: Recent controversial decisions to terminate several large clinical trials have called attention to the need for developing a sound ethical framework to determine when trials should be stopped in light of emerging efficacy data. Currently, the fundamental rationale for stopping trials early is based on the principle that equipoise has been disturbed. We present an analysis of the ethical and practical problems with the "equipoise disturbed" position and describe an alternative ethical framework based on the principle of nonexploitation. This (...) framework acknowledges the need for balancing the dual ethical obligations of clinical research, the protection of human subjects and the generation of new medical knowledge. Based on this framework, we put forward a proposal to make early stopping guidelines more stringent under specified conditions. The temporary withholding of apparent benefits in certain circumstances is justified by achieving a fair contract with the research participants, one that protects them from undue harm and exploitation while reducing the many uncertainties surrounding new investigational treatments that arise when trials are stopped prematurely. The corporate social responsibility literature recognizes that firms’ existing CSR reputation can serve as a safeguard from the impact of reputation-damaging events on a firm’s social legitimacy. However, the literature has yet to focus on the extent to which CSR activities can help mitigate such damage, post-event. This article examines how a firm’s social actions following a product recall facilitate the recovery of its diminished social legitimacy. We test our predictions using a sample of 197 product recalls involving 168 publicly (...) traded corporations from 1999 to 2009 and demonstrate that the speed of the CSR response, the frequency of CSR activities, and the intensity of CSR activities have a significant effect on firm recovery following crisis. The effects were most pronounced in instances where the magnitude of the recall was most severe. The visibility of the recall has a limited impact on post-event recovery. We discuss our contributions to research on strategic CSR and recovery. (shrink)

A good deal has been written on the ethics of peer review, especially in the scientific and medical literatures. In contrast, we are unaware of any articles on the ethics of peer review in bioethics. Recognising this gap, we evaluate the extant proposals regarding ethical standards for peer review in general and consider how they apply to bioethics. We argue that scholars have an obligation to perform peer review based on the extent to which they personally benefit from the peer (...) review process. We also argue, contrary to existing proposals and guidelines, that it can be appropriate for peer reviewers to benefit in their own scholarship from the manuscripts they review. With respect to bioethics in particular, we endorse double-blind review and suggest several ways in which the peer review process might be improved. (shrink)

A number of recent theories of quantum gravity lack a one-dimensional structure of ordered temporal instants. Instead, according to many of these views, our world is either best represented as a single three-dimensional object, or as a configuration space composed of such three-dimensional objects, none of which bear temporal relations to one another. Such theories will be empirically self-refuting unless they can accommodate the existence of conscious beings capable of representation. For if representation itself is impossible in a timeless world, (...) then no being in such a world could entertain the thought that a timeless theory is true, let alone believe such a theory or rationally believe it. This paper investigates the options for understanding representation in a three-dimensional, timeless, world. Ultimately it concludes that the only viable option is one according to which representation is taken to be deeply non-naturalistic. Ironically then we are left with two seemingly very unattractive options. Either a very naturalistic motivation—taking seriously a live view in fundamental physics—leads us to a very non-naturalistic view of the mental, or else views in the philosophy of mind partly dictate what is an acceptable theory in physics. This paper aims to provide an overview of the conceptual terrain of what we call conative accounts of personal identity. These are views according to which the same-person relation in some sense depends on a range of broadly conative phenomena, especially desires, behaviours and conventions. We distinguish views along three dimensions: what role the conations play, what kinds of conations play that role, and whether the conations that play that role are public or private. We then offer a more detailed (...) consideration of direct private conativism—the version of conativism that we favour—before considering how conativists ought respond to a general worry, according to which any conativist view will lead us to be radically pluralist about persons. In this paper we argue that reflection on the patterns of practical concern that agents like us exhibit strongly suggests that the same person relation comes in continuous degrees rather than being an all or nothing matter. We call this the SP-degree thesis. Though the SP-degree thesis is consistent with a range of views about personal-identity, we argue that combining desire-first approaches to personal-identity with the SP-degree thesis better explains our patterns of practical concern, and hence gives us reason to (...) endorse such an approach. We then argue that the combination of the SP-degree thesis and the desire-first approach are best modelled by a stage-theoretic view of persistence according to which temporal counterpart relations are non-symmetric relations that come in continuous degrees. Ultimately, we think that the overall appeal of this package of views provides reason to accept the package: reasons that outstrip the reasons we have to endorse any particular member of the package. We provide a positive solution for Post’s Problem for ordinal register machines, and also prove that these machines and ordinal Turing machines compute precisely the same partial functions on ordinals. To do so, we construct ordinal register machine programs which compute the necessary functions. In addition, we show that any set of ordinals solving Post’s Problem must be unbounded in the writable ordinals.

Metaphysics is largely an a priori business, albeit a business that is sensitive to the findings of the physical sciences. But sometimes what the physical sciences tell us about our own world underdetermines what we should think about the metaphysics of how things actually are, and even how they could be. This chapter has two aims. The first is to defend a particular conception of the methodology of a priori metaphysics by, in part, exemplifying that methodology and revealing its results. (...) The second is to present a new account of holes. These two aims dovetail nicely. We are independently interested in providing a better analysis of the concept <hole> that yields a more plausible metaphysical story about holes. But focusing on holes is also a good way to explore the methodology we endorse: for this is an area of metaphysics that is sufficiently self-contained and narrow in focus that it provides a manageable case study, while at the same time raising interesting and deep issues about the nature of space. Ultimately we defend a new, functionalist, analysis of holes, which, unlike its rivals, neither misidentifies nor renders us implausibly eliminativist about holes under various different metaphysical suppositions about the nature of space. In the process, we set out the complex relations between the intension of “hole,” and its extension at various worlds under different suppositions about the nature of space. In explicating these relations our account exemplifies what we take to be the core methodology in a priori metaphysics. (shrink)

The paper defends a combination of perdurantism with mereological universalism by developing semantics of temporary predications of the sort ’some P is/was/will be (a) Q’. We argue that, in addition to the usual application of causal and other restrictions on sortals, the grammatical form of such statements allows for rather different regimentations along three separate dimensions, according to: (a) whether ‘P’ and ‘Q’ are being used as phase or substance sortal terms, (b) whether ‘is’, ‘was’, and ‘will be’ are the (...) ‘is’, ‘was’, ‘will be’ of identity or of constitution, and (c) whether ‘Q’ is being used as a subject or predicate term. We conclude that this latitude is beneficial, as it conforms with linguistic reality (i.e., the multiple uses actually in place) and also enables one to turn what is ordinarily perceived as a problem for universalist perdurantism viz., a commitment to all sorts of weird and gerrymandered temporally extended entities, into an advantage, for the richness in questions allows us to make sense of. Ismael aims for an understanding of the nature of an embedded perspective of agents in a world. If successful, this would explain a cluster of ways in which from an embedded perspective, we experience the world in an array of temporally asymmetric ways. Moreover, these are ways that have led many philosophers to rather metaphysically inflationary views about the nature of time, according to which time itself really is dynamical, and is characterized by the movement of an objectively (i.e., non-perspectival) (...) present. Ismael aims to explain these features of our experience without positing any such metaphysical picture. She argues that there are constraints which prevent us from taking this Olympian conception of the world and our place in it, and that these, jointly, explain why we experience the world in these temporally asymmetric ways. We take up two related questions. First, what it would mean to say that these constraints are not merely epistemic, and second, how far these constraints get us in explaining why we experience the world in these ways. (shrink)

This paper proffers an account of why interdisciplinary research on, inter alia, the nature of time can be fruitful even if the disciplines in question have different explanatory pro-jects. We suggest that the special sciences perform a subject setting role for lower-level disciplines such as physics. In essence, they tell us where, amongst a theory of the physical world, we should expect to locate phenomena such as temporality; they tell us what it would take for there to be time. Physical (...) theory tells us whether there is anything like that in the world and what its hidden nature is. Only working in tandem can physics and the special sciences locate and describe the phenomenon that is time. (shrink)

Harold Noonan has recently argued (2003) that one of Lewis’s (1983: 76– 77) arguments for the view that objects persist by perduring is flawed. Lewis’s argument can be divided into two main sections, the first of which attempts to show that it is possible that there exists a world of temporal parts or stages, and the second, which attempts to show that our world is such a world. If ever there were a time in which concerns about equality as a primary issue for social policy disappeared from public view, now is not that time. Recent work in economics on inequality has climbed to the top of best-sellers lists, and the issue was a major talking point in American midterm elections in 2014. The sheer bewildering volume of scholarship and discussion of equality makes it difficult to distinguish signal from noise. What, of all that we know about ways (...) in which we are equal and ways in which we are unequal, matters? If, as seems plausible, we neither are nor should desire to be equal in every respect that we could in theory be equal, in which ways ought we to care about being equal? Does the kind of equality of outcome — perhaps equality of income or wealth — that is frequently the focus of discussion matter most? Does opportunity matter more? What about less material forms of equality such as equality of status, or power, or authority? How do these various forms of equality interact with each other? The essays in this volume represent the work of a number of leading scholars from different disciplines on these questions. Drawing on sources in philosophical analysis, empirical science, and history, they sort through competing claims and counterclaims about the intuitions that drive our concern for equality. Their conclusions are not in unison, but nonetheless represent important advances in our attempts to grapple with this crucial social value. (shrink)

The democratic boundary problem arises because it appears that the units within which democratic decision procedures will operate cannot themselves be constituted democratically. The study argues that setting the boundaries of democracy involves attending simultaneously to three variables: domain (where and to whom do decisions apply), constituency (who is entitled to be included in the deciding body) and scope (which issues should be on the decision agenda). Most of the existing literature has focussed narrowly on the constituency question, endorsing either (...) the All‐Affected Interests Principle or the All Subjected Principle, but neither is satisfactory as a general solution. In particular, the former fails to explain why having interests at stake in a decision necessarily gives you the right to participate in making it, and the latter, although more plausible on that count, assumes that the domain and scope issues have already been settled. To make progress, we need to bring democratic values to bear on the boundary problem. The units we favour should be those that are likely to promote political equality and solidarity among members of the demos. Although this approach will often justify existing territorial states as sites of democracy, it can also generate arguments for making boundary changes along one or other dimension. (shrink)

This article attacks the view that global justice should be understood in terms of a global principle of equality. The principle mainly discussed is global equality of opportunity – the idea that people of similar talent and motivation should have equivalent opportunity sets no matter to which society they belong. I argue first that in a culturally plural world we have no neutral way of measuring opportunity sets. I then suggest that the most commonly offered defences of global egalitarianism – (...) the cosmopolitan claim that human lives have equal value, the argument that a persons nationality is a morally arbitrary characteristic, and the more empirical claim that relationships among fellow-nationals are no longer special in a way that matters for justice – are all defective. If we fall back on the idea of equality as a default principle, then we have to recognize that pursuing global equality of opportunity systematically would leave no space for national self-determination. Finally, I ask whether global inequality might be objectionable for reasons independent of justice, and argue that the main reason for concern is the inequalities of power that are likely to emerge in a radically unequal world. Nationalism is often dismissed today as an irrational political creed with disastrous consequences. Yet most people regard their national identity as a significant aspect of themselves, see themselves as having special obligations to their compatriots, and value their nation's political independence. This book defends these beliefs, and shows that nationality, defined in these terms, serves valuable goals, including social justice, democracy, and the protection of culture. National identities need not be illiberal, and they do not exclude other sources of personal (...) identity, such as ethnicity or religion. An ethics that gives weight to special relationships is more effective in motivating people to pursue justice and other values because it connects peoples’ duties to their identity; but this is consistent with recognizing some universal values, such as human rights. There are strong reasons for making the boundaries of states and nations coincide wherever possible, but in other cases, nations can achieve forms of self‐determination that fall short of full sovereignty. Multicultural arguments in favour of identity politics and special rights for minority groups ignore the benefits that such groups derive from participating in a shared national identity and the kind of democratic politics that such an identity makes possible. Although national identities are often said to be in decline in an increasingly globalized world, they serve such important purposes that our aim should be to rebuild them in a form that makes them more accessible to excluded cultural minorities.
