The article examines the compatibility of agonistic democracy and populism as well as their relationship to the idea of constitutionalism. The first part shows that Chantal Mouffe’s recent attempts to reconcile her normative approach of an agonistic pluralism with a populist style of politics are not fully convincing. Although there are undeniable commonalities between an agonistic and a populist understanding of politics – the appreciation of conflict, the rejection of moralistic and juridical modes of conflict resolution etc. – the populist (...) mode of the construction of the people (and the denunciation of political opponents as enemies of the people) risks impeding the transformation of antagonistic into agonistic modes of political contest. The tensions between agonism and populism are especially evident in matters of constitutionalism. This topic is examined in the second part of the article, which provides some ideas for reducing the normative and institutional blind spots of contemporary theories of agonistic democracy. It focuses on elementary principles for an agonistic concept of democratic constitutionalism that differs from the populist view of the relationship between politics and law, especially in respect of its interpretation of the concept of ‘resistibility’ of legal norms. Disability rights (DR) advocates have consistently opposed the legalization of physician-assisted dying (PAD) on the grounds that it wrongly discriminates against the disabled. This chapter distinguishes three variants of this objection. The first and perhaps primary one, based on “soft paternalism,” claims that PAD should not be legalized for the sake of those who might choose it. The second alleges that the laws harm all disabled people by encouraging support for PAD as the cheaper alternative to providing the disabled more (...) social support and protection from discrimination. The third alleges that legalized PAD harms all disabled people by expressing the denigrating message that their lives are less valuable than those of the able. The chapter finds that whatever the merits of the first two objections, DR advocates cannot consistently accept them while maintaining support for a legal right to reject unwanted treatment. It also finds grounds to doubt the cogency of the third objection. (shrink)

We present an argument for revising the theory of alternatives for Scalar Implicatures and for Association with Focus. We argue that in both cases the alternatives are determined in the same way, as a contextual restriction of the focus value of the sentence, which, in turn, is defined in structure-sensitive terms. We provide evidence that contextual restriction is subject to a constraint that prevents it from discriminating between alternatives when they stand in a particular logical relationship with the assertion or (...) the prejacent, a relationship that we refer to as symmetry. Due to this constraint on contextual restriction, discriminating between alternatives in cases of symmetry becomes the task of focus values. This conclusion is incompatible with standard type-theoretic definitions of focus values, motivating our structure-sensitive definition instead. (shrink)

There is ample discussion of MBA self-serving values in the corporate social responsibility literature, and yet empirical studies regarding the corporate manifestations and consequences of those values are scant. In a comprehensive study of major US public corporations, we find that MBA CEOs are more apt than their non-MBA counterparts to engage in short-term strategic expedients such as positive earnings management and suppression of R&D, which in turn are followed by compromised firm market valuations.

Drawing on attribution theory and expectancy violation theory, this study investigates the effect of corporate social responsibility (CSR) on stock market reactions in the context of intentional crises, during which stakeholders are likely to attribute crisis responsibility to the focal firm. Using a sample of Chinese listed firms from 2012 to 2022, we find that in the context of an intentional crisis, the stock market reacts more negatively to firms with higher prior CSR performance. Two contingency factors (i.e., media attention (...) and state ownership) strengthen this negative relationship. This study contributes to the CSR literature by broadening knowledge of the insurance-like effects of CSR and by identifying a “boomerang effect” of CSR in the context of intentional crises. According to the epistemic account of request normativity, a request gives us reasons by revealing normatively relevant information. The information is normative, not the request itself. I raise a new objection to the epistemic account based on situations where we might try to avoid someone requesting something of us. The best explanation of these situations seems to be that we do not want to acquire a new reason to do something. For example, if you know I am going to ask (...) you to read a draft of my paper, you might avoid running into me so as to avoid acquiring a reason to read a draft of my paper. I then argue that the epistemic account can successfully reply to this objection and that in fact the epistemic account does a better job of accounting for cases like this than competing views of the normativity of requests. Basedon several official pronouncements of the leading organs of the German Evangelical Church in the past decade on the ethical and internationallegal implications of the use of force either as collective action under the authority ofthe United Nations or by individual states, the article critically reviews the positions taken by the Church with regard to their consistency over time. In the early 1990s the Council of the German Evangelical Church clearly stated that peaceful means of conflict resolution generally take priority (...) over forceful means. However, in particular circumstances the use of force as ultima ratio cannot be ruled out. Recently, under the impact of the Iraq crisis, the positions taken were less strict. Due to a lack of a clear distinction between unilateral uses of force and enforcement action by the United Nations it remains unclear whether the Church still unequivocally holds on to its earlier ultima ratio stance. The paper argues that in view of the new challenges posed by global terrorism all social and political forces, including the churches, have to support the United Nations as the central institution for the maintenance of international peace and security which- inter aliis- requires the acceptance of the UN's competence to use enforcement measures in cases of grave breaches of peace including massive human rights violations as ethically and legally legitimate, provided the UN itself stays within the Iimits of the law. We agree that promoting intergroup harmony system-justifying and identify several ways in which and stereotypes, superordinate identification, intergroup contact, and prejudice reduction techniques can undermine social change motivation by reinforcing system-justifying beliefs. This may but it also prevents individuals and groups from tackling serious social problems, including inequality and oppression.

Though each of its four constituent essays has received scholarly attention in itself, Hume?s Four Dissertations (1757) has received virtually no consideration from scholars as a unified whole. This article offers such an assessment, and argues that two crucially Humean themes link the four texts. First, they show the applicability of Hume?s theory of the passions to a wide range of questions: to the philosophy of religion, to psychology, and to aesthetics. Second, they show Hume grappling with the tension between (...) his iconoclastic religious skepticism and his valorization of tolerant and sociable exchange between thinkers with differing views. Judith Jarvis Thomson and others contend that rights are pro-tanto rather than absolute, that is, that rights may permissibly be infringed in some circumstances. Alan Gewirth maintains that there are some rights that are absolute because infringing them would amount to unspeakable evil. However, there seem to be possible circumstances in which it would be permissible to infringe even those rights. Specificationists, such as Gerald Gaus, Russ Shafer-Landau, Hillel Steiner and Kit Wellman, argue that all rights are absolute because they (...) have implicit exceptions, the exceptions being either right-voiding or right-compatible. Specificationists have charged pro-tantoism with preventing rights from being action-guiding, and pro-tantoists have levelled the same charge against specificationism. I show that both charges are mistaken. Pro-tantoists claim that specificationists cannot account for the moral remainder that we recognise in some circumstances and which can be explained by reference to a permissible right-infringement. Specificationists retort that the moral remainder can be explained by invoking compensation-rights. I show that the pro-tantoist claim is true and that the specificationist retort is false on two counts: explanation in terms of compensation-rights is not applicable to all cases; and it fails to account for the moral dynamic in the cases to which it is applicable. The contention that rights are pro-tanto does not conflict with the substance of the contention that rights are trumps, despite claims of specificationists to the contrary. (shrink)

Scholars of ideology in social-scientific disciplines, including psychology, sociology, and political science, stand to benefit from taking seriously the philosophical contributions of Professor Peter Railton. This is because Railton provides much-needed conceptual precision—and a rare sense of epistemological and moral clarity—to a topic that is notoriously slippery and prone to relativistic musing and the drawing of false equivalences. In an essay entitled “Morality, Ideology, and Reflection: Or, the Duck Sits Yet,” Railton (2000/2003) aptly identified the purpose of ideological analysis as (...) the unmasking of “nonepistemic” interests—that is, interests other than truth-seeking, accuracy, or warrant —that contribute to the development, adoption, and dissemination of political and religious belief systems. We have just completed an exhausting nine‐month debate on the future of the Affordable Care Act. I see this debate as having ended—as of this writing—in a draw. After months of repeal efforts, Republicans in the House barely passed in early May, with a 217‐to‐213 margin, the American Health Care Act, which would have significantly amended the ACA. Republicans in the Senate spent the summer trying to arrive at amendments to the AHCA that could attract fifty of their fifty‐two votes, (...) but in the end, the clock ran out on their opportunity to enact an amendment without Democratic input. With this legislative failure, we appear to be in a stalemate. The Affordable Care Act remains in place as the law of the land, but the Trump administration seems committed to at best condemning the ACA to malign neglect and at worst actively undermining it at every opportunity. Given the political stalemate, the time is right to reassess the deeper issues at stake and ponder the prospects for a considered compromise on health reform. (shrink)

This paper examines footraces that are paced and unpaced, and runners who are pre-arranged, designated pacers and those who are not. Although pacesetting is commonplace in footraces today, the practice challenges our conception of sport competition, the nature of competitors and the meaning of records. For example, Bale calls paced races as ‘staged experiments’ to set world records and argues that pacers were crucial in the running career of Roger Bannister. In 2011, the International Association of Athletics Federation banned women’s (...) world records in mixed gender running events, like major marathons, because women were paced by male runners. By examining these cases and others, the authors here will claim paced footraces are qualitatively different than unpaced competitions, pacers introduce peculiar motives and intentions as competitors, women should not be denied opportunities to excel and perform at their very best, and the 2011 IAAF policy is unjustified. Jean-Luc Nancy is a prolific thinker, not only because of an abundant body of work—more than a hundred titles—but also and above all because his thought, in the form of an opening, encourages and invites us to think what he himself has not put into question. So it is with the category of “milieu”. This category, of which Georges Canguilhem in his time marked the contemporaneity, is more relevant today than ever. It enables us to think differently about our world, (...) and about what makes the world our world. Who makes the “we,” when we think through the “milieu”? How can we think from the relationship first and not from a primordial subject? How, therefore, can we think of another subjectivity, beyond the reflexive subjectivity of the human? This study aims to show the conditions in which Nancy’s work can contribute in a powerful way to a thought of being-together from an ecosophical point of view. (shrink)

This paper examines a single relevant source regarding Edmund Husserl’s transcendental phenomenology and his attempt to explain how we perceive and experience the Other. In the fifth chapter of the Cartesian Meditations, Husserl describes our encounters with others through a process of non-inferential analogy and details the ways we ‘appresent’ the Other. This unique and admittedly narrow approach to understanding intersubjectivity, I submit, offers significant insights regarding the nature of interactions between competing athletes and the meanings these experiences generate. The (...) descriptive-explanatory account of the ‘appresentation’ of the Other in sport presented here will not be exhaustive. But it will, I anticipate, be informative, supplement existing works in the phenomenology of sport, and appeal intuitively to some of our intersubjective experiences in competitive sport. (shrink)

For two and a half millennia readers of Aristotle have been struggling to understand just what sort of causation is being attributed to the Prime Unmoved Mover or PM, whether final or efficient, assuming that this supreme being could not be a material cause or even a formal cause of the entire cosmos. Fred Miller entered into this still ongoing debate with a fresh proposal, drawing on an almost incidental remark in GC 1.6.323a25-33 that was later picked up by Philoponus (...) in his commentary on Aristotle’s text. The fundamental question is whether the PM’s causal role is to be restricted to a case of final causation or is there evidence for efficient causation as well? Just how ancient this question of interpretation is can be clearly shown by the following remarks made by Simplicius in the first half of the sixth century in his Neo-Platonist commentary on Phys VIII.6.267b17-26:Simplicius goes on to argue in some detail for this dual picture, primarily because of his harmonizing approach to Plato and Aristotle, but also by referencing some very specific passages in other works—notably Cael, GC, DM—but also Met, albeit only from its first book (1361.11-1363.24). He starts out here by claiming that “[n]o one disputes that Aristotle calls god or the primary mover a final cause” but realizes that showing that the PM is an efficient cause as well needs some textual support, which he dutifully attempts to provide. We will be going over some of the same ground cited here in trying to articulate Aristotle’s conception of divine causation and in particular to decide if Fred Miller’s thoughts about the “untouched toucher” will help us in the overall endeavor to explore Λ.6-10. Since he points out (at p. 278) that the PM could hardly be a material cause or even a formal cause, his framing the issue as to whether the mode of causation here is exclusively efficient or exclusively final, or, on the other hand, both at once, seems very close to how Simplicius set up the problem. Indeed, he cites the same section of Simplicius’s commentary quoted above and finds this ancient perplexity a good jumping off point for his own attempt to shed light on a fundamental issue of interpretation, noting that if we balk at the Neo-Platonic suggestion that Aristotle’s PM “is on a par with Plato’s demiurge,” the question becomes: “in what way is the prime mover supposed to be an efficient cause?” (p. 279). Miller’s novel suggestion is that one way of dealing with this question is the thought that the PM is an “untouched toucher.” It is crucial to his picture that this suggestion is strongly tied to the prospect of finding “a way in which the unmoved mover of the cosmos could be a genuine efficient cause” (p. 287) and not I believe, as W.D. Ross may have held, an efficient cause only by being a final cause. This will become important when we explore what untouched touching would be quite generally, given the emphasis on the psychological dynamics of this sort of affective action as suggested by the everyday examples provided by both Aristotle and Philoponus. Esta posição partilhada e a procura de uma maior compreensão dos seus objetos de estudo específicos, criou nos profissionais de Arqueologia uma necessidade de recorrerem a várias metodologias (e tecnologias) originárias de outras disciplinas. De forma similar a outras ciências, a Arqueologia é uma área permeável à experimentação e aplicação de conceitos teórico-práticos exógenos que levou, inclusive, à formação de diversas especialidades que unem (...) a Arqueologia e outras áreas, como a Zooarqueologia. Como aconteceu ao longo da sua história, o meio académico está perante um momento de mudança na forma como se processa a aquisição de conhecimento. O fato de estarmos na Era Digital da globalização faz com que a adaptação do meio académico a esta realidade seja mais continuada, não sendo a Arqueologia alheia a esta transformação. Após uma breve introdução ao novo "paradigma digital" das humanidades, revemos alguns dos principais usos de tecnologias relacionadas com o uso da Internet no apoio à investigação em Arqueologia (e.g., bases de dados enriquecidas), e descrevemos algumas questões relacionadas com o uso de novas ferramentas e técnicas, seus principais obstáculos e tendências. The paper provides a deeper insight into institutionally given opportunities for and limitations to reflexive, dialogue-centered, and risk-sensitive knowledge exchange between scientific experts and agro-political decision makers, especially under the conditions of a significant degree of complexity, far-reaching uncertainties and potential impacts. It focuses on the practical orientations, guiding expectations and selection criteria shaping expertise in processes of science policy consulting. In doing so, two perspectives will be discussed: first the orientation of the knowledge production process by different concepts of (...) ‘‘usable knowledge.’’ Second, the influence of specific constellations on different stages of the political process, which shape the institutional conditions for the transfer and the use of scientific knowledge within the policy consulting process. Both perspectives help to come to a closer understanding of the demanding and very heterogeneous process of science policy consulting, which - if successful - leads to the interactive production of a very special form of ‘‘orientational knowledge.’’. In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

Building on previous works which argued that scalar implicatures can be computed in embedded positions, this paper proposes a constraint on exhaustification which restricts the conditions under which an exhaustivity operator can be licensed. We show that this economy condition allows us to derive a number of generalizations, such as, in particular, the ‘Implicature Focus Generalization’: scalar implicatures can be embedded under a downward-entailing operator only if the scalar term bears pitch accent. Este estudio recupera la idea de inconsciente del análisis fenomenológico de Edmund Husserl a fin de contribuir y apoyar la ciencia psicológica. Se realizó un estudio de investigación teórico-bibliográfica, llevando en consideración la propia trayectoria analítico investigativa del filósofo, buscando resaltar la importancia de este análisis para comprender el concepto de subjetividad y sus implicaciones para la reflexión sobre el tiempo, sobre la memoria y la afectividad, elementos que componen la historia individual y colectiva. Husserl valora la noción de inconsciente (...) vinculada a actos de afecto y de horizonte, cuyo contenido se evidencia en la síntesis asociativa pasiva, realizada en el fluir de la conciencia intencional. Concluye enfatizando la necesidad de considerar lo implícito en la experiencia humana en todos sus niveles, lo que incluye la cuestión del “enigma del inconsciente”, contribución esencial a la fundación de la Psicología y de las ciencias humanas. The similarity between ECs and PRCs is semantic: the interpretation of both is constrained by the interpretation of an antecedent. Le rôle des mathématiques dans la formation des officiers de l’armée néerlandaise, a profondément changé pendant le premier xixe siècle avec la fondation de l’Académie militaire en 1828. Les mathématiques étaient au centre de la formation. L’Académie était un des lieux les plus importants de diffusion des connaissances mathématiques aux Pays-Bas pendant la première moitié du xixe siècle, mais elle a perdu ce rôle pendant les années 1860-1870. Dans cet article, je me propose d’examiner à la fois les programmes de (...) l’Académie et le rôle central des enseignants de mathématiques de l’Académie dans la Société Mathématique néerlandaise et dans l’Académie royale des Sciences. Par ailleurs, l’évolution des mathématiques, visible dans ces deux institutions dans les années 1850, n’a pas entraîné une adaptation des programmes au sein de l’Académie. Ainsi, à partir de 1870, l’Académie a presque complètement disparu de la vie mathématique des Pays-Bas. The role of mathematics in the education of Dutch army officers changed dramatically in the early 19th century. This shift became visible with the founding of the Dutch Royal Military Academy in 1828, which shows the role of mathematics in military education shifting toward a purely pedagogical function. This change in approach, which primarily occurred in 1860’s, affected the standing and perception of an academy once highly respected in the field of mathematics. In the present work, I examine both the curricula at the Academy and the crucial role of the Academy’s mathematics instructors in the Dutch Mathematical Society and the Royal Academy of Sciences. Importantly, these two institutions managed to successfully adapt to the changing character of mathematical sciences that occurred around 185 Mathematicians at the Royal Military Academy, however, appeared to cling to an outdated view of mathematics. Failing to update their approach ultimately caused the Academy to lose its once prominent place in the Dutch mathematical community. (shrink)

This paper discusses gender, sexuality and race through the analysis of Ann Walker, who is a character in the Tv show Gentleman Jack (2019). It aims to focus on the encounter and on the latent desire between Ann and the series’ protagonist to then explore the tensions and established pacts within the limits of femininity, heterossexuality and whiteness, through an elusive gaze to the paranoid reading. Therefore, desire emerges as a theoretical-analytical category by the writings of Deleuze and Guattari (1997; (...) 1995) and Deleuze and Parnet (1998). Lugones’ theory (2014; 2007; 1994) on the coloniality of gender, purity and creativity also contributes to operating a racially aware analysis. Through her desire for the protagonist, Ann constitutes a pact with the demon, in Deleuzo-Gauttarian terms, which ambivalently culminates in the expropriation of herself and in the production of another self, elusive to the expectations of gender and sexuality, however sustained by the limits and possibilities of whiteness. An examination of these basic tenets is important for clarifying the philosophical rationale for conducting participant observation, making important research decisions, and appreciating the strengths and weaknesses of different approaches within the method. Participant observation as a formal means of inquiry is developed in close relation with the competing approaches of reality (ontology), truthfully apprehending reality (epistemology), and formal research (methodology). Dans un article récent publié sous le titre « The Sanctuary of Despoina at Lykosoura: A Megalopolitan Creation? », Alaya Palamidis remet en question les affirmations de Pausanias sur l’ancienneté de Lykosoura et de ses cultes ; elle fait l’hypothèse que le panthéon de Lykosoura est une création de Mégalopolis synécisée à partir d’emprunts à d’autres cultes de la région. Il a paru utile de revenir sur le sujet pour en revoir certains aspects (statut de Lykosoura au moment du synécisme (...) et absence de Despoina dans les sources écrites avant l’époque hellénistique), et pour cerner le caractère problématique de l’hypothèse qui sous-tend l’article, ce que suggérait déjà le point d’interrogation à la fin de la proposition affirmative du titre. Why do we so often defend the very social systems that are responsible for injustice and exploitation? In A Theory of System Justification, John Jost argues that we are motivated to defend the status quo because doing so serves fundamental psychological needs for certainty, security, and social acceptance. We want to feel good not only about ourselves and the groups to which we belong, but also about the overarching social structure in which we live, even when it hurts others (...) and ourselves. Jost lays out the wide range of evidence for his groundbreaking theory and examines its implications for our communities and our democracy. Drawing on twenty-five years of research, he provides an accessible account of system justification theory and its insights. System justification helps to explain deep contradictions, including the feeling among some women that they don’t deserve the same salaries as men and the tendency of some poor people to vote for policies that increase economic inequality. The theory illuminates the most pressing social and political issues of our time—why has it been so hard to combat anthropogenic climate change?—as well as some of the most intimate—why do some black children prefer white dolls to black ones and why do some people stay in bad relationships?
