Do the various ascriptions of “violence,” e.g., to rape, logical reasoning, racist legislation, unqualified statements, institutions of class and/or gender inequity, etc., mean something identically the same, something analogous, or equivocal and context-bound? This paper argues for both an analogous sense as well as an exemplary essence and finds support in Aristotle’s theory of anger as, as Sokolowski has put it, a form of moral annihilation, culminating in a level of rage that crosses a threshold. Here we adopt (...) Sartre’s analysis of the “threshold of violence” as indicating a basic “existential” possibility wherein persons may and do adopt a posture of anti-god. This has considerable symmetry with the mythic and theological figure in the Abrahamic religions who is called “Lucifer.” This personage, at a unique timeless moment, found himself empowered to assume the right to exercise an infinite will-act which tolerated no superior normative perspective. I argue that this mythic stance is a live option for persons. Further, modern day nation-state military preparedness, where nuclear weaponry is a major tool of foreign policy, is a way of putting on ice and holding in reserve, but button ready, the onto-logical madness of the Luciferian moment. Recent years have witnessed growing concerns about how we should conduct conservation activities in a world of human-altered biophysical conditions. The ‘novel ecosystems’ perspective has emerged as a way to meet this challenge. Yet its focus on accepting ‘new natures’ as the ‘new normal’ has drawn much criticism from those wedded to conventional forms of conservation, such as ‘ecological restoration’. This paper: 1) provides a much needed review of this dispute; 2) formulates and deploys an original analytical framework, which draws (...) on Thomas Kuhn's ‘theoretical history’ of science and Charles Taylor's moral philosophy to extricate the entangled moral and material ontologies of nature which conflate facts with values in the world-building activities of disputants; and 3) identifies and examines the processes underlying these world-building activities. The paper closes by offering an initial suggestion on how to explore options for resolving this highly contentious debate. (shrink)

This is the first book that pays systematic attention to ontological issues impinging on this question.

The first part of this article presents Ricœur's hermeneutics as a method, a style of writing and a particular philosophy. As a method, Ricœur revisits the notion of traditions and interpretations, in order to keep them open to debts from the past, to unexplored sources, to creative imagination and to the critical search for meaning. It is a style of writing, constantly put in dialogue with the history of philosophy which aims at unpacking a diversity of meanings. It is also (...) a philosophy in itself, a phenomenological hermeneutics of the self who is capable and suffering, although the Cogito is shattered and cannot pretend to immediacy and thus needs mediations. Such an hermeneutics is also tied to a new interpretation of ontology of being as capacity and actualization. The meanings of the other are discussed, as well as the notion of narrative identity for Ricœur's hermeneutics. In the second part of the article, the author highlights how this hermeneutics remains tied to the search for the originary and for universals, and is animated by the constant ethical demand of respect of the singularity of each person. This is why the notion of trust plays a particular role, as well as the dialogue with Levinas. The author thus revisits the important aspects of Ricœur's Little Ethics, and its distanciation from Sartre's voluntarist existential project. It is shown that beyond interpretations, a critique of ideologies remains necessary, as well as the demand for an ethics, a morality, and a judgment in situation. (shrink)

Tadeusz Kotarbinski is one of towering figures in contemporary Polish philosophy. He was a great thinker, a great teacher, a great organizer of philosophical and scientific life, and, last but not least, a great moral authority. He died at the age of 96 on October 3, 1981. Kotarbinski was active in almost all branches of philosophy. He made many significant contributions to logic, semantics, ontology, epistemology, history of philosophy, and ethics. He created a new field, namely praxiology. Thus, using (...) an ancient distinction, he contributed to theoretical as well as practical philoso~hy. Kotarbinski regarded praxiology as his major philosophical "child". Doubtless, praxiology belongs to practical philosophy. This collection, howewer, is mainly devoted to Kotarbinski' s theoretical philosophy. Reism - Kotarbinski' s fundamental idea of ontology and semantics - is the central topic of most papers included here; even Pszczolowski' s essay on praxiology considers its ontological basis.,Only two papers, namely that of Zarnecka-Bialy and that of Wolenski, are not linked with reism. However, both fall under the general label "Kotarbinski: logic, semantics and ontology". The collection partly consists of earlier published papers. (shrink)

Human embryonic moral status in the embryo debate in the Indian religious school of thoughts is a challenging issue. The paper tries to figure out whether ontological status implies moral status of embryo. Consciousness is an important determinant of animation of human embryo. In this paper an attempt had been made to understand the concept of man and soul in the Hindu philosophical thought. In the process we would also make a critical review of embryology in the (...) Hindu philosophical thought. The study would adopt a conceptual elucidation of morality. The paper made an elaborative study of Puruṣa as found in the Saṃkhya Philosophy and the study of consciousness and animation would try to resolve the related question, when does life begin to have that value? Embryo-protectionist regards embryos as a potential person. The Gita says the human person is individual self-called āttmā, whose nature is of pure consciousness, Brahman/Puruṣa. Consciousness constitutes the essentiality of individual Self. Human embryo developments are elaborately studied in the Yajñavalkya Smṛti, Garbha Upaniṣad, and Suśruta Saṃhitā. The self that remain latent in the embryo gets impetus with the association of consciousness until then it cannot be a human personality. In Hinduism sanctity of life gets combined with autonomy and self-determination. The sanctity of life applies both to the fetus as well as to the overall welfare of the society. The embryo being in an interim stage and the soul not being destroyed upon body annihilation, it may be claimed that since destruction or annihilation of the physical form does not destroy the soul, beneficial embryo research should thus not be abhorrent. The Hindu ethics as examined here precludes the consideration of the situation at hand, and causing the least harm and work according to one’s dharma. (shrink)

In this essay we will try to highlight the interweaving of language and morality and also the principle of legitimacy that derives from it. In her famous essay Modern Moral Philosophy (written in 1958 and which later became the modern manifesto of a neo-Aristotelian type of ethics), Elizabeth Anscombe highlights the need for a philosophy of psychology as well as the abandonment of a specific language in moral philosophy. Taking a position against the consequentialist conception of morality, she (...) implicitly stands opposed to the principle that conse- quences define legitimacy; it is precisely when the binomial language-morality fails that the principle of legitimacy loses its substance; a political authority can lose its moral legitimacy if she/he betrays the common good. Starting from a specific language adopted, a morality is derived from it. In fact, depending on what is considered to be a good or an evil, a specific moral action follows. In this perspective, responsibility and awareness of which goods need to be shared in common play a central role, and an ontological foundation is discovered. (shrink)

When answering questions about moral responsibility, many theories rely on answers to questions about the nature of agency and agents, the persistence of persons and the existence and nature of free will. In recent work in social ontology, philosophers have argued for views of social categories or identities that take ethical (...) and social–political desiderata into consideration in several ways. Some argue for views of gender identities that depend on epistemic and ethical considerations (Bettcher, 2009). Others develop views of gender categories in ways they take to be metaphysically realist, tracking robust explanatory patterns in the world. For instance, Barnes (2017) argues for this interpretation of Haslanger’s views of racial and gender categories. Others argue that injustice and oppression are reflected in the nature of social categories. For instance, while it ought not to be this way, some gender categories are, for instance, trans-exclusionary (Ásta 2018). Indeed, one might even argue that social categories can involve a distinctively metaphysical form of oppression (Jenkins 2020, 2023). This paper concerns the role of the transcendental distinction between agents qua phenomena and qua noumena in Kant's theory of free will. It argues (1) that Kant's incompatibilism can be accommodated if one accepts the "ontological" interpretation of this distinction (i.e. the view that agents qua noumena are ontologically prior to agents qua phenomena), and (2) that Kant's incompatibilism cannot be accommodated by the "two-aspect" interpretation, whose defining feature is the rejection of the ontological priority of agents qua (...) noumena. The ontological interpretation allows Kant to be an incompatibilist because the ontological priority of agents qua noumena "ontologically undermines" the significance of phenomenal determinism for agents' free will. That is, since agents qua noumena are ontologically prior to agents qua phenomena, the fact that agents qua noumena are not subject to determinism is more fundamental than the fact that agents qua phenomena are subject to determinism, and it is the more fundamental fact that we should be concerned with in the metaphysical foundations of moral responsibility. Recent (independent) work by myself, Eric Watkins, and Robert Hanna is drawn on to demonstrate that the ontological interpretation can mount a better defense against some traditional objections than has often been thought. -/- According to the two-aspect interpretation, the transcendental distinction between agents qua noumena and qua phenomena is a semantic and epistemological distinction. Since it rejects the ontological priority of noumena, it has no way to assert that the non-determinism of agents qua noumena is more metaphysically fundamental than the determinism of agents qua phenomena. For the two-aspect interpretation, the truth of determinism must remain just as fundamental as the truth of any other characterization of agents. This means that, on the two-aspect interpretation, there is no better reason to call Kant an incompatibilist than there is to call him a compatibilist. Since Henry Allison has presented the most detailed two-aspect interpretation of the agential transcendental distinction, the arguments against the two-aspect distinction address his interpretation. Part of Allison's strategy is to argue that phenomenal determinism poses less of a problem for free will if we accept his accounts of the Second Analogy and empirical psychology. This book offers comparative ontologies of both Islam and liberalism as discourses more broadly construed. The author argues that, despite recent efforts to speak of overlapping consensuses and discursive congruence, the fundamental categories that constitute 'Islam' and 'Liberalism' remain very different, and that these differences should be taken seriously. Thus far, no recent scholarly works have explicitly or meticulously broken down where these differences lie. The author rigorously explores questions related to rights, moral epistemologies, the role of religion in (...) the public sphere, and more general approaches to legal discourse, via primary and canonical sources constitutive of both Islam and liberalism. He then goes on to articulate why communitarian modes of thought are better suited for engaging with Islam and contemporary socio-political modes of organization than liberalism. The inherent normativity of HTA can be conceptualized as a result of normative commitments, a concept that we further specify to encompass moral, epistemological and ontological commitments at play in the practice of HTA. Based on examples from literature, and an analysis of the example of assessing Non-Invasive Prenatal Testing (NIPT), we will show that inevitable normative decisions in conducting an assessment commits the HTA practitioner to moral (regarding what makes a health technology desirable), ontological (regarding (...) which effects of health technology are conceivable), and epistemological (regarding how to obtain reliable information about health technology) norms. This highlights and supports the need for integrating normative analysis and stakeholder participation, providing guidance to HTA practitioners when making normative choices. This will foster a shared understanding between those who conduct, use, or are impacted by assessments regarding what are conceivable and desirable outcomes of using health technology, and how to collect reliable information to assess whether these outcomes are (going to be) realized. This book is yet another in the recent growth of studies of Kant’s "investigation and establishment of the supreme principle of morality." Its aim is stated in the subtitle and again in a number of variations throughout the book. The author examines and objects to the intrusion of Kant’s "official metaphysics" in what he believes is intended to be, but does not succeed in being, a guide to action. He deplores Kant’s unawareness that he was, in fact, a utilitarian. He (...) argues that Kant’s and all rationalistic ethics are teleological. Along the way he confuses Kant’s carefully distinguished supreme good and complete good and ignores—in good part by omitting considerations of the third section of the Groundwork—Kant’s identification of pure practical reason and the good will. Nevertheless, there are some virtues to this study: the analysis of the language of major passages of the first two sections of the Groundwork and, more effective, the presentation of the author’s own view, in the final thirty pages, of the notion of man as an end in himself; this is a view which Hutchings thinks Kant should have had but also one which many readers have long since attributed to him. Drawing on a formal model of reflexive consciousness, the author examines the causative relationship between logic, morality and conscious agency, which renders morality ‘realist’ in the sense that our actions have inescapable consequences for our capacities as agent. By means of comparison between Lao Tzu’s theory of Tao in ancient China and the concept of metaphysics originated from ancient Greece, the author redefined the concept of “form” and therefore, elaborated the meaning of metaphysics from its Chinese translation. According to the author’s re-interpretation of Tao Te Ching, Lao Tzu had resolved the ontological questions in a different way with that of ancient Greek philosophers, and he had answered the question of “One and Many”. In the past, people (...) had omitted the fact that there are actually two different “ones” in this question, and hence, metaphysics and ontology had been remained in a confused state. By giving an example in natural science, the author had illustrated clearly what is the metaphysical Tao, and then extendedthe idea to metaphysics of morals. As a conclusion, the author suggests that it is better to use a new term to replace the imperfectly defined “metaphysics”, for example, metaformology. (shrink)

Although scientific naturalistic philosophers have been concerned with the role of scientific psychology in illuminating problems in moral psychology, they have paid less attention to the contributions that it might make to issues of moral ontology. In this paper, I illustrate how findings in moral developmental psychology illuminate and advance the discussion of a long-standing issue in moral ontology, that of moral realism. To do this, I examine Gilbert Harman and Nicholas Sturgeon's discussion of that (...) issue. I contend that their explorations leave the issue unresolved. To break the stalemate, I appeal to empirical psychological findings about moral internalization—the process by which children acquire the capacity to act in terms of moral norms. I contend that these findings illuminate the issue, suggest a way to advance it, and tend to support a moral realist position. (shrink)

Starting with the point of freedom being one of unavoidable ideas of existential philosophy, as well as philosophy in general, we shall consider ethical and ontological aspects of contemplation of freedom in Kierkegaard’s philosophy. We deem that existential philosophy, “contemplated” in all its variations, represents the very horizon or manner of philosophical comprehension of freedom phenomena, where freedom is integrally observed, thus allowing us to talk about unique bliss of ontological and ethical dimension, both of those appearing to (...) be equally important. Therefore, freedom dominates the Kierkegaard’s determination of individual, co-determines all its leap stages but also continually makes possible the sense of human existence. (shrink)

Gene patenting was enabled by strained interpretations of legal precedent and with very little consideration of its ultimate ethical implications. The sciences of justice, ethics, and morals remain in their dark ages, with their practitioners all ascribing to differing values and modes of inquiry, besieged in their various camps of deontological, or consequentialist, or emotive or theistic dogmas. Ownership and property rights in moveables are good candidates for grounded relations as opposed to intellectual property. The groundedness of a valid possession (...) rests on the intentional state of the possessor and other external and objective facts of the possession. The ontology of the social and legal institution of ownership reveals that it is grounded in certain states of affairs, such as brute‐worldly facts and intentional states, as well as social acts revealing intentions of the parties. Designing an ontology that meets the needs of end-users, e.g., a medical team, is critical to support the reasoning with data. Therefore, an ontology design should be driven by the constant and efficient validation of end-users needs. However, there is not an existing standard process in knowledge engineering that guides the ontology design with the required quality. There are several ontology design processes, which range from iterative to sequential, but they fail to ensure the practical application of an ontology and (...) to quantitatively validate end-user requirements through the evolution of an ontology. In this paper, an ontology design process is proposed, which is driven by end-user requirements, defined as Competency Questions (CQs). The process is called CQ-Driven Ontology DEsign Process (CODEP) and it includes activities that validate and verify the incremental design of an ontology through metrics based on defined CQs. CODEP has also been applied in the design and development of an ontology in the context of a Mexican Hospital for supporting Neurologist specialists. The specialists were involved, during the application of CODEP, in collecting quality measurements and validating the ontology increments. This application can demonstrate the feasibility of CODEP to deliver ontologies with similar requirements in other contexts. (shrink)

According to recent suggestions within the global pragmatism discussion, metaethical debate must be fundamentally re-framed. Instead of carving out metaethical differences in representational terms, it has been argued that metaethics should be given an inferentialist footing. In this paper, I put inferentialist metaethics to the test by subjecting it to the following two criteria for success: Inferentialist metaethicists must be able to save the metaethical differences between moral realism and expressivism, and do so in a way that employs understandings (...) of these metaethical accounts which would be acceptable to moral realists or expressivists who endorse an inferentialist theory of meaning. Two results follow from my discussion. The first concerns inferentialist metaethics more narrowly, casting doubts on inferentialists’ ability to fulfil the two criteria for success by showing that proposed metaethical demarcation attempts either meet the first criterion but violate the second, or pass the second criterion but fail the first. The second upshot pertains to the global pragmatism debate more widely, pressing the point that inferentialists have not as yet provided a convincing account of ontological commitment. (shrink)

Through the concept of enjoyment in Levinas, this paper examines the phenomenological and ontological dimension of everyday aesthetics. Enjoyment, in Levinas, forms an essential element in the constitution of the subjectivity of the human being and is no longer to be seen as a moment of ‘inauthenticity’ or ‘alienation’. The experience of the objects of everyday experience is not related to that of objects of representation or of tools, but rather to that of a system of nourishment into which (...) the subject is integrated, as in an ‘element’ or ‘atmosphere’. This constitutive closeness of enjoyment indicates the fundamental difference between what we understand as everyday aesthetics and other aesthetics characterised by contemplation or disinterest. Atheist Michael Martin’s book ’Atheism, Morality, and Meaning’ attempts to defend the possibility of a naturalistic basis for morality and meaning; God (particularly the Christian God) is unnecessary to ground meaning, ethics, rights, moral obligation and motivation. Martin’s flawed arguments rely heavily on epistemological criteria rather than on (the far more critical) ontological grounding: why think personhood, obligation, and objective moral values should emerge from mindless, impersonal valueless processes? Martin’s arguments regarding Christian ethics, salvation, and atonement are (...) problematic in various ways. A biblical ethic offers rich resources for human rights and responsibility and can readily withstand Martin’s criticisms. (shrink)

The philosophy of history of 1804 and 1805 enables Fichte to place his natural right, developed previously at Jena, against a diachronic background. This means that Fichte does not reason merely synchronically from a timeless conception of society and state. From a synchronic viewpoint, Fichte cannot solve the problem of the control of political power because he has to draw on the assumption of a virtuous ephorate. This assumption is not consistent with the Fichtean ideal of a philosophy of right (...) completely independent from moral considerations. Thus, the control of government is possible only if at least a group of citizens can go beyond the mere rational egoism. This new temporal conception of the state leads Fichte to think that the problems of consistency of his theory of Jena are unavoidable, given that a society integrated by egoist individuals cannot be sustained. However, his later philosophy of history enables Fichte to state the inexorable annihilation of this type of community and gives place to an ensuing epoch, when citizens are not self-interested anymore. In response to comments on my book, Being Realistic about Reasons, by Justin Clarke-Doane, David Enoch and Tristram McPherson, and Gideon Rosen, I try to clarify my domain-based view of ontology, my understanding of the epistemology of normative judgments, and my interpretation of the phenomenon of supervenience.

The paper examines two forms of naturalistic moral realism, “Micro-structure realism” and “Reason realism” . The latter, as we defend it, locates the objectivity of moral facts in socially constructed reality, but the former, as exemplified by David Brink\'s model of naturalistic moral realism, secures the objectivity of moral facts in their micro- structure and a nomic supervenience relationship. We find MSR\'s parity argument for this account of moral facts implausible; it yields a relation ship (...) between moral facts and their natural- scientific constitution that has a queer, slapped- together quality. We argue that the relationship needs to be spelled out by a process of social construction, involving collective intentionality and constitutive rules. We explain how our constructivist model of RR differs from a form of it defended by Michael Smith , which analyzes moral facts by reference not to construction but rather to a hypothetical situation of full rationality. We agree with Smith, as against Bernard Williams, that a rational agent may have reasons for acting that go beyond the agent\'s “subjective motivational set,” but we locate such reasons by reference to the agent\'s member ship in an actual community, and we explore the prospects for moral objectivity given this constraint on moral reasons. RESUMEN Contra el esencialismo de las concepciones de la justicia social como desarrollo, se sostiene que los bienes se configuran siempre en relaciones recíprocas, nunca de manera objetiva e impersonal. El núcleo deontológico de la moral reside en la crítica de las formas de actuary reposa en una ontología natural, mientras que el amplio conjunto de creencias normativas que llamamos ética se basa en la crítica de los bienes y presupone una ontología dialéctica. Revelar que toda cosa buena es (...) ambivalente, es la forma ética -y antigua- de reflexión práctica. La formación de bienes, fines y valores razonables acontece en el terreno de los intercambios recíprocos. ABSTRACT Against the essentialism of the conceptions of social justice as development, the article argues that goods are always shaped by reciprocal relations and never in an objective and impersonal manner. The deontological core of morality resides in the critique of the ways of acting grounded in a natural ontology, while the broad set of normative beliefs that we call ethics is based on the critique of goods and presupposes a dialectical ontology. Revealing that any good thing is ambivalent is the ethical -and ancient- form of practical reflection. The formation of reasonable goods, ends, and values takes place in the field of reciprocal interchange. (shrink)

On the powerful qualities view, every fundamental property is both dispositional and qualitative. Identity theory is the standard account of the view, which makes the stronger claim that a property’s dispositionality and qualitativity are identical to each other, and identical to the property itself. Recent defences of the powerful qualities view have involved novel theories of powerful qualities which are not also variants of identity theory. Giannotti (Erkenntnis 86:603–621, 2021a) has suggested a novel theory of his own, the dual aspect (...) account, which makes use of a particular notion of aspects. For Giannotti, dispositionality and qualitativity are each an aspect of a property, and an aspect is a property’s way of being. The importance of aspects is twofold. Firstly, by introducing aspects to identity theory, the theory becomes more precise. Secondly, aspects allow for a novel theory of powerful qualities, the dual aspect account, which maintains that dispositionality and qualitativity are aspects, but rejects the identity claim. Giannotti’s aim is to show that even if identity theory is false, the dual aspect account remains an available theory for advocates of powerful qualities. This paper will be a critical examination of Giannotti’s ideas. Firstly, I will clarify Giannotti’s notion of aspects, explaining how it involves a misunderstanding of supervenience, and why it does not offer the advantages that he claims it does. Secondly, in light of my discussion of aspects, I will argue that the dual aspect account lacks relative advantages over the compound view of powerful qualities. (shrink)

This article is concerned with two interrelated questions: what, if anything, distinguishes synthetic from natural organisms, and to what extent, if any, creating the former is of moral significance. These are ontological and ethical questions, respectively. As the title indicates, I address both from a broadly neo-Aristotelian perspective, i.e. a teleological philosophy of life and virtue ethics. For brevity’s sake, I shall not argue for either philosophical position at length, but instead hope to demonstrate their legitimacy through their (...) explanatory power. I firstly argue that synthetic organisms differ in kind from natural organisms and machines, and differ only by degree from genetically modified organisms. I then suggest that this is nevertheless sufficient to give us specific ethical reservations about synthetic biology: namely, that more than any other widely used biotechnology, it is characterised by a drive to mastery that stands opposed to due appreciation of the giftedness of life. Étienne Souriau was a refined and demanding thinker, with an aristocratic demeanour, far removed from the currents of ideas dominant in his time. A difficult and erudite author, out of tune with the times he lived in, he would seem the least likely candidate to appeal to a hurried and globalised public like that of the twenty-first century. A sophisticated representative of a rationalist positivism, no stranger to the Husserlian canon and not even insensitive to the motivations dear to the (...) gnoseological debate of Cartesian and Kantian matrix (as well as to the major themes of classical metaphysics), Souriau pursues the ideal of a constructive philosophy, capable of understanding – and at the same time favouring – the advancement of the creative process conceived as a set of poetic acts and progressive dynamic operations. In his texts, Souriau is attentive to grasping the correspondences, exchanges and reciprocal transitions between one mode of existence and another, as well as the resonances between the various art forms in the different fields of knowledge, testing an original method that is epistemologically very fruitful. The aim of this monographic issue of Aisthesis dedicated to Étienne Souriau is to explore his thought in its multiple aspects, in order to measure its topicality in relation to the themes and problems that characterise contemporary philosophical debate, with particular reference to aesthetics and ontology as well as to the dense network of connections between the two fields. One of the most interesting characteristics of Souriau’s thought that has stood the test of time would appear to be its multifacetedness: the quality of lending itself to being applied even to spheres that are apparently very distant from reflection on art, such as cultural anthropology, political philosophy or morality. It seemed to us that it largely owes its relevance precisely to the intersections between one field of knowledge and another. The issue contains twelve contributions on Souriau that explore his main aspects in depth. They range from analyses devoted to the architecture of Souriau’s thought (his general philosophy) in the essays by Dominique Chateau and Filippo Domenicali, which can furnish a useful overall picture of the man, to essays that attempt to focus on the more properly ontological core of this thought, such as those devoted to the arabesque motif (Luigi Azzariti-Fumaroli), the theory of the soul (Sjoerd Van Tuinen) or the multiplicity of worlds (Noëlie Plé). Interspersed between these are contributions that focus more on the comparison between Étienne Souriau’s thought and the philosophers of his time, such as Dufrenne (Maryvonne Saison), or with well-known later philosophers who explicitly referred to him, prolonging his creative impetus, such as Gilles Deleuze (Casey Boyle) and Bruno Latour (Aline Wiame), the true architect of the current Souriau “comeback”. Finally, in addition to essays of a more theoretical nature, there are contributions that attempt to re-evaluate certain aspects of Souriau’s aesthetics, such as the fruitfulness of the cues that can come from his thought for the debate on animal aesthetics (Maddalena Mazzocut-Mis and Andrea Scanziani), or the possible topicality of his theory of forms (Isabelle Rieusset-Lemarie). In the “Miscellaneous” section, this issue hosts a number of studies that aim to explore the aesthetic implications of new technologies, the themes of ecological aesthetics, as well as to offer an unusual profile of Baumgarten. In recent years, William Lane Craig has vigorously championed a moral argument for God's existence. The backbone of Craig's argument is the claim that only God can provide a ' sound foundation in reality' for morality. The present article has three principal aims. The first is to interpret and clarify the account of the ontological foundation of morality proposed by Craig. The second is to press home an important objection to that account. In this paper, we establish gastrospaces as a subject of philosophical inquiry and an item for policy agendas. We first explain their political value, as key sites where members of liberal democratic societies can develop the capacity for a sense of justice and the capacity to form, revise, and pursue a conception of the good. Integrating political philosophy with analytic ontology, we then unfold a theoretical framework for gastrospaces: first, we show the limits of the concept of “third place;” second, (...) we lay out the foundations for an ontological model of gastrospaces; third, we introduce five features of gastrospaces that connect their ontology with their political value and with the realization of justice goals. We conclude by briefly illustrating three potential levels of intervention concerning the design, use, and modification of gastrospaces: institutions, keepers, and users. (shrink)

When Saint Thomas Aquinas makes claims such as “that which is not just seems to be no law at all” it is a bit difficult to discern what he means. Some think that Aquinas is defending what is now called the Strong Natural Law Thesis: for all X, X is a law only if X is just. Others think that Aquinas is defending what is now called the Weak Natural Law Thesis: for all X, X is a non-defective law only (...) if X is just. In this paper, focusing on Aquinas’s metaphysics, I argue that both of these interpretations are mistaken. Aquinas is primarily defending what we can call The Metaphysical Natural Law Thesis: since being and goodness are convertible, legal validity comes in degrees—and this entails that the justice of a law literally increases the amount of being a law possesses, while the injustice of a law literally decreases the amount of being a law possesses. On this interpretation, then, the injustice of a law entails an ontological attenuation of the law without entailing an ontological annihilation of the law. (shrink)

This paper develops a Kantian account of the moral assessment of institutions. The problem I address is this: while a deontological theory may find that some legal institutions are required by justice, it is not obvious how such a theory can assess institutions not strictly required (or prohibited) by justice. As a starting-point, I consider intuitions that in some cases it is desirable to attribute non-consequentialist moral value to institutions not required by justice. I will argue that neither (...) consequentialist nor virtue-ethical accounts account for these intuitions, suggesting that a distinctive deontological account is needed. The account I give is drawn from Kant’s Metaphysics of Morals; I distinguish it from Kantian views of institutions developed by Barbara Herman and Onora O’Neill. This essay aims to broaden the understanding of the nature of the physician–patient relationship. To do so, the concept of medical philia that Pedro Laín Entralgo proposes is analysed and is considered taking into consideration the relational trait of the human being and the structure of human action as a story of the permanent tension that exists between freedom and truth, where the ontological foundation of the hermeneutic of the "Gift" and the analogy of “Love” as the central dynamic (...) of this action, helps explain the nature of the doctor-patient relationship as a "friendship relationship". This understanding offers a perspective differing from just the utilitarian considerations of current "patient-centred" approaches and proposed the redirection of the teaching of medicine to more humanistic approaches. The dynamic of the doctor-patient relationship proposed here in its most genuine essence is effectively expressed in physician concrete attitudes that the patient usually captures and relates as the “the doctor’s way of being”. Goya's painting, Self-portrait with Dr Arrieta (1820), can be taken as an outstanding artistic representation of this expanded dimension of the medical act, capturing the “medical friendship” in action. This work seeks to develop a Kantian ethical theory in terms of a general ontology of values and norms together with a metaphysics of the person that makes sense of this ontology. It takes as its starting point Kant’s assertion that a good will is the only thing that has an unconditioned value and his accompanying view that the highest good consists in virtue and happiness in proportion to virtue. The soundness of Kant’s position on the value of the good (...) will is defended against criticisms directed against it by G. E. Moore and it is argued that there is an ambiguity in Moore’s notion of ‘intrinsic value’ that makes him unable to fully understand and appreciate the Kantian view. It is also argued that the special value of moral goodness has been unduly neglected in modern moral philosophy, even by those working in the Kantian tradition, and it is suggested that the possibility of a Kantian ethical theory centred on the notion of the highest good remains to be explored. In order to lay the ground for such a theory a Kantian approach to reasons for action and the metaphysics of the person is developed and defended, albeit in a way that, in contrast to Kant himself, emphasizes the social dimension inherent in being a person and acting on reasons. It is also argued that there exists what Henry Sidgwick has called a dualism of practical reason, which means that there are two systematic modes, the self-interested and the moral, of approaching action. These two modes correspond to the two components of the highest good as understood by Kant and it is argued that the highest good represents a reasonable way of unifying them. These two parts of the highest good are then considered, each in turn, and Kantian models for understanding them are elaborated and defended against main rivals. On the matter of happiness, it is argued that standard philosophical theories fail to properly account for the way in which a subject’s own opinions about what constitutes her happiness are important in determining where her happiness actually lies. On the matter of morality, Kantianism is contrasted with consequentialism, the other leading theory that understands morality in terms of an ideal of impartiality and it is argued that the Kantian ideal, which can be called ‘impartiality as universalizability’ is superior to the consequentialist one, which can be called ‘impartiality as impersonality’. A version of Kantian ethics that places its emphasis on the Formula of Universal Law is then elaborated and it is argued that it is reasonable to understand maxims, or at least those maxims eligible for the universalizability test, as having to do with the basic general principles according to which we live. This kind of interpretation creates a large room for the exercise of judgment on the part of the agent and it is suggested that the standards according to which such judgment is exercised are largely determined through our actual moral practices and discourses.
