Background: Research involving adults lacking mental capacity relies on the involvement of a proxy or surrogate, although this raises a number of ethical concerns. Empirical studies have examined attitudes towards proxy decision-making, proxies’ authority as decision-makers, decision accuracy, and other relevant factors. However, a comprehensive evidence-based account of proxy decision-making is lacking. This systematic review provides a synthesis of the empirical data reporting the ethical issues surrounding decisions made by research proxies, and the development of a conceptual framework of proxy (...) decision-making for research. Methods: A systematic review was conducted according to PRISMA guidelines. Databases including MEDLINE, EMBASE, and CINAHL were searched using a combination of search terms, and empirical data from eligible studies were retrieved. The review followed the framework synthesis approach to refine and develop a conceptual framework. Results: Thirty-four studies were included in the review. Two dimensions of proxy decision-making emerged. The ethical framing criteria of decision-making used by proxies: use of a substituted judgement, use of a best interests approach, combination of substituted judgement and best interests, and ‘something else’, and the active elements of proxy decision-making: ‘knowing the person’, patient-proxy relationship, accuracy of the decision, and balancing risks, benefits and burdens, and attitudes towards proxy decision-making. Interactions between the framing criteria and the elements of decision-making are complex and contextually-situated. Conclusions: The findings from this systematic review challenge the accepted reductionist account of proxy decision-making. Decision-making by research proxies is highly contextualized and multifactorial in nature. The choice of proxy and the relational features of decision-making play a fundamental role: both in providing the proxy’s authority as decision-maker, and guiding the decision-making process. The conceptual framework describes the relationship between the framing criteria used by the proxy, and the active elements of decision-making. Further work to develop, and empirically test the proposed framework is needed. (shrink)

In Between Shadows and Noise, Amber Musser develops a sensuous method of analysis by moving past the representational clarity of Enlightenment thinking and into the irrational and vulnerable space of shadow and the unruly and excessive dimensions of noise. For Musser, shadows and noise are categories of embodied relation or critical situatedness--modes of attending to context, relation, and hierarchy through affective and sensorial body work. The book's analysis of various art objects, such as Jordan Peele's film US and (...) Samita Sinha's sound performance This Ember State, is rooted in Musser's own autobiographical situatedness as a queer middle-class Black Caribbean expatriate woman and the various politics of difference those identities emerge from. Through a series of meditations on blackness, empire, and colonialism, Between Shadows and Noise offers Black feminist methods for sensing one's way through art (and living) using knowledges held by the body. The increasing possibility of anti-aging, plastic surgery and enhancement procedures, however, again bring about questions of the limits of human medicine, even (...) moreso if, as in transhumanist utopia and cryonic practice, the possibility of postponement or even of overcoming human finitude becomes possible. Medicine, society and the presence of death and dying must respond to these challenges. A variety of factors shape environmental policy and governance (EPG) processes, from perceptions of physical ecology and profit motives to social justice and concerns with landscape aesthetics. Many scholars have examined the role of values in EPG, and demonstrated that attempts to incorporate (especially) non-market values into EPG are loaded with both practical and conceptual challenges. Nevertheless, it is clear that non-market values of all types play a crucial role in shaping EPG outcomes. In this article we explore the role (...) of nostalgia as a factor in EPG. We examine literatures on environmental values, governance and affect in light of their relationships with environmental policymaking, first as a means to decide whether or not nostalgia can be rightly described as an ‘environmental value’. We suggest that, from a philosophical perspective, nostalgia is by itself environmentally neutral, and is not usefully described as a ‘value’. However, as an emotional state that longs to preserve or recover something of the past – whether fading or no longer present – that is fondly remembered, nostalgia does represent a potentially strong ‘motivator’ for EPG decisions. Despite this somewhat ambivalent assessment of nostalgia as an environmental value, we argue that nostalgia and nostalgic longing to return to ‘better’ or ‘cleaner’ environments can lead to potentially significant impacts on ecosystems and landscapes, both positive and negative depending on what it is that people want to preserve or restore. Thus we conclude that we neglect understanding the role of nostalgia in EPG at our peril: first, because preservationist goals have always been an important part of environmental responsibility; and second, because many people will be swayed regarding environmental action through a mobilisation of nostalgia by political leaders and interest groups alike. Political theorists converge in identifying modern techniques of domination as habit-formative and psychologically invasive, in contrast to earlier, more blatantly coercive forms of repression. Putting Aristotle on tyranny in conversation with Michel Foucault on subject formation, this article argues for continuity across the pre- and postmodern divide. Through a close reading of the “three heads of tyranny” in Politics 5.11 (1314a13-29)—those being the tyrant’s efforts to form subjects who (1) have small thoughts (2) are distrustful of one another, and (3) (...) are incapable of action—I argue that central to Aristotle’s account of tyrannical domination is how tyrants cultivate the ethical vice of “small-souledness” ( Nicomachean Ethics 1123b7), thus producing subjects with humbled desires for a proportionate distribution of political power. This article deepens our appreciation of the social and psychological registers of Aristotle’s theorization of domination and gives reasons for continuing to take Aristotle’s insights into tyranny seriously today. Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. A crucial part of William Rowe’s evidential argument from evil implies that God, like a loving parent, would ensure that every suffering person would be aware of his comforting presence. Rowe’s use of the “loving parent” analogy however fails to survive scrutiny as it implies that God maximally loves all persons. It is the argument of this paper that no one could maximally love every person; and whatever variation there is in the divine love undercuts the claim that every suffering (...) person would be aware of the divine presence. The risk of tort liability for health maintenance organizations and other managed care plans has dramatically increased in recent years. This is due in part to the growing percentage of health care rendered through managed care plans. The cost-containment mechanisms commonly used by managed care plans, such as limiting access to services and/or choice of providers, creates a climate ripe for disputes that may end up in court. As dissatisfied patients and providers seek recourse in the courts, tort doctrines are (...) extended and new legal theories emerge as needed. For example, the concepts of direct and vicarious tort liability developed in the hospital context have been extended by courts to encompass HMOs. vicarious liability claims, based on ostensible agency or respondeat superior doctrines, have been brought against HMOs and managed care plans for negligent treatment by physicians selected to provide care to members. Although thick ethical concepts have been neglected in Murdochian scholarship, this article argues that they were central to the thought of Iris Murdoch. In the first section, the article provides a sustained account of thick ethical concepts in Murdoch's philosophy, demonstrating how these concepts align with and illuminate familiar aspects of her philosophical essays. The first section also explores the ways in which Murdoch's alternative account of moral concepts was at the heart of her overall attack on the noncognitivism of (...) her day. In the second section, the article provides a reading of The Black Prince and considers the ways that thick ethical concepts offer new insight into Murdoch's literary activity. It concludes by suggesting that studying Murdoch's philosophy and literature in light of thick ethical concepts reveals a deep unity between her two intellectual projects. (shrink)

It has been said that the Second World War saved the Russian Orthodox Church from extermination. Ever since the Revolution of 1917, the religious peoples of Russia were constantly persecuted by Soviet ideologists and politicians. Prior to Operation Barbarossa, in 1941, it seemed that the days of the Russian Orthodox Church, the largest religious institution in the Soviet Union, were numbered. However, the unique climate of the Second World War forced the Soviet government to end its war against the church. (...) China is rising. As China ascends in power, it is likely that ?Western? administrators ? American and European, in particular ? will find that they must interact with Chinese administrators more and more. In this article, I offer readers a brief glimpse into Chinese administrative ethics through an investigation of two forms of Chinese philosophy ? Confucianism and Taoism. In addition to reviewing these philosophies, I derive some consequences for a public service ethic that lies between the East and the (...) West. In particular, this article includes some recommendations for the managerial implications of these two philosophies in the context of increased political and administrative connections between the West and China. The Milgram obedience experiments called into question the limits of obedience to authority figures. The perverse consequences of concerns over the Milgram experiments are that researchers must now submit to the authority of ethics review boards and that researchers are considered prima facie to be threats to participants. These assumptions are questioned widely by social science researchers, but this article argues that these assumptions seem to have blinded analysts to the possibility that there may be a group of participants that (...) might also be threatened by the power of authority figures in a research situation—researchers. Regarding the second point, social science researchers “interviewing up” may themselves be threatened, whether overtly or covertly, by their participants’ relative authority and power. In cases where researchers work with extraordinarily powerful respondents, what might IRBS and the researchers they work for learn from the Milgram experiments? (shrink)

Grush makes extensive use of von Holst and Mittelstaedt's (1950) efference copy hypothesis. Although his embellishment of the model is admirably more sophisticated than that of its progenitors, I argue that it still suffers from the same conceptual limitations as entailed in its original formulation.

This research examines how two dimensions of moral intensity involved in a corporation’s external crisis response—magnitude of effectiveness and interpersonal proximity—influence observer perceptions of and behavioral intentions toward the corporation. Across three studies, effectiveness decreased negative perceptions and increased pro-organizational intentions via ethical judgment of the response. Moreover, the two dimensions interacted such that a response high in proximity but low in effectiveness led to more negative perceptions and to less pro-organizational intentions. This interaction was particularly pronounced if the corporation (...) portrayed itself as communal-oriented. The interaction was mediated by individuals’ ethical judgment, which was a function of the corporation’s perceived benevolent concern. We termed the interaction the Strategic Samaritan, for it was when the corporation tried to appear like a Good Samaritan, displaying proximity with victims but not accompanying it with effective help, that it was seen as acting with less benevolent concern. The relationship between God and morality has been a topic of philosophical discussion since Socrates engaged Euthyphro in the agora. In recent years, it has received a lot of attention, as theistic philosophers have attempted to show that divine command theory and other theistic meta‐ethical accounts are defensible. Whether metaphysical naturalism is compatible with moral realism is a related (and equally controversial) topic. This essay surveys the main issues in these debates.

Aristotle bequeathed to us a powerful metaphysical picture, of substances in which properties inhere. The picture has turned out to be highly problematic in many ways; but it is nevertheless a picture not easy to dislodge. Less obvious are the normative tones implicit in the picture and the way these permeate our system of values, especially when thinking of ourselves and our ambitions, hopes and fears. These have proved, if anything, even harder to dislodge than the metaphysical picture which supports (...) them. This paper first draws out the ethics suggested by a conception of being as individual substances, and finds both inner tensions among these values—expressed in divergent characteristics in the history of philosophy—and a neglect of a significant set of values. Substance metaphysics prefers freedom, independence and autonomy over relational and reciprocal values, which can even be regarded as existentially threatening. A prominent attempt to accommodate both sorts of values without eschewing substantialist metaphysics is briefly considered, before turning to examine an alternative metaphysics and the values it implies. A metaphysics which takes being as becoming, it is argued, supports an ethics centred on relational values, and their associated virtues of care. (shrink)

This article examines Simone de Beauvoir’s use of a literary motif to convey her philosophical position on inequality in different geographical locations. The “lightscape,” an evocation of place that foregrounds light’s obfuscation of gritty reality, is considered across three works: Les Belles Images, The Mandarins, and America Day by Day. In these texts, the lightscape’s bifurcated presentation of a given locale reflects how inequality hides in plain sight, and divides the rich from the poor, respectively aligning them with the beautiful (...) and the abject. It is commonly maintained that neuroplastic mechanisms in the brain provide empirical support for the hypothesis of multiple realizability. We show in various case studies that neuroplasticity stems from preexisting mechanisms and processes inherent in the neural structure of the brain. We argue that not only does neuroplasticity fail to provide empirical evidence of multiple realization, its inability to do so strengthens the mind-body identity theory. Finally, we argue that a recently proposed identity theory called Flat Physicalism can be enlisted (...) to explain the current state of the mind-body problem more adequately. (shrink)

Socrates’ claim that pleasure is a γένεσις unifies the Philebus’ conception of pleasure. Close examination of the passage reveals an emphasis on metaphysical-normative dependency in γένεσις. Seeds for such an emphasis were sown in the dialogue’s earlier discussion of μεικτά, thus linking the γένεσις claim to Philebus’ description of pleasure as ἄπειρον. False pleasures illustrate the radical dependency of pleasure on outside determinants. I end tying together the Philebus’ three descriptions of pleasure: restoration, indefinite, and γένεσις.

A survey was conducted on the advertising practitioners in Taiwan concerning their experiences of ethical challenges at work. Among 120 respondents, while 32.5 percent responded that ethical problems did not exist, 67.5 percent admitted that ethical problem was a commonplace at work. According to these respondents, the most frequently mentioned ethical problems area representing unethical products or services, the message of advertisements, agency-client relationship, the creditability of research, undertable rebate, and the quality of service. Suggestions for international advertising managers were (...) also provided by comparing the finding from the present study with earlier studies in the United States. However, due to its preliminary nature, the present study should be considered exploratory and descriptive rather than conclusive, with the hope to inspire more research on advertising ethics in Taiwan as well as in other countries in the world. In Psychoanalysis as a Subversive Phenomenon, Amber M. Trotter explores processes of social change, highlights the role of ethics, and illuminates ways in which analytic theory and practice can disrupt contemporary American culture.

Microbiome science asserts humans are made up of more microbial cells and genes than human ones, and that each person harbors their own unique microbial population. Human microbiome studies gesture toward the post-racial aspirations of personalized medicine—characterizing states of human health and illness microbially. By viewing humans as “supraorganisms” made up of millions of microbial partners, some microbiome science seems to disrupt binding historical categories often grounded in racist biology, allowing interspeciality to supersede race. But inevitably, unexamined categories of race (...) and ethnicity surface in a myriad of studies on microbiota. This paper approaches race as a ghost variable across microbiome research and asks, what is race doing in studies of the microbiome? Why is it there, and how is it functioning? I examine this research to argue that social scientists must work with biological scientists to help put microbial differences into perspective—to investigate how microbiomes and race are entangled embodiments of the social, environmental, and biological. Ultimately, transdisciplinary collaboration is required to address racial health disparities in microbiome research without reifying race as a straightforward biological or social designation.
