This brief note aims at contributing to the study of the reception of parabiblical narratives in hadith literature and Islamic historiography. Taking the Testament of Abraham as a case study, it sets out to analyse a particular literary motif shared by this text and an early version of the miʿrāǧ (Ascension) of the Prophet Muhammad. The comparative analysis demonstrates that the Testament of Abraham could have provided a number of elements for the redaction of at least one particular section of (...) the miʿrāǧ. This hypothesis finds support in other cases of textual correspondence between several sections of the Testament of Abraham and other Islamic works such as the Tafsīr of Muqātil ibn Sulaymān (d. 150/767), the unedited Kitāb Mubtadaʾ al-dunyā wa-qiṣaṣ al-anbiyāʾ of Abū Ḥuḏayfa al-Buḫārī Isḥāq ibn Bišr (d. 206/821) and Ibn ʿAsākir’s Taʾrīḫ madīnat Dimašq (d. 571/1176). The examined material thus throws additional light on the continuity between late antique apocrypha and nascent Arabic literature. (shrink)

Hamblin distinguished between formal and descriptive dialectic. Formal normative models of deliberation dialogue have been strongly emphasized as argumentation frameworks in computer science. But making such models of deliberation applicable to real natural language examples has reached a point where the descriptive aspect needs more interdisciplinary work. The new formal and computational models of deliberation dialogue that are being built in computer science seem to be closely related to some already existing and very well established computing technologies such as problem (...) solving and decision making, but whether or how dialectical argumentation can be helpful to support these systems remains an open question. The problem of necessity remains one of the central issues in modern philosophy. The authors of this volume, originally published in 1985, developed a new approach to the problem, which focusses on the logical grammar of necessary propositions. This volume gathers their seminal essays on the problem of necessity, together with new material at the original time publication.

This paper explores the alleged role of a conception of human nature for Kant’s justification of the duty to leave the state of nature and the related right to coerce others to enter the civil condition in the Doctrine of Right (1797). I criticise the interpretation put forward by Byrd and Hruschka, according to which Kant’s postulate of public right is a preventive measure based on a “presumption of badness” of human beings. Although this reading seems to be supported by (...) § 42 of the Doctrine of Right, I shall argue that the paragraph neither offers a justification of why we have a duty to leave the state of nature, nor explains why individuals are allowed to coerce others to do so. I offer an alternative interpretation of § 42 by focusing on the difference between formal and material violations of right and argue that the rationale behind the postulate of public right is the idea that remaining in the state of nature is a formal violation of the concept of right. It is therefore not prudential reason that authorizes us to coerce others to enter the lawful condition. (shrink)

The UK Government's Higher Education (Freedom of Speech) Bill is currently progressing through Parliament. The bill is designed to strengthen free speech and academic freedom in higher education, in response to what former Education Secretary Gavin Williamson describes as ‘the rise of intolerance and cancel culture upon our campuses’. But is there really a crisis of academic freedom in British universities?To see that there is, say Judith Suissa and Alice Sullivan, we need only look at the contemporary reality of (...) suppression of debate on sex and gender. The evidence they catalogue of suppression of research, of blacklisting, harassment and smear campaigns, of no-platforming, disinvitations and shutting down of events, is incontrovertible. The recent experience of scholars and students wishing to discuss the material reality and political salience of sex makes complacency about academic freedom a luxury we cannot afford.Suissa and Sullivan set out a powerful argument for the role of academic freedom in pursuing truth within the academy and developing democracy beyond it. They effectively counter attempts to narrow the scope of academic freedom so as to render it compatible with no-platforming. And they lay out a series of practical steps administrators can take to ensure that universities are places where an expansive and pluralistic intellectual climate prevails.This is a timely and compelling intervention in a vexed but urgent public debate. For their clear-sighted diagnosis of where and how academic freedom has been eroded in our universities, and for their judicious account of what must be done to rebuild it, Suissa and Sullivan deserve a wide and attentive hearing. Research on evaluative conditioning (EC) shows that attitudes can emerge from co-occurrences of stimuli, and accumulating evidence suggests that EC usually depends on memory for these stimulus contingencies. Therefore, processes known to aid memory retention may be relevant for the development of stable attitudes. One such process may be memory consolidation, assumed to be promoted by waking rest and sleep. In two pre-registered experiments, we investigated whether waking rest (vs. cognitive activity, Experiment 1) and sleep (vs. wakefulness, Experiment 2) in (...) between conditioning and measurement of EC, consolidate contingency memory and EC. Contrary to our predictions, waking rest (vs. cognitive activity) promoted neither contingency memory nor EC effects. Sleep (vs. wakefulness) decreased forgetting of contingency memory but crucially, it did not attenuate the impact of counterconditioning on contingency memory. Sleep also did not influence EC effects, nor the reduction of EC by counterconditioning. EC effects in both experiments were predicted by contingency memory. Yet, unexpectedly, EC effects occurred in the absence of contingency memory after waking rest, but neither after sleep nor in the active control conditions. Our findings emphasise a role of contingency memory in EC, but it remains unclear whether this role changes during waking rest. (shrink)

Many translations have been made from the original Sanskrit of the Yoga Sutras of Patanjali. They have become well loved, well used, and well applied by many in all parts of the world and of all religious beliefs. The Sutras have a power and a timelessness about them which demonstrate the accuracy with which they pinpoint the basic truths of human evolution from subservience to personality clamours to the serene freedom of the soul. This is also brought out clearly in the teaching of the Lord Buddha, the treading of the Noble Eight-Fold path providing the only way out of the maze: Right Values; Right Speech; Right Mode of Living; Right Thinking; Right Expression; Right Conduct; Right Effort; Right Rapture or True Happiness. These are attributes of the soul. Patanjali explores exhaustively the means, the techniques and the mental posture which create the connecting thread between the form-centred personality and these stages towards spiritual achievement and soul fusion. Many different training techniques have been available over the centuries, depending on the condition of human consciousness and the phase of spiritual growth to be accomplished. Each Yoga has had its place, fulfilled its function, and become an absorbed part of human experience. In this book the factor of mind in meeting present-day needs is again given prominence as the agent of the soul, and the key to personality release. These Yoga Sutras of Patanjali are based on Raja Yoga, the kingly science of the soul: Through the science of Raja Yoga the mind will be known as the instrument of the soul and the means whereby the brain of the aspirant becomes illuminated and knowledge gained of those matters which concern the realm of the soul. DNA evidence has rapidly become a significant and routine feature of modern criminal prosecutions. The first introduction of DNA evidence in a U.S. Court occurred in 1987. By 1994, 42 percent of local prosecutors reported that they had used DNA evidence in a felony case at least once. By 2001 that number had increased to 68 percent. Moreover, from a technical point of view, the potential benefits of DNA testing are substantial. Early hurdles to admissibility during trial have been overcome (...) by the adoption of rigorous standards for DNA analysis. Rapid development of identification technology, fueled in significant part by the Human Genome Project, and the resultant development and expansion of national forensic DNA databases, has increased the potential of DNA to play a major role in crime solving. Indeed, over three million offender profiles, collected by state and federal authorities, now reside in the National DNA Index System. This number is likely to increase as more states and the federal government are expanding compelled DNA collections to individuals arrested for certain crimes. (shrink)

In the modular design of generative theory the syntax-semantics interface has accounted all along for meanings at the level of Logical Form. The syntax-pragmatics interface, on the other hand, is the result of what one may call the 'pragmatic turn' in the linguistic theory, where content is partitioned into given and new information. In other words, the structural division of the clause has been subjected to criteria of information, or discourse structure. Both interfaces require a structurally descriptive inventory whose specific (...) shapes can be motivated on theory-internal grounds only. The present collection of original articles develops the concept of these interfaces further. Philosophers of science have typically focused on “beauty”, “simplicity”, and “elegance” in their accounts of aesthetic values in science. But this is too narrow: other properties ought to be considered when thinking about aesthetics in science. In this chapter, Alice Murphy expands the discussion by asking: What makes a scientific experiment “profound”? To address this question, she draws on two accounts of profundity as developed in the philosophy of art to consider them in the scientific context. On the first (...) view, profound experiments are those which, due to their design, bring about understanding of some profound subject matter. On the second view, profound experiments are those which resist a straightforward interpretation, and can even prompt the development of new theories and concepts. To flesh out these two aspects of profundity, Murphy brings together theories from philosophy of art and topics in the epistemology of experiment. The chapter ends by demonstrating how broadening our class of aesthetic values to include profundity puts pressure on the scope of a central view brings together the epistemic and aesthetic by associating aesthetic experiences with “feelings of fluency”. We place agency front-and-centre in the aesthetics of science via an analysis of experimental design and performance. This first involves developing an account of scientific agency relevant to experiment. We do this via an analogy between experiments and games (as understood by Suits and Nguyen): both involve artificial practical environments designed to enable participants to exercise particular forms of agency. Second, we consider how this account of agency might underwrite an aesthetics of experiment. Experiments are well-designed not only when they (...) generate clear, elegant results, but also when they actively confront the experimenter with experimental phenomena, afford the exercise of agency throughout experimental runs and in iterative design and tweaking, and underlie stable, intersubjective experiences across agents. We apply the account to Newton’s optical work, and contrast this with contemporary experimental practices, where significantly more ‘experimental distance’ holds between the experimenter and the result. Taking the agency of experimental practice seriously enables a richer account of the role of aesthetic values, sensibilities, and judgments in science. (shrink)

In general outline, Astell's A Serious Proposal to the Ladies is well understood. In Part I, Astell argues that women are educable, and she proposes the construction of a women's academy. In Part II, she proposes a method for the improvement of the mind. In this article, I reconstruct and contextualize Astell's arguments and proposals within her theory of mind and her account of the skeptical predicament that she sees as being endemic among women. I argue that Astell's two proposals (...) are best understood as strategies that, when employed, will allow women to critique prejudice and custom. (shrink)

Background In the course of the COVID-19 pandemic, the biomedical research community’s attempt to focus the attention on fighting COVID-19, led to several challenges within the field of research ethics. However, we know little about the practical relevance of these challenges for Research Ethics Committees. Methods We conducted a qualitative survey across all 52 German RECs on the challenges and potential solutions with reviewing proposals for COVID-19 studies. We de-identified the answers and applied thematic text analysis for the extraction and (...) synthesis of challenges and potential solutions that we grouped under established principles for clinical research ethics. Results We received an overall response rate of 42%. The 22 responding RECs reported that they had assessed a total of 441 study proposals on COVID-19 until 21 April 2020. For the review of these proposals the RECs indicated a broad spectrum of challenges regarding social value, scientific validity, favourable risk–benefit ratio, informed consent, independent review, fair selection of trial participants, and respect for study participants. Mentioned solutions ranged from improved local/national coordination, over guidance on modified consent procedures, to priority setting across clinical studies. Conclusions RECs are facing a broad spectrum of pressing challenges in reviewing COVID-19 studies. Some challenges for consent procedures are well known from research in intensive care settings but are further aggravated by infection measures. Other challenges such as reviewing several clinical studies at the same time that potentially compete for the recruitment of in-house COVID-19 patients are unique to the current situation. For some of the challenges the proposed solutions in our survey could relatively easy be translated into practice. Others need further conceptual and empirical research. Our findings together with the increasing body of literature on COVID-19 research ethics, and further stakeholder engagement should inform the development of hands-on guidance for researchers, funders, RECs, and further oversight bodies.
