Our paper offers some lecture keys on the process through which made it possible the political relevance of judicial activity during the 1990's in Latin American in general, and in Argentina in particular. This phenomenon, commonly known as 'judicialization of politics', supposes a tendency of processing political conflicts through the judiciary. Related to that our paper proposes to show, to make it visible, interconnections and supports through which it is possible to understand it emergence within the diagram of power relations and processes of subjectivation that characterizes neoliberal governmentality. In this paper, I sketch out a new interpretation of the Second Essay of On the Genealogy of Morality by showing that its seemingly meandering character conceals a highly cogent structure. In contrast to the prevalent scholarly trend, I argue that the ideal of sovereignty Nietzsche introduces in the essay’s opening sections plays an integral and crucial role in his account of the emergence of the feeling of moral guilt. In contrast to another common trend in the scholarship, I (...) also argue that Nietzsche’s account is very different from the account Freud proposes in Civilization and Its Discontents, with which it is often compared. Specifically, I show that guilt is not, for Nietzsche, a form of fear, nor simply the product of raw aggression turned inward when it can no longer be vented outward. (shrink)

This paper takes up Nietzsche’s contrast between a relatively enduring ‘drama’ of punishment, which consists in sequences of procedures, and a congeries of often discrepant meanings and purposes of the drama and contrasts it favorably with the distinction between a definition of punishment and a justification for it which received a good deal of attention in the middle of the twentieth century in anglophone philosophical circles. My chief thesis is that the philosophical lesson to be drawn from the widely acknowledge (...) failure of efforts to further the philosophical understanding of punishment by the latter route is Nietzsche’s: that the concept in question and the practices that fall under it are fundamentally insusceptible to ahistorical methods. I argue for the thesis proper in the first section of the paper, and explore consequences of it for our understanding of the connection between punishment and justice in the second. (shrink)

This paper responds to the focus issue on exemplarity that includes contributions by Kyle Lambelet, Brian Hamilton, and Gustavo Maya. The paper calls attention to ancient, medieval, and modern precedents that ought to inform our thinking about the ethical and political significance of exemplars.

This volume provides an articulate restatement of many of the themes of Husserlian phenomenology.

Objective chance and morality are rarely discussed together. In this paper, I argue that there is a surprising similarity in the epistemic standing of our beliefs about both objective chance and objective morality. The key similarity is that both of these sorts of belief are undermined -- in a limited, but important way -- by plausible genealogical accounts of the concepts that feature in these beliefs. The paper presents a brief account of Richard Joyce's evolutionary hypothesis of the genealogy (...) of morality, and refines the debunking argument which he consequently mounts against moral beliefs. The evolutionary hypothesis in question suggests that we could easily have failed to believe that moral judgments have a peculiarly categorical force. This aspect of our moral belief, then, is unreliable. The paper then turns to chance, and presents a more speculative hypothesis about the cultural evolution of ideas about chance, as a peculiarly physical and objective form of probability. It is argued that, in the same way that our beliefs about morality could easily have lacked the commitment to inescapable force, our beliefs about chance could easily have lacked various idiosyncratic commitments. By a similar argument then, these aspects of our chance beliefs are unreliable. In the final section of the paper, I review some recent objections to genealogical debunking arguments, due to Roger White and Guy Kahane, showing how the form of argument developed in this paper is immune to these criticisms. RÉSUMÉ: Cet article présente une critique de la position dite de l’ «ironie morale», une position philosophique passablement répandue dans la culture intellectuelle con temporaine et dont la caractéristique centrale est de mettre en question de façon radicale le concept de vérité morale. En m’appuyant sur la lecture de Foucault pro posée par Robert Réal Fillion, je dégage les présuppositions qui sont au cœur de la position en question. Je souligne ensuite ses implications pragmatiques; en acceptant le gambit épistémologique, crucial (...) en l’occurrence, selon lequel toutes les affirmations d’ordre moral sont en dernière analyse des descriptions fausses, nous renonçons en fait à notre capacité de juger d’une manière signifiante qu’un état de choses, une ligne de conduite, etc., est qualitivement supérieur à un autre. La question ici posée est donc la suivante: étant admis que la conception ironique de la moralité implique cette perte considérable, les raisons fournies en sa faveur sont-elles suffisamment bonnes pour étayer une attitude aussi forte et aussi radicale à l’endroit de la moralité et de la vérité? Ma thèse est qu’elles ne le sont pas et qu’en réalité on s’abuse en acceptant pour nécessaire et inévitable cette conception débilitante de la moralité. Les raisons sur la foi desquelles cette conclusion est admise semblent inattaquables à première vue, mais il se révèle à y regarder de plus près qu’elles sont non concluantes et inadéquates, ou qu’elles requièrent à tout le moins une révision sérieuse. Medical practice has always involved at least three roles, three complimentary identities. Practitioners have been at once clinicians dedicated to a patient’s care, members of a professional organization promoting medicine, and informed citizens engaged in public debates on health issues. Beginning in the 1970s, a series of social and technological changes affected, and in many cases restricted, the practitioner’s ability to function equally in these three identities. While others have discussed the changing realities of medical practice in recent decades, none (...) have commented on their effect on their effect on rights of practitioners as citizens. Here several cases begin an analysis of the manner in which those changes have limited the physician’s right to act conscientiously and speak publicly in the face of organizational agendas and political priorities. This article explores the legacy of Aristotle's advice for the preservation of tyrannies found in Politics Book 5, Chapter 11 on the formation of medieval and Renaissance fiscal literature. The tyrant's economic techniques for preserving his regime established commonplaces of fiscal governance in the medieval commentary and mirrors-for-princes tradition. Authors' engagement with the legacy of this passage led to controversial treatments of a ruler's disposition toward the moral virtue of liberality. Machiavelli's intervention over the danger of liberality to the fiscal (...) governance of the state needs to be placed in this longer context. (shrink)

In 1990 Edward Craig published a book called Knowledge and the State of Nature in which he introduced and defended a genealogical approach to epistemology. In recent years Craig’s book has attracted a lot of attention, and his distinctive approach has been put to a wide range of uses including anti-realist metaepistemology, contextualism, relativism, anti-luck virtue epistemology, epistemic injustice, value of knowledge, pragmatism and virtue epistemology. While the number of objections to Craig’s approach has accumulated, there has been no sustained (...) attempt to develop answers to these objections. ‘On the 26th of January 1950, we are going to enter into a life of contradictions. In politics we will have equality and in social and economic life we will have inequality’. B. R. Ambedkar’s famous last speech to the Constituent Assembly on 25 November 1949 still resonates within contemporary Indian constitutional law, and even more so his following interrogation: ‘how long shall we continue to live this life of contradictions?’ Prima facie societal, the contradiction is however also a temporal (...) one, Indian constitutional law being founded on both the British traditional idea of ‘continuum’ and the American inspired revolutionary principles of ‘pursuance’ of a novel legal and social order. Two recent Indian Supreme Court decisions pertaining to the de-criminalisation of same sex relations ( Navtej Singh Johar v. Union of India) and for the right of menstruating women to enter the Sabarimala Temple in Kerala ( Indian Young Lawyers Association v. Union of India) offer through their differing and sometimes dissenting opinions a glimpse at those temporal contradictions. Through an analysis of both decisions and in particular that of Chandrachud J. and Malhotra J.’s judgements, this article seeks to highlight two radically differing conceptions of temporality applied to constitutional issues, which can themselves be linked back to the transposition of the legal positivist discourse in India within the colonial era: on the one hand, an attempt to continue Common law’s empirical-based tradition and on the other hand, an (apparently) a-historical perception of Law drawn from neo-Roman civilian legal discourse and later normative positivism. If both branches of legal reasoning aim at protecting minorities’ rights, the value they inscribe to History within the realm of Law cannot be further apart. (shrink)

Against those who identify genealogy with reductive genealogical debunking or deny it any evaluative and action-guiding significance, I argue for the following three claims: that although genealogies, true to their Enlightenment origins, tend to trace the higher to the lower, they need not reduce the higher to the lower, but can elucidate the relation between them and put us in a position to think more realistically about both relata; that if we think of genealogy’s normative significance in terms (...) of a triadic model that includes the genealogy’s addressee, we can see that in tracing the higher to the lower, a genealogy can facilitate an evaluation of the higher element, and where the lower element is some important practical need rather than some sinister motive, the genealogy can even be vindicatory; and finally, that vindicatory genealogies can offer positive guidance on how to engineer better concepts. Is it a way of thinking that belongs to a precise theoric movement, as lofty and profound as, for example, the phenomenological or neo-positivistic ones? What distinguishes the pragmatist way of philosophizing? James addresses this question by clarifying that pragmatism is not a doctrine, but an attitude, a tendency (...) to reason in a certain way. Viktor D. Kudryavtsev-Platonov is one of the most prominent representatives of Russian religious-academic philosophy of the second half of the nineteenth century whose theory of cognition bears an imprint of the Kantian theoretical philosophy. Kudryavtsev was not only thoroughly familiar with the Königsberg thinker’s work, but offered a critically reinterpreted version of Kant’s teaching on space, time and categories of understanding. But was the Russian philosopher original in his reading and critique of Kant? In his later works Kudryavtsev often cites (...) the works of Friedrich Adolf Trendelenburg whose works turn out to be very close to the Russian philosopher. Could it be that Kudryavtsev read Kant through Trendelenburg’s optics? To answer this question consistently I give outlines of Trendelenburg’s and Kudryavtsev’s theories of cognition and compare their views on the basis of the sources. I then draw on archive materials to characterise Kudryavtsev’s acquaintance with the works of Kant and Trendelenburg. It turns out that Kudryavtsev was well-versed in Kant’s philosophical ideas already in the early years of his teaching activities — but not from primary sources, but largely through German historical-philosophical renderings. I establish similarities between the teachings of Trendelenburg and Kudryavtsev on space, time and the categories of understanding and their critique of the relevant Kantian teaching. Finally, Kudryavtsev’s early manuscripts attest to his acquaintance with Trendelenburg’s ideas. I conclude that Trendelenburg influenced Kudryavtsev’s own theory of cognition, a fact that should be borne in mind when reading the Russian philosopher’s epistemological works. (shrink)

En este artículo mantengo que esta genealogía es ficticia y fue inventada con fines políticos. No hay razón por la cual se pueda mantener que es genuina; no contamos con ningún otro ejemplo en todo el mundo islámico, y esta genealogía presenta otros problemas. Las consecuencias (...) de que sea inventada son de importancia: primero, nos ayuda a ver la carrera del propio Ibn Ḥafṣūn bajo otra luz y comprender mejor qué estaba haciendo y cuándo, a lo largo de su prolongada carrera. En segundo lugar, nos permite una visión muy diferente de otras interpretaciones modernas de su carrera: comprender su genealogía como un fraude significa que ya no queda razón para considerar a Ibn Ḥafṣūn como uno de los últimos miembros de la nobleza visigoda y por lo tanto permite dudar de su actividad en tanto que debida a una especie de revanchismo político de los cristianos locales. In a recent paper, Nader Shoaibi (2024) makes a valuable contribution to the discussion on genealogies and conspiracy theories (CTs) by focusing on a particular kind of genealogy: what he calls 'political genealogies'. Roughly, political genealogies are not so much interested in the epistemic warrant (or rationality) of a given belief or theory. Rather, their function is to illuminate the social and political conditions that give rise to the spread of (unwarranted) CTs. Shoaibi also notes that such genealogies have (...) an important normative dimension: by drawing on the social/political conditions surrounding CTs we are also invited to engage in a ‘constructive strategy’ concerning CT-believers. This strategy, according to Shoaibi, can be cashed out in terms of ‘world-travelling’ which, as per feminist philosopher Maria Lugones, involves radical humility and playfulness. I agree with a lot of what Shoaibi has to say in his paper. I find his notion of CT political genealogies philosophically fruitful since it carves out what I take to be novel conceptual space in the literature. And I welcome the appeal to ‘world-travelling’ when dealing with proponents of unwarranted CTs. In this piece I respond to some of Shoaibi’s worries against epistemic genealogies, and I raise a concern about the possibility of political genealogies being hijacked by malicious actors. I also make some preliminary remarks about what could be called 'genealogical pluralism' about CTs, while also arguing for the primacy of epistemic genealogies. (shrink)

The essay aims at an assessment of whether and to what extent the history of governmentality can be considered to be a genealogy. To this effect a generic account of core tenets of Foucauldian genealogy is developed. The three core tenets highlighted are (1) a radically contingent view of history that is (2) expressed in a distinct style and (3) highlights the impact of power on this history. After a brief discussion of the concept of governmentality and a (...) descriptive summary of its history, this generic account is used as a measuring device to be applied to the history of governmentality. While both, the concept of governmentality and also its history retain certain links to genealogical precepts, my overall conclusion is that particularly the history of governmentality (and not necessarily Foucault's more programmatic statements about it) departs from these precepts in significant ways. Not only is there a notable difference in style that cannot be accounted for entirely by the fact that this history is produced in the medium of lectures. Aside from a rather abstract consideration of the importance of societal struggles, revolts and other forms of resistance, there is also little reference to the role of these phenomena in the concrete dynamics of governmental shifts that are depicted in the historical narrative. Finally, in contrast to the historical contingency espoused by genealogy and the programmatic statements about governmentality, the actual history of the latter can be plausibly, albeit unsympathetically, read in a rather teleological fashion according to which the transformations of governmentality amount to the unfolding of an initially implicit notion of governing that is subsequently realised in ever more consistent ways. In the final section of the essay I turn towards the field of governmentality studies, arguing that some of the more problematic tendencies in this research tradition can be traced back to Foucault's own account. In particular, the monolithic conceptualisation of governmentality and the implicit presentism of an excessive focus on Neoliberalism found in many of the studies in governmentality can be linked back to problems in Foucault's own history of governmenality. The paper concludes with suggestions for a future research agenda for the governmentality studies that point beyond Foucault's own account and its respective limitations. (shrink)

Can genealogical explanations affect the space of reasons? Those who think so commonly face two objections. The first objection maintains that attempts to derive reasons from claims about the genesis of something commit the genetic fallacy—they conflate genesis and justification. One way for genealogies to side-step this objection is to focus on the functional origins of practices—to show that, given certain facts about us and our environment, certain conceptual practices are rational because apt responses. But this invites a second objection, (...) which maintains that attempts to derive current from original function suffer from continuity failure—the conditions in response to which something originated no longer obtain. This paper shows how normatively ambitious genealogies can steer clear of both problems. It first maps out various ways in which genealogies can involve non-fallacious genetic arguments before arguing that some genealogies do not invite the charge of the genetic fallacy if they are interpreted as revealing the original functions of conceptual practices. However, they then incur the burden of showing that the conditions relative to which practices function continuously obtain. Taking its cue from the genealogies of E. J. Craig, Bernard Williams, and Miranda Fricker, the paper shows how model-based genealogies can avoid continuity failures by identifying bases of continuity in the demands we face. (shrink)

Explicitly fictional armchair reconstructions of the past are sometimes taken to be informative about philosophical issues. What appeal a counterfactual genealogy has depends on its speculative accuracy, that is, its accuracy in identifying relevant causal, functional, or explanatory particulars. However, even when speculatively accurate, counterfactual genealogies rarely secure more than proofs of possibility. For more ambitious deployments of genealogy – for example, efforts to show what properties the target concept in fact predicates – genealogies are hamstrung by the (...) possibility of predicative drift, or changes over time in what the concept predicates. Still, even when counterfactual genealogies fail to tell us about our current practices or concepts, they may identify appealing successors. Pettit's (2018 Pettit, Philip. 2018. The Birth of Ethics: Reconstructing the Role and Nature of Morality. New York, NY: Oxford University Press.[Crossref], [Google Scholar]) innovative defense of moral realism and his employment of a counterfactual genealogy provides an illuminating instance of the promise and challenges facing accounts employing counterfactual genealogies. Self-Interest before Adam Smith inquires into the foundations of economic theory. It is generally assumed that the birth of modern economic science, marked by the publication of The Wealth of Nations in 1776, was the triumph of the 'selfish hypothesis'. Yet, as a neo-Epicurean idea, this hypothesis had been a matter of controversy for over a century and Smith opposed it from a neo-Stoic point of view. But how can the Epicurean principles of orthodox economic theory be reconciled with the (...) Stoic principles of Adam Smith's philosophy? Pierre Force shows how Smith's theory refutes the 'selfish hypothesis' and integrates it at the same time. He also explains how Smith appropriated Rousseau's 'republican' critique of modern commercial society, and makes the case that the autonomy of economic science is an unintended consequence of Smith's 'republican' principles.
