We analyze the behaviour of declarations of independence between existential quantifiers in quantifier prefixes of Independence-Friendly (IF) sentences; we give a syntactical criterion to decide whether a sentence beginning with such prefix exists, such that its truth values may be affected by removal of the declaration of independence. We extend the result also to equilibrium semantics values for undetermined IF sentences.

This paper addresses the question of the constitution of ‘the people’. It argues that J.L. Austin’s concept of the ‘perlocutionary’ speech act gives us a framework for understanding the constitutive force of a specific constitutional document: the American Declaration of Independence. It does so through responding to Derrida’s analysis of the Declaration, which itself draws on Austin’s work. Derrida argues that the Declaration’s constitutive force lies in the fact that it cannot be simply understood as either (...) ‘performative’ or ‘constative’, in Austin’s terminology. According to Derrida, ‘the people’ do not pre-exist the Declaration, but are constituted in the act of declaration itself. In response, I argue that while Derrida’s insight regarding the constitution of ‘the people’ is sound, his analysis misses two key aspects of the Declaration. These two lacunae point the way to an understanding of the constitutive force of the Declaration in terms of Austin’s ‘perlocutionary’ speech act. (shrink)

According to orthodox (Kolmogorovian) probability theory, conditional probabilities are by definition certain ratios of unconditional probabilities. As a result, orthodox conditional probabilities are undefined whenever their antecedents have zero unconditional probability. This has important ramifications for the notion of probabilistic independence. Traditionally, independence is defined in terms of unconditional probabilities (the factorization of the relevant joint unconditional probabilities). Various “equivalent” formulations of independence can be given using conditional probabilities. But these “equivalences” break down if conditional probabilities are (...) permitted to have conditions with zero unconditional probability. We reconsider probabilistic independence in this more general setting. We argue that a less orthodox but more general (Popperian) theory of conditional probability should be used, and that much of the conventional wisdom about probabilistic independence needs to be rethought. In his book Natural Law and Human Rights: Towards a Recovery of Practical Wisdom, Manent writes: "Let us dwell a moment on (...) the proposition in which so much passion is invested today: man is the being who possesses rights. It resonates as our self-definition and our perspective on humanity, one that we take to have fortunately replaced other definitions and perspectives, such as that man is God's creature or that man is a political animal."1 Contemporary political discourse has arrived, so he thinks, at an impasse of contradiction, incoherence, and self-defeating beliefs.Manent finds a vital help for thinking through these issues in Thomas Aquinas,2 but perhaps also a useful resource is the work of Thomas Jefferson. In Natural Law and Human Rights, Manent cites the first article of the 1789 Declaration of the Rights of Man and of the Citizen: "Human beings are born and remain free and equal in rights."3 But Manent does not cite the Declaration of Independence drafted by Jefferson. The 1776 Declaration provides a way of addressing many of Manent's concerns about human rights, human nature, and equality because it combines an appeal to the Creator [End Page 249] with the establishment of rights grounded in human nature and defended by limited government. In order to approach some of the important political, religious, and philosophical questions raised in Natural Law and Human Rights, we can reconsider the famous "American proposition": "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." What exactly does this famous American proposition mean? Can it help us to address some of the concerns about incoherent political discourse that Manent highlights?We Hold These Truths to Be Self-EvidentWhat does "we hold these truths to be self-evident" mean? The interpretation of this phrase has generated no small amount of speculation.4 As Manent notes, appeals to self-evidence arise also today in disputes about same-sex marriage.5 Even if we cannot perfectly trace the remote or proximate historical origins of the phrase in 1776, we might still examine some possible meanings.For John Locke, a self-evident truth is akin to what later philosophers called an analytically true proposition.6 Such propositions are true in virtue of the agreement of the ideas that make up the proposition. "A bachelor is an unmarried man of marriageable age" is self-evidently true, since the idea of "bachelor" agrees with the idea "an unmarried man of marriageable age." It does not seem plausible that the self-evident truths of the Declaration of Independence were meant in this sense. The assertions of the Declaration are not true simply by agreement of ideas or by definition in a way that is obvious to anyone who is a native speaker.Thomas Reid suggests a different sense of self-evidence. In this book, Catherine Frost uses evidence and case studies to offer a re-examination of declarations of independence and the language that comprises such documents. Considered as a quintessential form of founding speech in the modern era, declarations of independence are however poorly understood as a form of expression, and no one can completely account for how they work. Beginning with the founding speech in the American Declaration, Frost uses insights drawn from unexpected or unlikely forms of (...) founding in cases like Ireland and Canada to reconsider the role of time and loss in how such speech is framed. She brings the discussion up to date by looking at recent debates in Scotland, where an undeclared declaration of independence overshadows contemporary politics. Drawing on the work of Hannah Arendt and using a contextualist, comparative theory method, Frost demonstrates that the capacity for renewal through speech arises in aspects of language that operate beyond conventional performativity. Language, Democracy, and the Paradox of Constituent Power is an excellent resource for researchers and students of political theory, democratic theory, law, constitutionalism, and political history. The American Declaration of Independence served as a starting point for the drafting of the Israeli Declaration of Independence of 1948. Most of the original content was lost in the long process of translation and adaptation, but, using David Armitage’s recent terminology, the Israeli text remained as "generically promiscuous" as its predecessor, combining a "manifesto" of justifications for the assumption of sovereignty, a formal proclamation and a proto-Bill of Rights. This Article depicts the work of Mordechai (...) Beham, the Israeli Declaration’s first draftsman, as a remarkable exercise in choosing contemporary, locally-valid "answers" to the fundamental "questions" posed by Thomas Jefferson and his contemporaries in 18th century America on human values, national identity, statehood, and God. The analysis is partially based in the current debate on "legal transplantation," arguing that the outstanding success of the Israeli Declaration stems from both the quality of the American original and the massive work of adaptation to Israeli soil. The political independence of the United States of America was proclaimed in a Declaration of Independence by the Second Continental Congress, in Philadelphia, on July 4, 1776. Thomas Jefferson drafted the document, and the changes made in the text reflected the struggle among different factions in the revolutionary camp. Jefferson's initial version was fundamentally retained, however; and that is precisely what makes the Declaration of Independence not merely a legal document but a vivid example of (...) a bourgeois revolutionary program expressing in concentrated form the ideology of the radical wing of the American Enlightenment. The form of the Declaration was an address to world public opinion explaining the causes and bases for the decisive political break of the 13 British colonies with the home country. In fact it provided a general philosophical justification for the validity of revolutionary change in the social order by the people. The Declaration became the legal ground for the American system of government, sanctioning its independence and serving as the basis for the documents of a constitutional nature that followed. Since antiquity, Confucians have sought to work with the state in order to implement their philosophy through state sponsorship. And yet, whenever Confucians have sought state sponsorship, naturally the government has adopted Confucian philosophy selectively to serve its own purposes and thus compromised the integrity of Confucianism. Throughout Chinese history, countless Confucian officials attempted to help rulers to do the right thing. They often failed when their advice went against the fundamental interest of rulers. On reflection, this outcome should not (...) be unexpected. The primary goal of rulers is to solidify power; the primary concern of Confucianism is the wellbeing of the people. When the two conflict, it is highly unlikely for a government to prioritize Confucian ideals. In a democratic era, Confucianism can influence society without joining the state apparatus. It can and must promote its social ideals through grassroots democratic participation rather than leave itself to the mercy of state sponsorship. (shrink)

Was the American War for Independence just? In July 1775, a full year before the Declaration of Independence, the colonists argued that they had the right to self-defense. They made this argument using language that accords with what we can broadly call classical just war thinking, based, inter alia, on their claim that their provincial authorities had a responsibility to defend the colonists from British violence. In the 1775 Declaration of the United Colonies, written two months (...) after British troops attacked colonial citizens, such arguments are made. This essay carefully looks at the historical context of the 1775 Declaration, the arguments made by the colonists, and the philosophical and theological underpinnings of those claims, and concludes that the colonists made a compelling argument commensurate with just war thinking. Aging populations have become a major concern in the developed world and are expected to require novel care strategies. Public policies, health-care regimes and technology developers alike stress the need for a more individualized care to meet the increased demand for care services in response to demographic change. Increasingly, care services are offered to individuals with diseases and or disabilities in their homes by means of Personalized Health-Monitoring (PHM) technologies. PHM-based home care is typically portrayed as the key to a (...) cost-effective future care that better can accommodate the needs of an aging population and promote care recipients’ independence. In light of the emerging technology-based home care, this article sets forth to investigate the significance and implications of a strong emphasis on independence in relation to this novel care form. Notions of independence as used by care planners, care providers and technology developers are examined in relation to ICT-based home care and the reasonableness of independence as an aim for future health-care is critically discussed. In conclusion, the need for a shift from a strong emphasis on independence to a right to healthy dependence is advocated. (shrink)

The article deals with the legal acts which were adopted by the Supreme Council Reconstituting the Seimas of the Republic of Lithuania on 11 March 1990, and which are related to the restoration of the independent State of Lithuania. The author discloses the chronology of the legal acts adopted on that day and investigates why some particular act was adopted first, and only later another act was passed; he investigates the circumstances which determined the content of the legal acts and (...) shows the interconnection between these acts. The sequence and content of the legal acts of restoration of independence were determined by the fact that the independent State of Lithuania could not arise from the so-called “Lithuanian SSR” which had never been a form of Lithuanian statehood. The restoration of independence could and had to be grounded only upon the continuation of the pre-war Republic of Lithuania. One had to draw a boundary line between the Supreme Soviet of the Lithuanian SSR, which was elected in democratic and free elections on 24 February 1990, and which was a genuine representation of the Nation, from the former Supreme Soviets of the Lithuanian SSR—the essence and formation procedure of which was completely different. This was done by adopting the Declaration “On the Powers of the Supreme Soviet of the Lithuanian SSR” in which it was held that in the 24 February 1990 elections the Nation vested to the deputies of the Supreme Soviet of the Lithuanian SSR the mandate and the duty to restore the State of Lithuania and express the sovereign will of the Nation through this body, which, from 11 March 1990, 6 p.m., would be referred to as the Supreme Council of Lithuania. The Japanese disability movement in the 1970s posed an important question about our inner eugenic thought. Their arguments should be one of the focuses of attention for bioethics and philosophy of life in the 21st century. Their philosophy is comparable with DPI’s declaration, “The Right to Live and be Different,” published in 2000. They thought that technology of selective abortion was dangerous because it systematically deprives us of a sense of security (=the fundamental sense of security) that our existence (...) is being accepted unconditionally. They were considered to be seeking “life studies,” which has broader and deeper meanings than contemporary bioethics. (shrink)

A recent on-line discussion asked whether healthcare for Americans is a constitutional right or a privilege. One can debate whether one can extract a legal right to healthcare from the Declaration of Independence depending on whether one sees it is a philosophical or as a legal document. The Constitution of the United States of America lists “promote the general welfare” and protect “ourselves and our posterity” as some of its aims. Perhaps this would demand the inclusion of certain (...) basic health services such as immunizations and antimicrobial therapy for every citizen; even for illegal immigrants, in order to protect the public. America must decide whether health care is a privilege or a right! If it is a privilege, one must accept the exclusion of some individuals and the unintended consequences of epidemics. If it is a constitutional right, one must accept paying for that right with increased taxes and the unintended consequences on the economy. But who should pay, how much and for what? (shrink)

Notwithstanding constant “crises of confidence,” a high number of international disputes lay at the docket of the International Court of Justice in The Hague. In the word of Judge Rosalyn Higgins, states are turning to the ICJ for the peaceful settlement of their disputes. The option provided by the Charter of the United Nations in limiting the compulsory jurisdiction of the Court to certain categories of disputes, clearly contributes to convening a greater number of states to accept this international jurisdiction, (...) resolve their disputes peacefully and in accordance with international law. Not surprisingly, only a few declarations provided in Article 36 of the Statute of the Court do not contain any reservation as to the limits of the Court’s competence. Interwar Lithuania contributed heavily to the strengthening of international justice. It was amongst the first members of the League of Nations to recognise the compulsory jurisdiction of the Permanent Court of International Justice and remained its faithful supporter until the very end of the Court’s activities. International justice provided at least titular security guarantees for the young nation. This faith of the Lithuanian government in relying on international justice was rewarded in full. The Lithuanian State defended its legitimate place amongst the independent nations and successfully stood up for its interests in all three cases before the Permanent Court. (shrink)

The case of the erased residents of Slovenia – when approximately 18,000 people who were mostly of Serbian, Croatian and Bosnian ethnicity, were erased from the permanent residence registry of the Republic of Slovenia – represents one of the most severe cases of administrative ethnic/racial discrimination and human rights violations in the post-communist East and Central Europe outside the conflict area. The erasure caused “civil death” of the people who were affected by the measure, depriving them of civil, political, social, (...) and economic rights. In 2007, 4 years after the 2003 Constitutional Court decision, declaring the 1992 erasure an unconstitutional act of the state and requiring the legislator to adopt measures to reinstate the statuses of the erased people, the problem remains unsolved and unaddressed both systemically and individually, and the situation of erasure persists. This article presents the case and analyses of the framework that made the erasure possible in terms of the preparation of the majority of Slovenes to accept and even support the violations and politicians to renounce their political responsibility to those who have lost the right to have rights. The mechanisms of imperial control - violence and economic warfare, hardly a distant memory in Latin America - are losing their effectiveness, a sign of the shift toward independence. Washington is now compelled to tolerate governments that in the past would have drawn intervention or reprisal.

Free universal primary education has been promoted globally since the declaration of Education for All in 1990. As a result, the number of school-going children in the developing world has increased at an unprecedented scale and governments have run short of educational facilities and qualified teachers. Millions of children have been left without access to school and those who enrolled received poor quality education. Low-fee independent schools, which charge small fees, have mushroomed everywhere in response to parental demand for (...) access and quality education. Low-income families began to send their children to LFISs rather than government schools. Despite the critical role they play in providing access and quality education, LFISs were faced with challenges that hindered them from unleashing their full potential. Edify was founded in 2009 with the vision of flourishing Godly nations to stand alongside Christian LFISs through the provision of loan capital, training and education technology services to enable them to improve and expand sustainable Christ-centred education globally. During its eight years of operation, Edify has cumulatively partnered with around 3500 schools, having an impact on 1 million children. Over 20,000 school leaders and teachers have been trained in conjunction with local training partners. With the recycling of repayment through local lending partners, Edify has dispersed US$21.9 million in total loans to schools. With a brief historical background of LFISs, this article presents the rationale, content and modus operandi of Edify’s programme. (shrink)

Kyrgyz people lived under the control of Soviet Union for about 70 years. During this time, they were forbidden to practice any kinds of religious duties. Their religious schools and mosques were closed or used for other aims rather than religious needs. In short, all kinds of religious freedom and practices were forbidden strictly. The aim was to bring up an atheistic people during the days of Soviet Union. However, when Kyrgyz people won their independence and established a new (...) country, all kinds of restrictions in terms of religion were abrogated and people began to establish their religious schools and mosques. While during the first years of independency of the country in 1991, there were only 39 mosques, as of 2018 there are nearly 3,000 mosques in the country. In addition to the increase of mosques, the number of people going to mosques also increases day by day. This article examines mainly the development of religious freedom in terms of legal aspect from the beginning of the establishment of the country to our time; the legal statues, functions, and duties of State Commission for Religious Affairs and Religious Office of Kyrgyzstan Muslims, and as common religious educational places mosques, religious activities done at mosques, the factors effecting these activities negatively.Summary: Kyrgyz Turks are one of the most ancient tribes in Central Asia. Although there are various views and knowledge about the religious life and the process of Islamization of them in various sources, there is no doubt that one of the most important elements which shapes Kyrgyz culture and social life is Islam. Even though they continued the activities of Islamic education and training under the rule of many nations thorough the history, all activities of religious education were tried to be forgotten and religion was removed from daily life under the Soviet communist regime. However, with the establishment of the Republic of Kyrgyz based on the secular and democratic bases on 31 August 1991, Muslim people showed a great effort and endeavor to open some institutions where they could live their religion, perform their religious duties, and teach religious and moral values for people. After the declaration of independence, with the enacting of “Freedom of Faith and Religious Institutions” on 16 December 1991 which was one of the first enacting laws, very important developments happened in terms of both formal and informal education. Some knowledge concerning Islam is given in some culture courses and “Religious Office of Kyrgyzstan Muslims” was created for meeting all kinds of religious needs of Muslims in the country in 1993. With the establishment of the “State Commission for Religious Affairs” in 1996, some new legal regulations were made. Thus the state’s policy about religious education and teaching gained a new dimension. During this process, the state faced some problems concerning developments in religious education. Although some of these problems have been solved legally, there are still many problems about religious education today. Since the independency until now, there have been many researches as articles, books, master theses and doctorate dissertations about various fields of religious education, religion-state relations, religious institutions, course books and their curriculums. However, a great majority of these studies belong to religion-state relations and the field of formal religious education. There aren’t any academic studies or research about mosques and imams that concern the great majority of the country population. In fact, from the point of religious education, common or informal religious education is as extremely important as formal religious education. For the mosques that are one of the most important institutions of common religious education are spread to the most remote corner of the country and serve for all people of different ages for the whole year. The effects of common religious education increase day by day. While there were just 33 mosques in 1933, there were 39 mosques in the independency year of 1991, as of 2018 this number has risen to 2830. Relating the imams who work at mosques, it is not possible to speak about a systematic structure. Since imams are generally graduated from madrasas, their educational levels are very low. As they have not enough financial support and highly educated teachers, they cannot give good education to their students and cannot adopt themselves to the modern educational levels in teaching religious issues. In order to solve this problem, Muftiyat either sends students to abroad or gives in service trainings for imams. Another important problem in relation to imams is the way of assignment. There is no criterion for assignment of imams. They are not designated by the Muftiyat, but it just legitimizes those imams who are chosen by congregation. Imams receive neither any salary from the Muftiyat, nor they have any social assurance. They work either voluntary or their incomes are paid by people. Although all of these negative conditions, mosques and imams have a great importance on Kyrgyz people’s education, culture, worship, and moral teaching. It can be said that there are two kinds of education at mosques and masjids. One of these is “moldos”, some men of religion who gather students and give some religious knowledge without following any curriculum. Although some of them take education from some Arabic countries or Pakistan, their educational level is very low and cannot recite even the Qur’an correctly. In addition, they have very little knowledge about pedagogy and religious themes, and they have not enough educational experience. The second type of education at mosques and masjids is carried out through Friday sermons and preaching. However, this is not an effective way in giving religious education. Because the way in which the Friday sermon is given is not appropriate as a good teaching method. As the sermons are done in Arabic, there is no effective communication between the imam and the congregation. However, Friday sermons and preaching are very important for people’s religious education and socialization. This article firstly deals with the developments in religion in the times of freedom of the country, secondly, it examines the institution of Muftiyat to which all mosques are adhered and “State Commission for Religious Affairs” that register the mosques which the Muftiyat approves, and lastly gives information about mosques and their congregations in the country. In July 2019, Secretary of State Mike Pompeo launched a Commission on Unalienable Rights, charged with a reexamination of the scope and nature of human rights–based claims. From his statements, it seems that Pompeo hopes the commission will substantiate—by appeal to the U.S. Declaration of Independence and to natural law theory—three key conservative ideas: (1) that there is too much human rights proliferation, and once we get things right, social and economic rights as well as gender emancipation and (...) reproductive rights will no longer register as human rights; (2) that religious liberties should be strengthened under the human rights umbrella; and (3) that the unalienable rights that should guide American foreign policy neither need nor benefit from any international oversight. I aim to show that despite Pompeo's framing, the Declaration of Independence, per se, is of no help with any of this, whereas evoking natural law is only helpful in ways that reveal its own limitations as a foundation for both human rights and foreign policy in our interconnected age. Eleven years after Kosovo’s unilateral declaration of independence, Spain’s position vis-à-vis Kosovo has not only not varied, but it has become stronger, turning Madrid into the leader of the Kosovo non recognizers club within the EU. This paper analyses Kosovo-Spain relations in the last eleven years. More specifically, the paper examines the reasons behind the non-recognition of Kosovo and the approach of the Spanish governments toward Kosovo’s statehood. This is followed by a thorough analysis on how Kosovo’s path (...) for self-determination played a major role in Catalonia’s quest for independence in 2017. The empirical research demonstrates that Spain’s main reason not to recognise Kosovo is based on the country’s internal dynamics; namely, Catalonia and the Basque country. Likewise, the paper argues that the Spanish governments throughout the last eleven years have created an analogy between Kosovo and Catalonia; not in their political statements, but in their political decisions, by worsening the almost inexistent diplomatic relations with Kosovo, when the Catalan path for independence was at its highest peak. By the same token, the paper reveals that this position was enhanced and driven by Catalan separatism, that continuously used Kosovo’s unilateral declaration of independence as a model to further their own path for self-determination. The data provided and analysed in this paper as well as the statements made are based on desk research and seven semi-structured interviews conducted in Prishtina, Brussels, Madrid and Barcelona in 2018. The violation of editorial independence by the CMA seriously damaged trust in CMAJ and raises questions whether the CMA can operate a truly independent journalOn February 20, 2006, John Hoey and Anne Marie Todkill, the two most senior editors of the Canadian Medical Association Journal were fired by the journal’s publisher, Graham Morris. At first, CMA spokespersons said that the firing had been planned for some time based on a desire to “refresh” the journal. Later they refused to offer (...) any explanation, and weeks later they declared that there had been “irreconcilable differences,” without specifying anything more. After the journal’s editorial board tried fruitlessly to convince the Canadian Medical Association to reinstate the dismissed editors, I resigned from the editorial board. The present study is a corpus-assisted analysis of discourses on the Catalan movement of independence in the Catalan and Spanish press. A referendum for Catalan independence was held on 1 October 2017 but was not approved by the central Spanish government and was declared illegal. Spanish and Catalan newspapers differed considerably in their treatment and representation of the conflict, which also drew the attention of the international press to Catalonia. My analysis interconnects theoretical perspectives from linguistic critical discourse (...) studies, cognitive linguistics, and media studies. The methodology is based on the analysis of two comparable corpora of journalistic texts. My aim is to identify and compare different features of the semantic prosody of words describing the event of geopolitical separation and the different narratives on this sociopolitical conflict that these prosodies contribute to producing. More specifically, I focus on a selection of keywords, like independence, secession, and sovereignty, that seem to be indicative of different discursive strategies consciously, and possibly unconsciously, chosen by a selection of national Catalan and Spanish newspapers. By carrying out a contrastive analysis of the two corpora, I am able to describe certain similarities, like the similar frequent use of the word independence, and differences, like the more frequent use of the word secession in the Spanish corpus, that indicate different framings of the same event and can be related to different ideological positionings against or in favor of Catalonia’s independence from Spain. Throughout the twentieth century, the automation of formal logics in computers has created unprecedented potential for practical applications of logic—most prominently the mechanical verification of mathematics and software. But the high cost of these applications makes them infeasible but for a few flagship projects, and even those are negligible compared to the ever-rising needs for verification. One of the biggest challenges in the future of logic will be to enable applications at much larger scales and simultaneously at much lower costs. (...) This will require a far more efficient allocation of resources. Wherever possible, theoretical and practical results must be formulated generically so that they can be instantiated to arbitrary logics; this will allow reusing results in the face of today’s multitude of application-oriented and therefore diverging logical systems. Moreover, the software engineering problems concerning automation support must be decoupled from the theoretical problems of designing logics and calculi; this will allow researchers outside or at the fringe of logic to contribute scalable logic-independent tools. Anticipating these needs, the author has developed the Mmt framework. It offers a modern approach towards defining, analyzing, implementing, and applying logics that focuses on modular design and logic-independent results. This paper summarizes the ideas behind and the results about Mmt. It focuses on showing how Mmt. provides a theoretical and practical framework for the future of logic. (shrink)

Declaration of independence became a reference point of a new historical epoch - epoch of free, sovereign development of Uzbekistan. Our country from first days of independent development, under direction of President I.A. Karimov, has headed for refusal of a heritage of a command control system, having started to construction of bases of a democratic legal society with the socially-focused market economy. For achievement of these purposes own model of updating and progress which essential features are the selective (...) approach to experience of the developed countries and the account of specificity and features of centuries-oldevolution of national statehood is involved. In Republic of Uzbekistan process of democratization and modernization of a society became stage-by-stage, with a stress on maintenance of deep understanding of an essence of democracy, in view of sociopolitical traditions and features of national mentality. The heritage of sociopolitical culture of our society has acted original “Means”. By means of which modern values and principles of democracy were brought home to people, their perception and understanding was facilitated. Psychological features of national character, such as tolerance, the aggravated feeling of validity, equality before the law, etc. were especially effectively used. It is known, that the basic directions of democratic transformations and formation of a civil society are defined depending on real needs and opportunities of their realization. We have a precise comprehension of that the major condition of formation of a democratic society is strengthening a role and value in a life of a society of not state and public institutes. In Uzbekistan this process goes by practical realization of the concept “From the strong state - to a strong society”. It is a question of stage-by-stage and gradual reduction of a role of the state structures in the decision of social and economic questions and about transfers of these functions to public organizations. Gradually we go to that participation of the state in economic sphere and a field of activity of managing structures, first of all, a private sector - decreases. In parallel the problem of creation of favorable conditions for realization of publiccontrol on the basis of corresponding motivation - public interests is solved. (shrink)

Considered the first significant teacher of rhetoric in America, John Witherspoon also introduced Scottish moral philosophy in America, and as president of Princeton reformed the curriculum to give emphasis to both studies. He was an active pamphleteer on religious and political issues and a signer of the Declaration of Independence. Thomas P Miller argues that Witherspoon’s career exemplifies the Ciceronian ideal, and the eight selections Miller presents from the 1802 American edition of the _Works _corroborate that claim.

Locke saw man in the state of nature as governed by reason. In this state, all are equal and independent. No one should harm another. This conceptualization is what the Declaration of Independence speaks of as the “Laws of Nature and Nature’s God.” Professor Konvitz contrasts and compares More’s, Hobbes’, and Locke’s viewed of the state of nature.

One of the curious things about this challenging book is that its ostensible subject— the Saxon medical and political scientist Hermann Conring (1606–1681)— is not mentioned in the title. Constantin Fasolt argues that we cannot know what Conring really thought or meant in his writings, which means that his topic cannot be Conring as such and must instead be that which occludes our knowledge of him, the titular limits of history. Given that we do in fact learn a good deal (...) about Conring from Fasolt’s book, we can only hope that the decapitation of its subject will be rectified in a subsequent edition, or perhaps by the restorative work of librarians putting together subject headings. And yet Fasolt’s decision is understandable, for Conring is indeed a stalking-horse for a much bigger quarry: historiography and the historical consciousness. By “history” Fasolt understands a way of imposing intelligibility on the world, which is founded on the twin assumptions that the past is gone and unchangeable, and that the meaning of texts can be determined by placing them in their historical contexts (ix). In challenging this mode of intelligibility, Fasolt is not attempting to improve professiona history—it’s already as good as it can be—but to displace it. He regards his work as a declaration of “independence from historical consciousness” (32). At the same time, Fasolt insists that he is not simply jumping from historiography to philosophy, or attempting to preempt history with ontology (37-39). That has been tried by Nietzsche and Heidegger, who have been tainted by Nazism (Fasolt thinks unfairly). It has also been attempted by modern philosophers from Gadamer to Foucault and Charles Taylor who, in failing to address the “violence” that its mode of intelligibility does to the world, have not succeeded in outflanking history. Perhaps, Fasolt wonders, it is only the personal experience of those who have been subject to this violence—the experience of those who have been subject to historical examination—that can break the spell of history. Fasolt’s disclaimer notwithstanding, in the course of these remarks I shall argue that he is indeed jumping from history to philosophy, or attempting to outflank history by subjecting it to a particular metaphysical understanding. I shall do so in part by sketching the recent intellectual history of this move—a historical examination that I hope inflicts as little violence as possible on Fasolt’s argument. (shrink)
