The reflection of global justice demands an innovative revision of traditional patterns of argument of political theory. How can moral responsibility be defined in connection with intergovernmental action? Ethical, institutional, and logical implications of a human legal foundation of intergovernmental justice are discussed in three theoretical chapters in this book. Further chapters deal with the structure of intergovernmental responsibility in connection with ethics of peace, humanitarian intervention, the fight against poverty, as well as migration. Cosmopolitanism in normative theory of transnational justice is often characterized by the thesis that the moral and legal status of states must be entirely derived from the moral status of the individuals who constitute them. Although the thesis itself is rather indeterminate in substantive and analytical content, it is generally understood as the claim that states should not be granted the status of moral and legal agents sui generis. This article argues that such a view is analytically and methodologically misleading, (...) and that any fruitful approach towards a liberal theory of transnational justice must face the challenge of coming up with a more complex concept of statehood, and acknowledge that in international relations and international law states are collective moral agents in their own right that can be addressees of genuinely collective forms responsibility. The argument starts with a critical examinations of two common interpretations of the cosmopolitan thesis, a reductivist reading, which suggests that we can reduce the moral and legal status of states to the rights and duties of the individuals (section I), and a methodological reading, which suggests that the moral status of individuals must based on the acknowledgment of “universal” individual rights (section II). For different reasons, both readings are argued to fail. Section III then presents an outline of how to conceive of states as agents that possess moral and legal status sui generis and be addressees of collective responsibility. Is sovereignty in Hobbes the power of a person or of an office? This article defends the thesis that it is the latter. The interpretation is based on an analysis of Hobbes’s version of the social contract in Leviathan . Pace Quentin Skinner, it will be argued that the person whom Hobbes calls “sovereign” is not a person but the office of government.

In a variety of disciplines, there exists a consensus that human rights are individual claim rights that all human beings possess simply as a consequence of being human. That consensus seems to me to obscure the real character of the concept and hinder the progress of discussion. I contend that rather than thinking of human rights in the first instance as “claim rights” possessed by individuals, we should regard human rights as higher order norms that articulate standards of legitimacy for (...) sociopolitical and legal institutions. Majority rule is an essential element of the institution of democratic government. In three steps, I will explore the conditions of its acceptance as a mechanism of pure procedural legitimacy. Starting from H.L.A. Hart's analysis of the concept «rule», I will argue that the validating conditions of rules are not normative beliefs or reasons, but essentially social patterns of conduct and reasoning that manifest themselves in political agency and discourse. Second, I will outline a normative rationale that defends majority rule (...) as a source of «political» legitimacy under conditions of social pluralism. Finally, I will explain why majority rule's legitimating potential requires that political agency and discourse accept the separation of the political sphere from private spheres. (shrink)

This paper offers an account of the property Feuerbach and Marx called “species-being,” the human being’s distinctive tendency to identify herself as a member of her species, and to think of the species as a “we.” It links the notion to Kant’s theory of rights, arguing that every claim of right commits the maker of that claim to something like world government, and therefore to the conception of humanity as a collective agent. It also links species-being to the concept of (...) practical identity, arguing that the conceptions under which we find our lives and actions valuable are ones according to which we make a positive contribution to the life of the species. It then argues that the resulting conception of humanity, together with certain considerations about the nature of the good, provides grounds for challenging the familiar claim that death is generally worse for human beings than for animals. On the other hand, because of species-being, the extinction of our species is a much worse prospect for human beings than for the other animals. (shrink)

This research aimed to inform nursing practice and policy by identifying satisfying and problematic experiences of hospital visitors during the hospitalisation episode of a significant other. An extensive contextual review revealed that healthcare systems in advanced economies face multiple pressures and that in England, the government leaves the determination of hospital visiting rules to individual trusts. The analytic lens of liminality provides rich interpretations of visitors’ accounts and demonstrates the importance to visitors of structure (hospital rules and systems) and communitas (...) (social bonding among liminal personae). Supportive hospital structures reduce the challenges of liminality and increase satisfaction. The data further suggest an extension to current understandings of liminality. Strong structure and successful communitas permit a safe exit from liminality after the hospitalisation episode for visitors with a close emotional bond with the patient. (shrink)

Indigenous communities have always cultivated social studies learning that is interactive, dynamic, and integrated with traditional knowledges. To confront the assimilative and deculturalizing education that accompanied European settlement of the Americas, Montana has adopted Indian Education for All (IEFA). This case study evaluates the Digital Storywork Partnership (DSP), which strives to advance the goals of IEFA within and beyond the social studies classroom through community-centered research and filmmaking. Results demonstrate the potential for DSP projects to advance culturally revitalizing education, community (...) connectedness, and identity-development. The DSP offers a model for social studies education that is not only culturally affirming and revitalizing for Indigenous communities, but also holds potential for use in all communities. We conclude with recommendations for educators, scholars, and community members engaged in similar efforts. (shrink)

Different types of sense organs are present on the larva of Drosophila. Several genes that specify the type of sense organ that will form at a particular position have been recently identified. Here we review the functional and molecular analyses of these genes, and summarize the evidence which supports a role in the choice of which type of organ will be formed. Most or all of these genes are required for the appropriate specification of adult as well as larval sense (...) organs, suggesting that the larval and adult systems share many gene requirements. Interestingly, the specifying genes identified so far in the peripheral nervous system are also expressed in subsets of cells in the central nervous system, where they might have similar roles. Film studies has largely avoided the biocultural turn that has swept through other areas of the humanities. This resistance may be understood in terms of the field’s recent distaste for grand theory—and in terms of the loose, social-constructionist thinking that is one residue of that distaste. Fortunately, a biocultural approach to cinema can offer film studies a necessary and defensible set of assumptions. It can also offer interpretive tools and potential ways of conceptualizing perennial concerns like authorship and genre. This (...) essay demonstrates the last two points through an evolutionary reading of Howard Hawks’s musical Gentlemen Prefer Blondes (1953) and through proposals for new ways of approaching auteurism and pornography. What makes a human voice agreeable is a matter of scientific discussion. Whereas prosody was shown to play a role regarding “male-female” attraction, the impact of frequency modulations in “non-sexual”, notably commercial, contexts has attracted little attention. Another point unaddressed in the literature is auditory sensitivity to short-term frequency modulations as current studies focus more on sentence. Thirty French female operators were recorded over the phone. All “bonjour” greeting words were classified in terms of frequency modulation linearity and orientation at (...) the syllable and word levels. Then, the different voices were played back to students and seniors who had to rate each voice according to their degree of agreeableness. Listeners preferred non-monotonous voices. Differences between age-classes were greater than between sex-classes. Results suggest that short-term frequency changes are important for auditory evaluation of voice agreeableness. This study opens new research perspectives concerning the importance of prosody during consumer-seller interactions. (shrink)

BackgroundThe spread of COVID-19 has disrupted the lifestyles of the world’s population. In the workplace, the pandemic has affected all sectors and has changed the way work is organized and carried out. The health sector has been severely impacted by the pandemic and has faced enormous challenges in maintaining healthcare services while providing care to those infected by the virus. At the heart of this battle, healthcare managers were key players in ensuring the orchestration of operations and the physical and (...) mental availability of employees during the crisis. Although few studies have been conducted to identify organizational practices or leadership skills to be adopted in a crisis context, the concrete behaviors of managers have not been documented yet. Therefore, this study aims at filling this gap by studying middle managers’ behaviors facing COVID-19 crisis in the healthcare sector.MethodsUsing a qualitative approach, eight focus groups were conducted online during the pandemic with 37 middle managers from the healthcare community of a Quebec health establishment from April to June 2020. Thematic analyses were conducted, and a mixed-methods approach was used to analyse the data based on Viitala’s hierarchical model of management skills.ResultsBased on the six managerial skills proposed in the model of Viitala, 21 specific management behaviors were identified as having been deployed by middle managers at the beginning of the pandemic. Considering that the health sector has been profoundly shaken by this health crisis, in addition to being an environment likely to experience other crises, managers need to develop practical skills in various crisis management situations. Thus, the results guide practitioners by highlighting the importance of team-oriented management behaviors, especially in a crisis context. (shrink)

A highly controversial issue in criminal law theory has been the use of strict liability offenses, i.e., offenses which create liability ‘without fault.’ The collection of strict liability offenses is varied according to the element of the particular offense with respect to which liability is strict. For example, a statute prohibiting the filing of a false financial statement with the Secretary of State might impose liability despite a reasonable error as to the truth of the statement, or as to the (...) financial nature of the statement, or as to the identity of the official in question. What all strict liability offenses have in common is the imposition of liability despite the possibility of reasonable mistake or due care regarding some important element of the offense. Generally, then, a strict liability offense is one to which a claim of no-negligence is not a defense. Indeed, such a claim will not even be heard. All that the prosecution need prove is the voluntary commission of the proscribed acts by the defendant; no other question concerning the defendant's efforts or opportunity to obey the law is relevant to liability or conviction. This phenomenological case study investigates how planning community-centered civics inquiries can prepare elementary pre-service teachers to better address inequities facing rural communities, including those located on Indigenous reservations. Specifically, the study addresses this research question: How does community-centered planning inform pre-service teacher readiness to support place-conscious and anti-colonial civics education within elementary contexts? Findings suggest that guided, community-centered planning leads to enhanced pre-service teacher confidence in preparing to facilitate equity-oriented elementary education, particularly as related to evolving understandings of civics content (...) competence, relational commitments, and responsibilities of rural teachers. Within the liberal framework, policies designed to rectify inequality generally take two forms: the formal equality option of equal treatment for everyone or the substantive equality option of "special" treatment for those whose difference continues to matter. Martha Minow argues that the framework creates a "dilemma of difference" because each option risks creating or perpetuating further disadvantages for members of oppressed groups. This paper examines the framework and the dilemma by highlighting the relational features of the language of equality and (...) of people who make determinations of equality. Relational insights are used to reexamine feminist work on care ethics, work considered to be hostile to equality analysis and justice theory. By providing a relational critique both of care ethics and of justice theory, I attempt to bring the two closer together by highlighting various connections. Care and justice are not entirely or always in opposition, but they inevitably interact and intertwine in ways that allow new possibilities and ways of being in social relations to emerge. (shrink)
