Few contemporary philosophers discuss the ways in which the emotion of shame may be gendered. This paper addresses this situation, examining Gabriele Taylor's account of genuine vs. false shame. 1 argue that, by attending to the social pressures placed on many women to conform to a certain vision of femininity, an analysis of the shame to which women may be prone shows that Taylor's account of shame remains incomplete.

Although significant literature and jurisprudence has amassed on rights-based climate litigation over recent years, less research and case law has emerged on poverty-related court cases and the fulfilment of economic, social, and cultural rights (ESCR) in Canada. Fewer still are studies exploring the interlinkages between these areas of inquiry. The purpose of this paper is to explore, using Canada as a case study, rights-based developments in climate litigation cases and how these could impact the innovative advancement of ESCR (e.g. to (...) food, housing and water). Typically, issues of justiciability and standing emerge, impeding the realization of such rights. Given the grave threats we now face, climate cases and social movements must be brought together to better hold state actors accountable for their rights obligations. We implore the legal community to explore ways to traverse juridical obstacles to realize the interdependencies of human rights and protect the planet from calamitous climate change. (shrink)

In contrast to many hypermediated texts that are poorly designed and are not geared to specific instructional needs, this paper describes the use of “Plato’s Apology: A Hypermediated Learning Environment” (HMLE), an instructional tool capable of meeting the challenge of building an instructionally sound environment for philosophy courses. In addition to providing a description of the interface, the underlying theory-based design principles used to create this HMLE are described, feedback concerning its first two implementations is discussed, and further implications for (...) its use in learning, assessment, and teaching are considered. In the late thirteenth century, western Europe suffered the notable disgrace of losing the last of the Christian strongholds in mainland Syria with the fall of Acre in 1291, and yet throughout the early fourteenth century Western powers were unable to launch a crusade to recover the Holy Land despite repeated and costly attempts. Until not long ago, historians of the crusades had interpreted the inaction of the fourteenth century as a sign that the age of true crusading was over (...) and that both disillusionment with the machinery of the papal indulgence and increasing local strife effectively removed the possibility of international cooperative action that a crusade to the Holy Land required. Recent scholarly work on the late Middle Ages has shown that this interpretation ignores both historical reality and late-medieval attitudes toward crusading. Acre's loss in many respects crystallized issues regarding crusade reform, and, though no new crusade to the Holy Land ever materialized, crusading in its various guises experienced renewed vitality throughout the fourteenth century—notably in Iberia, Italy, and the Baltic—in spite of the ravages of the Black Death, the suppression of the Templars, the collapse of prominent Italian banking houses that supported crusade finance, and the Anglo-French conflict. While the Holy Land may have remained in heathen hands, crusading remained a diverse, multifaceted, and vibrant set of practices that continued to be contested and redefined by various social groups despite the papacy's sophisticated descriptions of it in papal bulls and in canon law. In this study I hope to facilitate interdisciplinary discussion of crusade theory and practice by examining literary evidence—specifically, the Middle English romance Sir Isumbras—with a more broadly conceived notion of crusade discourse that includes connections among propaganda, chronicle, religious ritual, and popular romance. As I argue, Sir Isumbras critiques certain knightly behavior following Acre's loss and at the very least imagines, if not outright promotes, crusading reform and action for a mixed audience of lesser knights and non-nobles. The topicality of the poem's critique, however, is fully intelligible only when considered in light of other facets of crusade discourse; hence, I discuss below how features of popular fourteenth-century crusading movements, chronicle histories, and literary history are appropriated and reconfigured by the text. By reading these various sources as part of a connected, evolving discussion, we effectively expand our definition of the genre of the crusading romance in a way that not only incorporates historians' recent insights regarding the range of crusading practices but also reveals that crusading's personal and political aspects, in addition to its mass military campaigns, continued to shape a complex medieval outlook that found literary expression. Whether educational research should employ the ‘scientific method’ has been a recurring issue in its history. Hence, textbooks on research methods continue to perpetuate the idea that research students ought to choose between competing camps: ‘positivist’ or ‘interpretivist’. In reference to one of the most widely referred to educational research methods textbooks on the market—namely Research Methods in Education by Cohen, Manion, and Morrison—this paper demonstrates the misconception of science in operation and the perversely false dichotomy that has become (...) enshrined in educational research. It then advocates a new approach, and suggests that the fixation with ‘science’ versus ‘non-science’ is counterproductive, when what is actually required for good inquiry is a critical approach to knowledge claims. Logical monism is the claim that there is a single correct logic, the 'one true logic' of our title. The view has evident appeal, as it reflects assumptions made in ordinary reasoning as well as in mathematics, the sciences, and the law. In all these spheres, we tend to believe that there aredeterminate facts about the validity of arguments. Despite its evident appeal, however, logical monism must meet two challenges. The first is the challenge from logical pluralism, according to which (...) there is more than one correct logic. The second challenge is to determine which form of logicalmonism is the correct one. One True Logic is the first monograph to explicitly articulate a version of logical monism and defend it against the first challenge. It provides a critical overview of the monism vs pluralism debate and argues for the former. It also responds to the second challenge by defending a particularmonism, based on a highly infinitary logic. It breaks new ground on a number of fronts and unifies disparate discussions in the philosophical and logical literature. In particular, it generalises the Tarski-Sher criterion of logicality, provides a novel defence of this generalisation, offers a clearnew argument for the logicality of infinitary logic and replies to recent pluralist arguments. No discussion of academic freedom, research integrity, and patient safety could begin with a more disquieting pair of case studies than those of Nancy Olivieri and David Healy. The cumulative impact of the Olivieri and Healy affairs has caused serious self examination within the biomedical research community. The first part of the essay analyses these recent academic scandals. The two case studies are then placed in their historical context—that context being the transformation of the norms of science through increasingly close (...) ties between research universities and the corporate world. After a literature survey of the ways in which corporate sponsorship has biased the results of clinical drug trials, two different strategies to mitigate this problem are identified and assessed: a regulatory approach, which focuses on managing risks associated with industry funding of university research, and a more radical approach, the sequestration thesis, which counsels the outright elimination of corporate sponsorship. The proto-code of ethics and conduct for European nurse directors was developed as a strategic and dynamic document for nurse managers in Europe. It invites critical dialogue, reflective thinking about different situations, and the development of specific codes of ethics and conduct by nursing associations in different countries. The term proto-code is used for this document so that specifically country-orientated or organization-based and practical codes can be developed from it to guide professionals in more particular or situation-explicit reflection and values. This paper presents a qualitative study investigating the application of physiotherapists’ professional ethics in practice with respect to touch, intimacy, and corporeality during therapy, based on the experiences of elderly patients. As the relationship in a physiotherapy session is multidimensional, the study considered three levels: physical contact, verbal contact, and the conditions in which the therapy took place. The aim of this study was to find out what values are of importance to older people during a physiotherapy session, with emphasis (...) on the categories of touch, corporeality, and intimacy. The studied group consisted of sixteen male and female physiotherapy patients aged between sixty-six and ninety-two years. The study was conducted according to the grounded theory methodology. The research material consisted of transcriptions of free targeted interviews, which were subjected to a process of coding and analysis. As a result of data analyses, three superior categories have been identified—safety, anxiety, interpersonal relationship—and three a priori categories stemming from the characteristic features of the study area—touch, corporeality, and intimacy. The a priori categories did not appear independently in statements made by the respondents, but instead seemed to be components of superior categories. The most important values indicated by the respondents concerned the interpersonal relationship with their physiotherapist and the feeling of safety and care. In terms of touch, corporeality, and intimacy, the respondents indicated, among others, the importance of predictability, a sense of security, privacy, and acceptance of the body. (shrink)

We have surveyed various recent European opinions on Germ-Line engineering. The majority express more or less severe reservations about any interventions on the human Germ-Line, including therapeutic ones. However, they are divided over the pragmatic, or categorical-ethical nature of the relevant arguments. This split reflects two competing views of technology. The ‘pessimistic’ one is deeply concerned by the slippery slope leading from bona fide therapeutic applications of genetic engineering to eugenic practices. It insists that, if anything can defend us against (...) these evils, it must be a set of strong, ethically-based prohibitions. The other, ‘optimist’ view is more confident in the discriminating powers of societal regulation. We argue for the latter view and suggest that the pragmatic arguments brought to this debate are less problematic than the ethical ones. (shrink)

Near the beginning of In Toga Candida, Cicero informed his audience of a private meeting between his two most serious competitors for the consulate and the managers of their campaigning funds. This meeting took place at the house of a nobleman whom Cicero did not name but to whom he attributed a signal notoriety in the practice of electoral corruption. Asconius offers a solution without hesitation: it was at the house of either Caesar or Crassus. He explains his choice: these (...) two men were Cicero's most committed and influential opponents in his campaign for the consulate, and he has excellent evidence for their opposition: Cicero's own Expositio consiliorum suorum, no longer extant. The credibility or otherwise of this controversial work must be dismissed from any enquiry into the identity of the mysterious figure, however. Asconius, in naming the two alternative possibilities, discloses himself to be without authoritative evidence on the point. Nothing can have been said in De consiliis suis to identify the house, the meeting, or the notorious nobleman. Asconius' words reveal that his attempt at an identification is based on Cicero's assertion therein of an overt hostility to him on the part of both Crassus and Caesar during the campaign. His attribution of a covert ‘dirty tricks’ operation to one of them is no more than speculation. (shrink)

The witness of the Community of God to every individual man points in this direction: that this choice of the Godless is null and void, that he belongs to Jesus Christ from eternity and thus is not rejected, but rather chosen by God in Jesus Christ, that the reprobation which he deserves (...) on the basis of his wrong choice is borne and removed by Jesus Christ; that on the basis of the true, the Divine choice he is chosen for eternal life with God. The promise of his election will determine him as a member of the Church to become himself a carrier of its witness to the whole world. We present the opinion of some authors who believe there is no force between a stationary charge and a stationary resistive wire carrying a constant current. We show that this force is different from zero and present its main components: the force due to the charges induced in the wire by the test charge and a force proportional to the current in the resistive wire. We also discuss briefly a component of the force proportional to the square of the current (...) which should exist according to some models and another component due to the acceleration of the conduction electrons in a curved wire carrying a dc current (centripetal acceleration). Finally, we analyze experiments showing the existence of the electric field proportional to the current in resistive wires. (shrink)

Few people would care to deny, whether within India or without, that Buddha is the greatest Indian of all times. Whether from the standpoint of the purity of his life, the daring originality and novelty of his thought, or the extent of his influence in shaping the culture of the world, it would be hard to beat the record of Buddha. Even making every allowance for the common idea that no man is a prophet in his own land, it is (...) difficult to believe that for the last thousand years Buddha has been practically an exile from the land of his birth. It is nothing short of an irony of history, and nothing short of a tragedy for India, that the great unifying force that he represented in his time and does represent even to-day has been allowed to run waste and the great moral stamina that he sought to supply failed in its historic mission. The fundamental question I consider is the following: What is it that makes one thing a person and another thing not? I do not provide a complete answer; rather I begin to develop a framework for answering the question. In this essay I do the following: (1) distinguish between the powers possessed by persons and the constitutions of persons, and propose some metaphysical conjectures concerning the relationship between persons' powers and their constitutions; (2) propose for Christians, as well as for (...) others, an hylomorphic soul-body alternative to Cartesianism; (3) highlight some prominent differences between the nature of human persons and the natures of brute animals; and (4) apply this framework for understanding human persons to problems in biomedical ethics concerning the ontological and moral status of human embryos and of the comatose.
