Health is a value-laden concept. The state of being that it designates is a fundamental human goal. As a value, the concept is normative, governing both clinical practice and the therapeutic treatment developed by medical research. Also, the promise of health plays a pivotal role in health-policy discourse. Almut Caspary considers philosophical and theological concepts of health in the context of its practical significance, both in the past and today. This conceptual analysis culminates in a preliminary sketch of a (...) concept of health; focusing on the stem-cell debate, it offers a discriminating approach to contemporary ethical problems in medicine. "Gesundheit" ist ein wertgeladener Begriff. Er bezeichnet einen grundsatzlich wunschenswerten Zustand menschlicher Existenz, der das arztliche Handeln im klinischen Alltag leitet. This essay examines the role of Martin Heidegger’s philosophy in the ideology of what the author calls the “Nationalist International,” a loosely affiliated international network of “New” Right, nationalist, alt-right, and neo-fascist groups. The author argues that thought leaders of this movement, from the relatively obscure to politicians and organizers in major political parties, such as Steve Bannon in the MAGA movement in the United States or Marc Jongen of Alternative für Deutschland in Germany, have drawn upon Heidegger to articulate (...) their principles and aims. More openly neo-fascist thinkers, such as Greg Johnson in the United States and Aleksandr Dugin in Russia, have produced sophisticated readings of Heidegger to support their causes. Such figures use Heidegger’s critique of Plato, as the onset of a metaphysical nihilism that culminates in modernity, to condemn liberalism as a facet of a rootless universalism that deprives a people of its history and identity. The repudiation of classical liberal democracy in many militant alt-right organizations and online communities played a role in assault on Congress on January 6, 2021 and Donald Trump’s attempted coup that day. The conclusion addresses the question of how educators and others can engage a new generation vulnerable to radicalization and argues for a form of “absolute welcome” as a response to increasing polarization. In both ancient tradition and modern research Pythagoreanism has been understood as a religious sect or as a philosophical and scientific community. Numerous attempts have been made to reconcile these pictures as well as to analyze them separately. The most recent scholarship compartmentalizes different facets of Pythagorean knowledge, but this offers no context for exploring their origins, development, and interdependence. This collection aims to reverse this trend, addressing connections between the different fields of Pythagorean knowledge, such as eschatology, metempsychosis, metaphysics, (...) epistemology, arithmology and numerology, music, dietetics and medicine as well as politics. In particular, the contributions discuss how the Pythagorean way of life related to more doctrinal aspects of knowledge, such as Pythagorean religion and science. The volume explores the effects of this interdependence between different kinds of knowledge both within the Pythagorean corpus and in its later reception. Chapters cover historical periods from the Archaic Period (6th century BC) to Neoplatonism, Early Christianity, the European and Arabic Middle Ages, and the Renaissance through to the Early Modern Period (17th century AD). Hermann Cohen’s essay on Maimonides’ ethics is one of the most fundamental texts of twentieth-century Jewish philosophy, correlating Platonic, prophetic, Maimonidean, and Kantian traditions. Almut Sh. Bruckstein provides the first English translation and her own extensive commentary on this landmark 1908 work, which inspired readings of medieval and rabbinic sources by Leo Strauss, Franz Rosenzweig, and Emmanuel Levinas. Cohen rejects the notion that we should try to understand texts of the past solely in the context of their own historical (...) era. Subverting the historical order, he interprets the ethical meanings of texts in the light of a future yet to be realized. He commits the entire Jewish tradition to a universal socialism prophetically inspired by ideals of humanity, peace, and universal justice. Through her own probing commentary on Cohen’s text, like the margin notes of a medieval treatise, Bruckstein performs the hermeneutical act that lies at the core of Cohen’s argument: she reads Jewish sources from a perspective that recognizes the interpretive act of commentary itself. This paper examines the efforts of contractualists to develop an alternative to aggregation to govern our duty not to harm (duty to rescue) others. I conclude that many of the moral principles articulated in the literature seem to reduce to aggregation by a different name. Those that do not are viable only as long as they are limited to a handful of oddball cases at the margins of social life. If extended to run-of-the-mill conduct that accounts for virtually all unintended (...) (in the sense of undesired) harm to others—noncriminal activities that impose some risk of harm on others—they would rule out all action. Moreover, because such conduct poses an irreducible conflict between freedom of action and freedom from expected harm, it can be regulated only by principles that accept the necessity of making precisely the sorts of interpersonal trade-offs that contractualism is foundationally committed to reject: trade-offs in which the numbers count, such that a risk of serious harm to one person can be justified by small benefits to the many. My topic is authenticity in or perhaps as painting, not the authenticity of paintings; I know next to nothing about the problem of verifying claims of authorship. I am interested in another kind of genuineness and fraudulence, the kind at issue when we say of a person that he or she is false, not genuine, inauthentic, lacks integrity, and, especially when we say he or she is playing to the crowd, playing for effect, or is a poseur. These are not (...) quite moral distinctions (no one has a duty to be authentic), but they are robustly normative appraisals, applicable even when such falseness is not a case of straight hypocrisy but of lack of self-knowledge or of self-deceit. (A person can be quite sincere and not realize the extent of her submission to the other’s expectations and demands.) This sort of appraisal also has a long history in post-Rousseauist reflections on the dangers of uniquely modern forms of social dependence, and they are prominent worries in the modern novel. Abstract„Erleuchtung“ ist einer der prominentesten Begriffe, mit dem in der europäischen Kultur- und Religionsgeschichte Ideen der Vervollkommnung des Menschen zum Ausdruck gebracht worden sind. Anhand ausgewählter Beispiele umreißt das vorliegende Papier seine Entwicklung von einer Metapher in der griechischen Philosophie hin zu einem transkonfessionellen Sammelbegriff, der im Zuge der Pluralisierung von Religionen seit den 1960er Jahren eine Konjunktur in neuen, durch Markt und Medien allgemein zugänglichen Sinnstiftungsangeboten der „populären Religion“ (Knoblauch) erfahren hat. In einer Tour d’horizon, die bei Platon einsetzt (...) und über Clemens von Alexandrien und Ps.-Dionysios Areopagita ins 18. Jahrhundert sowie in die Gegenwart führt, wird gezeigt, wie sich Vorstellungen von Licht und Erleuchtung und die Rede hierüber zu einem religiösen Begriff verdichtet haben, der über lange Zeit einen Ort im Christentum hatte, bevor er, begünstigt durch die Aufklärung, zu einer populären Kategorie wurde, die vor allem mit asiatischen, oder zumindest asiatisch inspirierten, Praktiken zur Erlangung von Heil in Verbindung gebracht wird. Der Beitrag rückt bei der Darstellung dieser Entwicklung in der Moderne Auswirkungen der Aufklärung in den Blick sowie asiatisch-euroamerikanische Beziehungsdynamiken der europäischen Kolonialzeit, die zur Entdeckung des Buddhismus als Religion führten. Haben diese doch maßgeblich dazu beigetragen, dass Erleuchtung im gegenwärtigen populären Verständnis, wie es sich beispielhaft in der sog. Satsang-Bewegung und populär-religiöser Erzähl- und Ratgeberliteratur findet, nicht mehr, wie in der neoplatonischchristlichen Prägung des Begriffs, als Zwischenstufe auf einem Weg zur Vervollkommnung gilt, sondern als Ziel und bleibender Besitz, der mit Vollendung assoziiert wird. The development of nursing ethics as a field of inquiry has largely relied on theories of medical ethics that use autonomy, beneficence, and/or justice as foundational ethical principles. Such theories espouse a masculine approach to moral decision-making and ethical analysis. This paper challenges the presumption of medical ethics and its associated system of moral justification as an appropriate model for nursing ethics. It argues that the value foundations of nursing ethics are located within the existential phenomenon of human caring within (...) the nurse/patient relationship instead of in models of patient good or rights-based notions of autonomy as articulated in prominent theories of medical ethics. Models of caring are analyzed and a moral-point-of-view (MPV) theory with caring as a fundamental value is proposed for the development of a theory of nursing ethics. This type of theory is supportive to feminist medical ethics because it focuses on the subscription to, and not merely the acceptance of, a particular view of morality. (shrink)

The so-called quantum Zeno effect is essentially a consequence of the projection postulate for ideal measurements. To test the effect, Itanoet al. have performed an experiment on an ensemble of atoms where rapidly repeated level measurements were realized by means of short laser pulses. Using dynamical considerations, we give an explanation why the projection postulate can be applied in good approximation to such measurements. Corrections to ideal measurements are determined explicitly. This is used to discuss how far the experiment of (...) Itanoet al. can be considered as a test of the quantum Zeno effect. We also analyze a new possible experiment on a single atom where stochastic light and dark periods can be interpreted as manifestation of the quantum Zeno effect. We show that the measurement point of view gives a quick and intuitive understanding of experiments of the above type, although a finer analysis has to take the corrections into account. (shrink)

The speech of Gregory Thaumaturgus to the Christian scholar and theologian Origen is a historical document of unusual importance, both in terms of its content, depicting the master-student relationship of the time from the perspective of the student, and in terms of form, providing an actual implementation of the theory of rhetoric that was a cornerstone of higher education. Yet disagreement persists to this day in the scholarly literature over the generic classification of this first example of Christian epideictic oratory. (...) It is most frequently found categorized as a speech of thanksgiving, of praise, or of farewell. This paper discusses the grounds for the various definitions, examines the text itself in search of such grounds, and shows, in reference to two treatises on epideictic attributed to Menander Rhetor, why the most plausible classification is as a logos syntaktikos – a farewell speech, in which a traveler, by means of portraying and arousing emotion, laments the necessary parting and praises the person or people of whom leave is taken. Last year, the Joint Commission on Accreditation of Healthcare Organizations for the first time included provisions in its Hospital Accreditation Manual requiring institutions to have mechanisms in place to consider ethical issues arising in the care of patients and to educate care givers and patients on bioethical issues. This new requirement is notably vague. There is no indication of what type of mechanisms would be appropriate or how those involved in considering ethical issues should conduct themselves. This vagueness is by (...) no means accidental, but it reflects a recognition that clinical bioethics is still in its formative stages and that there are currently almost as many different mechanisms for dealing with bioethical issues in the healthcare setting as there are institutions that have such mechanisms. The Joint Commission's action, however, also implies that the time for experimentation will soon be over. (shrink)

Managers conduct open market repurchases for many different reasons, including to distribute excess cash. However, the most widely discussed explanation for OMRs is the “signaling theory:” that managers announce OMRs to signal that the stock is underpriced. The first purpose of this paper is to show that the signaling theory is theoretically problematic—in part because it assumes managers deliberately sacrifice their own wealth to increase that of shareholders—as well as inconsistent with much of the empirical evidence. The second purpose of (...) the paper is to put forward an alternative explanation for managers’ use of OMRs: the managerial-opportunism theory. This theory, which assumes that managers seek to maximize their own wealth, predicts that managers announce OMRs both when the stock is underpriced and when it is not. When the stock is underpriced, managers may announce and conduct an OMR to transfer value to themselves and other remaining shareholders. When managers wish to sell a large portion of their shares, they announce an OMR to boost the stock price before selling their shares. The paper shows that managerial opportunism is not only a more plausible motive for OMRs than is signaling, it is also more consistent with the empirical data. The strict distinction and separation of mind and body is a particularly modern Western point of view that is routinely also applied to other cultures. Arguing against this dichotomy, the following contribution builds upon research on "implicit knowledge" and "knowing how" that allow us to view body and mind in their interaction. The focus is on Simeon Stylites the Elder, the most prominent representative of the Syrian ascetic movement, who, in a spectacular way and after incessant exercise, was able to (...) act from a sphere of internalized body-knowledge. Selected texts on him dating from Late Antiquity will illustrate how the ascetic body was represented as a body of knowledge with which the idea of Christian perfection was to be fulfilled. (shrink)

Various explanations are offered to explain why employees increasingly work longer hours: the combined effects of technology and globalization; people are caught up in consumerism; and the "ideal worker norm," when professionals expect themselves and others to work longer hours. In this article, we propose that the processes of employer recruitment and selection, employee self-selection, cultural socialization, and reward systems help create extended work hours cultures (EWHC) that reinforce these trends. Moreover, we argue that EWHC organizations are becoming more prevalent (...) and that organizations in which long hours have become the norm may recruit for and reinforce workaholic tendencies. Next, we offer spiritual leadership as a paradigm for organizational transformation and recovery from the negative aspects of EWHC to enhance employee wellbeing and corporate social responsibility without sacrificing profitability, revenue growth, and other indicators of financial performance. Finally, we will offer suggestions for future theory, research, and practice. (shrink)

Contract as Promise is a study of the philosophical foundations of contract law in which Professor Fried effectively answers some of the most common assumptions about contract law and strongly proposes a moral basis for it while defending the classical theory of contract. This book provides two purposes regarding the complex legal institution of the contract. The first is the theoretical purpose to demonstrate how contract law can be traced to and is determined by a small number of basic moral (...) principles. At the theory level the author shows that contract law does have an underlying, and unifying structure. The second is a pedagogic purpose to provide for students the underlying structure of contract law. At this level of doctrinal exposition the author shows that structure can be referred to moral principles. Together the two purposes support each other in an effective and comprehensive study of contract law. This second edition retains the original text, and includes a new Preface. It also includes a substantial new essay entitled Contract as Promise in the Light of Subsequent Scholarship--Especially Law and Economics which serves as a retrospective of the work accomplished in the last thirty years, while responding to present and future work in the field. This paper extends Being-centered and spiritual leadership theory using non-self from the Buddhist philosophy to further our understanding of how inner life functions as the source of spiritual leadership. While spiritual leadership theory has received widespread acceptance and considerable empirical support, its developmental process and potential for being used to pursue self-centered ends remain underdeveloped. Drawing on non-self from the Buddhist emptiness theory, we identify different egoistic forms of attachment at each level of being that can lead to forms of (...) suffering in spiritual leadership. Then we show how leaders operating at lower levels of being can fall into the trap of practicing a form of pseudo-spiritual leadership that is overly focused on self-centered or instrumental purposes and economic rationality. We then introduce mechanisms to move beyond pseudo-spiritual leadership practices and discuss implications for future theory, research, and practice. (shrink)
