The composition of nitrogen-doped hydrogenated amorphous carbon films grown in a magnetically confined rf plasma-enhanced chemical vapour deposition system has been determined by X-ray photoelectron spectroscopy and compared with that determined using a combination of elastic recoil detection analysis, Rutherford back-scattering and nuclear reaction analysis. The importance of nitrogen doping or 'incorporation' in hydrogenated amorphous carbon films is discussed in relation to the significant variation in the sp 2 -to-sp 3 ratio that takes place. At 7 at.% N in the (...) a-C : H matrix, a critical change in the microstructure is observed, which governs the resulting mechanical, optical and electronic properties. Finally, the correlation between the sp 2 and sp 3 fractions determined by a non-destructive method of obtaining the bond fractions and by electron-energy-loss spectroscopy is discussed, with a view to evaluating accurately the sp 2 fraction in a-C : H : N films. Mathematicians often describe the importance of well-developed intuition to productive research and successful learning. But neither education researchers nor philosophers interested in epistemic dimensions of mathematical practice have yet given the topic the sustained attention it deserves. The trouble is partly that intuition in the relevant sense lacks a usefully clear characterization, so we begin by offering one: mature intuition, we say, is the capacity for fast, fluent, reliable and insightful inference with respect to some subject matter. We illustrate the (...) role of mature intuition in mathematical practice with an assortment of examples, including data from a sequence of clinical interviews in which a student improves upon initially misleading covariational intuitions. Finally, we show how the study of intuition can yield insights for philosophers and education theorists. First, it contributes to a longstanding debate in epistemology by undermining epistemicism, the view that an agent’s degree of objectual understanding is determined exclusively by their knowledge, beliefs and credences. We argue on the contrary that intuition can contribute directly and independently to understanding. Second, we identify potential pedagogical avenues towards the development of mature intuition, highlighting strategies including adding imagery, developing associations, establishing confidence and generalizing concepts. We defend a noetic account of intramathematical explanation. On this view, a piece of mathematics is explanatory just in case it produces understanding of an appropriate type. We motivate the view by presenting some appealing features of noeticism. We then discuss and criticize the most prominent extant version of noeticism, due to Inglis and Mejía Ramos, which identifies explanatory understanding with the possession of well-organized cognitive schemas. Finally, we present a novel noetic account. On our view, explanatory understanding arises from (...) meeting specific explanatory objectives. We defend a cluster-concept account of explanatory objectives and identify four important subfamilies within the relevant network of resemblance relations. The resulting view is objectivist (in the sense that it takes explanatory success to be a matter of observer-independent fact), broader in scope than why-question-based accounts, compatible with empirical findings on experts’ explanatory judgments, and capable of generalizing (with appropriate provisos) to scientific explanation as a whole. It thus fulfills Friedman’s half-century-old demand for a general and objectivist theory which accounts for the link between explanation and understanding. (shrink)

This paper presents a critical analysis of dual-class share structures (DCSS) within an ethical and logical framework for ownership and control. Moreover, it contends that the existence of DCSS constitutes a de facto infringement on the ownership rights of shareholders. By adopting a conceptual approach rooted in symbolic logic, the paper demonstrates that DCSS falls short of the ethical precept of “one share, one vote” and is therefore an unjust and inefficient equity arrangement. Can agents be duty-bound towards ends that are infeasible? Some scholars have endorsed a “feasibility constraint” on justice and answered that we cannot be duty-bound to bring about the infeasible. In this paper, I question whether the feasibility constraint on justice should still be endorsed and whether we are duty-bound to pursue some aims regardless of this constraint. I ask: Can an ethical agent be duty-bound to work towards bringing about a state of affairs that is desirable but infeasible? I (...) consider the climate crisis: climate justice may require us to work towards ends that may be infeasible, such as maintaining global climate warming below 1.5°C or mitigating climate change in a way that treats all people affected fairly. I argue that we may be duty-bound or obliged to work towards some desirable goals when faced with the infeasible and conclude that we should reject feasibility constraints on climate justice. This paper addresses the issue of how science and history of science may help or be helped by Vedic studies. The conclusions drawn are that: 1. Vedic studies are important for the history of Indian science; 2. Modern science, in particular physics, is not a useful source of philosophical ideas that confirm aspects of Vedic studies; 3. Vedic studies will not contribute to modern scientific research; and 4. Vedic studies are nevertheless centrally important for an understanding of Indian history and (...) culture in general. In this paper we report on our experiences with using network analysis to discern and analyse ethical issues in research into, and the development of, a new wastewater treatment technology. Using network analysis, we preliminarily interpreted some of our observations in a Group Decision Room session where we invited important stakeholders to think about the risks of this new technology. We show how a network approach is useful for understanding the observations, and suggests some relevant ethical issues. We argue that (...) a network approach is also useful for ethical analysis of issues in other fields of research and development. The abandoning of the overarching rationality assumption, which is central to network approaches, does not have to lead to ethical relativism. (shrink)

Background: Demand for organisational ethics capacity is growing in health organisations, particularly among managers. The role of clinical ethicists in, and perspective on, organisational ethics has not been well described or documented in the literature. Objective: To describe clinical ethicists’ perspectives on organisational ethics issues in their hospitals, their institutional role in relation to organisational ethics, and their perceived effectiveness in helping to address organisational ethics issues. Design and Setting: Qualitative case study involving semi-structured interviews with 18 clinical ethicists across (...) 13 health organisations in Toronto, Canada. Results: From the clinical ethicists’ perspective, the most pressing organisational ethics issues in their organisations are: resource allocation, staff moral distress linked to the organisation’s moral climate, conflicts of interest, and clinical issues with a significant organisational dimension. Clinical ethicists were consulted in particular on issues related to staff moral distress and clinical issues with an organisational dimension. Some ethicists described being increasingly consulted on resource allocation, conflicts of interest, and other corporate decisions. Many clinical ethicists felt they lacked sufficient knowledge and understanding of organisational decision-making processes, training in organisational ethics, and access to organisational ethics tools to deal effectively with the increasing demand for organisational ethics support. Conclusion: Growing demand for organisational ethics expertise in healthcare institutions is reshaping the role of clinical ethicists. Effectiveness in organisational ethics entails a re-evaluation of clinical ethics training to include capacity building in organisational ethics and organisational decision-making processes as a complement to traditional clinical ethics education. What makes Jehovah's Witnesses tick? What motivates practitioners of medicine? How is benevolent human behaviour to be interpreted? The explanation that fear of censure, mind-control techniques or enlightened self-interest are the real motivators of human conduct is questioned. Those who believe that man was created in "God's image", hold that humanity has the potential to rise above selfishly driven attitudes and actions, and reflect the qualities of love, kindness and justice that separate us from the beasts. A comparison of general (...) medical ethics and disciplines, and those of the Jehovah's Witness community, is made in this context. The easy charge that frequent deaths result from refusal of blood transfusions is examined. The central source of antipathy towards Jehovah's Witnesses, namely the alleged imposition of extreme and even harmful refusal of blood therapy on our children is addressed. Of course, "...few dilemmas are likely to be resolved wisely or satisfactorily by a blinkered adherence to abstract principles alone. Solutions to most cases will be dictated by a combination of factors. The support of medical ethics by Jehovah's Witnesses, and their willingness to share in reasoned and ethical debate, while at the same time holding firm to their religious and conscientious principles are emphasised. Throughout his lengthy career Arthur Danto made significant and original contributions to action theory, historical narrative, and epistemology. He became best known however for his work as an art critic in the Nation, Artnews and elsewhere, and for his philosophical publications on art theory, beginning with his early (1964) article “The Artworld.” In fact, Danto’s views on art are emblematic of his overall philosophy: he managed to reconcile conflicting philosophical sensibilities without short-schrifting them. He appreciates both Hegel and postmodernism, but (...) his own philosophy is a good deal less radical than most postmodernisms in that he denies that philosophy is a radically historicist enterprise. This article provides an ISCT analysis of commercial bribery focused on transaction cost economics. In the language of Antitrust, commercial bribery is a form of vertical arrangement subject to the same efficiency analysis that has found other vertical arrangements potentially beneficial to consumers. My analysis shows that actions condemned as commerical bribery in the Honda case may well have benefited Honda's dealer network once promotional free riding and other forms of rent seeking by dealers are considered. I propose that the (...) term "commercial bribery" should be avoided until after an ISCT analysis shows that the community is likely to have been harmed. The term "third-party payments" is a more ethically neutral term with which to begin the analysis. (shrink)

Zusammenfassung In diesem Artikel wird das neoliberale Modell von Rationalität dem Verständnis der Rationalität gegenübergestellt, das Fichte in der Grundlage der gesamten Wissenschaftslehre vorschlägt. Der erste Teil dreht sich um Foucaults Verbindung zwischen Gouvernementalität und Rational Choice Model. Im zweiten Teil werde ich die Handlungstheorie von Ludwig von Mises erörtern, die er in seinem Meisterwerk von 1940, Nationalökonomie. Eine Theorie des Handelns, aufarbeitet. Denn obwohl er die Rational Choice Theory nicht selbst formulierte, gilt er als beispielhafter Vertreter eines anthropologischen Musters, (...) in dem menschliches Handeln, Wahl, Rationalität und Wirtschaft eng voneinander abhängen. Im dritten Teil des Artikels kommt J. G. Fichte ins Spiel und seine in der Grundlage vorgeschlagene Rationalitätskonzeption zur Geltung. Denn die ganze Anthropologie von von Mises, auf welche sich die Möglichkeit des vernünftigen Handelns des homo oeconomicus überhaupt stützt, kann darauf zurückgeführt werden, was Fichte allein im zweiten, theoretischen Teil der Grundlage darstellt, dem Fichte allerdings einen dritten, praktischen Teil folgen lässt, in dem er die Gründung und die Rechtfertigung, ja die authentischen Bedingungen der Möglichkeit jenes theoretischen Handelns bzw. der Intelligenz in der Entfaltung der praktischen Vernunft darstellt. In recent years Michael Sandel’s communitarian criticism of John Rawls’s theory of justice has gained much attention in philosophical circles. Specifically, he takes issue with the conception of the self—implicit in Rawls’s “veil of ignorance”: an extraction of the individual from their social environment, which creates an “unencumbered self” that is then used to theorize about justice. Sandel believes that some social ties are so deeply embedded in the human experience that even hypothetical isolation of the individual is likely to (...) lead ethical thinking astray. In a recent article in this journal our unit was accused of a number of errors of judgment in applying covert video surveillance (CVS) to infants and children suspected of life-threatening abuse. The article implied, that on moving from the Royal Brompton Hospital in London to North Staffordshire Hospital, we failed to present our work to the Research Ethics Committee (REC). We did send our protocol to the REC though we did not consider that, after a total of 16 patients (...) had been documented as being the subject of life-threatening abuse, this was research. The REC in Staffordshire agreed with us. We were also accused of undertaking work that should be pursued by the Police. We agree with this. However, unlike the Metropolitan Police the Staffordshire Police would not undertake CVS. We fail to agree that 'working together' with parents is necessarily practical or safe when trying to protect children from life-threatening abuse of this kind. (shrink)

Here we suggest a formal using of N.A. Vasil’ev’s logical ideas in categorical logic: the idea of “accidental” assertion is formalized with topoi and the idea of the notion of nonclassical negation, that is not based on incompatibility, is formalized in special cases of monoidal categories. For these cases, the variant of the law of “excluded n-th” suggested by Vasil’ev instead of the tertium non datur is obtained in some special cases of these categories. The paraconsistent law suggested by Vasil’ev (...) is also demonstrated with linear and tensor logics but in a form weaker than he supposed. As we have, in fact, many truth-values in linear logic and topos logic, the admissibility of the traditional notion of inference in the categorical interpretation of linear and intuitionistic proof theory is discussed. A new understanding of the correspondence principle,an unexpected role of perturbation theory and, most of all, acriterion to reduce the set of consistent theories frominfinitely many to finitely many, are the key concepts of atheoretical set-up that appears to overcome in a natural wayvarious consistency problems of quantum mechanics and offerseveral hints for further developments.

Purpose. The aim of the article is to clarify the content of the concept of culture as an explication of vitality within the philosophy of life and its further modifications in current problems of contemporary. The analysis performed standing from the point, that contrasting of nature and culture is irrelevant, since culture does not contradict natural determinants and patterns, but rather qualitatively alters them. So, are justified the idea of culture as a phenomenon that exist accordingly and in proportion to (...) nature, need to form its potential and content and not contradict the axioms and values of life. Theoretical basis. In the theoretical field of philosophy of life, the local development of the problem of culture as an explication of vitality produces grounds for analytical and prognostic activity concerning meaningful transformations in a separate historical and social horizon. The fundamental categories of culture: spirit, value, symbol, freedom, justice and harmony receive the requested content and meaning. The idea of the constancy and super-naturality of cultural universals is illusory and dangerous. The consequences of such a "non-cosmological" justification of freedom and will, and the assertion of values, that contradict the logic of life, are the global environmental, economic and social crisis of our time. Originality. The originality of the authors’ thought lies in the interpretation of the essence of culture as an explication of vitality, as a logical and natural extension of life. In this formulation of the problem of culture, the possibility of reconciling the natural, social and value determinants of human life is formed. Theorists of the philosophy of life substantiated the primacy and supremacy of the values of life over the values and meanings of culture. The position of authors position consists in the need to understand culture as an environmentally appropriate and dimensional phenomenon, the content and strategies of which are determined by a single ontology. Conclusions. The analysis let authors understand the voluntarily chaotic element of life. Culture in its philosophical analysis took on a clearer anthropomorphic dimension: the immanent logic of being in substantiating the essence and purpose of man and the value of his being localized the universe of transcendence in the concept of "living world", "inhabited space", "human, too human". Accordingly, the range of cultural evaluations has been polarized: from the approving statement of its vital essence, to the disparaging calls for its reform. The chaotic state of voluntarily acts is transformed into cultural codes and stereotypes by rationalization. The modern global nature of crisis phenomena, both in the worldview, in the social, and in the ecological dimension, requires reformatting the understanding of culture as a continuation of nature, and not its antipode.
