Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework ofdemocratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)

This article argues that cruelty, as a willingness to see or orchestrate the suffering of others, is not an unfortunate side-effect of neoliberal theories put into practice but is constitutive of the neoliberal project from its theoretical inception. Drawing on Lisa Duggan’s concept of ‘optimistic cruelty’ and treating the canonical texts of neoliberal economic theory as literary artefacts, the article develops this argument through a close reading of one of the central architects of the neoliberal project, the philosopher and economist (...) Friedrich Hayek. The first part of the article examines how Hayek attempts to justify the brutality of the market order he imagines – the catallaxy – by arguing that this brutality is the natural consequence of the spontaneous evolutionary processes that move civilisation forward. The second part brings to the fore the eugenicist undertones that suffuse this vision, despite Hayek’s apparent rejection of Social Darwinism. I analyse how Hayek’s market order operates through a series of disciplinary and biopolitical technologies that use pain, frustration, punishment and stigmatisation to eliminate bad habits, practices and subjectivities. These cruel mechanisms enable the catallaxy to sort between productive and unproductive lives to ensure that available resources are directed towards the former – even if it means that the others might be left to die. As such, cruelty is an affective atmosphere that permeates the catallaxy. (shrink)

People with mental illness are subjected to stigma and discrimination and constantly face restrictions in the exercise of their political, civil and social rights. Considering this scenario, mental health, ethics and human rights are key approaches to advance the well-being of persons with mental illnesses. The study was conducted to review the scope of the empirical literature available to answer the research question: What evidence is available regarding human rights and ethical issues regarding nursing care to persons with mental illnesses? (...) A scoping review methodology guided by Arksey and O’Malley was used. Studies were identified by conducting electronic searches on CINAHL, PubMed, SCOPUS and Hein databases. Of 312 citations, 26 articles matched the inclusion criteria. The central theme which emerged from the literature was “Ethics and Human Rights Boundaries to Mental Health Nursing practice”. Mental health nurses play a key and valuable role in ensuring that their interventions are based on ethical and human rights principles. Mental health nurses seem to have difficulty engaging with the ethical issues in mental health, and generally are dealing with acts of paternalism and with the common justification for those acts. It is important to open a debate regarding possible solutions for this ethical dilemma, with the purpose to enable nurses to function in a way that is morally acceptable to the profession, patients and members of the public. This review may serve as an instrument for healthcare professionals, especially nurses, to reflect about how to fulfil their ethical responsibilities towards persons with mental illnesses, protecting them from discrimination and safeguarding their human rights, respecting their autonomy, and as a value, keeping the individual at the centre of ethical discourse. Research on children’s ability to attribute false mental states to others has focused exclusively on false beliefs. We developed a novel paradigm that focuses instead on another type of false mental state: false perceptions. From approximately 4 years of age, children begin to recognize that their perception of an illusory object can be at odds with its true properties. Our question was whether they also recognize that another individual viewing the object will similarly experience a false perception. We tested 33 (...) preschool children with a task in which distorting lenses caused a small object to appear large and a large object to appear small. To succeed, children needed to recognize that a naive agent would falsely perceive the relative size of the objects and to correctly anticipate the agent’s actions on that basis. Children performed significantly better than chance in our false perception test, and there was a developmental progression in performance from 4 to 5 years of age similar to that seen in standard false belief tests. Our findings demonstrate that preschool children are capable of understanding that other individuals will be perceptually misled by illusory objects and that these false perceptions will influence their actions in predictable ways. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

ABSTRACT As we strive for a more polyvocal history of science, historians have placed increasing emphasis on local case studies as a way to globalize the field. This tension between the local and the global extends to the practice as well as the content of the history of science, as the field has begun to pay more attention not just to local case studies, but also to local cultures of historiography. Many historians of science want multiple historiographical voices that take (...) seriously the concerns and literatures in different linguistic and national contexts. As more journals urge translation into what are perceived as the dominant languages in “global” humanities discourses and scholars are encouraged to facilitate the Englishing of their historical research, many questions remain: In what ways does it make sense to nationalize or culturally locate individual cultures of the history of science? Is translation a democratic and positive force in the discipline, and/or does it kill local difference? Will it continue to be meaningful to talk about the history of science? A collective dialogue within the field depends on finding a way to take local diversity in historiography and epistemology seriously while translating that local difference into a meaningful common conversation. This essay considers the challenges of embracing multiple ways of knowing that might fall under the purview of the history of science, while wondering what that means for the coherence of the field as we move forward into the next century of work in Isis. This article analyzes Galileo's mathematization of motion, focusing in particular on his use of geometrical diagrams. It argues that Galileo regarded his diagrams of acceleration not just as a complement to his mathematical demonstrations, but as a powerful heuristic tool. Galileo probably abandoned the wrong assumption of the proportionality between the degree of velocity and the space traversed in accelerated motion when he realized that it was impossible, on the basis of that hypothesis, to build a diagram of the law (...) of fall. The article also shows how Galileo's discussion of the paradoxes of infinity in the First Day of the Two New Sciences is meant to provide a visual solution to problems linked to the theory of acceleration presented in Day Three of the work. Finally, it explores the reasons why Cavalieri and Gassendi, although endorsing Galileo's law of free fall, replaced Galileo's diagrams of acceleration with alternative ones. (shrink)

Background Ethical decision making in intensive care is a demanding task. The need to proceed to ethical decision is considered to be a stress factor that may lead to burnout. The aim of this study is to explore the ethical problems that may increase burnout levels among physicians and nurses working in Portuguese intensive care units . A quantitative, multicentre, correlational study was conducted among 300 professionals.Results The most crucial ethical decisions made by professionals working in ICU were related to (...) communication, withholding or withdrawing treatments and terminal sedation. A positive relation was found between ethical decision making and burnout in nurses, namely, between burnout and the need to withdraw treatments , to withhold treatments and to proceed to terminal sedation . This did not apply to physicians. Emotional exhaustion was the burnout subdimension most affected by the ethical decision. The nurses' lack of involvement in ethical decision making was identified as a risk factor. Nevertheless, in comparison with nurses , it was the physicians who more keenly felt the need to proceed to ethical decisions in ICU.Conclusions Ethical problems were reported at different levels by physicians and nurses. The type of ethical decisions made by nurses working in Portuguese ICUs had an impact on burnout levels. This did not apply to physicians. This study highlights the need for education in the field of ethics in ICUs and the need to foster inter-disciplinary discussion so as to encourage ethical team deliberation in order to prevent burnout. An attempt is made to answer this question by first analyzing the structure of Darwinian inheritance as it is exemplified in the current biological theory of evolution. Based on this analysis a generalized framework for Darwinian inheritance containing conditions which must be met by all proper Darwinian evolutionary theories is developed. Subsequently this framework is employed to assess, in part, the adequacy of Toulmin's evolutionary epistemology. Although Toulmin asserts that Darwinian inheritance operates in conceptual development, the framework is used to (...) show that the structure of concepts which he presents is unable to support the requirements for this kind of inheritance. It is critically important for emerging professionals in education to be sensitised to the ethical and moral responsibilities of their practice throughout their training and beyond. There is a wide disparity in contemporary practice in this regard, which points to a need for greater clarity and consistency in our thinking about ethics within education. Ethics in Education attempts to meet this need, and will be a valuable resource for students, teachers and researchers in education, health and social sciences. Health is a basic human right, and drug use represents a severe influence on people’s health. This qualitative study aimed to understand how health professionals in a public health-care team working with drug users in a city of the state of São Paulo, Brazil, perceive the human rights of these users and how these rights are being respected in health care. Data were collected through semistructured interviews with 10 health professionals at the service under analysis. A thematic analysis of the (...) interviews reveals the professionals’ difficulty to define the concept of human right and contextualize these rights in their work environment. A deeper understanding of the right to health, however, represents an important premise for a more humanized care practice in health services to drug users. (shrink)

This article analyzes the evolution of Mersenne's views concerning the validity of Galileo's theory of acceleration. After publishing, in 1634, a treatise designed to present empirical evidence in favor of Galileo's odd-number law, Mersenne developed over the years the feeling that only the elaboration of a physical proof could provide sufficient confirmation of its validity. In the present article, I try to show that at the center of Mersenne's worries stood Galileo's assumption that a falling body had to pass in (...) its acceleration through infinite degrees of speed. His extensive discussions with, or his reading of, Descartes, Gassendi, Baliani, Fabri, Cazre, Deschamps, Le Tenneur, Huygens, and Torricelli led Mersenne to believe that the hypothesis of a passage through infinite degrees of speed was incompatible with any mechanistic explanation of free fall. Transgender individuals and families throw existing taxonomic classification systems of identity into perplexing disarray, illuminating sociolegal dilemmas long overdue for critical sociological inquiry. Using interview data collected from 50 cisgender women from across the United States and Canada, who detail 61 unique partnerships with transgender and transsexual men, this work considers the pragmatic choices and choice-making capacities of this social group as embedded within social systems, structures, and institutions. Proposing the analytic constructs of “normative resistance” and “inventive pragmatism” to situate (...) the interactional processes between agency and structure in the everyday lives of this understudied group of cisgender women, this work theorizes the liminal sociolegal status of an understudied family form. In so doing, it exposes the increasingly paradoxical consolidation and destabilization of sociolegal notions of identity, marriage, normativity, and parenthood—challenging, contributing to, and extending current theoretical and empirical understandings of agency and structure in twenty-first-century families. While foregrounding the historiography of HIV and AIDS in the South African context, this article analyses AIDS as simultaneously existing in three spheres: first, virtually – as the subject matter of electronically measurable research; second, academically – as a topic of research in the discipline of History; and third, actually – as a complex health concern and signifier that, via the field of Medical and Health Humanities, could allow for new collaborations between historians and others interested in understanding AIDS. Throughout, (...) the central focus is the discipline of History and the global trends that become evident when examining metrics about AIDS research, particularly those that show the hierarchies of knowledge ‘production’, the reinforcement of disciplinary boundaries, and the discrepancy between the amount of research ‘produced’ by scientific and humanities disciplines. Overall, the article suggests that ‘post-AIDS’ is not currently helpful to health historians working on South African and other majority world contexts. More specifically, the article reflects on what AIDS histories still need to be written, and I argue that Medical and Health Humanities could provide a space for historians to work within and across disciplinary boundaries given the ever evolving remit of AIDS histories, temporalities, and narratives. This essay examines phrenological tools as instruments of matchmaking and focuses on the personal ad as a site for producing and exchanging knowledge about individuals. It shows how cranial measurement produced character profiles for the purpose of judging suitable marriage partners and how users integrated those profiles into personal advertisements published in the Water-Cure Journal. A popular but contested science of the mind, phrenology maintained that one could truly know others and oneself through measuring “organs” of the mind via protrusions (...) on the skull. While much has been written about phrenology, less attention has been paid to its focus on marriage and mating and to how users enrolled phrenology to find and judge the viability of a mate. Focused on the American context in the 1850s, this essay will show that notions of race and gender, heredity, and marital “relations” were embedded in the shorthand of phrenological measurements and personal ads. Based on a non-cognitivist meta-ethical position and an anti-subjectivist concept of “reality”, Hägerström questioned the pretension of traditional legal theory, especially legal positivism, to be a science of law, because the entities to which it refers are not real. Olivecrona succeeded in pursuing such a thesis while he tempered it. The fact that despite the efforts of contemporary jurists terms like ‘legal philosophy’, ‘legal theory’ and ‘jurisprudence’ do not have established meanings is one of the reasons behind the dispute regarding the function and validity of legal philosophy; a second issue worth considering is the transformations of law due to diverse influences such as globalization or theories on human rights. En este artículo se pretende establecer una base común para la discusión en torno a estos problemas mediante la revisión de algunas de las diferencias que las dos principales tradiciones occidentales para después describir la precepción general y evolución de la filosofía del derecho. The diagnosis of Fetal Alcohol Spectrum Disorders is embedded in a matrix of biological, social and ethical processes, making it an important topic for crossdisciplinary social and ethical research. This article reviews different branches of research relevant to understanding how FASD is identified and defined and outlines a framework for future social and ethical research in this area. We outline the character of scientific research into FASD, epidemiological discrepancies between reported patterns of maternal alcohol consumption during pregnancy and the incidence (...) of FASD, and the social and ethical considerations that may impact on who is, and is not, diagnosed. We highlight what further research investigating FASD diagnostic processes, as well as the multi-generational impacts of FASD, is needed. Important research priorities are to: 1) enumerate the variety of stakeholders involved in seeking FASD diagnoses; 2) understand the experiences and perspectives of mothers from different backgrounds who have consumed alcohol during pregnancy and their affected children; and 3) collect health histories of maternal alcohol consumption in families to determine the effect of FASD at sub-cultural and cultural levels. There is a widespread assumption in Construction Grammar (but also before and elsewhere) that the meanings of verbs correlate with or even determine their complementation forms and patterns. There is much less research on noun complementation, however, although this category is even more interesting for a number of reasons such as the potential for valency reduction, nominal topicalization constructions, and additional complementation options, e.g.of-PPs and existential constructions.In this paper we focus on the class of nouns reporting commissive illocutionary acts (promise, (...) offer, pledge, refusal, bet, threat, etc.), and address the question of whether there is a correlation (i) between the meaning of these nouns and their preferred complementation patterns, and (ii) between their semantic similarity and their similarity in the distribution of complementation patterns.We report the results of a study of a set of 17 commissive nouns chosen from a wider collection of illocutionary nouns. Two types of analysis were carried out in order to compare the semantic and grammatical characteristics of these nouns. The semantic analysis was based on insights from speech act theory and the philosophy of language. We developed a framework for a systematic comparative description of the nouns in our word field. The results were tallied with a corpus-based grammatical analysis. Two hundred tokens of each noun type were randomly sampled from the Corpus of Contemporary American English. Using these data, the 17 nouns were subjected to an analysis of the relative frequencies of their complementation patterns.Results indicate a general match between noun meanings and complementation patterns. More specifically, however, they indicate that the closeness of this match depends on the prototypicality of nouns as members of the class of commissives.The study, then, contributes to our understanding of the relation between lexis and syntax. At the same time, it confirms the need for a close semantic analysis to account for the great extent to which item-specific information, i.e. properties of individual nouns, have to be taken into consideration at the expense of large-scale generalizations.
