Increased melting of Arctic sea ice due to climate change attracts interests of national states who sense the potential that opening northern waters will enhance access of the Northwest Passage (NWP) and subsoil resources. Claims for Arctic sovereignty include conflicts around the status of the NWP, ownership of resources, but also attempts of Inuit to decolonize through the establishment of self-government in their respective countries that receive a new urgency due to the effects of climate change. From a (...) review of different existing institutional and organizational bodies and mechanisms that serve as intervention tools in the sovereignty disputes in the Arctic (the UN, the Arctic Council and the Inuit Circumpolar Council) it emerges that such actors can ultimately only provide a non-binding platform for orientation and exchange and eventually leave nation-states as ultimate power-holders which reinforces and is in accordance with realist theory and its understanding of the international system as anarchic (i.e. as lacking a decision-making and binding overarching authority beyond the state-level). Despite their good intentions, external general acceptance and partial success, the potential of the organizations and institutions analyzed here is also ultimately challenged by nation states, who seem to prefer circumventing such intervention tools to be able to interact instead with each other via officialdiplomacy or by making singular and autonomous decisions to maximize their power and sovereignty. She was the inaugural Artist in Residence (2011 to 2021) at TRIUMF, Canada’s particle accelerator center, and co-organizes processes of collaboration between artists and physicists in a project called Leaning Out of Windows. Her studio and research practices traverse the fields of physics, social history, feminist theory, and narratives of science. Doctoral programs at U.S. universities play a critical role in the development of human resources both in the United States and abroad. This volume reports the results of an extensive study of U.S. research-doctorate programs in five broad fields: physical sciences and mathematics, engineering, social and behavioral sciences, biological sciences, and the humanities. Research-Doctorate Programs in the United States documents changes that have taken place in the size, structure, and quality of doctoral education since the widely used 1982 editions. This (...) update provides selected information on nearly 4,000 doctoral programs in 41 subdisciplines at 274 doctorate-granting institutions. This volume also reports the results of the National Survey of Graduate Faculty, which polled a sample of faculty for their views on the scholarly quality of program faculty and the effectiveness of doctoral programs in preparing research scholars/scientists. This much-anticipated update of such an essential reference will be useful to education administrators, university faculty, and students seeking authoritative information on doctoral programs. This work studies the Great Council of Malines as an institution. It analyzes the Council's internal organization and staff policy, its position within the broader society of the Austrian Netherlands, the volume and nature of litigation at the Council, and its final years and ultimate demise in the late 18th and early 19th century. By means of this institutional study, this volume provides insight into the role played by the Great Council in the process of state-building (...) in the 18th century Austrian Netherlands. While superior courts were once considered to be the prime agencies of change in the Early Modern Period, tools par excellence for the sovereigns' striving towards centralization and superiority, their position in the 18th century has so far been barely touched upon. This work focuses specifically on the 18th century supreme court of the Austrian Netherlands, and provides a broad overview with attention to other aspects of the tribunal's functioning and to its role in 18th century attempts at state formation. Waters, Ian The Australian hierarchy was established by Pope Gregory XVI in 1842. Since then, there have been six national Catholic councils held in Australia. The first two, celebrated in 1844 and 1869, are known as the First Provincial Council of Australia and the Second Provincial Council of Australia, as until 1874 the Australian dioceses were all in the one ecclesiastical province with Sydney being the sole metropolitan see. In 1874, a second province - Melbourne - was established, (...) and the national councils since then - four of them, celebrated in 1885, 1895, 1905 and 1937 - have been called plenary councils, the term used in the Catholic Church in recent centuries for councils whose participants are from more than one ecclesiastical province; in the past, terms such as regional councils or national councils have been used. The principle of the responsibility to protect (RtoP) conceives of a broad set of measures that can be employed in preventing and responding to atrocity crimes. Nevertheless, the UN Security Council remains an important part of the implementation architecture, given what the International Commission on Intervention and State Sovereignty referred to as its authoritative position in international society as the “linchpin of order and stability.” As part of the roundtable “The Responsibility to Protect in a Changing World Order: Twenty (...) Years since Its Inception,” this review of the Council's role in fulfilling its responsibility to protect advances two somewhat contrasting arguments about the original ICISS report. First, it suggests that the commissioners may have underestimated the Council's potential contribution, by concentrating on the authorization of coercive means to address crises of human protection. Over the past two decades, the Security Council has not only employed various diplomatic, political, and humanitarian measures to address atrocity crimes but also adjusted the purposes and practices of peace operations to advance protection goals and more subtly shaped discourses and expectations about state responsibilities for protection. However, I also argue that the willingness of the ICISS to identify potential alternatives to the Security Council when its members are paralyzed appears in retrospect to have been both bold and forward looking, in light of the Council's failures to act in a timely and decisive manner to protect amid crises and the contemporary realities of geopolitical rivalry. The article concludes by suggesting that future efforts to protect populations from atrocity crimes should focus not only on the herculean task of trying to change the behavior of P5 members of the Council but also on encouraging a new institutional balance between the Security Council and other intergovernmental bodies. In July 2018, the Nuffield Council on Bioethics released the report Genome editing and human reproduction: Social and ethical issues, concluding that human germline modification of human embryos for implantation is not ‘morally unacceptable in itself’ and could be ethically permissible in certain circumstances once the risks of adverse outcomes have been assessed and the procedure appears ‘reasonably safe’. The Nuffield Council set forth two main principles governing anticipated uses and envisions applications that may include health enhancements as (...) a public health measure. This essay provides a critique of three aspects in the Nuffield Council’s Report: its presumption of therapeutic efficacy, its inflation of parental rights to create a certain type of child, and its reliance on a specially commissioned report that appears to distort key definitions in international law. This article is interested in the general question of what justifies territorial rights over unoccupied places, including places that are not occupied but are situated within the territorial borders of a state. This question arises because one of the most common defenses of rights over territory makes use of the idea of occupancy and has difficulty explaining such rights in places that are not occupied. It explores this question through an examination of the claims and arguments in the Canadian (...) class='Hi'>Arctic, which provides an historically specific test case for the merits and plausibility of the various arguments appealed to. It argues that territorial rights in unoccupied places, including the Canadian Arctic, are justified on different grounds than in occupied parts of the territory, and that the justification also affects the kinds of rights—particularly over resources—that such states can claim. The search for the Northwest Passage in the years following the Napoleonic Wars provided both a market and testing ground for marine chronometers. Long voyages and extreme temperatures challenged the best chronometers. Among the firms seeking to meet those challenges was that of William Parkinson & William James Frodsham. Their chronometers performed particularly well in the Arctic, as John and James Clark Ross, William Edward Parry, and Edward Sabine gladly recognized. The way in which chronometers were made and sold, (...) however, meant that there were sometimes controversies over who was entitled to claim credit for a particular instrument. A letter from Parkinson & Frodsham in 1821 illustrates the problem, and its causes in the nature of the trade; the text of that letter is published here in its entirety. Also problematic, and discussed here, was the craft aspect of the industry, in which the ‘mechanical construction’ of a chronometer might not reveal the process of manufacture that gave it its steady rate and accuracy. Increasingly, the Internet is proving to be an important research tool. Today, cyberspace affords researchers easy access to traditionally difficult to reach populations, a host of virtual communities, and a wealth of data created through computer-mediated-communication. This newfound research frontier brings with it, however, a multiplicity of ethical concerns, including: (1) whether the Internet constitutes a private or public space; (2) whether the human subject paradigm is appropriate when considering the ethics of Internet research; and (3) whether cyber participants/‘speakers-as-writers’ and (...) communities should be guaranteed confidentiality and anonymity when researchers contain or consider them in research. This paper examines these specific ethical concerns as they relate to Canada's Tri-Council Policy Statement: Ethical Conduct for Research Involving Humans, which, as yet, does not explicitly address ethics involved in Internet research. I propose that in large part the Internet is by definition a public site of activity, and as such, many posters cannot expect their texts to remain confidential, nor their names anonymous, and that the human subject paradigm is highly problematic in terms of regulating ethics involved in some research generated through new information technologies. This is most expressly the case with computer-mediated-communication, which, in light of the Tri-Council Policy Statement, can be viewed as theoretically akin to public entertainment and performance. Many interpreters of Plato's Laws have seen the introduction of the ‘nocturnal council’ towards the end of that dialogue as a return to the sort of philosophic dictatorship allegedly recommended in the Republic and thus as a betrayal of the principle of the rule of law evinced in most of the Laws. This paper defends the consistency of the council with the larger programme of the Laws by showing that its function is philosophic discussion and not rule. Its (...) influence will be the influence of philosophy on its members, who already occupy political offices in the city, and not direct rule as a body. In this way, the council provides a point of entry for the transpolitical good of philosophy into the city and thus offers an essentially legal regime the means of transcending some of its characteristic limitations. It also points to larger themes in Plato's political philosophy. (shrink)

The Council on Ethical and Judicial Affairs of the American Medical Association examines physicians’ professional ethical responsibility in the event that the security of patients’ electronic records is breached.

ABSTRACT The militarization of Alaska during and after World War II created an extraordinary set of new facilities. But it also reshaped the imaginative role of Alaska as a hostile environment, where an antagonistic form of nature could be defeated with the appropriate combination of technology and training. One of the crucial sites for this reformulation was the Arctic Aeromedical Laboratory, based at Ladd Air Force Base in Fairbanks. In the first two decades of the Cold War, its employees (...) conducted numerous experiments on acclimatization and survival. The laboratory is now best known for an infamous set of tests involving the application of radioactive tracers to indigenous Alaskans—experiments publicized by post–Cold War panels established to evaluate the tragic history of atomic-era human subject research. But little else has been written about the laboratory's relationship with the populations and landscapes that it targeted for study. This essay presents the laboratory as critical to Alaska's history and the history of the Cold War sciences. A consideration of the laboratory's various projects also reveals a consistent fascination with race. Alaskan Natives were enrolled in experiments because their bodies were understood to hold clues to the mysteries of northern nature. A scientific solution would aid American military campaigns not only in Alaska, but in cold climates everywhere. (shrink)

The quality of doctoral-level biochemistry (N=139), botany (N=83), cellular/molecular biology (N=89), microbiology (N=134), physiology (N=101), and zoology (N=70) programs at United States universities was assessed, using 16 measures. These measures focused on variables related to: (1) program size; (2) characteristics of graduates; (3) reputational factors (scholarly quality of faculty, effectiveness of programs in educating research scholars/scientists, improvement in program quality during the last 5 years); (4) university library size; (5) research support; and (6) publication records. Chapter I discusses prior attempts (...) to assess quality in graduate education, development of the study plans, and the selection of disciplines and programs to be evaluated. Chapter II discusses the methodology used, focusing on each of the assessment measures. Chapters III to VIII present, respectively, findings from the analyses of the biochemistry, botany, cellular/molecular biology, microbiology, physiology, and zoology programs. Chapter IX includes a summary of results, correlations among measures, several additional analyses, and suggestions for future studies. Among the findings reported are those indicating that cellular/molecular biology programs had, on the average, the largest number of faculty and that students in cellular/molecular biology, biology, biochemistry, microbiology, and physiology received a relatively high fraction of financial support. While proponents of sustainability reporting believe in its potential to help corporations be accountable and transparent about their social and environmental impacts, there has been growing criticism asserting that such reporting schemes are utilized primarily as impression management tools. Drawing on Goffman’s self-presentation theory and its frontstage/backstage analogy, we contrast the frontstage sustainability discourse of a sample of large U.S. oil and gas firms to their backstage corporate political activities in the context of the passage of the American-Made Energy and (...) Good Jobs Act, also known as the Arctic National Wildlife Refuge Bill. The ANWR Bill was designed to allow oil exploration within the most sensitive environmental areas in the Refuge and this bill was vigorously debated in the United States Congress in 2005 and 2006. Our results suggest that the firms’ sustainability discourse on environmental stewardship and responsibility contrasts sharply with their less visible but proactive political strategies targeted to facilitate the passage of the ANWR Bill. This study thus contributes to the social and environmental accounting and accountability literature by highlighting the relevance of Goffman’s frontstage/backstage analogy in uncovering and documenting further the deceptive nature of the discourse contained in stand-alone sustainability reports. In addition, it seeks to contribute to the overall understanding of the multifaceted nature of sustainability reporting by placing it in relation to corporate political activities. (shrink)

The failure of the UN Security Council to adequately and effectively address the Syrian crisis has brought renewed scrutiny to the veto and its capricious use during mass atrocity situations. In response to these concerns, the idea of a code of conduct to regulate the exercise of the veto during humanitarian situations is now being increasingly advanced by several states, including France and the United Kingdom. This paper disputes the utility of such a code and argues that it would (...) not make any significant difference to the way mass atrocity crimes are addressed. I examine three core arguments often extended to justify the merit and the utility of the norm: the circumvention argument, the naming and shaming argument, and the Charter reform argument. I show how each of these arguments is undermined by mistaken notions about the norm's procedural effectiveness, and the role the veto plays in cases of what Simon Chesterman calls “inhumanitarian noninterventions.” Additionally, drawing on interviews conducted with diplomats at the United Nations in New York, I present evidence that resistance to a code of conduct comes not only from the permanent five members of the Council but also from the nonpermanent members, further imperiling the idea's capacity to effect change. Ultimately, I contend that the current global effort to curtail the influence of the veto is nothing more than a journey down the rabbit hole: exciting, but ultimately distracting. (shrink)

The article presents a geographic position of the Arctic. Legal regimes of the Arctic and the Antarctic are compared. In a geographical terms, the Arctic is part of the ocean that is covered by ice, and Antarctic is a continent covered by ice which is surrounded by an ocean. It follows that Arctic should be considered a part of the world’s ocean, which is governed by 1982 UN Convention on the Law of the Sea. Currently, a (...) sectoral regime is established in the Arctic. The article analyzes the views of international law scholars on the issue and shares an opinion of those who criticize sectoral regime of the Arctic as incompatible with international law. Yet, what principles should underpin legal regime of the Arctic? Recent scholarly writings have considered a concept of common heritage of mankind. The article discusses the concept of common heritage of mankind. In the view of the author, this concept can be applied only to specific maritime areas but not to Arctic in its entirety. The article further thoroughly discusses Russia’s practice as regards its claims regarding the continental shelf of the Arctic. Furthermore, it evaluates the grounds of Russia’s policy in the Arctic until 2020 and also examines Russia’s application for extension of continental shelf in the Arctic and the Pacific Oceans.
