Gilbertson, Savulescu, Oakley and Wilkinson propose extending the availability of terminal sedation (TS) to patients with intractable pain and/or suffering who are expected to live more than 2 weeks (hence the designation of extended TS (ETS)) and to patients whose values are known but who do not have decision-making capacity.1 Their plan is worthy of serious consideration: it is, after all, based on the fundamental and well-recognised medical ethical values of patient autonomy and beneficence. But, even when restricted to jurisdictions (...) that allow assisted dying, the ETS proposal raises three important issues. When the authors speak of ‘assisted dying’ and of ‘Voluntary Assisted Dying (VAS)’, they refer specifically to the laws in Australia and similar ones in New Zealand, the Netherlands, Belgium, Luxembourg, Switzerland, Spain and Canada that permit clinicians either to provide patients with lethal medications for self-administration (formerly called physician-assisted suicide) or to administer lethal medications themselves (voluntary euthanasia). If the discourse of manners and customs aspires to a stable fixing of subjects and systems of differences, however, its project is not and never can be complete. This is true if only for the seemingly trivial reason that manners-and-customs descriptions seldom occur on their own as discrete texts. They usually appear embedded in or appended to a superordinate genre, whether a narrative, as in travel books and much ethnography, or an assemblage, as in anthologies and magazines.6 In the case (...) of travel writing, which is the main focus of this essay, manners-and-customs description is always in play with other sorts of representation that also bespeak difference and position subjects in their own ways. Sometimes these other positioning complement the ideological project of normalizing description, and sometime they do not.In what follows, I propose to examine this interplay of discourses in some nineteenth-century travel writing chiefly about Africa. While Barrow’s work is not prominent on anybody’s mental bookshelves these days, readers will recognize such names as David Livingstone, John Speke, James Grant, Richard Burton, Mungo Park, or Paul Du Chaillu. During the co-called opening up of central and southern Africa to European capitalism in the first half of the nineteenth century, such explorer-writers were the principal producers of Africa for European imaginations—producers, that is, of ideology in connection with the European expansionist project there. What I hope to underscore in these writings is not their tendency towards single, fixed subject positions or single, fixed systems of difference. Rather, I wish to emphasize the multiplicity of ways of codifying the Other, the variety of fixed positions and the variety of given sets of differences that they posit. European penetration and appropriation is semanticized in numerous ways that can be quite distinct, even mutually contradictory. In the course of examining discursive polyphony in these travel writings, I hope to stress the need to consider ideology not only in terms of reductive simplification but also in terms of the proliferation of meanings. 6. Two recent films by Pulitzer Prize-winning playwright, David Mamet, can provide opportunities for observing student reactions to ethically troublesome situations and for discussing business-communication ethics in the classroom. The key question addressed in this article is whether business-communication courses, for example, those in public relations, can encourage students to make the "metaphoric leap" and apply Mamet's messages to class readings and discussions on ethical problems or challenges. Through showing two films in their entirety and conducting focus groups among upper-level (...) undergraduates, the authors find that there is instructional value in using Mamet's films to discuss ethics in business-related settings. In "Time to Stop" (Analysis, 29,2, December 1968) Vernon Pratt argues that on a relativistic view of time the universe could not become static. Dilthey’s moral writings have received scant attention over the years, perhaps due to his apparent tendency toward relativism. This essay offers a unified look at Dilthey’s moral writings in the context of his Kantian-styled “Critique of Historical Reason.” I present the Dilthey of the moral writings as an observer of reason in the spirit of Kant, watching practical reason devolve into error when it applies itself beyond the bounds of possible experience. Drawing on moral writings from across Dilthey’s corpus, I (...) retrace Dilthey’s argument that moral theories from Kantianism and utilitarianism to natural law theory suffer significant motivational problems because of the way they transcend the “synthesis” of moral perception. Dilthey’s argument suggests that abstract moral theory is always bound to seem unmotivating and unreal from the standpoint of lived experience, and perhaps that, to avoid this, moral philosophy should confine itself to more situated, case-specific judgments. _The Gift of Death_, Jacques Derrida’s most sustained consideration of religion, explores questions first introduced in his book _Given Time_ about the limits of the rational and responsible that one reaches in granting or accepting death, whether by sacrifice, murder, execution, or suicide. Derrida analyzes Czech philosopher Jan Patocka’s _Heretical Essays in the Philosophy of History _and develops and compares his ideas to the works of Heidegger, Lévinas, and Kierkegaard. ABSTRACT:Guidelines and regulations for medical research recognize that the experiences of humans and animals both matter morally. They thus set a presumption against harming research subjects, whether humans or animals, and mandate that the harms subjects experience should be the minimal necessary for achieving the scientific aims of the study. Beyond this, guidelines and regulations place upper limits on the extent to which human, but not animal, subjects may be harmed. They also mandate that human, but not animal, subjects should (...) be compensated for the harms they experience. In this article, I argue that this common approach to regulating medical research is mistaken. In particular, there are upper limits on the extent to which animals may ethically be harmed in order to collect data to benefit others, and there are moral reasons to compensate them for the harms they experience. I conclude that guidelines and regulations for research with animals should be revised accordingly. (shrink)

David Alexander has argued that “weak inferential internalism” (WII), a position which amounts to a qualified endorsement of Richard Fumerton’s controversial “principle of inferential justification,” is subject to a fatal dilemma: Either it collapses into externalism or it must make an arbitrary epistemic distinction between persons who believe the same proposition for the same reasons. In this paper, I argue that the dilemma is a false one, for weak inferential internalism does not entail internalism simpliciter. Indeed, WII is compatible (...) with modest externalism, and so is consistent with what Armstrong calls “Type II justification,” the rejection of which leads to the arbitrary epistemic distinctions to which he rightly objects. Background: Current practice relies on patient-designated and next-of-kin surrogates, in consultation with clinicians, to make treatment decisions for patients who lose the ability to make their own decisions. Yet there is a paucity of data on whether this approach is consistent with patients' preferences regarding who they want to make treatment decisions for them in the event of decisional incapacity. Methods: Self-administered survey of patients at a tertiary care center. Results: Overall, 1169 respondents completed the survey (response rate = 59.8%). (...) Of the 229 respondents who had previously designated a surrogate, 78.2% wanted their surrogate to make treatment decisions in the event of decisional incapacity, whereas 21.8% wanted their doctors to make treatment decisions. Of the 822 respondents who had not designated a surrogate, 66.1% wanted their family to make treatment decisions, whereas 33.9% wanted their doctors to make treatment decisions. The most common explanation provided for why respondents wanted their surrogate or family to make treatment decisions for them in the event of decisional incapacity was the belief that loved ones knew the patient's treatment preferences. Conclusions: Contrary to current practice, 33.9% of respondents who had not designated a surrogate and 21.8% of those who had designated a surrogate indicated that they wanted their doctors to make treatment decisions for them in the event of decisional incapacity. Moreover, many of those who wanted their surrogates or family members to make treatment decisions explained this preference by citing a belief that loved ones knew the patient's treatment preferences. This belief is undermined by prior research that suggests that surrogates and family members frequently are unable to predict which treatments their charges would want. Future research should assess these two concerns with current practice and, where necessary, identify approaches to address them. (shrink)

The Zhuangzi text deploys two epistemic themes to accomplish its ends of combatting human pretensions to know the world and to prompting us to rediscover the world through fresh eyes. To get us to shed our arrogant dispositions it applies a constructive skepticism to whatever it is that human beings claim to know. To point towards a more constructive relationship with Nature, it articulates the stance of being a mirror to nature. David R. Loy addresses head-on the most pressing issues of Buddhist philosophy in our time. What is the meaning of enlightenment--is it an escape from the world, or is it a form of psychological healing? How can one reconcile modern scientific theory with ancient religious teachings? What is our role in the universe? Loy shows us that neither Buddhism nor secular society by itself is sufficient to answer these questions. Instead, he investigates the unexpected intersections of the two.

This essay argues for a concept of political identity that is fundamentally relational in nature contra more liberal accounts of identity that are atomistic. I consider John Rawls’ account of political identity in his Political Liberalism and provide a response stemming from Hannah Arendt’s account of political identity grounded in the existential condition of politics: human plurality. Using her concept of human plurality, I argue that political identity ought to be conceived as relationally individuated as opposed to atomistically so, meaning (...) that our identities only emerge in and through appearing before other political actors and not prior to it. The larger upshot is that conceiving of political identity as relational provides a more fruitful concept of the citizen and might allow progress to be made regarding some of the more entrenched political problems in American political culture, especially polarization and partisanship. How best go about protecting them? What trade-offs are involved in allocating resources to security problems? This book responds to these questions by stripping down our preconceptions and rebuilding an understanding of security from the ground up on (...) the basis of a common-sense ontology and an explicit theory of value. It argues for a clear distinction between objective and subjective security threats, a non-anthropocentric understanding of security, and a particular hierarchy of security referents, looking closely at four in particular-the ecosphere, the state, culture, and individual human beings. AtRepublic9, 583b1–587a2, Socrates argues that the pleasure of the philosophical life is the truest pleasure. I will call this the ‘true pleasure argument’. The true pleasure argument is divisible into two parts: 583b1–585a7 and 585a8–587a2. Each part contains a sub-argument, which I will call ‘the misperception argument’ and ‘the true filling argument’ respectively. In the misperception argument Socrates argues that it is characteristic of irrational men to misperceive as pleasant what in fact is a condition of neither having pleasure nor (...) being pained. In the true filling argument Socrates argues that in so far as pleasure entails somatic or psychic filling and there are more and less true fillings, there are more and less true pleasures. Philosophical filling is the truest filling and thus the truest pleasure. The misperception argument critically contributes to the true pleasure argument by clarifying what pleasure is not: merely an appearance or merely the absence of pain. The misperception argument thereby clears the ground for the constructive contribution of the true filling argument. (shrink)

MUCH RECENT SCHOLARSHIP HAS CALLED FOR THE INTEGRATION OF NATural law theory with biblical revelation, yet few writers have pursued such a project in detail. This essay presents the foundations of a constructive account of natural law grounded in an overlooked biblical text and in Reformed covenant theology, in conversation with contemporary biblical exegesis and recent Protestant and Roman Catholic literature on natural law. It explores the character of the Noahic covenant established with all creation (Gen. 8:20—9:17) and argues that (...) this covenant provides necessary theological foundation for understanding nature and common human moral obligations. This account of natural law provides a sound way to integrate natural law theory with the biblical narrative and to conceive of natural law as a universal God-given standard mediated through a fallen world.
