This paper argues that Kant’s distinction between “civil union” and “ethical community” can be of great value in dealing with a problem that causes considerable trouble in contemporary political and social philosophy, namely the question of the normative significance and role of religion in political and social life. The first part dwells upon the third part of Kant`s Religion within the Boundaries of Mere Reason with the intention of exposing the general features of ethical community. It highlights the (...) fact that Kant considers publicity, and indeed public authority, to be constitutive of the ethical community. The second part discusses his argument that we have a unique ethical duty to enter into an ethical community. This discussion clarifies the constitutive purpose of ethical community and sets forth why Kant thought that the ethical community should have a religious form. The third part presents an account of the constitutive purpose of the state in light of the Doctrine of Right. Throughout these steps, as is concluded, the essentials of a model for the relations between law, ethics, and religion emerge, which shows the way in which both religious and secularist worries can be met on a principled basis. William Dean is a tireless proponent of a public role for religion in American society, most recently in his American Academy of Religion award winning book The Religious Critic in American Culture . He writes there about the importance of, and need for, both a common American spiritual culture and public intellectuals who would understand, criticize, and innovatively rework that shared American religion. Dean represents a metaphysical strand of American pragmatism. His thought is rooted in (...) William James’s radical empiricism, Bernard Meland’s and Bernard Loomer’s empirical theology, and Alfred North Whitehead’s process metaphysics. He takes seriously what I will call the problem of cosmic estrangement. The American public religion that he advocates, among other things, is supposed to resolve that problem. An embedded ideology of the religious-secular binary in its various forms has assumed currency in recent continental and Anglo-American political thought. This ideology highlights the difference between religion under modernization, broadly defined by the secularization thesis, and that of religious revival in a period characterized by postsecularism. It reflects the rise of new epistemologies and the dissolution of the antinomies between faith and reason characteristic of a postsecular culture. In pre-democratic – also pre-modern – times, religion had been at the centre of much of human life, filling the private as well as the public realm of people’s daily existence. However, with the change to democratic rule in major countries in the modern world (see, most influentially, Article 1 of the French Constitution after the French Revolution and the First Amendment to the Constitution of the United States, influencing all other democracies in their wake), religion has (...) for the most part reflexively been sidelined from public life. Or has it? Does religion not still hold a special place in law in democratic societies, but now in reverse? Firstly, whereas matters of religious faith had throughout the greater part of human history been included in matters of politics, it is now as a matter of course of law excluded, purposely so. Religion is thus still a ‘special case’, a unique aspect of humanity when compared to all other matters, in law as much as in politics and other aspects of public life. Secondly, in the post-secular cultural climate dawning across the world, matters of faith (religion, spirituality) are no longer as stringently excluded from public life, which impacts directly on how religion is touched upon in law, sociology, philosophy, music and other academic disciplines too. Our dawning post-secular age is bringing something new. Two scholars, who have been doing foundational work in this regard, have done so fully in parallel, not taking cognisance of the mutualities in their academic contributions. Otto in Munich, Germany, has been combining his two areas of expertise, the Pentateuch in the Hebrew Bible and the sociologist Max Weber, to indicate the trajectory through history of democratic impulses from Ancient Near Eastern founding documents into the current era. Benson in Sydney, Australia, has on his part been drawing on his expertise in law as practised in Canada and taught in Europe, South Africa and Australia to indicate how, in inclusively liberal democracies, law cannot justifiably be used to exclude religion from the public domain, as has been the usual modern case. Drawing together these parallel contributions, Lombaard places these initiatives within the emerging post-secular climate, which augurs a different way of being religious or non-religious, publicly as much as privately, in democratic societies in our time. The writers have learned that public expressions of religious faith or reasoning are to be kept separate from the practices of caring for patients. Mixing the two is dangerous. How do we deal with difference personally, interpersonally, nationally? Can we weave a cohesive social fabric in a religiously plural society without suppressing differences? This collection of significant essays suggests that to truly honour differences in matters of faith and religion we must publicly exercise and celebrate them. Although emerging scholarship in the social sciences suggests that religion can be a potential catalyst of cosmopolitanism and global citizenship, few attempts have been made to bring to the fore new theoretical positions and empirical analyses of how cosmopolitanism -- as a philosophical notion, a practice and identity outlook -- can also shape and inform concrete religious affiliations. Key questions concerning the significance of cosmopolitan ideas and practices - in relation to particular religious experiences and discourses -- remain to (...) be explored, both theoretically and empirically. This book takes as its starting point the emergence of cosmopolitanism -- as a major interdisciplinary field -- as a springboard for generating a productive dialogue among scholars working within a variety of intellectual disciplines and methodological traditions. The first part is dedicated to the different accounts on secularization that may be applied to European countries: the classical Weber theory that view secularization as an “iron law” of any society, the institutional secularization, secularization as the decline and adequacy of religious practice, the continuation of the classical theory in the 60’s and beyond, the criticism of this theory and the particular argument of the increase of fundamentalist religious movements. The attempts to formulate new theories on secularization based on other assumptions than the classical one are also presented. The increased presence of religion in private life does not mean a decrease of religion in the public space but rather a new definition of it. Despite the different intensity of belief in national terms, some trends like “believing without belonging” are common, meaning that secularization could have a single meaning in Europe, apart from other continents. The second part starts with presenting the three types of Church - State relationship at the national level. All these have in common the fact that the state is neutral towards religious subjects, a religious subsection is singled out within the public sphere and the state has the right to intervene in this area only as an arbiter. There is already a European law on religion and this statement is supported by examples from the Lisbon Treaty, The Charter of Fundamental Rights, different Directives and decisions of the European Court of Justice. Common rules on religion agreed at the European level helps better to understand why there is a common European model on religions, different from the national models. After taking into account the two aspects described above, a common European model on religion in the public sphere emerges as a necessary conclusion. (shrink)

This article explores the question of the role of religion in the public square through the lens of Richard Rorty’s more general public–private distinction. When we note his various positions over the years on the role of religion in the public square we observe a shift that yields a more favorable public role for religion so long as it limits itself to social action and refrains from making knowledge-claims that serve as tools of (...) the powerful. But if, according to Rorty, religion per se is no longer the problem, then what becomes of his efforts to endorse a more general public–private distinction? The argument set forth assesses the inadequacies and limitations of Rorty’s assumptions about the public–private split and suggests another way of framing the issue that will prove productive in debates concerning the role of religion in the public square. Mark S. Cladis pinpoints the origins of contemporary notions of the public and private and their relationship to religion in the work of Jean-Jacques Rousseau. His thesis cuts across many fields and issues-philosophy of religion, women's studies, democratic theory, modern European history, American culture, social justice, privacy laws, and notions of solitude and community-and wholly reconsiders the political, cultural, and legal nature of modernity in relation to religion. Turning to Rousseau's Garden, its inhabitants, the Solitaires, and (...) the question of restoration and redemption that preoccupied much of Rousseau's thought, Cladis examines how Rousseau addressed the tension between the joys and moral obligations of social engagement and the desire for solitude. He was caught between two possibilities: active involvement in the creation of an enlightened and humane society or extrication from social entanglements in favor of cultivating a spiritual interior life. Yet Rousseau did not view this conflict as a desperate division. Rather, for him it was a moral struggle to be endured by those who had fallen from the Garden. For this edition Cladis has added a substantive introduction that discusses the role of religion in contemporary democratic societies, particularly in American public life. Cladis proposes four models of thinking about religion in public and champions what he calls spiritual democracy-a dynamic, culturally specific, and progressive democracy. Cladis argues that spiritual democracy refers not only to a society's legal codes and principles but also to its democratic culture and symbols and its daily practices and institutions. The role of religious self-understandings as resources for the normative foundations of democracy is much debated in social and political ethics, theology and law. The comparison of the positions of Rawls, Habermas and Ricoeur highlights alternative conceptions of the premises of "public reason" and of religion. Recent philosophical and theological receptions and critiques in English and German are brought into conversation.

I present a persistent religious moral theory, known as divine command theory, which conflicts with liberal political thought. John Rawls's notion of public reason offers a framework for thinking about this conflict, but it has been criticized for demanding great restrictions on religious considerations in public deliberation. I argue that although Paul Kurtz is critical of organized religion, his epistemological suggestions and ethical theory offer a feasible way to build common moral ground between atheists, secularists, and theists, (...) so long as each maintains the important democratic value of toleration in the form of either fallibilism or skepticism. Ethics deals with how we make decisions and the actions we perform. In decision-making, one weighs the pros and the cons of any course of action. Besides the realm of the private, there are ethical issues regularly dealt with in public discourses. Human identity in most instances is a cultural and religious construct. Our socio-historical background as human beings is constitutive of our identity and also informs our ethical decision making. In this essay, I argue for a possibility of (...) positively incorporating ideas from world religions and diverse cultures into public ethical discourses. Since world religions are about people, it is possible to appropriate humanity as understood in religions in the development of ethics. Hence, I present religions as practically relevant in the analysis of public ethical issues. Public ethical discourses are viewed as inclusive of history, religion, and culture. Further, the work of the philosopher Paul Ricoeur is presented as a way of reconciling subjectivity and objectivity in history and ethics. This essay is an analysis on ways in which the debate on ethical issues can incorporate all the voices in a society without excluding anyone while avoiding ideological extremism.  . (shrink)

John Locke's theory of toleration is generally seen as advocating the privatization of religion. This interpretation has become conventional wisdom: secularization is widely understood as entailing the privatization of religion, and the separation of religion from power. This book turns that conventional wisdom on its head and argues that Locke secularizes religion, that is, makes it worldly, public, and political. In the name of diverse citizenship, Locke reconstructs religion as persuasion, speech, and fashion. He (...) insists on a consensus that human rights are sacred insofar as humans are the creatures, and thus, the property of God. Drawing on a range of sources beyond Locke's own writings, Pritchard portrays the secular not as religion's separation from power, but rather as its affiliation with subtler, and sometimes insidious, forms of power. As a result, she captures the range of anxieties and conflicts attending religion's secularization: denunciations of promiscuous bodies freed from patriarchal religious and political formations, correlations between secular religion and colonialist education and conversion efforts, and more recently, condemnations of the coercive and injurious force of unrestricted religious speech. The article introduces to the issue of religion, rights and the public sphere. It analyzes 4 challenges that the conception of the public sphere currently faces: Does there exists a trade-off between the public sphere and a legal regime of civil rights? Does the public sphere really require us to keep the good and religious questions outside of it? To what extent is the public sphere neutral and not rather itself the outcome of a (...) particular and contingent conception of the good? Whatever might be our answers to the questions 1 to 3, does not Islam constitute a special challenge for any conception of the public sphere? The article draws following prudent conclusions: First, rights are somewhat fundamental for a democratic public sphere. Second, a democratic public sphere cannot exclude religion. Third, little indicates that the public sphere is only a western concept. On the contrary, the public sphere has a universal character. Fourth, Islam does not pose any specific challenge to the public sphere, at least no more than the other religions. (shrink)

Religion and Public Reasons collects the theological work of John Finnis, spanning his contribution to such foundational issues as the justification for belief in revelation and moral-theological methodology; to the role of religion in public reason and law; and to major controversies within Catholic thought and practice since the 1960s.

In this article I analyze Rawls' and Habermas' accounts of the role of religion in political deliberations in the public sphere. After pointing at some difficulties involved in the unequal distribution of deliberative rights and duties among religious and secular citizens that follow from their proposals, I argue for a way to structure political deliberation in the public sphere that imposes the same deliberative obligations on all democratic citizens, whether religious or secular. These obligations derive from the (...) ideal of mutual accountability that is supposed to guide political deliberation in a deliberative democracy. The main advantage of this proposal is that it recognizes the right of all democratic citizens to adopt their own cognitive stance (whether religious or secular) in political deliberation in the public sphere without giving up on the democratic obligation to provide reasons acceptable to everyone to justify coercive policies with which all citizens must comply. Listening closely to the religious pitch in Rousseau's voice, Cladis convincingly shows that Rousseau, when attempting to portray the most characteristic aspects of the public and private, reached for a religious vocabulary. Honoring both love of self and love of that which is larger than the self--these twin poles, with all the tension between them--mark Rousseau's work, vision and challenge--the challenge of 21st-century democracy.

Religion can affect public support for the European Union. However, specifying the circumstances under which religion may become a stronger predictor of EU-support has so far been neglected. This article shows that the media play a role in this process and it is investigated to what extent the presence or absence of references to religious issues in EU news coverage primes people's religious attitudes to contribute to their evaluation of the EU. For this purpose, a content analysis (...) of the amount of religious news items in EU coverage in German and Dutch newspapers between 1997 and 2007 was conducted. Two points in time were chosen — 1998, when only a small amount of religious news items appeared in EU coverage, and 2005, when religious items reached a peak. Eurobarometer data were used to test the media priming proposition. The findings show that an increasing religious dimension in media coverage about the EU primes a linkage between religious and political considerations and thus influences the strength of the impact of religion on attitudes towards the EU. ABSTRACT: This paper aims at providing a general assessment of Habermas’s recent positions on the place of religion in the public sphere. After reviewing and contrasting Rawls’s and Habermas’s respective positions on the issue, it argues that Habermas’s contribution raises some difficulties both theoretical and practical. At the theoretical level, it is shown that Habermas’s contribution poses a problem of coherence with respect to his more general conception of deliberative democracy. At the practical level, the soundness of Habermas’s (...) view of the respective roles expected of religious and secular citizens in the public sphere is brought into question. (shrink)

What role should religion play in public discourse? Not long ago Richard Rorty argued, in more than one place, that religion is a "conversation stopper" which polite people refer to only in private conversations. Religious believers complain, however, that this practice renders it impossible for them to participate in public discourse. They ask whether a democratic community is worthy of the name if it effectively forbids (by custom or legislation) a significant segment of its citizens from (...) acknowledging and drawing upon their own traditions to help justify their moral and political claims? This paper draws upon the work of Jeffrey Stout, Robert Brandom, and importantly a Confucian understanding of ritual to argue that Rorty goes too far in arguing that religious assumptions have no place in public discourse. This vigorous debate between two distinguished philosophers presents two views on a topic of worldwide importance: the role of religion in politics. Audi argues that citizens in a free democracy should distinguish religious and secular considerations and give them separate though related roles. Wolterstorff argues that religious elements are both appropriate in politics and indispensable to the vitality of a pluralistic democracy. Each philosopher first states his position in detail, then responds to and criticizes the opposing viewpoint.

This paper examines Cornel West’s attempt to offer an alternative to the dominant liberal view concerning the proper role of religion in the democratic public square. Whereas mainstream liberals seek strategies to keep religion and public life separate, West seeks to dissolve the apparent tension between religion and democratic citizenship by reconstructing religion pragmatically such that it can be rendered compatible with democracy. I argue that West’s proposal fails to be a viable alternative precisely (...) because the “prophetic pragmatism” underwriting his view is unethical to the extent that it relies upon manipulative relationships with traditional religious believers in African-American churches. For the last several decades, philosophers have wrestled with the proper place of religion in liberal societies. Usually, the debates among these philosophers have started with the articulation of various conceptions of liberalism and then proceeded to locate religion in the context of these conceptions. In the process, however, too little attention has been paid to the way religion is conceived. Drawing on the work of Robert Audi and Nicholas Wolterstorff, two scholars who are often read as (...) holding opposing views on these issues, I argue that, for the purposes of their argument about liberalism, both have implicitly accepted a concept of religion that has come under severe attack in recent work on the subject. Namely, they have accepted a concept of religion that identifies religion primarily with belief, ritual practice, and ecclesial institutions. Following recent scholarship, I suggest that religion is better conceived as a kind of culture. To conclude the essay, I gesture toward what the beginnings of a re-visioned debate about religion and liberal society might look like if one started from this revised conception of religion. In recent years, debates about the legitimate place of religion in the public sphere have gained prominence in political theory. Departing from Rawls’s view of public reason, it has lately been argued that liberal regimes should not only be compatible with, but endorsing of, arguments originating in religious belief systems. Moreover, it has been maintained that the principle of political autonomy obliges every democratic order to enable all its citizens, be they secular or religious, to become the (...) authors of the laws to which they are subjected. Mere toleration, it is often said, strengthens social cohesion in the wrong way because it narrowly defines it as the product of bargaining processes, posited against the backdrop of power structures. The consensus many liberal defenders of religion in the public sphere wish to advance, however, aims at something radically dissimilar: particular institutions and arrangements need to be endorsed “for the right reasons”, i.e. based on arguments to which all citizens could hypothetically agree. This paper primarily grapples with the contractarian idea as a lens through which the legitimate place of religion in the public sphere is negotiated. I argue that the emphasis on “right reasons” is mistaken in an essential way: it underrates the impact of power structures on the ways in which particular institutions and arrangements are actually justified or criticized. I shall claim that public reason must rather be conceived in terms of a discursive and dynamic modus vivendi. This implies acknowledging the pervasiveness of power structures in society at all times, without giving up on the potential for deliberation among secular and religious citizens. As a case study, the paper looks into the findings of the Bouchard/Taylor commission in Québec (2007-2008) and maintains that the context-sensitive method used by the authors exemplifies this novel, more useful approach to public reason and modus vivendi. This paper underlines the surprising ways in which subject formation, agency and human flourishing emerge in counter discourses. As examples I offer a post-colonial critique of Rosa Parks in the USA and Fayza in the film Cairo 678. Economic and epistemic violence of neo-liberalism, neo-colonialism, racism, fundamentalism, nationalism, classism, sexism, homophobia, speciesism, etc. call for a critique of religion with corresponding answers. For such a project, the analysis brings together the theologian Dietrich Bonhoeffer and the post-colonial scholar Gayatri Chakravorty (...) Spivak, and questions their notions of religion and gender as well as resistance and representation. Spivak’s critique of capitalism, the post-colonial condition and epistemic violence in terms of gender constructions is seminal. However, her understanding of ‘religion’ remains ambivalent, yet influences post-colonial theologies tremendously. Bonhoeffer is interesting for a de-essentialized understanding of religion in the post-secular context, because he keeps the tension between a secularized world, engagement with the world and the appreciation of religious knowledge. His final perspective on gender and representation might be more advanced than expected. (shrink)

However, recent debates over the place of religious symbols in public spaces, state financing of faith schools, and tax relief for religious organisations suggest that this distinction is not particularly useful in easing the tension between liberal commitments to equality on the one hand, and freedom of religion on the other. This article deals with one aspect of this debate, which concerns whether members of (...) religious communities should receive exemptions from regulations that place a distinctively heavy burden on them. Drawing on Habermas’ understanding of churches as ‘communities of interpretation’, we explore possible alternatives to both the ‘rule-and-exemption’ approach and the ‘neutralist’ approach. Our proposal rests on the idea of mutual learning between secular and religious perspectives. On this interpretation, what is required is (i) the generation and maintenance of public spaces in which there could be discussion and dialogue about particular cases, and (ii) evaluation of whether the basic conditions of moral discourse are present in these spaces. Thus deliberation becomes a touchstone for the building of a shared democratic ethos. (shrink)

This article gives an overview of the debate about the “restraint principle” that political liberals urge on those who are inclined to use distinctive moral and theological doctrines in public square debates about politics. It clarifies such central concepts as “public reason” while surveying the main arguments and highlighting three different proposals for possible convergence in this conflict.
