, rejected or described the initiation of technology dependence. The majority were conceptual or discussion papers, less than a third were empirical studies. Most discussed neonates and focused on end-of-life care.ConclusionsThere is a lack of empirical studies on this topic, scant knowledge about the experience of older children and their families in particular; and little written on choices made outside ‘end-of-life’ care. This review provides a sound basis for empirical research into the important influences on a child’s potential technology dependence. (shrink)

As an emancipatory political project, cosmopolitanism always invited skepticism. This paper focuses on the economic-progressivist line of critique of cosmopolitanism, which has gained momentum in recent years. This critique is based on real concerns that the economic left must prioritize and integrate into its thinking; however, it is also fatally flawed. Any progressive project that takes seriously strong democratic self-determination for all peoples needs some version of a commitment to a global order that is democratically politically integrated, and this means (...) stronger forms of supranational political integration, not weaker ones. I argue that the allure of progressive economic statism rests on erroneous assumptions about the character of the Westphalian state system and its relation to the evolution of global capitalism, which give a misleading impression that this system is somehow less friendly than neoliberal globalization to capitalist imperatives for extraction, accumulation, and growth. But there are equally expropriative and violent versions of capitalism that thrive in a closed Westphalian world. With great power rivalry once again emerging as a structuring feature of world order, signs of such versions are already making their appearance today. (shrink)

This article explores the bases of Kant’s cosmopolitanism in his more systematic writings on freedom, judgment, and community. My argument is that, if we peer beneath his more explicitly normative prescriptions for achieving “perpetual peace,” we find the tools not just of a cosmopolitan vision but what we might call a “cosmopolitical method.” While many assume Kant’s political thought descends directly from his moral philosophy, a look back at relevant passages in the first Critique reveals an alternative reading that points (...) toward his theory of reflective judgment, which combines practical freedom with judgments based on theoretical concepts. Of particular importance is Kant’s conception of community as commercium, through which Kant discerns all matters of right to concern the way free actors are constrained to share the earth in common. These considerations allow for a broader way of thinking about Kantian cosmopolitanism, one that is responsive to the reflective judgment of world citizens as they encounter new challenges. (shrink)

After a recent spate of terrorist attacks in European and American cities, liberal democracies are reintroducing emergency securitarian measures that curtail rights and/or expand police powers. Political theorists who study ESMs are familiar with how such measures become instruments of discrimination and abuse, but the fundamental conflict ESMs pose for not just civil liberty but also democratic equality still remains insufficiently explored. Such phenomena are usually explained as a function of public panic or fear-mongering in times of crisis, but I (...) show that the tension between security and equality is in fact much deeper and more general. It follows a different logic than the more familiar tension between security and liberty, and it concerns not just the rule of law in protecting liberty but also the role of law in integrating new or previously subjected groups into a democratic community. As liberal-democratic societies become increasingly diverse and multicultural in the present era of mass immigration and global interconnectedness, this tension between security and equality is likely to become more pronounced. This essay explores the problem of legitimation crises in deliberative systems. For some time now, theorists of deliberative democracy have started to embrace a “systemic approach.” But if deliberative democracy is to be understood in the context of a system of multiple moving parts, then we must confront the possibility that that system’s dynamics may admit of breakdowns, contradictions, and tendencies toward crisis. Yet such crisis potentials remain largely unexplored in deliberative theory. The present article works toward rectifying this lacuna, (...) using the 2016 Brexit and Trump votes as examples of a particular kind of “legitimation crisis” that results in a sequence of failures in the deliberative system. Prior researchers have studied individual components of a theoretical decision-making model. This paper presents the results of a more complete study of the model components and presents limited support of theory. The study examines the relative importance of regulatory, organizational, and personal constructs on an individual''s ethical sensitivity. Auditors from the major international accounting firms, located in two southeastern cities, are surveyed. Structural equation modeling is used to allow for the simultaneous evaluation of the three constructs of interest. The results (...) indicate that the regulatory and organizational constructs are negatively correlated with the personal experience construct. The three constructs are not significant causal factors on ethical sensitivity. This result may be due to the manner in which ethical sensitivity is typically measured or may indicate that the complexity of the ethical decision-making process is not fully captured in the theoretical models. Thus, the models suggested in the prior literature and the results presented in prior studies of the individual components may need to be reconsidered. (shrink)

Surgical innovation involves practices, such as new devices, technologies, procedures, or applications, which are novel and untested. Although innovative practices are believed to offer an improvement on the standard surgical approach, they may prove to be inefficacious or even dangerous. This article considers how surgeons considering innovation should reason in the conditions of uncertainty that characterize innovative surgery. What attitude to the unknown risks of innovative surgery should they take? The answer to this question involves value judgments about the acceptability (...) of risk taking when satisfactory scientific information is not available. This question has been confronted in legal contexts, where risk aversion in the form of the precautionary principle has become increasingly influential as a regulatory response to innovative technologies that pose uncertain future hazards. Demands for access to experimental therapies are frequently framed in the language of rights. This article examines the justifiability of such demands in the specific context of surgical innovations, these being promising but non-validated and potentially risky departures from standard surgical practices. I argue that there is a right to access innovative surgery, drawing analogies with other generally accepted rights in medicine, such as the right not to be forcibly treated, to buy contraceptives, and to choose to have an abortion, (...) including a post-viability abortion where the mother's life or health is threatened by the pregnancy. I argue that we accept these rights because we believe that people are entitled to try to preserve their lives and health and to make choices of an important and intensely personal kind, and I suggest that a person's choice of medical treatment should be seen in the same light. However, since few rights are absolute, I also consider the circumstances in which it may be justifiable to limit the right to access innovative surgery. In discussing this question, I apply the human rights standard of proportionality, comparing the importance of the reasons for limiting the right with the severity of the invasion on liberty. Storage and secondary use of bloodspots collected for newborn screening raises controversies because of the particularly sensitive nature of the information that can be derived from them and the lack of national standards and consistent provincial policies that can serve to guide storage facilities. This report, derived through a review of Canadian and provincial policy statements, a survey of provincial newborn screening laboratory directors and program directors, as well as through a consultative workshop, illustrates the social, ethical and legal issues (...) regarding the storage, access and further uses of newborn bloodspots. The report indicates that there is a need for heightened transparency and clear recommendations concerning the criteria for storage, the duration of storage, and permissible secondary uses of dried bloodspots in Canada. An anti-realist stance prevalent in philosophy of film, probably less familiar to analytical than continental philosophers, raises issues that are philosophically accessible and engaging. While this anti-realist stance can be historically situated many of its constituent ideas remain influential in contemporary milieus. A common claim of anti-realism is that realist art or cinema, in part by virtue of ‘reification', is inherently ‘non-transformative’. Without rigorously refuting all manifestations of the ‘reification thesis’, key assumptions of anti-realism associated with it are challenged in (...) this paper. An aesthetic and a political-ideological anti-realist thesis are identified and critiqued. Kant’s distinction between ‘aesthetic’ and ‘mechanical art’ provides a basis for defending a form of cinematic realism that vindicates its potential transformative power. The Kantian framework provides a reference point for a comparative analysis of Brecht’s and Lukács’ views on anti-realism versus realism as well as for a favourable reconsideration of Andre Bazin’s cinematic realism. This gender difference has been attributed to world-view differences. Women have a care-oriented world-view and men a justice-oriented world-view – at least in masculine cultures. In feminine cultures, however, both men and women have a care-oriented world-view. The present study investigated whether in the feminine, Dutch culture the culturally adapted help-others appeal was more persuasive than the culturally (...) unadapted help-self appeal for both men and women. Mediating the meaning of evidence through epistemological diversityNursing's disciplinary recognition of ‘multiple ways of knowing’ reflects an epistemological diversity that supports nursing praxis. Nursing as praxis offers a conceptual way to explore what it is about the interface of practice, knowledge and evidence in nursing that distinguishes us as a discipline. I suggest that the relationship between evidence and knowledge is defined and mediated by the same epistemological diversity that supports nursing as praxis. Just as the meaning and truth‐value of (...) evidence is evaluated from within the body of existing disciplinary knowledge, new evidence may prompt an evaluation of the meaning and truth‐value of extant nursing knowledge. Nursing practice that relies on scientific evidence as a singular basis of practice knowledge is susceptible to exploitation by the diverse agendas operating within an ideology of evidence‐based practice and the healthcare system. Mediating the meaning of evidence for nursing practice through acknowledgement of the diverse epistemologies that underpin nursing knowledge will contribute to a disciplinary‐specific definition of what constitutes evidence for nursing, and will better direct how evidence is integrated into a disciplinary body of knowledge. Injurious speech echoes relentlessly, years after the occasion of its utterance, in the mind of the one at whom it was aimed: the bad word, splinterlike, pierces to lodge. In its violently emotional materiality, the word is indeed made flesh and dwells amongst us—often long outstaying its (...) welcome. Old word-scars embody a "knowing it by heart," as if phrases had been hurled like darts into that thickly pulsating organ, but their resonances are not amorous. Where amnesia would help us, we can't forget.This sonorousness of vindictive words might help to characterize how, say, racist speech works on and in its targets. But doesn't such speculation also risk becoming an advocacy for the cultivation of insensitivity on the part of those liable to get hurt—or worse, a criticism of their linguistic vulnerability: "They just shouldn't be so linguistically sensitive"? There's much to be said for studiously practicing indifference. But the old playground chant of "sticks and stones may break my bones, but words can never hurt me" was always notoriously untrue. An important contribution of Alan Patten’s Equal Recognition is the conception of neutrality that grounds his defence of minority cultural rights. Built in to his conception of neutrality of treatment is a notion of ‘fairness’ whose effect is to provide an upfront, across the board limitation on the demands cultural minorities may legitimately make on the rest of society. There must be limits on the duty to accommodate, but it obscures more than it illuminates to build this into the content (...) of the right to equal recognition itself. We see more clearly what is at stake in these conflicts by articulating the value of self-determination independently and taking account of necessary limits to its satisfaction as part of a second-stage analysis of what duties may be claimed and against whom. Familiar principles of discrimination law exemplify this alternative model. This presents the interest in self-determination more robustly, while acknowledging that the claims of duty arising out of it are defeasible. The result is a more flexible and nuanced exploration of the complex moral issues involved when fundamental interests clash. (shrink)

This paper suggests a new approach (with old roots) to the study of the connection between logic and geometry. Traditionally, most logic diagrams associate only vertices of shapes with propositions. The new approach, which can be dubbed ’full logical geometry’, aims to associate every element of a shape (edges, faces, etc.) with a proposition. The roots of this approach can be found in the works of Carroll, Jacoby, and more recently, Dubois and Prade. However, its potential has not been duly (...) appreciated, probably because of the complexity of the diagrams in these works. The following study demonstrates how the Hexagon of Opposition can be represented as a triangle and Classical Logic as a tetrahedron (rather than a rhombic dodecahedron). It then applies the approach to modal logic, extending the tetrahedron for the logic KT into a dipyramid and a cube for KD, and finally an octahedron for K. Some philosophers have argued that Aristotle’s view of habituation gives rise to a ‘paradox of moral education.’ The inculcation of habit, they contend, seems antithetical to the cultivation of virtue. I argue that this alleged paradox arises from significant misunderstandings of Aristotle’s view. Habit formation need not be at odds with the development of the kinds of intelligent, reflective capacities required for virtue. Indeed, Aristotle seems right to insist on an important role for habit in the cultivation of virtue. In theory, a human rights framework should protect and guarantee the equal provision of care and rights of all people. In practice, however, the universality that underlies human rights is enacted through citizenship rights, which rely on the individual politically ‘belonging’ to a nation-state.

There are significant challenges to developing a neo-Aristotelian account of a virtue of patience. First, on an Aristotelian understanding, virtue is both instrumentally good and good in itself. Yet exclusively instrumental views of patience are pervasive in the philosophical literature. Furthermore, these instrumental views present patience as more like a psychological skill than a virtue of character. Skills, however, can be misused. If patience is to be a virtue, its account must entail goodness in its possessor. Finally, there is the (...) challenge of specifying a field, or sphere of concern, for patience, given the diversity of phenomena that we tend to attribute to it.
