Secondary findings for adult-onset diseases in pediatric clinical sequencing can benefit parents or other family members. In the absence of data showing harm, it is ethically reasonable for parents to request such information, because in other types of medical decision-making, they are often given discretion unless their decisions clearly harm the child. Some parents might not want this information because it could distract them from focusing on the child's underlying condition that prompted sequencing. Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. Cuando Walter Benjamin desarrolla en el “Prólogo epistemocrítico” de _El origen del Trauerspiel_ alemán la más extensa de las presentaciones de su teoría del conocimiento (así como la única publicada en vida), lo hace a partir de una explícita reinterpretación de la filosofía platónica, en particular de su “doctrina de las ideas”. Este artículo se propone investigar las afinidades entre el prólogo de Benjamin y la filosofía platónica, poniendo especial énfasis en las relaciones entre los desarrollos metodológicos de (...) ambos autores, es decir entre la “forma de la exposición” de Benjamin y la dialéctica de Platón. A partir de explorar estas relaciones, se busca poner de relieve una visión de la filosofía que ambos autores comparten, y de la que se quiere señalar la originalidad, potencia y actualidad. Even if it has not been so thoroughly investigated, the importance of Platonic philosophy in Benjamin’s work can hardly be argued. Numerous texts, notes and letters reveal the presence of Plato in Benjamin’s thought. But it is specially The origin of German Trauerspiel the place where Benjamin takes Plato’s philosophy most explicitly and extensively. In the “Epistemocritical Preface” –where he develops his theory of knowledge through a revindication and reinterpretation of the Platonic “doctrine of ideas”– as well (...) as in other sections of the book, Plato appears as a fundamental source. In this context, a dialogue stands out: the Symposium. This article aims at investigating Benjamin’s reading of that dialogue, a reading which articulates the figure of a Plato that develops his philosophy as a way to oppose myth, and that allows to elevate philosophy again as a form for the exposition of truth in language. According to Pablo Oyarzun, Benjamin’s concept of history “is not about a war over the representation of history, but a war over history itself. Only in so far as this is its field, there can also be a struggle for its representation”. While Oyarzun’s observation refers to the first “thesis” of Benjamin’s «On the Concept of history», in this article I argue that it can be productively used to shed light onto a broader understanding of the Benjamin’s (...) concept of history. To that end, I elaborate on Oyarzun’s comment in order to analyze and to render explicit the relationship between 'Truth' and 'presentation' in Benjamin’s thought. In doing so, I highlight the relevance of this relationship for the concept of 'History' that Benjamin elaborated in the late ‘30s. (shrink)

The relationship between “Towards a Critique of Violence” (1921) and the work of Franz Kafka has been well established by several critical studies devoted to Walter Benjamin. However, it is striking that Benjamin himself, already well acquainted with the work of the Czech writer in 1921, never made any comment to Kafka’s work in this essay, and, more broadly, in any of the related texts that make up the project on the ‘Critique of Violence’. In this article, we (...) analyze a set of notions (Entstellung, Entsühnung, Zurechstellen) that allow us to establish a mediated relationship between this essay and the articles and letters that Benjamin devoted to Kafka in the 1930s. This relationship takes us back to the only piece in which Benjamin carries out an autonomous treatment of the “category of justice” (1916) in which he identifies -as it will happen eighteen years later, in the essay on Kafka (1934)- the locus of justice in the “non-violence”, thus untying the knot that binds in a perhaps indiscernible way in the Jewish tradition the notions of “messianism” and “violence”. El artículo examina el conflicto formal que se produce en la descripción de Odradek al interior de “La preocupación del padre de familia” de Franz Kafka. En la voz de su narrador, Kafka se vale de un lenguaje de extraordinaria precisión para describir a su criatura (Odradek), produciendo una serie de paradojas. Prestamos atención seria a estas paradojas, mostrando las consecuencias que ellas plantean para los conceptos de “historia” en Kant y Benjamin, en sus respectivas relaciones con el concepto (...) de “naturaleza” en estos autores. ABSTRACT While the concept of “infinite distance” (ID) appears as such only in the work of Maurice Blanchot, in this paper we argue that it could be productively coined in Walter Benjamin’s as well. We argue that (1) the concept of ID is elaborated from a revision, a re-signification, and a radicalization of the modern concept of “aesthetic distance”, and that (2) this modification is fundamentally based on the interpretations that both, Benjamin and Blanchot, make first of early (...) German Romanticism, and second of the work of Franz Kafka. This modification, we contend, (3) contains a shift in the ground of the concept: the concept of ID has no longer as ground the realm of the subjective faculties (i.e., the ‘judgment of taste’), but the realm of art and language. Finally, we show (4) that the concept of ID presupposes the existence of a ‘fragmentary impulse’ within literary works that can be understood as a “limit-experience” for the subjectivity. (shrink)

O trabalho se ocupa da infância como expressão estética em dois filmes do alemão Wim Wenders, Alice nas cidades e Lisbon Story. Para isso procura construir um jogo entre ambos, em que cada uma das obras aparece simultaneamente como testemunho histórico e síntese de questões que dizem respeito à existência e às próprias possibilidades do cinema. Comparecem, portanto, o amor, a amizade, a memória, a reelaboração do passado, as cidades, o progresso e a regressão, bem como as técnicas de captação (...) e produção de imagens e sons, os destinos e a memória do cinema como inconsciente onírico de uma época. O apoio se encontra principalmente em Walter Benjamin, nem tanto em seus comentários sobre cinema, mas muito mais no que se refere ao que escreveu sobre a infância na cidade, demarcando, assim, como Wenders o fará, um olhar infantil, oblíquo em relação ao seu destino, mas não infantilizado, sobre as coisas do mundo. In recent years, some authors have shown a renewed interest in interpretivist theories of folk psychological ascription [Hutto 2013. “Fictionalism About Folk Psychology.” The Monist 96 (4): 582–604.; Mölder 2010. Mind Ascribed: An Elaboration and Defence of Interpretivism. Amsterdam: John Benjamins; Sanchez-Curry 2020. “Interpretivism and Norms.” Philosophical Studies 177 (4): 905–930.; Mölder 2021. “Interpretivism Without Judgement-Dependence.” Philosophia 49 (2): 611–615.; Slors 2015. "Interpretivism and the Meaning of Mental State Ascriptions." Studia Philosophica Estonica, 10 (2): 18–27.]. Part of the virtue of (...) interpretivism lies in its ability to provide an answer to elminativist arguments without falling into the assumptions and problems of intentional realism. However, some recent developments in semantic expressivism applied to normative expressions could help to build an alternative theory to interpretivism that would enjoy the same virtues. The aim of this paper is to present and defend an expressivist approach to the status of folk psychological ascriptions. According to this view, mental states ascriptions are evaluative and non-descriptive statement that express or reflect certain normative standards or values of the attributor. After presenting the view and contrasting it with interpretivist positions, with which expressivism shares important motivations and claims, I present two arguments to favor the expressivist analysis. In line with the first argument, expressivism can account for fundamental aspects of disagreements regarding mental attributions while the second highlights the capacity of the view to explain the widespread justificatory and exculpatory uses of mental states ascriptions. Esta ponencia se propone demostrar que, para John Locke, el individuo posee derechos inalienables, pero que la misma naturaleza humana tiende a establecer ciertas relaciones de poder que lo esclavizan. La constatación teórica e histórica de este postulado lleva a Locke a sostener que la salida del hombre de esa situación de enfermedad debe liberarlo no de las relaciones de poder, que pueden ser legitimadas, sino de sus propias pasiones que lo llevan a juzgar con parcialidad sus derechos y a (...) intentar someter a otros a los designios de su amor propio. Para ello, el contrato social lockeano busca elaborar un equilibrio entre los derechos inalienables de los hombres y la construcción de un espacio comunitario que haga posible la justicia en las relaciones humanas y, por lo tanto, emancipe al hombre del estado de enfermedad en el que se encontraría si no existiese el poder político. La función del poder político surgido en el contrato social es, pues, la de respetar-reestablecer el equilibrio entre libertad e igualdad que debe primar entre los hombres. (shrink)

En los estudios de Marx sobre el modo de producción específicamente capitalista en la periferia, más allá de Europa occidental, encontramos un doble movimiento: sus estudios históricos configuran todo un campo de tensiones en el que podemos examinar sus posiciones políticas y teóricas entrecruzadas con los cambios y las contradicciones históricas del siglo xix. Analizando las opiniones de Marx sobre la cuestión colonial y la cuestión nacional en casos tan variados como los de India, América Latina, China, Irlanda, Polonia o (...) Rusia comprobamos su distanciamiento creciente pero irregular con respecto al “sistema” hegeliano, que nunca dejó de inspirarlo, en un intento de superar la teleología de la historia. En cuestionamiento se encontraba el presupuesto de que las formas sociales superiores surgen del agotamiento y la aniquilación de las directamente inferiores. Aunque imperfecta, la superación de la teleología acercó a Marx al reconocimiento de la coexistencia en el espacio y en el tiempo de formas sociales heterogéneas, lo que apuntaba hacia una concepción diferente de la teoría y la acción política. When business organisations become involved in contributing to and resolving social issues, they enter areas traditionally seen as the purview of governments. In doing so, they begin to take on the expectations and responsibilities of government; they become politicised. This politicisation is a product of business’s success and power and appears largely unavoidable. Adopting Matten & Crane’s (2005a) extended view of corporate citizenship, business organisations’ responsibilities extend to the administration of citizens’ social, civil and political rights. We term these areas (...) where business organisations take over the administration of citizenship rights as the social governance gap. Drawing upon the agenda of Margolis and Walsh (2003), we seek to enhance the understanding of how business navigates its responsibilities within the social governance gap, including its function as a significant actor influencing societal development and wellbeing. We do this through an exploration of Rio Tinto’s involvement in the WA Future Fund. This paper forms part of an introductory scoping case study of the Rio Tinto WA Future fund and its function as one of Rio Tinto’s diverse responses to community development issues in Western Australia. Structural history, Conceptual history, Theory of historical time, Semantics of History: the work of Reinhart Koselleck is associated with a wide spectrum of methodological orientations that emerged during the post-war period and originated from the in-depth reflection on the significance of historical sciences. Koselleck shared with numerous West-German historians the observation that historical science was experiencing a profound crisis exacerbated by the increasing influence of social sciences. However, unlike his contemporary historians, who advocated the criticism of historicism as a prerequisite (...) for reforming their discipline, Koselleck championed a radically different path to remedy to this crisis. In this paper, we shall outline the major stages of the critical dialogue between Koselleck and the West-German historiography of his time. Two distinct historical intervals emerge from this analysis: the first is marked by the influence of the structural historical model, developed by Werner Conze during the 1950s, on Koselleck’s theoretical vision; the second, which started in the 1970s, is characterized by the refusal to consider the critical social history as the basis for a holistic explanation of national history. Within the field of medical ethics there is a startling amount of diversity regarding which issues and relationships are deemed relevant for ethical inquiry and analysis, what strategies are appropriate for examining and resolving ethical conflict, what should be the goals for medical ethics, even who should participate in that project. What I will try to make clear in this paper is that how we go about this process of doing medical ethics, of examining, reflecting, decisionmaking, and behaving, makes a (...) practical difference, and not just a philosophical one, in terms of the understandings we will reach about ethical matters. Without attempting to resolve any of the conflicts within or between different conceptions of doing ethics, I will try to articulate the differences in orientation, and particularly the tone and educational emphasis, that attend four major contemporary approaches to ethical inquiry and analysis: deductivism, principlism, modern casuistry, and feminist/relationist ethics. Steady-state visual evoked potentials are commonly used for functional objective diagnostics. In general, the main response at the stimulation frequency is used. However, some studies reported the main response at the second harmonic of the stimulation frequency. The aim of our study was to analyze the influence of the stimulus design on the harmonic components of ssVEPs. We studied 22 subjects using a circular layout. At a given eccentricity, the stimulus was presented according to a 7.5 Hz square wave with (...) 50% duty cycle. To analyze the influence of the stimulus eccentricity, a background luminance of 30 cd/m2 was added to suppress foveal stray light effects; to analyze the influence of simultaneous foveal and peripheral stimulations, stimulations are performed without stray light suppression. For statistical analysis, medians M of the amplitude ratios for amplitudes at the second harmonic to the first harmonic and the probability of the occurrence of the main response at the second harmonic P are calculated. For stimulations with foveal stray light suppression, the medians were M0–1.6° = 0.45, M1.6–3.5° = 0.45, M3.5–6.4° = 0.76, M6.4–10.9° = 0.72, and M10.9–18° = 0.48, and the probabilities were P0–1.6° = 0.05, P1.6–3.5° = 0.05, P3.5–6.4° = 0.32, P6.4–10.9° = 0.29, and P10.9–18° = 0.30. For stimulations without foveal stray light suppression, the medians M were M0–1.6° = 0.29, M1.6–3.5° = 0.37, M3.5–6.4° = 0.98, M6.4–10.9° = 1.08, and M10.9–18° = 1.24, and the probabilities were P0–1.6° = 0.09, P1.6–3.5° = 0.05, P3.5–6.4° = 0.50, P6.4–10.9° = 0.55, and P10.9–18° = 0.55. In conclusion, the stimulus design has an influence on the harmonic components of ssVEPs. An increase in stimulation eccentricity during extrafoveal stimulation leads to a transition of the main response to the second harmonic. The effect is enhanced by a simultaneous foveal stimulation.
