Hadley Arkes argues that it is necessary to move "beyond the Constitution", to the principles that stood antecedent to the text, if we are to understand the text and apply the Constitution to the cases that arise every day in our law.

The flaws in social psychological research pointed out by Cesario have societal costs. These include ignoring crucial base rates thereby degrading the effectiveness of policy decisions, generalizing the conclusions derived from experiments on non-professionals thereby distorting the public's view of professional law enforcement personnel, questionable accusations of racism, and mis-attributions of the causes of racial differences in behavior.

"Dialogue" is one of American religion's shopworn terms. Although we hear much talk about dialogue, very little of it actually takes place. Religious discourse - especially about politics and public affairs - is increasingly polarized, involving much contestation but little conversation. If truth are to be tested, however, there is no substitute for dialogue.

The city of Cincinnati, we know, can be an engaging place, but federal judge Arthur Spiegel also found, in the mid-'90s, that it could be quite a vexing place. The city council of Cincinnati had passed what was called the Human Rights Ordinance of 1992, which barred virtually all species of discriminationAppalachian origin.sexual orientation.minority status” in the law. The framers of the amendment objected to the tendency to treat gays and lesbians on the same plane as groups that have suffered (...) discrimination based on race, religion, or gender. The proposal, known as Issue 3, drew wide support and passed in a referendum in 1993. It was, of course, challenged in the courts, which is why it found its way into the hands of Judge Spiegel. According to a simple form of consequentialism, we should base decision on our judgments about their consequences for achieving out goals. Our goals give us reason to endorse consequentialism as a standard of decision making. Alternative standards invariably lead to consequences that are less good in this sense. Yet some people knowingly follow decision rules that violate consequentialism. For example, they prefer harmful omissions to less harmful acts, they favor the status quo over alternatives they would otherwise judge to be (...) better, they provide third-party compensation on the basis of the cause of an injury rather than the benefit from the compensation, they ignore deterrent effects in decisions about punishment, and they resist coercive reforms they judge to be beneficial. I suggest that nonconsequentialist principles arise from overgeneralizing rules that are consistent with consequentialism in a limited set of cases. Commitment to such rules is detached from their original purposes. The existence of such nonconsequentialist decision biases has implications for philosophical and experimental methodology, the relation between psychology and public policy, and education. (shrink)

İşitme kaybı sebebiyle işitme engeli olan çocukların dil gelişimleri gecikmekte ve buna bağlı olarak da bilişsel ve sosyal gelişimlerinde gecikme yaşanmaktadır. Bu sebeple işitme engelli çocuklara işitme engelliler için açılan ilkokullar, ortaokullar ve liselerde özel eğitim verilmektedir. İşitme engelliler ortaokullarının ve bu okullarda öğrenim gören öğrencilerin birçok sorunu bulunmaktadır. Bu sorunlardan biri de öğretmen eğitimi konusudur. Çünkü işitme engelliler eğitimi özel bir alandır ve eğitim verecek kişilerin de bu özel eğitimi verebilecek yeterlilikte olması gerekmektedir. Ancak özel eğitime ihtiyacı olan işitme (...) engelli öğrencilere eğitim veren işitme engelliler ortaokullarında görev yapmaya başlayan Din Kültürü ve Ahlak Bilgisi (DKAB) öğretmenleri, bu okullarda görev yapan diğer branş öğretmenleri gibi işitme engelli öğrencilerin eğitimi konusunda özel eğitim almadan, işitme engelli öğrencileri tanımadan bu okullarda görev yapmaya başlamaktadır. Bu da birçok sorunu beraberinde getirmektedir. Bu araştırmada Türkiye’de işitme engelliler ortaokullarında görev yapan DKAB öğretmenlerinin DKAB derslerinin öğretimi konusundaki yeterliliklerini, yine DKAB öğretmenlerinin görüşlerine bağlı kalarak çeşitli boyutlarıyla ortaya çıkarmak amaçlanmıştır. Öğretmenlerin karşılaştıkları sorunları ayrıntılı olarak ifade edebilecekleri düşüncesiyle araştırmada nitel araştırma yöntemi belirlenmiştir. Farklı illerde bulunan öğretmenlere yönelik hazırlanan görüşme formu, yarı yapılandırılmış görüşme tekniği ve standartlaştırılmış açık uçlu görüşme yapılarak 28 katılımcıya uygulanmıştır. Araştırmada ortaya çıkan bulgular değerlendirilmiş ve araştırmanın son bölümünde sonuç ve öneriler ifade edilmiştir. Araştırma sonucunda işitme engelliler ortaokullarında göreve başlayan DKAB öğretmenlerinin bu alanda yeterli düzeyde eğitim almadan göreve başladıkları, bu sebeple okula uyum sağlayana kadar ciddi bir zaman kaybı yaşadıkları, öğrencilerle iletişim kurmada zorlandıkları, öğretmen ve öğrencilerin yeterli seviyede Türk işaret dili bilmemesinin de bu sorunu artırdığı görülmüştür. Öğretmenlerin derslerde farklı anlatım yöntemleri kullanmaya çalışmalarına rağmen bu konuda da zorluklar olduğu, bireyselleştirilmiş eğitim planı hazırlanması ve uygulanmasında da sorunlar yaşandığı ortaya çıkmıştır. What role did Humanism play in the emergence of English Protestantism? This question has remained a live issue for Reformation scholarship over the past four centuries. In The Ark, the Covenant, and the Poor Men's Chest, the author examines the issue in detail, utilizing categories drawn from the research of John W. O'Malley on the application of different modes of classical rhetoric to biblical interpretation during the Renaissance. Anyone interested in either the revival of classical learning during the Renaissance or (...) the religious upheaval of the English Reformation will benefit from reading this work. The book's focus on primary sources from the sixteenth century and the best insights from recent secondary scholarship yields insights that will be of great interest to specialists in the field of Renaissance and Reformation studies. The inclusion of a timeline of major events, a biographical index of major figures, and a glossary of theological terms make this work accessible and helpful for students with varying degrees of familiarity with early modern England. Comparing the exegetical writings of Erasmus and John Colet, the author illustrates the key differences between Erasmian and Italian Humanism. Erasmus' reliance upon deliberative oratory for the explication of scripture, and his preoccupation with a Platonic philosophia Christi, result in an oracular Christology, focused narrowly on the speech of Jesus. By contrast, Italian Humanism relies upon epideictic rhetoric, and yields a portrait of Christ that highlights the deeds of the Messiah and the paschal dimensions of His salvific work, as seen in the writings of John Colet. These divergent patterns of biblical interpretation are also characteristic of the writings of the two bishops of London during the Reformation, Edmund Bonner, and Nicholas Ridley. Their contrasting approaches to scriptural interpretation suggest that opting for either Italian or Erasmian Humanism may have been decisive, both for Ridley's Protestantism and Bonner's Catholicism. In 1990 the Human Genome Project (HGP) was launched as an important historical marker, a pivotal contribution to the time-old quest for human self-knowledge. However, when in 2001 two major publications heralded its completion, it seemed difficult to make out how the desire for self-knowledge had really been furthered by this endeavor (IHGSC 2001; Venter et al. 2001). In the middle of the ninth century, Isho‘dad of Merv, the East Syrian bishop of Haditha wrote extensive commentaries on all of the books of the Old and the New Testament, using a variety of sources, not only exegetical ones. This article offers the first (partial) reconstruction of Isho‘dad’s Syriac chronographic source, on the basis of a comparison of material in his commentaries on the Old Testament with two Syrian Orthodox chronicles (Michael the Syrian and the Anonymous Chronicle of 1234) (...) and one Arabic Melkite chronicle (Agapius of Mabbug). It will be argued that this Syriac chronicle was written between the middle of the sixth century and the middle of the ninth century and was influenced by a variety of sources, most notably the Syriac Chronicle of Andronicus and the Chronicle Epitome of John Malalas. «Etre ou ne pas être phénoménologue?» Cette question a une portée historique. Elle nous confronte à ceux qui l’ont posée la première fois : à ceux qui ont fait de cette interrogation un motif central de leur pensée. Peut-on comprendre Heidegger sans l’imaginer faire l’inventaire de l’héritage husserlien et avancer des raisons pour défendre ou réfuter une de ses thèses? Il s’est souvent demandé pourquoi il n’était pas phénoménologue, et plusieurs de ses livres donnent une réponse à cette question. Est-il (...) possible de comprendre Sartre sans cette question ? Et Merleau-Ponty ? On voit planer au-dessus de leurs œuvres l’ombre bienveillante et sévère d’Husserl, cette ombre qui est comme un défi à leur originalité. On imagine ces deux Français se demander secrètement si l’Allemand de Fribourg avait prévu que sa doctrine serait un jour confrontée à la question de la contingence ou à celle de l’esthétique. Sartre, comme beaucoup de génies, manifeste de l’impatience vis-à-vis du génie d’autrui ; celui d’Husserl l’a parfois exaspéré. On lit dans son œuvre les raisons qui expliquent pourquoi il n’est pas qu’un phénoménologue husserlien. Une autre réponse à la même question se trouve dans les œuvres de Merleau-Ponty. (shrink)
