In lieu of an abstract, here is a brief excerpt of the content:Toward a Political Economy of the Libro De AlexandreSimone Pinet (bio)The carefully composed and craftily pronounced stanzas of the thirteenth-century Libro de Alexandre, if mostly a (free) translation of Gautier de Châtillon’s Alexandreis, provide readers with glimpses of northern Iberia in descriptions and comparisons, but especially through curious formulations and eloquent rewritings.1 These incite the reader to reflect upon the emergence of the vernacular regime of literary composition by (...) clerics that developed in the thirteenth century, a corpus known to us as the mester de clerecía. In this corpus, the use of the vernacular, in particular, brings with it an unproblematized sense of transparency of the context in which the works of mester de clerecía were produced, a genre of which the Libro de Alexandre is a key poetic point of origin. Next to an emphasis on a Latinate syntax and recitation techniques that underline the corpus’s clerical production, the irruption of quotidian phrases, vocabulary, figures of medievalization, and especially of Iberization, make these texts a privileged site to study the articulation of the varied phenomena that from economics to the grammatical, from Aristotle to technology, come to revolutionize medieval culture from the twelfth century onward. Of the many peculiar uses of the vernacular in the Libro de Alexandre, references that connote a sense of worthlessness through the repeated structure “not worth an X, ” especially those that express the comparison with minted coinage of little value: dinero, meaja, pepión, or sueldo, as in “not worth a penny,”2 will serve here as a point of entry. These hyperbolic [End Page 44] expressions, common to Romance languages, underline not only the moral and economic ambivalence of terms such as preçio, valor, honor, pagar(se), dar crédito, and so forth, but also the incorporation of a monetary economy within this ambivalence. These types of expressions, moreover, produce a linguistic marker for such ambiguity, as Louis F. Sas noted when he underlined the “affect” which marks, at the level of speech, the reference to abstract terms such as infinity, nothing, and zero in these types of constructions [469, 471].3Sas notes that the vast majority of the occurrences of these phrases in the Libro de Alexandre happen “in combination with the word valer, with its synonyms, or with dar por, that is, in contexts of exchange” [475]. Many years before Sas exhaustively documented these expressions, Alois Richard Nykl had interpreted their presence as related to barter and a supposed clerical contact with local markets, which to some extent could explain their frequent use in the poem, and he especially mentioned the use of fruits and vegetables in these expressions. Nykl also suggested these were “rustic” similes, favored by men of the clergy such as Berceo, Juan Ruiz, and the authors of the Alexandre and the Fernán González, showing, in his opinion, these men’s contact with a certain world in which fruits and vegetables could serve as payment for the church or diezmo, bringing in through this curious interpretation not only a historical economic context but also its [End Page 45] qualification as something “rustic” or at least foreign to the cleric [311].4In 1929, a couple of years after Nykl’s article appeared, George Irving Dale would correct his affirmations, noting that the expressions called “rustic” by Nykl belonged to a well-studied figure called figurative negation. Dale remarked that figurative negation appeared already in the Poema de mio Cid, and he directed the reader to the bibliography offered by Menéndez Pidal in his edition of the Poema under the title of “Refuerzo de la Negación” [Cantar de Mio Cid 1: 376 and glossary]. In his article, Dale wrote in passing that the type of adjectives used with these expressions “increases the insignificance or lack of value” [324]. Dans toutes les langues occidentales, le mot " temps " recouvre deux notions différentes : le temps, collectif, de l'horloge, et celui, individuel, de l'âme. Husserl, Bergson et Heidegger ont cerné le temps individuel mais ne sont pas allés au bout des conséquences de leur introspection. Einstein, en relativisant le temps de l'horloge, n'en a pas développé les implications philosophiques. Cette étude propose d'explorer cette nouvelle approche dans laquelle le temps n'est plus " a priori ", mais est généré par (...) le " phénomène ", au sens large du terme. On bascule alors dans un monde nouveau où l'inexistence du temps " habituel " entraîne des modifications considérables dans la philosophie, la théologie et... la vie quotidienne. Aristotle’s Naïve Somatism is a re-interpretation of Aristotle’s cognitive psychology in light of certain presuppositions he holds about the living animal body. The living animal body is presumed to be sensitive, and Aristotle grounds his account of cognition in a rudimentary proprioceptive awareness one has of her body. With that presupposed metaphysics under our belts, we are in a position to see that Aristotle in de Anima (cognition chapters at least) has a di erent explanatory aim in view than that (...) which the literature generally imputes to him. He is not explicating what we would call the “mental”—the private, inner realm which some take to be of a di erent kind than the physical—as most take him to be. His explanandum is content acquisition; the explanans is showing how the body becomes like various aspects of objects. Although he famously describes the mind (nous) as unmixed with the body, he is guided by functional constrains—nous cannot be limited or qualified if it is to potentially think all things. Thus, his inquiry into cognition is philosophically limited from a contemporary perspective. Aristotle is not doing philosophy of mind, for he doesn’t seem to find the “mental” philosophically perplexing. (shrink)

My article in this issue of PPP is based on a lengthy book, La Société du malaise, in which I examine the shift from Oedipal neurosis to narcissistic pathologies in France and in the United States, viewing this shift in connection with changes in social ideals regarding autonomy that I summarize as autonomy–aspiration and autonomy–condition. Using the notion of social pathology, I consider sociological/anthropological dimensions of so-called mental health problems by viewing them as individualistic ways of dealing with adversity or (...) misfortune in a form of life permeated with the autonomy–ideal. The very diversity of cultures impels the economist to respect a principle of modesty when it comes to specifying the degree of universality to which the science of economics can lay claim. In considering this issue, this paper: a) criticizes the ambition of certain forms of economic thought to arrive at truths which are universal, and b) explores the modes by which contemporary economic science participates in a renewed pursuit of a universalist doctrine. It concludes that the logic of economic (...) rationality implies a representation of the world that is incompatible with the diversity of cultures. At the same time, such diversity should not be raised to the status of absolutes. Combining difference and unity is a major challenge for current economics. (shrink)

It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. In this paper, I offer an analytical and normative framework to re-visit the question of whether state parties should derogate from the European Convention on Human Rights (ECHR) in order to combat the COVID-19 pandemic via harsh ‘lockdown’ measures. It is three-pronged. First, I show that the predominant debate on the (non-)derogation question is informed by a textual approach to adjudication, which severely limits the analytical and evaluative horizon for addressing the issue. Most importantly, it cannot address one salient fact (...) about the effects of lockdown measures, namely their highly disproportionate effects on vulnerable groups and minorities. Second, I argue that proportionality assessment should be the basis for determining whether state parties ought to derogate or not. This is because proportionality’s very purpose is in part to track the effects of state interferences on minorities and vulnerable groups by measuring the disproportionate burden imposed on them. It is also because proportionality assessment has very different requirements between limitation clauses built into the relevant Convention articles (e.g. Article 5, Articles 8–11) and the derogation clause (Article 15) under the ECHR. Surprisingly, while the emerging literature almost always mentions proportionality as an important component of the analysis, it does not investigate the extent to which each regime (derogation or limitation) better performs it, and why. Third, I draw from the philosophical literature on the ‘right to justification’ to clarify the egalitarian and justificatory function of proportionality. Unlike derogation, limitation clauses have a much higher and systematic requirement of justification, which makes the case for non-derogation clearer and stronger. (shrink)

Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. C'est qu'il constitue, a sa modeste echelle, un document " exceptionnel et normal ", selon le fameux oxymore d'Edoardo Grendi, rendu celebre par Carlo Ginzburg : enracine en Toscane, entre Florence et Sienne, il offre environ 150 cas de la vie (...) quotidienne des citoyens et des marchands, poses dans un cadre plus ethique et social que strictement religieux. Sur le commerce, il apporte parfois des precisions inconnues par ailleurs, par exemple sur la culture et la vente du safran de San Gimignano, ou sur le negoce des chevaux en Toscane. Il offre un document de premier ordre sur la soccida, contrat d'elevage, espece du metayage, qui nait alors en Toscane avant de connaitre un long et capital developpement en Europe. Le Livre des cas est suivi d'un contrat de donation et d'une consultation, sans doute rediges par Chiaro, de Decisions curiales, auxquelles il a participe et de deux textes de son confrere et ami franciscain Manfredo de Tortona, un Traite sur les restitutions et un autre Sur la diversite des contrats, ainsi que par un extrait du franciscain Guiral Ot, Sur la necessite des marchands. Le décret de la Confédération des Insulaires pour le banquier Timôn de Syracuse (IG XII 5, 817) fait mention d’une opération financière dont il est montré ici qu’elle ne peut qu’avoir été une opération de change. Timôn avait changé aux Insulaires une importante somme d’argent sans leur faire payer de kollybos. Sur la base de divers parallèles (inscriptions d’Olbia, Delphes, Pergame et Mylasa), on démontre ensuite qu’à Délos le change était libre et ne faisait pas l’objet d’un monopole de la (...) cité, et que, de manière générale, le kollybos correspondait non pas à une taxe (même s’il devenait une taxe lorsqu’un État établissait un monopole de change) ou à une commission de change stricto sensu, mais à un agio de change, établi sur la base du cours du change entre espèces différentes. Michel Foucault inaugure avec ses "reportages d'idées" sur le soulèvement iranien contre le Shah (1978-1979) une approche du présent et un mode d'écriture situés au point de rencontre de la philosophie et du journalisme. Il s'y interroge sur ce qui, dans cet événement, fait époque, en tant qu'il signale la fin de l'ère des révolutions et se trouve placé sous le signe énigmatique du soulèvement d'un peuple tout entier contre un pouvoir despotique. Au coeur de sa réflexion s'identifie une réflexion (...) sur la spiritualité politique qui anime les masses iraniennes - ce mélange inextricable d'inspiration religieuse et d'aspiration à la dignité, l'égalité, la liberté. Ce qui le fascine dans ces événements, c'est la puissance mobilisatrice de la religion (l'Islam dans sa version chiite, ici) non pas au service de l'obscurantisme et de l'asservissement, mais de la lutte pour l'émancipation - comment, avant l'établissement de la théocratie de Khomeiny, la foi religieuse comme le terreau commun de la "volonté de tous" d'un peuple en lutte pour son émancipation. Ces reportages, dans la mesure même où il ont suscité à l'époque de leur publication des discussions acharnées et sont encore aujourd'hui susceptibles d'être discutés, dessinent une ligne de force qui conduit à toutes les discussions en litige dans le présent, à propos des relations entre politique et religion, du rôle de l'Islam dans les sociétés modernes, des luttes des peuples contre la violence du pouvoir. En 1950, Paul Ricœur publia une imposante Philosophie de la volonté, vite brocardée par la vague structuraliste et les critiques de toute « philosophie de la conscience ». On y trouve notamment une analyse du phénomène de l’hésitation qui contient bien des éléments encore pertinents. Phénomène bien connu, l’hésitation n’a pas été vraiment thématisée en tant que telle, même si, comme le montre Ricœur, l’histoire de la philosophie est susceptible d’aider à le faire. Mais le doute cartésien, par exemple, n’est (...) guère hésitant. Ce chapitre fourmille d’analyses denses mais claires, d’allusions qu’il faut expliciter, de métaphores « vives » très riches, qui permettent de concevoir un sujet se cherchant dans l’hésitation avant de se choisir dans la décision. Il y a là un concept indispensable à toute théorie de l’action.Philosophie de la volonté, a major work published by Ricœur in 1950, was quickly derided by members of the structuralist trend and by those critical of every single « philosophy of consciousness ». The book includes notably an analysis of the phenomenon of hesitation, many elements of which are still relevant. Although a well known phenomenon, hesitation has never been fully analyzed in itself, even though the history of philosophy, as Ricœur shows, might be helpful in such an endeavor. Cartesian doubt, for instance, shows hardly any hesitation. This chapter is replete with dense yet clear discussions, with allusions that require elucidation, and with a wealth of vivid metaphors which help us to envisage a subject in search of himself through hesitation, before choosing himself through decision.
