ABSTRACT:The distinction between what I call nonelective obligations and discretionary obligations, a distinction that focuses on one particular thread of the distinction between perfect and imperfect duties, helps us to identify the obligations that carry over from principals to agents. Clarity on this issue is necessary to identify the moral obligations within “shareholder primacy”, which conceives of managers as agents of shareholders. My main claim is that the principal-agent relation requires agents to fulfill nonelective obligations, but it does not always (...) require discharging discretionary obligations. I show that the requirement to fulfill nonelective obligations is more far-reaching than has been acknowledged by most defenders and critics of shareholder primacy. But I also show that managers are not bound by certain discretionary obligations like charity, showing that their moral obligations are more circumscribed than the obligations that apply to human beings in general. It has been a common claim that surrogacy is morally problematic since it involves harm to the child or the surrogate—the harm argument. Due to a growing body of empirical research, the harm argument has seen a decrease in popularity, as there seems to be little evidence of harmful consequences of surrogacy. In this article, two revised versions of the harm argument are developed. It is argued that the two suggested versions of the harm argument survive the current (...) criticism against the standard harm argument. The first version argues that the child is harmed by being separated from the gestational mother. The second version directs attention to the fact that surrogacy involves great incentives to keep the gestational mother’s level of maternal-fetal attachment low, which tend to increase the risk of harm to the child. While neither of the two arguments is conclusive regarding the moral status of surrogacy, both constitute important considerations that are often ignored. (shrink)

Martha Nussbaum’s capabilities approach is today one of the most influential theories of justice. In her earlier works on the capabilities approach, Nussbaum only applies it to humans, but in later works she extends the capabilities approach to include sentient animals. Contrary to Nussbaum’s own view, some scholars, for example, David Schlosberg, Teea Kortetmäki and Daniel L. Crescenzo, want to extend the capabilities approach even further to include collective entities, such as species and ecosystems. Though I think we have strong (...) reasons for preserving ecosystems and species within the capabilities approach, there are several problems with ascribing capabilities to them, especially if we connect it with the view that species and ecosystems are subjects of justice. These problems are partly a consequence of the fact that an ascription of capabilities to species and ecosystems needs to be based on an overlapping consensus between different comprehensive doctrines, in accordance with the framework of political liberalism on which the capabilities approach builds. First, the ascription of capabilities to species and ecosystems presupposes the controversial standpoint that they are objectively existing entities. Second, the ascription of capabilities to ecosystems and species and the view that they are subjects of justice is justified by claiming that they have integrity and agency, but these characteristics have different meanings when applied to collective entities and humans, respectively. Third, the view that species and ecosystems are subjects of justice seems to require the controversial assumption that they have interests of their own, which differ from the interests of the sentient beings that are part of them. However, even if we do not ascribe capabilities to species and ecosystems and regard them as subjects of justice, there are still strong reasons to protect them within the capabilities approach, as the preservation of ecosystems and species is an important precondition for many human and animal capabilities. This essay explores Bernard Williams’s portrayal of his, Alasdair MacIntyre’s, and Charles Taylor’s views on how to move in relationship to religion in our modern world: backward in it (MacIntyre), forward in it (Taylor), and out of it (Williams). I contend that this portrayal is not entirely accurate in each case, though there is some truth in it, and that looking at each author’s view on the relationship of religion to modernity is instructive for those of us who wish to (...) keep religious faith alive in our modern, secular age. I begin with Williams, and then discuss MacIntyre and Taylor in turn. I seek to show how MacIntyre and Taylor can help us to overcome the challenge to religious faith that Williams presents and how both offer important guidance for the life of faith in our modern, secular age. Courtroom talk in child custody interrogations recurrently features contrasting event descriptions about ‘what happened’, as well as contrasting person descriptions. This case study – from a large set of audio-recorded courtroom examinations – documents how social workers’ contrasting narrative versions about alleged domestic violence are related to divergent problem formulations. Blame-account sequences feature descriptions of a particular event as violent or nonviolent and descriptions of a new partner as ‘non-adult’ or merely as ‘impulsive’ but ‘concerned’. Other contrasting person descriptions (...) feature a target child either as ‘normal’ or as someone who ‘has a diagnosis’. This involves categorizations of the particular child either as a victim or as someone ‘with a diagnosis’, two contrasting accounts that provide divergent explanatory formulations of what the overall problem is. Ultimately, divergent testimonies also reflect how social accounts in court reflect both mitigated/aggravated descriptions of violence and divergent accounts of parents’ and children’s agency and accountability. Let me offer you some reflections of a general nature. My primary objective is to set out at least some of the problems I encountered in my first approaches to this topic. Of course, people can say that a discourse on this topic is premature, that the Soviet period of our history is not even history in the strict sense, at least not for representatives of the generation that passed a good proportion of its creative life in it. For them (...) this is not history but life, passions that have not been and, perhaps, never can be overcome, likes and dislikes that are rooted in the brain and the heart. This is our fate, if you will, and, as they say, it is best left alone. That is true. We, of course, still relate to our philosophical past emotionally, for the most part, rather than in an investigative, intellectual, objective spirit. And yet, "an epoch has come to a close. Cross-dressing, as a cultural practice, suggests gender ambiguity and allows freedom of self expression. Yet, it may also serve to reaffirm ideological stereotypes and the binary distinctions between male and female, masculine and feminine, homosexual and heterosexual. While in the realm of scholarly debate on intergenerational justice the mechanism of a transgenerational intertwinement has been often adopted as a chief conceptual device in view of overcoming ethical short-termism and legitimizing duties towards future generations, this paper aims at showing that there are good reasons for considering the opposite outcome. Drawing on three paradigmatic examples taken from three mainstream approaches in the debate—Rawls’s contractualism, Gauthier’s contractarianism, and indirect reciprocity—I will show how the grammar of presentism is still largely (...) operative under the surface of theories explicitly recurring to such a device and thereby advocating a chain of duties capable to reach the remote future. A short closing section will be devoted to endorsing a radical reorientation in ethics, such that a direct link to future invocations will be considered as a promising strategy for genuinely justifying intergenerational obligations. As it comes to animal ethics, broad versions of contractualism are often used as a reason for excluding animals from the category of those with moral value in the individualistic sense. Ideas of “reciprocity” and “moral agency” are invoked to show that only those capable of understanding and respecting the value of others may have value themselves. Because of this, possible duties toward animals are often made dependent upon altruism: to pay regard to animals is to act in an (...) other-regarding manner instead of mutual benefit. There are three main versions of altruism in animal ethics. The first one of these is the most traditional, and emphasises benevolence as a source of moral regard. The second concentrates on the notion of value, and claims that animals have value in the individualistic sense despite being incapable of moral agency. The third resists overt theory-dependency, often included in the second version, and concentrates more on the elements of “context” and “identification”. Out of these, a combination of the last two is identified as the most fruitful basis for altruistic animal ethics. (shrink)

When Taylor Swift's record label was sold in 2019, the six studio albums she recorded for them came under the control of a person with whom she has had years of bad blood: Kanye West's former manager Scooter Braun. But rather than move on, Swift chose to take the unprecedented step of re-recording duplicate versions of those albums. With all of the profits made from selling, streaming, and licensing these “Taylor's Versions” going directly to Swift, she could deprive (...) Braun of potentially hundreds of millions of dollars. The gambit has already paid off. The first two Taylor's Versions (of Fearless and Red) debuted at Number 1 on the Billboard charts and have sold over one million copies so far; and four more are still on the way. In this book, nine philosophers and one music producer explore the philosophical richness of Swift's project and the questions it raises: Are Swift's re-recordings new works of art or mere copies of the originals? This article first briefly examines the textual structure of the Bhikkhu Samyutta of the Pali Samyutta-nikaya in conjunction with two other versions preserved in Chinese translation in Taisho vol. 2, nos. 99 and 100. Then it compares the main teachings contained in the three versions. These three versions of this collection on the subject of monks represent three different early Buddhist schools within the Sthavira branch. This comparative study of these three different versions focuses on four (...) major topics: physical appearance, Dharma talk, solitude, and heat meditation. Ḥaydar al-Harawī (d. 825/after 1427) was a significant scholar from Khorasan who migrated to the Ottoman lands. A distinguished student of al-Taftazanī, he earned high regard from Mehmed I and received patronage from him. al-Harawī dedicated his commentary on al-Zamakhsharī’s al-Kashshāf to Mehmed I with exaggerated expressions of praise and provided significant details about his biography in the introduction of the work. After spending many years in Ottoman lands, al-Harawī established contact with Shahrukh, the son of Timur. He rewrote the (...) introduction of Sharḥ al-Kashshāf and ded- icated the work to Shahrukh. This new patronage relationship is evident in the second version of the introduction, where not only the dedication part but also the content was rearranged concerning the new patron’s identity. Important biographical details not found in the first version are included in the second version, making it a crucial source for al-Harawī’s biography. This article brings the second version of the introduction to light for the first time, constructing al-Harawī’s biography by compiling information from both versions. While no specific dates are provided in either version, the duration of al-Harawi’s stay in certain cities is mentioned. Gaps in the narrative were filled based on histori- cal events, allowing for accurate dating of approximately forty years of al-Harawī’s life, from Sarakhs through Shiraz, Tabriz, Shirvan, Bursa, Edirne, and back to Khorasan. This comprehensive overview sheds light on the relationship between scholars and rulers, the influence of political developments on scholarly life, and the intellectual world of a scholar dedicated to the pursuit of knowledge. Interpersonal Needs Questionnaire is a self-report measure of perceived burdensomeness and thwarted belongingness with five versions in recent studies. There are five versions of INQ. But results from studies using different versions are quite different. Current suicide behavior among teenagers has attracted much attention. But which version is more suitable for teenage samples is still uncertain. It is important to compare the potential differences in different versions of INQ to identify the most psychometrically available version to (...) predict teenagers' acquired capability for suicide and provide them with timely help to reduce teenagers' suicide rates. This study compared the construct validity, internal consistency, validity, and average test information of each version in the sample of teenagers. Results showed the 10-item version provided the most average test information in both thwarted belongingness subscale and perceived burdensomeness subscale, and the INQ-10 is more suitable for teenage samples. BackgroundMeasurement of tinnitus-related distress and treatment responsiveness is key in understanding, conceptualizing and addressing this often-disabling symptom. Whilst several self-report measures exist, the heterogeneity of patient populations, available translations, and treatment contexts requires ongoing psychometric replication and validation efforts.ObjectiveTo investigate the convergent validity and responsiveness of the German versions of the Tinnitus Questionnaire [TQ], Tinnitus Handicap Inventory [THI], and Tinnitus Functional Index [TFI] in a large German-speaking sample of patients with chronic tinnitus who completed a psychologically anchored 7-day Intensive (...) Multimodal Treatment Programme.MethodsTwo-hundred-and-ten patients with chronic tinnitus completed all three questionnaires at baseline and post-treatment. Intraclass correlation coefficients determined the convergent validity of each questionnaire’s total and subscale scores. Treatment responsiveness was investigated by [a] comparing treatment-related change in responders vs. non-responders as classified by each questionnaire’s minimal clinically important difference-threshold, and [b] comparing agreement between the questionnaires’ responder classifications.ResultsThe total scores of all three questionnaires showed high agreement before and after therapy. All total scores changed significantly with treatment yielding small effect sizes. The TQ and TFI yielded comparable and the THI higher responder rates. The TQ | THI and TQ | TFI showed fair, and the THI | TFI moderate agreement of responder classifications. Independent of classification, responders showed significantly higher change rates than non-responders across most scores. Each questionnaire’s total change score distinguished between responders and non-responders as classified by the remaining two questionnaires.ConclusionThe total scores of all three questionnaires show high convergent validity and thus, comparability across clinical and research contexts. By contrast, subscale scores show high inconsistency. Whilst the TFI appears well suited for research purposes, the THI may be better suited to measure psychological aspects of tinnitus-related distress and their changes with accordingly focused treatment approaches. Emotion recognition plays an important role in children’s socio-emotional development. Research on children’s emotion recognition has heavily relied on stimulus sets of photos of adults posed stereotyped facial configurations. The Child Affective Facial Expression set is a relatively new stimulus set that provides researchers with photographs of a diverse group of children’s facial configurations in seven emotional categories—angry, sad, happy, fearful, disgusted, surprised, and neutral. However, the large size of the full CAFE set makes it less ideal for research in (...) children. Here, we introduce two subsets of CAFE with 140 photographs of children’s facial configurations in each set, diverse in the race and ethnicity of the models, and designed to produce variability in naïve observers.
