In 2010, Martin Loughlin published his opus magnum Foundations of Public Law, the culmination of years of intensive research on the topics of public law and constitutional theory. In Questioning the Foundations of Public Law, Michael Wilkinson and Michael Dowdle put together a rich collection of papers that probe deeply into various facets of Loughlin’s work. In this review article, I critically examine an aspect of this probing, articulated by Wilkinson, to do with the autonomy of the political (...) as the basis of political jurisprudence. I argue that both the probing and Loughlin’s response articulate horns of a dilemma that points to a deeper issue: the epistemological repercussions of the rise of the social sciences as forms of distinctively modern inquiry into the causes of social phenomena, where these include phenomena such as the autonomy of political power in modern states. This article sets out a series of critical reflections on recent and contemporary theoretical literature that makes expansive claims for the status of the political as an autonomous category of social practice in modern society, and it argues that such theories usually rest on rather tautological and self-supporting constructions of society's politicality. To counter this, the article advocates and proposes a social-functional reconstruction of what, precisely, is political in modern society, and it suggests that modern societies are in (...) fact structurally dependent on their ability to reduce the volume of social exchanges that have to be articulated as specifically political. In particular, it asserts that many aspects of the legitimatory grammar of modern societies — especially rights and constitutions — are devices through which societies restrict their political concentration and de-politicize their primary functions. On this basis, the article concludes by proposing a more limited concept of the political that is socio-theoretically adjusted to, and usable in, the evolved form of a modern society. (shrink)

This article critically examines the transition from Marx to Spinoza within Antonio Negri’s postoperaist thought and explores a potential alternative rooted in Mario Tronti’s concept of the ‘autonomy of the political’. In Negri’s postoperaismo, the embrace of Spinoza reevaluates Marx’s critique of political economy through an optimistic lens, suggesting a tendency beyond capitalism. However, Negri’s embrace of a Spinozian plane of immanence entails a problematic affirmation of what exists. The article argues that Negri’s worldview, despite its beginnings, (...) ends up resembling deterministic historical materialism. While critical theory exposes flaws in Negri’s theory, it falls short in providing a practical alternative. Returning to Negri’s interpretation of Spinoza’s Political Treatise uncovers earlier arguments, rooted in paradoxes inherent to practical politics. However, reliance on the concept of the multitude highlights deeper issues in Negri’s approach. Rather than adhering to postoperaismo or critical theory, the article suggests an alternative in Tronti’s journey from operaismo, particularly in the concept of the ‘autonomy of the political’. Notwithstanding critiques, this attempted liberation from Marxist determinism allows for a clearer confrontation with politics. The article concludes that Hardt and Negri’s recent critical engagement with this concept advances their arguments but does not entirely overcome inherent limitations in their approach. (shrink)

Individuals use their capacity for autonomy to express preferences regarding food choices. Food choices are fundamental, universal, and reflect a diversity of interests and cultural preferences. Traditionally, autonomy is cast in only epistemic terms, and the social and political dimension of it, where autonomy obstruction tends to arise, is omitted. This reflects problematic limits in the Cartesian notion of the individual. Because this notion ignores context and embodiment, the external and internal constraints on autonomy that (...) extend from social location are not considered. Therefore, reconceptions of the individual and autonomy which emphasize social location and relational interdependency are needed. To combat autonomy obstruction, individuals can appeal to community and community autonomy as a social mechanism. Communities are social groups characterized by people living in places with shared goals. Recognizing their interdependency, individuals can organize as communities in order to accomplish objectives that they cannot on their own. While community autonomy is valuable unto itself, it can also enhance individual autonomy. (shrink)

Zdenko Kodelja's purpose in this essay is not to give a comprehensive explanation of the impact of neoliberal ideas and politics on authority (in all of its forms) of universities and their professors. His aims are much more modest: to sketch a theoretical framework for better understanding what the essence of authority is; to show that the relation between authority and trust is the key to explaining the effect of neoliberal politics on the authority of the university and university professors; (...) to discuss professors' autonomy as deriving primarily from epistemic authority and to point out that what makes professors epistemic authorities is not the truth of what they say, but rather the students' belief that it is true; and to disclose some problems related to authority, university autonomy, and neoliberal politics. Should the liberal state accommodate the cultural traditions of minority groups even if these traditions infringe upon the rights of women? This article discusses two empirical cases that pose just this problem for public policy in the Netherlands: requests for surgical reconstruction of the hymen and gender-selective abortion. While hymen reconstruction is linked to a cultural norm that young women, but not young men, remain virgins until marriage, sex-selective abortion is linked to a cultural preference for sons. The autonomy (...) of women is at issue in these cases in two ways: the traditions limit their autonomy, yet it is the women who demand the medical intervention. The cases illustrate the complexities of women's agency under oppressive social conditions. The author develops a moral argument concerning these two cases that understands the women in question as moral agents, while taking into account these complexities. The article does not pit multicultural and feminist concerns against each other. Instead, it is argued that good feminism may well require acts of multiculturalism. It is not desirable, so it is argued, to restrict access to abortion or to ban hymen repair. (shrink)

How should we read Foucault's claims, in his late work, for the relevance of ‘aesthetic criteria’ to politics? What is Foucault's implicit understanding of the nature of aesthetics and the autonomy of the aesthetic sphere? Would an ethics which gave a place to the aesthetic legitimize a politics of manipulation, brutality and aggression ‐ in short, a ‘fascist’ politics ‐ as some of Foucault's critics argue? In this paper, I examine key accounts of the fascist ‘aestheticization of politics’ ‐ (...) from Walter Benjamin's classic essay, ‘The Work of Art in the Age of Mechanical Reproduction’ (1936), to Philippe Lacoue‐Labarthe's work on the relation between Heidegger's philosophy and the fascist theme of politics as the plastic art of the state. Through a discussion of Foucault's late work, the paper demonstrates the connection between Foucault's turn to ancient Greek ethical practices and his call for a contemporary renewal of the idea of ethics as an art of living. The aim of the paper is to show in what ways the ethico‐political position which is presented in Foucault's late work, far from contributing to a fascist politics, in fact provides ways of thinking about the relationship between the aesthetic and the political which avoid both mindless radicalism and totalitarian narcissism. In doing so, the key question is, ‘What's aesthetic about Foucault's “aesthetics of existence"?’. (shrink)

ABSTRACT While democratic states may manipulate public opinion and mobilize society to serve their interests, a focus on such active efforts may distract us from the passive, default condition of ignorance‐based state autonomy. The electorate’s ignorance ensures that most of what modern states do is unknown to “society,” and thus need not even acquire social approval, whether manipulated or spontaneous. Similarly, suggestions that democratic states may be “captured” by societal groups must take cognizance of the factors that enable elites (...) to serve the interests of specific societal groups at the expense of the larger society. Bringing studies of voter ignorance into the analysis of state’s autonomy from society provides a novel approach to the study of democratic states’ autonomy, while also serving to explain how societal “capture” of state policies is possible. After so much scholarship has been devoted to the dispute between the defenders and critics of liberalism, it is reasonable to ask whether the topic has been exhausted or, at the very least, if the rival and incommensurable options have been so thoroughly defined that one simply has to pick a side. John Christman's new book, The Politics of Persons, demonstrates that this intuition is flawed. The women’s liberation movements that emerged in Britain in the late 1960s are rarely thought of through their relationship with technology and technical knowledge. To overlook this is to misunderstand the movement’s social, cultural and economic interventions; it also understates how the technical environment conditioned the emergence of autonomous, women-centred politics. This article draws on archival evidence to demonstrate how the autonomous women’s liberation movement created experimental social contexts that enabled de-skilled, feminised social classes to confront their technical environment and (...) the deficits they experienced within it. The context for forging such politics was the workshop. More than a one-off, skill-sharing event, the workshop was a mobile habitus, adapted from a Marxist craft politics that prioritised the distribution of collective knowledge and responsibility and enabled the realisation of women's self-determination and autonomy. The workshop was discursively extended through women-authored publications in the 1970s and 1980s and designated a specific orientation within knowledge that supported women to practise a range of technical knowledge and gain expertise. An important, and largely forgotten political legacy of women's liberation is its world-making activisms: how it created social contexts that supported de-skilled, feminised classes to substantially intervene, shape and re-build their environments. Such histories can inspire how we practise politics today within an environment characterised, some theorists claim, by dramatic scales of de-skilling and dispossession. (shrink)

Much modern liberal political theory takes the concept of autonomy as central and argues that political arrangements are to be assessed, in some part, by their ability to foster the development of individual autonomy understood as being the author of one's own life. This paper argues that so understood, autonomy is less important than is usually thought The liberal requirement that we 'author' our own lives disguises the importance of also being accurate readers of our (...) own lives. I explore the metaphor of reading through a discussion of the character of Nora in Ibsen's Doll's Houseand argue that Nora's case demonstrates the limitations of the liberal understanding of autonomy as involving authorship of one's own life. It is both an ideal and an assumption of traditional conceptions of justice for liberal democracies that citizens are autonomous, self-governing persons. Yet standard accounts of the self and of self-government at work in such theories are hotly disputed and often roundly criticized in most of their guises. John Christman offers a sustained critical analysis of both the idea of the 'self' and of autonomy as these ideas function in political theory, offering interpretations of these ideas which avoid (...) such disputes and withstand such criticisms. Christman's model of individual autonomy takes into account the socially constructed nature of persons and their complex cultural and social identities, and he shows how this model can provide a foundation for principles of justice for complex democracies marked by radical difference among citizens. Carl Schmitt's Concept of the Political advances an understanding of the political in which the political is assessed in terms of the autonomy of the friend-and-enemy distinction. This article questions the autonomous foundations of Schmitt's concept of the political. Ultimately, Schmitt's desire to establish the autonomous nature of the political, allowing the specifically political antithesis to achieve mastery over all other forms of discourse, is replete with paradox. Whilst Schmitt endeavours to establish the (...) autonomy of the political—where the political is free from interference from other domains—it is argued that his account of the political is highly dependent on the state. More critically, Schmitt's depiction of the political as autonomous is a strategic manoeuvre to establish the autonomy of the domain of the political vis-à-vis other conceptual domains. (shrink)

Contemporary Anglo-American political thought is witnessing a revival of theories of deliberative democracy. The principle of public argumentation, according to which the legitimation of a general norm is predicated upon a rational and open dialog among all those affected by this norm, constitutes their common underlying assumption. This assumption is itself grounded in the metatheoretical claim that arguing is the defining activity of a demos of free and equal members. Habermas' well-known formulation of communicative or discursive democracy represents one (...) of the earliest, most discussed, and indeed most emblematic versions of the existing models of deliberative democracy. It is here, I believe, that Castoriadis' political theory can prove exceptionally important as it provides a starting point and a solid ground for articulating one of the most incisive and convincing critiques of the limits and flaws of communicative democracy. Although Castoriadis himself never directly discussed deliberative democracy as such, we can try to approximate from various parts of his work what he might have thought about, especially when it comes to Habermas' model. We fear that the growing threat of violent attack has upset the balance between existential concepts of political power, which emphasize security, and traditional notions of constitutional limits meant to protect civil liberties. We worry that constitutional states cannot, during a time of war, terror, and extreme crisis, maintain legality and preserve civil rights and freedoms. David Williams Bates allays these concerns by revisiting the theoretical origins of the modern constitutional state, which, he argues, recognized and made room for (...) tensions among law, war, and the social order. We traditionally associate the Enlightenment with the taming of absolutist sovereign power through the establishment of a legal state based on the rights of individuals. In his critical rereading, Bates shows instead that Enlightenment thinkers conceived of political autonomy in a systematic, theoretical way. Focusing on the nature of foundational violence, war, and existential crises, eighteenth-century thinkers understood law and constitutional order not as constraints on political power but as the logical implication of that primordial force. Returning to the origin stories that informed the beginnings of political community, Bates reclaims the idea of law, warfare, and the social order as intertwining elements subject to complex historical development. Following an analysis of seminal works by seventeenth-century natural-law theorists, Bates reviews the major canonical thinkers of constitutional theory (Locke, Montesquieu, and Rousseau) from the perspective of existential security and sovereign power. Countering Carl Schmitt's influential notion of the autonomy of the political, Bates demonstrates that Enlightenment thinkers understood the autonomous political sphere as a space of law protecting individuals according to their political status, not as mere members of a historically contingent social order. In this new study of Rousseau, Levine presents a Kantian reading of the Social Contract. By attempting to reveal Rousseau’s anticipation of such Kantian themes as moral right and obligation the author’s purpose has been "to produce a Kantian reading of The Social Contract, a reading that emphasizes the many respects in which Rousseau anticipates Kant and motivates his investigations in moral philosophy". This purported similarity has been noted previously by thinkers such as Hegel and Cassirer. The book also develops (...) the theme that the solution to the conflict between moral autonomy and political authority is the main issue in The Social Contract. Because Rousseau apparently "grasped his conflict better than either Hobbes or Locke" he was able to anticipate Marx’s critique of the contractarian tradition. Consequently, Rousseau’s political philosophy underlies the "deep structure" of contemporary mentality, and continues to dominate our own sense of self, society, and being-in-the-world. While the main issues in Kant’s moral philosophy—autonomy/heteronomy, person/thing, rule of reason/heteronomous irrationalism—are present in ovo in Rousseau, the author warns us of crucial differences between the two thinkers, for example, in Kant the notion of our being forced to our own freedom is absent. But both thinkers share the belief that any conception of the state’s function as merely external coercion or coordination is sub-rational. Also, Kant’s conception of moral autonomy located in the de jure kingdom of political ends is anticipated in Rousseau’s attempt to direct society to the norm of the general will as its legitimate political end. In sum, Levine’s book, while drawing from the previous work of Althusser, avoids the usual Marxist concept manipulation, and gives us an interesting addition to Rousseau scholarship.—H.N.T. (shrink)

This paper suggests that genealogy is an exemplary form of critique. The stakes of this argument are established in the course of on intial response to critics of genealogy such as Habermas and Fraser throght the distinguishing of legislative and exemplary forms or critique. The essay then goes on to to show how Foucault's central concern, namely, the relation of humanism and bio-power, leads him to articulate an ethics of creativity which exhibits an ethods of ironic heroization and discloses a (...) conception of the political as agon. Reflecting on these features of genealogy's saying, it is argued that the form of genealogical reflection manifests these features. This emphasis on the showing of genealogy leads to the claim that Foucault's anti-humanism, mode of historical consciousness and perspectivism reproduce the substantive commitment of genealogy to the value of autonomy within the structure of genealogical reflection. The political self is a concept which is fundamental to political theory. This work focuses an liberal democratic theory because this type of political theory privileges the individual. It is ideal ground for rethinking a concept of the political self. ;I propose to look at abstractions and idealizations which are theoretical tools used in determining a concept of the political self. These: valuable theoretical manoeuvres are not value-neutral. A critical stance must always be taken when (...) such conceptualizations are undertaken. The conception of the political person in the theory of John Rawls will be examined through the lens of the concepts of autonomy and difference. This will focus our attention to the particular theoretical endeavours which-have excised certain features from the concept of the political person. I argue that the fiction of the 'persons in the original position' in Rawls's theory has been extended to an ideal of the political person which excludes certain individuals. This extension is unwarranted and detrimental to some individuals. ;I analyze the categories of the public-private since these are tied to a notion of the self. I claim that profound difference cannot be accommodated within the public realm of traditional liberal theory; it forces the concerns of certain individuals, such as care givers and persons with severe incapacities, into the private realm. These individuals are relegated to the private sphere only and consequently suffer from a devalued moral status. This devalued moral status within political society comes from the fact that they can not approximate the ideal of a fully cooperating member of society. This, I argue, goes against the ideal of a just society which values selves as individuals of equal moral worth. ;Finally, I suggest that our theorisation has always involved a certain detachment from bodily concerns. These have been erased from our theoretical considerations; I claim they have theoretical import. I suggest that we need to think of the political self as a whole self. The liberal focus on interests or goods should be supplemented by an understanding of needs. The latter address our interdependency as well as our vulnerability. The call for political presence is more than just a call to be heard, it's a call to be seen and recognized in the flesh. (shrink)

An attractive form of social stability is realized when the members of a well-ordered society give that society’s organizing principles their free and reflective endorsement. However, many political philosophers are skeptical that there is any requirement to show that their principles would engender this kind of stability. This skepticism is at the root of a number of objections to political liberalism, since arguments for political liberalism often appeal to its ability to be stable in this way. The (...) aim of this paper is to address skepticism about the stability condition by putting forward a novel defense of it. This article contends that the environmental release of genetically engineered (GE) animals with heritable traits that are patented will present a challenge to the efforts of nations and indigenous peoples to engage in self‐determination. The environmental release of such animals has been proposed on the grounds that they could function as public health tools or as solutions to the problem of agricultural insect pests. This article brings into focus two political‐economic‐legal problems that would arise with the environmental release of (...) such organisms. To address those challenges, it is proposed that nations considering the environmental release of GE animals must take into account the underlying circumstances and policy failures that motivate arguments for the use of the modified animals. Moreover, countries must recognize that the UN International Covenant on Civil and Political Rights and the UN International Covenant on Economic, Social and Cultural Rights place on them an obligation to ensure that GE animals with patented heritable traits are not released without the substantive consent of the nations or indigenous peoples that could be affected. This article argues for a new interpretation of the realist claim that politics is autonomous from morality and involves specific political values. First, this article defends an original normative source: functional normativity. Second, it advocates a substantive functional standard: political institutions ought to be assessed by their capacity to select and implement collective decisions. Drawing from the ‘etiological account’ in philosophy of biology, I will argue that functions yield normative standards, which are independent from morality. For example, a (...) ‘good heart’ is one that pumps blood well, and a good army is one that it is effective at exerting military force. I then interpret realism’s naturalistic conception of politics as an etiological function of social groups: namely making binding collective decisions under persistent disagreement. I conclude that political institutions should be evaluated realistically by how well they perform this task. Finally, I assess trade-offs between this functional political normativity and other moral values. I conclude that justice, fairness, freedom and equality remain obviously important concerns, but only once the basic political function is secured. (shrink)

Autonomous decision-making over therapy options is not reducible to the refusal of unwanted medical intervention. This is a myth that has been imported from questionable assumptions in political economy, and is of little benefit to medical practice and the sometimes agonizing decisions which have to be taken by patients and their relatives. An individual's right to therapy abatement can be protected from abuse only in the context of a full understanding of autonomous choice; not merely the right to refuse, (...) but the opportunity to receive assistance and consider alternatives. Limits are also required on the role of the surrogate in the refusal of therapy. Policies endorsing therapy abatement and exercise of the right to forego life-sustaining therapy should carry cast iron guarantees that they will not be disadvantageous to the poor and undereducated members of society. It should also be noted that fears of unlimited life-prolongation have been greatly exaggerated. In an atmosphere of governmental indifference to the plight of the sick, with the notion of welfare tuned to market forces, there is a danger that self-determination can have a restricted meaning; the option of death in the context of an underfunded health service. This may not be the time to campaign for the right to refuse therapy, but rather the time to campaign for improvements to existing therapy. (shrink)

It is a commonplace that ‘autonomy’ has several different senses in contemporary moral and political discussion. The term’s original meaning was political: a right assumed by states to administer their own affairs. It was not until the nineteenth century that ‘autonomy’ came (in English) to refer also to the conduct of individuals, and even then there were, as now, different meanings.1 Odd as it may seem from our perspective, one that was in play from the beginning (...) was Kant’s notion of “autonomy of the will,”2 as Kant defined it, “the property of the will by which it is a law to itself independently of any property of the objects of volition” (4:440).3That’s a mouthful, to say the least. In The Autonomy of Morality Charles Larmore challenges two ideas that have shaped the modern mind. The world, he argues, is not a realm of value-neutral fact, nor does human freedom consist in imposing principles of our own devising on an alien reality. Rather, reason consists in being responsive to reasons for thought and action that arise from the world itself. Larmore shows that the moral good has an authority that speaks for itself. Unilateral coercive international political, diplomatic, and economic sanctions are regular events of international relations and international law within the landscape of foreign affairs. However, while they may be prescribed by international law, or national legal systems, for peace and security reasons they have also been imposed for political grounds by powerful States such as the United States. The US sanctions are now targeting science, academic and university domains. When applied in this way, these sanctions violate international law, principles (...) of human rights, ethics, the autonomy of scientific institutions, and the norm of universalism in science. All of which protect and promote scientific freedom of expression. It is vital that international and domestic law be correctly applied to uphold proper ethical standards and scientific independence in order to protect the work and the freedom of scholarship. Research on autonomy exhibits a constellation of variegated perspectives, from the problem of the crude deprivation of it to the study of the distinction between personal and moral autonomy, and from the problem of the role of a “self as narrator”, who classifies its own actions as autonomous or not, to the importance of the political side and, finally, to the need of defending and enhancing human autonomy. My precise concern in this article will be the (...) examination of the role of the human cognitive processes that give rise to the most important ways of tracking the external world and human behavior in their relationship to some central aspects of human autonomy, also to the aim of clarifying the link between autonomy and the ownership of our own destinies. I will also focus on the preservation of human autonomy as an important component of human dignity, seeing it as strictly associated with knowledge and, even more significantly, with the constant production of new and pertinent knowledge of various kinds. I will also describe the important _paradox of autonomy_, which resorts to the fact that, on one side, cognitions (from science to morality, from common knowledge to philosophy, etc.) are necessary to be able to perform autonomous actions and decisions because we need believe in rules that justify and identify our choices, but, on the other side, these same rules can become (for example, as a result of contrasting with other internalized and approved moral rules or knowledge contents) oppressive norms that diminish autonomy and can thus, paradoxically, defeat agents’ autonomous capacity “to take ownership”. Marcel Gauchet has launched one of the most ambitious and controversial works of speculative history recently to appear, based on the contention that Christianity is "the religion of the end of religion." In The Disenchantment of the World, Gauchet reinterprets the development of the modern west, with all its political and psychological complexities, in terms of mankind's changing relation to religion. He views Western history as a movement away from religious society, beginning with prophetic Judaism, gaining tremendous momentum in (...) Christianity, and eventually leading to the rise of the political state. Gauchet's view that monotheistic religion itself was a form of social revolution is rich with implications for readers in fields across the humanities and social sciences. Life in religious society, Gauchet reminds us, involves a very different way of being than we know in our secular age: we must imagine prehistoric times where ever-present gods controlled every aspect of daily reality, and where ancestor worship grounded life's meaning in a far-off past. As prophecy-oriented religions shaped the concept of a single omnipotent God, one removed from the world and yet potentially knowable through prayer and reflection, human beings became increasingly free. Gauchet's paradoxical argument is that the development of human political and psychological autonomy must be understood against the backdrop of this double movement in religious consciousness--the growth of divine power and its increasing distance from human activity. In a fitting tribute to this passionate and brilliantly argued book, Charles Taylor offers an equally provocative foreword. Offering interpretations of key concepts proposed by Gauchet, Taylor also explores an important question: Does religion have a place in the future of Western society? The book does not close the door on religion but rather invites us to explore its socially constructive powers, which continue to shape Western politics and conceptions of the state. (shrink)

Authenticity has become one of the defining ideals of the modern world. It is the quality we are meant to demand in that which we consume; a value to be opposed to all that is ‘fake’ or ‘phoney’ or ‘artificial’. Above all, it is what an individual is meant to aspire to be: true to one’s self, self-actualising and self-expressing. Authenticity today has an almost ethical force. It underpins identity politics, legitimises transgenderism and informs the ubiquitous demand for often legal (...) recognition and informal respect. But what does its elevation say about the condition of modernity? What is its historical and conceptual relationship to ideas of freedom and autonomy? And to what extent is it really possible or even desirable, as Shakespeare’s Polonius insisted it was, to be true to thine own self? (shrink)

Levine’s Kantian reading of Rousseau’s social contract is a legitimate enterprise. Accordingly, he rightly distinguishes the a priori from the a posteriori elements of the work. The former becomes the ground of liberty, rebaptized as autonomy. The latter is devoted to a discussion of the relation of theory to practice.

The contributors to _The Anomie of the Earth_ explore the convergences and resonances between Autonomist Marxism and decolonial thinking. In discussing and rejecting Carl Schmitt's formulation of the nomos—a conceptualization of world order based on the Western tenets of law and property—the authors question the assumption of universal political subjects and look towards politics of the commons divorced from European notions of sovereignty. They contrast European Autonomism with North and South American decolonial and indigenous conceptions of autonomy, discuss (...) the legacies of each, and examine social movements in the Americas and Europe.
