The first part of this paper finds Craver’s (2007) mutual manipulability theory (MM) of constitution inadequate, as it definitionally ties constitution to the feasibility of idealized experiments, which, however, are unrealizable in principle. As an alternative, the second part develops an abductive theory of constitution (NDC), which exploits the fact that phenomena and their constituents are unbreakably coupled via common causes. The best explanation for this common-cause coupling is the existence of an additional dependence relation, viz. constitution. Apart from adequately (...) capturing the essential characteristics of constitution missed by MM, NDC has important ramifications for constitutional discovery—most notably, that there is no experimentum crucis for constitution, not even under ideal discovery circumstances. The Christian doctrine of the Trinity poses a serious philosophical problem. On the one hand, it seems to imply that there is exactly one divine being; on the other hand, it seems to imply that there are three. There is another well-known philosophical problem that presents us with a similar sort of tension: the problem of material constitution. Musical Platonists identify musical works with abstract sound structures but this implies that they are not created but only discovered. Jerrold Levinson adapts Platonism to allow for creation by identifying musical works with indicated sound structures. In this paper I explore the similarities between Levinson's view and Kit Fine's theory of qua objects. Fine offers the theory of qua objects as an account of constitution, as it obtains, for example, between a statue and the clay the statue is made out (...) of. I argue that Fine's theory does not adequately characterize the constitution relation and that the problems it faces extend to Levinson's account of musical works as indicated structures. I develop an alternative theory of constitution, based on the notion of being made out of. This approach to constitution enables me to offer an account of musical works as abstract objects that are constituted by sound structures. I argue that my account has several advantages over the Levinson/Fine approach. (shrink)

Adams and Aizawa, in a series of recent and forthcoming papers ((2001), (In Press), (This Volume)) seek to refute, or perhaps merely to terminally embarrass, the friends of the extended mind. One such paper begins with the following illustration: "Question: Why did the pencil think that 2+2=4? Clark's Answer: Because it was coupled to the mathematician" Adams and Aizawa (this volume) ms p.1 "That" the authors continue "about sums up what is wrong with Clark's extended mind hypothesis". The example of (...) the pencil, they suggest, is just an especially egregious version of a fallacy said to pervade the literature on the extended mind. This fallacy, which they usefully dub the "coupling-constitution fallacy", is attributed , in varying degrees and manners, to Van Gelder and Port (1995), Clark and Chalmers (1998), Haugeland (1998), Dennett (2000), Clark (2001), Gibbs (2001), and Wilson (2004). The fallacy, of course, is to move from the causal coupling of some object or process to some cognitive agent, to the conclusion that the object or process is part of the cognitive agent , or part of the agent's cognitive processing (see e.g. Adams and Aizawa (This volume) ms p.2). Proponents of the extended mind and related theses, Adams and Aizawa repeatedly assert, are prone to this fallacy in part because they either ignore or fail to properly appreciate the importance of " the mark of the cognitive" viz the importance of an account of "what makes something a cognitive agent" (op cit ms p.3). The positive part of Adams and Aizawa's critique then emerges as a combination of the assertion that this "mark of the cognitive" involves the idea that "cognition is constituted by certain sorts of causal process that involve non-derived contents" (e.g. op cit ms p.3) and that these processes look to be characterized by psychological laws that turn out to apply to many internal goings-on but not currently (as a matter of contingent empirical fact) to any processes that take place in non-biological tools and artifacts. In what follows, I shall try to show why these arguments display nothing so much as mutual failures of communication: crossed wires concealing a couple of real, important, but much more subterranean, disagreements. In particular, I try to show why the negative considerations advanced by Adams and Aizawa fail to successfully undermine the argument for the extended mind, and why their more radical positive story, unless supplemented by implausible additional claims, fails to cast doubt on the claim that minds like ours can (without the need for any radically new techniques, technologies or interventions) extend into the world. In metaphysics, the view that material constitution is transitive is ubiquitous, an assumption expressed by both proponents and critics of constitution views. Likewise, it is typically assumed within the philosophy of mind that physical realization is a transitive relation. In both cases, this assumption of transitivity plays a role in discussion of the broader implications of a metaphysics that invokes either relation. Here I provide reasons for questioning this assumption and the uses to which this appeal to transitivity is put. (...) This paper argues for interpreting Nietzsche along the lines of a self-constitution view. According to the self-constitution view, a person is a kind of creation: we constitute our selves throughout our lives. The self-constitution view may take more than one form: on the narrative version, the self is like a story, while on the Kantian version, the self is a set of principles or commitments. Taking Marya Schechtman’s and Christine Korsgaard’s accounts as paradigmatic, I take the self-constitution view to emphasize (...) practical considerations and the first person point of view and to conceive of the self as active in self-creation. The interpretation I offer can make sense of Nietzsche’s remarks about self-creation and of many of Nietzsche’s remarks about the self that would otherwise seem contradictory. In particular, Nietzsche’s anti-metaphysical remarks about the self fit well with the self-constitution view as long as they are understood as theoretical claims that do not undermine the importance of the practical point of view. The paper traces, historically and systematically, the influence of Carnap’s philosophical program on the writings of Nelson Goodman, focusing on the relationship between Carnap’s Aufbau and Goodman’s Structure of Appearance. In particular, drawing on unpublished material from the Carnap Research Archives, I show that Carnap had already anticipated Goodman’s criticism of the method of quasi-analysis and that Goodman misconstrued the status of this procedure on several counts. I also argue that Carnap’s anti-metaphysical stance left his approach with an explanatory deficit (...) which Goodman’s pragmatist pluralism is able to address. (shrink)

This paper analyzes the transformation from the human zygote to the implanted embryo under the prism of substantial change. After a brief introduction, it vindicates the Aristotelian ideas of substance and accident, and those of substantial and accidental change. It then claims that the transformation from the multicelled zygote to the implanted embryo amounts to a substantial change. Pushing further, it contends that this substantial change cannot be explained following patterns of genetic reductionism, emergence, and self-organization, and proposes Gustavo Bueno’s (...) idea of anamorphosis as a means to encapsulate criticism against such positions. This op-ed examines the philosophical foundation of the debate over the 1972 Constitution of Bangladesh and whether it requires reform or a complete rewrite. Reform would involve specific amendments to address current issues while rewriting would involve a full reconsideration to eliminate authoritarian elements and restore alignment with the democratic ideals of the 1971 Liberation War. This perspective emphasizes the need to return to the roots of the 1971 Proclamation of Independence, issued on April 10, 1971, by the Provisional Government (...) of Bangladesh in Mujibnagar. The proclamation championed the values of equality, human dignity, and social justice. Philosophy provides a framework for evaluating the Constitution’s core principles—nationalism, socialism, democracy, and secularism—and exposes how their misapplication has weakened democracy and marginalized citizens. A complete rewrite grounded in the first principles of equality, human dignity, and social justice could restore the Constitution’s role as both a moral and legal guide. Such an effort would ensure ethical governance and a democratic framework, providing stability and realigning the nation’s governance with its founding ideals. Omissions are metaphysically puzzling: Are they something or are they nothing? This paper develops and defends the constitution view of omissions, according to which a correct analysis of a person’s omission has the form “S omitted to X by Y-ing,” where her Y-ing is what constitutes her not-X-ing. The paper explains why the constitution view should be preferred to other views of omissions and defends the view against objections.

In her recent book Persons and Bodies1, Lynne Rudder Baker has defended what she calls the constitution view of persons. On this view, persons are constituted by their bodies, where “constitution” is a ubiquitous, general metaphysical relation distinct from more familiar relations, such as identity and part-whole composition.

This paper poses a problem of promiscuity for views that endorse material constitution as a metaphysic relation.

This paper is concerned with the notions of supervenience and mechanistic constitution as they have been discussed in the philosophy of neuroscience. Since both notions essentially involve specific dependence and determination relations among properties and sets of properties, the question arises whether the notions are systematically connected and how they connect to science. In a first step, some definitions of supervenience and mechanistic constitution are presented and tested for logical independence. Afterwards, certain assumptions fundamental to neuroscientific inquiry are made explicit (...) in order to show that the presented definitions of supervenience are virtually uninteresting for theory construction in this field. In a third step, a new formulation of supervenience is developed that makes explicit reference to the notion of constitution and that bridges the gap between the philosophical concepts and explanatory practice in neuroscience. Monists about material constitution typically argue that when Statue is materially constituted by Clay, Statue is just Clay. Pluralists about material constitution deny that constitution is identity: Statue is not just Clay. When Clay materially constitutes Statue, Clay is not identical to Statue. I discuss three familiar puzzles involving grounding, overdetermination and conceptual issues, and develop three new puzzles stemming from the connection between mereological composition and material constitution: a mereological puzzle, an asymmetry puzzle, and a structural puzzle.

In this paper, we develop an understanding of recognition in terms of individuals’ capacity for conflict. Our goal is to overcome various shortcomings that can be found in both the positive and negative conceptions of recognition. We start by analyzing paradigmatic instances of such conceptions—namely, those put forward by Axel Honneth and Judith Butler. We do so in order to show how both positions are inadequate in their elaborations of recognition in an analogous way: Both fail to make intelligible the (...) fundamental nexus between relations of recognition and individuals’ capacity for conflict. We then move on to reconsider aspects of Hegel's view of recognition—ones that, from our viewpoint, have been unjustly neglected in the debate about recognition: his focus on the constitution of relations of recognition in conflict and on the status of being an author of acts of recognition. On this basis, we then spell out in a more systematic way what we take to be a more convincing conception of recognition. This puts us in the position to gesture at some consequences of this conception in practical contexts, above all with regard to the justification, role and structure of political institutions. This paper addresses republican conditions of legitimacy for the constitution of the civic statuses of migrants. It identifies two legitimacy tests to which any civic status is subject, namely, that it does not make its bearers more vulnerable to the arbitrary exercise of private or public power and that the constitution of the person as bearer of this status is not itself the product of an arbitrary exercise of public power . It is argued that R1 puts significant constraints on (...) what can be legitimate migrant statuses and R2 links republicanism to cosmopolitanism in terms of a basic norm in respect of the production and allocation of civic statuses in that those who are subject to such a regime should have the effective power to ‘shape and contest’ the rules of this regime. Communitarians like Alasdair MacIntyre, Charles Taylor, and Michael Sandel, defend what we may call the ‘social constitution thesis.’ This is the view that participation in society makes us what we are. This claim, however, is ambiguous. In an attempt to shed some light on it and to better understand the impact its truth would have on our beliefs regarding autonomy, I offer four possible ways it could be understood and four corresponding senses of individual independence and autonomy. Narrative views of the self argue that we constitute our self in self-narratives. Embodied views hold that our self is shaped through embodied experiences. In that case, what is the relation between embodiment and narrativity in the process of self-constitution? The question demands a clear definition of embodiment, but existing studies remains unclear on this point (section 2). We offer a correction to this situation by drawing on Merleau-Ponty’s analysis of the body that highlights its habituality. On this account, the (...) body has an inherent tendency to cultivate an organization of habits through its history of engagement with the world (section 3). Next, we explore its role in narrative self-constitution by distinguishing between two aspects of the narrative self, the narrated I and the narrating I (section 4). We argue on phenomenological grounds that self-narratives are informed by bodily perspectives in both respects. Furthermore, a focus on the habituality of the body allows for a better explanation of self-constitution than those based on implicit self-narratives (section 5). For these phenomenological and theoretical reasons, we conclude that narrative self-constitution is an embodied and embedded practice (section 6). (shrink)

I argue that, against what is commonly believed, Spinoza’s use of the relation of constitution to characterize the relation between attributes and the essence of a substance does not indicate that, for him, there must be a numerical identity between each attribute and the essence constituted by that attribute. To do this, I follow a twofold strategy. First, I contend that the claim that because in Spinoza’s time constitution was understood as a one- to-one relation is mistaken: the main logicians (...) of Spinoza’s time, all Cartesian philosophers, believe that the constitution of an essence can be a many-to-one relation. I show that Spinoza can both accept that constitution is a many-one relation and share Descartes’ understanding of this relation. Second, I defend the claim that Spinoza’s use of constitution in the Ethics is consistent with these logicians’ account of constitution. In particular, I focus on Spinoza’s inclusion of the intellect in the definition of attribute and his definition of God. (shrink)

This article develops a discursive explanation of mixed constitution: mixed constitutional ideas and discourse generate mixed constitutional design and practice. On that base, it explores the nature, factors, and functions of the mixed constitution in Vietnam. The emergence of competing constitutional ideas (Confucian, socialist, liberal, universal) animates a constitutional discourse in which different actors adhere to different ideas. Consequently, the 2013 Constitution of Vietnam embodies a mixture of the ideas in its provisions on political institutions, economy, and especially human rights. (...) The enforcement of the constitution induces competing claims to constitutional meanings. The mixed constitution is shaped by path dependency and global diffusion of constitutional ideas. It functions as the base to constrain ideational monopoly and widen the public discourse on constitutional development. (shrink)

Since the post-August 5 discourse among public intellectuals has centered around op-eds and commentaries, the buzzwords "reform" and "rewrite" dominate discussions about our Constitution. But how many of us have paused to explore what these terms truly mean? In this commentary, I delve into the ongoing debate about reforming vs. rewriting Bangladesh’s Constitution. My op-ed explores the semantics of these terms and insinuates a bold argument: You don’t need to invoke the “spirit of 2024” to justify rewriting the 1972 Constitution. (...) Instead, the answer lies in returning to the core spirit of Bangladesh’s 1971 Liberation War: equality, human dignity, and social justice. Even substantial reformation may fall short to abolish all elements that contradict the Liberation War. A comprehensive rewrite is the only way to uphold the true spirit of our Liberation War and lay the foundation for a genuinely democratic Bangladesh, free from Hasinocratic authoritarianism. This paper builds a three-part argument in favour of a more transcendentally focused form of ‘postphenomenology’ than is currently practised in philosophy of technology. It does so by problematising two key terms, ‘constitution’ and ‘postphenomenology’, then by arguing in favour of a ‘transcendental empiricist’ approach that draws on the work of Foucault, Derrida, and, in particular, Deleuze. Part one examines ‘constitution’, as it moves from the context of Husserl’s phenomenology to Ihde and Verbeek’s ‘postphenomenology’. I argue that the term tends (...) towards different senses in these contexts, and that this renders its sense more problematic than the work of Ihde and Verbeek makes it appear. Part two examines ‘postphenomenology’. I argue that putatively ‘poststructuralist’ thinkers such as Derrida, Foucault, and Deleuze may be better characterised as ‘postphenomenologists’, and that approaching them in this way may allow better access to their work from a philosophy of technology perspective. Part three argues for a ‘transcendental empiricist’ approach to philosophy of technology. In doing so, it argues for a rewriting of contemporary philosophy of technology’s political constitution: since an ‘empirical turn’ in the 1990s, I argue, philosophy of technology has been too narrowly focused on ‘empirical’ issues of fact, and not focused enough on ‘transcendental’ issues concerning conditions for these facts.
