Ethical thought is articulated around normative concepts. Standard examples of normative concepts are good, reason, right, ought, and obligatory. Theorists often treat the normative as an undifferentiated domain. Even so, it is common to distinguish between two kinds of normative concepts: evaluative or axiological concepts, such as good, and deontic concepts, such as ought. This encyclopedia entry discusses the many differences between the two kinds of concepts.

Who owns frozen human embryos? Are "surrogate motherhood" arrangements dangerous for women? Should access to in vitro fertilization be limited or increased? With the development of complex reproductive technologies and the ensuing controversies in reproductive ethics, there is an urgent need for more careful examination of moral principles, current practices, and social policies pertaining to reproduction. The issues examined in this collection of nine papers focusing of the Canadian experience include abortion, the cryopreservation of embryos, the selective termination of fetuses (...) within multiple pregnancies, social policy for gestational "surrogacy," and the regulation of in vitro fertilization. It has now become a realistic prospect for smart care to be provided at home for those living with long-term conditions such as dementia. In the contemporary smart care scenario, homes are fitted with an array of sensors for remote monitoring providing data that feed into intelligent systems developed to highlight concerning patterns of behaviour or physiological measurements and to alert healthcare professionals to the need for action. This paper explores some ethical issues that may arise within such smart care (...) systems, focusing on the extent to which ethical issues can be addressed at the system design stage. Artificial intelligence has been widely portrayed as an ethically risky technology, posing challenges for privacy and human autonomy and with the potential to introduce and exacerbate bias and inequality. While broad principles for ethical artificial intelligence have become established, the mechanisms for governing ethical artificial intelligence are still evolving. In healthcare settings the implementation of smart technologies falls within the existing frameworks for ethical review and governance. Feeding into this ethical review there are many practical steps that designers can take to build ethical considerations into the technology. After exploring the pre-emptive steps that can be taken in design and governance to provide for an ethical smart care system, the paper reviews the potential for further ethical challenges to arise within the everyday implementation of smart care systems in the context of dementia, despite the best efforts of all concerned to pre-empt them. The paper concludes with an exploration of the dilemmas that may thus face healthcare professionals involved in implementing this kind of smart care and with a call for further research to explore ethical dimensions of smart care both in terms of general principles and lived experience. One major insight derived from the moral twin earth debate is that evaluative and descriptive terms possess different levels of semantic stability, in that the meanings of the former but not the latter tend to remain constant over significant counterfactual variance in patterns of application. At the same time, it is common in metanormative debate to divide evaluative terms into those that are thin and those that are thick. In this paper, I combine debates about semantic stability and the distinction (...) between the thin and the thick by presenting a new seamless inferentialist account of thin and thick evaluative terms which, despite subsuming them under the same metasemantic analysis, can nevertheless account for their varying levels of semantic stability. According to this position of ‘seamless metaconceptualism’, thin and thick evaluative terms do not belong to different categories, but are both understood as metaconceptual devices which do not differ in kind, but in scope. By providing the same analysis for both thin and thick terms, seamless metaconceptualism not only entails that the latter cannot shoulder the philosophical work that some have attributed to them, but also removes much of their surrounding intrigue. This article considers film as a form of artificial intelligence (AI). This non-anthropocentric hypothesis was first formulated in 1946 by filmmaker and theorist Jean Epstein and regards film as the thinking performance of a technical apparatus, the cinematograph, which is a manifestation of machine thinking based on the holistic entanglement of thought and world, film and philosophy. The article pursues an enquiry into ‘thinking’: one of the most prominent and oldest topics considered in philosophy, and also essential to art and (...) film. Thinking is not only characterised as a sense (like sight or taste) but as a creative and, ultimately, intra-active act. The possibility of film as AI is approached not only from a Deleuzian angle, long appraised by film-philosophy, but also through questions recently raised by theories of artistic research and the speculative-materialist turn in contemporary philosophy. The latter have as a common denominator a strong critique of anthropocentrism in Western philosophy; the article enquires into this criticism from different angles and applies it to the main hypothesis of this analysis – to regard film as a form of AI. In organizational psychology the positive effects of democratically structured enterprises on their employees are well documented. However, the longstanding viability as well as economic success of democratic enterprises in a capitalistic market environment has long been contested. For instance, this has given rise to widespread endorsement of the “degeneration thesis” and the so-called “iron law of oligarchy”. By reviewing 77 qualitative studies that examined 83 democratic enterprises within the last 50 years, the present systematic review provides evidence that such enterprises (...) are able to economically survive and prosper. The majority of studied enterprises either resisted pressures toward degeneration or subsequently regenerated after undergoing degenerative processes. Only 9.5% fully degenerated in accordance with the degeneration thesis and the “iron law of oligarchy”, while 27.0% of the democratic enterprises showed diverse and mixed forms of degeneration tendencies, indicating that the notion of an “iron law” needs to be revised. Within the nine investigated cases of Mondragon not one single enterprise or group fully degenerated. Three cases showed degenerative tendencies, another three one degeneration tendencies and simultaneously regeneration, one case fully resisted degeneration tendencies and two cases regenerated. Further, this systematic review provides an overview of organizational and external conditions, non-/democratic or non-/participative practices and psychological phenomena that contribute to the degeneration, regeneration, or resistance to degeneration. The described examples of such practices may help practitioners to implement and maintain democratic structures and processes in contemporary organizations. (shrink)

The historic Christian tradition of offering hospitality to strangers provides moral, theological and practical insights for contemporary responses to the needs of refugees, asylum seekers and immigrants. Ancient writers were explicit about the difficulties, blessings, and necessity of welcoming strangers. In this paper, specific components of the tradition, especially as they are evident in the writings of Chrysostom, Calvin and Wesley, are discussed. Suggestions are offered for points of intersection with contemporary concerns related to asylum and immigration.

This article presents the results of an evaluative research on the impacts of collaborative research in the evolution of the practices of researchers and associated teachers. It was a question of understanding how the collaborative approach was useful and relevant to the participants, how it enabled them to better take ownership of their role as an associate teacher, and how to transform their practices.

Wild horses are becoming dependent on transitional environments between domesticity and wildness. In Dutch new nature areas they are learning to perform roles as ecological surrogates for their extinct ancestors. In the U.S. wild horses are 'feral' and exist in numbers deemed to be in excess of the carrying capacity of semi-arid public range lands. The federal government is removing and relocating thousands to long-term holding pastures. The capabilities approach of Nussbaum (2006) allows us to evaluate this transitional environment against (...) a threshold of opportunities to exercise capabilities judged to be central to their flourishing as wild horses. I shall hear address the question of whether or not feminist philosophers should accept Kantian markers for the boundary between the aesthetic and nonaesthetic realms. I shall look at the way gender operates at the point in Kant's philosophy at which the aesthetic and ethical attitudes intersect: in the experience of the sublime. As we shall see, the later developments within the Kantian system mean that women fit comfortably neither side of the aesthetic/ethical divide and, indeed, fall outside personhood altogether.

The role emotions play in the dynamics of cultural phenomena has long been neglected. The collection of articles recently published in Emotion Review provides an important first step into this necessary endeavor. In this commentary, we discuss this contribution by emphasizing the role epistemological parsimony should play in the future of this research agenda. The cultural behavior and emotions of chimpanzees is taken as reference.

Over the past decades, anti-cancer treatments have evolved rapidly from cytotoxic chemotherapies to targeted therapies including oral targeted medications and injectable immunooncology and cell therapies. New anti-cancer medications come to markets at increasingly high prices, and health insurance coverage is crucial for patient access to these therapies. State laws are intended to facilitate insurance coverage of anti-cancer therapies.Using Massachusetts as a case study, we identified five current cancer coverage state laws and interviewed experts on their perceptions of the relevance of (...) the laws and how well they meet the current needs of cancer care given rapid changes in therapies. Interviewees emphasized that cancer therapies, as compared to many other therapeutic areas, are unique because insurance legislation targets their coverage. They identified the oral chemotherapy parity law as contributing to increasing treatment costs in commercial insurance. For commercial insurers, coverage mandates combined with the realities of new cancer medications — including high prices and often limited evidence of efficacy at approval — compound a difficult situation. Respondents recommended policy approaches to address this challenging coverage environment, including the implementation of closed formularies, the use of cost-effectiveness studies to guide coverage decisions, and the application of value-based pricing concepts. Given the evolution of cancer therapeutics, it may be time to evaluate the benefits and challenges of cancer coverage mandates. (shrink)

Using humor, empathy, and improvisation to make science more accessible to the average person, the center has helped many scientists communicate more effectively about what they do. In many cases, this involves taking science down from the metaphorical “ivory tower” and bringing it into the comfort zone of students and people who may not have had a positive experience in science classes. A variety of metaphors are used to make science “come alive.” This is an interesting counter example to earlier (...) theories of metaphor and comedy such as the “disparagement theory” which described jokes as more successful if they relied on disparaging metaphors that build community through shared hostility. The metaphor approach builds community and creates inclusion through “social-facilitative functions of playful language”. When a scientist helps a layperson or student understand humorous metaphors, it communicates the literal meaning of terms, but also the contextual meaning, research practices, and the laboratory social setting. This is argued through examples of humor, comedy, and metaphor—a timely issue given current political discussions in the United States. (shrink)

This book shows students how to use the Three Pillars to make successful business decisions that manage risk (the Law Pillar) and create value (the Strategy Pillar) in a responsible manner (the Ethics Pillar). Through the Three Pillar framework, students will understand why law is a positive, value-creating force that enables them to (...) succeed in business. Framed ontologically in Maxine Greene's existential-phenomenological notion of Becoming, the author explicates Greene's Naming as a praxis within her own early teaching experiences through the interpretive methods of currere and teacher lore. This study evolves in epistolary conversation with Maxine Greene, teacher colleagues, and new teachers. It demonstrates the possibilities of applying critical (...) reflective and discursive dialogue to the tensions of a teacher's life of practice in order to identify the obstacles to and the opportunities of the Becoming of the teacher and the student(s) in the educational encounter. This phenomenological case study investigates how planning community-centered civics inquiries can prepare elementary pre-service teachers to better address inequities facing rural communities, including those located on Indigenous reservations. Specifically, the study addresses this research question: How does community-centered planning inform pre-service teacher readiness to support place-conscious and anti-colonial civics education within elementary contexts? Findings suggest that guided, community-centered planning leads to enhanced pre-service teacher confidence in preparing to facilitate equity-oriented elementary education, particularly as related to evolving understandings of civics content (...) competence, relational commitments, and responsibilities of rural teachers. Heterosexuality, which I define as a romantic and sexual orientation toward persons not of one's own sex, is apparently a very general, though not entirely universal, characteristic of the human condition. In fact, it is so ubiquitous a part of human interactions and relations as to be almost invisible, and so natural-seeming as to appear unquestionable. Indeed, the 1970 edition of The Shorter Oxford English Dictionary defines ‘heterosexual’ as ‘pertaining to or characterized by the normal relation of the sexes.’.

Feminists look critically at any infliction of pain on others, usually requiring that it be consensual, and often both consensual and for the benefit of the person afflicted. Most torture of women is not recognized under official definitions of torture because it is not performed by or with the consent of (government) officials. Women are, however, also victims of torture under official definitions as military or civilian prisoners or as members of defeated populations in war, and are more often subjected (...) to sexual torture, which until recently has not been understood either as torture or even a war crime. Rape, especially serial gang rape, it is argued, should be understood as torture, as the essence of torture is the use of severe pain to obscure or obliterate the victim's sense of agency. (shrink)

This article begins with discussing challenges encountered while managing the epistemology of legal modes of thinking and social science, and the limits of relying on discipline-based methodologies for the advancement of empirical legal scholarship. In then discusses two approaches to empirical legal training employed in New York. Through this, it seeks to demonstrate the strengths of collaborative research with illustrations of a cross-national collaboration. Empirical research on law is a multi-method phenomenon. Ideally, empirical legal training means that students need and (...) can further foster a background in a broad range of social science methods and in a set of methods that can use triangulation or juxtaposition to capture the factors that explain law as a social phenomenon. In seventeenth- and eighteenth-century London and Paris, growing numbers of poor alarmed notables and city officials who would come to view a policy of confinement as an appropriate social, economic, religious, and political solution. This work examines the motivations of patrons to support these institutions (called hospitals). In particular, this study looks at their support for the construction (or renovations) of chapels (e.g. chapel at La Salpêtrière and the chapel at the Lock Hospital) and their visitations to these hospitals. Vagrants, (...) beggars, prostitutes, and idlers of other sorts healthy or not were confined not necessarily for theirhealth but for their souls and for the social order of the city. The locations of these hospitals indicate a geographical isolation not only in their “placement” outside the city walls but even in the Christian charitable rhetoric or visitations by benefactors that emphasized their separateness. “Unclean livers” or destitute beggars were put on view so that the morally upright who patronized these institutions could view for instructional purposes and could be viewed for purposes of salvation, but remained as separate nonetheless. Great masses and grand sermons were heard in the chapels that adorned these institutions, but a clear policy of segregation existed that kept the godly patrons separate from the “polluted.”. A highly controversial issue in criminal law theory has been the use of strict liability offenses, i.e., offenses which create liability ‘without fault.’ The collection of strict liability offenses is varied according to the element of the particular offense with respect to which liability is strict. For example, a statute prohibiting the filing of a false financial statement with the Secretary of State might impose liability despite a reasonable error as to the truth of the statement, or as to the (...) financial nature of the statement, or as to the identity of the official in question. What all strict liability offenses have in common is the imposition of liability despite the possibility of reasonable mistake or due care regarding some important element of the offense. Generally, then, a strict liability offense is one to which a claim of no-negligence is not a defense. Indeed, such a claim will not even be heard. All that the prosecution need prove is the voluntary commission of the proscribed acts by the defendant; no other question concerning the defendant's efforts or opportunity to obey the law is relevant to liability or conviction. The integrative memory model formalizes a new conceptualization of memory in which interactions between representations and cognitive operations within large-scale cerebral networks generate subjective memory feelings. Such interactions allow to explain the complexity of memory expressions, such as the existence of multiples sources for familiarity and recollection feelings and the fact that expectations determine how one recognizes previously encountered information.

ABSTRACT The problem of the captivated gaze has been taken up repeatedly in philosophy. Plato's Allegory of the Cave stands paradigmatically for this. Here, the gaze at the shadowy images prevents people from taking the path to the sun. Denis Diderot's critical reinterpretation of Plato's Allegory of the Cave is less well known. In Diderot, the view of the artificial light images is just as captivating as Plato's shadow images. Unlike there, however, Diderot does not distinguish between perception and cognition (...) but instead focuses on the significance of the seemingly unimportant shift of the gaze within the cave. Diderot determines the starting point of the realisation of freedom in the liberation of one's own gaze from the captivation intended by third parties. Prerequisites for the liberation of the gaze are the realisation of an interruption. It is shifts in the alignment of the eyeballs that become visible here as lucid intervals and which, in Diderot, become the starting point of power analysis and the site of revolt and freedom practice. In this article, I will show how Diderot's demand for enabling the individual realisation of lucid intervals is not first and foremost an aesthetic, but a highly political one. The criteria of art, which are defined by Diderot and have not lost their relevance until today, are based on his explosive insight that the incessant captivation of the gaze stands in the way of democratisation. Here, we describe how Casas Grandes Medio period (AD 1200 to 1450) shamanic practices of the North American Southwest used tobacco shamanism, a ritual stance called the Tennessee Diviner (TD) posture, and cultural expectations to generate trance experiences of soul flight and divination. We introduce a conceptual model that holds that specific trance experiences are the emergent result of human minds interacting with additional factors including entheogens, cultural expectations, physiological states, postures/movement, and sound/stimulation. Experimental and ethnographic evidence indicates initiating trance (...) with either tobacco intoxication or the TD posture accompanied with a rapidly beating drum or rattle corresponds with perceptions of soul flight, transformation, and divination/information acquisition. Both have similar results but pairing them together as they were during the Medio period likely helped ensure the culturally desired trance experiences. This practice of mutually reinforcing factors was likely part of tobacco‐based shamanism found in other New World cultures as well. We suggest our general model can be applied to other contexts to examine how various aspects of trance induction interact to produce the cultural patterns (and resulting cosmological and spiritual frameworks) anthropologists have documented in other cultures. What would a person look like if she were to possess a virtue like compassion or courage? This is the question that will come to mind when contemplating the hau.

In this paper, I develop an expressive account of disrespect according to which an action becomes disrespectful in virtue of making an explicitly or implicitly demeaning statement about its target’s moral standing. On my reading, we act disrespectfully whenever we (in word or deed) spread the falsehood that some people can be treated worse than they in fact can be given the correct account of what we owe to each other. After elaborating on the content that renders an action disrespectful (...) and explaining how disrespectful actions come to acquire their distinctive content in the first place, I go on to defend my account against rival approaches and stress its usefulness in detecting a previously disregarded moral phenomenon, namely, the risk of causing moral confusion. I do so by arguing that, given our nature as social cognisers, disrespectful actions are particularly well-suited to pollute our beliefs about what we owe to each other and what is owed to us.
