The use of advanced AI and data-driven automation in the public sector poses several organisational, practical, and ethical challenges. One that is easy to underestimate is automation bias, which, in turn, has underappreciated legal consequences. Automation bias is an attitude in which the operator of an autonomous system will defer to its outputs to the point where the operator overlooks or ignores evidence that the system is failing. The legal problem arises when statutory office-holders (or their employees) either fetter their (...) discretion to in-house algorithms or improperly delegate their discretion to third-party software developers—something automation bias may facilitate. A synthesis of previous research suggests an easy way to mitigate the risks of automation bias and its potential legal ramifications is for those responsible for procurement decisions to adhere to a simple checklist that ensures that the pitfalls of automation are avoided as much as possible. This paper explores ways in which service-learning programs can enhance ethics education in engineering. Service-learning programs combine volunteer work and academic study. The National Society for Professional Engineers (NSPE) and American Society for Civil Engineers (ASCE) codes of ethics explicitly encourage engineers to seek opportunities, beyond their work-related responsibilities, to serve their communities. This paper offers critical reflection on the contemporary tendency to approach health care in instrumentalist terms. Instrumentalism is means-ends rationality. In contemporary society, the instrumentalist attitude is exemplified by the relationship between individual consumer and a provider of goods and services. The problematic nature of this attitude is illustrated by Michael Oakeshott’s conceptions of enterprise association and civil association. Enterprise association is instrumental; civil association is association in terms of an ethically delineated realm of practices. The latter offers (...) a richer ethical conception of the relation between person and society than instrumentalism does. Oakeshott’s conception is further illustrated by reflection on the connection between morality and religion that he explores in an early essay concerning “religious sensibility”. Religious sensibility turns on the acknowledgement of the vulnerability of the self to the vicissitudes of life. This vulnerability cannot be bargained over instrumentally without imperilling the self. Religious sensibility is thus a valuable resource for criticising instrumentalist attitudes. It allows for the cultivation of ethical self-understanding that is essential to comprehending the conditions in virtue of which genuine civil life is possible. These conditions need to be taken into account in health care. Health care is not simply about substantive wants. It also necessarily concerns the universal and constant condition of being prey to illness that is the common lot of all citizens. (shrink)

This study investigated how the social identities assumed by individuals as part of their professional roles influence the nature and use of a range of rationalizations for their corruption or the corrupt acts of others. Thirty senior Indonesian public servants were interviewed about the causes and factors that perpetuated corruption during the Suharto era, and how they rationalized corrupt behavior within the role of being a civil servant. Findings revealed that corruption was routine and embedded in the daily activities (...) and administrative structures of Indonesian public servants. Rationalizing ideologies that supported corruption included a denial of responsibility, social weighting and an appeal to higher loyalties. Central to these rationalizations were explanations around the low levels of civil service salaries, poor accountability, and corrupt leadership at senior levels of the government. However, the expression of these rationalizations varied across three social or role identities of the Indonesian civil servant: the professional civil servant, the collegial civil servant, and the corrupt civil servant. The implications of these findings for interventions in organizations in developing countries are discussed. (shrink)

The magnitude and future importance of some of the problems perceived by society are directly related to the field of the civil engineer, implying an inescapable burden of responsibility for a group whose technical soundness, rational approach and efficiency is highly valued and respected by the citizen. However, the substantial changes in society and in the way it perceives the problems that it considers important call for a thorough (...) review of our structures, both professional and educational; so that our profession, with its undeniable historical prestige, may modernize certain approaches and attitudes in order to continue to be a reliable instrument in the service of society, giving priority from an ethical standpoint to its actions in pursuit of the public good . Foucault makes clear in his later lectures that the notion of parrhesia has a long and varied history, which he merely sketches in his investigations of ancient politics and philosophy. Recent research extends and modifies Foucault’s genealogy of parrhesia as an aspect of the practice of the adviser or counsellor of a monarch or prince, showing how parrhesia informed notions of counsel at other times: in later antiquity, the middle ages as well as early modern Europe. Here we seek to (...) show that the ancient notion of parrhesia reappears as a graft in another domain of modern truth telling: that of bureaucracy in Britain, in the debates over the organisation of the offices of government, with the middle years of the nineteenth century a decisive moment of rupture. We consider the fate of bureaucratic frank counsel in our own era. Interpreters of Foucault’s later lectures on governmentality have analysed the consequences of neoliberal rule for the government of public servants during the era of Margaret Thatcher. Presenting a reappraisal of the era, we show how important counter-discourses also emerged in this era, bringing the ethics of office to the fore, as civil servants argued for the formal codification of bureaucratic ethics, including frank counsel, as they tried to defend their professional ethics. Our discussion therefore addresses a key, early moment in the emergence of the ideal of codifying frank counsel and bureaucratic ethics. We consider the consequences of codification, arguing that a deep ambivalence now characterises the way in which political authorities seek to govern this domain of ethical practice. (shrink)

The paper is devoted to the problem of historical development of university community through the lenses of understanding of university mission. The authors undertake critical reflections of the scheme of evolution of university mission, which was elaborated by American researcher John Scott, as far as add some theoretical and methodological suggestions to this scheme. In this respect, typical for late medieval university mission of teaching and corporate based building of university community in the modern times are supplemented by the mission (...) of research. At the same time, university is incorporated in the system of arising nation-state as a tool for preparation highly-qualified bureaucrats for its apparatus. In postmodern times in the context of globalization and certain emancipation of the university from the state such aspects of university mission as the different forms of civil service or the third mission of university become more and more important. The article explores the impact of civil regulation on the environmental behaviour of SMEs. It shows that although civil regulatory pressures are generally subdued, and that conventional regulation continues to be an important driver of behaviour, there are circumstances where civil pressures nevertheless produce a ‘regulatory’ stimulus. Where they do, it appears that civil regulatory pressures tend to derive from stakeholders pursuing relatively narrow self-interest (rather than public interest) mandates; and they normally target particular issues rather (...) than ‘social responsibility’ in any broad sense. SME responses typically take the form of compliance-reinforcing (rather than beyond compliance) measures. For SMEs, it is suggested that, in some circumstances, civil regulation provides a bespoke regulatory mechanism which is more likely to bring about changes in basic practices on narrow issues. The Internet is used for every conceivable form of communication and it is therefore only natural that it should be used as an infrastructure even for protest and civil disobedience. The technology however brings with it the ability to carry out new forms of protest, in new environments and also involve changed consequences for those involved. This article looks at four criminal activities, which are used as active forms of Internet based protest in use today and analysis these forms (...) in relation to the traditional civil disobedience discourse. The analysis is done by studying four basic criteria (disobedience, civil, non‐violence and justification) found in tradition civil disobedience discourse and observing their applicability in online environments. The purpose of this article is to better understand the political protest activities carried out online and to see whether traditional civil disobedience theory embraces these new forms of political activism. Shortened and moderately revised version of an essay that initially appeared in Murove (ed.) African Ethics (2009). This chapter is a work of applied ethics that aims to provide a convincing comprehensive account of how a government official in a post-independence sub-Saharan country should make decisions about how to allocate goods such as civil service jobs and contracts with private firms. Should such a person refrain from considering any particulars about potential recipients, or might it be (...) appropriate to consider, for example, family membership, party affiliation, race, or revolutionary stature as reasons to benefit certain individuals at some cost to the public? Which of these factors should be considered an unjust or corrupt basis on which to allocate state goods and which should not? Drawing on an African ethic, this chapter answers these questions with what it calls a “moderate partialism,” according to which a government agent may rightly favor at some cost to the public veterans and victims of state injustices, but not those in her family or party. This chapter seeks to provide a new, unified explanation of why characteristically sub-Saharan values permit some forms of partiality, such as the preferential hiring of those who suffered from or struggled against colonialism, but forbid other, nepotist or prebendalist forms of partiality. The new introduction to the second edition of Habits of the Heart is a very helpful reminder of the main points of the first edition. Moreover, it is very useful in situating, indeed resituating the book’s concerns, given the lapse of time since the book’s first appearance. It provides new insights made possible by second thoughts, as well as by the questions and criticisms of others. The problem of individualism and the slackening, not to say refusal, of traditional communal ties, (...) has accelerated in American society since the first writing. We find phenomena such as middle class ‘cocooning,’ as well as an often low grade civil war, let us say the culture wars. There is a widespread disquiet — to the left, to the right, in the anxious middle — about the future direction of society. One thing is noted from the beginning as common across the divisions, namely, a certain view of the economy. Correspondingly, the authors themselves seem more insistent on issues of class than they were previously: “the festering secret that Americans would rather not face.”I will confine myself to two points: first, the issue of economy in terms of more basic metaphysical assumptions in the whole notion of ‘use.’ I will suggest some connections between serviceable disposability and the culture of autonomy, and between these and the equivocal relation to the other that besets the identification of freedom with autonomy. I work towards the question: must not our communal relations to others be placed in a deeply ambivalent position, if economic relations are dominated by serviceable disposability and freedom as autonomy is idolized?Second, I want to remark on how far we dwell in an ethos of will to power of which use and autonomy serve as masks. I must summon to our discussion the roaming, uninterred ghost of Nietzsche. Whence comes the spell that spoils our taste for the good? Whence comes this, this blandness of the good? The issue of nihilism and religion cannot be buried. Is this issue even more urgent than Bellah and his collaborators, in their essential decency, acknowledge? (shrink)

A sympathetic examination of the failure of anti-corruption efforts in contemporary Indonesia. Combining ethnographic fieldwork in the city of Kupang with an acute historical sensibility, Sylvia Tidey shows how good governance initiatives paradoxically perpetuate civil service corruption while also facilitating the emergence of new forms of it. Genetic knowledge is a civil right and a civil obligation. New genetic knowledge in individual health risk prediction and prevention and new pharmacogenetic opportunities for developing more efficacious individualized drugs broaden human and civil rights for better health and health care. Public health policy has yet to develop and provide programs in genetic information and consultation together with other health risk information and health literacy education. Data availability and genetic knowledge will make citizens more competent partners in (...) health risk management. As with all information, abuse and manipulation of genetic information cannot be excluded; but health education as an essential part of public health services will empower citizens to better care for their own and their families health. Existing cultural and ethical principles, laws and regulations need to be reviewed and modified in order to prevent and fight illegal or immoral use of genetic information. It explores the motivations behind greenwashing, which often stem from the pressure to appear environmentally responsible without incurring the costs associated with genuine sustainability. Additionally, the paper addresses the emerging issue of "machinewashing," wherein companies make exaggerated claims about the ethical aspects of their AI technologies. Furthermore, the concept of environmental vices is explored, illustrating how greenwashing perpetuates unethical behaviors and undermines authentic sustainability efforts. To address these practices, the study advocates for a comprehensive approach that includes stricter regulations, increased transparency, and greater engagement from civil society. By promoting genuine sustainability and holding corporations accountable, it is possible to restore consumer trust and support authentic environmental initiatives, thereby fostering a more sustainable and ethical commerce. The diffusion of New Public Management reforms across the globe is based on the assumption of the universal applicability of managerialism, driven by instrumental rationality, individualism, independence and competition. The aim of this article is to challenge this conception and to fill a significant gap in the existing research by analysing potential problems arising from the implementation of the NPM philosophy in non-Western public organisations. In-depth interviews and a large-scale survey were conducted across six public organisations in Thailand based on (...) the Competing Values Framework (CVF). Thematic analysis of the data revealed that the traditional cultural model of the organisations studied was characterised by a combination of hierarchical and clan-based cultures, which remained largely unaltered despite massive-scale reform. The persistence of this hybrid cultural system appears to be rooted in the deep-seated Confucian ethical values governing Thai society, in which the organisations are embedded. Based on the research findings, the paper underlies the importance of a symbolist viewpoint of culture and argues that a rational perspective underpinning a functionalist cultural management must be challenged. Fanny Bré was a volunteer nurse in the International Brigades, who fought in the Spanish Civil War (1936–1939) on the side of the democratically elected Republican government. The objective of this study is to understand the relationship between Bré's antifascist ideas, her conception of care and the activities she carried out in the Spanish hospitals of Casa Roja (Murcia), Villa Paz (Selices, Cuenca) and Vic (Barcelona). We use narrative biography to describe Bré's personal, political and professional trajectory. To do (...) so, we conducted a content analysis of primary sources archived in Spain, Russia and France and secondary sources that emerged from a thorough literature review. We identified three thematic axes: (1) a concept of nursing in the service of the antifascist struggle, (2) nursing activity for high‐quality care and (3) political action for improving hospital organisation and care. The interest of Bré's texts transcends the war in Spain because, in them, Bré questions the neutrality of care by revealing that care can itself be a political act. (shrink)

The idea underlying this article was that the humanities in general and business ethics in particular should be more firmly embedded in business management programs. A number of areas have been identified for students to use as topics for research projects in management ethics. These ranged from Biblical and classical times to the present day. Some were drawn from sources that were less well known e.g. the De consolatione philosphiae ‘The Consolation of Philosophy’ by Boethius 524 AD. This (...) was chosen partly for its ethical content, but also because Boethius was magister officiorum i.e. head of the civil service. Aelfred the Great (849–899) King of Wessex (he who burnt those cakes) was chosen because he promoted the intellectual, moral and spiritual qualities that were to serve as guidelines for his executives. Nineteenth century literature (Dickens, Thackeray, Trollope and Galsworthy) was also chosen as a source of topics for research projects in business ethics. The philosophy of Albert Schweitzer has proved widely influential in modern thinking, especially in the field of ethics. His leading ethical idea can be summarized in the phrase "reverence for life" - namely, that good consists in maintaining and perfecting life, and evil consists in destroying and obstructing life. The concept of community is increasingly the focus of political argument in Britain, the United States and elsewhere around the world. Purpose This paper aims to examine whether there are morally defensible reasons for using or operating websites that offer distributed denial-of-service attacks on a specified target to users for a price. Booters have been linked to some of the most powerful DDoS attacks in recent years. Design/methodology/approach The authors identify the various parties associated with booter websites and the means through which booters operate. Then, the authors present and evaluate the two arguments that they claim may be used to (...) justify operating and using booters: that they are a useful tool for testing the ability of networks and servers to handle heavy traffic, and that they may be used to perform DDoS attacks as a form of civil disobedience on the internet. Findings The authors argue that the characteristics of existing booters disqualify them from being morally justified as network stress testing tools or as a means of performing civil disobedience. The use of botnets that include systems without the permission of their owners undermines the legitimacy of both justifications. While a booter that does not use any third-party systems without permission might in principle be justified under certain conditions, the authors argue that it is unlikely that any existing booters meet these requirements. Practical/implications Law enforcement agencies may use the arguments presented here to justify shutting down the operation of booters, and so reduce the number of DDoS attacks on the internet. Originality/value The value of this work is in critically examining the potential justifications for using and operating booter websites and in further exploring the ethical aspects of using DDoS attacks as a form of civil disobedience. A new model of the public library is outlined that explicitly links it to its role in support of civil society. The model argues that the ongoing “chaining” of public libraries to direct government oversight and control is deleterious to their ability to actualize their potential. Collateral argument is made that that it is the civil society character rather than the simply free nature of these libraries which needs to be harnessed to help move the conceptualization of the (...) sector away from a reactive model of client service toward a dynamic approach that integrates with the life experiences of clients. The conflict of administrative morality among civil servants at the grassroots level arises from the background of China’s long-standing traditional culture, and the current administrative system cannot keep up with the pace of economic development. In the process of grassroots management, due to the lag in the construction of administrative morality, the traditional official standard thinking, the imperfection of the current system, and the restriction of human nature, it is easy to cause the administrative moral conflict of the grassroots (...) civil servants in practice. This paper takes the interpersonal society as the research background, analyzes the influence of the interpersonal society on the environment, and studies the administrative ethics conflicts and governance issues of basic civil servants from the interpersonal background. In addition, this paper conducts a more detailed field investigation based on fuzzy cluster analysis, analyzes the manifestations and causes of the administrative moral conflict of grassroots civil servants in the context of human society from multiple perspectives and levels, and then proposes countermeasures to solve the administrative moral conflict. The administrative moral conflict and governance of grass-roots civil servants under the background of interpersonal relationship is of great positive significance for solving the administrative moral conflict and improving the service awareness and service level of grass-roots civil servants. Since its origins in the mid-1980s, DNA profiling has become the most powerful tool for identification in contemporary society. Practitioners have deployed it to determine parentage, verify claims to identity in various civil contexts, identify bodies in wars and mass disasters, and infer the identity of individuals who have left biological traces at crime scenes. Thus DNA profiling can be used to implicate or exonerate individuals from participation in particular social relations and activities; this affords it a growing importance (...) in major social institutions such as the family, the criminal justice system, immigration services, and health services. There are key state, security, civil liberty, personal, and commercial considerations surrounding the reliability and social implications of DNA profiling in establishing the identities of “family members,” “claimants,” “customers,” “suspects,” and “citizens.”Given that DNA profiling is increasingly influential in forensic inquiries, the recently-developed practice in the UK of “familial searching” of DNA databases has the potential to become a significant aspect of investigations.
