Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden die Fortsetzung (...) eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. Indem ich versuchte, von Seiten der Logik aus einen Zugang zu den Grundbegriffen der Mathematik zu gewinnen, erwies es sich vor allem als notwendig, die B e g r i f f s f u n k t i 0 n e'lhsimaher zu zergliedern und auf ihre Voraussetzungen zuruckzufuhren. Hier (...) aber machte sich alsbald eine eigentumliche Schwierigkeit geltend: die her kommliche logische Lehre vom Begriff zeigte sich in ihren bekannten Hauptzugen als unzureichend, die Probleme, zu denen die Prinzipienlehre der Mathematik hinfuhrt, auch nur vollstandig z u b e z e i c h n e n. Die exakte Wissenschaft war hier, wie sich mir immer deutlicher zu ergeben schien, zu Fragen gelangt, fur welche die Formensprache der tradi tionellen Logik kein genaues Correlat besitzt. The subtitle of this book, a slightly revised dissertation from the University of Bonn (1994), reads: "Investigations into the developmental history of Johann Gottlieb Fichte's original reception of Kant." The work (...) comes to almost 600 pages. The main text is heavily overlaid with detailed footnotes, extensive quotations and supplementary material in smaller print and narrow line spacing. To the reader who is patient enough to face this scholastic mode of presentation, there emerges behind it a valuable contribution to our overall understanding of Fichte's philosophical work in general and its core discipline, the Wissenschaftslehre or first, transcendental philosophy, in particular.In the grand narrative about the development of German idealism Fichte is placed between Kant and Schelling. More precisely, he is typically portrayed as continuing but also revising Kant's work under the double influence of the leading early post-Kantian, Karl Leonhard Reinhold (1758-1823), and the skeptical anti-Kantian and anti-Reinholdian, Gottlob Ernst Schulze (1761-1833), called "Aenesidemus" after the title of his anonymous main work.Wildfeuer's investigations supplement this picture with a detailed consideration of what could be called "Fichte before Fichte": the early development of Fichte's thought, prior to his encounter with Reinhold and prior even to his encounter with Kant (1790). To be sure, Wildfeuer also deals with Fichte's continued philosophical development up through 1794, and he has many interesting things to say about the lasting presence of Fichte's earliest concerns in his more mature work. In particular, he maintains the dependence of the will on the intellect and of the latter on sensations or sensory impressions. Wildfeuer refers to this position, as it was temporarily adopted by Fichte, as that of the primacy of the understanding over the will.But Wildfeuer also shows that from early on Fichte's determinist leanings in speculation were counterbalanced by the conviction that feeling, especially feeling in religious matters, is an equally valid source of truth. For Wildfeuer, this early duality of speculation and feeling is the lasting basis of Fichte's life-long concern with reconciling the competing demands of head and heart. A large number of engineering problems involve several conflicting objectives, which today are often solved through expensive simulation calculations. Methods based on meta-models are one of the approaches to solving this group of problems. In this paper, multiobjective optimization in the extraction system of a copper open-pit mine complex is presented by the modified-NBI optimization method and regression meta-model. For this purpose, two objective functions of maximizing the amount of total extraction, which is the sum of the extraction of sulfide, (...) oxide, low-grade ores, and waste in this mine, and minimizing the transport time of haulage according to the limitation of its storage capacity, transport equipment, and budget are considered. The Central Composite Design method is used to build the Design of Experiments for the design variables. The considered design variables are the number of trucks of 120 tons, 240 tons, 35 tons, and 100 tons. The number of targets considered in each design combination is considered the response surface. The suitable meta-model to maximize the total extraction rate and minimize the transport time of the haulage, two modified functions of nonlinear regression have been determined. The accuracy of the models for selection has been done using PRESS and R 2 statistics. The most common PRESS error has also been used to validate the meta-models. Then the multiobjective optimization problem was solved using the modified-NBI method. Finally, Pareto and optimal solutions using the proposed approach were presented and discussed. (shrink)

Idle talk, seemingly dimming one's view, has been replaced by hallucination, dreams, and illusions. It is so very difficult to see through them and to realize that there is nothing there but them.

During the last decade, an increasing amount of research has focused on the ethical context in organizations. Among the recent approaches in this area is the construct of socio-moral climate, which adopts a developmental perspective and refers to specific elements of organizational climate that include communication, cooperation, and how organizations handle conflict. In this article, we present the results of three empirical studies, shedding light on the nomological network of SMC. Whereas the first study introduces a short SMC measure, the (...) other two studies examined antecedents and outcomes of SMC as well as related mediating mechanisms. Confirmatory factor analysis revealed good fit indices of the 21-item measure of SMC with five subscales. Structural equation modeling confirmed a strong relationship with servant leadership as antecedent to SMC. In turn, employees who perceived a positive SMC were less likely to experience feelings of organizational cynicism and to engage in deviant behaviors. Results indicate that SMC accounted for additional variance above and beyond perceived overall justice. (shrink)

Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die Schreiben (...) Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts.
