El objetivo del trabajo consiste en revisar dos versiones del argumento que concibe a la averiguación de la verdad como un factor que confi ere legitimidad al ejercicio de la función jurisdiccional penal: la de Ferrajoli y la de Laudan. Se sostiene que su estudio minucioso puede proporcionar bases racionales para decidir sobre la conveniencia de suscribir un garantismo extremo o uno de carácter más mesurado. El artículo revisa las aportaciones más trascendentes que Jordi Ferrer ha hecho a la tradición racionalista de la prueba jurídica y evalúa críticamente el limitado papel que, desde su óptica, le corresponde desempeñar a la epistemología en la discusión general sobre los estándares de prueba apropiados para las distintas ramas del derecho. Más específicamente, se analiza la irrelevancia que Ferrer parece atribuir a dicha disciplina –o el silencio que debe guardar–, respecto del establecimiento del estándar de prueba deseable en materia (...) penal. Se concede que, en efecto, le corresponde al pueblo tomar la decisión de qué estándar implementar. No obstante, se sostiene, ello no impide que la epistemología incida en el proceso de formación de dicha decisión mediante la realización de observaciones, el ofrecimiento de argumentos y la propuesta de metodologías adecuadas, con miras a que aquella se tome en un contexto mejor informado y sea lo más racional posible. La sociedad del conocimiento y la introducción en los procesos de enseñanza-aprendizaje de las tecnologías de la información y la comunicación, están exigiendo de quienes nos dedicamos a la educación en el ámbito universitario, la utilización de nuevas estrategias didácticas y la reinvención de algunas antiguas o no tan nuevas. Se trata de dar respuesta a la demanda social de “aprender de otra manera” para mejorar la inserción de los nuevos egresados en su ámbito profesional. Esta nueva forma de aprender (...) debe tener en consideración las exigencias de los nuevos contextos de enseñanza-aprendizaje, donde el protagonismo de los estudiantes es un elemento esencial y la relación de lo aprendido con sus posibilidades de aplicación en el contexto profesional es el otro. Casualmente el modelo de formación basado en competencias desde el enfoque socioformativo coincide en ambos protagonismos y el portafolio como estrategia didáctica que puede utilizarse en este modelo puede ayudar a dotar de protagonismo al que aprende haciéndole tomar conciencia de que el aprendizaje no se produce de manera automática sino a través de una serie de pasos y etapas que a la vez que se van consiguiendo nos permiten reflexionar el proceso. Una vez llevado a cabo este proceso de reflexión general, puede aplicarse en el ámbito médico para iniciar al estudiante a tomar conciencia de su semejanza con el diagnóstico clínico. El artículo aborda la pandemia del covid-19 como elemento contingente y su efecto de develamiento respecto de algunas manifestaciones contemporáneas de la ideología neoliberal en Latinoamérica. De esta forma, en base a conceptos filosóficos y psicoanalíticos de orientación lacaniana planteados fundamentalmente por Slavoj Žižek, se examinan los usos críticos de la noción de ideología en sus diversas manifestaciones: miedo al otro, imposición de la lógica del empresario de sí, destrucción de lazos sociales, extractivismo de recursos naturales y fetichización de los (...) discursos de unidad frente a la pandemia. La hipótesis radica en que la pandemia presenta una oportunidad para repensar la subjetividad contemporánea, mediante la confrontación con el Real que bordea a la simbolización y, en definitiva, a la captura ideológica, a fin de poner en cuestión la afirmación de que no hay alternativa. ABSTRACTPrior research has found a relationship between perceived facial attractiveness and perceived personal trustworthiness. We examined the time course of attractiveness relative to trustworthiness evaluation of emotional and neutral faces. This served to explore whether attractiveness might be used as an easily accessible cue and a quick shortcut for judging trustworthiness. Detection thresholds and judgment latencies as a function of expressive intensity were measured. Significant correlations between attractiveness and trustworthiness consistently held for six emotional expressions at four intensities, and neutral (...) faces. Importantly, perceived attractiveness preceded perceived trustworthiness, with lower detection thresholds and shorter decision latencies. This reveals a time course advantage for attractiveness, and suggests that earlier attractiveness impressions could bias trustworthiness inferences. I provide a variation on ideas presented by Walton and Currie, elaborating the view that fictive utterances are characterized by a specific form of illocutionary force in the family of directives – a proposal or invitation to imagine. I make some points on the relation between the proposal and the current debates on intentionalist and conventionalist views, and I discuss interesting recent objections made by Stacie Friend to the related, but crucially different, Gricean view of such force advanced by Currie (...) and others. María Lugones was a feminist philosopher whose work spanned four decades, two continents, and multiple languages. Over the course of her career, her writing made major contributions to feminist ethics, the philosophy of race, lesbian epistemology, and decolonial thought. She passed away on July 14, 2020, after many years of poor health, leaving behind an influential legacy and a substantial body of unpublished work.

The origin of the eukaryotic cell nucleus and the selective forces that drove its evolution remain unknown and are a matter of controversy. Autogenous models state that both the nucleus and endoplasmic reticulum (ER) derived from the invagination of the plasma membrane, but most of them do not advance clear selective forces for this process. Alternative models proposing an endosymbiotic origin of the nucleus fail to provide a pathway fully compatible with our knowledge of cell biology. We propose here an (...) evolutionary scenario that reconciles both an ancestral endosymbiotic origin of the eukaryotic nucleus (endosymbiosis of a methanogenic archaeon within a fermentative myxobacterium) with an autogenous generation of the contemporary nuclear membrane and ER from the bacterial membrane. We specifically state two selective forces that operated sequentially during its evolution: (1) metabolic compartmentation to avoid deleterious co‐existence of anabolic (autotrophic synthesis by the methanogen) and catabolic (fermentation by the myxobacterium) pathways in the cell, and (2) avoidance of aberrant protein synthesis due to intron spreading in the ancient archaeal genome following mitochondrial acquisition and loss of methanogenesis. This paper will concentrate mainly on the analysis of some features present in Putnam's internal realism and in his "natural realism" that he shares with the pragmatist thinkers Peirce and James. Following the middle way which Putnam tries to reach between "reactionary metaphysics" and "irresponsible relativism," the first part of the paper deals with what is the positive insight of traditional realism, i. e., the reality of external things as independent from our mind, as it is emphasized by Putnam. It (...) also analyzes how this idea of the mind-independent character of reality has been very well worked out in Peirce's thought through the category of Secondness. The second part focuses on the right insight of relativism that Putnam wants to maintain: How our notion of reality changes and evolves together with our language, our life and our handling the world. From the thought of mid-twentieth century Mexican philosopher Jorge Portilla, I develop an account of what I call ‘ethics of ethnic identity,’ which include: a) a set of norms of agency grounded in ethnic identity, or ethnic norms of agency—reasons for action and obligations that spring from a given ethnic identity, and b) a type of normativity governing these ethnic norms of agency. I argue that one of the theoretical advantages of this account is that it fares well with respect (...) to human flourishing, moral obligations, and freedom and autonomy. I also develop an account of ethics of ethnic identity from Christine Korsgaard’s account of the sources of normativity and use it as a sophisticated foil against which my elaborations of Portilla’s views can be fruitfully contrasted. The idea that natural selection acts on many levels—and not only at the level of organisms or individual genes—is increasingly accepted among biologists. However, it is not easy to reconcile this idea with the strictly “individualistic” conception of the evolutionary process that has always characterized Darwinian thought. Moreover, the individuality of some forms of life is a vague concept and therefore controversial. This is the case of Candidatus Magnetoglobus multicellularis, whose discovery immediately inspired the following question: Does the concept of (...) individuality have degrees? Alternatively, how far is this structure of prokaryotic cells from deserving to be called an organism? In this article, we propose a new conceptual scheme based on an idea of individuality that is not limited to organisms and that makes sense in terms of Darwinian evolution. In this conceptual scheme, selection at levels above that of the individual organism is interpreted as the evolutionary emergence of higher-level individuality. This proposal may serve as a basis on which to construct a promising hierarchical evolutionary theory. (shrink)

Este artigo apresenta uma revisão de literatura, que possui como objetivo investigar como o fenômeno corpolatria está inserido em publicações científicas. Teve como lócus três portais de buscas (Scielo, Portal de Periódicos da CAPES e Google Acadêmico) e recorte temporal de 2012 a 2021. Os dados foram analisados qualitativamente, no qual, averiguou-se a conceituação de corpolatria destacada na literatura e o local de origem dos estudos. A partir dos resultados, inferiu-se que a temática ainda é incipiente entre os pesquisadores brasileiros, (...) embora haja boa distribuição geográfica dos estudos. Percebeu-se que corpolatria é uma patologia da modernidade, caracterizada pelo culto exagerado do corpo, referendada como uma espécie de ditadura corporal, estabelecida pelo discurso do corpo perfeito. Disseminada pela mídia, pelas redes sociais e pela sociedade, caracteriza-se como uma patologia social à medida que causa mal-estar social, pois pode gerar consequências físicas, transtornos psicológicos e insegurança. Este artículo pretende establecer los nexos y asociaciones de los conceptos fundamentales que sustentan la obra filosófica, pero sobre todo la critica literaria de Rafael Gutiérrez Girardot. Hegel y Schlegel aparecen como pilares que fundamentan sus interpretaciones criticas y sobre los cuales se abre el horizonte de América Latina; a través de autores como Jorge Luis Borges, Alfonso Reyes y César Vallejo.

Este artículo muestra los paralelismos y las divergencias del giro ontológico y de la antropología fenomenológica. Ambas corrientes, en fidelidad al dato etnográfico, comparten el rechazo al régimen de representación y ambas corrientes cuestionan los compromisos epistémicos del investigador. Sin embargo, el giro ontológico presenta una orientación conceptual, que deriva a menudo en tipología, mientras que la antropología fenomenológica atiende a las relaciones perceptivas del mundo de la vida desde una apertura hermenéutica.

The concept of well-being of rural families is part of a theory under construction in which new theoretical elements are constantly being incorporated. This research aims to determine the influence of farmers’ knowledge on the well‑being of cocoa growing families in the departments of Santander, Huila, Meta and Caquetá, Colombia. Four categories of farmers were identified with different levels of knowledge in the management of cocoa cultivation obtained through a cluster analysis. The well-being of cocoa farmers, understood as the balance (...) in the capital endowment of rural households, was obtained through the application of a semi-structured interview with 49 variables of human, cultural, social, political, natural, built, and financial capitals. The results show that cocoa knowledge is heterogeneous in the study area, with a slight improvement towards harvesting, post-harvest and transformation links. There is a positive relationship between cocoa knowledge and the well-being of cocoa farming families. Thus, producers with greater integral knowledge, with emphasis on post-harvest and bean transformation links, showed greater well-being. The Random Forest analysis identified that human capital (political, social, human, and cultural) made the greatest contribution to well-being. The findings show that cocoa knowledge contributes to the well-being of rural households to the extent that it favors vertical relationships (linkages with local governments) and horizontal relationships of producers (participation of association managers, sharing knowledge with friends, neighbors and partners, and cocoa training). El presente artículo sostiene la siguiente hipótesis: la inmensa mayoría de las conceptualizaciones teóricas con las que, a inicios del siglo XXI, se intenta dar cuenta de la subjetividad contemporánea son explícita o subrepticiamente reelaboraciones del concepto de superhombre. De ciborgs a posthumanos, pasando por una amplia y variada gama de sujetos contemporáneos, se puede apreciar que el concepto de Übermensch aporta las claves fundamentales con las cuales deconstruir el concepto de identidad fija que pone en juego el universalismo abstracto. Siguiendo la teorización de Nietzsche, estas nuevas posiciones teóricas proponen una forma particular y concreta de vida como alternativa a las dicotomías y trasmundos con que la metafísica construyó a los sujetos del pasado. Sin embargo, estas propuestas han pasado por alto algo fundamental. Para demostrarlo, proponemos una relectura de Nietzsche y de dichos conceptos con el objetivo de plantear una nueva manera de pensar sobre la vida. (shrink)

Unethical pro-organisational behaviour is an ongoing concern, prompting the need for more nuanced understanding of the workplace environment most likely to inhibit it. This study considers the role of risk climate, sometimes referred to as risk culture, as well as ethical climate, for reducing UPB. The study investigates whether four risk climate factors can, by focusing on the long-term consequences of UPB to the organisation, and providing guidance on behavioural norms, reduce UPB misconduct. Surveying employees in three financial institutions we (...) found that only one of the risk climate factors, avoidance, is consistently associated with UPB. On the other hand, a self-interested, ethical climate significantly increases UPB in all samples. In multi-climate analysis, we found that risk climate factors interacted with ethical climate to predict UPB. That is, when employees perceive that the workplace ethos is not self-interested, three factors of risk climate—avoidance, proactive and manager—significantly predict UPB. UPB is least likely when self-interest is low, avoidance risk climate is low, proactive risk climate is high and manager risk climate is high. Implications for leaders are discussed. (shrink)

La Psicología de la Sustentabilidad (PS) estudia las problemáticas hídricas considerando la relación entre disponibilidad per cápita y consumo de agua. A partir de conceptos tales como; densidad poblacional, infraestructura hídrica y provisión de agua plantea tres estilos de vida relativos al almacenamiento de agua, la reparación de fugas y el consumo hídrico. La PS advierte que las relaciones causales entre las problemáticas hídricas y los estilos de vida son relevantes si se considera el Desarrollo Local Sustentable más que regional (...) y global. A medida que las problemáticas hídricas se intensifican, procesos actitudinales y de austeridad prevalecen sobre el dispendio de agua. En contraste, las situaciones hídricas en equilibrio con el consumo residencial facilitan el dispendio. La discusión alusiva a las problemáticas hídricas y los estilos de vida permitirá construir un sistema tarifario de consumo y delimitar las políticas públicas que se requerirán en el marco de la crisis de abastecimiento y distribución que se espera en los próximos años. In this paper a definition of n-valued system in the context of the algebraizable logics is proposed. We define and study the variety V3, showing that it is definitionally equivalent to the equivalent quasivariety semantics for the “Three-valued BCK-logic”. As a consequence we find an axiomatic definition of the above system.

En las ciencias cognoscitivas, existe una teoría con respecto a la arquitectura computacional de la mente conocida como el modularismo masivo. Esta teoría sostiene que la mente está en su mayoría constituida por mecanismos que son cognoscitivamente modulares. Algunos de los defensores de esta teoría proponen un argumento cuya conclusión es que es muy probable que mecanismos que son cognoscitivamente muy modulares sean más evolucionables que aquellos mecanismos que no son cognoscitivamente modulares. Aquí muestro que para poder defender plausiblemente esta (...) conclusión es necesario añadir a la noción de modularidad cognoscitiva la siguiente característica: "Un sistema cognoscitivo S de organismos de una población P es cognoscitivamente modular sólo si S es variacionalmente modular en P." Defiendo también la idea que una de las características que normalmente se asocian al concepto de modularidad cognoscitiva-i.e., la noción de doble disociación cognoscitiva-es muy cercana a la idea de modularidad variacional. Adicionalmente, argumento que no hay razones positivas, y sí algunas razones negativas, para pensar que las otras características usualmente asociadas al concepto de modularidad cognoscitiva-tales como la especificidad de dominio o la especialización funcional-coadyuven a la evolucionabilidad de los módulos cognoscitivos. In the cognitive sciences, there is a theory concerning the computational architecture of the mind known as massive modularity. This theory holds that the mind is constituted mostly by cognitive modules. Some of the defenders of this theory have put forward an argument whose conclusion is that it is very likely that those mechanisms that are cognitively very modular are more evolvable than mechanisms that are not cognitively modular. Here I show that a plausible defense of this conclusion requires us to add to the usual notion of cognitive modularity the following characteristic: "A cognitive system S of organism of a population P is cognitively modular only if S is variationally modular in P." I also defend the view that one of the characteristics normally associated to the concept of cognitive modularity-namely, the notion of a double dissociation-is conceptually close to the concept of variational modularity. Additionally, I argue that there are not positive reasons-while there are some negative ones-to think that the other characteristics usually associated to cognitive modularity, such as domain specificity or functional specialization, enhance the evolvability of cognitive modules. Este trabajo intenta delinear los ejes centrales de la concepción merleaupontyanade la naturaleza, poniendo especial atención en los últimos cursos del filósofoacerca de la historia del concepto (La nature). El análisis hace escala en lascosmologías presocráticas, la concepción aristotélica de la physis y la interpretación merleaupontyana del mecanicismo y la teleología moderna. Primeramente nos referimos a la crítica de las categorías con que tradicionalmente se hapensado a la physis, crítica fundada en su originaria adscripción a lo humanamente instituido y construido. (...) En segundo lugar, relativizamos esta crítica apartir de la posible consideración de la técnica humana como imitación y extensión de la naturaleza. La evaluación de ambos movimientos de este argumentocircular da lugar a una particular relación de Ineinander o entrelazamiento entre lo natural y lo humano. Reparamos, por último, en la necesidad enfatizadapor Merleau-Ponty de recobrar el significado primordial de la naturaleza como“suelo” y “excedente”. (shrink)

The novelty is not so in his original ideas as in the fact that these are useful to keep on completing the doctrine of a "descriptive" and "naturalist" metaphy-sick against "revisionism" such as the scepticism in its different modalities.

The origin of chordates and the consequent genesis of vertebrates were major events in natural history. The amphioxus (lancelet) is now recognised as the closest extant relative to the stem chordate and is the only living invertebrate that retains a vertebrate‐like development and body plan through its lifespan, despite more than 500 million years of independent evolution from the stem vertebrate. The inspiring data coming from its recently sequenced genome confirms that amphioxus has a prototypical chordate genome with respect to (...) gene content and structure, and even chromosomal organisation. Pushed by joint efforts of amphioxus researchers, amphioxus is now entering a new era, namely its maturation as a laboratory model, through the availability of a large amount of molecular data and the advent of experimental manipulation of the embryo. These two facts may well serve to illuminate the hidden secrets of the genetic changes that generated, among other vertebrates, ourselves. (shrink)

The most popular work of Francisco Sánchez, Quo nihil scitur (1581), transmits an absolutely sceptic thought. However, other writings like Carmen de Cometa anni M.D.LXXVII (1578), offer us different ideas about how Sánchez considers possible the scientific knowledge like, for example, his idea about the casual relations between natural objects.

The purpose of the present paper is to demonstrate a series of connections in terms of concepts and subjects between Ockham and Kant’s philosophical models that may provide a comprehensive framework for their respective insights on Law. Our main thesis postulates the existence of a continuum of certain fundamental assumptions derived from Nominalist theology and enlightened rationality that contribute to the essential unity of so-called “modern thought” and how such continuity is projected in the legal domain. In this sense, we (...) suggest the need to reflect upon the tacit Nominalism underlying Kantian criticism, which, although devoid of all theological premises, reconstructs metaphysics while preserving its basic scheme. In order to do so, our starting point is a very brief reference to the similarities between their respective theories of knowledge. We go on to analyze the structure behind moral actions according to Ockham and Kant’s doctrines. Finally, we point to certain founding principles and elements common to both doctrines in the field of legal-political thought. (shrink)

Había estudiado en Salamanca, Roma, Valencia y Munich. Su tesis doctoral sobre el pensamiento antropológico de Nietzsche fue dirigida por Aranguren. Fue catedrático de instituto en Andújar, Ávila y Badalona, y profesor de universidad en Barcelona y Madrid. Este artículo discute y analiza la formación del carácter crítico e intelectual en Rafael Gutiérrez Girardot. A partir de fuentes diversas y, en parte, inexploradas, se reconstruye el proceso de formación y ejercicio de su actividad crítica entre 1950 y 1965. Se tienen en cuenta tanto las relaciones con otros intelectuales como la influencia de los diversos contextos en los cuales se dieron dichas relaciones. Así, su participación en Cuadernos Hispanoamericanos, su correspondencia con Alfonso Reyes y con Nils Hedberg, su (...) actividad diplomática, su trabajo editorial y de traducción y, finalmente, su práctica docente, se estudian con objeto de tener un marco comprensivo. La obra crítica de Gutiérrez Girardot dista de estar comprendida y, de hecho, se precisa todavía de un exhaustivo trabajo de reconstrucción y análisis. This paper discusses and analyses the critical and intellectual nature of the work of Rafael Gutiérrez Girardot. It reproduces the process of construction and exercise of his critical activity (1950-1965), based on different sources some of them not yet very studied. The paper takes into account his relationships with other intellectuals and the influence of its different contexts. Thus, in order to get a comprehensive framework, it studies his participation in Cuadernos Hispanoamericanos, his correspondence with Alfonso Reyes and Nils Hedberg, his diplomatic activity, his work as editor and translator and finally his teaching experience. The critical work of Gutiérrez Girardot is far from being completely interpreted and this makes necessary an exhaustive work of reconstruction and analysis. (shrink)

Histamine is a multifunctional biogenic amine with relevant roles in intercellular communication, inflammatory processes and highly prevalent pathologies. Histamine biosynthesis depends on a single decarboxylation step, carried out by a PLP-dependent histidine decarboxylase activity (EC 4.1.1.22), an enzyme that still remains to be fully characterized. Nevertheless, during the last few years, important advances have been made in this field, including the generation and validation of the first three-dimensional model of the enzyme, which allows us to revisit previous results and conclusions. El cálculo proposicional se basa proposiciones que son tautologías, antilogías y de tipo contingente, construidas con las operaciones de disyunción, conjunción, y negación, así como con el llamado condicional material para trasladar los enunciados condicionales. Con todo ello se obtiene una estructura de álgebra de Boole, que permite equiparar el cálculo proposicional al cálculo algebraico booleano. En parte, la simplificación conceptual que se obtiene resulta de ser el orden parcial del álgebra equivalente a la afirmación del condicional material. Además, con (...) tal metodología cabe ver qué partes del cálculo proposicional clásico pueden trasladarse, aun con limitaciones, a estructuras más débiles y, a la vez, más generales, como son los ortoretículos no booleanos o las álgebras de De Morgan.El cálculo proposicional trata con la deducción. Por ello, el artículo lo desarrolla a partir de un operador de consecuencias en el sentido de Tarski. Ampliado el modelo deductivo, es fácil ver otras consecuencias que las usualmente consideradas en los textos elementales; en particular, se analizan cuatro esquemas de razonamiento deductivo típicos y, entre ellos, se presta especial atención a los usuales Modus Ponens y Modus Tollens. En el caso de las estructuras algebraicas de conjuntos ‘borrosos’, ninguna es de álgebra de Boole ni siquiera de orto-retículo y sólo cabe trabajar, en algunos casos, con álgebras de De Morgan-Kleene. Por lo tanto el cálculo proposicional ‘fuzzy’ debe construirse de acuerdo con la estructura algebraica que corresponda en cada caso y una vez elegida como representación del condicional una función que verifique el Modus Ponens. In this article, I explore the role of the body in Indian thought through the lens of Lilian Silburn’s works, focusing on the idea of carving the cosmos, namely of somatic performances that have cosmological relevance. First, I delve into her biography, to study, subsequently, her analysis of ancient Vedic philosophy, the Brāhmaṇa, the Upanişad, and Buddhism. In this manner, I touch upon a series of conceptual developments, trying to understand the constant tensions between the discontinuous and the continuous, the (...) non-arranged and the arranged, the multiple and the One, and finally between eternalism and nihilism. I conclude by examining the way Buddhism has of resolving these tensions in the non-substantial theory of Karman. (shrink)

Clinical practices are considered one of the cornerstones in nurses' education. This study provides a framework to determine how factors in the academic environment, influence nursing student's satisfaction with their practices. A cross-sectional analytical study was conducted in a convenience sample of 574 nursing students at a private university in Valencia, during the 2016/2017 academic year, 79% were women. Two statistical methodologies were used for data analysis: hierarchical regression models and fuzzy sets qualitative comparative analysis. The HRM indicate that the (...) students' mean score influences all dimensions of satisfaction. Furthermore, in the fsQCA, the type of service and center, as well as the type of management, the preference in the choice of the practice center and the number of students per period per clinical educator influence satisfaction with clinical practices. These results could be used to understand how academic factors influence nursing students' satisfaction with their clinical practices and to create intervention programmes that improve it. This will help prepare students to be the future nursing workforce. (shrink)

Electricity is an indicator that shows the progress of a civilization; it is a product that has greatly changed the way we think about the world. Electricity price forecasting became a fundamental task in all countries due to the deregulation of the electricity market in the 1990s. This work examines the effectiveness of using multiple variables for price prediction given the large number of factors that could influence the price of the electricity market. The tests were carried out over four (...) periods using data from Spain and deep learning models. Two different attribute selection methods based on Pearson’s correlation coefficient have been used to improve the efficiency of the training process. The variables used as input to the different prediction models were chosen, considering those most commonly used previously in the literature. This study attempts to test whether using time series lags improves the non-use of lags. The results obtained have shown that lags improve the results compared to a previous work in which no lags were used. (shrink)
