Background: Ethical and legal issues are increasingly being reported by health caregivers; however, little is known about the nature of these issues in geriatric care. These issues can improve work and care conditions in healthcare, and consequently, the health and welfare of older people. Aim: This literature review aims to identify research focusing on ethical and legal issues in geriatric care, in order to give nurses and other health care workers an overview of existing grievances and possible solutions to take (...) care of old patients in a both ethical and legally correct way. Methods: Using a systematic approach based on Aveyard, a search of the PubMed, CINAHL, and Ethicshare databases was conducted to find out the articles published on ethical and legal issues in geriatric care. Ethical considerations: The approval for the study was obtained from UMIT-The Health and Life Sciences University, Austria. Results: Only 50 articles were included for systematic analysis reporting ethical and legal issues in the geriatric care. The results presented in this article showed that the main ethical issues were related to the older people’s autonomy, respect for their needs, wishes and values, and respect for their decision-making. The main legal issues were related to patients’ rights, advance directives, elderly rights, treatment nutrition dilemma, and autonomy. Conclusion: Further education for professional caregivers, elderly people, and their families is needed on following topics: care planning, directive and living wills, and caregiver-family member relationships to guide and support the elderly people within their decision-making processes and during the end-of-life care. The study is an intercultural comparison of the theory of reasoned action and the theory of planned behavior (original and modified versions) to predict students’ intentions for academic cheating. The sample included university students from 7 countries: Poland, Ukraine, Romania, Turkey, Switzerland, United States, and New Zealand. Across countries, results show that attitudes, perceived behavioral control, and moral obligation predict students’ intentions to engage in academic dishonesty in the form of cheating. The extended modified version of the theory of planned (...) behavior emerged as the best explanatory model predicting intentions to cheat. Significant cross-cultural differences were found and discussed. (shrink)

Within Ajzen's Planned Behavior Theory framework, this article tests a model to estimate the predictors of entrepreneurial intention in academic scientists working in Chile. We adapted into Spanish the entrepreneurship intention questionnaire. We tested the entrepreneurship intention model on a sample of 1,027 scientists leading research projects funded by the Chilean Scientific and Technological Development Fund, the country's primary scientific research grant. The results show strong empirical support for the entrepreneurship intention model proposed while highlighting some critical issues specific to (...) entrepreneurial intention in scientists. In particular, we found an indirect effect of perceived subjective social support on entrepreneurial intention, which is mediated by entrepreneurial attitude and perceived behavioral control toward entrepreneurship. These results suggest that policies orientated toward promoting academic entrepreneurship should include developing a healthy social environment toward it, meaning that entrepreneurial intention is not only an individual but an organizational challenge. These policies should analyze the social norms guiding the scientists' reference groups to increase their effectiveness. (shrink)

Preterm discharge effects: Relationship between the maternal experience and newborn's psychobiological regulation The purpose of this study is to investigate how the past experiences of mothers and their potentially traumatic events during pregnancy may have influenced the processes of psychobiological self-regulation and cognitive development in a child born preterm. Eighty children who had a gestational age of < 32 weeks were examined at the 9th month of the corrected age. The mothers and children were divided in two groups: multipara mothers (...) and their children and the primipara mothers and their children. These children were examined on the basis of sleep disorders, nutritional problems and mental development. Perinatal data from clinical observations and data from standardized developmental tests were used to describe the differences. The children of primipara mothers who had unexpected preterm delivery presented major incidences of sleep disorders while the children of primipara mothers, who programmed preterm delivery, presented a major incidences of nutrition problems. The predictability of preterm delivery has a major influence on the capacity of newborns for self-regulation in the case of primipara mothers. (shrink)

Background: As a non–European Union member state, Albania is increasingly orienting itself on Western models regarding human rights, patient rights, and legal regulations for healthcare. Due to its limited fiscal and legal power, enforcing legal and ethical regulations poses a major problem. Aim: The aim of this study is to investigate nurse’s knowledge and experiences regarding ethical and legal issues in Albanian elder care in state-funded and privately run institutions. Research design: The study was conducted using an inductive and qualitative (...) design, utilizing a focused ethnographic approach, based on Roper and Shapira’s framework. Method: Data were collected between June 2017 and September 2018 using participant observation, field notes, and semi-structured interviews with 15 nurses in seven different elder care institutions. In total, 100 h of observation and 15 interviews were performed. Data analysis was based on Mayring’s qualitative content analysis. Ethical consideration: The approval for the study was obtained from UMIT—The Health and Life Sciences University, Austria. Findings: The findings of the study fell into the following main categories: “Everyday care issues,” “End-of-life issues,” “Legal issues,” and “Ethical-legal education and conflicts.” Discussion: The participants reported many ethical and legal issues when describing their everyday challenges and displayed a strong lack of ethical and legal education. Despite a wide spectrum in the quality of care between private and state-funded nursing homes, older people mostly do not know their own diagnosis. Conclusion: This study indicates that further ethical and legal education is needed. Furthermore, nurses need to be better prepared for ethical conflicts with families, as strengthening patient rights could come into conflict with traditional rights of the Albanian family. (shrink)

Individuals who deviate from social norms by committing crimes may have reduced facial emotion recognition abilities. Nevertheless, a specific category of offenders – i.e. organised crime (OC) members – is characterised by hierarchically organised social networks and a tendency to manipulate others to reach their illicit goals. Since recognising emotions is crucial to building social networks, OC members may be more skilled in recognising the facial emotion expressions of others to use this information for their criminal purposes. Evidence of a (...) difference between OC and non-organised crime (NOC) offenders in terms of facial emotion recognition is still lacking. To fill this gap in the literature, we tested 50 OC, 50 NOC offenders, and 50 non-offender controls for their ability to identify six basic emotions (happiness, sadness, fear, anger, disgust, and surprise). All participants underwent a cognitive and psychological evaluation to avoid alternative explanations. Results show that OC members were more able to detect the expression of fear in others as compared to NOC. We interpreted this finding in light of the social context and the behavioural criminal attitude of OC members. (shrink)

El presente artículo aborda la estrategia escritural de Daniela Catrileo. Se propone revisar la elaboración del concepto de piñen examinando la relación entre lenguaje y colonialidad, para, de ese modo, subrayar el potencial político y reivindicativo que comporta en la novela del mismo nombre, Piñen (2019). Dicha hipótesis articulará el ejercicio de lectura aquí propuesto, atendiendo principalmente las estrategias narrativas empleadas –servirse de un polilingüismo que rompe estructuras gramaticales– para descentrar el lenguaje de su determinismo colonial. "Theory of mind� describes the ability to impute mental states, such as beliefs, desires and intentions, to oneself and to other people. Usually we want to know why people did what they did and we wonder what they are going to do next. That is, everyday we try to predict and explain human behaviour. In order to do this we refer to a person"s beliefs, desires, emotions, intentions etc. Behaviour is the product of belief and desire: People do things because (...) they desire something and believe some act will achieve it. For adults it is clear that our assumptions about reality do not necessarily match the real world; but we know, regardless of whether our beliefs are true or not, our beliefs direct our actions. In contrast, it is not until the age of 4 years that children understand that one can be mistaken about the world and that actions can be based on this false belief. (shrink)

The article provides a historical and philosophical analysis of the deportation of many Russian intellectuals abroad in 1922. It is known that such a vicious deed on the part of the Soviet authorities, in fact, turned out to be an act that saved many Russian intellectuals either from starvation or from repression and death in the camps. It is also widely known that the cultural activities of Russian emigrants after their arrival in the West were varied and intense. The article (...) also emphasizes that expulsion and its significance for the destinies of the country and the emigrants themselves remained a "blank spot" for a long time. It was only in the 1990s that research into the events of the 1922 exile, both in Russia and abroad, started to change. The author draws attention to the fact that the very nature of examination of the expulsion of the Russian intelligentsia has also changed over the years. At the beginning of studies in the 1990s, it was purely archival works aimed at recovering emigrants' cultural heritage and returning "forgotten" names. Over the last decade, we may observe a more critical reading of this heritage, supposing a more precise reconstruction of facts and contexts and a broader analysis of the significance of events in the history of the early 1920s. The study of the various cultural activities of the Russian migr intelligentsia allows us to strike a conversation on Russian philosophy, its peculiarity and originality, the mutual influences of the Russian and European philosophical traditions, and the meaning and significance of Soviet philosophy relevant again. The present article is devoted to a logical treatment of some fundamental concepts involved in responsibility attribution. We specify a theoretical framework based on a language of temporal deontic logic with agent-relative operators for deliberate causal contribution. The framework is endowed with a procedure to solve normative conflicts which arise from the assessment of different normative sources. We provide a characterization result for a basic system within this framework and illustrate how the concepts formalized can be put at work in (...) the analysis of examples of legal reasoning. This paper explores the perceptual space of Thomas A. Clark’s poetry and its links with the long and influential Western literary and artistic traditions of walking in the landscape, from Romanticism to Land Art. Particular attention will be given to the relations that Clark establishes in his writing between walking as a bodily practice and the multi-sensory engagement with the landscape it provides. It will be shown that Clark’s most significant contribution to the literature of walking lies in the balance (...) he creates between movement and stillness. In this dynamics, walking is envisaged as means of contemplation and communion to be found within the body, but which is at the same time directed towards the world, and the landscape appears as an infinite variety of perspectival views and as a dynamic process of discovery. El presente trabajo tiene por objeto delinear aquellos conceptos centrales de la narración en Walter Benjamin que se despliegan en las lecturas de los cuentos y relatos que forman parte del corpus central del movimiento jasídico. Para ello se analiza la concepción de la experiencia, el uso de las palabras y las alusiones del narrador en ese instante en que, a través del consejo, el maestro transmite sabiduría. El consejo no es una respuesta cerrada ni un saber exclusivo sobre los (...) aspectos metafísicos, sino que es –ante todo– la transmisión del aspecto de unificación del mundo, donde lo cotidiano devela su carácter inexplicable y lo trascendental –en un instante fugaz– se aproxima a la vida misma. Lo que narra el maestro jasídico sucede entre el cielo y la tierra, entre la vida práctica y la mística. La narración no abrevia: se despliega, da cuenta de lo inacabado, del requerimiento de la tarea del hombre en el mundo, de la labor paciente, insistente, del constructo de una artesanía que sólo la convicción –aquello más allá del mero y puro intelecto– y el amor a la letra del texto sagrado puede reavivar. Deleuze's theory of time set out in Difference and Repetition is a complex structure of three different syntheses of time – the passive synthesis of the living present, the passive synthesis of the pure past and the static synthesis of the future. This article focuses on Deleuze's third synthesis of time, which seems to be the most obscure part of his tripartite theory, as Deleuze mixes different theoretical concepts drawn from philosophy, Greek drama theory and mathematics. Of central importance is (...) the notion of the cut, which is constitutive of the third synthesis of time defined as an a priori ordered temporal series separated unequally into a before and an after. This article argues that Deleuze develops his ordinal definition of time with recourse to Kant's definition of time as pure and empty form, Hölderlin's notion of ‘caesura’ drawn from his ‘Remarks on Oedipus’ (1803) and Dedekind's method of cuts as developed in his pioneering essay ‘Continuity and Irrational Numbers’ (1872). Deleuze then ties together the conceptions of the Kantian empty form of time and the Nietzschean eternal return, both of which are essentially related to a fractured I or dissolved self. This article aims to assemble the different heterogeneous elements that Deleuze picks up on and to show how the third synthesis of time emerges from this differential multiplicity. (shrink)

Leading philosophical models of curiosity represent it as a desiderative attitude whose content is a question, and which is satisfied by knowledge of the answer to that question. I argue that these models do not capture the distinctive character of a form of curiosity that I call 'erotic curiosity'. Erotic curiosity addresses itself not to a question but to an object whose significance for the inquirer is affective as well as epistemic. This form of curiosity is best understood by analogy (...) to erotic love as theorized by Plato in the Symposium. (shrink)
