Bestehen Maximen den Test, dann ist es zulässig oder sogar geboten, nach ihnen zu handeln; bestehen sie den Test nicht, so sind ihnen entsprechende Handlungen unmoralisch und verboten.

Background: Nursing students on clinical placements as part of their professional training are routinely faced with situations involving ethical conflicts. The initial act of perceiving a situation as causing an ethical dilemma is the result of both the students’ personal values, drawn from their culture and families, and of the professional knowledge and values that they have acquired through training and experience. Objectives: Nursing students’ experiences on clinical placements in primary care settings were investigated in order to identify situations that (...) they perceived as involving ethical conflict and describe the elements they took into consideration during their decision-making processes in these situations. Methods: The research design was qualitative descriptive case study. Around 50 students from three different intakes to a nursing degree answered a questionnaire and discussed it in focus groups. Ethical considerations: The study was designed in accordance with the principles guiding research with human beings and was approved by the Human Research Ethics Committee. Results: Synthesised into two principal axes: (a) ethical conflicts in primary care, linked with the domains of working processes, professional nursing ethics and human and social rights and (b) students’ decision-making processes – realisation, reflection and intervention. Conclusion: The student nurses saw themselves both as actors and spectators in situations involving ethical problems and demanding moral deliberation, demonstrating the ability to base their arguments soundly. They tended to emphasise the possibilities offered by dialogue and that different ethical values must be respected to find fair solutions to ethical problems. (shrink)

A categorical, higher dimensional algebra and generalized topos framework for Łukasiewicz–Moisil Algebraic–Logic models of non-linear dynamics in complex functional genomes and cell interactomes is proposed. Łukasiewicz–Moisil Algebraic–Logic models of neural, genetic and neoplastic cell networks, as well as signaling pathways in cells are formulated in terms of non-linear dynamic systems with n-state components that allow for the generalization of previous logical models of both genetic activities and neural networks. An algebraic formulation of variable ‘next-state functions’ is extended to a Łukasiewicz–Moisil (...) Topos with an n-valued Łukasiewicz–Moisil Algebraic Logic subobject classifier description that represents non-random and non-linear network activities as well as their transformations in developmental processes and carcinogenesis. The unification of the theories of organismic sets, molecular sets and Robert Rosen’s (M,R)-systems is also considered here in terms of natural transformations of organismal structures which generate higher dimensional algebras based on consistent axioms, thus avoiding well known logical paradoxes occurring with sets. Quantum bionetworks, such as quantum neural nets and quantum genetic networks, are also discussed and their underlying, non-commutative quantum logics are considered in the context of an emerging Quantum Relational Biology. O presente relato nasce de um projeto pedagógico desenvolvido na Aldeia Tupinikim de Comboios, município de Aracruz- ES, durante a disciplina Projetos de Pesquisa e Prática Pedagógica – PPPP III, no curso de Licenciatura Intercultural Indígena Tupinikim e Guarani, do Programa de Licenciaturas Indígenas – PROLIND, oferecido pela Universidade Federal do Espírito Santo – UFES. O projeto teve como objetivos: Pesquisar com os mais velhos os tipos de trançados, colaborando na reafirmação cultural do nosso povo Tupiniquim; Reconhecer os tipos de (...) trançados Tupiniquim; Confeccionar alguns tipos de trançados; Produzir textos coletivos a partir dos trançados e analisar o processo de letramento a partir de atividades contextualizadas. With reference to recently proposed theoretical models accounting for reduction in terms of a unified dynamics governing all physical processes, we analyze the problem of working out a worldview accommodating our knowledge about natural phenomena. We stress the relevant conceptual differences between the considered models and standard quantum mechanics. In spite of the fact that both theories describe systems within a genuine Hilbert space framework, the peculiar features of the spontaneous reduction models limit drastically the states which are dynamically stable. This fact by itself allows one to work out an interpretation of the formalism which makes it possible to give a satisfactory description of the world in terms of the values taken by an appropriately defined mass density function in ordinary configuration space. A topology based on this function and which is radically different from the one characterizing the Hilbert space is introduced, and in terms of it the idea of similarity of macroscopic situations is precisely defined. Finally, the formalism and the interpretation are shown to yield a natural criterion for establishing the psychophysical parallelism. The conclusion is that, within the considered theories and at the nonrelativistic level, one can satisfy all sensible requirements for a completely satisfactory macro-objective description of reality. Current UK legislation is impacting upon the feasibility and cost-effectiveness of medical record-based research aimed at benefiting the NHS and the public heath. Whereas previous commentators have focused on the Data Protection Act 1998, the Health and Social Care Act 2001 is the key legislation for public health researchers wishing to access medical records without written consent. The Act requires researchers to apply to the Patient Information Advisory Group for permission to access medical records without written permission. We present a (...) case study of the work required to obtain the necessary permissions from PIAG in order to conduct a large scale public health research project. In our experience it took eight months to receive permission to access basic identifying information on individuals registered at general practices, and a decision on whether we could access clinical information in medical records without consent took 18 months. Such delays pose near insurmountable difficulties to grant funded research, and in our case £560 000 of public and charitable money was spent on research staff while a large part of their work was prohibited until the third year of a three year grant. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. The ability of the medical profession to sustain life, or more appropriately, to prolong dying, in patients with terminal illness, creates a most complex and controversial situation for all involved: the patient, if mentally alert; the patient's family; and the medical care team including physicians, nurses and attendants. This situation is especially complex in large acute care hospitals where medical and nursing students, residents and house officers receive advanced medical training. A major problem, prolonging the dying of the terminally ill, (...) with its medical, legal, ethical and economic complexities now confronts American society. The problem is particularly acute in teaching hospitals, in which one finds a disproportionate number of terminally ill patients. The ability to work at these questions as a community rather than as adversaries will determine much about the ability of the health care system to respect the dignity and autonomy of those who seek aid and comfort when faced with serious illness and impending death. Better communication between the physicians, health care providers, the lawyers and ethicists must be developed in order to solve these problems. Over the next ten years society and our elected representatives will be making very demanding decisions about the use of the health dollar. One possible way to prevent increasing costs is to reach significant agreement on the proper care of the dying. Proper care for the dying is being considered, discussed, and evaluated by very thoughtful people. It is not governments which should decide who is to live or who is to die. There is the serious problem of the 'slippery slope' to euthanasia by omission if cost containment becomes the major force in formulating policy on the proper care of the dying. (shrink)

A categorical ontology of space and time is presented for emergent biosystems, super-complex dynamics, evolution and human consciousness. Relational structures of organisms and the human mind are naturally represented in non-abelian categories and higher dimensional algebra. The ascent of man and other organisms through adaptation, evolution and social co-evolution is viewed in categorical terms as variable biogroupoid representations of evolving species. The unifying theme of local-to-global approaches to organismic development, evolution and human consciousness leads to novel patterns of relations that (...) emerge in super- and ultra- complex systems in terms of colimits of biogroupoids, and more generally, as compositions of local procedures to be defined in terms of locally Lie groupoids. Solutions to such local-to-global problems in highly complex systems with ‘broken symmetry’ may be found with the help of generalized van Kampen theorems in algebraic topology such as the Higher Homotopy van Kampen theorem (HHvKT). Primordial organism structures are predicted from the simplest metabolic-repair systems extended to self-replication through autocatalytic reactions. The intrinsic dynamic ‘asymmetry’ of genetic networks in organismic development and evolution is investigated in terms of categories of many-valued, Łukasiewicz–Moisil logic algebras and then compared with those obtained for (non-commutative) quantum logics. The claim is defended in this essay that human consciousness is unique and should be viewed as an ultra-complex, global process of processes. The emergence of consciousness and its existence seem dependent upon an extremely complex structural and functional unit with an asymmetric network topology and connectivities—the human brain—that developed through societal co-evolution, elaborate language/symbolic communication and ‘virtual’, higher dimensional, non-commutative processes involving separate space and time perceptions. Philosophical theories of the mind are approached from the theory of levels and ultra-complexity viewpoints which throw new light on previous representational hypotheses and proposed semantic models in cognitive science. Anticipatory systems and complex causality at the top levels of reality are also discussed in the context of the ontological theory of levels with its complex/entangled/intertwined ramifications in psychology, sociology and ecology. The presence of strange attractors in modern society dynamics gives rise to very serious concerns for the future of mankind and the continued persistence of a multi-stable biosphere. A paradigm shift towards non-commutative, or non-Abelian, theories of highly complex dynamics is suggested to unfold now in physics, mathematics, life and cognitive sciences, thus leading to the realizations of higher dimensional algebras in neurosciences and psychology, as well as in human genomics, bioinformatics and interactomics. Contextual emergence was originally proposed as an inter-level relation between different levels of description to describe an epistemic notion of emergence in physics. Here, we discuss the ontic extension of this relation to different domains or levels of physical reality using the properties of temperature and molecular shape as detailed case studies. We emphasize the concepts of stability conditions and multiple realizability as key features of contextual emergence. Some broader implications contextual emergence has for the foundations of physics and cognitive (...) and neural sciences are given in the concluding discussion. Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)
