Son olarak klasik İslam hukuk teorisi kuralları ve prensiplerinin ne derece itibar gördüğü ve bunların günümüzde ictihad vasıtasıyla ger çekleştirilen reformlarda ne derece takip edildiği araştırılmaktadır. Tezin ana odak noktasını modern Müslüman-çoğunluklu ülkelerde İslam hukukunun en yaygın uygulanan yönü olması sebebiyle aile hukuku teşkil etmektedir. 2004 Fas Aile Kanunu reformlarıictihada dayanılarak uygulamaya konduğundan dolayı özellikle incelenmiştir. Tezin ana argümanı ictihadkavramının klasik ana akımdaki anlayıştan tanım, kapsam ve ictihadetme yetkisi açısından farklılık gösterse de modern dönemdeki ictihadkavramsallaştırmaları ve uygulamalarının İslam hukuku içerisinde yer alması gerektiğidir. Nitekim kavramsal bir analiz yapıldığında özellikle tarihi bağlamın sosyo-politik değişikliklerinin zemin hazırladığı çeşitli ictihadanlayışlarının ve uygulamalarının İslam hukuk tarihi içerisinde var olduğu görülmektedir. Modern dönem ictihaduygulamalarına bakıldığında çoğunun genel olarak klasik İslam hukuk teorisinin detaylı kural ve prensiplerini sıkı bir şekilde takip etmediği görülmektedir. Bununla birlikte bu uygulamalar hukuki temellendirmelerden mahrum değildir ve bazıları klasik İslam hukuk bilimi içerisinde kaynağını bulabilmektedir. Reflective journal writing has been recognized as an effective pedagogical tool for nurturing students’ lifelong learning skills. With the paucity of empirical work on the dimensionality of reflective writing, this research sought to qualitatively analyze students’ RJ writing and design a generic reflection scheme for identifying dimensions of reflective thinking. Drawing on the theoretical scheme, another aim was to design and validate a questionnaire to measure students’ perceptions of their reflective writing experiences. The last aim was to quantitatively measure the (...) link between perceived reflective writing and students’ tendency to use RJs in their future careers and personal lives. This exploratory sequential research included the following steps: First, experts’ review and analysis of 1312 RJ entries were attained. This step led to the design of a theoretical scheme of reflective writing and a 31-item questionnaire, used to gather data from 171 students. Partial Least Squares analysis corroborated the structure suggested by the theoretical scheme: two timelines–reflections regarding the current course assignments and those related to the student’s future development. Students’ tendency to use reflective skills in their future professional lives was highly connected to their long-term reflections, including learning experiences linked to academic, professional, personal, and multicultural development. The current study’s suggested validated generic scheme can be adapted and integrated into different curricula, thereby possibly increasing the potential of infusing RJ instructional strategies into higher education curricula, improving the quality of reflection in student journals, and promoting lifelong learning skills. The present study is aimed at comprehensively assess tendency to neutralize (justify) academic cheating as a function of individual experience of teachers’ just behavior and new learning environments (NLE), while considering the Belief in a Just World (BJW) as a personal resource that has the potential to enhance those experiences. Data were collected from a sample of 193 second-year undergraduate college students. Path analysis main results showed that students who evaluated their teachers’ behavior toward them personally as just, held more (...) positive evaluation of the learning environment, and were less inclined toward academic cheating neutralization. Personal BJW was partly associated with the perceived NLE, this connection was primarily mediated by the experience of teacher justice. Moreover, students’ evaluation of their teachers’ just behavior was a stronger negative predictor of academic cheating neutralization than perceived forms of NLE. Interpretation of these results, applications and implications for future research are discussed. (shrink)

Wright Mills was that rarity among American thinkers — a political intellectual — who drew primarily on Western liberal traditions, American traditions of moral pragmatism and craftsmanship, the social classics and methods of sociology, to fashion a unique critical voice. Writing at the end of the liberal era, he brilliantly captured the outlines of a post-modern society he referred to as the “fourth epoch.” In this work, he anticipated and helped shape much of what was good in the American (...) new left, raising questions which remain largely unanswered twenty-four years after his untimely death at age forty-five. Incivility in the academic arena elicits a wide range of reactions: it interferes with learning, increases stress, feelings of disrespect and helplessness. Although reactions to incivility were mainly tested in workplaces, an extensive, robust framework to explain and measure responses to faculty incivility is yet to be offered. This study used Facet theory approach with a multidimensional scaling method of smallest space analysis, and confirmatory factor analysis to confirm the theoretical structure of reactions to FI. A mapping sentence was constructed (...) expressing the composite of three individual facets based on the theoretical framework: Facet A including four types of reactions Exit Voice Loyalty and Neglect ; Facet B reflecting the destructiveness – constructiveness dimension, and Facet C illustrating a dimension ranging from passive to active responses. Data were gathered by a scale measuring students’ reactions to FI. According to the findings, the CFA result presented four relatively interpretable factors while the SSA showed these factors as well as additional facets. (shrink)

ZusammenfassungDie Palliative Sedierung als therapeutische Handlungsoption in anderweitig refraktären Behandlungssituationen wird in der Öffentlichkeit und in Fachkreisen in ihrer klinischen Wertigkeit grundsätzlich akzeptiert und weitgehend positiv konnotiert. Im Widerspruch dazu fallen sowohl die Quantität der empirischen Forschung als auch die Intensität der ethischen und klinischen Diskussion ins Auge, mit der konzeptuelle als auch durchführungsbezogene Aspekte der Palliativen Sedierung beschrieben und kontrovers erörtert werden. Anstatt eines distinkten Behandlungskonzeptes stellt sich hier eher ein komplexes Spektrum verschiedener Vorgehensweisen dar. We argue for a relevance-guided learning mechanism to account for both innovative reproduction and faithful imitation by focusing on the role of communication in knowledge transmission. Unlike bifocal stance theory, this mechanism does not require a strict divide between instrumental and ritual-like actions, and the goals they respectively fulfill (material vs. social/affiliative), to account for flexibility in action interpretation and reproduction.

While religious politics have been a widely discussed topic in the social sciences in recent decades, few studies develop general explanations based on systematic and detailed comparative analysis. This article seeks to explain when and how successful religious parties rise. To that end, I comparatively analyze the politicization of German Catholicism in the second half of the nineteenth century and Turkish Islam in the post-1970 period and briefly examine the negative case of nineteenth-century German Protestantism. According to the theory of (...) revival-reaction-politicization I propose, successful religious parties rise when major religious revivals confront social counter-mobilization and state repression, provided that existing political parties do not effectively represent religious defense. The study's findings challenge the pervasive tendency to treat Christian and Islamic politics as incommensurable. (shrink)

The outbreak of the COVID-19 pandemic has accelerated the need for online counseling to preserve therapeutic processes that have begun face to face and to provide service to others in need during lockdowns. Previous studies underscored the importance of providing updated training as counselors frequently hesitate to use technological advances in therapeutic sessions. This study aims at reducing such barriers by revealing personal characteristics of future professionals that might inhibit or encourage their openness toward providing online counseling. To this end, (...) this study is focused on several precursors of openness to provide online counseling: preference to communicate emotions online, identification of emotional expressiveness advantages in providing online counseling, innovative behavior, creativity, and future problem-solving thinking skills. The question at focus is which constructs would be found contributive to students’ openness to provide online counseling. The sample included 277 undergraduate students who filled out questionnaires. Data were analyzed using Partial Least Squares Structural Equation Modeling. Our findings pointed to the centrality of students’ preference to communicate their emotions online in explaining their openness to conducting online counseling. This study might help pinpointing the adjustments curriculum designers should address to better reflect the intensive changes within the counseling field that necessitate transferring face-to-face skills to online settings. Children develop language and communication skills through interaction with adults and other children. This study therefore focuses on two interdependent issues: the effect of philosophizing with children on children’s language development and the speech acts of teachers and children in philosophical enquiries. As part of a before-after test with the “Hamburger Verfahren zur Analyse des Sprachstandes Fünfjähriger” (Reich & Roth, 2004, Hamburg Procedure for Analysing the Language Level of Five Year-olds), weekly philosophical discussions were undertaken with a test class over (...) a period of six months. The central findings are that the philosophising children developed significantly higher language ability compared with a non-philosophising control class in two areas, namely general performance in discussion and the use of more sophisticated connectors. A further part of the study compared the speech acts of the children and their pre-school teacher in the context of philosophical discussion with their speech acts in a different dialogic situation (dialogic discussion of picture books). This showed that philosophical questions from the pre-school teacher led to the production of particularly complex language by the children. Complex speech acts involve the use of higher-level verb structures and connectors. These are necessary in order to reason and act as a citizen agent and are supported by philosophising with children, as this study shows. (shrink)

This study was aimed at formulating a model to examine the potential value of perceived constructivist pedagogical practices in decreasing tendency to neutralize academic cheating through a psychological outcome of academic self-efficacy, in three academic learning settings: new learning environments, traditional face-to-face learning environments and distance learning environments. Data were collected from a sample of 289 undergraduate college students. Path analysis main results showed positive connections between the extent to which constructivist practices are present in the learning settings, as perceived (...) by the participants, and SE, which in turn reduced the tendency toward justifying academic cheating. Analysis of variance results showed that most of the constructivist dimensions were perceived by students enrolled in the NLE as relatively highly present compared with the other groups. Moreover, NLE students held more positive academic SE beliefs and were less inclined toward academic cheating justification than the other groups. Interpretation of these results and implications for future research are discussed. (shrink)

This dissertation is a study of John Buridan's (c.1300-c.1361) conception of modalities. Modal concepts - concepts of necessity, possibility, impossibility, and contingency - describe the ways in which things could and could not be otherwise. These concepts became notoriously central for philosophical discourse in the late Middle Ages. In recent years, Buridan's philosophy and modal theory have received sophisticated scholarly attention. The main contribution of the dissertation is to show new ways in which Buridan's modal theory is embedded in its (...) contextual practical aims, as providing methods for argumentation schemes and analysis used in his natural philosophy and metaphysics. The dissertation is divided into two parts. In Part I, I conduct a detailed analysis of Buridan's account of varieties of modality in logical contexts. In Chapter 2, I show that Buridan distinguishes between broad and restricted forms of necessity in his treatment of logical consequence. Moreover, I show how the distinction between these forms of necessity underpins his modal syllogistics. I argue in Chapter 3 that Buridan acknowledged a variety of modal concepts that are distinguished as a matter of degree. I identify the main modal concepts Buridan's theory reckons with, show how he motivates the distinctions among them, and clarify how they are logically related. Part II turns to applications of Buridan's modal analyses to natural philosophy. In Chapter 4, I address the relationship between necessity with sempiternal truth in Buridan's commentary on Aristotle's De Caelo and compare Buridan's treatment of a key passage in that commentary with the treatment by John of Jandun (c. 1285-1328), a near-contemporary master of arts at Paris. Chapter 5 focuses on Buridan's account of the relationship between power-based concepts of modality and his modal semantics. Chapter 6 describes Buridan's account of contingency in the Physics, and sets Buridan's account of the relationship between forms of contingency and chance against the background of a received debate between Avicenna's and Averroes' views on the subject. Finally, in Chapter 7, I analyse some important applications of Buridan's distinction between logical and metaphysical possibility in physical contexts. I conclude this section by showing how Buridan considered merely conceivable possibilities useful in natural philosophy, and draw further conclusions for investigating the connections between logic and natural philosophy in the later Middle Ages.
