Grice proposed to investigate 'the total signification of the utterance'. One persistent criticism of Grice's taxonomy of signification is that he missed an important category of information. This content, and/or the process of providing it, goes by a variety of labels: 'generalized implicature', 'explicature', 'unarticulated constituents', 'default heuristics', 'impliciture'. In this study we first take a sample of such phenomena and, from the point of view of pure pragmatics, survey the central descriptions of the content expressed and the mechanisms (...) that might deliver these contents. We then, from the point of view of experimental pragmatics, focus on two accounts: Levinson's I-heuristic, and Bach's standardization. We find experimental evidence for the existence of such implicitures, and for the use of language specific standardizations over language neutral background information. (shrink)

Pragmatics is the study of the role of context in communication. This chapter discusses experimental research in pragmatics. It provides clarity on pragmatics by contrasting the role of context in communication with the role of sentence meaning. There is some disagreement about which communicative effects are due to which thing, so there is some disagreement as to where to draw the boundary between semantics and pragmatics. The chapter considers a rich experimental research project in (...) pragmatics, which has developed primarily within linguistics and psychology over the course of the last several decades in response to the boundary disputes. Finally, it talks about a more nascent experimental research project, which, building upon insights from psychology, aims towards understanding survey pragmatics. These two projects are discussed and attention is paid to the methods unique to each project and the philosophical and linguistic underpinnings they share in common. (shrink)

This chapter describes some of the important research in experimental pragmatics, most notably studies related to recovering speakers’ intentions, inferring conversational implicatures, and the role of common ground in discourse understanding. My aim is to demonstrate the utility of different experimental methods for studying pragmatics, and how research findings in the field are relevant to traditional concerns within the linguistic pragmatics community. But I will also argue that experimental pragmatic studies show great regularities and (...) significant variation, both within and across individuals, in the ways people speak and understand language. My alternative view claims that dynamical, self-organizing processes form the critical background from which meaningful pragmatic actions emerge. The implications of this position for interdisciplinary pragmatic research will be discussed. (shrink)

In this contribution we focus on one phenomenon that has a special role in pragmatic theorizing, namely metaphor, and select two issues deriving from theoretical models and prone to be tested experimentally. The first issue concerns the comprehension procedure, that is whether access to metaphorical meaning goes through a mandatory literal stage and thus is indirect, as predicted by a Gricean inspired account, or rather is retrieved directly. The question will be discussed by referring to behavioral and neurophysiological studies, which (...) advanced our understanding of the time course of metaphorical interpretation but proved not fully suitable to answer the question. The second issue revolves around the cognitive architecture of the pragmatic system as it operates in the case of metaphor comprehension. We will illustrate the contribution that functional neuroimaging, coupled with clinical investigations can provide to fine-tune the architecture of the system responsible for metaphor processing. Some outstanding questions are highlighted in the final part, aiming at sketching our interpretation of the experimental pragmatic enterprise. (shrink)

In the past several decades, psychologists and linguists have begun experimentally investigating linguistic pragmatic phenomena. They share the assumption that the best way to study the use of language in context incorporates an experimental methodology, here understood to comprise controlled studies and careful field observations. This article surveys some key projects in experimental pragmatics and relates these projects to ongoing philosophical discussions.

Although a few pioneers in psycholinguistics had, for more than twenty years, approached various pragmatic issues experimentally, it is only in the past few years that investigators have begun employing the experimental method in testing pragmatic hypotheses. We see this emergence of a proper experimental pragmatics as an important advance with a great potential for further development. In this chapter we want to illustrate what can be done with experimental approaches to pragmatic issues by presenting one (...) case, that of so-called ‘scalar inferences’, where the experimental method has helped sharpen a theoretical debate and has provided uniquely relevant evidence. We will focus on work done by the first author and his collaborators or work closely related to theirs, but other authors have also made important contributions to the topic. (shrink)

This paper considers three package deals combining views in philosophy of mind, meta-philosophy, and experimental philosophy. The most familiar of these packages gives center-stage to pumping intuitions about fanciful cases, but that package involves problematic commitments both to a controversial descriptivist theory of reference and to intuitions that “negative” experimental philosophers have shown to be suspiciously variable and context-sensitive. In light of these difficulties, it would be good for future-minded experimental philosophers to align themselves with a different (...) package deal. This paper suggests two alternatives. Experimentalists might help fans of “naturalized” approaches discover what natural kinds have been playing an appropriate role in causing us to use concepts as we do. Or, better still, experimentalists might instead help pragmatists and teleo-semanticists discover how our concept usage regularly yields beneficial outcomes, so that we can then craft philosophical analyses that will.. The relation between knowledge and action has been a lengthy debate in philosophy which traces back to Descartes and Locke. Purism holds that the practical factors related to action are fundamentally independent of the standard of knowledge, while pragmatic encroachment argues that practical considerations about action can impact judgments about knowledge. This traditional debate was put front and center recently by discussions on some knowledge attribution cases and relevant empirical studies. This paper reports three empirical studies based on three pairs (...) of classic knowledge attribution cases on Chinese participants. The results indicate that folk's understanding of knowledge is more compatible with purism and suggest a conversational implicature account of the connection between judgments about knowledge and action. The purpose of this paper is to show how the degree of experimental validity of scientific procedures is crucially involved in determining two typical pragmatic modes in science, namely, the preservation of useful procedures and the disposal of useless ideas. The term 'pragmatic' will here be used following Schurz's characterisation of being internally pragmatic, as referring to that which proves useful for scientific or epistemic goals. The first part of the paper consists in a characterisation of the notion of (...) experimental validity. The second part is focused on several historical examples illustrating how the above pragmatic modes relate to the question of experimental validity. The Michelson-Morley experiment is presented as a case of a highly valid and useful experiment preserved through the development of different theories (like, on the one hand, the ether theory, upheld by Fitzgerald and Lorentz, and, on the other hand, Einstein's special theory of relativity). The concept of caloric will be discussed as an example of an idea that was discarded once it became useless, after heat was understood as a form of energy within the new frame provided by the kinetic theory of heat towards the middle of the 19th century. This handbook is the first to explore the growing field of experimental semantics and pragmatics. Following an introduction from the editors, the chapters in this volume offer an up-to-date account of research in the field spanning 31 different topics, as well as identifying questions and methods for future research.

One of the traditional pragmatic approaches to vagueness suggests that there needs to be a significant gap between individuals or objects that can be described using a vague adjective like tall and those that cannot. In contrast, intuitively, an explicit comparative like taller does not require fulfillment of the gap requirement. Our starting point for this paper is the consideration that people cannot make precise measures under time pressure and their ability to discriminate approximate heights obeys Weber’s law. We formulate (...) and experimentally test three hypotheses relating to the difference between positive and comparative forms of the vague adjectives, gap requirement, and Weber’s law. In two experiments, participants judged appropriateness of usage of positive and comparative forms of vague adjectives in a sentence-picture verification task. Consequently, we review formal analysis of vagueness using weak orders and semi-orders and suggest adjustments based on the experimental results and properties of Weber’s law. (shrink)

In this paper I discuss some of the criteria that are widely used in the linguistic and philosophical literature to classify an aspect of meaning as either semantic or pragmatic. With regards to the case of scalar implicature (e.g. some Fs are G implying that not all Fs are G), these criteria are not ultimately conclusive, either in the results of their application, or in the interpretation of the results with regards to the semantics/pragmatics distinction (or in both). I (...) propose a psychologically relevant criterion, that of the primary or secondary role of context. This criterion applies to sub-personal processes that derive the interpretation of a scalar term rather than to the eventual interpretation of the term, and there exist well-established experimental paradigms that can generate quantitative data. I present recent studies on scalar implicature which employ such off-line and real-time paradigms, aiming to demonstrate how research on the semantics/pragmatics distinction can benefit from experimental investigation. Our position is critical of the dominant method in psychology, and critical of the social use of psychological models. We assert that the scientific approach in psychology must break with modernist claim, but without sinking into post-modernist relativism. We consider that the epistemology associated with experimental psychology should be a specific epistemology associated with the particular objects studied. By calling on pragmatism and realism, psychology can find the resources to use quantitative studies as an action deployed within a complex, (...) interactive and dynamic social space, and thus break with its normative practice and function. The present work constitutes an attempt to make explicit those pragmatic norms successfully operating in empirical science. I will first comment on the initial presuppositions of the discussion, in particular, on those concerning the instrumental character of scientific practice and the nature of scientific goals. Then I will depict the moderately naturalistic frame in which, from this approach, the pragmatic norms make sense. Third, I will focus on the specificity of the pragmatic norms, making special emphasis on what I regard (...) as a key idea underlying them, namely, the view, vigorously advocated by classical pragmatists like C. S. Peirce and G. Vailati, that the best test for objectivity is the test of action. Finally, I am going to put forward a tentative list of pragmatic norms that can be abstracted from a careful observation and analysis of scientific practice as provided by current philosophers of experimentation (A. Franklin and F. Steinle among others). The norms will be divided into four classes corresponding to four aspects of science in which they rule, that is, self-correction, prediction, explanation and both experimentation and computation. In the following account, the formulation of those pragmatic norms successfully governing science will be understood as a contribution that scientifically-oriented pragmatism can make to the normative naturalistic project in epistemology. Cognitive science is experiencing a pragmatic turn away from the traditional representation-centered framework toward a view that focuses on understanding cognition as "enactive." This enactive view holds that cognition does not produce models of the world but rather subserves action as it is grounded in sensorimotor skills. In this volume, experts from cognitive science, neuroscience, psychology, robotics, and philosophy of mind assess the foundations and implications of a novel action-oriented view of cognition. In this article, I propose a business paradigm that allows and enables the integration of environmental ethics into business decisions while creating a competitive advantage through the use of an ethical framework based on classical American pragmatism. Environmental ethics could be useful as an alternative paradigm for business ethics by offering new perspectives and methodologies to grant consideration of the natural environment. Experimental Semiotics (ES) is the study of novel forms of communication that communicators develop in laboratory tasks whose designs prevent them from using language. Thus, ES relates to pragmatics in a “pure,” radical sense, capturing the process of creating the relation between signs and their interpreters as biological, psychological, and social agents. Since such a creation of meaning-making from scratch is of central importance to language evolution research, ES has become the most prolific experimental approach in this (...) field of research. In our paper, we report the results of a study on the scope of recent ES and evaluate the ways in which it is relevant to the study of language origins. We coded for multiple levels across 13 dimensions related to the properties of the emergent communication systems or properties of the study designs, such as type of goal (coordination versus referential), modality of communication, absence or presence of turn-taking, or the presence of vertical vs. horizontal transmission. We discuss our findings and our classification, focusing on the advantages and limitations of those trends in ES, and in particular their ecological validity in the context of bootstrapping communication and the evolution of language. This paper provides new tools for philosophical argument analysis and fresh empirical foundations for ‘critical’ ordinary language philosophy. Language comprehension routinely involves stereotypical inferences with contextual defeaters. J.L. Austin’s Sense and Sensibilia first mooted the idea that contextually inappropriate stereotypical inferences from verbal case-descriptions drive some philosophical paradoxes; these engender philosophical problems that can be resolved by exposing the underlying fallacies. We build on psycholinguistic research on salience effects to explain when and why even perfectly competent speakers cannot help making (...) stereotypical inferences which are contextually inappropriate. We analyse a classical paradox about perception, suggest it relies on contextually inappropriate stereotypical inferences from appearance-verbs, and show that the conditions we identified as leading to contextually inappropriate stereotypical inferences are met in formulations of the paradox. Three experiments use a forced-choice plausibility-ranking task to document the predicted inappropriate inferences, in English, German, and Japanese. The cross-linguistic study allows us to assess the wider relevance of the proposed analysis. Our findings open up new perspectives for ‘evidential’ experimental philosophy. (shrink)

Experimental data are often acclaimed on the grounds that they can be consistently generated. They are, it is said, reproducible. In this paper I describe how this feature of experimental-data (their pragmatic reliability) leads to their epistemic worth (their epistemic reliability). An important part of my description is the supposition that experimental procedures are to certain extent fixed and stable. This essay argues that to understand Dewey's vision of democracy as “epistemic” requires consideration of how experiential and communal aspects of inquiry together produce what is named here “pragmatic objectivity.” Such pragmatic objectivity provides an alternative to absolutism and self-interested relativism by appealing to certain norms of empirical experimentation. Pragmatic objectivity, it is then argued, can be justified by appeal to Dewey's conception of primary experience. This justification, however, is not without its own complications, which are highlighted with objections regarding (...) “radical pluralism” in political life, and some logical problems that arise due to the supposedly “ineffable” nature of primary experience. The essay concludes by admitting that while Dewey's theory of democracy based on experience cannot answer all of the objections argumentatively, it nevertheless provides potent suggestions for how consensus building can proceed without such philosophical arguments. ABSTRACT In Philosophy Within its Proper Bounds, Édouard Machery argues that the results of experimental philosophy should lead us to abandon much of traditional philosophical practice. In its place Machery defends naturalized conceptual analysis as a more modest and pragmatic alternative to standard analytic philosophy. This paper argues that Machery overstates the metaphilosophical significance of x-phi’s results. We can and should keep many of the insights and good methodological habits that come with x-phi. However, if one is not already (...) convinced of pragmatism or naturalism, the discoveries of x-phi are unlikely to make too much difference to one’s metaphilosophical position. (shrink)

Amidst long-running debates within the field, high energy physics has adopted a statistical methodology that primarily employs standard frequentist techniques such as significance testing and confidence interval estimation, but incorporates Bayesian methods for limited purposes. The discovery of the Higgs boson has drawn increased attention to the statistical methods employed within HEP. Here I argue that the warrant for the practice in HEP of relying primarily on frequentist methods can best be understood as pragmatic, in the sense that statistical methods (...) are chosen for their suitability for the practical demands of experimental HEP, rather than reflecting a commitment to a particular epistemic framework. In particular, I argue that understanding the statistical methodology of HEP through the perspective of pragmatism clarifies the role of and rationale for significance testing in the search for new phenomena such as the Higgs boson. Citing some recent experimental findings, I argue for the surprising claim that in some cases the less time you have the more you know. More specifically, I present some evidence to suggest that our ordinary knowledge ascriptions are sometimes sensitive to facts about an epistemic subject's truth-irrelevant time constraints such that less is more. If knowledge ascriptions are sensitive in this manner, then this is some evidence of pragmatic encroachment. Along the way, I consider comments made by Jonathan Schaffer (...) and Jennifer Nagel to construe a purist contextualist and a strict invariantist explanation of the data respectively, before giving reasons to resist them in favor of an account that indicates pragmatic encroachment. If successful, this may suggest a new way to argue for the controversial thesis that there is pragmatic encroachment on knowledge. (shrink)

This book explores new territory at the interface between semantics and pragmatics, reassessing a number of linguistic phenomena in the light of recent advances in pragmatic theory and presenting stimulating insights by experts in linguistics and philosophy. The authors begin by reassessing the definition of four theoretical concepts: saturation, free pragmatic enrichment, completion and expansion. They go on to confront disciplines that have addressed similar issues but that have not necessarily been in close contact, and then turn to questions (...) related to reported speech, modality, indirect requests and prosody. Chapters investigate lexical pragmatics and lexical semantics and other interactions involving experimental pragmatics, construction grammar, clinical linguistics, and the distinction between mental and linguistic content. The authors bridge the gap between different disciplines, subdisciplines and methodologies, supporting cross-fertilization of ideas and indicating the empirical studies that are needed to test current theoretical concepts and push the theory further. Readers will find overviews of the ways in which concepts are defined, empirical data with which they are illustrated and explorations of the theoretical frameworks in which concepts are couched. This exciting exchange of ideas has its origins in the editors’ workshop series on the theme ‘The semantics/pragmatics interface: linguistic, logical and philosophical perspectives’, held at the University of Lille 3 in 2012-13. Scholars of linguistics, logic and philosophy and those interested in the research benefits of crossing disciplines will find this work both accessible and thought-provoking, especially those with an interest in pragmatic theory or semantics. Among the readings available for NL sentences, those where two or more sets of entities are independent of one another are particularly challenging from both a theoretical and an empirical point of view. Those readings are termed here as ‘Independent Set (IS) readings'. Standard examples of such readings are the well-known Collective and Cumulative Readings. (Robaldo, 2011) proposes a logical framework that can properly represent the meaning of IS readings in terms of a set-Skolemization of the witness sets. One of (...) the main assumptions of Robaldo's logical framework, drawn from (Schwarzschild, 1996), is that pragmatics plays a crucial role in the identification of such witness sets. Those are firstly identified on pragmatic grounds, then logical clauses are asserted on them in order to trigger the appropriate inferences. In this paper, we present the results of an experimental analysis that appears to confirm Robaldo's hypotheses concerning the pragmatic identification of the witness sets. (shrink)

This paper introduces pragmatic hypotheses and relates this concept to the spiral of scientific evolution. Previous works determined a characterization of logically consistent statistical hypothesis tests and showed that the modal operators obtained from this test can be represented in the hexagon of oppositions. However, despite the importance of precise hypothesis in science, they cannot be accepted by logically consistent tests. Here, we show that this dilemma can be overcome by the use of pragmatic versions of precise hypotheses. These pragmatic (...) versions allow a level of imprecision in the hypothesis that is small relative to other experimental conditions. The introduction of pragmatic hypotheses allows the evolution of scientific theories based on statistical hypothesis testing to be interpreted using the narratological structure of hexagonal spirals, as defined by Pierre Gallais. Despite quantum theory’s remarkable success at predicting the statistical results of experiments, many philosophers worry that it nonetheless lacks some crucial connection between theory and experiment. Such worries constitute the Quantum Measurement Problems. One can broadly identify two kinds of worries: (1) pragmatic: it is unclear how to model our measurement processes in order to extract experimental predictions, and (2) realist: we lack a satisfying metaphysical account of measurement processes. While both issues deserve attention, the pragmatic worries have worse (...) consequences if left unanswered: If our pragmatic theory-to-experiment linkage is unsatisfactory, then quantum theory is at risk of losing both its evidential support and its physical salience. Avoiding these risks is at the core of what I will call the Pragmatic Measurement Problem. Fortunately, the pragmatic measurement problem is not too difficult to solve. For non-relativistic quantum theory, the story goes roughly as follows: One can model each of quantum theory’s key experimental successes on a case-by-case basis by using a measurement chain. In modeling this measurement chain, it is pragmatically necessary to switch from using a quantum model to a classical model at some point. That is, it is pragmatically necessary to invoke a Heisenberg cut at some point along the measurement chain. Past this case-by-case measurement framework, one can then strive for a wide-scoping measurement theory capable of modeling all (or nearly all) possible measurement processes. For non-relativistic quantum theory, this leads us to our usual projective measurement theory. As a bonus, proceeding this way also gives us an empirically meaningful characterization of the theory’s observables as (positive) self-adjoint operators. But how does this story have to change when we move into the context of quantum field theory (QFT)? It is well known that in QFT almost all localized projective measurements violate causality, allowing for faster-than-light signaling; These are Sorkin’s impossible measurements. Thus, the story of measurement in QFT cannot end as it did before with a projective measurement theory. But does this then mean that we need to radically rethink the way we model measurement processes in QFT? Are our current experimental practices somehow misguided? Fortunately not. I will argue that (once properly understood) our old approach to modeling quantum measurements is still applicable in QFT contexts. We ought to first use measurement chains to build up a case-by-case measurement framework for QFT. Modeling these measurement chains will require us to invoke what I will call a QFT-cut. That is, at some point along the measurement chain we must switch from using a QFT model to a non-QFT model. Past this case-by-case measurement framework, we can then strive for both a new wide-scoping measurement theory for QFT and an empirically meaningful characterization of its observables. It is at this point that significantly more theoretical work is needed. This paper ends by briefly reviewing the state of the art in the physics literature regarding the modeling of measurement processes involving quantum fields. (shrink)

This book examines the ways in which religious communities experimentally engage the world and function as fallible inquisitive agents, despite frequent protests to the contrary. Using the philosophy of inquiry and semiotics of Charles Sanders Peirce, it develops unique naturalist conceptions of religious meaning and ultimate orientation while also arguing for a reappraisal of the ways in which the world’s venerable religious traditions enable novel forms of communal inquiry into what Peirce termed “vital matters.” Pragmatic inquiry, it argues, is a (...) ubiquitous and continuous phenomenon. Thus, religious participation, though cautiously conservative in many ways, is best understood as a variety of inhabited experimentation. Religious communities embody historically mediated hypotheses about how best to engage the world and curate networks of semiotic resources for rendering those engagements meaningful. Religions best fulfill their inquisitive function when they both deploy and reform their sign systems as they learn better to engage reality. (shrink)

In the study of reference assignment, the question of what pragmatic criteria are used to evaluate the resulting interpretation seems not yet to have been properly dealt with. This paper addresses the issue by examining factors which affect the acceptability of various cases of bridging reference. It demonstrates that even highly successful accounts of reference assignment which place major emphasis on accessibility factors, e.g. the accessibility of candidate referents and the accessibility of contextual assumptions, must nonetheless involve some pragmatic criterion (...) with which hearers can evaluate the resulting interpretation. Moreover, it argues that the pragmatic criterion used in reference assignment is not the truth-based one, which has been widely accepted, but the criterion of consistency with the principle of relevance proposed by Sperber and Wilson. Various accounts are tested against a wide range of examples on which I have conducted experimental tests with several sets of subjects. (shrink)

One prominent argument for pragmatic encroachment (PE) is that PE is entailed by a combination of a principle that states that knowledge warrants proper practical reasoning, and judgments that it is more difficult to reason well when the stakes go up. I argue here that this argument is unsuccessful. One problem is that empirical tests concerning knowledge judgments in high-stakes situations only sometimes exhibit the result predicted by PE. I argue here that those judgments that appear to support PE are (...) better interpreted not as judgments that the epistemic demands for knowing increase as one’s practical situation becomes more demanding, but instead as judgments reflecting a different kind of normative epistemic evaluation, namely whether one is acting in an epistemically responsible way. The general idea is that when someone treats a proposition as a reason for acting we can evaluate them epistemically both in terms of whether they know that proposition, as well as in terms of whether they are acting on their knowledge in the right kind of way. My charge against the PE proponent, then, is that she is interpreting judgments that are indicative of whether we are adhering to certain normative epistemic requirements generally as being indicative of whether we have knowledge specifically. There are, however, normative epistemic requirements that make demands of us that are indicative of something other than our possession of knowledge. (shrink)

ABSTRACTJacques Rohault is often considered to be one of the most meticulous followers of Descartes. Despite this, Rohault’s natural philosophy lacks much of the metaphysical bulwark that typifies Cartesian treatises of the seventeenth century. Instead, Rohault’s work, as well as his popular weekly meetings, strongly emphasized rigorous observation and experimentation. Traditionally, this emphasis on experiment over metaphysics is seen as a pragmatic omission to avoid the perils associated with censorship and Cartesian metaphysics. Language pragmatics is applied to analyse problem statements and instructions used in a few influential experimental tasks in the psychology of reasoning. This analysis aims to determine the interpretation of the task which the participant is likely to construct. It is applied to studies of deduction (where the interpretation of quantifiers and connectives is crucial) and to studies of inclusion judgment and probabilistic judgment. It is shown that the interpretation of the problem statements or even the representation of (...) the task as a whole often turn out to differ from the experimenter's assumptions. This has serious consequences for the validity of these experimental results and therefore for the claims about human irrationality based on them. (shrink)

The poor performances of typically developing children younger than 4 in the first-order false-belief task “Maxi and the chocolate” is analyzed from the perspective of conversational pragmatics. An ambiguous question asked by an adult experimenter (perceived as a teacher) can receive different interpretations based on a search for relevance, by which children according to their age attribute different intentions to the questioner, within the limits of their own meta-cognitive knowledge. The adult experimenter tells the child the following story of (...) object-transfer: “Maxi puts his chocolate into the green cupboard before going out to play. In his absence, his mother moves the chocolate from the green cupboard to the blue one.” The child must then predict where Maxi will pick up the chocolate when he returns. To the child, the question from an adult (a knowledgeable person) may seem surprising and can be understood as a question of his own knowledge of the world, rather than on Maxi's mental representations. In our study, without any modification of the initial task, we disambiguate the context of the question by (1) replacing the adult experimenter with a humanoid robot presented as “ignorant” and “slow” but trying to learn and (2) placing the child in the role of a “mentor” (the knowledgeable person). Sixty-two typical children of 3 years-old completed the first-order false belief task “Maxi and the chocolate,” either with a human or with a robot. Results revealed a significantly higher success rate in the robot condition than in the human condition. Thus, young children seem to fail because of the pragmatic difficulty of the first-order task, which causes a difference of interpretation between the young child and the experimenter. (shrink)

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This (...) dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil. (shrink)

In order to investigate whether addressees can make immediate use of speaker‐based constraints during reference resolution, participant addressees' eye movements were monitored as they helped a confederate cook follow a recipe. Objects were located in the helper's area, which the cook could not reach, and the cook's area, which both could reach. Critical referring expressions matched one object (helper's area) or two objects (helper's and cook's areas), and were produced when the cook's hands were empty or full, which defined the (...) cook's reaching ability constraints. Helper's first and total fixations showed that they restricted their domain of interpretation to their own objects when the cook's hands were empty, and widened it to include the cook's objects only when the cook's hands were full. These results demonstrate that addressees can quickly take into account task‐relevant constraints to restrict their referential domain to referents that are plausible given the speaker's goals and constraints. This paper trials new experimental methods for the analysis of natural language reasoning and the development of critical ordinary language philosophy in the wake of J.L. Austin. Philosophical arguments and thought experiments are strongly shaped by default pragmatic inferences, including stereotypical inferences. Austin suggested that contextually inappropriate stereotypical inferences are at the root of some philosophical paradoxes and problems, and that these can be resolved by exposing those verbal fallacies. This paper builds on recent efforts to empirically document inappropriate (...) stereotypical inferences that may drive philosophical arguments. We demonstrate that previously employed questionnaire-based output measures do not suffice to exclude relevant confounds. We then report an experiment that combines reading time measurements with plausibility ratings. The study seeks to provide evidence of inappropriate stereotypical inferences from appearance verbs that have been suggested to lie at the root of the influential ‘argument from illusion’. Our findings support a diagnostic reconstruction of this argument. They provide the missing component for proof of concept for an experimental implementation of critical ordinary language philosophy that is in line with the ambitions of current ‘evidential’ experimental philosophy. It has historically been assumed that comparative and superlative quantifiers can be semantically analysed in accordance with their core logical–mathematical properties. However, recent theoretical and experimental work has cast doubt on the validity of this assumption. Geurts & Nouwen have claimed that superlative quantifiers possess an additional modal component in their semantics that is absent from comparative quantifiers and that this accounts for the previously neglected differences in usage and interpretation between the two types of quantifier that they identify. (...) Their semantically modal hypothesis has received additional support from empirical investigations. In this article, we further corroborate that superlative quantifiers have additional modal interpretations. However, we propose an alternative analysis, whereby these quantifiers possess the semantics postulated by the classical model and the additional aspects of meaning arise as a consequence of psychological complexity and pragmatic implicature. We explain how this model is consistent with the existing empirical findings. Additionally, we present the findings of four novel experiments that support our model above the semantically modal account. (shrink)
