The problem of the concept of Ukraine’s state economic policy of regulation of human resources international movement in the context of global intellectualization remains topical throughout the existence of Ukraine as an independent state. It should be noted that the favorable geopolitical position of Ukraine provides potential opportunities for the development of both regions and the state as a whole, creates conditions that are associated with the involvement in international migration, tourism (...) and transit and professional processes. Their number increases in modern conditions of globalization development. The analysis of features of Ukraine's participation in the processes of intellectualization of the human resources international movement demonstrates the necessity of developing the state economic policy of the human resources international movement, which would become part of the global space and have certain benefits. The article is devoted to revealing the phenomenon of contemporary changes in the language space, in accordance with the processes of transition that take place in the economy of Ukraine in the context of knowledge representation, neuro-modeling and artificial intelligence. The relevance and expediency of the study are due to the uncertainty to some extent of innovative processes occurring in the development of the contemporary Ukrainian language in connection with the transitional processes in the economy. The relevance of the (...) study is determined by: 1) the importance for contemporary linguistics of identifying and describing the structural and typological features of the “dominant” lexical and semantic subsystems of the contemporary Ukrainian language, reflecting the most significant concepts of contemporary Ukrainian conceptosphere; 2) the importance of the lexical subsystem of public administration not only for the contemporary Ukrainian language and contemporary Ukrainian national consciousness, but also for the effective economic policy of the state; 3) a lack of special generalizing research on the problems of formation, development and current state of the Ukrainian vocabulary of state regulation of the economy; 4) the need to clarify and improve the methodology of complex analysis of lexical and semantic systems in the Ukrainian language, methods and techniques of describing lexical units in synchronous and diachronic aspects. 5) current needs in the use of artificial intelligence, based on the principles of neuro-modeling in the representation of knowledge in the conditions of transition economy of Ukraine. Our world is mobile. People move, either within the state or from one state to another, to access opportunities, to improve their living conditions, or to start afresh. Yet, we usually assume that migration is an exceptional activity that leads to permanent settlement. In this paper, I invite us to reconsider this assumption. First, I analyse several ways in which people experience mobility in contemporary societies. Then, I turn to migration, as a specific form of mobility. (...) I distinguish between a legal/administrative, a social, and a self-identification-based approach to migration, demonstrating that they lead to divergent definitions of who is a migrant. I proceed by introducing the concept of mobile migration and by developing a typology of mobile migrants. I conclude that, in order to devise migration policies that treat migrants fairly, a careful consideration of the claims and interests of the different types of mobile migrants is necessary. This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We (...) challenge the conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

The European Union (EU) has been challenged by several crises lately. In addition to Brexit, the Euro crisis, and the migration crisis; global issues such as the coronavirus pandemic and the Russian attack on Ukraine affected the EU. The migration crisis, on the one hand, differs from the above-mentioned crises with one remarkable feature. The member states have no real consensus about forming a common migration policy. Besides, for geographic reasons, some member states put much (...) more burden on immigrants. Agreeing on immigration becomes impossible for the border countries on the migration route and also transit countries. The paper argues that, unlike the other crises of the EU, the migration crisis reinforces EU integration in such a way that disputes between member states prevent the EU from making institutional changes about the issue. The study results assume that the other above-mentioned crises, on the other hand, stimulated institutional change throughout the EU. In light of this information, this study evaluates, using a method of relevant literature review and comparing the arguments of the researchers, how the migration issue became a subject of dispute between member states by evaluating the 2015 crisis. The key problems of Ivan Vyghovsky’s rule (the main problem among them – is Gadiatskiy pact in 1658) in Mykhailo Grushevskiy’s works are considered in the article. It’s emphasized the scientist’s ambiguity in treatment of polish Ukrainian compromise in 1658. On the one hand the researcher highly evaluates Ivan Vyghovskiy and his like minded persons for their realization the basic idea of social and political development of Ukrainian nation, the necessity of being independent and trying to legalize it in the (...) appropriate paragraphs of “Big kingdom of Russia”.On the other hand emphasizes the factors which caused the union “lack of vitality” and hopeless of I. Vyghovskiy’s polish foreign policy choice.In the scientist’s conception the compromise of 1658 is the result of acombination of a set of factors, opposing tendencies, which had a deep foundation; the current geopolitical realities. For the «Zaporizhzhya Army» it was seen as a salvation from the expansionist, incorporationist policy of Muscovy, the mechanism of affirmation of the Orthodox « Grand Duchy of Rus» as an equal component of the reorganized Commonwealth.Mykhailo Hrushevsky, while paying tribute to the Treaty of Hadiach asa political and legal act, which testified to the level of state thinking of the then Ukrainian elite, indicates, at the same time, his doom.First of all, the historian observes that the treatise was in a hurry, under pressure of circumstances, it may have a temporary character. The most dangerous thing in the treaty is the «... competition of the Cossack and Nobility element...». The researcher believes that the basis of the Hadiach Union was nobility, because it was called «... to restore the economic and political affluence... of this social stratum...».Even the acquisition of the nobility`s rights by the Cossack sergeant «... meant only the strengthening of the nobility stratum against the Cossack masses». Therefore, for the Cossack public (for the common people - moreover, because it was not mentioned in the treaty) the union was unacceptable. In addition, the weak power of the Commonwealth government was incapable of fulfilling allied obligations to the «Zaporizhzhya Army» and the magnate-nobility community has demonstrated its inability to engage in relations with it on a parity basis.In contrast to the Hadiach apologists in 1658, who admired the preferencesfor the Ukrainian in the field of education and culture. Mykhailo Hrushevskyconvincingly states: «For us, from a retrospective perspective, it is quite clear that the Hadiach Union did not look to be successful...».In fact, only a formal Ukrainian-Polish compromise on the 6th(16th ) September 1658, could have been the basis of a federal union of Ukraine, Poland and Lithuania: the really progressive provisions of the treaty, which were proposed by Y. Nemirich - I. Vyhovsky, were already limited in time by signing it near Hadiach ; then - substantially eliminated in the process of ratification by the Warsaw Sejm; The illogical view of the coexistence of the Cossack emancipated Ukraine with the state-regulated Crown (with privileged nobility and followed by a feudal dependent slap) is seen in the «renewed» Commonwealth. That is why the Hadiach Treaty eventually became one of the decisive factors in defeat of Vyhovsky as a hetman.And at the same time it remains a Memorandum of such a desired mutual forgiveness and consent of the elites of the two peoples for a better life of each of them. The article examines the key conclusions and recommendations to candidate countries and potential candidates for accession, set out by the European Commission in the annual Communication on the EU enlargement policy in 2022. For better understanding of the essence of the Commission’s Communication, this article the author analyses the realities faced by the EU with the beginning of the Russian Federation’s full-scale war against Ukraine. According to scholars and experts, the war changed Europe more profoundly than any event (...) since the end of the Cold War. It is found that the war clearly emphasized the attractiveness of EU membership and strengthened its transformative power, which was formed thanks to the values, diversity of the societies of the Member States, fundamental freedoms and way of life of the Union. In this context, one can agree with the statement of scholars that the real challenges that the EU cannot avoid if it wants to become more authoritative and strategically autonomous are the strengthening, not the weakening of the European level (institutional and legal systems, common EU policies) under a strict democratic control. The analysis of the conclusions and recommendations in the Commission’s Communication allowed us to conclude that after the Russian invasion of Ukraine, the policy of EU enlargement was returned to the forefront of the EU’s agenda. Evidence of this was, firstly, granting the status of a candidate for accession to Ukraine and Moldova and a potential candidate – to Georgia, and, secondly, a joint search by the EU and its Member States for ways to activate and speed up the process of European integration of the countries of the Western Balkans region. In addition, it should be noted that the cross-cutting themes of the Commission’s conclusions and recommendations are EU security and energy policy, key areas of the Green Course, in particular decarbonization of the economy, as well as the issue of recovery after the COVID-19 pandemic. A separate emphasis in the Commission’s Communication is placed on the reforms continued by the countries of the Western Balkans, which are necessary to fulfill the accession criteria. (shrink)

The article presents the results of an analysis of perceptions of migrants in press releases and regulatory documents of law enforcement and civil government agencies. We considered these texts within the framework of a "soft" constructionist approach, as a tool for problematizing the social process and one of the key ways of producing the discourse of power. The purpose of the study was to use a combination of quantitative content analysis and discourse analysis to identify the "equivalence chains" that give (...) meanings to the nodal sign "migration" in the texts of power. The objectives of the study were to collect a text array relevant to the topic and determine the social context in which the migrant is placed: the spaces in which they are present, the actions of which they are the subject and object. In most of the 548 texts reviewed, the migrant is presented as a suspicious, impersonal object of state paternalism. The most extensive category of social actions in which a migrant acts as a subject are crimes, mainly related to violation of the regime of stay in the Russian Federation. The most common actions committed against a migrant are inspections and raids, as well as various kinds of punishment. The subject of action against a migrant in regional government texts is not the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation, but the Main Directorate for Public Order Maintenance, the Prosecutor's Office of the Russian Federation, and the courts. The article proposes a hypothesis according to which law enforcement agencies use press releases simultaneously as a way to problematize migration and maintain public attention to it. Having monopolized the problem, the Ministry of Internal Affairs, the Prosecutor's Office, and the courts use it to repeatedly "sell" this issue to the public through the only tool available to them - symbolic and physical violence. The epitome is the emergence of slave markets in Libya (at the gates of the EU), a failed state that, nevertheless, the EU and its Member States are determined to raise to the status of privileged partner of their outsourcing policies. Based on the analysis of Lochak, Agambem and Bauman and the conception of the proposed by the Cameroonian philosopher Mbembé who develops Foucault's thesis about biopolitics, this text will propose some alternatives that are leaded by the requirement of recognition and guarantee of rights of immigrants and refugees. The article is focused on some aspects of development adult learning and education policy in Ukraine from stakeholders` perspective, and active role of the Ukrainian civil society in this discourse. This was facilitated by conducting analytical research and further advocacy activities on the protection and representation of interests in Ukraine in 2018-2019. Adult learning and education following the change in UNESCO’s terminology from «adult education» to «adult learning and education» (abbreviated - ALE), is interpreted as a permanent (...) activity aimed at acquiring, recognizing and applying key skills. Acquisition of new skills, abilities and knowledge by adults usually occurs after they receive basic education and enter the labour market. In European practice, this covers formal, non-formal and informal forms of adult learning. Stakeholders were involved in the analytical re- search through a survey of experts; participation in a practical seminar on peer review workshop, which was held in the format of a progress meeting to present the Policy Research Report and discuss the preliminary results; virtual discussion of analytical documents. Usually, adult learning policy promotes social well-being and integration, employment and active civil participation. Ukraine lack of consolidate active state adult learning policy during the whole period of its independence since 1991. The problem-solving options proposed in the research and validated by stakeholders are presented in this article. Cultural heritage, which serves as a substratum of national identity, forms the right of the state to its own sovereignty. The substantiated proof of the possibility of independence from other cultures and nations has relatively recently entered the conceptual field of the philosophy of culture. In January 2023, significant changes made to the Foundations of the state Cultural Policy took into account the concept of cultural sovereignty and, to the necessary extent, justified its high importance for (...) the development of the state and society. The fundamental role of culture in the creation and development of the state has been repeatedly recognized as one of the priorities. It should be noted that even later this priority was not a Russian regulatory novel. The purpose of the study is to consider a range of concepts and legal novels reflecting the sphere of cultural heritage. The long-term work of an extensive circle of philosophers and culturologists has been crowned with the recognition of the value of culture in the system of state regulation of various spheres of human activity. As a result of the research, the conclusion is made about the relevance and timeliness of the implementation of the most important philosophical concepts in strategic planning documents and the high potential practical significance of the actualization of cultural heritage in order to achieve the results of the state cultural policy. In conclusion, it is noted that heritage as a cultural phenomenon has direct access to its semantic and value core. The preservation of cultural identity through the consistent building of cultural sovereignty is one of the most important priorities of modern state policy. (shrink)

In order for a state to rightfully exercise self-determination by means of setting policies concerning migrants and migration, they must be legitimate, Gillian Brock argues in _Justice for People on the Move_. Legitimacy, in Brock’s view, requires that states satisfy three (jointly sufficient) conditions: they must respect their own citizens’ human rights; they must be a part of a legitimate state system; and they must adequately contribute to the maintenance of this state system. In her new (...) book, Brock also argues persuasively for a variety of migration-related policies that states ought to adopt (concerning, for example, addressing the needs of refugees, regularization of undocumented migrants, and protections for temporary labor migrants). In previous work (Brock, _Global Justice: A Cosmopolitan Account_, Oxford University Press, New York, 2009; Brock and Blake, _Debating Brain Drain: May Governments Restrict Emigration?_, Oxford University Press, New York, 2015), Brock has compellingly defended the justice of policies designed to allay the harmful effects of brain drain. In this commentary, I wish to argue that the legitimacy standard Brock defends in _Justice for People on the Move_ is an obstacle to the justified adoption of the migration-related policies Brock demonstrates here and in previous work to be substantively morally justified, if not required by justice. If a state is not legitimate, then it lacks the moral standing to adopt migration policies that are otherwise morally justified. I do not intend to question the importance of the concept of state legitimacy for political philosophy generally. However, I wish to argue that that in the context of migration justice, considerations of state legitimacy may be contrary to the goal of defending a view on what policies a state ought to adopt. It may be more useful simply to consider whether or not there is moral justification for a particular state to adopt a particular policy. (shrink)

Due to the innovative nature of the world economy and the continuity of scientific and technological progress, intellectualization becomes one of the world's leading trends. The article is aimed to evaluate the state of intellectualization of the national economy of Ukraine in the context of globalization. In the article the existing approaches are considered, which are used by international organizations and expert agencies to evaluate the intellectualization level of the countries around the world. The indicators of the (...) class='Hi'>state of intellectualization, available in the publications of the State statistics service of Ukraine have been researched. The author's deductive description of the intellectualization state of the regions (on the basis of twenty four indicators) and of types of economic activity (three indicators) of the national economy has been presented. It has been determined, that in the today's circumstances, an increasing of intellectualization level of the Ukrainian economy could happen, on the one hand, by means of getting balanced the status of intellectualization of the regions, given their natural resource potential, the socio-economic situation and the international human resources movement. On the other hand, this can happen due to introduction of new forms of national economic policies for human resources development in the fields of IT-technologies, information services, sports, education, space industry, tourism. The scientific novelty and practical importance, as well as originality of the obtained results is represented by an elaborated methodological framework for evaluating the state of the intellectualization of the national economy plus a further projecting of mechanisms of intellectualization of Ukraine in the worldwide context. The recent widespread shift in governance from the state to the market and to civil society, in combination with the simultaneous shift from the national level to supra-national and sub-national levels has led to a significant increase in the numbers of public and private players in nature policy. This in turn has increased the need for a common vocabulary to articulate and communicate views and values concerning nature among various actors acting on different administrative levels. In this article, (...) we will examine the role of concepts of nature as communicative devices in public debates and political decision-making. We try to show that the now dominant functionalist approach to concepts of nature, due to its focus on interests, threatens to narrow public and political communications to purely strategic negotiations. Instead of this functionalist approach we put forward a structuralist approach, which focuses not on interests but on values. (shrink)

Significant “guestworker” immigration occurs when the state lacks the capacity to inhibit rent-seeking by private interests that benefit from imported labor. Policies allowing imported labor result in government subsidies for employers’ profits. These subsidies are usefully conceived as rents. A developmentalist state will constrain the creation of such rents, especially because imported labor carries long-term costs not borne by employers and inhibits productivity growth and positive structural change. A clientelist state falls prey to this type of rent-seeking (...) because of a weaker institutional capacity for creating conditions that make alternative solutions feasible and profitable for employers. The defeat of russia on the battlefield must be accompanied by the delegitimization of the “russian world”, that is, the loss of attractiveness for the russians themselves of the concept of the supremacy of everything Russian over everything non-russian. Cultivating russia’s greatness as a key task of “russian world” is one of the main reasons for the current Russian armed aggression against Ukraine, but also for Russia’s aggressive foreign policy in the world in general. The purpose of (...) this article is to clarify the main features of the delegitimization of the “russian world” in the regime of social education. To do this, the definition of “russian world” as a special symbolic system, which the modern russian political regime is trying to adjust from the standpoint of aggressive russian geopolitical subjectivity, has been previously clarified. This leads to the performative selfdenial of the “russian world”, which can be traced at the level of the accumulation of symbolic capital, the establishment of political elites (the authorities and the opposition), as well as at the level of the development of civil society. Social learning involves the search at the level of civil society for new forms of communicative self-organization at various levels of collective formation. A way out for such performative self-denial is possible only through the ways of social learning, the search for a change in one’s own identity, and not through attempts at autistic self-affirmation characteristic of the modern russian political regime, as well as the destruction of all political and cultural alternatives to the stateapproved canon. Social education is a way of soft and non-violent delegitimization of the “russian world”, in contrast to rebellion and revolutions, which in russia traditionally only lead to the emergence of even more brutal forms of state dictatorship. The monologic nature of the russian political space provokes the reation of new forms of social consensus outside the russian political system – in the sphere of culture, counterculture, and subcultures. The article is devoted to the decolonization of Ukrainian culture as an important factor of nation-building in the European perspective. At the same time, decolonization is a current trend in Western academic thought, which is embodied in social activism, in particular, in the wok movement and the culture of abolition. Postcolonial studies has become an intellectual battleground. These studies draw a new front line in the culture wars. Rethinking Western culture in light of its imperial expansionist past defines the goal (...) of decolonization. However, the tendency towards the politicization of vouk and the culture of cancellation. carries the risks of undermining the basic values of Western culture - freedom of thought and the rule of law, while the decolonization of Ukrainian culture has a different purpose. Unlike cultural decolonization in Western countries, cultural decolonization in Ukraine is aimed at legitimizing modern European values (Lisbon Agreement, 2007) by overcoming the «Russian-oriented» (Eurasian) tradition of thinking.Identifying the authentic contents of Ukrainian culture and refuting its imperial-Soviet interpretations is one of the main tasks of the decolonization of Ukrainian culture. The article offers a comparative analysis of Ukrainian and Western versions of cultural decolonization in order to avoid uncritical borrowings and ignoring the peculiarities of the Ukrainian context. The successful decolonization of Ukrainian culture requires the development of its 1) concept, 2) methods of theoretical substantiation, and 3) methods of practical implementation. The article states that the decolonization of Ukrainian culture becomes possible if its research strategies are deprived of colonial influences, which reveal indications of the imperial and Soviet scientific paradigm of social and humanitarian knowledge. The key concepts of the research are referring to the works of Nigel Giggar (2023), Douglas Murray (2022), Linda Martín Alcoff (2023), Jonh Darwin (2009), Kwasi Kwarteng (2013), Yaroslav Hrytsak (2022), Serhii Plokhii (2021, 2023), Timothy D. This article considers the question of the value and limits of the concept of discrimination for the ethics of migration by drawing attention to the need for a conceptualization of discrimination that can encompass forms of group-based disadvantage that are enabled and reproduced by the three central norms of our contemporary regime of global migration governance: the state’s right to unilateral control over its border regime, birthright citizenship and rights of (re)entry to one’s own state, (...) and the individual right to leave a state. I sketch an historical account of the forging and yoking together of these norms as bound up with the history of European imperialism and argue that they function to enable the reproduction of the advantage of states of the Global North. I illustrate this argument by reference to the example of the transnational migration of medical professionals from sub-Saharan Africa and argue that this may amount to structural discrimination against the human right to health of the populations of these states of emigration before considering two responses to this condition: ‘no recruitment’ and ‘no disadvantage’. The article is devoted to the study of an important problem - how to build a reliable model of interaction between the state and the individual based on the idea of social justice in modern society. This issue is especially relevant against the background of rapid political and social changes that require the unification of citizens around common values and a vision of the future. Renewal of the ideological foundation, which is the basis of national identity, as well as (...) the formation of a unified outlook on social justice can become a powerful driver of the state’s development.The main goal of the article is to find effective approaches to the modernization of society through the creation of a nationwide concept of social justice, which is able to unite society around common values and contribute to the formation of trust in social institutions. For this, the article refers to the theory of John Rawls «justice as honesty», which has already proven itself in European countries as an effective basis for establishing social harmony. The study also examines two main ethical concepts – «correctness» and «goodness», which complement Rawls’s theory and provide an opportunity to build a more stable ideological foundation for Ukraine.The research methodology includes systemic-analytical, historical, comparative and structural-functional approaches, which allow a comprehensive assessment of how mass attitudes and social attitudes affect the formation of the concept of justice in the country. Sociological methods were also used, which helped to identify shortcomings in the attitude of citizens towards state institutions and to determine the main directions for strengthening public consensus.The results of the study demonstrate that there is a lack of a generally accepted vision of social justice in Ukrainian society, and the lack of a single ideological reference point makes it difficult for citizens to consolidate around national priorities. Sociological surveys indicate a low level of trust in state institutions, which significantly slows down reform processes. Therefore, the implementation of the concept of social justice requires active cooperation between the public and the political elite, efforts to restore trust and build a positive vision of the future.As a result, the author of the article concludes that in order to build a just and prosperous society, it is necessary to update the existing approaches to social policy. Only through the creation of a common ideological field based on justice and an active citizen position, it is possible to achieve sustainable development of the country and ensure the consolidation of the nation. Much modern discussion of the morality of migration begins with the concept of coercion, and takes the coercive nature of border enforcement as especially salient in the moral analysis of migration policy. Much migration control, however, begins not with overt coercion, but with what I term manipulations; these are ways of making migration more difficult that do not resemble canonical cases of coercion. Examples include the alteration of the physical pathways between states, attempts to (...) deceive or mislead prospective migrants about what they will discover upon arrival, and the deliberate use of abstract and complex rules to make legal migration difficult or impossible. I argue that these manipulations are worthy of independent moral examination—and that the tradition of classical liberalism has resources with which to undertake this examination. (shrink)

For Europeans who strive for greater justice, there is no more cruel dilemma that the tension between maximal generosity towards the weakest among insiders and maximal hospitality towards the many outsiders who are keen, indeed sometimes desperate, to immigrate into the European Union. Opening the doors wide open would not only increase competition for the jobs, housing and public services which the least advantaged insiders need. It would also threaten the viability, both economic and political, of generous welfare state (...) institutions. And it would shake the fragile institutional framework that supports the imperfect yet exceptional combination of freedom and peace, of prosperity and solidarity which European citizens currently enjoy. Such a diagnosis may need qualification on several counts. But when endeavouring to determine what immigration policy the European Union should adopt, we should not deny or hide or minimize the dilemma it implies. Nor should we surrender to the demands it is likely to inspire to self-interested democratic majorities. We need a sensible conception of what a just world would be like and a pragmatic, no-nonsense, opportunistic approach to the measures that could take us closer to it in the messy world we live in. These measures are bound to be many. But there are at least two that deserve more attention than they usually receive: the efficient use of the diasporas present in our cosmopolitan cities and transnational interpersonal transfer schemes. The more than thirteen-year co-existence of the Ukrainian state and the Church in the qualitatively new conditions prevailing in the post-Soviet space together with the formation of an independent Ukraine, functioning during this period of state-church relations give reasonably reliable grounds for scientific analysis, a number of generalizations and conclusions regarding the results and conclusions conditions of state policy on religion, church and religious organizations, ensuring in Ukraine the right of everyone to freedom of (...) world view and religion - on the one hand, and repair and optimize -tserkovno and religious life - on the other. The fluid use of the terminology associated with “migration governance” can obscure its intention and implications. Different meanings of core terminology risks allowing troubling policies that are not really about migration, understood widely as border crossing, or even more broadly as human movement, to be legitimized. UN-level coordination with regard to “migration governance” needs to be part of addressing this concern. For example, this article advocates explicitly engaging with this risk through the implementation of the Global Compact (...) for Safe, Orderly and Regular Migration. It considers this issue from the perspectives of a handful of countries, each of which has its own complex relationship to the compact. It argues that in each of these apparently very different contexts, policies identified as being directed at “migration control” can be found to be directed not at controlling migration but at reconfiguring existing and stable state societies along ethnic, racial, linguistic, and other lines. The development of implementation plans for the Global Compact for Migration provides the opportunity to interrogate the purposes of “migration governance” and to find mechanisms to address its hidden uses. This article discusses the significance of international borders in Europe and Northeast Asia during the Cold War (1945–1989) and after. Using the concept of ‘moral hazard’, the article examines what happens when great powers frequently violate the borders of neighboring countries without suffering adverse repercussions. Norms of sovereignty and territorial integrity are viable only if large countries are willing to uphold them most of the time. The Soviet Union used or threatened to use military force against East European countries (...) on numerous occasions (1953, 1956, 1968, and 1980–1981) with impunity. The Russian Federation adopted a broadly similar policy toward neighboring countries that had been republics of the Soviet Union until 1991. Russian forces in Georgia, Moldova, Tajikistan, Belarus, and Ukraine served as instruments of Russian hegemony in those countries. Until 2014, Western governments made little or no effort to deter or counter Russian military encroachments in neighboring republics. By the principle of moral hazard, leaders in the Kremlin came to believe that they could act with a free hand in the former USSR. (shrink)

Who is to be included in a political community and on what terms? William A. Barbieri Jr. seeks answers to these questions in this exploration of the controversial concept of citizenship rights—a concept directly related to the nature of democracy, equality, and cultural identity. Through an examination of the case of Germany’s settled “guestworkers” and their families, _Ethics of Citizenship_ investigates the pressing problem of political membership in a world marked by increased migration, rising nationalist sentiment, and (...) the ongoing reorganization of states through both peaceful and violent means. Although some of Germany’s foreign workers have gradually attained a degree of social and economic legitimacy, Barbieri explains how they remain effectively excluded from true German citizenship. Describing how this exclusion has occurred and assessing current attitudes toward political membership in Germany, he argues for a just and democratic policy toward the tax-paying, migrant worker minority, one that would combine the extension of the individual rights of citizenship with the establishment of certain group rights. Through a dissection of ongoing public “membership debates” over issues such as suffrage, dual citizenship, and immigration and refugee policy, Barbieri identifies a range of competing responses to the question of who “belongs” in Germany. After critiquing these views, he proposes an alternative ethic of membership rooted in an account of domination and human rights that seeks to balance individual and group rights within the context of a commitment to democracy and equal citizenship. Until recently, the name of Metropolitan Alexy was mentioned by researchers, mainly historians and religious scholars, mostly in the context of the problem of the split of the Orthodox Church in the Ukrainian lands during the years of the Great Patriotic War of 1941-1943 as the head of the Autonomous Church. At the same time, he remains almost unknown as a religious thinker, and meanwhile, in his numerous theological-philosophical and historical-religious studies works, the bishop raised the most devastating religious and (...) spiritual problems of society and person, many of which have not lost their relevance to this day. Since Ukraine began to realize itself as a democratic country, the process of revising the relations of our state with various social institutions, including the Church, began to find a model that would ensure the harmonious development of both the state and the Church. The entry of Ukraine into a new period of formation of all spheres of social, economic, political, and spiritual development, when the statehood is restored, the multifaceted revival of the Ukrainian people, the problem of national, spiritual and moral and ethical education of student youth is activated. Spiritually - the moral crisis of Ukrainian society needs urgent return to spiritual sources. Ukraine has historically been a Christian state, and a return to Christian norms of morality and ethics (...) will help it to re-emerge and take its place among European countries. The revival of Christian morality can change society and, above all, young people need it. Therefore, we see as one of the means of spiritual revival of the nation, the introduction of an optional elective course "Fundamentals of Christian Ethics" in Ukrainian secondary schools. On 3 June 2008 the National Family Policy Concept was adopted by Seimas that states the goals and principles of the state family policy and several times refers to historical and scientific experience. The present article aims to reveal the historical and legal experience of the ancient Rome that laid foundations of contemporary private law and to compare the goals of the National Family Policy Concept and the state policy of the ancient (...) Rome regarding family issues. The concept of family framed by the National Family Policy Concept is based on matrimony. This is why the authors of the article focus on Roman matrimony. Having discussed the ancient Roman concept of marriage and Roman state policy regarding issues of matrimony and family and comparing it with the aims of the National Family Policy concept it might be stated that policy of encouraging family and promoting family relations based on matrimony that is provided by the Lithuanian state is not a new invention but may also refer to legal resolutions of the ancient Rome. The history of Iraq in the twentieth century, and perhaps the Middle East more broadly, is punctuated by an intellectual shift that has, for the most part, escaped the attention of scholars. It might be characterized as a shift from a problem of representation introduced by the rise of left-wing politics, to a problem of experience created by its failure. This shift registers in the work of writers and artists, where the depiction of the social world gave way to an (...) exploration of states of being. The paradigm for that turn inward in modern art was set by the artist Kadhim Haidar, in a series of paintings exhibited at the National Museum of Modern Art in Baghdad, in 1965, under the title The Epic of the Martyr [Malḥamat al-shahīd]. The paintings reconstructed imagery from the mourning processions that annually commemorate the martyrdom of the Prophet Muhammad’s grandson, al-Husayn. This paper argues that the ritual imagery contains a grammar of experience, forged in the early history of Islam, that linked justice to a state of being, and that the transposition of the imagery into painting activated that grammar in the artwork. The Russian invasion of Ukraine in 2022 inflicted severe damage on the country’s cultural heritage, triggering an upsurge in attempts to export cultural property across its borders. This paper deals with relevant issues related to the policy of Ukraine regarding the prevention of the export of cultural property abroad and the expertise of confiscated cultural property, as well as underscores the significance of enhancing state policy in this sphere in response to the challenges caused by (...) Russian invasion. The notable increase in illegal attempts to export antiquities abroad requires a revision of the procedure for appointing and conducting the expertise of confiscated objects. This primarily applies to excessively prolonged periods of expertise, the lack of uniform rules applicable to all art experts regardless of their affiliations, and the ambiguous criteria defining “cultural property” in Ukrainian legislation. The paper proposes measures to resolve these difficulties, including introducing preliminary expertise at customs control, unifying the requirements for experts’ conclusions, and clarifying definitions in legislation. The legal instruments for migration and asylum policies implemented by the European Union and its member States as part of th_e New European Agenda on Migration_ introduced by the European Commission in May 2015 has turned out to be not only ineffective, but also highly questionable in what concerns their consistency with the protection of Human Rights, the principles of liberal democracy, and even with those of egalitarian liberalism. As the author sees it, the problem derives from the challenges (...) posed by the management of cultural diversity (especially, _deep diversity_). The relevance of the research is in dynamism and information globalism in all life spheres of a modern post-industrial society, rises to the information one, necessitates multi-dimensional and multidimensional scientific discussions of information, high technologies and innovative breakthroughs in the plane of existing and necessary legal norms in conditions of formation technologies for introducing knowledge and rules for handling information as a resource for the development of modern man, societies and the state. This is actually began in the pre-election (...) program of the President of Ukraine Vladimir Zelensky, which aims to perceive possibilities of modern information and communication technologies in the administration of the state and the organization of public and politic life of the country in a qualitative and new way. Purpose of the research is the end-epitualization of the electronic paradigm of Ukraine in the context of the formation of information legislation for the innovative development of the state. Objectives of the research: 1) to identify new problems of information of the state to achieve a more active implementation of innovative ICT in the coordinates of the requirements for creating an e-government system in the country; 2) analysis of the implementation of the state information and communication functions, in a broader sense of the understanding of the concept of "state information policy"; 3) analysis of the role of high technology and the scientific and educational sphere in the conditions of the information civilization; 4) identification of the goal of the country's existence in the global world as an electronic state. The research methodology is a systematic and structural-functional analysis of the problem of the electronic paradigm of Ukraine in the context of the formation of information legislation for the innovative development of the state. The scientific novelty of the research is in structuring the problems of the electronic paradigm of Ukraine and finding ways to solve them. I provide an alternative to the two prevailing accounts of justice in immigration policy, the free migration view and the state discretion view. Against the background of an internationalist conception of domestic and global justice that grounds special duties of justice between co-citizens in their shared participation in a distinctive scheme of social cooperation, I defend three principles of justice to guide labor immigration policy: the Difference Principle, the Duty of Beneficence, and the Duty of Assistance. (...) I suggest how these principles are to be applied in both ideal and nonideal circumstances. Finally, I argue that the potential conflict between these principles has often been overstated, and propose priority rules for genuine cases of conflict. (shrink)

The article considers what arbitrary law-making is and what may count as arbitrary law-making in the field of migration policy. It contributes to the discussion of arbitrary law-making in relation to migration policy in two ways. First, it offers an analysis of arbitrariness, pointing out that rhetorical definitions abound – perhaps not surprisingly, given that migration is a highly-contested policy area – and argues for why transposing a conception developed in ethical theory to the (...) law has high theoretical costs. An alternative conception is described and found to be better equipped to deal with arbitrary law-making in migration policy. It is argued that if we want to understand how arbitrariness plays out in the field of migration law – which is necessary to find ways to hinder its spread by the adoption of specific law-making practices – we first need to distinguish arbitrariness from legitimate choices of legislators. Secondly, a typology of forms of arbitrariness is fleshed out in relation to contemporary migration policy. The policy area is here broadly construed to include not only naturalisation processes, but also migration, asylum and refugee policies and more generally border control. ExcerptThe high-water mark of globalization has passed. New competitions continue to emerge in a decidedly multipolar international system. As the United States views China and Russia as strategic competitors or worse, an array of mid-level powers—Iran, North Korea, Saudi Arabia, Turkey, India, the BRICS, and so forth—try to navigate this complex system and pursue their national interests. Meanwhile, no matter how much the United States and the European Union both believe themselves part of a single “West,” divergent interests tend to (...) drive them apart, even as tensions within the EU itself have grown sharper. In order to describe part of this increasingly competitive environment, an analytic distinction between so-called “civilizational states” and “liberal empires” seems to provide a framework to analyze international political processes in starkly contrasting terms.1 To some extent, the two terms repackage the terminology of the Cold War era that contrasted closed and open societies, and if we are indeed entering a new Cold War, the return of these categories is arguably appropriate. Yet more is surely at stake than a repetition of the historical competition between Communism and democracy, and the focus on the contrast between allegedly civilizational states and liberal empires may be missing a key part of the picture. Let’s take a closer look at the two concepts and then ask whether this binary provides an adequate toolkit to understand, for example, the conflict in Ukraine. To anticipate the conclusion: those who celebrate Russia as a “civilizational state” doing battle with the evil “liberal empire” of the West miss the key point in the conflict, the will of the Ukrainian people to assert their autonomy as a nation and to resist foreign occupation. After the full-scale invasion of the Russian Federation into Ukraine, the flow of forced migration from Ukraine has significantly increased as people tried to protect their lives and find a safe place to live. Given that Ukraine shares the external border with the European Union, most people sought protection precisely in the Member States of the European Union. The study aims to analyze the features of the legal regulation of the provision of temporary protection in the (...) European Union and determine the reasons and conditions that led to its activation after the full-scale invasion of the Russian Federation into Ukraine on February 24, 2022. The leading method of the research was the method of systematic analysis, which helped define temporary protection as a multifaceted phenomenon and determine the reasons and conditions that led to its activation in the European Union after the full-scale invasion of the Russian Federation into Ukraine on February 24, 2022. In order to regulate the mass influx of Ukrainian displaced persons, the European Union has activated the mechanisms of temporary protection, which is an emergency mechanism introduced by a decision of the Council of the European Union. The status of a person with temporary protection provides certain rights analyzed in the article. Thus, the activation by the European Union of the Temporary Protection Directive is a justified and appropriate measure to protect the mass influx of displaced persons from Ukraine. (shrink)

According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state (...) and co-citizens. In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. In an unpublished paper of 1693 John Locke weighed in on the ongoing debate in the English Parliament by declaring that there should be a “general naturalization” of all immigrants currently residing in England. His argument for this controversial policy was entirely economic and based on promoting England's interest in achieving greater wealth. He wrote nothing about the interests of the immigrants (most of whom were escaping religious persecution) nor did he appeal to the moral and political theory he (...) had so strongly proposed in Second Treatise of Government, published only a few years earlier in 1690. In this paper I look closely at the concepts of community and law in the state of nature and conclude that if Locke had employed the fundamental principles developed in Second Treatise he would have endorsed a far more radical policy that would have permitted the immigration and eventual naturalization of persons on humanitarian grounds. The application of these principles have important consequences for contemporary debates in the United States Congress and in other wealthy countries about the extent of the obligation to provide relief to foreigners who are escaping religious persecution, war, enslavement, hunger, and natural disaster. Can state sovereignty justify privileged receiving countries exercising authority over non‐members in a third country to safeguard their own interests? Under the current migration governance of the EU, state sovereignty is manifested in migrant interdiction, interception and detention policies employed to prevent unauthorized migrants from reaching the EU, and even from attempting to embark on cross‐Mediterranean journeys. While reinforcement of the Schengen region's external borders is a key aim of the EU's internal migration politics, collaboration with (...) third countries regarding migration control has, in the last decade, become a key feature of its external migration policy. In close collaboration with third countries, the EU has managed to curb the outflux of migrants from transit and sending countries. In effect, irregular migrants are prevented from exiting as well as from entering. This article explores the justifiability of such practices, by questioning commonly invoked models of justification such as the sovereignty “model”, with a special focus on partnership agreements regarding migration control between the EU and Libya. Poland has faced two waves of migration: the first was of irregular asylum seekers, which led to the humanitarian crisis on the eastern EU–Belarusian border since 2021; the second was of Ukrainians fleeing the Russian invasion. Although there are noticeable differences between these situations, and between the different reactions of the Polish authorities, it is possible to juxtapose them in terms of the right to health. The normative content of refugee and human rights law is the starting point for (...) reconstructing the meaning of the terms ‘refugee’ and ‘right to health’. A refugee is a person who needs international protection because of a well-founded fear of harm, which is not limited to persecution as defined by the Refugee Convention but also includes situations of international and non-international armed conflict. The right to health, which includes, inter alia, entitlements to a ‘system of health protection’ and ‘underlying determinations of health’, is reconstructed on the basis of human rights law and refugee and migration law. There are no legal and moral grounds to grant the right to health differentially to different groups of refugees. Nondiscriminatory health policy requires that refugees have the same access to health care as nationals, although their specific health needs resulting from past experiences and refugee situation require special treatment, that is, an appropriate refugee health policy. The broad understanding of the underlying determinants of health demonstrates the importance of overall migration policy for refugees’ health, which can jeopardise the fragile good of refugee health. ФAs an important indicator of protection of citizens, society and state, information security is an integral part of national security. Therefore, its definition is mainly focused on preventing those negative consequences that may arise from various information threats, as well as eliminating and overcoming these consequences with the least losses for society and a human. In this aspect, what has become particularly relevant is the research of not only philosophical, phenomenological and socio-psychological determinants of the information security of citizens, (...) but also political and legal resources and mechanisms of the information space of the state in the conditions of the functioning of the global information society. Unfortunately, Ukraine has not yet produced an effective model of the information security system of the state, society and a human, although the need for this is fixed at the constitutional level. Therefore, today it is very important to develop a holistic codifying document that would fully cover various aspects of the formation of national security policy, and also define a specific tool for its implementation. The author considers that it is important to pay attention to the development of the theoretical and methodological foundations of research of the problem of information security, which are focused on strict observance of national interests both at the internal and external levels. It is also necessary to form a comprehensive conceptual and theoretical basis that should cover the philosophical-political and information-technological aspect of the issue. A number of issues in the areas of national security and information in Ukraine in terms of concept theory and legislation and developing integral system of strategic tasks fulfillment in the practice of information society is considered. How should liberal societies select prospective members? A conventional reading of immigration history posits that whereas ascriptive characteristics drove immigration policy in the past, contemporary policy is based on the principle of nondiscrimination. Yet a closer look at the characteristics of those admitted reveals systematic group biases that run counter to liberalism’s core moral commitments. This article first discusses liberal states’ basic moral obligation to treat their citizens with equal respect. It then identifies ways in which the group (...) biases produced by immigration policy violate that principle, when states either deprive their citizens of fundamental rights or stigmatize them through hierarchical constructions of citizenship. Three mechanisms are presented—structural bias, profiling, and positive selection—by which seemingly liberal admissions policies produce illiberal outcomes. The empirical analysis explores the resulting discriminatory group biases in the context of language and income conditionalities on family migration, excessive demand restrictions against economic migrants, and visa waivers for international travelers. We conclude that immigration reforms that mitigate, if not erase, these morally problematic patterns are within the reach of liberal states. (shrink)

Ambiguous interpretation of the concept of gender equality has caused problems in understanding and legal support of the concept of gender. This and the global democratic process contribute to the relevance of the issue and generate the need for its thorough study. The article aims to define the essence of the concept “gender,” analyze the legal support of gender policy, and develop proposals for its improvement in Ukraine. In the study, we applied theoretical (analysis, synthesis, (...) generalization, systematization) and empirical (observation) methods. The article also uses methods of statistical and comparative analysis, extrapolation, dialectical method, etc. We analyzed the content of gender policy and its consequences and identified the features of its legal support and impact on society. To replace the concepts of gender, gender equality, and its derivatives with “equality of rights of men and women” proved expedient. Proposals for improving the legal support of gender policy in Ukraine were developed. The article has a multidisciplinary nature and will appeal to a broad readership from lawyers to psychologists to raise awareness and competence in this area. (shrink)
