This book offers a transnational perspective of evidentiary problems, drawing on insights from different systems and legal traditions. It avoids the isolated manner of analyzing evidence and proof within each Common Law and Civil Law tradition. Instead, it features contributions from leading authors in the evidentiary field from a variety of jurisdictions and offers an overview of essential topics that are of both theoretical and practical interest. Las artes visuales, marginadas de otras áreas del conocimiento, por la fragmentación epistemológica propi-ciada por el positivismo y con afán de responder al desarrollo vertiginoso y complejo de nuevas tecnologías, han perdido la más importante de sus tareas, la reflexión. La especulación sobre la acción artística y la entrega de juicios críticos acerca de sus manifestaciones implica la introspección y el pensar sobre sus procesos y parámetros de desarrollo. Imaginar y crear en las artes visuales se ha convertido en las (...) reacciones espontáneas resultantes de la intuición del instante, olvidando etapas importantes de concentración, abstracción, especulación y transformación de la experiencia estética. Hoy las artes son la provocación de una cadena de reacciones físicas: repulsión, sorpresa, rechazo, etc., de las transgresiones a la forma y no al fondo, hay un abismo entre el pensamiento y la razón. Hay un olvido de los contenidos, por los que lucharon Klee, Kandinsky, Arnheim o Gombrich y que hizo comprensible la obra de Cézanne, Duchamp o Beuys. Se trata de una reflexión sobre la importancia del dominio epistemológico en las artes visuales, una llamada a regresar a su conceptualización y a reconstruir la filosofía y la teoría del arte visual de nuestro tiempo. Estas disciplinas tienen un aspecto teórico referente a los conceptos que las sustentan, un aspecto técnico concerniente a los medios por los cuales se crea la obra o la acción artística y un aspecto poético, que establece un nexo entre quien crea la obra y quienes la perciben y contemplan, éstos entre sí y entre éstos y la obra. Lo anterior requiere de los conocimientos indis-pensables para reconocer y comprender tanto el excedente de sentido de las artes visuales como la socialización sus valores culturales, son indispensables las estructuras y concepciones teóricas porque, de un mismo objeto o acción se dan diversas interpretaciones igualmente válidas, siempre y cuando estén sustentadas cognoscitivamente. Las artes visuales son una unidad de saber, un conjunto de conocimientos unificados merced a ciertos principios, pero no es un cuerpo de verdades cerradas, al contrario, se hallan en relación permanente y dinámica con otros ámbitos cognoscitivos, influyen en algunos y son influenciadas por otros. La conceptuación de las artes visuales es valiosa porque tiene efectos directos en la forma de pensamiento, en la conducta y en las acciones y decisiones de los seres humanos, en virtud de que se conciben como generadoras de valores y bienes culturales. The aim of this study was to investigate the consistency between the self-reports and teacher ratings of students’ emotional and social inclusion at school as well as for their academic self-concept. The German version of the Perceptions of Inclusion Questionnaire (PIQ) was administered to 329 grade 8 students (50.8% female, Mage = 14.5 years, SDage = 0.5 years) and their teachers. First, the three-dimensional structure of both PIQ versions was confirmed by confirmatory item factor analysis. The  and  coefficients (...) demonstrated good reliability for all scales. Second, a correlated trait-correlated method minus one model provided evidence that the method-specificity of teacher ratings was larger than the consistency between the self-reports and teacher ratings. Third, the results of a latent difference model indicated that general method effects can partly be explained by a student’s gender or special educational needs. Finally, the low consistency between self-reports and teacher rating is discussed. (shrink)

Por medio de un ejercicio de lectura comparada, y siguiendo un método inductivo, el presente artículo identifica distintas formas de figurar o imaginar el cuerpo en un corpus de obras de la autora panameña Cheri Lewis G., observando las posibles relaciones, tensiones o contradicciones con este mismo tipo de representación ficcional en las obras narrativas de otras autoras centroamericanas contemporáneas. En los mundos ficcionales de la selección, por un lado, el cuerpo fragmentado, animalizado o hibridizado propone modos de contradecir, pensar, (...) resistir o criticar ciertos estándares opresivos hacia las mujeres; por otro, hace elaboraciones metafóricas sobre vínculos afectivos humanos con otras formas de vida, así como alegorías de la nación fragmentada. Este artículo analiza tres conceptos relacionados entre sí: la identidad, la nación y el concepto de frontera. Esto implica reconocer que la identidad, la nación y la frontera son unidades específicas de análisis y objetos de estudio en ciencias sociales. De este modo, se revisan distintas aportaciones teóricas con el objetivo de fundamentar una perspectiva coherente alrededor de estos tres conceptos, así como de las relaciones entre ellos. Se analiza, en primer lugar, el concepto de nación y su influencia bidireccional (...) con el concepto de identidad, y en segundo lugar, las condiciones históricas y actuales de los Estados-nacionales haciendo mención al caso mexicano. Nos parece que las actuales circunstancias sociales, culturales y políticas explican la emergencia de la identidad como objeto de análisis en ciencias sociales. (shrink)

Moving on to a higher level of schooling represents a crucial developmental challenge for children: studies have shown that transitioning to a new school context can increase the perceived importance of peer acceptance, popularity, and adaptation to the new social environment. The aim of this study was to investigate simultaneously the influence of interpersonal variables and personal variables on role-taking in bullying episodes from a longitudinal perspective. These variables were assessed on 41 children in their last year of kindergarten and (...) in their 1st year of primary school. The main longitudinal results showed that prosocial behaviors are more stable than hostile, victim, and outsider behaviors. Moreover, social preference—together with affective empathy—at t1 had a clear negative predictive effect on hostile roles at t2, while social preference had a positive effect on prosocial roles at t2. Social impact at t1 negatively predicted being a victim at t2. On the other hand, social preference at t2 was negatively predicted only by the victim role at t1. Social impact at t1 had a significant and negative effect on being victimized at t2 while was negatively predicted at t2 by the outsider at t1. Our study—even if exploratory—seems to highlight the existence of a specific, differentiate effect of two distinct social status indices on the participant role-taking in bullying episodes in the transitional period from kindergarten to primary school. Auxilio Social se convertía en una institución oficial del régimen franquista con la misión de cumplir, bajo el protectorado del Estado, unas funciones benéficas y político-sociales determinadas. A nivel local, en Almería, el trabajo que aquí se presenta tiene como objetivo aproximarse al estudio de dicha institución como (...) parte de un elemento perfectamente integrado y hasta necesario dentro del sistema totalitario que construye el primer franquismo. As research on meaning in work progresses, access to theoretically integrated, differentiated survey instruments becomes crucial. In response to this demand, the present article introduces ME-Work, a modular inventory to measure meaning in work. Derived from research findings on meaning in life, the ME-Work inventory offers three modules that can be used separately or jointly. Module 1 assesses four facets of meaning in work, i.e., coherence, significance, purpose and belonging; module 2 measures the subjective assessment of work as meaningful or (...) meaningless, and module 3 records the extent to which work is perceived as a source of meaning. We report on the development of the instrument and the results of an exploratory factor analysis in a pilot study of 115 working adults. A further study with 278 working adults provided evidence for construct and incremental validity. Relationships with meaning in life, mental health, job satisfaction, socio-moral climate, burnout and work as meaning were investigated. Confirmatory factor analysis supported the factor structure. Gender-specific analyses of the four facets of meaning’s differential predictive power provided additional insights. Practical implications and further research needs are discussed. (shrink)

Hearing loss in old age, which often goes untreated, has far-reaching consequences. Furthermore, reduction of cognitive abilities and dementia can also occur, which also affects quality of life. The aim of this study was to investigate the hearing performance of seniors without hearing complaints with respect to speech perception in noise and the ability to localize sounds. Results were tested for correlations with age and cognitive performance. The study included 40 subjects aged between 60 and 90 years with not self-reported (...) hearing problems. The subjects were screened for dementia. Audiological tests included pure-tone audiometry and speech perception in two types of background noise which was either co-located or spatially separated from the target speech. Sound localization ability was assessed and hearing performance was self-evaluated by a questionnaire. Speech in noise and sound localization was compared with young normal hearing adults. Although considering themselves as hearing normal, 17 subjects had at least a mild hearing loss. There was a significant negative correlation between hearing loss and dementia screening score. Speech perception in noise decreased significantly with age. There were significant negative correlations between speech perception in noise and DemTect score for both spatial configurations. Mean SRTs obtained in the co-located noise condition with amplitude-modulated noise were on average 3.1 dB better than with continuous noise. This gap-listening effect was severely diminished compared to a younger normal hearing subject group. In continuous noise, spatial separation of speech and noise led to better SRTs compared to the co-located masker condition. SRTs in MSNF deteriorated in modulated noise compared to continuous noise by 2.6 dB. Highest impact of age was found for speech perception scores using noise stimuli with temporal modulation in binaural test conditions. Mean localization error was in the range of young adults. Mean amount of front/back confusions was 11.5% higher than for young adults. Speech perception tests in the presence of temporally modulated noise can serve as a screening method for early detection of hearing disorders in older adults. This allows for early prescription of hearing aids. (shrink)

Partimos de unas reflexiones sobre el Racionalismo y el Historicismo como dos enfoques con perfiles epistemológicos claramente diferenciados, que llevan a quien en ellos se sitúe a muy diversos planteamientos respecto a cualquier cuestión de carácter social. Examinamos el alcance y potencial de ambos en su argumentación cuando pretenden dar cuenta del origen de la sociedad política y todo lo que ello representa, instituciones, valores… Esbozada esta cuestión se recala en el análisis jovellanista de la mujer. Jovellanos conoce bien ambos (...) enfoques, sus lecturas de los autores aquí citados están plenamente contrastadas y no son objeto de este trabajo; apuesta por el enfoque historicista inglés para comprender el rol femenino, para situar a las instituciones que le niegan su ingreso en su decurso histórico, y curiosamente convierte el modelo historicista en una vía de análisis y acceso a propuestas de una extraordinaria modernidad. Analizamos desde estos enfoques los planes de estudio en los que estamos inmersos. (shrink)

Childhood obesity, linked to a sedentary lifestyle and an unbalanced diet, is one of the main problems in today’s Western societies. In this sense, the aim of the study was to analyze students’ perceived satisfaction in physical education classes with learning strategies and engagement in learning and critical thinking as determinants of healthy lifestyle habits. The study involved 2,439 high school students aged 12–18 years (M= 14.66,SD= 1.78). Structural equation modeling was conducted to analyze the predictive relationships between the study (...) variables. The results showed that teaching, teaching mastery, and cognitive development are precursors to deep thinking on the part of students, indicators of the adoption of healthy lifestyle habits. These results reflect the importance of the methodology adopted by the teacher in order to positively influence the students’ habits. (shrink)

No doudt society have changed, in de middle of century, nothing of the kind would imagine. Now, prostitutes, outcast women, was looking the way to defend judical and individual mechanims what it esploit them, for that they used the "fourth power".

During the pandemic, civil society organisations adjusted their purpose to provide support to the most vulnerable. In the midst of the first wave, Superbergamo, an initiative that grew out of local activist associations, provided groceries and medicine to the elderly, the infirm and at-risk groups during the lockdown in Bergamo, Italy. This research analyses a newspaper article from Corriere della Sera published almost two years after the event, which tells the story of Stefano ‘Kino’, one of the volunteers of Superbergamo. (...) Using Critical Discourse Analysis, we show how the mainstream media normalised the story of Superbergamo to transform a critical, radical, leftist mutual aid practice, into an example of charitable volunteering. By omitting and recontextualising central elements, the article inscribed the mutual aid practice in a catholic narrative, stripping it of any critical afflatus of the status quo. Reframed within the catholic vocabulary by the Corriere della Sera’s weekly insert ‘good news’, the story of Superbergamo becomes one that reinforces the common sensical model of catholic charitable volunteering. Handwriting is a complex activity that involves continuous interaction between lower-level handwriting and motor skills and higher-order cognitive processes. It is important to allocate mental resources to these high-order processes since these processes place a great demand on cognitive capacity. This is possible when lower-level skills such as transcription are effortlessness and fluent. Given that fluency is a value in virtually all areas of academic learning, schools should provide instructional activities to promote writing fluency from the first stages of learning (...) to write. In an effort to determine if teaching handwriting enhances writing fluency, we conducted a systematic and meta-analytic review of the writing fluency intervention literature. We selected 31 studies: 21 true and quasi-experimental studies, 4 single-group design, 3 single-subject design, and 3 non-experimental studies, conducted with K-6 students in a regular school setting. A total of 2,030 students participated in these studies. When compared to no instruction or non-handwriting instructional conditions, teaching different handwriting intervention programs resulted in statistically significant greater writing fluency (ES = 0.64). Moreover, three specific handwriting interventions yielded statistically significant results in improving writing fluency, when compared to other handwriting interventions or to typical handwriting instruction conditions: handwriting focused on training timed transcription skills (ES = 0.49), multicomponent handwriting treatments (ES = 0.40), and performance feedback (ES = 0.36). There were not enough data to calculate the impact of sensory-motor and self-regulated strategy handwriting interventions on writing fluency. The significance of these findings for implementing and differentiating handwriting fluency instruction and guiding future research will be discussed. (shrink)

This paper describes the main drawbacks of extrapolating Noam Chomsky’s hypothesis about the existence of a Universal Grammar of language to the realm of morality as illustrated in Marc Hauser’s 2006 volume, Moral Minds.

The category of expressive speech acts has traditionally proven elusive of definition in contrast to other types of speech acts. This might explain why this group of speech acts has been less researched. The present paper aims to redress this imbalance by analysing the expressive speech acts performed by two groups of university students in two educational chats, carried out in English or in Spanish, respectively. The main purpose of the study is to find out if students express their emotions (...) when interacting online and, if the use of their mother tongue or not affects their performance of expressive speech acts in terms of frequency and type. To this purpose, Weigand’s taxonomy of speech acts was followed, since it provides a more systematic delimitation of the traditional category of “expressive acts”. Her distinction between emotives and declaratives was thus applied to the dataset under scrutiny. Results show that students opt for performing declarative acts but refrain from expressing their own emotions in an educational setting. As for the use of English or Spanish, no significant differences were observed, which reveals that the use of their mother tongue does not seem to affect the kind of acts performed. (shrink)

The aim of this article is to analyse Spanish conversational structure, more concretely, to investigate in depth the role of the third move, or follow-up, outside classroom discourse. Since first introduced by Sinclair and Coulthard, the follow-up move has attracted a great deal of attention, as proved by numerous studies. However, these studies have mostly focused on English while Spanish has been neglected. The present study intends to fill in this gap by analysing a corpus of 50 conversational exchanges in (...) Peninsular Spanish. The analysis is qualitative and based on Tsui’s conversational framework, which has proved methodologically useful. As results will show, the presence or absence of the third move in Spanish conversations seems to rely heavily on a gender-based distinction. (shrink)

Este trabajo rastrea los pilares definitorios de la Estética Cotidiana a partir del análisis de dos nociones básicas: desinterés y Einfühlung. Se aborda primero la tradición estética occidental erigida sobre estos conceptos, y después el posicionamiento diferencial de la estética japonesa. El artículo contrasta ambas posturas y sitúa a la Estética Cotidiana entre una y otra, argumentando su conexión con la estética japonesa como alternativa a la estética desinteresada y empática de Occidente.

The aim of the present study is to analyze individual differences in academic self-efficacy within a population of Unaccompanied Foreign Minors from the European cities of Ceuta and Melilla. Variables describing educational level and length of stay were considered in a sample of 377 individuals being cared for in different youth centers. Of these, 63.4% belonged to the group who had stayed at the center for less than 9 months and 36.6% reported a length of stay of more than 9 (...) months. The age of participants ranged between 8 and 17 years old. Once the quality parameters of the instrument were elaborated, reliability and validity was confirmed through Confirmatory Factor Analysis using Structural Equation Modeling methodology. Data collection was then initiated. The results overall indicate that 87.6% of those who completed the questionnaire reported a higher level of self-efficacy with regards to working with any classmate, whilst at the same time seeing themselves as capable of achieving good marks. ANOVA results indicated significant differences with respect to educational level and length of stay. In this regard, students who had received professional training and had been at the Center for more than 9 months, were the ones who developed greater academic self-efficacy for spending more time working when tasks were judged to be difficult. The results obtained demonstrate that any intervention will be positive as long as it promotes different institutions to develop strategies that cater to a length of stay of more than 9 months and target education, academic self-efficacy, socialization and strengthening the future workforce. Such interventions can be directed through new European, Spanish or local level policies. It is clear that institutions still have a lot of work left to do. (shrink)
