En este artículo se dan algunas de las razones por las cuales promover un conjunto de valores específicos en las empresas no es un propósito claro si no se le entiende en su relación con el criterio moral, según el cual es deber de las directivas de las empresas promover una armonía en las relaciones de riesgo e interés entre las empresas y sus stakeholders. Para ello se tendrán en cuenta, por una parte, un concepto de cudaimonía, cuya justificación es (...) formal y pragmática y, por otra, un concepto de racionalidad no instrumental. Por último, se darán las razones por las cuales la capacidad humana de ponerse crítica y participativamente en el lugar del otro, si se promueve, puede ser una manera de realizar el propósito moral de procurar un balance en dichas relaciones. Además del argumento que, para sostener esta posición, apela al valor de la autonomía, hago referencia al debate sobre el contenido cognitivo de actitudes como la humillación. El propósito de este artículo es fortalecer los vínculos entre las razones de justicia y las razones históricas para justificar el reconocimiento de ciertos derechos en favor de grupos culturalmente diferenciados. Intento con ello mostrar que a la lucha por la defensa de la preservación de ciertas culturas no es marginal, sino más bien esencial, el hecho de que dicha defensa provenga de una historia de exclusión. Acudiendo a ejemplos, en la primera parte del trabajo intentaré integrar algunos rasgos de (...) lo que Charles Taylor entiende por proceso de formación de la identidad al conjunto de etapas que, según Luis Villoro, dan lugar a la proyección de un modelo de justicia. En la segunda parte contaré algunos episodios del reciente proceso de recuperación territorial de la comunidad indígena U'wa en Colombia. El propósito de esta parte del trabajo es fortalecer el vínculo que establece Villoro entre las historias de exclusión y los procesos de consolidación de la justicia. A modo de conclusión y teniendo en cuenta la diferencia planteada por Ernst Tugendhat entre derechos generales y derechos especiales, mostraré en qué medida las historias tristes no dejan de constituirse en contenidos para la justicia una vez que la ley positiva ha consagrado una serie de derechos. Los textos de Ernst Tugendhat sobre mística están acompañados de una serie de referencias a la experiencia estética. Dadas estas referencias y la importancia que puede atribuirse a ellas en el propósito de Tugendhat de aclarar el sentido de lo místico, en este trabajo exploro la posibilidad de responder positivamente a esta pregunta: ¿Puede la experiencia estética comportar algunos de los rasgos de la experiencia mística? El punto de partida en mi propósito será atender a la reflexión de Tugendhat en (...) torno al término "asombro" en el contexto de la experiencia estética. A continuación doy las razones por las cuales, según el autor, la expresión "¡qué asombroso que exista el mundo!" tiene, en efecto, el sentido que Wittgenstein negó para ella. Concluyo mostrando que quien, con este tipo de expresiones, afirma la belleza del mundo no solo expresa la emoción que comporta el asombro; expresa también una disposición para asumir una actitud mística. Ernst Tugendhat's works on mysticism are provided of a series of references to the aesthetic experience. Based on these references, and the significance they may be attributed in Tugendhat's purpose to clarify the sense of mysticism, in this paper I explore the possibility to answer affirmatively the question: Can the aesthetic experience imply some of the traits attributed to the mystical experience? My starting point to get the answer is to focus on Tugendhat's reflections on the term "astonishment" in the context of the mystical experience. i then give the reasons that, according to Tugendhat and opposed to Wittgenstein, may make us think that the expression 'How astonishing that the world exists!' has indeed a sense. Finally, i conclude showing that anyone using expressions like this to affirm the beauty of the world, not only expresses the emotion implied by his astonishment: he also expresses a disposition to assume a mystical attitude. In this article I make references to a set of statements made by Albert Speer –Hitler’s architect–, about his situation in the Third Reich after the end of the Second World War. The heart of these statements is the term “self-deception”. Taking into account of Speer’s words, I emphasize on a feature which, as I see it, goes along with the process of self-deception: imposture. With the inclusion of imposture in the discussion on self-deception, I emphasize on the fact that (...) it frequently takes place in a context made not only by the self-deceiver alone, but by others as well. In this sense, the presence of the others or what I want to call “the audience” is a significant part of what makes self-deception more or less notorious, more or less easy to occur. (shrink)

El propósito de este artículo es mostrar cómo ciertos procesos de victimización condenan a quienes los padecen a una suerte de destierro del mundo y de la realidad. El caso de la larga presencia paramilitar en El Placer (Putumayo, Colombia) es un ejemplo de lo anterior. Con el uso que hacen los sobrevivientes en El Placer de los términos “el mal aire” y “los aires de la muerte” se expresan nítidamente dichas formas de destierro. El propósito general del texto se (...) cumple, en primer lugar, recurriendo al término ‘mundo’ tal como este es usado por Hannah Arendt y por Edmund Husserl y, en segundo lugar, al término ‘realidad’ propuesto por Arendt y por Somogy Varga. Para concluir, intento establecer una relación entre la pérdida de mundo, la pérdida del sentido de la realidad y lo que se conoce en fenomenología como‘despersonalización’. AbstractThe purpose of this article is to show how certain forms of victimization condemn those who suffer them to a sort of exile from the world and from reality. The case of the long paramilitary presence in the town El Placer (Putumayo, Colombia) is a good example of this. The use its survivors make of the words “bad air” and “the airs of death” neatly expresses the mentioned forms of exile. To accomplish this purpose, firstly, I appeal, to the term ‘world’ as used by Hannah Arendt and Edmund Husserl, and secondly, to the term ‘reality’ as usedby Arendt and Somogy Varga. RESUMEN El artículo responde algunas críticas planteadas por Ignacio Ávila a mi interpretación de la epistemología davidsoniana. Presento argumentos en contra de: a) que sea necesario distinguir entre representaciones epistemológicamente “peligrosas”e “inofensivas”; b) que el empirismo mínimo sea un tipo de realismo directo; c) que mi uso de la expresión “evidencia distal” y el interés por la teoría de la correspondencia sean asuntos ajenos a Davidson. Finalmente, sostengo que la triangulación es un elemento fundamental de la epistemología davidsoniana, pues permite (...) sortear la ansiedad realista manteniéndose en una postura no representacionalista. ABSTRACT In this article, I respond to some of Ignacio Ávila's criticisms of my interpretation of Davidson’s epistemology. I argue against: a) the need to distinguish between epistemologically “dangerous” and “harmless” representations; b) the idea that minimal empiricism is a kind of direct realism; and c) the claim that my usage of the expression “distal evidence” and interest in the theory of correspondence are issues that do not pertain to Davidson. Finally, I claim that triangulation is a key element in Davidsonian epistemology since it allows us to deal with the realist anxiety while maintaining a non-representationalist viewpoint. (shrink)

RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. RESUMEN Largamente desatendida o malinterpretada, la noción de caos en la filosofía de Nietzsche es una pieza constitutiva de la particular concepción del ser que este autor habría dejado apenas esbozada. El artículo se propone elaborar este concepto en la obra nietzscheana, siguiendo algunas de las metáforas que lo iluminan. Desde allí se busca plantear los rasgos centrales de una ontologia del caos, de sesgo no metafísico, que, al afirmar el carácter acontecimental de la realidad, puede verse como precursora de (...) la ontología hermenéutica contemporánea. ABSTRACT The notion of chaos, which has long been neglected or misinterpreted, is a constitutive element of a peculiar conception of being that the philosopher only had time to outline. The objective of this article is to elaborate on this concept in Nietzschean philosophy, guided by some of the metaphors that shed light on it. This serves as the basis to set forth the main characteristics of a non-metaphysical ontology of chaos that asserts the eventful nature of reality and can thus be seen as a precursor of contemporary hermeneutic ontology. The predominant view is that a study using health data is observational research and should require individual consent unless it can be shown that gaining consent is impractical. But recent arguments have been made that citizens have an ethical obligation to share their health information for research purposes. In our view, this obligation is sufficient ground to expand the circumstances where secondary use research with identifiable health information is permitted without explicit subject consent. As such, for some studies the Institutional (...) Review Board/Research Ethics Committee review process should not assess the practicality of gaining consent for data use. Instead the review process should focus on assessing the public good of the research, public engagement and transparency. (shrink)

The future of health research will be characterised by three continuing trends: rising demand for health data; increasing impracticability of obtaining specific consent for secondary research; and decreasing capacity to effectively anonymise data. In this context, governments, clinicians and the research community must demonstrate that they can be responsible stewards of health data. IRBs and RECs sit at heart of this process because in many jurisdictions they have the capacity to grant consent waivers when research is judged to be of (...) particular value. However, several different terms are used to refer to this value, indicating a lack of conceptual clarity regarding the appropriate test for access to health data for research without consent. In this paper we do three things. First we describe the current confusion and instability in terminology relating to public interest in the context of consent waivers. Second we argue for harmonisation of terminology on the grounds of clarity, transparency and consistency. Third we argue that the term ‘public interest’ best reflects the normative work required to justify consent waivers because it is the broadest of the competing terms. ‘Public interest’ contains within its scope positive and negative implications of a study, as well as welfare, justice and rights considerations. In making this argument, we explain the normative basis for consent waivers, and provide a starting place for further discussion about the precise conditions in which a given study can be said to advance the public interest. This paper contends that a research ethics approach to the regulation of health data research is unhelpful in the era of population‐level research and big data because it results in a primary focus on consent (meta‐, broad, dynamic and/or specific consent). Two recent guidelines – the 2016 WMA Declaration of Taipei on ethical considerations regarding health databases and biobanks and the revised CIOMS International ethical guidelines for health‐related research involving humans – both focus on the growing reliance on health data (...) for research. But as research ethics documents, they remain (to varying degrees) focused on consent and individual control of data use. Many current and future uses of health data make individual consent impractical, if not impossible. Many of the risks of secondary data use apply to communities and stakeholders rather than individual data subjects. Shifting from a research ethics perspective to a public health lens brings a different set of issues into view: how are the benefits and burdens of data use distributed, how can data research empower communities, who has legitimate decision‐making capacity? I propose that a public health ethics framework – based on public benefit, proportionality, equity, trust and accountability – provides more appropriate tools for assessing the ethical uses of health data. The main advantage of a public health approach for data research is that it is more likely to foster debate about power, justice and equity and to highlight the complexity of deciding when data use is in the public interest. Public-private partnerships are established to specifically harness the potential of Big Data in healthcare and can include partners working across the data chain—producing health data, analysing data, using research results or creating value from data. This domain paper will illustrate the challenges that arise when partners from the public and private sector collaborate to share, analyse and use biomedical Big Data. We discuss three specific challenges for PPPs: working within the social licence, public antipathy to the commercialisation of public sector (...) health data, and questions of ownership, both of the data and any resulting intellectual property or products. As a specific example we consider the case of the UK National Health Service providing patient data to Google’s DeepMind AI program to develop a diagnostic app for kidney disease. This article is an application of the framework presented in this issue of ABR. Please refer to that article for more information on how this framework is to be used, including a full explanation of the key values involved and the balancing approach used in the case study at the end. We use four specific values to help analysis these issues: public benefit, stewardship, transparency and engagement. We demonstrate how the Deliberative Framework can support ethical governance of PPPs involving biomedical big data. (shrink)

Throughout March and April 2020, debate raged about how best to allocate limited intensive care unit (ICU) resources in the face of a growing COVID-19 pandemic. The debate was dominated by utility-based arguments for saving the most lives or life-years. These arguments were tempered by equity-based concerns that triage based solely on prognosis would exacerbate existing health inequities, leaving disadvantaged patients worse off. Central to this debate was the assumption that ICU admission is a valuable but scarce resource in the (...) pandemic context.In this paper, we argue that the concern about achieving equity in ICU triage is problematic for two reasons. First, ICU can be futile and prolong or exacerbate suffering rather than ameliorate it. This may be especially true in patients with COVID-19 with emerging data showing that most who receive access to a ventilator will still die. There is no value in admitting patients with poor prognostic indicators to ICU to meet an equity target when intensive critical care is contrary to their best interests. Second, the focus on ICU admission shifts focus away from important aspects of COVID-19 care where there is greater opportunity for mitigating suffering and enhancing equitable care.We propose that the focus on equity concerns during the pandemic should broaden to include providing all people who need it with access to the highest possible standard of end-of-life care. This requires attention to culturally safe care in the following interlinked areas: palliative care, communication and decision support and advanced care planning. (shrink)

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

‘Flourishing’ is a concept of the good life of plants which comprises an empirical and an evaluative aspect. In this article, I shall discuss this concept as a starting point for addressing the moral status of plants anew; I shall therefore first outline the content of flourishing as explained in botany. The article then explores the evaluative aspect of flourishing in the context of three questions. These questions are: how does the concept of flourishing fit into moral theory? Why do (...) plants deserve a moral standing? And finally, what are the consequences of this approach to plants in ethics? The exploration of these questions contributes to a fine-grained perspective on the moral implications of the capacity of plants to flourish. (shrink)

Many clinical ethics support services do not involve patients. This is surprising because of the broad commitment to provide patient-centered healthcare. Clinical ethics support services are a component of the healthcare system and have an influence on patient care, and should therefore align with the regulatory and ethical requirements of patient-centered care, just process and cultural competence. First, in order to achieve good patient care, it is essential to involve patients in making their own healthcare decisions. Second, just ethical deliberation (...) requires that the deliberating parties have access to complete, accurate and unbiased information – this is best achieved through direct patient input. These arguments are especially compelling in the case of non-dominant cultural and ethnic groups. Here, we argue that when a clinician refers a case to a clinical ethics support services for consideration, and that case involves a conflict between the views or values of the clinician and the patient, the patient is entitled to, at a minimum: (a) be informed of the referral; (b) have the opportunity to speak directly to the clinical ethics support services prior to deliberation; (c) be provided with any opinion directly from the clinical ethics support services; and (d) have the opportunity to speak to a clinical ethics support services member after the deliberation. We use New Zealand as a case study to support and extrapolate the ethical principles and the minimum patient involvement requirements. We draw on our empirical research with senior doctors at a tertiary New Zealand hospital. Clinicians in our study indicated that they would feel bound by clinical ethics support service advice and that the clinical ethics support service has a significant impact on patient care in the case it reviews. RESUMO O propósito deste artigo é aproximar o significado do pensar calculador de Heidegger e a teoria sobre a sociedade do risco de Beck, considerando suas interpelações com o significado da técnica na modernidade. Porém, mais que tratar das aproximações entre ambos os pensadores, este estudo pretende também demonstrar a importância da filosofia da técnica de Heidegger para pensar o sentido do cálculo do risco e do risco do cálculo na sociedade do risco. Assim, argumenta-se que a teoria do risco (...) de Beck confirma e atualiza o pensamento de Heidegger sobre a técnica moderna, quando se observa que o pensar calculador, que dirige e controla o modo de ser na era do técnico, manifesta-se hoje com toda claridade na sociedade do risco global. ABSTRACT The purpose of this paper is to bring the meaning of Heidegger’s calculative thinking and Beck’s risk society theory closer, as well as their interpellations with the meaning of technique in modernity. Nevertheless, more than dealing with the convergences between both thinkers, this study also intends to demonstrate the importance of Heidegger’s technique philosophy in order to investigate the meaning of risk calculation and of calculation risk in risk society. Therefore, it argues that Beck’s risk theory confirms and updates Heidegger’s thinking on modern technique, as one observes that calculative thinking, which directs and controls the way of being in the age of technicality, clearly manifests itself nowadays, in the global risk society. This article outlines the limits of Marx’s critique of political economy by underscoring the grounding of economics in the nomos of the oikos—law of the household, or oikonomia. It traces the racial-gendered limits on concepts of equality and justice that have shaped neoliberalism, economic nationalism, and their contemporary criticism.

Biotechnology might contribute to solving food safety and security challenges. However, gene technology has been under public scrutiny, linked to the framing of the media and public discourse. The study aims to investigate people’s perceptions and acceptance of food biotechnology with focus on transgenic genetic modification versus genome editing. An online experiment was conducted with participants from the United Kingdom and Switzerland. The participants were presented with the topic of food biotechnology and more specifically with experimentally varied vignettes on transgenic (...) and genetic modification and genome editing. The results suggest that participants from both countries express higher levels of acceptance for genome editing compared to transgenic genetic modification. The general and personal acceptance of these technologies depend largely on whether the participants believe the application is beneficial, how they perceive scientific uncertainty, and the country they reside in. Our findings suggest that future communication about gene technology should focus more on discussing trade-offs between using an agricultural technologies and tangible and relevant benefits, instead of a unidimensional focus on risk and safety. Concerns about exploitation pervade the literature on commercial cross-border reproductive care, particularly egg selling and surrogacy. But what constitutes exploitation, and what moral weight does it have? I consider the relationship between vulnerability, limited choice, consent, and mutually advantageous exploitation. To elucidate the difference between limited choice and consent, I draw on an account of relational autonomy. In the absence of a normative principle of fair distribution, it is unclear whether the providers of reproductive goods and services are treated fairly (...) in such contracts, and therefore whether they have been exploited. I finish with some pragmatic recommendations for minimizing risks and empowering egg sellers and surrogates. (shrink)

In this article, we discuss the ethics of research suspensions in animal research facilities and the consequent (mis)treatment of laboratory animals during emergencies. Through a case study from Switzerland during the COVID-19 pandemic, we articulate ethical principles and moral considerations that ought to guide the treatment and care of laboratory animals within animal research facilities during emergencies. They include a principle of preparedness, the importance of recognizing animal laboratory personnel as essential workers and conducting a Harm-Benefit Analysis in the case (...) of an emergency, assigning responsibilities in a clear way, and providing psychological support in the aftermath of an emergency. More generally, we suggest that the pandemic should be taken as a learning opportunity for critically re-evaluating and improving emergency planning within animal research institutions worldwide, in view of mitigating risks to both human and animal well-being in future emergencies. The most distinctive features of public goods are usually understood to be the difficulty of excluding potential beneficiaries and the fact that one appropriator’s benefits do not diminish the amount of benefits left for others. Yet, because of these properties (non-excludability and non-rivalry), public goods cause market failures and contribute to problems of collective action. This article aims to portray public goods in a different light. Following a recent reassessment of public goods in political philosophy, this contribution argues that public (...) goods are particularly suitable for sustaining a well-ordered society. Public goods contribute to social inclusion, they support the generation of the public, and they strengthen a shared sense of citizenship. This article scrutinizes these functions of public goods and offers a discussion of the interventionist thesis which states that governments should sustain public goods. (shrink)

Environmental virtues have become an essential ingredient in an ethics of nature. An account of environmental virtues can contribute to this ethics of natre by exploring the virtues that the gardener displays in cultivating and caring for plants. An approach that relates to the virtues of gardening is helpful in explicating a more general approach in a certain domain of interaction with nature. Good gardeners get involved in processes of natural growth and decay, they are aware of their position within (...) the garden, and they endure ambivalences in nature. This relational account of the virtues of gardening is also exemplary in processes of active co-designing of nature and in landscaping. (shrink)

In political philosophy, citizenship is a key concept. Citizenship is tied to rights and duties, as well as to concepts of social justice. Recently, the debate on citizenship has developed a new direction in focusing on qualified notions of citizenship. In this contribution, I shall defend three claims. Firstly, consumer citizenship fits into the discussion of qualified notions of citizenship. Secondly, the debate on qualified notions of citizenship cannot be detached from the normative claims in the philosophy of citizenship more (...) generally. In particular, duties and rights receive a distinct shape when debated in terms of “consumer citizenship”. Thirdly, I shall argue that further normative limits can be established by discussing qualified notions of citizenship as items of a list that need to cohere in normative terms. In discussing water justice, this paper distinguishes four concepts of water justice: Distributive justice claims a fair share of water, ecological justice focuses on the integrity of water as a vulnerable resource, cultural justice addresses values attached to water reservoirs, and procedural justice explicates fair procedures in negotiating water conflicts. After having given an overview over recent contributions to the various meanings of water justice, the paper tries to answer the question of how standards of justice can be integrated into (...) an approach that overcomes the alleged tragedies of the commons. Este artículo busca debatir las preguntas concernientes al campo de estudio de la comunicación, su objeto y el público objetivo de sus avances. Fuera de preguntarse sobre el qué y el porqué de la comunicación, cuestiona el rol de la medición bibliográfica como criterio suficiente para determinar la calidad de la investigación y propone abrir un debate público con los desarrollos investigativos del campo. El debate toma aspectos epistémicos del campo de estudio y confronta la visión positivista que limita actualmente (...) las políticas gubernamentales sobre ciencia y tecnología. Finalmente se propone una visión más amplia de los problemas atinentes a la comunicación y se abren algunos interrogantes a propósito de la cienciometría como criterio de medición de calidad. FEATURED IN EVENTAL AESTHETICS RETROSPECTIVE 1. LOOKING BACK AT 10 ISSUES OF EVENTAL AESTHETICS. In this article I ask: how to rescue “magical thinking” (a notion I inherit from Max Horkheimer and Theodor Adorno) in and from Hegel and imagine its possibilities for posthuman society, ethics, and aesthetics? To address this question, I read Hegel’s Phenomenology of Spirit through Horkheimer and Adorno, who argue that Enlightenment’s program is “the disenchantment of the world”: with the end of magical thinking and the (...) beginning of enlightened thinking came chasm and disparity between subject and object and, for Horkheimer and Adorno, the onset of barbarism. Hegel himself speaks directly to the danger of failed recognition between two consciousnesses, a failure followed by a duel to the death, in which the two figures leave each other indifferently, like things. After reading a distinctly “magical thinking” into the shape of Hegel’s dialectic, I show how contemporary posthumanism and ecopoetics make use of Hegel’s thought in order to reimagine subject-object relations in and as response to ecological crisis. I discuss how Donna Haraway, following in the traditions of Hegel and Adorno, magically thinks her way toward new models for relating more ethically (to borrow Haraway’s own terminology) to human and other-than-human others in the new century. Then, I look at how such models are being adapted in and by aesthetic practice — specifically, in the experimental ecopoetics of contemporary poet Brenda Hillman. In the end, I argue that contemporary posthumanisms and ecopoetics in fact need magical thinking in order to begin reimagining the social and the ecological and resuscitate a devastatingly enlightened world.
