In the last years, a theological turn had a pervasive influence in the reception of Carl Schmitt’s writings. According to this view, his thought has a strong, substantial religious foundation. With regards to understanding not only Schmitt’s position but also his current influence in authoritarian countries, this essay argues that this interpretation is misleading and proposes a different and comprehensive analysis of Schmitt’s concept of political theology that replaces it in a political-legal framework. Against the theological reading, it argues that (...) Schmitt’s concept of “political theology” refers to his own conception of legal theory as an attempt to relegitimize authority in a secular context. As “political theology,” this legal theory is designed to overcome normativism and parliamentarism by “substantializing” the legal form. Using Schmitt’s post-1933 works as an example, the essay shows that, as theology translates faith into a written doctrine, legal theory must, according to Schmitt, substantialize the legal form by translating the political idea into jurisprudence. Hence, this article concludes that Schmitt’s theory might be described as “political theology” but only in a formal, ideological sense. It is part of an authoritarian theory that is not religious but uses theology to revive an appearance of absolute legitimacy. (shrink)

The Italian «constitutional compromise» between the liberal, catholic, and socialist-communist traditions and the «fordist-keynesian compromise» between capital and labor are two frequent set expressions. They are often put together, and sometimes overlapped, insofar as they share an emphasis on the central role of labor, the former putting it at the very foundation of the Republic, the latter at the core of the virtuous circle of mass production and mass consumption. Starting from a discussion of these formulas, the essay will propose (...) some lines of research for the history of the Italian Republic, not without significance for contemporary political discourse. It is commonly assumed that blameworthiness is epistemically constrained. If one lacks sufficient epistemic access to the fact that some action harms another, then one cannot be blamed for harming. Acceptance of an epistemic condition for blameworthiness can give rise to a worry, however: could agents ever successfully evade blameworthiness by deliberately stunting their epistemic position? I discuss a particularly worrisome version of such epistemic shirking, in which agents pre-emptively seek to avoid access to potentially morally relevant facts. As Roy (...) Sorensen and Jan Willem Wieland have argued, we seem to be faced with a potentially troubling regress when trying to explain what goes wrong in such situations. I argue that the solution to this so-called Shirker Problem is not to be found in complicated and demanding anti-shirking-principles with universal scope and potentially self-reflexive content. Instead, careful consideration of the necessary motivational make-up of genuine shirkers reveals their ignorance to lack the necessary depth to be exculpatory. Since shirkers by definition react to the possibility of the revelation of morally relevant facts with acts of epistemic self-limitation, they necessarily prove guilty of a form of culpable moral recklessness. Epistemic shirking thus does not pose a worrisome problem for ethical theory. (shrink)

When reading contemporary theories of distributive justice, one could easily get the impression that questions of fiscal design are normatively speaking merely instrumental for realizing the distributive ideal. Once the overall conception of justice is settled upon, questions of how the state should arrange its institutions and policies are settled if they effectively and efficiently promote the preferred distribution. I argue that such pure instrumentalism is mistaken in the context of fiscal policy. As a result, there is nothing problematic or (...) morally arbitrary about accepting domain-specific principles of fiscal justice. (shrink)

In this paper we question the hypothesis of bounded rationality against full rationality in the context of job changing behavior, via simple econometric explorations on microdata drawn from Worker Histories Italian Panel (WHIP) and Sample of Integrated Labor Market Biographies (SIAB). The identification strategy builds on a quasi-counterfactual experiment in which the performance of each voluntary mover is compared to the average performance of a peer-group of stayers of the same skill group, co-workers in the firm from which the movers’ (...) job switch originated. Voluntary movers are identifiable in the WHIP and SIAB datasets, while it is not possible to do the same among the stayers. Full rationality suggests that the performance of voluntary movers should be superior to the stayers’ (both voluntary and involuntary) as the involuntary stayers have a smaller decision set from which to choose. In this exploration we find a clear opposite result, which we take as evidence of bounded rationality of the movers. (shrink)

Trata-se, neste artigo, de investigar as noções de filosofia, pedagogia e espírito à luz dos debates decoloniais. Neste sentido, a partir de um diálogo que procuro estabelecer com Enrique Dussel, Catherine Walsh e M. Jacqui Alexander, desenvolvo três hipóteses. Em primeiro lugar, apresento certa noção de pedagogia como constitutiva da própria filosofia (portanto, a ideia de pedagogia para além de mero instrumento, meio ou termo acessório à filosofia). Em segundo lugar, argumento que essa dita pedagógica-filosófica precisará ser entendida como a (...) epistemologia indispensável para a abordagem, conhecimento e tratamento da realidade, no seguinte sentido: mediante o aprender e o ensinar alternadamente (como práxis, atitude e método filosófico por excelência), tornar possível que a realidade apareça. E esse é mais um dos pontos em relação aos quais os três autores estão de acordo, assim como em relação ao terceiro e mais importante movimento da presente investigação. Pois será, então, do reconhecimento do fracasso da ontologia universalista (moderna e colonial), mais precisamente, do encontro com uma realidade indeterminada e aberta, que se poderá a fundo compreender o sentido da atitude pedagógica (da epistemologia pedagógica) que descerra toda a realidade possível. Tal realidade_ _sempre Outra_ _– que não se pode localizar em qualquer lugar ou tempo, na mesma medida em que se faz presente em todos os lugares e momentos – é o que se poderá caracterizar como espírito. E é o que fará do espírito, por conseguinte, agência de resistência e perturbação a todo esforço epistemológico/filosófico, tanto quanto (e por isso mesmo) da atitude pedagógica-filosófica instância de revelação de um mundo prenhe de sentidos possíveis. O trabalho tem o objetivo de evidenciar a ética da experimentação animal em John Dewey, observando se é possível propor uma deliberação moral antiespecista. Assim, analisaremos o modo deweyano de aliar uma ética voltada ao progresso humano, mesmo que dela resultem condutas que desencadeiem na exploração de animais não humanos, verificando paulatinamente se é possível propor uma deliberação moral de maneira criativa por meio da experiência humana e que beneficie os animais não humanos. No primeiro momento, será exposto o conceito (...) de especismo, tal como sua derivação, o especismo antropocêntrico, o qual será esmiuçado, para mostrar como os animais humanos incorrem em certas argumentações que viabilizem a exploração de animais não humanos, principalmente na discussão do pragmatismo deweyano. Segundo, iremos aprofundar a questão do especismo por meio de uma atitude pragmática, que, além de evidenciar o entrave moral a partir do pragmatismo clássico de Dewey, mostrará argumentações favoráveis a deliberações morais que propiciem o bem-estar dos animais não humanos, de acordo com o pragmatismo contemporâneo, já que esse debate sobre o bem-estar animal no contexto da moral pragmatista é recente. Nosso trabalho conta com o aporte teórico de Dewey (2020), Fesmire (2004) e Singer (2010), entre outros. A pesquisa indica que, ao manifestar uma possibilidade expansiva da experiência, através da natureza humana, criada por uma rede de relações sociais mútuas que está em constante movimento, e que precisa se adequar a novos entendimentos éticos, é possível alinhar tanto as emoções quanto a simpatia humana para permitir novas experiências sociais criativas que despertem deliberações morais que favorecem diversos seres sencientes. A crítica de Platão à escrita se situa em meio ao conflito entre o mundo oral e a cultura escrita. Platão escreveu diálogos que são claramente o retrato de discussões que ocorreram na vida real, tenham ou não acontecido verdadeiramente. Os Ensaios de Montaigne, por outro lado, são monólogos que estabelecem uma interlocução com o leitor. Ambos tentaram de alguma forma superar a artificialidade da escrita trazendo ao texto a mesma versatilidade e vivacidade do discurso oral. Montaigne escreveu em uma (...) época na qual muitas obras em forma de diálogo circulavam, sendo então um gênero literário conhecido e influente na sua época. Os Ensaios emergem no contexto histórico do Renascimento com uma originalidade sem precedentes. Com esse intento, entre as muitas atualizações possíveis do pensamento do secretário florentino para os dias atuais, destaco duas matrizes conceituais, justamente aquelas mais concernidas com as noções de liberdade e ação política popular. Seguindo as sugestões de Helton Adverse, procuro então aprofundar e esclarecer a sua proposta de uma matriz “institucional” e uma matriz “conflitiva” quando da interpretação e recuperação das ideias (...) de Maquiavel. Os medicamentos estão presentes no cotidiano de pessoas e sociedades de uma maneira inédita no âmbito da cultura. Do ponto de vista da economia, produção, circulação e consumo cresceram massivamente e integram de maneira decisiva os fluxos financeiros produtivos e rentistas que atravessam o planeta. Do ponto de vista das subjetividades, e enquanto objetos tecnológicos, eles atendem às demandas dos processos saúde doença, contribuem para a melhoria de diferentes performatividades humanas e ainda alimentam o sonho do melhoramento e da felicidade. (...) Com o objetivo de problematizar o lugar cultural e tecnocientífico dos medicamentos, este artigo percorre trabalhos de Madeleine Akrisch, François Dagognet, Philippe Pignare e Ronald W. Dworkin, que os abordam em diferentes perspectivas. Na sequência, discute os processos de medicalização e biomedicalização em curso nos dias atuais, destacando as questões do sujeito cerebral, do self neuroquímico, e do lugar atual da psicologia cognitiva. Em contraponto, retoma a figura do monstro, tal como abordada por Michel Foucault, para ativá-la como categoria da imaginação, da anomalia e da singularização, multiplicando os horizontes éticos que se colocam para a pesquisa conjunta entre tecnociências e subjetividades. Montaigne e Diderot foram filósofos, humanistas e defensores de um ceticismo crítico. Seus escritos se caracterizam por um estilo de escrita fluído, privado e cômico. Em Diderot vemos um filósofo dramaturgo, autor e crítico de peças teatrais. Em Montaigne um filósofo não acadêmico, um magistrado avesso ao perfeccionismo da filosofia escolástica, que instaurou um novo estilo de escrita. Há um traço em comum na forma como ambos compreendem a filosofia. Para Montaigne e Diderot, ética e estética são dois domínios da (...) filosofia que possuem uma estreita relação. A obra de arte é um elemento essencial que possui o poder de despertar o espírito humano e conduzi-lo à vivência da verdadeira virtude. (shrink)

Marcus Aurelius reigned from 161 A.D. to 180 A.D., and he ranks among the most successful emperors of the antonine dynasty. The success of his administration may be attributed to his philosopher personality and, more than that, to his stoic character. Meditations presents thoughts of a stoicism devotee, which reflects in moments of intimacy on the challenges that he faced throughout his life as an emperor. It is in the practice of the ethical precepts of stoicism that he finds his (...) refuge. The text consists of a series of spiritual exercises which reaffirm the indifference to pleasures, contempt for fame, detachment from riches and abnegation for political power. This paper is a study of Meditations, and its main purpose is to elucidate how the stoic way of life is incorporated in the figure of the philosopher emperor; this, as a military function, as he was a commander of the Roman army in the war against the Nordics, where political virtue was tested. Amid the chaos of an insane struggle for the survival of Rome, he found in stoicism a precious source of inspiration. Marcus Aurelius was not dazzled by the cult of the emperor's personality; he acted for the natural right to freedom and guided his political actions for the common good. His stoic perseverance reveals itself in a harmonious conduct with the city, the rational and cosmic organism from which the emperor is a simple part. (shrink)
