I saggi che compongono questo libro intendono presentare in maniera organica e interdisciplinare, anche se da una prospettiva fondazionale logico-filosofica, il ruolo che il concetto di prova svolge in differenti ambiti del sapere. L’elemento innovativo e caratterizzante del volume è quello di stabilire e formulare quali sono le condizioni di adeguatezza materiale e formale per una corretta esplicazione del concetto di prova nelle sue differenti applicazioni. Si cercherà, inoltre, di cogliere cosa ha qualificato storicamente e qualifica tuttora il concetto di (...) prova tentando di individuarne, da un lato, le caratteristiche persistenti o invarianti e, dall’altro, le differenze specifiche che esso assume in molteplici settori della ricerca. This paper outlines a truth-conditional view of logical form, that is, a view according to which logical form is essentially a matter of truth-conditions. The main motivation for the view is a fact that seems crucial to logic. As _§_1 suggests, fundamental logical relations such as entailment or contradiction can formally be explained only if truth-conditions are formally represented.§2 spells out the view. _§_3 dwells on its anity with a conception of logical form that has been defended in the past. Name any valued human trait—intelligence, wit, charm, grace, strength—and you will find an inexhaustible variety and complexity in its expression among individuals. Yet we insist that such diversity does not provide grounds for differential treatment at the most basic level. Whatever merit, blame, praise, love, or hate we receive as beings with a particular past and a particular constitution, we are always and everywhere due equal respect merely as persons. -/- But why? This essay explores the connection between representation and explanation in the sciences. I suggest that scientific representation schemes be viewed as pragmatic tools for acquiring the sort of articulated awareness that is the hallmark of nontrivial knowledge. Crystal field theory in chemistry illustrates this perspective. Certain representations achieve the status of being paradigmatically explanatory, thereby shaping models of intelligibility. In turn, these explanatory preferences serve largely to define and differentiate disciplinary communities by implicitly endorsing particular epistemic aims and values. Most contemporary chemists consider quantum mechanics to be the foundational theory of their discipline, although few of the calculations that a strict reduction would seem to require have ever been produced. In this essay I discuss contemporary algebraic and diagrammatic representations of molecular systems derived from quantum mechanical models, specifically configuration interaction wavefunctions for ab initio calculations and molecular orbital energy diagrams. My aim is to suggest that recent dissatisfaction with reductive accounts of chemical theory may stem from both the (...) inability of standard accounts of reduction to incorporate the diverse forms of representation found in chemical practice and our philosophical predilection to analyze all connections between theories in terms of logical reduction. This book develops the view that meaningful work is central in human flourishing. The author defends a pluralistic account of what makes work meaningful, arguing that work can be meaningful in virtue of developing capabilities, supporting virtues, providing a purpose, or integrating elements of a worker's life.

Is logic masculine? Is women's lack of interest in the "hard core" philosophical disciplines of formal logic and semantics symptomatic of an inadequacy linked to sex? Is the failure of women to excel in pure mathematics and mathematical science a function of their inability to think rationally? Andrea Nye undermines the assumptions that inform these questions, assumptions such as: logic is unitary, logic is independenet of concrete human relations, and logic transcends historical circumstances as well as gender. We argue that there are three coherent, nontrivial notions of basic-ness: conceptual basic-ness, biological basic-ness, and psychological basic-ness. There is considerable evidence for conceptually basic emotion categories (e.g., “anger,” “fear”). These categories do not designate biologically basic emotions, but some forms of anger, fear, and so on that are biologically basic in a sense we will specify. Finally, two notions of psychological basic-ness are distinguished, and the evidence for them is evaluated. The framework we offer acknowledges the force of some (...) of the objections to basic emotion theory whilst demonstrating that the notion of a basic emotion, once properly reformulated, is still of scientific value. Philosophical cognitivists have argued for more than four decades that emotions are special types of judgments. Anti-cognitivists have provided a series of counterexamples aiming to show that identifying emotions with judgments overintellectualizes the emotions. I provide a novel counterexample that makes the overintellectualization charge especially vivid. I discuss neurophysiological evidence to the effect that the fear system can be activated by stimuli the subject is unaware of seeing. To emphasize the analogy with blind sight , I call this phenomenon blind (...) fright . Cognitivists may reply that blindfright is nothing but an unconscious judgment subcortically elicited. This reply is in line with the strategy commonly employed by cognitivists against their critics. I call it the Elastic Strategy, because it consists of ‘stretching’ the notion of judgment in order to accommodate counterexamples. This strategy, I argue, turns cognitivism into a theory that is at worst unfalsifiable and at best trivially true. The final portion of my article aims to rescue cognitivism from the damage done by the Elastic Strategy. I distinguish three varieties of cognitivism, one concerned with what emotions essentially are (Constitutive Cognitivism), one concerned with what causes emotions (Etiological Cognitivism) and one concerned with what emotions represent (Representational Cognitivism). I conclude that what cognitivism has to offer to emotion theory are primarily insights concerning the causes and representational content of emotions. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. In this concise exploration of the significance of the celestial world for Aristotle's science of nature, Falcon investigates the source of discontinuity between celestial and sublunary natures and argues that the conviction that the natural world exhibits unity without uniformity is the ultimate reason for Aristotle's claim that the heavens are made of a special body, unique (...) to them. The aim of this review is to highlight the most relevant contributions on dance in neuroscientific research. Neuroscience has analyzed the mirror system through neuroimaging techniques, testing its role in imitative learning, in the recognition of other people's emotions and especially in the understanding of the motor behavior of others. This review analyses the literature related to five general areas: breakthrough studies on the mirror system, and subsequent studies on its involvement in the prediction, the execution, the control of movement, (...) and in the process of “embodied simulation” within the intersubjective relationship; research focused on investigating the neural networks in action observation, and the neural correlates of motor expertise highlighted by comparative studies on different dance styles; studies dealing with the viewer's experience of dance according to specific dance repertoires, which revealed the relevance of choreographic choices for aesthetic appreciation; studies focused on dance as an aesthetic experience, where both the emotional and the cultural dimension play a significant role, and whose investigation paves the way to further progress both in empirical and in phenomenological research methodologies; collaboration-based experiments, in which neuroscientists and choreographers developed expertise-related questions, especially focusing on the multiple phenomena that underlie motor imagery. There seems to be a minimal core that every theory wishing to accommodate the intuition that the future is open must contain: a denial of physical determinism (i.e. the thesis that what future states the universe will be in is implied by what states it has been in), and a denial of strong fatalism (i.e. the thesis that, at every time, what will subsequently be the case is metaphysically necessary).1 Those two requirements are often associated with the idea of an (...) objective temporal flow and the non-reality of the future. However, at least certain ways to frame the “openness” intuition do not rely on any of these. Branching Time Theory (BTT) is one such: it is compatible with the denial that time flow is objective and it is couched in a language with a (prima facie) commitment to an eternalist ontology. BTT, though, urges us to resist certain intuitions about the determinacy of future claims, which arguably do not lead either to physical determinism or to fatalism. Against BTT, supporters of the Thin Red Line Theory (TRL) argue that their position avoids determinism and fatalism, while also representing the fact that there is a future which is “special” because it is the one that will be the case. But starting with Belnap and Green 1994, some have objected to the tenability of TRL, mainly on metaphysical grounds. In particular, those argue that “positing a thin red line amounts to giving up objective indeterminism,”2 and that “has unacceptable consequences, ranging from a mistreatment of actuality to an inability to talk coherently about what would have happened had what is going to happen not taken place.”3 In this paper, we wish to reframe the.. Perceptions of a firm’s stance on corporate social responsibility (CSR) are influenced by its corporate marketing efforts including branding, reputation building, and communications. The current research examines CSR from the consumer’s perspective, focusing on antecedents and consequences of perceived CSR. The findings strongly support the fact that particular cues, namely perceived financial performance and perceived quality of ethics statements, influence perceived CSR which in turn impacts perceptions of corporate reputation, consumer trust, and loyalty. Both consumer trust and loyalty were also (...) found to reduce the perceived risk that consumers experience in buying and using products. This paper employs some outcomes (for the most part due to David Lewis) of the contemporary debate on the metaphysics of dispositions to evaluate those dispositional analyses of meaning that make use of the concept of a disposition in ideal conditions. The first section of the paper explains why one may find appealing the notion of an ideal-condition dispositional analysis of meaning and argues that Saul Kripke’s well-known argument against such analyses is wanting. The second section focuses on Lewis’ work (...) in the metaphysics of dispositions in order to call attention to some intuitions about the nature of dispositions that we all seem to share. In particular, I stress the role of what I call "Actuality Constraint". The third section of the paper maintains that the Actuality Constraint can be used to show that the dispositions with which ideal-condition dispositional analyses identify my meaning addition by "+" do not exist (in so doing, I develop a suggestion put forward by Paul Boghossian). This immediately implies that ideal-condition dispositional analyses of meaning cannot work. The last section discusses a possible objection to my argument. The point of the objection is that the argument depends on an illicit assumption. I show (1) that, in fact, the assumption in question is far from illicit and (2) that even without this assumption it is possible to argue that the dispositions with which ideal-condition dispositional analyses identify my meaning addition by "+" do not exist. This text aims to show how some substantial ontological conclusions, consistent with the notion of ‘complexity’, can be demonstrated through elementary phenomenological analyzes. In particular, we will show that it is necessary to acknowledge an ontology where the forms of ontological efficacy cannot be reduced to efficient causality, the relations between properties are irreducible to deduction, irreducible qualities must exist originally, further qualities emerge from existing qualities, and no explanatory key less complex than the fullness of consciousness’ functions can account (...) for reality. The essay discusses Donald Davidson’s concept of anomalous monism in the framework of Husserlian phenomenology. It develops in four stages. Section 1 is devoted to a critical presentation of the argument for anomalous monism. Section 2 succinctly examines those Husserlian notions that best provide the ground for a discussion parallel to Davidson’s. In Sect. 3, the aporetic status of “mental causation” is analyzed by providing a genetic-phenomenological account of efficient causation. Section 4 draws some general conclusions concerning the kind of (...) efficaciousness that must be attributed to consciousness and discusses the sense in which anomalous monism can be defended in a phenomenological framework, but not in a naturalistic one. The Amazon rainforest is one of the most important topics of transnational activism. Based on the assumption that the consumption of timber in the Northern hemisphere is largely responsible for deforestation, campaigners have focused on the global timber trade. From a strategy of boycotting tropical timber in the 1980s, environmentalists shifted their approach to one influenced by a discourse on ‘sustainable development’ in the 1990s. Believing that they could persuade loggers to use less predatory practices, the mainstream NGOs developed a (...) certification scheme in association with timber companies known as the FSC – Forest Stewardship Council. Since then, the NGOs have gained influence over international policies. The focus on the so-called ‘Amazon forestry vocation’, however, may lead to doubtful results when sustainability of local societies and ecosystems is considered. This article discusses some dimensions of the new Amazon policies that are driven by a global market perspective and which may consequently render local and diverse cultures invisible. (shrink)

The notion of social practice and a family of notions akin to it play an essential role in contemporary philosophical reflection, with particular reference to the conceptualisation of historical processes. Stephen Turner's book A Social Theory of Practices has provided a major challenge to this family of notions, and our purpose is to outline a grounding account of the notion of social practice in the form of an answer to Turner's criticisms. We try to answer three questions: first, if it (...) is necessary to grant a tacit dimension to transmittable habits; second, if and how a tacit dimension of "meaning" could be intersubjectively transmitted; third, what is the possible role of rationality in changing social practices. Our discussion moves from Wittgenstein's argument on rule-following; in its wake we try to examine the nature of habits as a basis for rules and discuss their temporal sedimentation, inertia and modes of intersubjective transmission. In conclusion we support the idea that social practices must rely on a tacit dimension, that their tacit dimension does not represent a hindrance to intersubjective transmission, and that the possible dogmatism of social practices is not due to their "hidden" side, but to their explicit quasi-rational side. Does the recent publication of Heidegger’s Black Notebooks require a re-evaluation of his thought? In the present text we will deal with this question and reach the conclusion that a change of theoretical perspective on Heidegger’s work is indeed justified. The franker and less cautious style of the Black Notebooks puts in the foreground stances that were already known, but were previously relegated to the background: it becomes possible thereby to establish that Heidegger’s philosophical views host a significant lot of (...) unwarranted prejudices, which are incorporated in his picture of the ‘history of being’. We argue that in his process of radical questioning Heidegger progressively drops all available rational methods and epistemic criteria, and that this paves the way to the unwitting reception of personal prejudices in his theoretical frame: Heidegger knowingly abandons all the theoretical instruments that could enable him to discriminate between deeply felt prejudices and proper philosophical intuitions. We conclude our analysis by proposing some criticisms that should be acceptable also to scholars sympathetic with Heidegger’s thought. Heidegger’s vindication of an ‘erratic’ way of thinking, where the journey is more qualifying than the result, turns out to be incompatible with the assertiveness of the many unjustified claims disseminated across the Black Notebooks. Moreover, Heidegger wants to show the narrowness of an overwhelmingly dialectical and argumentative attitude, while his late style of thinking unwittingly discredits an alternative philosophical style, that widely appeals to a ‘principle of charity’ in the collaboration between author and reader. In his novel The Idiot in particular, in which the death penalty and imprisonment are explored, Dostoevsky unmasks—more radically even than Victor Hugo—the supposedly civilised and lenient forms of modern criminal justice. Dostoevsky’s criticism is ahead of its time; his arguments resemble those subsequently put forward by Foucault. Through a reading of Merleau-Ponty’s late courses on Nature, this essay presents a new reflection on technique and makes explicit the ontological significance of a rethinking of technique in this period. After an analysis of the historical sense of the notion of Nature and of animal behavior, we turn to cybernetics. The need to rethink man on the basis of his contingency, that is, on the basis of his relationship with the world and with the technical objects through which this (...) relationship is structured, arises in the essay. Merleau-Ponty’s course on Nature has thus allowed us to investigate the ontological significance of the notion of technique by considering technical objects that Merleau-Ponty himself references. Technique, by prolonging Nature, becomes the keystone to the contact between man and Being, thus illustrating the necessity, for philosophy and for culture, of a return to the contact with brute being that founds and inhabits it. In his interesting commentary, Joshua Shepherd raises two points—one related to epistemology, the other to ethics—about our article on human cerebral organoids.1 2 From the epistemological standpoint, he calls into question the need for a theory of consciousness. A theory of consciousness, for him, is not necessary because of the lack of consensus about the very nature of consciousness. Shepherd suggests that ‘given widespread disagreement, applying a theory of consciousness may not be helpful when attempting to diagnose the presence of (...) consciousness in cerebral organoids’. In Shepherd’s view, it would be better to transfer ‘concepts already under development in work on the presence and structure of consciousness in difficult marginal cases involving traumatic brain injury’.2 We could not agree more on this last point; detecting a minimal capacity for consciousness in the brain of comatose patients is a very similar challenge to inferring the presence of consciousness in cerebral organoids. Every day, as a by-product of saving many lives, intensive care medicine artificially produces thousands of brains that may remain isolated, split or fragmented; in the worst case, cortical islands, or an archipelago of islands, may survive while being disconnected from the outside world. Can these islands host some form of consciousness? That is, does it feel like anything to be a large piece of human cortex? Addressing this difficult question requires the development of general, objective brain-based indices of consciousness that are independent of sensory processing, executive functions and motor outputs.3 Consider, for example, a patient showing reflexive spontaneous behaviour, no response to command and no ability to communicate. In her brain, afferent pathways are damaged, thereby impairing the recruitment of cortical areas in response to sensory stimulation; basal ganglia, as well as other frontal structures supporting executive functions, are impaired. Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

Masini, A., 2-Sequent calculus: a proof theory of modalities, Annals of Pure and Applied Logic 58 229–246. In this work we propose an extension of the Getzen sequent calculus in order to deal with modalities. We extend the notion of a sequent obtaining what we call a 2-sequent. For the obtained calculus we prove a cut elimination theorem.

According to a widespread view, a complete explanatory reduction of all aspects of the human mind to the electro-chemical functioning of the brain is at hand and will certainly produce vast and positive cultural, political and social consequences. However, notwithstanding the astonishing advances generated by the neurosciences in recent years for our understanding of the mechanisms and functions of the brain, the application of these findings to the specific but crucial issue of human agency can be considered a “pre-paradigmatic science” (...) (in Thomas Kuhn’s sense). This implies that the situation is, at the same time, intellectually stimulating and methodologically confused. More specifically—because of the lack of a solid, unitary and coherent methodological framework as to how to connect neurophysiology and agency—it frequently happens that tentative approaches, bold but very preliminary claims and even clearly flawed interpretations of experimental data are taken for granted. In this article some examples of such conceptual confusions and intellectual hubris will be presented, which derive from the most recent literature at the intersection between neurosciences, on the one hand, and philosophy, politics and social sciences, on the other hand. It will also be argued that, in some of these cases, hasty and over-ambitious conclusions may produce negative social and political consequences. The general upshot will be that very much has still to be clarified as to what and how neurosciences can tell us about human agency and that, in the meantime, intellectual and methodological caution is to be recommended. This paper argues that most of the alleged straight solutions to the sceptical paradox which Kripke ascribed to Wittgenstein can be regarded as the first horn of a dilemma whose second horn is the paradox itself. The dilemma is proved to be a by‐product of a foundationalist assumption on the notion of justification, as applied to linguistic behaviour. It is maintained that the assumption is unnecessary and that the dilemma is therefore spurious. To this end, an alternative conception of the (...) justification of linguistic behaviour is outlined, a conception that vindicates some of the insights behind Kripke's Wittgenstein's sceptical solution of the paradox. This alternative conception is defended against two objections (both familiar from McDowell's works): (1) that it would imply that for the linguistic community there is no authority, no standard to meet and, therefore, no possibility of error and (2) that it would lead to a kind of idealism. Neuroscientific research on the removal of unpleasant and traumatic memories is still at a very early stage, but is making rapid progress and has stirred a significant philosophical and neuroethical debate. Even if memory is considered to be a fundamental element of personal identity, in the context of memory-erasing the autonomy of decision-making seems prevailing. However, there seem to be situations where the overall context in which people might choose to intervene on their memories would lead to view those actions (...) as counterproductive. In this article, I outline situations where the so-called composition effects can produce negative results for everyone involved, even if the individual decisions are not as such negative. In such situations medical treatments that usually everyone should be free to take, following the principle of autonomy, can make it so that the personal autonomy of the individuals in the group considered is damaged or even destroyed. In these specific cases, in which what is called the “conformity to context” prevails, the moral admissibility of procedures of memory-erasing is called into question and the principle of personal autonomy turns out to be subordinate to social interests benefitting every member of the group. The study here is a qualitative research based on multiple case studies of banking service providers to analyze the role of corporate social responsibility (CSR) in the definition of the corporate identity of these kinds of organizations. The results show that, although companies increasingly integrate CSR into their business strategies, there are some aspects of its management such as its communication or the measurement of its results that detract from its success. These results have important implications for those managers pursuing (...) an effective management of CSR policies and strategies in their organizations, especially as the information comes from 6 of the biggest and most important banking institutions in a European country, with a declared assets (loans) volume which represents 62.75% of the total assets in the national banking industry, and thus largely representing the possible heterogeneity of the market in terms of company size, location, legal status, and management styles. In recent years, Brentano’s theory of consciousness has been systematically reassessed. The reconstruction that has received the most attention is the so-called identity reconstruction. It says that secondary consciousness and the mental phenomenon it is about are one and the same. Crucially, it has been claimed that this thesis is the only one which can make Brentano’s theory immune to what he considers the main threat to it, namely, the duplication of the primary object. In this paper, I argue that (...) the identity reconstruction is untenable, and I defend an alternative, which I name the unity reconstruction. According to the unity reconstruction, secondary consciousness is a real part of the mental phenomenon it is about, and hence is distinct from it. I contend that this thesis does not in itself lead to the duplication of the primary object, and that what should be blamed is rather a controversial thesis about the intentional structure of secondary consciousness—a thesis which Brentano ultimately abandoned. Non‐invasive brain stimulation is used to modulate brain excitation and inhibition and to improve cognitive functioning. The effectiveness of the enhancement due to transcranial direct current stimulation (tDCS) is still controversial, but the technique seems to have large potential for improvement and more specific applications. In particular, it has recently been used by athletes, both beginners and professionals. This paper analyses the ethical issues related to tDCS enhancement, which depend on its specific features: ease of use, immediate effect, non‐detectability and (...) great variability of effects. If tDCS were to become widespread, there could be some potential side effects, especially the rise of inequality in many selective competitive contexts. I discuss two possible scenarios to counter this effect: that of prohibition and that of compensation, each supported by reasons and arguments that seem plausible and worthy of consideration. In conclusion, I show why I think the scenario of compensation is the preferable one. (shrink)
