Art and Authority explores the sources, nature, and limits of artistic freedom. K. E. Gover draws upon real-world cases and controversies in contemporary visual art to offer a better understanding of artistic authorship and authority. Each chapter focuses on a case of dispute over the rights of an artist with respect to his or her artwork.

In a recent article, Hans Maes argues that examples drawn from contemporary visual art shed new light on the long-standing and seemingly intractable debate between Hypothetical Intentionalism (HI) and Moderate Actual Intentionalism (AI). He presents two test cases that, he argues, tilt the scale in favour of AI. In this paper I re-examine Maes's two test cases, and argue that neither succeeds as a test case. The first case fails because it confuses a relevant fact about the artwork with the (...) artist's intentions for the work. The second case fails because the work in question does not count as an utterance. The failure of Maes's examples suggests that the interpretive norms surrounding contemporary visual art cannot settle the debate between AI and HI. (shrink)

In this essay I call attention to the fact that there is a work of art in Heidegger’s “The Origin of the Work of Art,” and yet almost no one talks about it: the C. F. Meyer poem “Roman Fountain.” This critical silence is all the more ironic, since (1) it is a self-sufficient artwork, and not just described or mentioned in the text; and (2) the poem’s fountain, as man-made spring, seems to speak to—if not speak of—Heidegger’s thesis concerning (...) the Ur-sprung of the artwork itself. I argue that the poem illuminates a central problem or question concerning the status of art as mimesis, and I suggest that the reason why this poem tends to be overlooked amid the “obsessive” critical attention that it otherwise attracts can be found within the essay itself. The aim of this inquiry is to determine whether printmaking is best understood ontologically as analogous to a work-performance relation. Are prints the visual analogue of symphonies? My motivation for pursuing the comparison of printmaking to music is twofold. First, because relatively little has been written on the ontology of fine art prints, our use of an already developed body of scholarship will help us to gain some traction on the question. Second, within the existing literature on the ontology of (...) prints, there seems to be a persistent confusion about the difference between what makes a print an artwork, and what makes it a genuine or authentic artwork, signed or in some other way ratified by a given artist. I conclude by suggesting that prints are indeed ontologically unusual insofar as they occupy an intermediate position between pure multiples, of which there can be an unlimited number of tokens, and singular artworks that consist of one physical object. The 1990 Visual Artists Rights Act (VARA) is a provision of U.S. copyright law that seeks to protect the noneconomic rights of artists, called "moral rights." These rights are due to the "presumed intimate bond between artists and their works."1 In the United States it protects rights of artistic attribution and integrity: the artwork cannot be claimed as the work of another, and it cannot be distorted. In some cases VARA protects artworks from destruction. But what is the nature of (...) this intimate bond? This article develops and defends a full account of the nature and normativity of resistance to evidence, according to which resistance to evidence is an instance of input-level epistemic malfunctioning. At the core of this epistemic normative picture lies the notion of knowledge indicators, as evidential probability increasing facts that one is in a position to know; resistance to evidence is construed as a failure to uptake knowledge indicators.

In a diversity course for pre-service teachers, we explored coursework by students of color to uncover instances in which they resisted the existence systemic oppression in K12 schools. First, we examined the written responses from three students of color (Asian-Indian, Asian immigrant, and Latina) who were largely agreeable to the existence of different forms of oppression presented in the course content. Our work illuminated instances of what we have described as narrative-based resistance. Students initially referred to narratives of rugged (...) individualism or the American Dream to resist the existence of systemic barriers. As the course progressed, students shifted to deeply entrenched responses that rejected the course content to refute systemic oppression. Secondly, we developed a case study for one student, a biracial female that self-identified as White who consistently rejected systemic oppression during class interactions to the point of displaying openly defiant behaviors. The examples of resistance we encountered served as a reminder that students of color along with their White peers must be able to critically examine and understand systems of oppression that are pervasive throughout education. Furthermore, the underlying sources of the resistance were closely associated with indoctrination in Whiteness, limited understanding of systemic oppression, deeply held beliefs and understandings and the lived experiences of individuals. While we agree that teacher education must recruit and retain more teachers of color for an increasingly diverse US K12 student population, we add that preparation that meets the needs of teachers of color is essential. -/- . Teachers’ job satisfaction has been the subject of many studies that tried to identify its main sources. Based on the social cognitive career theory, the present study aimed to investigate the relationships between personality traits, goals orientation, and teachers’ job satisfaction. A total of 321 Romanian teachers completed an online questionnaire. The results demonstrated new insights regarding the relationships between psychological variables and teachers’ job satisfaction. Cognitive rigidity, as a mechanism to resistance to change, mediates between conscientiousness and teachers’ (...) job satisfaction. Moreover, the moderation role of learning goals orientation manifests in the relation between conscientiousness and job satisfaction. These findings emphasize that school management needs to offer teachers information and explain the change’s benefits if they want to prevent individual resistance to change and decrease satisfaction related to their work. Disregard of gender and of women’s contributions in the higher education curriculum is still a widespread phenomenon. Building on feminist institutionalism, this article explores the forms and types of resistance that efforts to engender the higher education curriculum must contend with and discusses the ways in which resistance to curricular reform is entrenched in a web of both gender-specific and apparently gender-neutral academic informal rules. In doing so, the authors use empirical evidence collected by an action-research project undertaken (...) at a faculty of political and social sciences in a Catalan public university. The Spanish case is intriguing because mainstreaming gender in higher education has been prescribed by various national and regional laws that are nonetheless poorly implemented. The article also reflects on the positive feedback loop action-research projects can facilitate within gendered institutions such as universities and pinpoints the role of feminist agency in counteracting resistance to institutional change. As destructive narcissists attain positions of power, unethical behavior ensues. Organizational identity shifts in response. As a result, unethical decisions become amplified in organizational structure and practices and embedded in technology. Little research related to how employees respond to organizational events, cost/benefit analysis of such, or the effects of negative treatment of employees by organizations is available. As persons become aware of the circumstances generated by destructive narcissistic behavior and informed about the consequences, some will resist. The human blood coagulation system comprises a series of linked glycoproteins that upon activation induce the generation of downstream enzymes ultimately forming fibrin. This process is primarily important to arrest bleeding (hemostasis). Hemostasis is a typical example of a molecular machine, where the assembly of substrates, enzymes, protein cofactors and calcium ions on a phospholipid surface markedly accelerates the rate of coagulation. Excess, pathological, coagulation activity occurs in “thrombosis”, the formation of an intravascular clot, which in the most dramatic form (...) precipitates in the microvasculature as disseminated intravascular coagulation. Thrombosis occurs according to a biochemical machine model in the case of atherothrombosis on a ruptured atherosclerotic plaque, but may develop at a slower rate in venous thrombosis, illustrating that the coagulation machinery can act at different velocities. The separate coagulation enzymes are also important in other biological processes, including inflammation for which the rapid conversion of one coagulation factor by the other is not a prerequisite. The latter role of coagulation enzymes may be related to the old and probably maintained function of the coagulation machine in innate immunity. Interviews formed an integral part of Foucault's work alongside and complementary to the published works. It is primarily in interviews that he elaborates on the implications of his historical studies for thinking about the problems raised by social and political movements. Like his published books, Foucault's lectures sought to engage with the social, political, and intellectual present in which they were presented. In this sense, they are closer to the interviews. This chapter focuses on the developments in his thinking about (...) power as these are displayed in his lectures between 1976 and 1979. It also discusses the role of strategy in relations of power. Building on the centrality of freedom to this concept of power as action on the actions of others, Foucault asserts that there is an intransigence of freedom and a corresponding “agonism” at the heart of power relations. Standing in front of perhaps the most crucial decade of the future to come, when mankind has just experienced three years of global pandemic, a raging war, extreme climate events and mass extinction of animals and plants, we have arrived at a crossroads. Decisions must be made on whether we charge at full speed to explore alternative social-ecological systems that lead to human well-being and regeneration of nature; or continue down a pathway built on resource extraction, unsustainable and unethical urbanization (...) and destruction of nature and lives. Recently, as countries seek to recover from the pandemic, many are contemplating large-scale infrastructure schemes and projects, which have been tried and proven means to drive extraction-based economic growth. This highlights the importance of environmental justice and resistance – an area from which voices are not often heard loud enough, yet offers fertile ground where radical, sustainable alternatives may emerge among people and communities that refuse to comply with the unjust development imposed on them. Our work seeks to contribute to research studying the potential of such phenomena, by designing a framework to capture key organizational, political and ethical features that make resistance a transformative practice. The outcome of this effort is a Resistance-Based Transformative Alternative (ReBasTA) Framework, which can be employed to inform both desktop-based data collection and analysis on resistance practices, as well as in-depth field research on deep drivers and leverage points for transformation. Moreover, the framework makes longitude study of transformative practice possible, by using a consistent set of criteria. This paper introduces the conceptual and methodological approach underlying our framework and the collaborative process employed in designing it and its key criteria. In the final section, we also discuss possible applications, with particular reference to resistance movements triggered by large-scale infrastructures. (shrink)

Using survey responses from 400 fashion companies in Denmark, Norway, Sweden, Finland, and Iceland, we examine the diversity of strategic responses to institutional pressures for corporate social responsibility within the Nordic fashion industry. We also develop and test a new model of strategic responses to institutional pressures that encompasses both resistance and opportunity-seeking behaviour. Our results suggest that it is inconsistent pressures within, rather than between, stakeholder groups that shape strategic responses to CSR pressures and that increasing pressures stimulates (...) opportunity-seeking at the expense of compliance. The fact that people think is taken for granted. How we go about the thinking process is seldom reflected upon by the individual. In order to be able to grasp complex phenomena, and changing and interdependent relationships students participating in a systems course are required to become aware of their way of performing the thinking process. In discussions with them and based on ?soft analysis? it seems that there is resistance to a dynamic, multilevelled thinking process due to habits (...) acquired at school, or perhaps even at an earlier age. The personality structure, and a coherent experience of a complete ?self? seems to enhance mental mobility, and the possibility of developing a dynamic world view. (shrink)

In Bernard Stiegler’s Automatic Society Volume 1: The Future of Work, ‘the impossible’ and ‘the improbable’ appear as explicit parts of his political project. In his philosophy of technology, the impossible highlights the structural incompleteness that technics imparts to human existence. This article will trace how Stiegler draws on the work of Maurice Blanchot to produce this conjunction between technics and indetermination, and explore its political ramifications. This will show that rather than being a recent aspect of Stiegler’s work, the (...) political use of the impossible brings Blanchot’s subterranean influence to the fore. After briefly reconstructing Blanchot’s understanding of language, impersonality, and writing, it will be shown that Stiegler shifts Blanchot’s emphasis from the impossible to technical practices of the improbable. Stiegler follows an anthropological line where the experience of the impossible becomes a more general understanding of the experience of improbability through technical structures. Stiegler’s reading of Blanchot is central in his break with the place of the impossible in the politics of resistance advocated by post-structuralism, allowing him to support a politics of invention which makes space for the improbable within a large-scale politics of technicity, rather than privileging indeterminacy itself. The essay is designed to present the phenomena of popular culture, its difference from pop culture, both products of modern West, and their impact on film and advertisement media in India. First, the discussion focuses on the Critical School which proposed the initial thesis of commodification of culture with a resultant “lowering” of standards to appeal to “the masses”, and an appeal to the “average” tastes. In the essay an argument is presented that pop culture is a “critique” of popular (...) culture and is an elitist position attempting to shock popular mores and media content. Given this setting, it is argued that while India has followed both the globalizing popular and pop cultures, neither are adequate to encompass Indian media, specifically their film content. Those who bear the burdens of injustice and oppression are entitled to act in ways contrary to existing laws and institutions to secure their own entitlements and those of others. This article aims to articulate a Confucian perspective on resistance against injustice. There are reasons for thinking that the notion of resistance is fundamentally at odds with Confucian political thought. In this article, I move beyond this simple conflict/compatibility model and explore the complex relationships between resistance and (...) Confucianism. On one hand, some of Confucianism’s core commitments can be better attained in contemporary societies by allowing resistance; on the other, a Confucian perspective can offer insights into current discussions on the ethics of resistance. Many studies have demonstrated differential resistance to change in the context of negative behavioral contrast. That is, as a result of introducing a disruptor, response rates decrease to a greater extent when the maintaining reinforcement schedule is leaner. Resistance to change also applies to positive contrast, in that increases in response rate are greater in leaner schedules. Imaginative resistance refers to a perceived inability or unwillingness to enter into fictional worlds that portray deviant moralities (Gendler, 2000): we can all easily imagine that dragons exist, but many people feel incapable of imagining fictional worlds in which morality works differently. Although this phenomenon has received much attention from philosophers, no one has attempted to operationalize the construct in a self-report scale. In Study 1, we developed the Imaginative Resistance Scale (IRS), investigated its relationship to theoretically related (...) constructs, and confirmed its structure and reliability (rα = 0.92) in a large sample. In Study 2, we asked participants to rate scenarios expected to provoke imaginative resistance and predicted these ratings from the IRS and its validity measures. IRS scores accounted for variability in ease of imagining these scenarios over and above gender, political orientation, and three related measures. The results are discussed in terms of theories of imaginative resistance and directions for future research. (shrink)

Behavioral ethics research has focused predominantly on how the attributes of individuals influence their ethicality. Relatively neglected has been how macro-level factors such as the behavior of firms influence members’ ethicality. Researchers have noted specifically that we know little about how a firm’s CSR influences members’ behaviors. We seek to better merge these literatures and gain a deeper understanding of the role macro-level influences have on manager’s ethicality. Based on agency theory and social identity theory, we hypothesize that a company’s (...) commitment to CSR shifts managers’ focus away from self-interests toward the interests of the firm, bolstering resistance to temptation. We propose this occurs through self-categorization and collective identification processes. We conduct a 2 × 2 factorial experiment in which managers make expense decisions for a company with commitment to CSR either present or absent, and temptation either present or absent. Results indicate that under temptation, managers make decisions consistent with self-interest. More importantly, we find when commitment to CSR is present, managers are more likely to make ethical decisions in the presence of temptation. Overall, this research highlights the interactive role of two key contextual factors—temptation and firm CSR commitment—in influencing managers’ ethical decisions. While limited research has highlighted the positive effects that a firm’s CSR has on its employees’ attitudes, the current results demonstrate CSR’s effects on ethical behavior and imply that through conducting and communicating its CSR efforts internally, firms can in part limit the deleterious effects of temptation on managers’ decisions. Music education is frequently growing around the globe and needs emotional attachments and adoption innovation for the attractive music education that needs researcher’s emphasis. Thus, the current article investigates the impact of lack of emotional experience and resistance to innovation on unattractive music education in China. The current research also investigates the mediating impact of dissatisfied musicians among the association of lack of emotional experience, resistance to innovation, and unattractive music education in China. The study has used the (...) primary data collected using questionnaires. The current article examines the validity and reliability using the measurement assessment model and also tests the hypotheses using the structural assessment model with the help of smart-PLS. The results indicated that the lack of emotional experience and resistance to innovation has a positive and significant impact on unattractive music education in China. The findings also revealed that dissatisfied musicians significantly mediate among lack of emotional experience, resistance to innovation, and unattractive music education in China. This article helps policymakers establish policies about making music education attractive for musicians by adopting innovation. (shrink)
