The question is: How is a global peace order possible in the shape of an international legal system? The article focuses on the problems of international law within the present system of the UN and tries to actualise the Kantian concept of perpetual peace (1795), with regard to positions of international lawyers. A peaceful international order must have the means to protect against unlawful violence, even by armed forces, e.g. to intervene against gross violations of fundamental (...) human rights. It is necessary that even the great powers are obliged to act only within this legal framework. This collection of eleven essays, the second volume edited for the Society of Philosophy and Public Affairs, attempts to bring philosophical scrutiny to bear on the intersection, if any, of morality and international conduct. The book’s premise is that "the efficacy of reasoned criticism, even if slight, cannot be neglected". Hence these essays "are written not merely to help us understand the political world but to suggest changes in it". There is, however, little agreement beyond this point. (...) Contributors disagree, for example, whether current laws of war are coherent and morally adequate, whether any clear meaning or value can be assigned to "national self-determination," and who or what, if anything, is responsible for genocide in Vietnam—if, indeed, that is what has occurred. But disagreement does not detract from the worth of this volume. ABSTRACT The individual-community relationship has always been one of the most fundamental topics of social sciences. In sociology, this is known as the micro-macro relationship while in economics it refers to the processes, through which, individual actions lead to macroeconomic phenomena. Based on philosophical discourse and systems theory, many sociologists even use the term "emergence" in their understanding of micro-macro relationship, which refers to collective phenomena that are created by the cooperation of individuals, but cannot be reduced to individual actions. (...) "Emergence" theories attempt to explain the nature of society as a complex system by examining how individuals and their relationships lead to the creation of integrated and macro-social phenomena such as markets, educational systems, cultural beliefs, and shared social practices. As a prelude to activity, every researcher has to answer the question from the methodological point of view, how is it possible to study the behavior of social groups and how can we gain knowledge about the laws related to social groups? Anyone who deals with humanities and social sciences or any reality and phenomenon that affects human beings, inevitably deals with the reality that is emerging. In fact, emergence occurs when one level of reality emerges radically from another level. Examples of emergent levels of reality include how the mind emerges from the body; or the way society emerges from human beings. Therefore, when there is an emerging factor, different scientific disciplines should be used, because it is inevitable to talk about social affairs, psychology and neurobiology, as well as physical and even chemical. -/- INTRODUCTION Since its beginning in the 19th century, sociology has faced the fundamental question of what a social phenomena stands for? At a glance, sociologists deal with the study of social groups, collective behavior, institutions, social structures, social networks, and social dynamics, and ultimately all such phenomena are composed of individuals. Therefore, social phenomena seem to have no independent ontological status, and in this case, sociology is ultimately about reducible individuals. Different approaches about the micro-macro relationship, using the concept of "emergence", argue that although collective phenomena are created by individuals, they cannot be reduced to individual action. The term "emergence" is used to distinguish "emergent results" from " Procedural results". Results are called Procedural that can only be calculated by adding or subtracting the causes that act together. On the contrary, they are emergent outcomes that are qualitatively novel compared to the causes from which they originate. An example of such emergent results is mental characteristics that emerge from neural processes, but are not considered among the characteristics of neural processes of components - which are their origin. Philosophical debates about emergentism and reductionism focus on the mind-brain relationship, but as many philosophers have noted, they can be generalized to apply to any hierarchical set of features. The cognitive revolution reactivated a 19th century controversy between theorists of Identity and dualism. The theorists of Identity believe in reductionist materialism and elimination of metaphysics, according to which the mind is nothing more than the biological, while the dualists believe that the mind and the brain are distinct from each other. Emergence has been considered as a third way between the theories of Identity and dualism. -/- METHODOLOGY Interdisciplinarity Is fundamentally indicated by the dominance of open systems as well as social and emerging systems at different levels. Therefore, as long as we are facing a new emergentism, there will necessarily be different fields and an interdisciplinary method. The commonality of social sciences and cognitive sciences on the issue of emergence provides the possibility of interaction and exchange of concepts between these two for deeper research. Therefore, in this research, apart from the concepts of Subvenience and downward causation, we have used multiple realization and wildly disjunctive, which are used to explain the emerging concept in cognitive sciences, including neurobiology, psychology, and philosophy. For analytical and interdisciplinary approaches, after examining the concepts of subvenience, and wildly disjunctive, Individualistic and collectivist emergentism have been reviewed. And then their adequacy is criticized and evaluated in meeting strong emergence conditions. -/- FINDINGS Philosophers of the mind have been able to define the conditions of irreducibility and downward causation, which are essential for strong emergence, by using the principle of subvenience with the help of multiple realization and wildly disjunctive principles. Therefore, by definition, emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and emergentist collectivism faces the challenge of reification. The analysis of the challenges facing the two methodological approaches of individualism and collectivism leads us to three unresolved issues about the emerging phenomenon, which are realism, downward causality, and mechanism. Despite the differences in the stances of these two approaches regarding the aforementioned triple problems, individualists and collectivists both agree that some social characteristics are reducible; and some others are irreducible due to their complexity, the determination of which, depends on the case study of the mechanism of emergence of each social characteristic. -/- CONCLUSION An emergence that is consistent with reductionism is called a weak emergence. And strong emergence includes the principle of irreducibility and downward causality. According to strong emergence, the characteristics of social phenomena have downward causal power, which cannot be reduced to the causal forces. The principle of subvenience, together with multiple realization and wildly disjunctive, can provide the conditions of irreducibility and downward causality, which are essential conditions of strong emergence. Based on the philosophical analysis of two methodological approaches, individualist and collectivist, it can be concluded that emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and reification collectivism faces the challenge of reification. The analysis of the problems faced by these two approaches leads us to three unresolved issues, which are realism, downward causality, and mechanism. individualist emergentists acknowledge the existence of emergent social characteristics, but despite this, they believe that these characteristics are not real but merely analytical constructs that require explanation based on individuals and their mutual actions. But collectivists argue that emergentism yields a categorical ontology and supports social realism. They accept the dependence of social characteristics on individuals, but claim that social entities and structures are ontologically independent. Individualists and collectivists both agree that some social characteristics are reducible; and others are irreducible due to their complexity; and the only way to recognize this is to engage in empirical studies of the mechanisms and temporal processes of "emergence" that create social characteristics. -/- NOVELTY The newness of this compact article is as follows: a) Presenting an interdisciplinary approach using the analysis of philosophy of cognitive sciences, including the philosophy of mind, neurobiology and psychology to formulate the issue of social emergence; b) Criticizing individualist and collectivist methodological approaches to the issue of social emergence and explaining the sufficiency and shortcomings of both in providing weak and strong emerging conditions; c) Explaining and categorizing the challenges facing methodological approaches in explaining the phenomenon of social emergence, in three categories: realism, downward causality, and mechanism. This paper focuses on the push to stabilise society through civil defence education (CDE) in the changing context of nationalism and populism. We analysed the way in which justifications and criticism of civil defence education (CDE) have evolved as an ordering project intended to solve the problems with dangers that were variously defined. We identified two locations of the danger to be tackled by the new CDE – external and specific; and internal and general – which partly correspond to (...) key political events: the migrant and Ukraine crises, and pre-election battles. Transformation of dangers stabilised education’s subservient role while destabilising educators’ position in the public debate. Drawing on relational sociology, qualitative analysis of the Czech media, and interviews, we show that the dangers defined by educational actors are circumvented to be replaced by populist and nationalist problems that were not the problems of the actors who would be most affected by the proposed curricular changes. We suggest looking at contemporary nationalists’ claims in education as a sign that topological arrangements are being reshaped among political, educational, and civic actors in terms of divides, externality, and irrelevance. The proceedings of the Third International Dharmakirti Conference held in Hiroshima in 1997 collect a number of papers devoted to the study of the great seventh-century Buddhist philosopher, Dharmakirti, and his impacts upon the succeeding generations of both Buddhist and non-Buddhist philosophers in India and Tibet. The Second International Dharmakirti Conference was held in Vienna, and its proceedings, Studies in the Buddhist Epistemological Tradition, have been published in this same series. The present volume contains the results of the (...) important researches made by the major Dharmakirtian scholars in the world since the last conference, so that the readers can discover the present state of affairs in the field of Buddhist epistemology and logic. Some papers are concerned with the epistemological topics, such as the notion of perceptibility, and others with the purely logical problems like an empty subject. Some deal with the Buddhist theory of language called apoha in comparison with the views of Nagarjuna, Bhartrhari and others, while others are devoted to the ontological questions, such as how to determine the causal relationship. Several papers discuss Dharmakirti in the light of criticism made by Jaina, Nyaya or Minamsa philosophers. And finally the most remarkable feature of the present volume is the increase of number of contributions devoted to the study of Tibetan tradition of Buddhist epistemology and logic which has been developed under the great influence of Dharmakirti. By Charles B.Jones. Honolulu: University of Hawaii Press, 1999. 233 pp. Charles Jones spent over three years living in Taiwan pursuing the research for this book and for journal articles about religion on the island. He is currently on the faculty of (...) the Department of Religion at the Catholic University of America. Jones primarily focuses on the history of Chinese Buddhism as an organized religion in Taiwan from the mid-1600s to the late 1980s. This is a much needed study as most literature on Chinese Buddhism is based on Mainland Chinese Buddhism. Only in the last decade has there been a shift to focus on Taiwan Buddhism as a separate entity rather than seeing it only as an extension of Mainland Chinese Buddhism.The book is nicely organized into three major historical eras. Part 1 is titled "The Ming and Qing Dynasty (1660-1895)." This section, only one chapter, mainly focuses on the arrival and early development of Buddhism in Taiwan. Part 2 is titled "The Japanese Colonial Period (1895-1945)." This section, two chapters, of course focuses on the advent of Japanese Buddhism on the island along with its impact on Taiwan's Buddhism. Part 3 is titled "From Retrocession to the Modern Period (1945-1990)." This is the largest section of the book, with four chapters. I found this section to be more detailed and interesting than the previous two sections. I will spend the remainder of this book review commenting on this last section.In part 3 of his book, Jones begins with a chapter on the retrocession (the period at the end of World War II when Japan was forced out of Taiwan) and the arrival of the Mainland Buddhist monks to Taiwan. This chapter shows the emergence of an organized Buddhism that started to develop under the oversight of the Buddhist Association of the Republic of China (BAROC), which had begun previous to World War II in Mainland China but relocated to Taiwan with the national government in 1949. Also of interest in this chapter is the discussion of the power struggles within Buddhism between a traditionalist faction led byYuanying, and a reformist faction led by Taixu. In the end, the struggle was resolved in favor of the traditionalists; this has led to Taiwan Buddhism tending to incline toward conservatism.Chapter five focuses entirely on the Buddhist Association of the Republic of China (BAROC). It is neatly organized into two major sections, "The early period, 1949-1960," and "The middle period, 1960-1986." In the early period section, Jones does a good job explaining the BAROC's organization, mission, and activities. Included as well is a small but fascinating discussion on "The vitality of the nun's order after 1952," in which Jones tries to answer the question of why nuns have increasingly come to predominate numerically over monks, a situation that exists only in Taiwan and Hong Kong.The second half of the chapter, "The middle period, 1960-1986," focuses on the leadership of the BAROC under Baisheng. From 1960, when Baisheng became president of BAROC, until his death in 1986, Baisheng remained a controlling presence in BAROC affairs, despite the fact that he did not hold the presidency continuously [End Page 133] during this period. Also in this section, Jones highlights the internationalism ofTaiwan Buddhism under the leadership of Baisheng, which was seen in the ordinations of foreign monks and in the involvement of BAROC in international Buddhism organizations. This chapter also covers the continual struggle to regain possession of Japanese-era temples.Chapter five ends with a section called "Criticisms of the BAROC." The largest criticism leveled against the BAROC was that it failed to become the unifying force for Taiwan Buddhism that it might have been, a problem related to its elitist attitude at the national level, where only a very small closed group of people had the actual decision... The Hwang affair, a dramatic and far reaching instance of scientific fraud, shocked the world. This collective national failure prompted various organizations in Korea, including universities, regulatory agencies, and research associations, to engage in self-criticism and research ethics reforms. This paper aims, first, to document and review research misconduct perpetrated by Hwang and members of his research team, with particular attention to the agencies that failed to regulate and then supervise Hwang’s research. The paper then examines the research ethics (...) reforms introduced in the wake of this international scandal. After reviewing American and European research governance structures and policies, policy makers developed a mixed model mindful of its Korean context. The third part of the paper examines how research ethics reform is proactive (a response to shocking scientific misconduct and ensuing external criticism from the press and society) as well as reactive (identification of and adherence to national or international ethics standards). The last part deals with Korean society’s response to the Hwang affair, which had the effect of a moral atomic bomb and has led to broad ethical reform in Korean society. We conceptualize this change as ethical modernization, through which the Korean public corrects the failures of a growth-oriented economic model for social progress, and attempts to create a more trustworthy and ethical society. Based on two presentations during a February 2020 South African academic visit at the University of Pretoria and the University of Johannesburg, in this contribution, the authors of this article engage with one of the bestselling recent volumes in philosophy, Martin Hägglund’s This Life: Why Mortality Makes Us Free (here, the 2020 edition; initial publication date, 2019). In this book, Hägglund propagates ideas akin to those promoted within secular humanism. Whilst on the one hand this article elaborates the shortcomings of (...) Hägglund’s criticism of religion, on the other hand it also strives for an empathetic reading of his secular humanist philosophy. The authors place this conversation within the post-secular religio-cultural climate currently rising internationally, along with some further contextualising remarks. The most important part of this article is the last section (‘Pitting some theological voices…’) in which the authors engage Hägglund’s main arguments theologically, which elaborate on the finitude of human life all the whilst denying it a prospect of immortality. The debate in this section procceeds along the lines of religious thought of Emmanuel Falque, Ebenhard Jüngel and Dewi Zephania Phillips, with a view to reconcile the radical awareness of finitude and temporality of human life, characteristic for modern discourse(s), with the religious language practices sustaining belief in eternal life. Contribution: This article engages with how Martin Hägglund’s This Life: Why Mortality Makes Us Free does not fairly convey aspects of the sense of secularism, and can additionally on the senses of finitude and temporality be improved by insights from Emmanuel Falque, Ebenhard Jüngel and Dewi Zephania Phillips. This essay argues that the possibility of governing the development and deployment of solar radiation modification (SRM) technology is predicated on the assumption of a liberal international order informed by an understanding of state responsibility. However, this order is experiencing a period of disruption that has placed stress on extant and emerging global governance regimes and brought the assumption of their efficacy and viability into doubt. In addition, international order and existing global governance of technologies with planetary implications, (...) such as nuclear weapons, have become the increasing focus of criticism because of the inequities embedded within these institutions, calling into question how much of a roadmap the existing governance architecture can or should provide. Leading developers and proponents of SRM have advocated for cooperative, transparent, science-led governance, which parallels the language of early nuclear governance advocates, but there is a long history of displacement and disruption of indigenous and otherwise marginalized populations without meaningful consultation to accommodate technological developments driven by powerful, industrialized countries. Developing an ethical framework for the governance of SRM will be challenging under the current conditions of increasing tensions and confrontations between major powers that may have non–climate-related interests in developing and controlling SRM technology. This essay will reflect on whether the current international order, stable or unstable, is capable of producing ethical governance of SRM. (shrink)

The facts are dismal. One out of five inhabitants of the earth lives in absolute poverty, while one out of seven is afflicted by hunger. Extreme poverty exists alongside extreme abundance. Empirical evidence points not to scarcity but to poor politics as the primary cause. The urgency of the situation as well as the intertwined nature of human misery and politics would lead one to expect global justice to be a major component of any respectable study of world affairs. (...) Quite to the contrary, theories of world politics are generally silent on these issues. The poor and the oppressed remain invisible, even in accounts of our brand new 'global village'. ;This dissertation aims to rectify the normative deficit of international theory by analyzing closely John Rawls's latest book: The Law of Peoples . Rawls takes on the challenge raised by global inequality and develops a theory of global justice that places moral judgment and action at the heart of world politics. The substance of this theory is filled out by using the famous original position, with its veil of ignorance, this time to generate global principles that regulate relations among peoples. The result is reassuring: human misery requires a response wherever it is experienced. In nonideal theory, the Law of Peoples necessitates global engagement for the eradication of the great evils that have historically followed from political injustice. ;In stark contrast to this global activism, Rawls defends nonintervention and rejects redistribution in ideal theory. This has provoked a heated debate in political philosophy, leading to cosmopolitan criticism of the Rawlsian enterprise. In light of such cosmopolitan objections, I assess the contributions and limitations of the Rawlsian project for global justice. I argue that the fundamental ideas of Rawls's broader thought necessitate the endorsement of Rawls's procedure, while at the same time requiring the revision of the substantive principles of the Law of Peoples. Thus reaching cosmopolitan conclusions without cosmopolitan premises, I claim that my reformulated Law of Peoples is more Rawlsian in spirit than the versions offered by either Rawls himself or his cosmopolitan critics. This paper considers the issue of fear in the field of international relations studies. Fear is a typical condition of international relations because of the anarchical nature of the international political system characterized by a common threat perception among states. Since the very beginning of international political thought the notion of fear has been given great consideration due to its correlation with conflict which is the main object of international relations. The paper argues that in (...) order to better understand what fear and perception in international relations is about is necessary to undertake the notion of political identity. In that sense we propose a would be political identity account of state that might share light on the perception of fear. We claim that the perception of fear depends on the type of identity of a given state. Hence we discuss three type of state political identity: weak-tribal, medium-ideological, strong-pluralistic. In the aftermath of the “Arab Spring” and of crumbling state structures, an exodus of unknown proportion from the Near East and from Northern Africa has set in and was further exacerbated by civil war and ISIS terror rule over large territories in the Near East. As a consequence, thousands of refugees came to Europe. Many of them fulfilled the conditions for non-refoulement according to Article 33 of the Geneva Convention on the Law of Refugees of 1951 or were at (...) least entitled for temporary protection according to the Common European Asylum System. These instruments did not, however, take into consideration situations of mass influx and neither is there an efficient mechanism for burden sharing within the EU in place. Some countries where overwhelmed by these migration flows. In this contribution, particular attention will be given to the reactions to these developments by the Austrian government. In Austria, as a consequence of mounting pressure by considerable parts of the population demanding a halt to this migration, the government adopted or announced a series of measures that, if implemented, will constitute a blatant violation of international law. This holds true, in particular, for the so-called upper limit for asylum seekers. Legal academia in Austria in part was silent as to these events, in part sustained it after having been engaged for a legal. It is contended here that unilateralism may be effective in a short-time perspective, but the long-term consequences should not be overlooked. It would be better to work on a genuine international burden-sharing mechanism even though this approach is more difficult to sell to national constituencies. (shrink)

The paper aims to prove the hypothesis that Sextus Empiricus’ Neo-Pyrrhonism is significantly influenced by the Cartesian meditation as a genre of philosophizing. It refutes theses about (1) the non-predicativity of Sextus’ language and about (2) Sextus’ epochê as an automatic result of the action of opposite things or statements, and it argues that both Sextus and Descartes distinguish between (a) internal (forced) agreement with clarity and (b) the personal acceptance of this agreement which depends on a volitional decision. Sextus’ (...) recognition of the clarity of appearance as appearance gives Descartes the only chance to refute the skepticism of Sextus, which is invulnerable to external criticism. Therefore, Descartes developed meditation as a special model of purely immanent criticism (the very word “skepticism” is never mentioned in the Meditations), focused on dealing with states of clarity and evidence. The author’s hypothesis is that the key elements to which this model appeals are the “history of a skeptic” set out in Outlines of Pyrrhonism and the conception of skeptical expressions. This hypothesis can be tested further by proving or disproving the thesis that the discourse of I, II, and at least partially of III Meditations is based on the pattern of skeptical expressions, focused on the internal states of the speaker, and not on clarifying the “objective” state of affairs (i.e. not on dogmatic inferences). In the De Generatione et Corruptione II 9, Aristotle aims to achieve the confirmation of his theory of the necessity of the efficient cause. In this chapter he sets out his criticism on the one hand of those who wrongly attributed the efficient cause to other kinds of causality and on the other, of those who ignored the efficient cause. More specifically Aristotle divides all preceding theories which attempted to explain generation and corruption into two groups: i) those which (...) offered an explanation by using the formal cause ii) those which provided an explanation by using the material or the instrumental causes. According to Philopo­nus, when Aristotle reproaches the other philosophers for adducing no proper notion of the efficient cause he alludes to both Anaxagoras and Plato. Regarding Anaxagoras, in our view this cannot be confirmed by internal textual evidence. In terms of Plato, in this chapter we trace an explicit and an implicit criticism of the Platonic Forms as causes. Aris­totle’s implicit criticism is that the Forms are not at all active causes. We can understand better the grounds for this criticism if we also consider his relevant arguments in Book Lambda of his Metaphysics. His explicit criticism, articulated in two arguments, is formulated in GC 335b18–24. We examine the different lines of its interpretation in the second­ary literature, but primarily we focus on Philoponus’ exegesis, which contributes significantly, not only to the clarification of Aristotle’s thinking, but also to the manifestation of the arguments articulated in defence of the Platonic theory of the Forms. In this paper, through the analysis of Philoponus’ exegesis we set out to prove that Aristotle’s criticism of the Platonic causes can be construed from the perspective of either Aristo­telian theory or the Platonic and Neoplatonic influence. Finally, based on Philoponus’ exegesis, we examine Aristotle’s criticism of those who posited matter or instrumental causes as efficient causes. (shrink)

Superficially, the proximity of Wittgenstein's work and its undisputed influence by Friedrich Nietzsche's ideas and concepts suggests that there are also overlaps in the large and in Nietzsche's work decisive field of progress and criticism of progress. The article tries to show that this is not the case. Despite all the overlaps that may exist between Friedrich Nietzsche and Ludwig Wittgenstein, these do not come to light in the concept of progress and the critique of progress. Both thinkers pursue (...) a very different movement of thought; Wittgenstein sees Nietzsche's focus on the "idea of great progress" as a "delusion", which he does not consider to be expedient. Ludwig Wittgenstein explicitly distances himself here from the spirit that defined the prevailing European and American civilization in the 1930s. He does not succumb to the delusions of grandeur of new, higher-level civilization, but leaves progress as the constantly progressing background noise of any civilization. (shrink)

The liberal international order is being challenged today by populism and unilateralism. Though it has been resilient in the past, the current challenges from within the order are unprecedented. Without being too pessimistic, I expect the LIO will survive but retract to its original core states in North America, Europe, and Northeast Asia, shedding some of its universal pretensions. States that remain within the liberal order, in turn, will compete with an alternative Chinese-led international hierarchy built around (...) all or part of the current Belt and Road Initiative countries. While international institutions can facilitate cooperation, they do not bridge this emerging divide sufficiently to forestall conflict and, in any event, will not be sufficiently robust to prevent a new cold war. As part of the roundtable “International Institutions and Peaceful Change,” this brief essay sketches this argument and concludes with some possible ways of moderating future conflicts. (shrink)

The political conception makes sense of human rights strictly in light of their role in international human rights practice, more specifically by describing how they justify interventions against states that engage in or fail to prevent human rights violations. This conception is, therefore, normative and fact-dependent. Beyond this, it does not seem to have much to say about the actual nature of international human rights practice. The argument sustained here reinterprets the political conception by resorting to a heuristic (...) device that explains how normativity can be fact-dependent: the Hartian model. The characteristics of H.L.A. Hart’s rule of recognition are useful to determine the characteristics of human rights practice from the viewpoint of the political conception. Also, they help to overcome some of the problems typically faced by the political conception, such as whether there is only one practice or many, whether the notion of human rights becomes too contingent on the way the world is currently organised, how agents can violate content-changing practices, or how reliance on current states of affairs leaves room for criticism of those states of affairs. According to the received view crimes like torture, rape, enslavement or enforced prostitution are domestic crimes if they are committed as isolated or sporadic events, but become crimes against humanity when they are committed as part of a ‘widespread or systematic attack’ against a civilian population. Only in the latter case can these crimes be prosecuted by the international community. One of the most influential accounts of this idea is Larry May’s International Harm Principle, which states that crimes (...) against humanity are those that somehow ‘harm humanity.’ I argue that this principle is unable to provide an adequate account of crimes against humanity. Moreover, I argue that the principle fails to account for the idea that crimes against humanity are necessarily group based. I conclude by suggesting that the problem with May’s account is that it relies on a harm-based conception of crime which is very popular, but ultimately mistaken. I submit that in order to develop an adequate theory of crimes against humanity we need to abandon the harm-based model and replace it with an alternative conception of crime and criminal law, one based on the notion of accountability. Timothy Williamson famously argued that assertion is constituted either by the knowledge rule or some similar epistemic rule. If true, the proposal has important implications for criticism of assertions. If assertions are analogical to other rule-constituted kinds like games, we can criticize assertions either on external or internal grounds, depending on whether the criticism draws from the necessary norms of assertion or some contingent ones. More recently, authors like Goldberg and MacFarlane have argued against other theories of assertion (...) on the grounds that they cannot explain the possibility of internal criticism for assertions. This paper raises methodological problems with these arguments. The main idea is to show that alternative, non-normative accounts of assertion can also explain the apparent differences in grounds of criticism without assuming that assertion is necessarily governed by some epistemic norm. This paper assesses the development of Niebuhr's thinking on the realist outlook in international relations and his attempt to link this as far as possible to ethical goals in world affairs. It will examine in particular Niebuhr's relevance to contemporary debate by focusing on Niebuhr's writings during and after the Second World War. The paper argues that it would be incorrect to perceive Niebuhr as simply a figure defined by the Cold War, for his writings contain a vision (...) extending beyond issues of bipolar rivalry. It was this vision which led him to attack what he saw as the misuse of American power in South East Asia in the 1960s. Niebuhr should not be seen only as an apostle of naked realpolitik, important though this element is to his thinking. The earlier radicalism of the inter-war years left an important legacy of concern for social and economic justice that makes him a figure of continuing interest for scholars. (shrink)

This article focuses on the relationship between emotions and passions, on the one hand, and values, needs and rights, on the other. This relationship is indeed central to the social dimension of international politics. In this perspective, the article examines how emotions and passions can be at the same time effects and causes of the extent to which actors feel that their needs and rights are fulfilled or not. In the process, the article also explores the negative and positive (...) features of emotions and passions, and their impact on the nature and dynamics of change in international affairs. Beyond this general approach to emotions and passions in connection with the social dimension of international politics and the questions of values, needs, and rights of actors and change, it concludes with the idea that there is also a contextual dimension to the generic argument developed in the article. Qutayba ibn Muslim al-Bāhilī is one of the leading soldier-bureaucrats of the Umayyads period. During the time he served as the governor of Khurāsān, he consolidated the Umayyad’s rule in Tokharistan and Transoxiana provinces, and expanded the borders of the state to China by conquering the Kashgar region. His activities for conversion of the people of the conquered regions have great importance in the history of Islam since the intense relations of the Turkish people with Islam fell upon the time (...) of his governorship. It is possible to argue that by introducing the religion to these people Qutayba had played an important role in their conversion to Islam. It is also known that he had sent a delegation to the emperor of China for the same purpose. However, despite all his achievements, it is seen that the academic studies about Qutayba in our country are very rare. Besides, some of the recent studies about him claim that he was a fraud, a trickster, and an untrustworthy person in his military activities; and had committed mass murders and massacres, persecuted innocent people, destroyed and burned the cities of conquered lands. In this article, it is examined that whether these claims and accusations have their justifications or not by consulting the main sources. In fact, what is expected from constructive criticism in this subject and every other area is to clarify the matter and make it more comprehensible of its context. However, it should not be forgotten that some conclusions over Qutayba in these studies might have been drawn to quickly in order to manipulate the conquest movements of the Umayyad period.Summary: The religious interaction and change taken place in the Arabian Peninsula with the emergence of Islam and with the political, military and cultural activities of the Muslims performed during the periods of Prophet Muhammad and the Rāshidūn (rightly guided) Caliphs had significant effects upon the lands of Iraq, Syria, Egypt and Khurāsān where the ancient civilizations located.The success made by the Muslim-Arabs in such a short time is accepted of course as one of the important events of world history. The message of Islam spread rapidly with their extraordinary efforts, and reached quickly in the early days of Islam to the Amu Darya/Oxus River, which is considered to be the natural border between the Iranians and the Turks (Iran and Turan).Although the Turks who had been struggling to dominate the region for centuries gained an opportunity with the disappearance of the Sasanian Empire from history, they could not take advantage of this new situation because of their lack of political unity and a strong state, and the power held by the regional Turkish Sultans were not enough to make their dominance happen. In this conjuncture, the Muslim-Arabs who appeared in the stage of history in a relatively late period but had the ideal of being a regional and a global power had rapidly realised their political and military activities called “conquest” in the Islamic historical sources. When it comes to the period of Caliph ʿUthmān, it is seen that the conditions were very suitable for passing to the east of the Oxus River where the Turkish elements lived intensively. At the time, the absence of a strong Turkish state in the region, and China’s occupation with its own internal problems made an important contribution for the Muslim-Arab capture of the region. In this region, which is called as “Transoxiana” in the Arabic sources, it is seen that the Turks organized their political structures as city-states and regional sultanates. In the north-eastern parts of this region, there was a strong Turkish State called the Turgish State and it provided political and military support to the people of the region who rebelled occasionally the Umayyads.After solving the internal problems of the state largely and suppressing some dangerous revolts, the Umayyad Caliph ʿAbd al-Malik ibn Marwān became capable of initiating military activities beyond the borders of the state. Nevertheless, the period when the actual conquests were made was the period of his son Walīd (86/705-96/715). It is seen that the conquests made in his time were permanent, and the people who lived in the conquered lands accepted Islam to a large extent. The conquest made during Walīd’s time which extended from Kashgar to the Pyrenees, realised at an unprecedented pace. The most important name for the eastern side of the conquests is undoubtedly Al-Ḥajjāj ibn Yūsuf. Ḥajjāj (75/694-95/714) who acted as the supreme governor of Iraq for nearly twenty years, had achieved important successes in the regions of Transoxiana and Sindh located in the eastern part of the country by the hands of his appointed governors. However, many governors appointed by him to Khurāsān from 75/694 to 86/705 with the hope of reaching his goals in the east could not meet his expectations because of the political, social and economic problems that existed throughout the country, and because of the resulting rebellions in the regions that these problems caused.These unwanted conditions continued to be seen in the region until he appointed Qutayba ibn Muslim as the governor of Khurāsān (86 / 705-96 / 715) who was one of the young commanders and administrators educated by Ḥajjāj personally. Qutayba known as having a close relationship with Ḥajjāj and consulting him when taking important decisions acted in this direction throughout the time he stayed in this position.It is known that the internal conflicts in the region continued during the time when Qutayba was appointed as the governor of Khurāsān. However, he had brought together northern and southern Arabian tribes living in the region with religious, political and economical suggestions and had succeeded in persuading them for military activities that he decided to operate beyond the Oxus. For the Umayyads, these military operations were justified, because the regional sultans who ruled in the western and eastern sides of the Oxus repeatedly violated the agreements they had made before. The tendency of the people of Turkic, Iranian, and Tajik origin who were the real owner of these lands and lived in both sides of the rich Oxus basin for many centuries to violate these agreements was in fact result of a great concern. They now realized that the Muslim-Arabs who followed a systematic settlement policy in the region came to their lands this time without any intention of going back. Even though Qutayba followed a fair and reasonable policy towards them, they violated their agreements with him, formed alliances among themselves and waged military campaigns against Qutayba not to be the subjects of any change in their religion, worldview, and perception of existence.Qutayba, who is believed to have spent his its utmost efforts to make the religion of Islam and the Umayyad political cause permanent in the region under these unfavourable conditions, has been recently criticized by some researchers. The criticisms intensify around the claims that he persecuted people, committed massacres, and behaved unfaithfully by breaking his promises that he made with people. From the perspective of our own times, it is possible to think that sometimes he had taken extreme measures in punishing the sultans and the persons who raised armed struggles against him and caused riots by violating the agreements. However, when the period is compared with the others, it can be easily said that the Umayyads showed in these and other remote areas a considerable amount of tolerance that they had never shown it in their internal conflicts. It is a known fact that he generally clashed with the ones who disrupted agreements, sought help from external forces, established alliances against them, and refused to pay taxes. Based on historical sources, it does not seem to be possible to say that while doing these activities in the region, Qutabya did not behave entirely in a way that his behaviour could be classified as massacres committed against innocent civilians. On the contrary, it is known that Qutayba had given many chances to the people of the region in administrative and military affairs. As a matter of fact, he ruled the city of Bukhara for 20 years with a Turkish ruler whom he appointed and supported, and he included in his army a union of twenty thousand cosmopolitan soldiers assembled from the people of Bukhara, Baykend, Chach and Samarkand and paid a regular salary to them.The fact that his grave known as the “Imam Shaykh Qutayba Tomb” was turned later into a shrine and visited by the people even today despite the passage of long centuries after his death shows that he has been loved by the people of the region and that they have always considered him as a conqueror-bureaucrat who spent his life for the ideals of his religion. From the late 1960s to the early 1980s, a team of U.S. political scientists and computer specialists designed an automated, computerized information system that could ostensibly forecast conflict earlier and more accurately than human analysts. Named the Crisis Early Warning and Monitoring System (EWAMS), it sought to bring international relations scholarship and U.S. national security policy—traditionally qualitative and interpretive domains—under the jurisdiction of a man–machine system. Drawing together the histories of social science, computing, and foreign policy, this essay argues (...) that deep epistemic insecurities led social scientists to apply information technology to the production of policy knowledge. Computers, they hoped, could overcome the innate cognitive limitations that imperiled human decision making. By showing how social scientists’ computational zeal overshadowed their commitment to human agency, this essay also demonstrates that the history of science has an important role to play in contemporary debates about the implications of big data projects for knowledge and policy. This paper aims to check some Nussbaum’s reviews, in Hiding from Humanity, about Mill’s conception of liberty. The analysis frame is given by constant tension between the utilitarian justification and the justification based on per se value of liberty. This article wants to support the following hypothesis: Millean liberty cannot be criticized for reducing its value to instrumental terms. On the contrary, in order to be loyal with Mill, liberty has a double justification: one based on its utilitarianism and another (...) based on its intrinsic value. We use Bernard Williams’s suggestion about the intrinsic value of human goods for supporting the latter. He proposed an important criterion to demonstrate the intrinsic value: coherent relation with other values and other human necessities. Finally, the article briefly exposes the problem of coherence in Millean utilitarianism. (shrink)

Leszek Kołakowski, who was brought up in the climate of Marxist philosophy, has moved away very considerably from the Marxist position of extreme atheism, but he may not be called a convert. Of the two contrasting attitudes which may be assumed in respect of the existential problems, the attitude of the priest and the attitude of the jester, Kołakowski is closer to the latter. The priest, if he is to perform his role well, should take his duties seriously; he should (...) be convinced of the truth of the deity that he serves. In carrying out his office he is expected to be ceremonious, formal and serious. The jester's position is more comfortable. His task is not to conduct a systematic and serious search for the truth: it is more the role of the critic. He is to observe the faults, the nonsenses, and the blunders, unconcerned for the persons at the butt-end of his critique and how they are to extricate themselves from it. The jester need not be a merry clown at all. Perhaps that is why alongside God, the sub-title of Kołakowski's book mentions things that are sad. Kołakowski is fascinated by the figure of Satan, who wants to be taken seriously but in culture, especially in the folk culture is attributed grotesque forms. Only the devil of the jasełka traditional Polish Christmas play makes audiences laugh hilariously, the real devil is deadly serious, since he is eternally thirsting for the truth and for love. Kołakowski is not pleased with his role of jester. But neither would he be any use as a priest. He has no gospel of his own which he could pass on to other people. He is trapped between two absurdities, which he briefly formulates after Pascal as: „The basic tenets of faith... are absurd, and yet the world image which excludes those tenets is even more absurd". In its predominant form, the understanding of the neurosciences, which stand in high public esteem, is a naturalistic one. The critique of this naturalism concerns the technical modelling of brain functions as a syntactic or control loop machine. Adequate solutions to the mind-body problem are not found in this way.

Global justice and international affairs is perhaps the hottest topic in political philosophy today. This book brings together some of the most important essays in this area. Necessity is a notoriously dangerous and slippery concept-dangerous because it contemplates virtually unrestrained killing in warfare and slippery when used in conflicting ways in different areas of international law. Jens David Ohlin and Larry May untangle these confusing strands and perform a descriptive mapping of the ways that necessity operates in legal and philosophical arguments in jus ad bellum, jus in bello, human rights, and criminal law. Although the term "necessity" is ever-present in discussions regarding the law and ethics (...) of killing, its meaning changes subtly depending on the context. It is sometimes an exception, at other times a constraint on government action, and most frequently a broad license in war that countenances the wholesale killing of enemy soldiers in battle. Is this legal status quo in war morally acceptable? Ohlin and May offer a normative and philosophical critique of international law's prevailing notion of jus in bello necessity and suggest ways that killing in warfare could be made more humane-not just against civilians but soldiers as well. Along the way, the authors apply their analysis to modern asymmetric conflicts with non-state actors and the military techniques most likely to be used against them. Presenting a rich tapestry of arguments from both contemporary and historical Just War theory, Necessity in International Law is the first full-length study of necessity as a legal and philosophical concept in international affairs. From the point of the EU law, the CJEU has the exclusive competence to interpret the EU legal norms and decide upon validity of the legal acts adopted by the EU institutions because it is the most effective method to ensure the unilateral interpretation of the EU law and to prevent its fragmentation. Thus, it can be presumed that all disputes between the Member States regarding the EU law must be solved by the CJEU. The paper aims at finding the (...) answer to the question whether international courts under the international law must refuse their jurisdiction in cases where disputes of the Member States relate with the EU law. With the view of this aim, arguments arising from the international law (for instance, prohibition of intervening into affairs of another legal system, prohibition of abuse of laws), on the basis of which an international court should decline its jurisdiction, and applicability of such arguments to the situation discussed is assessed and an independent approach is formulated.
