The Socratic method has a long history in teaching philosophy and mathematics, marked by such names as Karl Weierstra, Leonard Nelson and Gustav Heckmann. Its basic idea is to encourage the participants of a learning group (of pupils, students, or practitioners) to work on a conceptual, ethical or psychological problem by their own collective intellectual effort, without a textual basis and without substantial help from the teacher whose part it is mainly to enforce the rigid procedural rules designed to ensure (...) a fruitful, diversified, open and consensus-oriented thought process. Several features of the Socratic procedure, especially in the canonical form given to it by Heckmann, are highly attractive for the teaching of medical ethics in small groups: the strategy of starting from relevant singular individual experiences, interpreting and cautiously generalizing them in a process of inter-subjective confrontation and confirmation, the duty of non-directivity on the part of the teacher in regard to the contents of the discussion, the necessity, on the part of the participants, to make explicit both their own thinking and the way they understand the thought of others, the strict separation of content level and meta level discussion and, not least, the wise use made of the emotional and motivational resources developing in the group process. Experience shows, however, that the canonical form of the Socratic group suffers from a number of drawbacks which may be overcome by loosening the rigidity of some of the rules. These concern mainly the injunction against substantial interventions on the part of the teacher and the insistence on consensus formation rooted in Leonard Nelson's Neo-Kantian Apriorism. (shrink)

Autor rozpatruje - w kontekście dyskusji na temat eutanazji - argumenty przemawiające za stosowaniem silnych środków pozwalających uśmierzać ból i cierpienie w fazie terminalnej, jak też przemawiające przeciwko takiemu postępowaniu. W efekcie zestawienia ze sobą jednych i drugich argumentów dojść można do wniosku, że stosowanie środków uśmierzających jest zachowaniem o wiele bardziej wskazanym, aniżeli wspomaganie przy samobójstwie. Nie należy z tego jednak wyprowadzać wniosku, że jest to jedyna moralnie akceptowana opcja. Wniosek, do jakiego dochodzi autor, brzmi mniej więcej następująco: oba (...) sposoby postępowania są moralnie akceptowalne, atoli jeden z nich jest bardziej wskazany czy korzystny. Poza tym trzeba jeszcze wspomnieć o jednym: podczas gdy można wskazać racje przemawiające przeciwko temu, by obowiązkiem lekarza uczynić asystowanie przy samobójczym akcie cierpiącego pacjenta, to tak samo można wskazać racje przemawiające za tym, by zobowiązać lekarza do tego by w tych samych okolicznościach - przy założeniu, że jest to jedyny sposób uśmierzenia bólu - uczynić obowiązkiem lekarza to, by w danych okolicznościach podał pacjentowi silne środki uśmierzające ból. Autor skłonny jest nawet pójść dalej i przyznać pacjentowi prawo żądania w określonych okolicznościach podania środków uśmierzających ból w stanach terminalnych. Jedną z racji przemawiających za tym jest, według autora, żywotne zainteresowanie pacjenta tym, by w ostatnich chwilach swego życia być uwolnionym od cierpienia. (shrink)

Das Phänomen des Todes fordert wie kein anderes das philosophische Thaumazein heraus, das Sich-Wundern und das Stellen grundlegender Fragen. Deshalb ist er ein stets wiederkehrendes Thema der Philosophie. Es ist zugleich eines der Themen, dessen philosophische Behandlung im Zeitverlauf die radikalsten Wandlungen erfahren hat. Während viele der Aussagen über den Tod, die wir etwa in der Philosophie des Hellenismus finden, heute noch ebenso gültig sind wie vor mehr als 2000 Jahren, haben sich andere überlebt oder sind Gegenstand von Kontroversen geworden. Ursächlich dafür sind sowohl der medizinische und technische Fortschritt, der es erlaubt hat, den Tod weit über seine jahrtausendealten Grenzen hinaus zeitlich zu verschieben, als auch die zunehmend naturalistischen Sichtweisen von Leben und Tod. Der Band diskutiert primär aktuelle Fragen im Umkreis des Todes, wobei anthropologische, metaphysische und ethische Fragen gleichberechtigt angesprochen werden, u. a. Todesdefinition, Möglichkeiten eines "guten Todes", ärztliches Handeln am Lebensende, Überlebenshoffnungen und die auf den Tod gerichteten Emotionen. Dieter Birnbacher is professor of philosophy at the University of Düsseldorf and a member of the Foundation for the Rights of Future Generations’ scientific board. In 1988 he published the book Verantwortung für zukünftige Generationen ; which was translated into French and Polish. Hanna Schudy is an ethicist and environmentalist interested in questions of intergenerational responsibility concerning the natural environment. She is a doctoral student at the University of Wroclaw and a DAAD scholarship holder. The interview was conducted (...) in December 2011 at the Heinrich Heine Universität; Duesseldorf. Genome editing holds the promise of revolutionizing many fields in which human interventions have hitherto proved to be insufficient to meet major global challenges, like nutrition and environmental protection. However, it is controversial how far this method might also be applied to the human germline with a view to preventing the transmission of serious genetic diseases to offspring. While there is a near-consensus that genome editing, at the present stage of science, should not be applied clinically, it is unclear whether (...) this also extends to clinically oriented research. It is argued that among the arguments against interventions in the human germline there is only one that is sufficiently strong to be practically relevant: The argument that it is doubtful whether the challenge of off-target effects with potentially fatal health consequences can be met. Since nearly all objectives of human germline genome editing can be attained by PGD, there are good grounds for directing clinically oriented research toward the improvement of this alternative method, which has been proven to be without substantial risks and which involves no ethical problems over and above those involved in genome editing. ZusammenfassungWährend die terminale Sedierung neueren niederländischen Erhebungen zufolge bereits in mehr als 5% aller Sterbefälle zur Leidensminderung am Lebensende angewandt wird, sind viele der durch dieses Verfahren aufgeworfenen begrifflichen und ethischen Fragen weiterhin offen. Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Ethics in the 21st century is threatened by a split between practical philosophy as a full-blown academic discipline and applied ethics as pragmatic problem-solving inside the political process. The place of the professional philosopher sitting on medical and other 'ethics committees' as an 'ethical expert' is somewhere in between. But where exactly? How is his role defined? Is the expertise he brings to bear on practical decisions of a purely technical or of a substantially moral kind? These issues are discussed (...) both 'from the outside' and 'from the inside'. First, some of the theoretical controversies surrounding 'ethical expertise' are discussed on the background of a rapidly growing literature in the field. These are then related to the realities of commission work as they confront the academic ethicist in practice. (shrink)

In everyday morality, "naturalness" is a positively charged term. It plays a significant role wherever technical progress opens up natural processes to human control. This book enquires into the motives for the privileged position of the natural over the artificial and seeks out its roots in the history of ideas.

Research on the human embryo is one of the most obstinately controversial issues of international bioethical debate. There has not been enough of a consensus on this issue to allow for more than a formal compromise within Europe. I argue in this paper for a pragmatic approach to the problem which accords priority to "want-regarding" considerations but does not fail, as most utilitarian approaches do, to give due weight to the "morality-dependent harms" caused by the practice of embryo research to (...) those rejecting it from other than want-regarding principles. I suggest that in deeply controversial bioethical issues a consistent want-regarding perspective should be prepared, under certain narrow conditions, to make pragmatic tradeoffs between the inherent merits of the practice in question and the averse emotions of the public. These conditions are that the averse emotions are widespread, felt to be of existential importance, and stable under additional information, and that the costs in terms of reduced freedom and foregone humane progress do not seem excessive. Is there anything special about the ethical problems of intracerebral stem-cell transplantation and other forms of cell or tissue transplantation in the brain that provides neuroethics with a distinctive normative profile, setting it apart from other branches of medical ethics? This is examined with reference to some of the ethical problems associated with interventions in the brain such as potential changes in personal identity and potential changes in personality. It is argued that these problems are not sufficiently specific to justify (...) the autonomy of neuroethics as a separate discipline and can be handled by the established principles of medical ethics. The paper concludes with a constructive proposal how to deal with interventions in the brain for which the patient is unable to give valid ex-ante consent. (shrink)

Auch unter Befürwortern der Zulässigkeit einer Suizidassistenz durch Ärzte unter bestimmten Bedingungen besteht weitgehendes Einverständnis darüber, dass kein Arzt zu einer Suizidassistenz rechtlich oder berufsrechtlich verpflichtet sein sollte. Auch das Bundesverfassungsgericht hat in seinem Urteil vom Februar 2020 Suizidwilligen unter bestimmten Bedingungen nicht mehr als ein ungerichtetes in rem-Recht auf Suizidhilfe zugesprochen, das keinen Anspruch gegen einen einzelnen Arzt begründet. Mit dem letzten Satz seines Urteils hat es vielmehr die Freiheit jedes einzelnen Arztes – wie auch jedes anderen potenziellen Helfers (...) –, Nein zu sagen, nachdrücklich bekräftigt. Auf dem Hintergrund einer empirischen Untersuchung der Gründe, die in der Schweiz für die Ablehnung entsprechender Patientenanfragen gegeben werden, untersucht und gewichtet der Beitrag die Gründe, die für diese Freiheit sprechen, unter ethischen Gesichtspunkten und verteidigt ein bedingtes Recht auf Ablehnung gegen dessen jüngste Kritiker. In Fällen, in denen die Bedingungen erfüllt sind, durch die das Bundesverwaltungsgericht in seinem Urteil vom März 2017 „extreme Notlagen“ definiert hat, sollte jedoch zumindest eine moralische Pflicht anerkannt werden, den Patienten an einen Arzt zu verweisen, der zu einer Unterstützung bereit ist. Schopenhauers Tierethik kommt eine Pionierrolle zu, indem er in seiner Ethik menschliche Verpflichtungen gegenüber Tieren zum ersten Mal ausdrücklich und systematisch in eine umfassende Moraltheorie einbezieht. Mit seiner Berücksichtigung der Tiere stellte er sich gegen den mainstream der überwiegend anthropozentrisch orientierten Tradition der europäischen Ethik und wurde zum Wegbereiter der modernen Tierethik.

The relation between ethics and social science is often conceived as complementary, both disciplines cooperating in the solution of concrete moral problems. Against this, the paper argues that not only applied ethics but even certain parts of general ethics have to incorporate sociological and psychological data and theories from the start. Applied ethics depends on social science in order to asses the impact of its own principles on the concrete realities which these principles are to regulate as well as in (...) order to propose practice rules suited to adapt these principles to their respective contexts of application. Examples from medical ethics (embryo research) and ecological ethics (Leopold's land ethic) illustrate both the contingence of practice rules in relation to their underlying basic principles and the corresponding need for a co-operation between philosophy and empirical disciplines in judging their functional merits and demerits. In conclusion, the relevance of empirical hypotheses even for some of the perennial problems of ethics is shown by clarifying the role played by empirical theories in the controversies about the ethical differentiation between positive and negative responsibility and the relation between utility maximisation and (seemingly) independent criteria of distributive justice in the context of social distributions. One moot point in bioethical debates about genetic testing concerns the conditions that have to be fulfilled to make individual genetic testing or individual participation in genetic screening programs truly voluntary. Though there is a relatively broad consensus about the non-viability of views on the extremes of the spectrum of opinions, there is considerable disagreement in the middle. This mirrors the difficulties in defining satisfactory demarcation lines between autonomous choice, pressured choice and coercion in cases in which the decision to (...) participate is triggered, wholly or partly, by factors such as material incentives, urgent health needs, massive social expectations, or moral pressure from relatives. In this contribution, some of the semantic conditions and ethical principles concerning coercion are explored with a view to applying them to genetic testing, especially in the context of insurance and participation in clinical trials. The article is devoted to the problem of moral motivation. Author presents a view which, as he argues, is able to bridge the gap between acceptance of a moral rule and an action according to this rule. The main issue here is the future ethics that could possibly become a part of environmental ethics if it takes into consideration future goods and condition of nature. The author discusses rationality of moral norms in future ethics from a perspective of a universalistic (...) paradigm. Drawing from Hare and Sidgwick he maintains that temporal position of someone harmed by a present action cannot be relevant to the moral evaluation of the action in question. He also emphasizes that in case when moral agent is a future and abstract one, there is an important factor involved which could have an influence on our moral identity. It plays a crucial role because our ,,natural” motivation to act according to a rule concerns, first of all, moral subjects within a moral community. Birnbacher claims that taking non-moral motivations into account makes the prospects of future-oriented action appear much less gloomy. Therefore, in his project of future ethics, he fuses together levels of moral theory and of emotional basis of our motivation. He illustrates the point by demonstrating that the course of psychological factors has an impact on our motivation for action by the data drawn from empirical social research conducted in Europe and USA. ZusammenfassungDas Verfahren des Sterbefastens ) hat eine lange Tradition, die, soweit wir wissen, bis in die Antike zurückreicht. Besonders in jüngster Zeit findet es Interesse bei älteren Menschen, die dem Tode nahe sind und über Zeitpunkt und Umstände ihres Todes ein gewisses Maß an Gestaltungsspielraum behalten wollen. Unter den Befürwortern dieses Verfahrens ist allerdings u. a. strittig, wieweit Sterbefasten als eine „passive“ Form von Suizid gelten kann. Auf dem Hintergrund der WHO-Definition des Suizids verteidigt der Beitrag eine affirmative Antwort und (...) diskutiert, wieweit sich daraus Konsequenzen für die ethische Beurteilung des Sterbefastens ergeben. „Negative Kausalität“ bezeichnet ein hochkontroverses metaphysisches Problem. Können negative Entitäten wie Abwesenheiten oder das Nicht-Eintreten bestimmter Ereignisse Ursachen oder Ursachenfaktoren sein? Diese Frage steht im Schnittpunkt einer Reihe disziplinübergreifender Grundfragen: der Frage nach dem Wesen von Kausalität, der Frage nach der Natur von Handlungen und Ereignissen und der Frage nach der Beziehung zwischen Kausalität und normativer - moralischer und rechtlicher - Verantwortlichkeit. Die vorliegende Studie entwickelt im ersten Schritt eine Konzeption von negativer Kausalität ausgehend vom Sonderfall der handlungsförmigen negativen Kausalität, (...) der Kausalität durch Unterlassen. In einem zweiten Schritt erkundet sie anhand des Ariadnefadens der Kausalität von Unterlassungen die terra incognita der Kausalität andersartiger „negativer Ereignisse“ wie Abwesenheiten und Nicht-Ereignissen. In einem dritten Schritt zieht sie Konsequenzen für hartnäckige Probleme wie die Aufteilung der Kausalität beim Zusammentreffen mehrer negativer Ursachen. _English_ The term “negative causality” denotes a highly controversial problem in metaphysics: Can negative entities such as the absence or the non-occurrence of certain events be causes or causal factors? This question is situated at the intersection of a series of fundamental questions that transcend disciplinary boundaries, questions concerning not only the nature of causality, actions, and events, but also the relationship between causality and moral and legal responsibility. The contribution argues that causal interpretations of empirical correlations between neural and conscious events are meaningful even if not fully verifiable and that there are reasons in favour of an epiphenomenalist construction of psychophysical causality. It is suggested that an account of causality can be given that makes interactionism, epiphenomenalism and Leibnizian parallelism semantically distinct interpretations of the phenomena. Though neuroscience cannot strictly prove or rule out any one of these interpretations it can be argued that methodological principles favour a (...) causal interpretation on epiphenomenalist lines, both for reasons of metaphysical parsimony and for reasons of coherence with established physical principles such as the conservation of energy. In the concluding chapter, some of the philosophical and the empirical challenges following from this model are outlined, the most important being closer scrutiny of the neurophysiological processes accompanying conscious volition. The moral dilemma of nuclear deterrence arises from two conflicting facts: the fact that in a world of conflicting superpowers with nuclear arsenals preserving peace must have an overriding moral priority; and that a policy of mutual nuclear deterrence, which seems well suited to achieve this aim, faces grave moral difficulties on its own, the main difficulty being the moral indefensibility of the act of retaliation threatened in case of attack. It is argued that a consequentialist approach to the moral (...) assessment of nuclear deterrence is in principle able to provide a solution to this dilemma by reducing the moral dilemma to a non-moral dilemma which can in turn be solved by a comparison of risks. In this connection, a theory of the ‘functional’ assessment of intentions is developed in order to subject even threats involving a conditional intention to retaliate to consequentialist reasoning. Among systems of normative ethics, Utilitarianism has been the one most persistently claimed to stand on a scientific basis. The paper restates this claim by showing that although Mill’s so-called "proof"of Utilitarianism is indefensible even in terms of non-demonstrative plausibility, an alternative argument can be constructed yielding the same conclusion by making use of a "minimum agreement principle". It is argued, further, that the concept of happiness central to Utilitarianism is empirically determinate and is capable of scientific investigation by various (...) psychological and sociological approaches. Schopenhauers »Preisschrift über die Freiheit des Willens« ist eine der wenigen Einsendungen zu einem Wettbewerb, die nachhaltige Berühmtheit erlangt haben. Die Norwegische Sozietät der Wissenschaften in Trondheim hatte 1839 die Preisfrage gestellt »Lässt sich die Freiheit des menschlichen Willens aus dem Selbstbewusstsein beweisen?«, und Schopenhauers anonym eingesandte Abhandlung – die einzige – bekam den Preis zugesprochen.

Krause’s philosophy deserves to be memorized as the first link in a chain of thinking on animal rights that is still on the way today. Though Krause was not the first to talk of animal rights in the history of animal ethics, his theory of animal rights is pathbreaking in embedding a conception of animal rights in an all-encompassing metaphysical system. The essay situates Krause’s theory of animal rights in the framework of his general theory of rights and points to (...) the challenges Krause’s theory faces by the inevitability of trade-offs between animal and human rights. ZusammenfassungPatientenverfügungen für spätere Zustände schwerer kognitiver Beeinträchtigungen, wie sie für Spätphasen der Demenz typisch sind, stoßen auf weitergehende Vorbehalte als Patientenverfügungen für anderweitige Zustände eingeschränkter Einwilligungsfähigkeit. Einer der Gründe dafür scheinen die ethischen und psychologischen Konflikte im Gefolge von Patientenverfügungen zu sein, mit denen Patienten in gesunden Tagen für bestimmte Phasen der Erkrankung die Nichtbehandlung interkurrenter Erkrankungen oder die Unterlassung künstlicher Ernährung verfügt haben, während sich unter den in der Patientenverfügung gemeinten Bedingungen keine Anzeichen finden, dass sie unter ihrer Situation (...) leiden. Der Beitrag argumentiert für diese Situation für eine „gemischte“ ethische Strategie: Patientenverfügungen im rechtlichen Sinne sollten insbesondere dann, wenn sie im Rahmen eines Advance Care Planning erstellt sind, befolgt werden, um zu verhindern, dass den Vorausverfügenden das Vertrauen in die spätere Befolgung ihres Wunsches nach Abbruch oder Nichtaufnahme medizinischer Behandlungen genommen wird. Dagegen sollten darüber hinausgehende „Pflegeverfügungen“ ohne rechtlich verbindlichen Status nur in Fällen beachtet werden, in denen zwischen vorausverfügtem und „natürlichem“ Willen Konkordanz besteht.
