The main aim of my paper is to analyse Aristotle’s theory of language in the context of his Physics I.1 and via an analysis and an interpretation of this part of his Physics I try to show that (i) the study of human language (logos) significantly falls within the competence of Aristotle’s physics (i.e. natural philosophy), (ii) we can find the results of such (physical) inquiry in Aristotle’s zoological writings, stated in the forms of the first principles, causes and elements (...) of the human speech (logos) and (iii) the analogies (Phys. 184b13-14) made by Aristotle at the very end of the first chapter make better sense if we consider them in the broader context in which Aristotle recognizes language as a complex natural phenomenon we are born into and which has to be not only biologically, but also socially developed through our lives. Apparent motion is an illusion in which two sequentially presented and spatially separated stimuli give rise to the experience of one moving stimulus. This phenomenon has been deployed in various philosophical arguments for and against various theories of consciousness, time consciousness and the ontology of time. Nevertheless, philosophers have continued working within a framework that does not reflect the current understanding of apparent motion. The main objectives of this paper are to expose the shortcomings of the explanations provided for (...) apparent motion and to offer an alternative explanation for the phenomenon. (shrink)

One of Daniel Dennett's most sophisticated arguments for his eliminativism about phenomenological properties centers around the color phi phenomenon. He attempts to show that there is no phenomenological fact of the matter concerning the phenomenon of apparent motion because it is impossible to decide between two competing explanations. I argue that the two explanations considered by Dennett are both based on the assumption that a realist account of the phenomenon must include a neat mapping between phenomenological time (...) and objective time. Since this assumption is false, Dennett's argument is unsuccessful. Like most eliminativist arguments, Dennett's arguments may indicate that the subjective character of experience is different from how it is often described, but this leaves plenty of room for alternative models of consciousness. The phenomenon of language, being so familiar to us, still possesses unknown nature, origin, and, as we may say, function. For Plato, language was the way to cognition of the Universe. The phi- losophy of language, which was primarily initiated by Plato in his “Cratylus”, still has not ob- tained answers to the questions settled by great Greek thinker. In fact, it just acquired various solutions among different approaches during all four ages of understanding, namely Ancient, Scholastic, Modern and (...) Post-modern periods. The article is supplemented with excerpts from the first Ukrainian translation of Proclus’ “Commentary on Plato’s “Cratylus”. The specifics of the style and vocabulary of the work is emphasized in the context of interpretation into Ukrainian. Historical and cultural context of Proclus’ works in general and particularly its “Commentaries” is addressed, and the main terminological system of his works is analyzed. Ukrainian equivalents are suggested. Some common features as well as discrepancies in Neoplatonist and Peripatetic approach are considered in the context of solutions to the same questions. Contrastive analysis of the “Commentary on Plato’s “Cratylus” with prior mythological context as well as with fol- lowing scholastic teaching is conducted in philosophical and linguistic aspects. The importance of problems placed by Plato in the field of epistemology and philosophy of language is addressed. Analogies with contemporary approach to linguistic and philosophical questions are considered in the scope of nativism and empiricism. Immutability of questions and mutability of generations and approaches is shown. The importance of previous works for the next development of con- temporary thought is emphasized. (shrink)

Austere relationism rejects the orthodox analysis of hallucinations and illusions as incorrect perceptual representations. In this article, I argue that illusions of optimal motion present a serious challenge for this view. First, I submit that austere-relationist accounts of misleading experiences cannot be adapted to account for IOMs. Second, I show that any attempt at elucidating IOMs within an austere-relationist framework undermines the claim that perceptual experiences fundamentally involve relations to mind-independent objects. Giulio Tononi's integrated information theory (IIT) proposes explaining consciousness by directly identifying it with integrated information. We examine the construct validity of IIT's measure of consciousness,phi(Φ), by analyzing its formal properties, its relation to key aspects of consciousness, and its co-variation with relevant empirical circumstances. Our analysis shows that IIT's identification of consciousness with the causal efficacy with which differentiated networks accomplish global information transfer (which is what Φ in fact measures) is mistaken. This misidentification has the consequence of requiring (...) the attribution of consciousness to a range of natural systems and artifacts that include, but are not limited to, large-scale electrical power grids, gene-regulation networks, some electronic circuit boards, and social networks. Instead of treating this consequence of the theory as a disconfirmation, IIT embraces it. By regarding these systems as bearers of consciousnessex hypothesi, IIT is led toward the orbit of panpsychist ideation. This departure from science as we know it can be avoided by recognizing the functional misattribution at the heart of IIT's identity claim. We show, for example, what function is actually performed, at least in the human case, by the cortical combination of differentiation with integration that IIT identifies with consciousness. Finally, we examine what lessons may be drawn from IIT's failure to provide a credible account of consciousness for progress in the very active field of research concerned with exploring the phenomenon from formal and neural points of view. In this paper I undertake to resolve a main pragmatic puzzle triggered by Bank-type cases. After accepting ‘sanitized’ intuitions about Truth-Values, as reflected in x-phi experiments, the pragmatic puzzle about whether the husband is inconsistent remains, and if he isn’t, which intuitively is the case, how are we to explain it. The context in such cases is pragmatic, with awareness of high risks, and the treatment I propose is pragmatic as well, but not Gricean. I offer a new Pragmatics whose (...) main tools are Steering Thrust and Posting. It focuses on what I call Action-Directed Pragmatics. An overall view of Pragmatics centers on the primary resort to Sayability rather than to Truth-Values, and to the Pragmatic phenomenon of co-present operative norm-types, which can conflict in some cases vis-à-vis particular actions and about what subjects can say. The very satisfactory explanation of the above puzzle that I offer is in such terms. In particular, attention is focused on the phenomenon of Negative-Polarity Pragmatic Functors. (shrink)

The term complementarity plays a central role in quantum physics, not least in various approaches to defining entanglement and the conditions for its occurrence. It has, however, been used in a variety of ways by different authors, denoting different concepts and relationships. Here we describe and clarify some of them and analyze the role they play with respect to the phenomenon of entanglement. Based on these considerations we discuss the recently proposed system-theoretical generalization of the concepts entanglement and complementarity (...) (Atmanspacher et al. in Found Phys 32(3):379–406, 2002; von Lucadou et al. in J Conscious Stud 14(4):50–74, 2007; Filk and Römer in Axiomathes 21(2):211–220, 2011; Walach and Von Stillfried in Axiomathes 21(2): 185–209, 2011). This thesis consists of four essays and an introduction dedicated to two main topics: indexicality and presupposition. The first essay is concerned with an alleged problem for the standard treatment of indexicals on which their linguistic meanings are functions from context to content. Since most indexicals have their content settled, on an occasion of use, by the speaker’s intentions, some authors have argued that this standard picture is inadequate. By demonstrating that intentions can be seen as a parameter of the (...) kind of context that characters operate on, these arguments are rejected. In addition, it is argued that a more recent, variable-based framework is naturally interpreted as an intention-sensitive semantics. The second essay is devoted to the phenomenon of descriptive uses of indexicals on which such an expression seems to contribute, not its standard reference as determined by its character, but a property to the interpretation. An argument that singular readings of the cases in question are incoherent is shown to be incorrect, and an approach to descriptive readings is developed on which they arise from e-type uses akin to other well known cases. Further, descriptive readings of the relevant kind are seen to arise only in the presence of adverbs of quantification, and all sentences in which such an adverb takes scope over an indexical are claimed to be ambiguous between a referential and an e-type reading. The third essay discusses a version of the variable analysis of pronouns on which their descriptive meanings are relegated to the so-called phi-features – person, gender and number. In turn, the phi-features are here seen as triggering semantic presuppositions that place constraints on the definedness of pronouns, and ultimately of sentences in which they appear. It is argued that the descriptive information contributed by the phi-features diverges radically from presuppositional information of both semantic and pragmatic varieties on several dimensions of comparison, and instead the main role of the phi-features is seen to be that of guiding hearers’ attempts to ascertain the speaker’s intentions. The fourth essay addresses an issue concerning the treatment of presuppositions in dynamic semantics. Representing a semantic treatment of pragmatic presuppositions, the dynamic framework is shown to incorrectly regard conversational infelicity as sufficient for semantic undefinedness, given the standard way of defining truth in terms of context change. Further, it is shown that a proposal for a solution fail to make correct predictions for epistemic modals. A novel framework is developed on which context change potentials act on contexts that have more structure than the contexts usually countenanced by dynamic semantics, and it is shown that this framework derives truth from context change while making correct predictions for both presuppositions and modals. In the mid-seventeenth century a movement of self-styled experimental philosophers emerged in Britain. Originating in the discipline of natural philosophy amongst Fellows of the fledgling Royal Society of London, it soon spread to medicine and by the eighteenth century had impacted moral and political philosophy and even aesthetics. Early modern experimental philosophers gave epistemic priority to observation and experiment over theorising and speculation. They decried the use of hypotheses and system-building without recourse to experiment and, in some quarters, developed a (...) philosophy of experiment. The movement spread to the Netherlands and France in the early eighteenth century and later impacted Germany. Its important role in early modern philosophy was subsequently eclipsed by the widespread adoption of the Kantian historiography of modern philosophy, which emphasised the distinction between rationalism and empiricism and had no place for the historical phenomenon of early modern experimental philosophy. The re-emergence of interest in early modern experimental philosophy roughly coincided with the development of contemporary x-phi and there are some important similarities between the two. (shrink)

We think less than we think. My thesis moves from this suspicion to show that standard accounts of intentional action can't explain the whole of agency. Causalist accounts such as Davidson's and Bratman's, according to which an action can be intentional only if it is caused by a particular mental state of the agent, don't work for every kind of action. So-called automatic actions, effortless performances over which the agent doesn't deliberate, and to which she doesn't need to pay attention, (...) constitute exceptions to the causalist framework, or so I argue in this thesis. Not all actions are the result of a mental struggle, painful hesitation, or the weighting of evidence. Through practice, many performances become second nature. Think of familiar cases such as one's morning routines and habits: turning on the radio, brushing your teeth. Think of the highly skilled performances involved in sport and music: Jarrett's improvised piano playing, the footballer's touch. Think of agents' spontaneous reactions to their environment: ducking a blow, smiling. Psychological research has long acknowledged the distinctiveness and importance of automatic actions, while philosophy has so far explained them together with the rest of agency. Intuition tells us that automatic actions are intentional actions of ours all the same (I have run a survey which shows that this intuition is widely shared): not only our own autonomous deeds for which we are held responsible, but also necessary components in the execution and satisfaction of our general plans and goals. But do standard causal accounts deliver on the intentionality of automatic actions? I think not. Because, in automatic cases, standard appeals to intentions, beliefs, desires, and psychological states in general ring hollow. We just act: we don't think, either consciously or unconsciously. On the reductive side, Davidson's view can't but appeal to, at best, unconscious psychological states, the presence and causal role of which is, I argue, inferred from the needs of a theory, rather than from evidence in the world. On the non-reductive side, Bratman agrees, with his refutation of the Simple View, that we can't just attach an intention to every action that we want to explain. But Bratman’s own Single Phenomenon View, appealing to the mysterious notion of 'motivational potential', merely acknowledges the need for refinement without actually providing one. So I propose my own account of intentional action, the 'guidance view', according to which automatic actions are intentional: differently from Davidson and Bratman, who only offer necessary conditions in order to avoid the problem of causal deviance, I offer a full-blown account: E's phi-ing is intentional if and only If phi-ing is under E's guidance. This account resembles one developed by Frankfurt, with the crucial difference that Frankfurt – taking 'acting with an intention' and 'acting intentionally' to be synonymous – thinks that guidance is sufficient only for some movement being an action, but not for some movement being an intentional action. I argue that, on the other hand, Frankfurt's concept of guidance can be developed so that it is sufficient for intentional action too. In Chapter One I present and defend my definition of ‘automatic action’. In Chapter Two I show that such understanding of automatic actions finds confirmation in empirical psychology. In Chapter Three I show that Davidson's reductive account of intentional action does not work for automatic actions. In Chapter Four I show that the two most influential non-reductive accounts of intentional action, the Simple View and Bratman's Single Phenomenon View, don't work either. And in Chapter Five I put forward and defend my positive thesis, the 'guidance view'. Also, in the Appendix I present the findings of my survey on the intentionality of automatic actions. (shrink)

Plausibly, how much is at stake in some salient practical task can affect how generously people ascribe knowledge of task-relevant facts. There is a metaphysical puzzle about this phenomenon, and an empirical puzzle. Metaphysically: there are competing theories about when and how practical stakes affect whether it is correct to ascribe knowledge. Which of these theories is the right one? Empirically: experimental philosophy has struggled to find a stakes-effect on people’s knowledge ascriptions. Is the alleged phenomenon just a (...) philosopher’s fantasy? I propose a new psychological account of when and why people’s knowledge ascriptions are sensitive to stakes. My hypothesis is motivated by empirical research on how people’s judgements are sensitive to their social context. Specifically, people’s evaluations are sensitive to their ‘psychological distance’ from the scenarios they are considering. When using ‘fixed-evidence probes’, experimental philosophy has found that what’s at stake for a fictional character in a made-up scenario has little or no effect on how participants ascribe knowledge to them. My hypothesis predicts this finding: the scenarios are too ‘psychologically distant’ to participants. Our empirical puzzle is resolved: the stakes-effect often present in the wild won’t be present in vignette studies. (This illustrates a widespread problem with X-phi vignette studies: if people might judge differently in other social contexts, we can’t generalize from the results of these experiments. That is, vignette studies are of doubtful ‘external validity’.) The hypothesis also resolves our metaphysical puzzle. It predicts that people do not ascribe knowledge in a way deemed correct by any of the standard philosophical views, namely classical invariantism, interest-relative invariantism, and contextualism. Our knowledge ascriptions shift around in the way that’s most useful for social beings like us, and this pattern in our judgements can only be endorsed by a genuinely relativist metaphysics for knowledge. A model for measurement in collapse-free nonrelativistic fermionic quantum field theory is presented. In addition to local propagation and effectively-local interactions, the model incorporates explicit representations of localized observers, thus extending an earlier model of entanglement generation in Everett quantum field theory (Rubin in Found. Phys. 32:1495–1523, 2002). Transformations of the field operators from the Heisenberg picture to the Deutsch-Hayden picture, involving fictitious auxiliary fields, establish the locality of the model. The model is applied to manifestly-local calculations of the results (...) of measurements, using a type of sudden approximation and in the limit of massive systems in narrow-wavepacket states. Detection of the presence of a spin-1/2 system in a given spin state by a freely-moving two-state observer illustrates the features of the model and the nonperturbative computational methodology. With the help of perturbation theory the model is applied to a calculation of the quintessential “nonlocal” quantum phenomenon, spin correlations in the Einstein-Podolsky-Rosen-Bohm experiment. This paper offers an inconsistent model of motion perception. It was prompted by work on inconsistent motion due to Hegel and, following him, Priest. But the paper skirts Hegel's full scale idealism, by proposing that the inconsistency is with the cognitive contents of motion perception. The paper draws on work in the psychology of perception, and in the theory of inconsistency. I begin by noting the prima facie argument that temporal change threatens inconsistency, and canvassing ways in which this might (...) be avoided. The orthodox reply to the prima facie argument is that one and the same thing can have different incompatible properties at different times. This is plausible when applied to motion in the physical world. However, applied to cognition, it can be seen that the phenomenon of phi or beta, combined with the mechanism of a Reichardt detector, lends support to one key step in the prima facie argument, namely re-identification over time. The inconsistency of the model is then seen to follow from application of the Fade Principle. Advantages of the model are stressed: including a simple explanation of the debilitating condition of akinetopsia, that is, motion blindness; and a suggestion as to how to account for the “moving now.”. This paper shows that, when the phenomenon of implicature is scrutinized, there is overwhelming reason to doubt that a Russellian analysis can succeed. A positive, non-Russellian analysis is proposed: it is shown that, if definite descriptions are treated as referring expressions, it is easy to deal with the referential-attributive distinction. The properly metaphysical dimension of Augustine's thought has received little special attention among scholars - even "Scholastics. " The Thomist metaphysicians - especially we "Anglo-Saxon" ones - receive first honors for being the most neglectful of all. Why? I t is a puzzling phenomenon particularly in the light of the fact (recognized by almost every Thomist) that the very existence of Thomas the theologian is inconceivable apart from his pre-eminent Christian mentor in the intellectual life, the Bishop of Hippo. (...) It is a puzzling phenomenon because, although the Christian metaphysics of Thomas Aquinas is not the Christian metaphysics of Augustine, these metaphysics could not be simply opposed to one another, else the theologies wherein they exercise the indispensable function of vital rational organs would themselves be discordant. But what respectable "Scholas tic" would deny that, in their essential teaching about God and the things of God, the thought of these two masters is remarkably congruent? May I suggest that one of the major reasons for this paradoxical neglect of Augustinian metaphysics on the part of Thomists (above all, in the English-speaking world) is their simplistic assumption that whereas Aquinas was an Aristotelian in phi losophy, Augustine was a Platonist, despite the fact that in theology they were substantially at one - as if there could be theological agreement, formally speaking, even where there is metaphysical disagreement, formally speaking. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Background In the context of discussions between supporters and opponents of euthanasia, and legal regulations regarding this type of practices, the attitude of young people with respect to this phenomenon is a very interesting issue. According to Polish law, euthanasia is prohibited. The aim of this study was to determine the degree of acceptance of euthanasia among students from Polish universities across three different fields of study: psychology, medicine, and economic-technical disciplines, and to identify the factors associated with the (...) acceptance of this phenomenon. Methods The study included 627 persons studying in Lublin, Poland: medicine (280), psychology (170), and economic-technical studies (177). The study was conducted as a survey using questionnaire containing items concerning students’ attitudes towards euthanasia. The analysis of the collected data was conducted using the SPSS software (version 29) with the following methods: Chi2, Student’s t-test, Phi test, Cramer’s V test, Kolmogorov-Smirnov test, one-way ANOVA with Dunnett’s post hoc test, linear regression analysis, and categorical regression analysis using optimal scaling (CATREG). Results Nearly half of the students participating in the study (45.9%) rated the practice of euthanasia as decidedly negative. The highest number of strongly negative evaluations was found among psychology students, and the least among students of economic-technical disciplines. The level of acceptance of euthanasia is significantly associated with religious involvement and studying psychology. Being religious and being a psychology student both contribute to lower acceptance of euthanasia and a lower willingness to consent to euthanasia. Consent to euthanasia is more commonly declared by individuals with experience of living with elderly people. Conclusions Although nearly half of the respondents expressed a negative attitude towards euthanasia, considering the secularization process among Polish youth, it can be assumed that the level of acceptance of euthanasia in this social group will increase. The lower level of acceptance of euthanasia among psychology and medical students compared to students of economic-technical disciplines suggests that the curricula of these studies present alternative solutions to the problems of terminally ill patients other than euthanasia. The catalyst is Moore’s Paradox: can a trans person coherently state ‘I am a girl but I don’t believe that’? More deeply, three fundamental philosophical questions arise, of ontological, epistemological, and conceptual significance: what Self understands that the natal-gender is ‘wrong’? How does the trans person know that the natal-gender is ‘wrong’ and what counts as evidence? And finally, how does this (...) effect the concept of Self itself? Seeking answers, Brakel considers various theories of the Self, including classical accounts, modern views, and models developed by selected gender theorists. The book then takes a biological turn, first developing an evolutionary proper-function analysis of gender and trans-gender and subsequently proposing the possibility of a new ontological phenotype. The serotonin transporter plays an important role in regulating serotonergic transmission via removal of serotonin from synaptic clefts. Alterations in 5-HTT expression and subsequent 5-HT transmission have been found to be associated with changes in behaviour, such as fearfulness or activity, in humans and other vertebrates. In humans, alterations in 5-HTT expression have been suggested to be able to lead to better learning performance, with more fearful persons being better at learning. Similar effects of the variation in the 5-HTT on (...) fearfulness have been found in chickens, and in this study, we investigated effects on learning. Therefore, we tested 52 adult laying hens, differing in their functional 5-HTT genotype in an operant learning paradigm in three different phases and in a tonic immobility test for fearfulness. We found that the 5-HTT polymorphism affects the initial learning performance of laying hens, with homogeneous wild-type hens being the slowest learners, and the most fearful birds. W/W hens, showed significantly more choices to solve the initial learning task and had the highest latencies in a tonic immobility test, indicating the highest fearfulness. Our results provide interesting first insights into the role of 5-HTT in chickens and its sensitive interaction with the environment. We further suggest that the 5-HTT gene can be an interesting target gene for future breeding strategies as well as for further experimental studies. (shrink)

Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. This paper investigates the alignment of business school curriculums with the Sustainable Development Goals, utilising a case study of Griffith Business School, Australia. The study utilises an audit of keywords to map content and concepts associated with the goals, targets and indicators of SDGs. The audit results revealed that although there was already considerable uptake of key SDGs concepts throughout the undergraduate programs, in particular Goal 16, there were some gaps. Feedback from teaching staff on the results was combined with (...) existing literature and industry/government approaches to offer considerations for future curriculum development that seeks to better integrate SDGs and sustainability. This work contributes to ongoing discussions about sustainability curriculum development and links previous research with the emerging SDG agenda in business schools. The practical nature of this research lends to direct transfer of method to other business schools who are wishing to map and develop their curriculum in relation to the SDGs. (shrink)

The nationwide economic reform in 1986 transformed Vietnam from a centrally planned economy to a socialist-oriented market economy. Entrepreneurs and entrepreneurial spirits within the populace are suggested to fuel the structural changes. Despite the importance of entrepreneurship in Vietnam’s economy, studies in Vietnam mainly pay attention to the practical aspects of entrepreneurial activities and neglect the cognitive and theoretical aspects of entrepreneurship. Thus, the current study employs the information-processing perspective of the Mindsponge Theory to explore how entrepreneurs’ knowledge accumulation can (...) affect their perceived likelihood of business success. Bayesian analysis indicates that business-related experience positively affects entrepreneurs’ business success likelihood. Greater willingness/readiness to transform thinking, acting, and beliefs can improve the business success of entrepreneurs who study others’ failures carefully. However, for entrepreneurs who perceive learning from others’ failures as unnecessary, higher willingness/readiness to transform diminishes their chance of success. Based on these findings, we recommend Vietnamese entrepreneurs accumulate knowledge through experience, learning, and an open mind for better decision-making and innovation creation capabilities. X-Phi and Theory Acceptance in Political Philosophy -/- What is the relevance of experimental philosophy (X-Phi) to theory acceptance in political philosophy? To answer this question, the paper distinguishes between four views, to wit: (i) X-Phi as a systematic method to avoid or reduce biases in our moral intuitions—The De-Biasing View; (ii) X-Phi as a tool for assessing the fruitfulness or consequences of various concepts—The Fruitfulness View; (iii) X-Phi as the best way to unearth the kind of moral principles we (...) are interested in as political philosophers—The Unearthing Principles View; and (iv) X-Phi as a way of testing the coherence of principles with folk intuitions—The Defeasible Reason (or Squatters’ Rights) View. The paper argues that the first two views and the last—subject to some clarifications—describe important X-Phi contributions to theory acceptance as this is traditionally understood within contemporary political philosophy. The rise of experimental philosophy has placed metaphilosophical questions, particularly those concerning concepts, at the center of philosophical attention. X-phi offers empirically rigorous methods for identifying conceptual content, but what exactly it contributes towards evaluating conceptual content remains unclear. We show how x-phi complements Rudolf Carnap’s underappreciated methodology for concept determination, explication. This clarifies and extends x-phi’s positive philosophical import, and also exhibits explication’s broad appeal. But there is a potential problem: Carnap’s account of explication was limited to empirical and (...) logical concepts, but many concepts of interest to philosophers are essentially normative. With formal epistemology as a case study, we show how x-phi assisted explication can apply to normative domains. (shrink)

One central purpose of Experimental Philosophy (hereafter, x-phi) is to criticize the alleged reliance on intuitions in contemporary philosophy. In my book Philosophy without Intuitions (hereafter, PWI), I argue that philosophers don’t rely on intuitions. If those arguments are good, experimental philosophy has been engaged in an attack on a strawman. The goal of this paper is to bolster the criticism of x-phi in the light of responses.

Contrary to adjectives like amusing and touching, certain Ving/ant adjectives have a psych reading without originating from a psych verb, such as jaw-dropping 'surprising' in English and marrant 'amusing' in French. It is a fact that emotions trigger certain characteristic physical effects. The verbs of such adjectives name that physical effect. This article claims that languages can, provided that independent grammatical conditions are respected, display constructs of that phy-inside-psych form, namely, a psych construct with an embedded V naming the physical (...) effect triggered by the psych cause. This articles deals with such adjectives in two different languages, showing similarities and differences due to their particular grammar, and it offers an original analysis of effing adjectives along those lines. Using two decades worth of experimental philosophy (aka x-phi), Edouard Machery argues in Philosophy within its Proper Bounds (OUP, 2017) that philosophers’ use of the “method of cases” is unreliable because it has a strong tendency to elicit different intuitive responses from non-philosophers. And because, as Machery argues, appealing to such cases is usually the only way for philosophers to acquire the kind of knowledge they seek, an extensive philosophical skepticism follows. I argue that Machery’s “Unreliability” argument fails because, once (...) its premises are percisified, they are either self-defeating or without justification. This is a significant result because Machery’s arguments are the most widely cited and discussed x-phi arguments for philosophical skepticism and many hold that Machery provides the most empirically informed, convincing, and thus best case for this kind of skepticism. So, if my arguments are sound, then the best x-phi argument for philosophical skepticism fails. I further argue that this result provides strong reason to believe the more general conclusion that “negative” x-phi is likely doomed: x-phi likely can never support a substantive philosophical skepticism. Ultimately, I argue for the broad conclusion that all empirically minded arguments for philosophical skepticism are likely to fail for the same reasons that Machery’s does, i.e. they are (likely) self-defeating. In this article, we analyse the evidential value of the corpus of experimental philosophy. While experimental philosophers claim that their studies provide insight into philosophical problems, some philosophers and psychologists have expressed concerns that the findings from these studies lack evidential value. Barriers to evidential value include selection bias and p-hacking. To find out whether the significant findings in x-phi papers result from selection bias or p-hacking, we applied a p-curve analysis to a corpus of 365 x-phi chapters and articles. (...) Our results suggest that this corpus has evidential value, although there are hints of p-hacking in a few parts of the x-phi corpus. (shrink)
